BE IT RESOLVED, that the following Jeanne C. Berard is hereby appointed as a Trustee of the Sand Lake

Town Library; the term of office shall expire on December 31, 2003.

BE IT RESOLVED, that in lieu of the filing and publishing requirements set forth in Town Law 29(10), the

Supervisor shall submit to the Town Clerk within 60 days after the close of the fiscal year, a copy of his

report to the State Comptroller, and that the Town Clerk shall publish a summary of such report within

10 days in the official newspaper of the town as permitted by Town Law 29(10-a). In the event the filing

of the annual report is extended by the State Comptroller, the Supervisor’s time for filing a copy of the

report with the Town Clerk is likewise extended.

Salaries of Town officials and Employees

Supervisor Kelley moved and Councilwoman Fasoldt seconded the following resolution:

BE IT RESOLVED, that the salaries of Town officers and employees shall be as set forth in the 1999 Town

Budget except as otherwise specified by resolution.

Appointment of Current Employees and Officers

Supervisor Kelley moved and Councilman Welcome seconded the following resolution:

BE IT RESOLVED, that all current employees and officers not specifically mentioned in the resolutions

adopted at this meeting and who will serve at the pleasure of the Town Board are hereby continued in

office until such time as the Board shall otherwise direct, and that no appointment for a term is made

hereby.

RESOLUTION # 11-99

1999 Association of Towns Training School and Annual Meeting

Supervisor Kelley moved and Councilwoman Fasoldt seconded the following resolution:

BE IT RESOLVED, that the following Town Officials are hereby authorized to attend the 1999 Annual

Training School and Annual Meeting of the New York State Association of Towns in New York City,

February 14 - 17, and each shall be advanced or compensated up to $500.00 for their documented

actual and necessary expenses. Supervisor Douglas S. Kelley, Councilwoman Fasoldt, Judge David Fryer

and Steve Robelotto, Commissioner of Public Works.

BE IT RESOLVED, that Flora Fasoldt is appointed the Town’s Official Delegate and that Douglas S. Kelley is

appointed Alternate Delegate to the Association of Town’s Annual meeting.

RESOLUTION # 12-99

Authorization for attendance of the NYS Assessor’s Association

Supervisor Kelley moved and Councilwoman Dunn seconded the following resolution:

BE IT RESOLVED, that Garth Slocum and Tracy Albanese are authorized to attend the New York State

Assessor’s Association Sponsored Seminar entitled “Valuation of Cell Towers” in Newburgh, New York

on January 27, 1999 and that the Town pay the $160.00 enrollment fee and traveling expenses.

RESOLUTION # 13-99

In the matter of appointing special counsel in connection with certain Article 78 proceedings against

Town Justice David Fryer.

Supervisor Kelley moved and Councilwoman Fasoldt seconded the following resolution:

WHEREAS, Article 78 proceedings have been brought against Town Justice David Fryer arising out of

decisions made by him in two driving while intoxicated cases, and

WHEREAS, the New York State Attorney General has advised Justice Fryer that such office does not

undertake representation of Town Justices in such matters, now therefore

IT IS HEREBY RESOLVED AS FOLLOWS:

Frederick J. Schreyer, Esq. Of Averill Park is retained as Special Counsel for the purpose of representing

Justice Fryer in the Article 78 proceedings described above, with compensation to be paid to Mr.

Schreyer at the rate of $50.00 per hour, plus expenses, to be paid upon standard vouchers.

1. Frank Allen spoke to the Board and asked them to remember that there are numerous people

in Sand Lake on Fixed Incomes and to please keep them in mind.

The regular monthly meeting of the Town Board of the Town of Sand Lake was called to order by

Supervisor Kelley at 7:30 P.M. at the Town Hall in Sand Lake, New York. After the Pledge of Allegiance,

APPROVAL OF MINUTES: Councilman Trupia made the motion to approve the minutes of 12/09/98;

MONTHLY REPORTS:

TOWN CLERK - Christine M. Kronau

· Total fees submitted to the Supervisor for December 1998 - $ 864.68

SUPERVISOR’S REPORT:

Supervisor Kelley stated that he received a letter from Superintendent Butterworth concerning holding

Town Meetings at the Averill park High School. The School District has consented to our request. The

meetings will be held there during our renovation of Town offices. He also responded to the Planning

Board request for additional hours for the Planning Board clerk until the Town hired the Receptionist.

According to time cards, the clerk worked an average of 15 hours per week in the previous year. He

informed the public that the State Education Department had appointed the Trustees to the Sand Lake

Library. That concludes his report.

BOARD MEMBER REPORTS:

STREET LIGHTING - Councilwoman Dunn - no report; but did ask the Department of Public Works to

notify her of any street lights which were not working, as they made their rounds plowing at night.

INSURANCE - Councilman Trupia; no report.

ANIMAL CONTROL - Councilman Trupia; report on file in Town Clerk’s office.

LIBRARY - Councilwoman Fasoldt reported that the following people had been appointed to the Board

of Trustees of the Sand Lake Library by the New York State Board of Regents; Sue Larson and Beth

Schroder terms to expire 12/31/99. Sean Maloney term to expire 12/31/2000 Arthur P. Handley III and

Elizabeth Wicks terms to expire 12/31/2001. I am requesting that the Library Board send a

representative to give the Town Board a report at it’s monthly meeting. I feel this will enhance

communications between the Library Board and the Town Board.

YOUTH - Councilwoman Fasoldt; The Circle players have received a Grant and will be working with the

Youth this summer. The Court Program is moving along. We are waiting for input from the School

District.

