Description: Recent changes to the Ohio Rules of Professional Conduct mandate that attorneys become knowledgeable of current technology. Perhaps the biggest challenge to attorneys with regard to data and digital evidence is a failure to remain competent in an electronic environment. Challenges to the eDiscovery process will be discussed.

Description: This training event will outline the particular ways that lawyers are distracted from making good decisions for their clients. Clients retain lawyers for their good judgment and decision-making ability based on the law. A growing body of research indicates that good decisions are not purely rational. Seminar attendees will be trained on how to understand the components of a good decision and the factors that can impair their ability to make excellent decisions for their clients. Attendees will also learn about the common decision-making errors that can affect judgment. One variable is the over-abundance of available information. Lawyers are inundated with information—too much information can impair a lawyer’s attention and ability to focus on client needs. Many factors play into fraudulent behavior, but self-deception (justification or rationalization) is one of the central components. Lawyers will learn the factors that contribute to the slippery slope of fraudulent behavior and how to prevent it. Finally, attendees will learn about one particular distraction—alcohol—and its effect on judgment, self-restraint, and self-deception.
