There were no amendments to the agenda. 30 31 Item 3 – Public Comment 32 Mr. Kennedy called for any public comments. There were no members of the public who wished to make comments. 33 34 Item 4 – December 8, 2016 Meeting Summary 35 Ms. Ensminger made a motion to approve the minutes as submitted, which was seconded by Mr. Meadows. The motion 36 passed unanimously. 37 38 Item 5a – Approval of CMAQ Project Requests for FY18 & FY19 39 Mr. Day noted that Congestion Mitigation and Air Quality (CMAQ) funding would be available for Orange County and the 40 northeast portion of Chatham County including the Pittsboro area. He described three projects that had been submitted 41 for funding consideration: (1) a new 30-35 foot low-floor transit bus for Chatham Transit that would cost $500,000; (2) a 42 sidewalk project on West Street between NC 87 and Central Carolina Community College in Pittsboro that would cost 43 $95,951; and (3) a sidewalk project on NC 87 between Pittsboro Elementary School Road and Town Lake Park in Pittsboro 44 that would cost $326,478. He also noted that TARPO anticipated having $456,281 in Federal CMAQ funding available, and 45 that CMAQ funds could only cover 80% of the project cost and required a 20% local match. 46 47 The committee discussed the three projects, and noted that the transit project was likely to have the greatest air quality 48 benefit. 49 50 Ms. Ensminger made a motion to recommend that the RTAC approve full funding for the Chatham Transit project as 51 TARPO’s top priority, and that the remainder of any available funding be made available for the Town of Pittsboro to apply 52 toward the cost of the West Street sidewalk project (at less than 80%) if they chose to do so. The motion was seconded by 53 Mr. Meadows, and passed unanimously. 54 55

Item 5b – Release of Draft TARPO Planning Work Program for FY18 56 Mr. Day discussed the draft Planning Work Program, Planning Work Program Supplement, and Five Year Planning Calendar 57 for FY18, based on the feedback that had been provided at the previous meeting. 58 59 Mr. Gould made a motion to recommend that the RTAC release the draft document as presented by staff for public 60 comment and review by NCDOT. Ms. Graham seconded the motion, which passed unanimously. 61 62 Item 5c – Appointment of Prioritization Subcommittee 63 The committee discussed the need for a subcommittee of the RTCC to develop a draft list of projects to submit for scoring 64 in the NCDOT Prioritization 5.0 process. It was noted that the committee should include representatives from each county 65 as well as each NCDOT division. The committee members developed the following slate of members for the 66 subcommittee: 67 68

75 Mr. Montgomery made a motion to recommend the RTAC approve the membership list above for the TARPO Prioritization 76 Subcommittee, which was seconded by Mr. Meadows. The motion passed unanimously. 77 78 Item 6a – FY18-27 Draft STIP Results and Preparation for Prioritization 5.0 79 Mr. Day provided the committee with a summary of the projects that were successfully funded in Prioritization 4.0, and 80 noted the P4.0 projects that will automatically carry forward for reconsideration in P5.0. 81 82 Item 6b – Potential Updates to TARPO Prioritization Methodology Document 83 Mr. Day suggested some updates to the Prioritization Methodology TARPO uses to assign local points, including 84 recommendations to use the NCDOT quantitative scores in all modes, to formalize the process for coordinating with the 85 NCDOT Divisions on point assignment, and to update the schedule. Mr. Tillman recommended that the language 86 regarding NCDOT coordination should refer to position titles rather than the names of specific people. Mr. Day noted that 87 he would return with additional recommendations once the NCDOT scoring criteria are completed later in the Spring. 88 89 Item 6c – RTAC Member Ethics/Finance Reporting Requirements 90 Mr. Day provided a brief overview of the ethics and finance reporting requirements of RTAC members, noting that their 91 finance paperwork must be filed with the State Ethics Commission by April 15. 92 93 Item 6d – TARPO Q2 Financial Update 94 Mr. Day provided an update on TARPO’s expenses for the second quarter of FY17, noting that $52,396 (or 42% of the 95 annual budget) had been spent in the first half of the year. 96 97 Item 6e – Legislative Update 98 Mr. Day presented information about the proposed legislation that came out of the House Select Committee on Strategic 99 Transportation Planning and Long Term Funding Solutions. 100 101 Item 7 – Member Updates 102 Ms. Coppola noted that Chatham County would be holding public meetings for its Comprehensive Plan. 103 104 At approximately 11:45 am, the RTCC recessed for lunch. Item 5a: Adoption of FY18 Planning Work Program and Planning Calendar

Background

Staff presented a draft version of the proposed FY18 Planning Work Program on February

9, 2017, at which time the RTAC approved release of the draft for NCDOT review and public

comment. In late February, staff received notice from NCDOT that the amount of state

funding available to TARPO in FY18 would grow from the original amount of $96,075 to a

new amount of $110,486 (a 15% funding increase). As a result, staff has proposed a

revised Planning Work Program for approval by the RTAC today. This revised version

recommends (as compared to the February draft):

Additional $5,000 in the Comprehensive Transportation Plan category, raising its

total budget to $30,000.