EMERGENCY - Councilman Welcome; On file in the Town Clerk’s Office.

SENIORS - Councilman Welcome; No report.

TOWN ATTORNEY - No report.

COMMITTEE REPORTS:

PLANNING - Justin Schultz, On file in Town Clerk’s Office.

ZONING- No Report.

COMMISSIONER OF PUBLIC WORKS - Steve Robelotto reported on the road conditions, the distribution

of the sand/salt mixture, Generator for the DPW Building, and sidewalk conditions.

YOUTH - Tracy Albanese reported on the roller skating which was changed to January 29th. She also

reported that they are working on field trips for the two weeks of school break.

AMBULANCE: Stephanie Kehn reported that the Ambulance is interviewing for EMT’s and thanked the

Board for their cooperation in trying to solve some of the problems that they were having.

COMMENTS FROM RESIDENTS:

· Ed Patanian: commented on the sand/salt program and thought a sign in sheet with name and

phone number would be helpful. He also thought a decal for ID might work. He also wanted to bring to

the attention of residents to watch what special districts were costing them on their tax bills.

Supervisor Kelley moved and Councilwoman Fasoldt seconded the motion to open the public

hearing at 8:05 P.M.

Please take notice that the Sand Lake Town Board will HOLD A PUBLIC HEARING ON January 13,

1999 at the Sand Lake Town Hall, Route 43 at 7:30 P.M. concerning an ordinance to increase the annual

income ceiling applicable to the Town of Sand Lake Ordinance # 1 of 1966 which was originally passed to

grant a partial tax exemption for real property of senior citizens.

Senior Citizen Exemption - Amendment of Maximum Allowable Income

SENIOR CITIZENS EXEMPTION - AMENDMENT OF MAXIMUM ALLOWABLE INCOME

WHEREAS, the laws of the state of New York provide for the granting of a partial exemption from real

property taxation for real property owned by certain persons with limited income who are 65 years of

age or over, and

WHEREAS, there is currently in effect within the Town of Sand Lake, an Ordinance providing for such

partial exemption subject to the conditions as stated in the basic enabling legislation as amended to

date, for persons who are 65 years of age or over, having income within specified income limits, and

WHEREAS, a public hearing was duly called and held on January 13, 1999, concerning the possible

increase of said specified income limits.

NOW, THEREFORE, be it ordained as follows:

1. Said Ordinance concerning the tax exemption for senior citizens is hereby amended and

modified to increase the amount of income which said persons who are 65 years of age or over; may

receive and still be eligible for said exemption from the limits currently in effect to:

current and future needs,

BE IT RESOLVED, that the Town Clerk shall advertise for bids for modifications to the newly acquired

Sand Lake Municipal Building. Such Notice to Bidders shall be in the attached form and shall be

published in the Troy Record and Sand Lake Advertiser.

Supervisor Kelley moved and Councilman Welcome seconded the following resolution:

BE IT RESOLVED, that the January 1999 Fund Warrant be approved as audited: General Fund $37,372.36;

Highway Fund $ 39,905.72; Street Lighting $5,609.26; Sewer $9,109.89 and Municipal Account $

14,880.61 for a total of $ 106,877.84.

SUPERVISOR’S REPORT:

Supervisor Kelley began his report informing the Town that Y2K will have no effect on the Town. He will

be scheduling a meeting with the Zoning Change Committee sometime this month. Councilwoman

Fasoldt and Supervisor Kelley had a meeting with EWI and negotiated a new plan. There will be a slight

change at the convenience facility. We are working on an appliance day, a tire day and perhaps a

hazardous waste disposal for the year 1999. I have notified the Consolidation Committee that we will be

meeting in the near future, probably this month. I have notified DOT that a correction needs to be

addressed in the hamlet of West Sand Lake. We will be sending certified resolutions to them concerning

the problem and enforcing the correction of this drainage problem with State DOT and Malloy

Construction. I have talked to Kestner Engineers and will be scheduling a workshop with the Crooked

Lake Residents in the early part of March to go over some alternatives. Paul Splain has handed in his

resignation from the BAR. Anyone interested in serving on this board should send a resume to the

Supervisor’s Office. We will be entertaining a proposal from a resident about the possibility of an elderly

day care program. There will also be a proposal concerning a revolving low income loan for residents of

Sand Lake for the improvements of their property. That concludes my report.

BOARD MEMBER REPORTS:

CABLE: Councilwoman Dunn: We have received requests to extend Cable Service along Sheer Road &

Biittig Road. Service along Sheer Road will be included in Time Warner’s budget for the year 2000.

STREET LIGHTING: Councilwoman Dunn reported that the 4.6% tax increase for Sand Lake Consolidated

Lighting on the 1999 tax bill reflects the increase in the tax levy not an increase in the Street Lighting

costs.

ANIMAL CONTROL: Councilman Trupia: On file in the Town Clerk’s office.

INSURANCE: Councilman Trupia: Is reviewing the policies which are due for renewal next month.

YOUTH COURT: Councilwoman Fasoldt: Has contacted the Assistant Principal at the High School and

they will be setting up a committee of peers in the Spring.

LIBRARY: Sue Larsen; presented the goals of the library, their web page; parenting course from a

neighboring Library. Mrs. Larsen reported on the Automation Services Committee with the Upper

Hudson and the State funded Data Base project.

