FederalDefinitionHowdoesthestatutedefineacharterschool?
Definitioninsection5210(1)oftheESEA,whichisasfollows:Theterm“charterschool”meansapublicschoolthat:
a) InaccordancewithaspecificStatestatuteauthorizingthegrantingofcharterstoschools,isexemptfromsignificantStateorlocalrulesthatinhibittheflexibleoperationandmanagementofpublicschools,butnotfromanyrulesrelatingtotherequirementsinparagraphs1through12ofthisdefinition;
b) Iscreatedbyadeveloperasapublicschool,orisadaptedbyadeveloperfromanexistingpublicschool,andisoperatedunderpublicsupervisionanddirection;
c) Operatesinpursuitofaspecificsetofeducationalobjectivesdeterminedbytheschool’sdeveloperandagreedtobytheauthorizedpubliccharteringagency;
d) Providesaprogramofelementaryorsecondaryeducation,orboth;e) Isnonsectarianinitsprograms,admissionspolicies,employmentpractices,andallother
operations,andisnotaffiliatedwithasectarianschoolorreligiousinstitution;f) Doesnotchargetuition;g) ComplieswiththeAgeDiscriminationActof1975,titleVIoftheCivilRightsActof1964,
titleIXoftheEducationAmendmentsof1972,section504oftheRehabilitationActof1973,titleIIoftheAmericanswithDisabilitiesActof1990,asamended,andpartBoftheIndividualswithDisabilitiesEducationAct;
h) Isaschooltowhichparentschoosetosendtheirchildren,andthatadmitsstudentsonthebasisofalottery,ifmorestudentsapplyforadmissionthancanbeaccommodated;
i) AgreestocomplywiththesameFederalandStateauditrequirementsasdootherelementaryschoolsandsecondaryschoolsintheState,unlesssuchrequirementsarespecificallywaivedforthepurposeofthisprogram;
j) MeetsallapplicableFederal,State,andlocalhealthandsafetyrequirements;k) OperatesinaccordancewithStatelaw;andl) Hasawrittenperformancecontractwiththeauthorizedpubliccharteringagencyin

(1)A"charterschool"meansapublic,non-religious,non-home‑based,nonprofitcorporationformingaschoolthatoperatesbysponsorshipofapublicschooldistrict,theSouthCarolinaPublicCharterSchoolDistrict,orapublicorindependentinstitutionofhigherlearning,butisaccountabletotheboardoftrustees,orinthecaseoftechnicalcolleges,theareacommission,ofthesponsorwhichgrantsitscharter.Nothinginthischapterprohibitscharterschoolsfromofferingvirtualservicespursuanttostatelawandsubsequentregulationsdefiningvirtualschools.

(2)declinetoapprovecharterapplicationsaccordingtoSection59‑40‑70(C);
(3)negotiateandexecutesoundchartercontractswitheachapprovedcharterschool;
(4)monitor,inaccordancewithchartercontractterms,theperformanceandlegal/fiscalcomplianceofcharterschoolstoincludecollectingandanalyzingdatatosupportongoingevaluationaccordingtothechartercontract;
(5)conductorrequireoversightactivitiesthatenablethesponsortofulfillitsresponsibilitiesoutlinedinthischapter,includingconductingappropriateinquiriesandinvestigations,onlyifthoseactivitiesareconsistentwiththeintentofthischapter,adheretothetermsofthechartercontact,anddonotundulyinhibittheautonomygrantedtopubliccharterschools;
(6)collect,inaccordancewithSection59‑40‑140(H),anannualreportfromeachofitssponsoredcharterschoolsandsubmitthereportstotheDepartmentofEducation;
(7)notifythecharterschoolofperceivedproblemsifitsperformanceorlegalcomplianceappearstobeunsatisfactoryandprovidereasonableopportunityfortheschooltoremedytheproblem,unlesstheproblemwarrantsrevocationandrevocationtimeframesapply;
(8)takeappropriatecorrectiveactionsorexercisesanctionsshortofrevocationinresponsetoapparentdeficienciesincharterschoolperformanceorlegalcompliance.Theseactionsorsanctionsmayincluderequiringaschooltodevelopandexecuteacorrectiveactionplanwithinaspecifiedtimeframe;
(9)determinewhethereachchartercontractmeritsrenewal,nonrenewal,orrevocation;and
(10)providetoparentsandthegeneralpublicinformationaboutcharterschoolsauthorizedbythesponsorasanenrollmentoptionwithinthedistrictinwhichthecharterschoolislocatedtothesameextentandthroughthesamemeansasthedistrictinwhichthecharterschoolislocatedprovidesandpublicizesinformationaboutallpublicschoolsinthedistrict.Acharterschoolshallnotifyitssponsorofitsenrollmentproceduresanddatesofitsenrollmentperiodnolessthansixtydayspriortothefirstdayofitsenrollmentperiod.