Additional $5,000 in the Prioritization and Program Development category, raising

its total budget to $30,000.

Additional $8,000 in the General Transportation Planning category, raising its total

budget to $28,000.

Additional $14 in the Administrative Documents and Public Involvement category,

raising its total budget to $25,108.

This change in state funding does not require a change in local dues ($7,500 per county),

but does reduce the amount of “beyond-the-match” funding available (the difference

between the local dues paid and the minimum required match)—the Planning Work

Program Supplement has been updated to reflect this reduced amount that falls under its

purview.

Recommendation

Recommend RTAC adoption of FY18 Planning Work Program, Five Year Planning Calendar,

and Planning Work Program Supplement.

Dear Mr. Day:

The North Carolina Department of Transportation has allocated Rural Transportation Planning Funds in the

amount up to $110,486 for the Triangle Area RPO for FY 2018. The funds are available based on an 80/20

costs share, and are expected to be matched by a 20% local share, exclusive of any other state funds. Thus,

if full funding is available, the total work plan would be $138,108 ($110,486 – State, $27,622 – Local).

Reimbursement for planning expenses should be made through the invoice submittal procedure as outlined

by the RPO Administrative Procedures. Reimbursements will only be made for transportation planning

expenses incurred in executing the work tasks described in your approved FY 2018 Planning Work

Program (PWP), which is due by May 31, 2017.

Five Year Planning Calendar

FY 2018 – FY 2023

Triangle Area Rural Planning Organization

As part of developing an annual planning work program, the Triangle Area Rural Planning

Organization (TARPO) is required to document the ongoing and planned future activities of the

RPO for the next five fiscal years. This document should serve as the vision for guiding the

RPO’s future activities and should be used for guidance in the development of future planning

work programs.

For the period FY 2018 through FY 2023, TARPO proposes to undertake the following general

activities:

Data Collection and Assessment – annually maintain necessary GIS data layers for use in

transportation planning activities; and develop interactive online maps to display

available GIS information (such as AADT, crash locations, CTP recommendations, and

project information) to the public. Assist with local bicycle and pedestrian plans as they

occur and implement actions from Regional Bicycle & Pedestrian Planning Framework.

Comprehensive Transportation Plan (CTP) Development – assist in the completion of

CTPs in Moore County and Lee County, including assistance with public involvement,

plan recommendations, socioeconomic data/forecasts, and adoption. Conduct minor

update of Orange County CTP. Update Chatham County CTP to include

recommendations from Pittsboro area, following local approval of Chatham Park small

area plans.

Prioritization and Program Development – prepare necessary information for STI/SPOT

processes every two years, including necessary updates to the process for soliciting and

scoring projects; review and provide comments on STIP documents developed as a

result of STI process.

Project Development – participate in meetings and review materials for funded highway

projects, as well as bridge and non-highway projects.

General Transportation Planning – participate in corridor studies and other special

studies; coordinate with neighboring MPOs and RPOs on planning activities; document

compiled regional transportation plan based on county and municipal CTPs; participate

in North Carolina Association of RPOs.

Supplement to Triangle Area Rural Planning Organization

Fiscal Year 2017-2018 Planning Work Program

Each year, the four counties that are members of the Triangle Area Rural Planning Organization

(TARPO) each contribute $7,500 toward the organization, for a total annual local amount of $30,000.

This amount is greater than the minimum 20% local match funding required to receive RPO funding

from the state. The TARPO Rural Transportation Advisory Committee (RTAC) has determined that

any amount of local funding provided to the Triangle J Council of Governments (TJCOG) each year for

the purposes of conducting TARPO business that is above that required for the 20% local match shall

be accounted for in a work program supplement, and shall have the ability to carry balances from

year to year and reprogram unused funds from previous years.

This document shall serve as the work program for this additional local funding.

For the 2017-2018 Fiscal Year, NCDOT is anticipated to reimburse TARPO for eligible expenses up to

$110,486. The required local match for this level of state funding is $27,622. The difference between

this and the $30,000 provided by the TARPO member counties is $2,378. However, this could change

if NCDOT increases or decreases the amount of state funding.

The total budget for TARPO, including that which is programmed within the standard Planning Work

Program and that which is programmed in this local funding addendum, will be $140,486.

The following tasks will be eligible expenses for the $2,378 covered by this addendum:

Purchase of food for TARPO meetings – this expense is not eligible to be paid using state RPO funding or the 20% local match, so it must be paid from this additional local funding (estimated

at about $1,800 annually for six meetings);

Purchase of equipment or supplies for use on TARPO projects; and

Payment for work on tasks included in the standard FY 2017-18 TARPO Planning Work Program that require additional funding, including those affected by funding caps on item III-1.1.f.

This Work Program Addendum will be effective from July 1, 2017 until June 30, 2018. In the event

that TARPO does not utilize its entire budget in Fiscal Year 2016-2017, any remaining local funding

balance from that fiscal year will carry over to the 2017-2018 Fiscal Year, and will be added to the

amount eligible for use in this Work Program Supplement.