YOUTH: Lynn Hamel reported on the roller skating events, the Easter Egg Hunt, the Easter Cake raffle

and Registration for the Summer Day Care program. This will be held on two dates; March 27 and March

31, 1999. The Day Camp runs from July 5 through August 15, 1999. Medical forms and ½ the registration

fee are due at the time of registration.

WHEREAS, the State of New York entered into a contract for the reconstruction of a portion of

Route 43 in the hamlet of West Sand Lake,

WHEREAS, as a result of such contract work a temporary detour road was constructed from

Route 150 through the Malloy Gravel Bank,

down Route 150,

WHEREAS such change in drainage has caused and will continue to cause flooding of a portion

of the Hamlet of West Sand Lake thereby endangering the lives and property of residents, pedestrians,

motorists, schoolchildren and churchgoers,

THEREFORE, BE IT RESOLVED, that the New York State Department of Transportation

immediately have this dangerous condition corrected before further injury to persons or property

occurs.

· Met with Kiwanis regarding the Orange Crate Derby. The tentative date will be 8/14/99 upon

securing the proper insurance; safety issue of closing Gettle Road; the Police services that will be

provided, the Ambulance Service and the use of Butler Park.

· Supervisor’s Association will be represented on the Sales Tax Committee with a Supervisor to be

part of the Panel.

· Highway - We are looking into the immunization of our Highway Crews regarding Lyme Disease

and Rabies due to this occupational hazard.

· Mark Kestner from Kestner Engineers will be updating the Town Board on the Sand Lake Sewer

District No. II Project.

· I will be sending a request to Senator Bruno seeking information on additional funds.

· I received a letter from Sand Lake Businessmen’s Ass. voicing their opposition regarding the

legislation about Demolition permit.

· Reported on Linda Reynolds, Secretary who had surgery on 4/09/99. She is doing nicely but will

have a slow recovery.

BOARD MEMBER REPORTS:

CABLE - Councilwoman Dunn reported that cable would be available on Luther Road, East Greenbush in

the vicinity of Collins Road by the end of the year. She also stated that Road Runner would be available

around the first of the year 2000. She brought our attention to the new invoices from Time Warner

which had certain information which was required by Federal regulations although Cablevision did not

include it on their billing. The Federal Government has now come out with a new regulation stating that

the municipality can choose whether or not such information should appear on the invoice. We should

receive information from Time Warner regarding this soon. Hi

STREETLIGHTING - Councilwoman Dunn. There were several outages reported last month, however

everything is in working order at this time.

ANIMAL CONTROL - Councilman Trupia - on file in the Town Clerk’s Office.

INSURANCE - Councilman Trupia - The Town’s Health Insurance is up for renewal next month and there

will be an open period from 5/01/99 to 5/15/99 for employees who wish to make changes.

PARKS AND RECREATION - Councilwoman Fasoldt - We have applied for the Town’s Beach Permit and

have been notified that the Rensselaer County Health Department requires that we test our water

In order to reserve Butler Park for an occasion, a form needs to be filled out and filed with the

Supervisor’s office.

YOUTH - Councilwoman Fasoldt - Their will be a Summer Theatre program this summer with Joan Fuess

as the Director. This will be in conjunction with our Summer Program.

YOUTH COURT - Councilwoman Fasoldt - Judge Fryer - We now have 10 Averill Park students in training

for this new program. Julia Tobin is the Liaison at the Averill Park High School. Saturday, April 24, 1999

the Town will sponsor a White Goods Day. Item can be dropped off at the Department of Public Works

on Springer Road from 9:00 A.M. to 2:00 P.M. A permit can be obtained from the Town Clerk’s office.

WHEREAS, in 1998 the Town was awarded a grant through the State Environmental Bond Act to

help finance construction of a sanitary sewer system in a portion of proposed Sand Lake Sewer System

No. II, encompassing the area of the Town around Crooked Lake, and

WHEREAS, additional grant funding will be necessary in order to finance construction of a sewer

system in the entire area of such proposed Sewer District, and

WHEREAS, in order to apply for such additional funding a new Environmental Bond Act

application must be submitted by the Town, and

WHEREAS, the firm of Kestner Engineers has been working with the Town in regards to the

previous grant application and design and creation of the proposed Sewer District, and

Engineers, P.C. for preparation of a concept plan with respect to installation of sewers in the vicinity of

Glass and Crooked Lakes in the Town, and

Whereas, upon application the Town has been awarded an Environmental Bond Act grant of up to

$500,000.00 (limited to 85% of construction cost) to partially fund the project, and

Whereas, public informational meeting were held concerning the proposal at which affected property

owners and residents were invited to review the concept plan and make their views known as to

whether they would support such a project, and,

Whereas, at such meeting and through a straw poll, affected residents and property owners evinced

substantial interest in the project, and

Whereas, based upon such interest the firm of Kestner Engineers, P.C. was directed to complete a map,

plan and report concerning such proposal, which map, plan and report has now been completed and

filed with the office of the Town Clerk on the 20th day of April, 1999, and

Whereas, pursuant to the State Environmental Quality Review Act, the Board has found this to be a Type

I action, that it conducted a coordinated review of the project, that the Town Board of the Town of Sand

Lake designated itself as lead agency, that Kestner Engineers, P.C. prepared a draft long form

Environmental Assessment Form for completion by the Board with such firm’s aid, and that notice

thereof was provided to the following involved and interested agencies: Department of Environmental

Conservation, County Health Department, County Sewer District, New York State Department of

Transportation, Rensselaer County Highway Department, federal Environmental Protection Agency, NYS