ConflictofInterest–Whendoesaboardmemberneedtorecusethemselvesfromdiscussion?
Conflict of Interest Charter schools fall under the State
Ethics Act. Board members who may benefit from an action of the board must recuse themselves from any discussion or vote regarding that action.
Implementation of Conflict of Interest– § When a board member recuses
himself or herself they must do so in writing to the board chair. That should be included with the minutes.
§ They should not be part of the discussion either.
§ It is suggested that they leave the room.

SECTION33‑31‑830.Generalstandardsfordirectors.
(a)Adirectorshalldischargehisdutiesasadirector,includinghisdutiesasamemberofacommittee:
(1)ingoodfaith;
(2)withthecareanordinarilyprudentpersoninalikepositionwouldexerciseundersimilarcircumstances;and
(3)inamannerthedirectorreasonablybelievestobeinthebestinterestsofthecorporation.
(b)Indischarginghisorherduties,adirectorisentitledtorelyoninformation,opinions,reports,orstatements,includingfinancialstatementsandotherfinancialdata,ifpreparedorpresentedby:

(c)Adirectorisnotactingingoodfaithifthedirectorhasknowledgeconcerningthematterinquestionthatmakesrelianceotherwisepermittedbysubsection(b)unwarranted.
(d)Adirectorisnotliabletothecorporation,amember,oranyotherpersonforanyactiontakenornottakenasadirector,ifthedirectoractedincompliancewiththissection.
(e)Adirectorshallnotbedeemedtobeatrusteewithrespecttothecorporationorwithrespecttoanypropertyheldoradministeredbythecorporation,includingwithoutlimit,propertythatmaybesubjecttorestrictionsimposedbythedonorortransferroroftheproperty.
(f)Anactionagainstadirectorassertingthedirector’sfailuretoactincompliancewiththissectionandconsequentliabilitymustbecommencedbeforethesoonerof(i)threeyearsafterthefailurecomplainedofor(ii)twoyearsaftertheharmcomplainedofis,orreasonablyshouldhavebeen,discovered.Thislimitationsperioddoesnotapplyifthefailuretoactincompliancewiththissectionhasbeenfraudulentlyconcealed.

Enrollment Preference:
A charter school must:
(8) not limit or deny admission or show preference in admission decisions to any individual or group of individuals, except in the case of an application to create a single gender charter school, in which case gender may be the only reason to show preference or deny admission to the school; a charter school may give enrollment priority to a sibling of a pupil currently enrolled and attending, or who, within the last six years, attended the school for at least one complete academic year. A public charter school shall give enrollment preference to students enrolled in the public charter school the previous school year. An enrollment preference for returning students excludes those students from entering into a lottery. A charter school also may give priority to children of a charter school employee and children of the charter committee, if priority enrollment for children of employees and of the charter committee does not constitute more than twenty percent of the enrollment of the charter school. In addition, a charter school located on a federal military installation or base where the appropriate authorities have made buildings, facilities, and grounds on the installation or base available for use by the charter school as its principal location also may give enrollment priority to otherwise eligible students who are dependents of military personnel living in military housing on the base or installation or who are currently stationed at the base or installation not to exceed fifty percent of the total enrollment of the charter school. This priority is in addition to the other priorities provided by this item, but no child may be counted more than once for purposes of determining the percentage makeup of each priority;

(H) A charter school shall report to its sponsor and the Department of Education any change to information provided under its application. In addition, a charter school shall report at least annually to its sponsor and the sponsor shall compile those reports into a single document which must be submitted to the department. The Department of Education shall develop a template to be used by charter schools for this annual report. The report shall provide all information required by the sponsor or the department and shall include, at a minimum,:
(1) the number of students enrolled in the charter school from year to year;
(2) the success of students in achieving the specific educational goals for which the charter school was established;
(3) an analysis of achievement gaps among major groupings of students in both proficiency and growth;
(4) the identity and certification status of the teaching staff;
(5) the financial performance and sustainability of the sponsor’s charter schools; and
(6) board performance and stewardship including compliance with applicable laws.
