Superintendents the recruitment material created for TVHS that should better fit the incoming students to the school. He plans to present it to the board at next month’s meeting.

attention of the board and reported that all future policies would also be made available to them as these are important.

BOARD REPORTS / DISCUSSION Member Garland commented on Matt’s visit to Cairo-Durham’s Board of

Education meeting, stating that he did a great job in Dr. Cruz’s absence. On the same note, several board members also complimented the visits made by Dr. Cruz and Matt Sloane to our districts, stating that they are widely well received and important that we maintain that relationship with the components to address their needs and interests as a BOCES.

EXECUTIVE OFFICER’S REPORT Dr. Gladys I. Cruz began by informing the board members that the Office of the

State Comptroller Audit has been completed and she’s been informed that the report will indicate a “no findings” status. She thanked Harry Hadjioannou, Julie Best and Jennifer Mulligan for their time, diligence and efforts in providing the necessary information to the auditor for him to complete his work, and commended the controls and protocols that are in place.

Dr. Cruz also thanked the Board Members for their attendance to the component Board meeting visits. She said their participation is extremely valuable and meaningful to our districts.

Dr. Cruz closed by reporting that she continues to attend our building faculty and department staff meetings.

CONCUSSION MANAGEMENT

1. Statement of Purpose

The Board of Education recognizes that concussions and head injuries are the most commonly reported injuries in children and adolescents who participate in physical education and recreational activities. Concussions can impact a student’s academic success as well as athletic pursuits. The Board adopts this policy to support the proper evaluation and management of concussion injuries in order to support student success.

2. Definition

A concussion is a mild traumatic brain injury (MTBI). A concussion occurs when normal brain functioning is disrupted by a blow or jolt to any portion of the head or body that causes the head and brain to move rapidly back and forth. Recovery from concussion and its symptoms will vary. Avoiding re-injury and over-exertion until fully recovered are the cornerstones of proper concussion management.

3. Staff Training

Questar III physical education teachers and school nurses will complete a course of instruction every two (2) years relating to recognizing the symptoms of concussions or MTBIs and monitoring and seeking proper medical attention for students who suffer from concussion or MTBI.

The course can be completed by any means of instruction as approved by the New York State Education Department including but not limited to courses provided online or by teleconference. Training shall include:

The definition of MTBI; Signs and symptoms of MTBI; How MTBIs may occur; Practices regarding prevention; and Guidelines for the return to school and school activities for a student who has

suffered a MTBI, even if the injury occurred outside of school.

4. Identifying Concussion and Removal from Physical Activities

Any student who has sustained, or is suspected of having sustained, a MTBI or concussion shall be removed from organized physical activities during school including but not limited to OT/PT, physical education class, and recess. A student

demonstrating signs, symptoms or behaviors consistent with a concussion while participating in a class or extracurricular activity shall be removed from the class, game, or activity and must be evaluated as soon as possible by a building nurse or other appropriate health care professional.

Students may exhibit concussion symptoms caused by injuries sustained outside of school. Removal from physical activities at school must occur based on display of symptoms or reported symptoms regardless of whether such injury occurred inside or outside of school. If there is doubt as to whether the student has sustained a concussion, it shall be presumed until proven otherwise.

The District Superintendent or his/her designee shall establish protocols for evaluating students who are suspected of having sustained a MTBI or concussion and notifying the student’s parents/guardians, emergency providers where appropriate, and the student’s home school district’s nurse.

5. Return to School Physical Activities

A student shall not return to organized physical activity until he/she has been symptom-free for not less than twenty-four (24) hours and has been evaluated by and received written authorization from a licensed physician. The standards for return to physical activity will also apply to concussion sustained outside of school. In accordance with the Commissioner’s regulations, all such authorizations shall be kept on file in the student’s permanent health record.

Questar III staff will follow any directives issued by the student’s treating physician regarding return to physical activities, with or without limitations or restrictions.

Questar III reserves the ability to direct re-evaluation of the student by the Questar III physician for return to activities upon recommendation of the school nurse.

