AN ORDINANCE OF THE CITY OF ENCINITAS, CALIFORNIACALIFORNIA AMENDING ENCINITAS MUNICIPAL CODE CHAPTER 14.42 RELATED TO PARKING VIOLATION ENFORCEMENT

This ordinance will correct a discrepancy regarding the Parking Penalty for two code sections. EMC Section 14.40.125 regulates two-hour parking in business districts when signs are posted. EMC Section 14.40.055 regulates violations of signs posted for one-hour parking. This ordinance will change the fines to $45.

In addition, a policy change regarding handicapped parking citations; CVC Section 22507.8 allows fines to be issued to vehicles parked in disabled parking spaces without displaying the proper disabled placard. The proposed parking penalty for such a ticket is $345. At times, a disabled individual may neglect to either bring or neglect to display the identifying placard resulting in the issuance of a citation. CVC Section 40226 allows jurisdictions to charge an administrative fee of $25 to process cancellation of the citation upon verification of possession of a valid placard at the time the citation was issued. This ordinance will require this charge of $25 administrative fee to begin after a six-month grace period.