Environmental Facilities Corporation, and

Whereas, the Board has heretofore on October 9, 1998, issued a negative declaration of environmental

significance with respect to the project, there have been no significant changes to the project since such

time and the Board hereby readopts, reaffirms and ratifies such negative declaration, and

Whereas, the area to be encompassed within the proposed Sand Lake Sewer District Number 2 is

bounded and described as follows: that area of the Town encompassed by the parcels of land identified

by tax map number in Exhibit A attached hereto; also see map of proposed district dated April 19, 1999

and filed with the Town Clerk’s office; and,

Whereas the improvements proposed consist of sanitary sewer service to the Crooked Lake area as

shown on a map prepared by Kestner Engineers, P.C. dated March, 1998. Initially, sanitary sewer service

would be provided to the properties from Creek Lane southeasterly along State Route 43/66 past the

intersection of Eastern Union Turnpike to Methodist Farm Road and then along Methodist Farm Road in

a westerly direction approximately nine hundred feet. Sanitary sewer service would also be extended

once funding were obtained along Eastern Union Turnpike and further westerly along Methodist Farm

Road servicing properties on both sides of those roads including Maria Villa Way, Twin Lion Way, Holser

Road Way and Perry Way off of Eastern Union Turnpike, and Connelly Way, Lilly Lane to Stewart Lane,

Saxby Way and Stone Camp Way. The project would be serviced by grinder pumps and would discharge

waste water to the existing Town of Sand Lake Sewer District #1 pump station at Creek Lane. Waste

water treatment would be provided by the Rensselaer County Sewer District Plant on the Hudson River.

Whereas the maximum amount proposed to be expended for the said improvement is the sum of

$680,000.00 to be financed as follows: $462,000.00 grant through the New York State Environmental

Bond Act (85% of construction costs) and $217,600 5%, 20year bond, and

Whereas, annual expenses and hook-up fees for the typical property or one or two family home if

different are as follows:

Served: (Includes properties on west side of Route 43/66 and both sides of Methodist Farm Road for

approximately 900 feet from its intersection with Route 43/66):

Connected: $464.10 per residential unit which includes capital costs,

transportation, county and maintenance fees.

INTRODUCTION: Supervisor Kelley informed the residents that a survey was being conducted through

Smith & Mahoney will be offering some changes today that we might consider. The State Police Grant is

still available. Although they will not make a commitment to the Town to increase their numbers, they

will not decrease their presence. Smith & Mahoney will be doing a survey of the proposed residents in

the proposed water district. This will be confidential.

PRESENTATION:

Mike Mc Nerney and Dave Winkler passed out a preliminary cost estimate to the public.

They proceeded to go over each line item and addressed the changes that could lower the cost of

renovation.

COMMENTS FROM RESIDNETS:

· Jack Reardon had questions on the stage, stage curtain, stage lighting and State Police facility.

Jack also commented on saving funds for the landfill. He feels we should be careful with the monies put

aside in case of leakage.

· Cheri Foland suggested asking organizations for volunteer donations such as landscape, lighting

etc.

· Colleen Regan objected to this meeting not being televised. She felt we were not given residents

proper notice of meetings.

· Peg Burkhart objected to short cuts. She felt we should do the renovations as stipulated and not

cut costs by renovating existing heating, etc.

Mike McNerney and Dave Winkler stated that renovation work is always more difficult than new

construction. They suggested that the Board come up with a budget that the engineers would have a

figure to work with. They also stated that they had not had time to go over the phone bids.

SUPERVISOR’S REPORT:

· Supervisor Kelley noted that the presentation by Smith & Mahoney was removed from the

agenda due to the fact that it is not ready yet, as the Town Board is still working on a budget and until

we finalize the budget for this Town Hall no plans can be produced. We will have a presentation in the

future as soon as our plans are finalized. I apologize to anyone who came to see this presentation.

· The former Capital Mutual Building is coming along quite nicely. We anticipate a substantial

completion date of June 12, 1999. At that date, town officials will be going through the building to

create a punch list, a list a small things which need to be completed by the contractor before final

completion date. We are not quite sure if that will actually be a moving date. We don’t want to be in the

way of the contractors. The upstairs is coming along quite nicely. There is still some work to be done on

the outside.

· We are taking a careful and cautious approach with this building.

· Creation of Crooked Lake Sewer District No. II will be on the agenda tonight. We are asking the

People in the District to vote on this referendum.

· Regarding the Averill Park Water District- Over 500 surveys have been mailed out to residents in

this district. About 25% were returned because of incorrect mailing addresses. We will be having a

meeting with the people in this district and we are moving along with the implementation of this

project. Please return your survey as we need a good percentage in order to compile figures for Grant

monies.

· Received the resignation of our convenience facility operator, Charles Smyth. Any interested

parties, please contact the Supervisor’s office.

· I also received a positive response from Senator Joseph Bruno in regards to our letter for

additional funds for the Crooked Lake Sewer District and Burden Lake area.

BOARD MEMBER REPORTS:

CABLE - Nancy Dunn - A Cable committee is being formed for the purpose of expanding Cable use in

town. We have discussed this with Supervisor Kelley and are in agreement. We expect an increase in

the cable casting of Civic and Informational as well as Educational Programs. Time Warner Cable is also

changing their billing cycle. You will notice an extra weeks service on your current bill. This is a one time

adjustment.

