What is PBC?What is PBC?• Performance-Based Contracting (PBC) -

mechanism that solicits bids on basis of what RESULTS that you want achieved rather than what ACTIVITIES you want conducted:– Contract for “What,” not “How”

• Characteristics of PBC:– Clearly defined performance expectations and measures

(baseline vs. expected results)– Clearly defined due dates & milestones– Use of incentives for performance– Flexibility in exchange for accountability for results

• Army retains Environmental Liability• Regulators concur with remedy selection and

response complete

What Does BRAC 2005 Mean to States? What Does BRAC 2005 Mean to States?

• BRAC is different Funding source:– Identify affected installations in your state and adjust

Attachment A and JEP to ensure smooth transition of funds and activities

• Army Program Management shifting for closing installations: – For Cleanup from USAEC to office on Army Staff (BRAC

Division)– For Compliance from Lead organizations to BRACD

• Army approach - cleanup to like reuse:– Local Redevelopment Authority may proposed reuse

which may require more stringent clean up Environmental Services Cooperative Agreements (ESCA)

• Efficiency initiatives:– Performance Based contracting focusing on cost

and time savings• Environmental liabilities:

– Chief Financial Officer Act of 1990 requires federal agencies to report liabilities

– Supporting documentation and supervisory controls are key

– Real property reconciliation
