    of the Under Secretary to Govt. (AR Wing), Chief Secretariat,

    Puducherry.

    Consequent to the out-of-court settlement reached between the Government

    of Puducherry and the Puducherry Executive & Technical Officers Association,

    Puducherry and Puducherry Stenographers Welfare Association, Puducherry the

    SLP (Civil) Nos. 25025 & 25026/2013 and SLP (Civil) Nos. 34171 & 35570/2013

    filed by the said Associations challenging the amalgamation of the posts of

    Superintendent Gr-II and Gr-I as Superintendent with effect from 01.01.1996 vide

    G.O.Ms.No.106, dated 07.01.2006 of DP&AR(PW), Puducherry, have been disposed

    by the Hon'ble Supreme Court of India vide Order dated 09.01.2015, as follows:

    "We dispose these petitions in terms of the settlement arrivedat between the parties and terms and conditions of the

    settlement shall form part and parcel of this order".

    2. Among other things in the terms of agreement, it has been agreed by

    the Government that the post of Assistant equivalent to the number of posts in the

    Superintendent cadre that are proposed to be diverted to Stenographer would be

    upgraded as Superintendent after identification of suitable posts of Assistant with

    the approval of Competent Authority. It is pointed out that as per the agreement,

    this Department promoted 31 Stenographers Gr-I (Erstwhile Stenographer Gr-II) as

    Superintendent on ad-hoc basis vide Memorandum dated 24.03.2015 after

    obtaining approval of the Competent Authority viz. the Lieutenant Governor,

    Puducherry.

    3. Hence, as per the terms of agreement, 31 posts of Assistant are to be

    upgraded as Superintendent. Since the post of Assistant being an essential one to

    an organization, consequential upgradation of 31 posts of UDC as Assistant is also

    necessitated.

    4. Accordingly, sanction of the Lieutenant Governor, Puducherry is hereby

    accorded to the upgradation of thirty one posts of Assistant (PB-2 Z9300-34800 +

    GP Z4200) as Superintendent (PB-2 Z9300-34800 + GP Z4600) and thirty one posts

    of Upper Division Clerk (PB-1 Z5200-20200 + GP Z2400) as Assistant (PB-2 Z9300-

    34800 + GP Z4200) in various Departments as detailed in the Annexure-I & II and

    as approved by the Work Study Group under the Chairmanship of Chief Secretary,

    Puducherry vide I.D Note read above.

    5. This order takes immediate effect and the posts will stand operated with

    effect from the date when they are filled up.

    6. The expenditure shall be debitable to the same Head of Accounts to which

    hitherto debited.

    7. This issues with the concurrence of the Finance Department vide I.D. Note

    No. 903/FD/F3/2015, dated 07.12.2015.