STREETLIGHTING - Nancy Dunn - Our 1999 Streetlight inventory has been completed. The town has been

billed for 497 lights and there are actually 497 in the town however, we have been underbilled in the

amount 960 watts resulting in an underbilling of $45.75 per month. Our monthly billing will be

ANIMAL CONTROL - Joseph Trupia - on file in the Town Clerk’s Office

INSURANCE - Joseph Trupia is looking into coverage in case any legal action is brought against the town

in regards to any contamination as a result of the old landfill site. It is very preliminary, but I am

investigating.

YOUTH & RECREATION - Flora Fasoldt - Interviews were conducted for the Day Camp program. There is a

resolution on the agenda tonight for the hiring of this staff. We have received our operating permit from

the Rensselaer County Health Department to run our Town Beach and will begin the process of

interviewing and hiring staff for the beach soon. We are in need of lifeguards.

PARKS - Flora Fasoldt - We completed the general clean-up of Butler Park and installed new guard rails

along the parking areas around the ball fields. We hope to be able to do around the playground area.

We will be contacting the Morton Co. about the addition to the pavilion as they built the original

building. We installed barbecue pits for your enjoyment.

YOUTH - Lynn Hamel - We have reached maximum capacity for summer day camp. Brooke Wagner, a

certified EMT, has agreed to return as Health Director for our summer camp program. Notification as

been mailed out for the remainder of tuition fees due. Field trip money must be paid by 6-1-1999. We

are still in need of Beach Staff. Children 14 years old may be considered for Beach Aides. We will be

conducting interviews this month so the results can be placed on the June agenda.

AMBULANCE - Jack Welcome - The Sand lake Ambulance had 37 basic life supports and 10 intercepts for

the month of April. They will be celebrating EMS Week, which is May 16th -May 22nd by holding several

events at schools and at the Ambulance Garage.

LIBRARY - Sand Lake Historical Society ball collection will continue to be housed in the portion of the

Library opened during normal Library hours. Library Board is still looking for someone to provide

some events scheduled for fall. We received a $1,000.00 grant from the Hudson River Bank & Trust

Company which has been set aside to be used in relation to our move. Internet training workshops are

being offered as part of a grant we received. We will be in contact with the many people who have

volunteered to help us with our move. A layout of our new space will be on display in the Library along

with a list of items and their prices needed. Anyone wishing to make a donation of these items may

sign up to do so. Siena College has donated used furnishings to us saving us $10,000 to $15,000 in

furnishings which will be available to us in August. During our move, the Library will be closed for

approximately one week to ten (10) days. Notice to parents: We will no longer be allowed to drop off

your very young children and leave them unattended due to staff shortages.

In the Matter of Establishing a Second Sewer District in the Town to be known as Sand Lake Sewer

District Number II

Supervisor Kelley moved and Councilwoman Fasoldt seconded the following resolution:

WHEREAS on April 20, 1999, pursuant to Article 12-A of the Town Law, the Town Board resolved to hold

a public hearing on May 6, 1999, on whether a new sewer district in the Town should be created to

provide sanitary sewer service in the Crooked Lake area, said new district to be known as Sand lake

Sewer District Number II, and

WHEREAS said resolution recited the improvements proposed, the boundaries of the proposed district,

the estimated expenses thereof, and the fact that a licensed engineer’s map, plan and report concerning

the project had theretofore been filed with the Town Clerk, and

had and all persons desiring to be heard having been duly heard including many people in the proposed

district and various other persons speaking in favor of the proposed district, and

WHEREAS, the Town Board as lead agency under the State Environmental Quality Review Act has on

October 9th, 1998, issued a written negative declaration of environmental significance with respect to

this Type I project and there has been no significant change with respect to such project since such time,

Now upon the evidence given upon such hearing,

IT IS HEREBY RESOLVED AND DETERMINED THAT (a) the Resolution of April 20, 1999, ordering a hearing

on this matter to be held May 6, 1999, was duly published and posted as required by law and is

otherwise sufficient; (b) all of the property and property owners within the proposed district are

benefitted thereby; ( c ) all of the property and property owners benefitted are included within the

limits of the proposed district; (d) the establishment of the proposed district is in the public interest; and

it is further

RESOLVED AND DETERMINED, that the establishment of a sewer district as proposed in the Board’s

resolution of April 20, 1999, is approved, that the improvement therein described be constructed and

the service therein mentioned be provided for upon the required funds being made available or

provided for; and that such district shall be designated and known as the Sand Lake Sewer District

Number II, and shall be bounded and described as set forth in Attachment A hereto which is

incorporated herein by reference; and it is further

RESOLVED, that the proposed improvements including costs of rights of way, construction costs, legal

fees and all other expenses shall not exceed $680,000.00 and shall be financed as follows: bond issue

and 94 of the Town Law, said referendum to be held no less than 60 nor more than 75 days from the

date of adoption hereof, and it is further,

RESOLVED, that the exact date, time and place of such referendum, qualifications of voters and an

abstract of the proposition to be voted upon shall be established by this Board at its regular meeting in

June, 1999.

RESOLVED that the Town Clerk of this Town shall within ten days after the adoption of this resolution

cause to be published in the official newspaper and posted on the Town Bulletin Board an abstract of

this resolution specifying that it shall be subject to a referendum as provided by law.

· There was a break-in of the Sand Lake Town Hall on Friday June 4, 1999. It is under investigation

by the New York State Police. If anyone has any information, please report it to the State Police at 477-

9333.

· There will be a walk through of the new Municipal Center on Monday, June 14th, 1999 at 6:30

P.M. with the Town Board and Smith & Mahoney, Engineers. This is to go over the punch list of things

still needing to be completed by the Contractor’s. Due to Liability concerns I ask the public to refrain

from visiting the building at this time.