6. Periodic Review and Regulations

This policy may be reviewed periodically by Questar III staff for continued compliance with NYSED requirements. Amendments may be recommended to the Board.

The District Superintendent may adopt and update regulations to implement the policy as necessary or desirable.

CONCUSSION MANAGEMENT REGULATIONS

1. Questar III staff may become aware that a student has suffered or may have suffered MTBI or concussion in a variety of ways:

Staff member observes a student injured during school; Staff member observes a student exhibit signs of concussion; Student reports to staff member that he/she was injured outside of school; Parent/guardian reports to staff that student was injured outside of school; or Student’s home school district reports to Questar III staff that student was injured

during activities at home school.

Questar III staff shall respond to a student’s suspected or known MTBI or concussion in accordance with the Concussion Management policy and protocols in all such instances.

2. In the event a student is injured while at Questar III, a student reports injury outside of school to a staff member, or a student exhibits signs of concussion, the student shall be referred as soon as possible to the school nurse. The school nurse shall complete the “Concussion Checklist Form” during evaluation of student. Where appropriate, the parents/guardians shall be notified and the home school district nurse shall be notified. Where appropriate, emergency responders will be called.

3. Questar III staff who observe a student injured while at Questar III (whether or not there is suspicion of concussion) shall complete the Student Injury form.

4. On occasion a parent/guardian and/or home school district may report to Questar III staff that a student was injured outside of school or during activities at the home school. In such instances, Questar III will still follow the “Return to Physical Activities” protocols set forth in the Questar III Concussion Management Policy.

Compensation Plan for Employees Not Affiliated with

a Bargaining Unit The Questar III Policy on Staff Recruitment and Retention reads as follows:

As a learning organization, Questar III is dedicated to recruiting, hiring and retaining employees who are not only well qualified for their positions but are committed to being lifelong learners, who desire to become experts within their fields and who understand the mission and goals of Questar III. Questar III strives to create a work environment that fosters performance and organizational identity.

Consistent with this policy, there is a desire to promulgate a compensation plan for non-represented employees that would consider agency goals, the fiscal condition of the agency and its component school districts; recruitment and retention prospects and market conditions for the various positions included in this plan. This plan maintains necessary and appropriate flexibility while providing guidance concerning salary decisions. It provides for equity and fairness in the compensation of our employees. Salaries of Questar III non-represented employees are determined annually, consistent with salary ranges adopted by the Questar III Board. This plan provides for performance-based compensation that incorporates the use of a salary grade-level structure similar to other public agencies. The critical elements are: base salary, cost of living adjustments, performance based compensation within the grade, bonus compensation based on exceptional performance and promotional increases. Base Salary Base salary is the rate of compensation provided in the approved schedule beginning with a hiring rate and culminating in a job rate for a position. Base salary schedules establish ranges beginning with a hiring rate and a job rate (the top level pay for the position on the schedule) for each salary grade. The proposed position grade levels and respective ranges are provided in Appendix A. This is not a traditional “step” schedule. Position grade level ranges for each non-represented title have been established as indicated. Titles have been assigned grade levels based upon authority, responsibilities and qualifications / expertise required for the position.

Hiring rates for all positions are subject to review and approval by the director of human resources prior to an offer of employment being made on behalf of Questar III. Such rates and offers of employment are further subject to approval of and recommendation by the district superintendent to the Questar III Board (per Board policy 5-120) for adoption. A new employee may be recommended for a starting salary beyond the hiring rate based upon relevant work experience and other factors as determined by the supervising administrator, director of human resources and the district superintendent. Examples of other factors influencing starting salary could be length of relevant work experience, specialized training / education qualifications and difficulty or ease of recruiting and retaining qualified, eligible candidates for the position. Except for some of those positions classified as Supervisors of Non-Instructional Personnel (SNIP) and M/C Administrative Assistant, most of the titles within the non-represented employee group are considered exempt from the Fair Labor Standards Act and are therefore not eligible for overtime. Those that are eligible for overtime payment are identified as such and treated accordingly. Assistant and Deputy Superintendent positions are not included in the schedule. The salary for these positions will be set at the sole discretion of the board upon recommendation of the district superintendent and under no circumstance will salary for these positions exceed 98% of the district superintendents combined state and Questar III salary. The district superintendent compensation is established pursuant to contract with the Board. Salary Increases Within the ranges provided in the salary schedule, cost of living and merit (performance) increases will be considered based upon the following:

a) Satisfactory (‘effective or highly effective’) performance as indicated by the employee evaluation, b) Supervisor recommendation and c) Approval of the district superintendent in the form of a recommendation to the Board for a change in salary.

In situations where an employee is considered ‘developing’ a recommendation for a cost of living adjustment may be considered. Employees rated ineffective or unsatisfactory shall not be eligible for salary increases. The director of human resources will compile performance evaluation data and identify those employees eligible for cost of living adjustments, merit increases or both. Bonuses for Exceptional Performance Bonuses may be awarded to recognize and reward exceptional performance for those employees rated highly effective.

Exceptional performance is an extraordinary and significant contribution(s) to the agency, its students and clients. It may include the assumption of significant additional responsibilities that are otherwise uncompensated. A bonus would take the form of a single payment. The district superintendent shall submit written justifications for such payments. The amount of such bonus shall not exceed $2,000 per year for any single employee. Under no circumstance shall bonuses be paid to probationary employees or those with less than a rating of highly effective. Promotional Increases A promotional increase is one where the employee is being recommended for a new salary based upon a move to a higher-level position within the agency or progress on an approved career ladder. The amount of a promotional increase is based upon the hiring rate of the new position, taking into account relevant work experience and other factors as determined by the supervising administrator, director of human resources and the district superintendent. Examples of other factors influencing a promotional increase could be length of relevant work experience, specialized training / education qualifications and difficulty or ease of recruiting and retaining qualified, eligible candidates for the position. Employees near, at or above job rates Every attempt has been made to consider current staff salaries when establishing salary grade ranges. However, over the course of time, because of the longevity of some staff or other reasons (such as being hired at a salary that was at the top of the range), there may be those who are near, at or above the job rate for the position they hold. Employees in this category shall be ‘grandfathered’ into the salary plan and any increase in salary will be based upon cost of living factors or supervisor recommendations tied to performance and retention. When a “grandfathered” position becomes vacant it will be reassessed and assigned a position grade level consistent with applicable criteria.

Performance Evaluation Rubrics Questar III uses a variety of performance evaluation rubrics designed to foster comparable rigor and developmental opportunities for employees in this class.

Principals are evaluated using the McRel performance evaluation rubric as provided in the BOCES’ approved APPR plan.

Other employees are evaluated using a Questar III developed performance

evaluation rubric(s). The Questar III developed rubric is consistent with agency values, strategic plan, professional development objectives, and mutually agreed upon action plans between supervisors and employees. The rubric addresses core competencies, essential skills and knowledge, as well as developmental and professional goals. It encourages a developmental approach with dialogue and feedback concerning employee performance. Salary Range Review and Grade Level Updates The salary plan provided herein shall be reviewed at least every two years to ensure continuing alignment with agency needs, economic or market conditions and recruitment / retention needs. The human resources department will undertake this review and make recommendations to the district superintendent who shall determine whether to make recommendations to the Board for any adjustments. The scope of this review shall include: salary data of component school districts, other BOCES in the region and relevant market data regarding positions that are similar in nature. The Board reserves the right to adjust this plan or any part thereof at its sole discretion based upon a recommendation from the district superintendent. Other Considerations Employees that are hired after January 1 of a school year are not eligible for salary adjustment until the following school year commencing in the following calendar year. All employees will receive an annual notice of their total compensation that will include salary and all benefit costs paid by Questar III, such as health and dental insurance, pension and any other fringe benefits. New positions created in this class will be assigned a position grade level with applicable salary ranges upon creation.