This Work Program Supplement may be amended as needed, based on a majority vote by the TARPO

RTAC.

Item 5b: Amendment # 1 of FY17 Planning Work Program

Background

Each year TARPO develops a Planning Work Program (PWP) to guide the planned work

tasks that staff will undertake in the coming year. The current Planning Work Program was

adopted in Spring 2016.

Each Spring, we typically examine our spending through the first three quarters of the year

and determine whether any amendments are necessary for the final quarter of the year. At

the time of this agenda’s publication (4/6/17) the final Third Quarter financial information

was not yet available, although it should be available within the next few days. On the day

of the meeting, staff will present a proposed amendment to address necessary shifts in

funding between categories. Please note that the total budgeted amount will remain the

same.

Based on the first two quarters, staff anticipates that the recommended amendment will

shift funding away from the Data Collection and Assessment category and the

Administrative Documents and Public Involvement category into the Comprehensive

Transportation Plan category and the General Transportation Planning category. However,

this is subject to change based on the results from the Third Quarter.

Draft Amendment will be provided as a handout at the meeting, and by email to RTCC and

RTAC members in advance if possible.

Item 6a: Prioritization 5.0 Update

Background

Every two years NCDOT develops a new Statewide Transportation Improvement Program

(STIP). The process that is being used to develop the next STIP, called Prioritization 5.0, is

already underway. The TARPO Prioritization Subcommittee has already met twice to

discuss potential projects for submittal, and has its next meeting scheduled for May 1.

Following that May 1 meeting, the draft list of projects recommended for submittal will be

posted on the TARPO website and will be circulated to each municipality and county for

review and approval. We will ask each local government to consider a resolution either

supporting the list as developed by the Prioritization Subcommittee or requesting

modifications to that list. These local resolutions or letters should be returned to TARPO

no later than the end of June. The TARPO Prioritization Subcommittee will then meet in

July to recommend a final project list based on the comments received from local

governments and the public. This final list of project submittals will be presented to the

RTCC and RTAC for approval on August 10, 2017.

At the same time, staff will also work on potential updates to TARPO’s methodology for

scoring projects and assigning local input points. We anticipate that NCDOT’s proposed

project scoring system will be finalized by the end of June, which will then be used to

inform staff’s recommendations. In addition, Cambridge Systematics has conducted a

review of all MPO and RPO scoring methodologies in the state and we anticipate receiving

their comments and suggestions on our current process (as of publication time of this

agenda on 4/6/17 we do not yet have the Cambridge Systematics assessment, but we expect it

soon—perhaps before the meeting, in which case it will be provided as a handout).

A schedule of Prioritization 5.0 activities is outlined below and on the next page.

The North Carolina General Assembly is in session and considering a number of bills

related to transportation. Staff will provide an update on these. Some of the bills of note

include:

H31 – Clarifies that inclusion on a CTP, alone, is not a material fact that must be

disclosed in a real estate transaction, but that inclusion in a fiscally-constrained plan

would be (bill status: passed full House, now in Senate committee)

H81 – Changes weighting of local points in STI process to place more weight on MPO

and RPO points and less weight on Division Engineer points (bill status: passed full

House, now in Senate committee)

H110 – Numerous minor DMV changes, and changes to rules for NCDOT release of

excess right-of-way (bill status: passed first House committee, now in second House

committee)

H141 – Would allow cities and counties to require maintenance bonds for

subdivision roads that are expected to be turned over to the state for maintenance

in the future (bill status: in House committee)

H219 – Establishes a “Megaproject Fund” to fund large projects costing over $200

The General Assembly of North Carolina enacts: 4

SECTION 1. G.S. 136-211 is amended by adding a new subsection to read: 5

"(d1) Attendance. – Each Rural Transportation Planning Organization shall develop and 6

implement an attendance policy that requires (i) members to submit to the Rural Transportation 7

Planning Organization the name of at least one designee who has authority to represent the 8

member at meetings held by the Rural Transportation Planning Organization and (ii) members, 9

or their designees, to attend no less than half of the meetings held per calendar year by the 10

Rural Transportation Planning Organization. Each Rural Transportation Planning Organization 11

shall maintain a record of attendance for each meeting held by the Rural Transportation 12

Planning Organization and shall post the record on the Rural Transportation Planning 13

Organization's Web site or submit the record to the Department to post on the Department's 14

Web site. Any area or entity represented by a member, or designee, that fails to meet the 15

minimum attendance requirement set forth in this subsection shall be suspended from 16

participating in the Rural Transportation Planning Organization for the calendar year 17

immediately subsequent to the calendar year in which the member failed to meet the attendance 18

requirement." 19

Background

N.C.G.S. 136-211(f) requires RPO RTAC members to file a Statement of Economic Interest

and a Real Estate Disclosure at the beginning of their service on the RTAC (before they can

take the seat) as well as annually in each calendar year that they serve. The documents

must be submitted no later than April 15 each calendar year (April 17 this year due to

weekend). There are significant penalties for non-compliance.

Staff will provide a brief presentation to go over the requirements.