· The Water District Survey has been mailed and is being returned to Smith & Mahoney. We

would like more of a response. If you feel you should be in the Water District please call Smith &

Mahoney and ask for a survey. We would appreciate all responses be made in a timely fashion.

· The Assessor’s Office will be having Summer Hours from June 28th to August 20th. They will be

open on Tuesday’s and Thursday’s from 9:30A.M. to 3:30 P.M.

· Our Town Historian, Judy Rowe recently was awarded the Sons of the American Revolution

Daughters of Liberty Medal by Dennis F. Marr of the Saratoga Battle Chapter, SAR. We extend our

congratulations to Judy.

· I received a response from the New York Sate DOT regarding the drainage situation along NY

150 & 43. They will consider our suggestion if any additional road work is planned in the future.

· I would like to thank the Rensselaer County Highway Department for their prompt response to a

guardrail request along Sheer Road.

· The Sand Lake Businessmen’s Association has a Town of Sand Lake Resource and Guide available

at no cost to resident’s of the community. These are available at the local Post Offices’, some

establishment’s in Town and at the Town Hall.

BOARD MEMBER REPORTS:

CABLE: Nancy Dunn -The Cablevision Committee met on May 20th and discussed expanding usage of

cable in our Town. We ran a tape tonight of the Memorial Day Parade. It was very light. We plan to look

into this problem and correct it. The Parade will also be shown on Wednesday June 16 at 7:00P.M. on

Channel 31. We have received a boiler plate from Time Warner and have about 18 months to go over it

before our agreement is up for renewal. I want to thank Frank Allen for televising the Planning Board

Meeting.

STREETLIGHTING: Nancy Dunn - An article regarding streetlight and visual pollution was brought to my

attention by a resident of Reichard’s Lake. I have since been in touch with our NYSEG representative We

are looking at streetlights now in the Reichards Lake area to see if any of them might be eliminated or

changed to shoe box lights According to our NYSEG rep. shoe box lights shine directly down and are

usually not an option as they create pools of darkness.

Town Beach will be open on June 26th. The water will be tested weekly this year. This is a new mandate

by the Rensselaer County Health Department. We will be having an additional refrigerator day on

Saturday, June 26th. The first students involved with the Rensselaer County Youth Court will be

graduating on Wednesday, June 16, 1999.

new Town Facility. The actual collection will be moved on Saturday, June 19th, 1999. We look forward to

our new home and the transition into larger quarters.

In support for the elimination of the sunset provision of the Local Government Records Management

Improvement Fund (LGRMIF)

The following resolution was moved by Supervisor Kelley and seconded by Councilwoman Fasoldt:

WHEREAS, the Local Government Records Management Improvement Fund was created in 1989 to

provide technical assistance and grants to establish, improve or enhance records management programs

in New York’s more than 4300 local governments, and

signally to improve the management of records and information in local governments, and

WHEREAS, the New York State Legislature in 1995 extended the sunset date to December 31, 2000 and

WHEREAS, the LGRMIF and the programs it support continue to operate at a high standard of excellence

and provide direct and significant benefit to local governments at no cost to the taxpayers, and

WHEREAS, the Town of Sand Lake has benefited from technical assistance, training, publications and

grants totaling $76,475.00 supported by the LGRMIF, and

WHEREAS, the LGRMIF continues to be critically important in the fulfillment of the many records and

information related responsibilities of local government name, therefore

BE IT RESOLVED, that the Town of Sand Lake supports the elimination of said sunset provision of

December 31, 2000 in order to make the LGRMIF permanent.

would establish the exact date, time and place of said referendum, and the language of the proposition

Rensselaer County and having a general circulation in the Town, and to post same on the town bulletin

board, specifying the date, time and place of the referendum, and the proposition to be voted upon.

Such publication and posting shall take place at least ten days prior to the date set herein for such

referendum. The Clerk, acting with the advice of Special Counsel to the Town Board and with the

assistance of the Office of Town Assessor, shall also establish a tentative list of eligible voters in such

referendum, and make same available for inspection by the public at least ten days before the date set

for the referendum.

In the matter of permitting an Encroachment on the Sewer Easement

Supervisor Kelley moved and Councilwoman Fasoldt seconded the following resolution:

WHEREAS, Noel and Bertha Higgins are the owners of residential real estate located on Route 43

in the Hamlet of West Sand Lake identified as tax map number 146.2-5-11, and

WHEREAS, the westerly portion of said property is encumbered by an easement in favor of Sand

Lake Sewer District Number I, and

WHEREAS, the Higgins wish to construct an above ground swimming pool on their property and

the only feasible place to locate same would result in an encroachment of three to four feet into the

sewer easement, and

WHEREAS, the Commissioner of Public Works and members of the Sewer Department have

conducted a site visit of the premises and do not have any objection to such encroachment provided the

property owners assume all risk in the event of repairs are ever necessary to that section of the sewer

line,

SUPERVISOR’S REPORT:

· The Summerfest will be held at Butler Park July 22nd through July 25th. There are many events

scheduled for all to enjoy. The Parade will be held on Saturday July 24th and the fire works display will

be at 9:15 that evening.

· We began the transition from the Old Town Hall to the new Municipal Building on Tuesday, July

6, 1999. All the offices are now located in the building at 8428 NY 66. I would like to thank the Highway

crew for all their help. They did an excellent job moving all the offices.

· We have been informed that the new Post Office will be located in the 43 Mall on a site near NY

150 with the completion date of the Spring of 2000.

· There will be a referendum regarding the proposed Sand Lake Sewer District Number II on

Saturday July 17, 1999 from 9:00 A.M. to 4:00 P. M. at the Old Town Hall.

shaky start, the beach seems to be running smoothly. We are preparing Butler Park for the Kiwanis

Summerfest. I have written another letter to Kiwanis regarding the Fitness Trail at Butler Park. Hopefully

we will hear soon what Kiwanis’ involvement will be in maintaining the trail.

Plans.

on Monday, June 28th and presented the Town Board with a guest book and a large thank you.

DRAMA - Joan Fuess - The Circle Theatre Players are very excited about their summer program and

would like people to know that there are still some openings in the drama program.

WHEREAS, at a regular meeting of the Town Board held May 12, 1999, the Board adopted a resolution

establishing Sand Lake Sewer District Number II to provide sanitary sewer service to the Crooked Lake

area of the Town, and

WHEREAS, the maximum amount proposed to be expended for the initial phase of construction along

State Route 43-66 and the easternmost 900 feet of Methodist Farm Road is $680,000.00, with such

initial phase of construction to be financed through a state grant of up to $500,000.00 or 85% of

construction costs, whichever is less, with the balance of such costs paid through a municipal bond at an

interest rate not to exceed 5%, and with an average residential unit cost for a served connected

property presently estimated at $464.10 per year and an unserved property at $60.00 per year, and

WHEREAS, said resolution was expressly made subject to a Referendum of affected property owners,

and

WHEREAS, said Referendum was duly held at the Town Hall on July 17, 1999, and

WHEREAS, the vote at said referendum was in the affirmative approving said resolution establishing

Sand Lake Sewer District Number II by a vote of 75 in favor and 24 against, and

WHEREAS, the said establishment of Sand Lake Sewer District Number II has been so approved;

NOW THEREFORE be it resolved, established and ordained:

1. That said public Referendum has approved the establishment of Sand Lake Sewer District

Number II.

2. That the Town Clerk of the Town of Sand Lake has duly filed the certificate concerning said

referendum or special election, as required by section 209-e of the Town Law, with the Rensselaer

County Clerk.

3. Pursuant to section 209-f of the Town Law, the permission of the New York State Department of

Audit and Control is not required because the annual cost to the typical property or typical one or two

family home is below the threshold set by such department for such projects.

A Resolution authorizing the Acquisition and Construction of a Sanitary Sewer System for Sand Lake

Sewer District Number II, Authorizing the Issuance of Serial Bonds of the Town of Sand Lake, Rensselaer

County, New York in an Aggregate Principal Amount Not To Exceed $680,000 Pursuant to the Local

Finance Law to Finance Said Purpose and Delegating the Power to Issue Bond Anticipation Notes in

Anticipation of the Sale of Such Bonds to the Town Supervisor.

Supervisor Kelley moved and Councilwoman Fasoldt seconded the following resolution:

BE IT RESOLVED, by the Town Board of the Town of Sand Lake, Rensselaer County, New York

(the “Town”) (by the favorable vote of not less than two-thirds of all of the members of the Board) as

follows:

SECTION 1. The specific purpose (hereinafter referred to as “purpose”) to be financed pursuant to this

resolution is the acquisition and construction of a sanitary sewer system for Sand Lake Sewer District

Number II. The estimated maximum cost of said purpose is $680,000.

SECTION 2. The Town Board plans to finance the total cost of said purpose by the issuance of serial

bonds of the Town in an amount not to exceed $680,000, hereby authorized to be issued therefore

pursuant to the Local Finance Law, and the cost of such improvement is to be paid by assessments upon

benefited real property in an area less than the area of said Town to the extent not covered by proceeds

of a New York State Environmental Bond Act grant heretofore committed to the Town for said purpose.

SECTION 3. It is hereby determined that said purpose is an object or purpose described in subdivision 4.

of paragraph (a) of Section 11.00 of the Local Finance Law, and that the period of probable usefulness of

said purpose is forty (40) years.

SECTION 4. It is hereby determined that the proposed maturity of the obligations authorized by this

resolution will be in excess of five (5) years.

SECTION 5. Current funds are not required to be provided prior to the issuance of the bonds authorized

by this resolution or any notes issued in anticipation of such bonds.

SECTION 6. The faith and credit of said Town are hereby irrevocably pledged for the payment of the

principal of and interest on such bonds as the same respectively become due and payable. An annual

appropriation shall be made in each year sufficient to pay the principal of and interest on such bonds

becoming due and payable in such year. There shall annually be levied on all the taxable real property

of said Town a tax sufficient to pay the principal of and interest on such bonds as the same become due

and payable.

SECTION 7. Subject to the terms and contents of this resolution and the Local Finance Law, and

pursuant to the provisions of Sections 30.00, 50.00 and 56.00 to 63.00, inclusive, of said Law, the power

to authorize bond anticipation notes in anticipation of the issuance of the serial bonds authorized by this

resolution and the renewals of said notes and the power to prescribe the terms, form and content of

said serial bonds, and said bond anticipation notes, and the power to sell and deliver said serial bonds

and any bond anticipation notes issued in anticipation of the issuance of such bonds, is hereby

delegated to the Town Supervisor, the Chief Fiscal Officer of the Town. The Town Supervisor is hereby

authorized to sign any serial bonds issued pursuant to this resolution and any bond anticipation notes

issued in anticipation of the issuance of said serial bonds, and the Town Clerk is hereby authorized to

affix the corporate seal of said Town to any of said serial bonds or any bond anticipation notes and to

attest such seal.

SECTION 8. The Town Supervisor is further authorized to take such actions and execute such documents

as may be necessary to ensure the continued status of the interest on the bonds authorized by this

resolution, and any notes issued in anticipation thereof, as excludable from gross income for federal

income tax purposes pursuant to Section 103 of the Internal Revenue Code of 1986, as amended (the

“Code”) and to designate the bonds authorized by this resolution, and any notes issued in anticipation

thereof, as “qualified tax-exempt obligations” in accordance with Section 265(b)(3) of the Code.

SECTION 9. The Town reasonably expects to reimburse itself from the proceeds of bond or notes herein

authorized for expenditures made for the purpose to be financed by this resolution prior to issuance of

such bonds or notes, and this resolution is intended to constitute a declaration of official intent to

reimburse for purposes of U.S. Treasury Regulation & 1.150-2.

SECTION 10. The Town has heretofore issued a negative declaration determining that the acquisition

and construction of a sanitary sewer system for Sand Lake Sewer District Number II will not have a

significant effect on the environment.

SECTION 11. The validity of said serial bonds or of any bond anticipation notes issued in anticipation of

the sale of said serial bonds may be contested only if:

(1) Such obligations are authorized for an object or purpose for which said Town is not authorized

to expend money, or

(2) The provisions of law which should be complied with at the date of the publication of this

resolution, or a summary hereof, are not substantially complied with, and an action, suit or proceeding

contesting such validity is commenced within twenty (20) days after the date of such publication, or

(3) Such obligations are authorized in violation of the provisions of the Constitution of New York.

SECTION 12. The Town Clerk is hereby authorized and directed to publish this resolution, or a summary

thereof, together with a notice in substantially the form provided by Section 81.00 of the Local Finance

Law, in the The Record, a newspaper having a general circulation in said Town and hereby designated as

the official newspaper of said Town for such publication.

SECTION 13. The firm of Hiscock & Barclay, LLP is hereby appointed Bond Counsel of the Town in

connection with the bonds and notes herein authorized.

SECTION 14. This resolution shall take effect immediately upon its adoption.

SUPERVISOR’S REPORT - Douglas S. Kelley

· We are working with DOT and Malloy regarding the drainage problem on NY 150 in the hamlet

of West Sand Lake.

· Saturday, August 21, 1999 we will hold Dedication Ceremonies of the New Municipal Offices and

the Sand Lake Library at 8428 Miller Hill Road.

· I have received some input from the community regarding the reconstruction of the Old Town

Hall. We are looking into reducing the cost and increasing it’s flexibility and use.

· We have received a petition from the residents in the area of NY43, Burden Lake Road and

Eastern Union Turnpike. This is still a very dangerous intersection and we will be submitting a request to

DOT to once again study this problem.

· The Rensselaer County Supervisor’s have recommended a larger portion of the Sales Tax

revenues should be returned to the towns. They feel that the formula used to distribute these revenues

should be modified.

· My office has distributed the worksheets to begin the preparation of the year 2000 budget. We

will be scheduling workshops and meetings in order for all departments to prepare their budgets.

· I would like to commend Jack Welcome and Steve Robelotto for the extensive time and effort

that they put into updating the Town’s Emergency Plan. We are still looking for a generator for the

Town.

BOARD MEMBERS REPORTS:

CABLE - Nancy Dunn - We televised the Planning Board meeting on Wednesday, August 4, 1999. We had

difficulty with the sound and were unable to contact Time Warner. There will be a phone in the building

shortly and this problem should be alleviated. We viewed the Summerfest Parade before tonight’s

meeting and will view it again on September 8, 1999.

STREETLIGHTING - Nancy Dunn - No report.

INSURANCE - Joe Trupia - No report.

ANIMAL CONTROL - Joe Trupia - On file in the Town Clerk’s Office.

YOUTH & RECREATION - Flora Fasoldt - Butler Park has had a busy season. I would like to remind

residents that there is no parking along Gettle Road and also there are no dogs allowed on town

property unless they are aiding disabled persons. The Town Beach will be open through Labor Day. We

will be notifying the students at APHS when the next Youth Court will be having instructions. The Drama

TOWN ATTORNEY - Joe Baum - Noise Ordinance - Joe reminded the residents that Section E of the

ordinance had been ruled unconstitutional. He has had some questions about the refuse trucks picking

up trash before 6:00A.M.. He will be looking into this matter.

COMMISSIONER OF PUBLIC WORKS - Steve Robelotto - On file in the Town Clerk’s Office.

YOUTH - Lynn Hamel - Day Camp has gone well. We have been having staff meetings every Thursday and

as this is our last week I would like to thank all the Counselors and CIT’s for a good summer. Also, a

special thanks to our Health Director, Brook Wagner and the donations of Chris Perry and her son, Glen.

We will be going to the Great Escape this Friday, August 13th. This is our final field trip. I would like to

thank those parents who donated tickets to the less fortunate.

LIBRARY - Sue Larsen - The shelving from Siena has been refinished and installed. The books that had

been in storage have been redistributed. The Town has given the Library $10,000 for furnishings and

other items such as the phone system. Additional contributions have also been made and these will be

addressed as part of the Open House.

The Friends of the Library will be holding an affair on 9/24 at the Crooked Lake House. They will also be

having a book sale at the Craft Fair at the APHS.

BE IT RESOLVED, that George Wright is authorized to attend the Annual Educational Conference to be

hosted by the New York State Building Officials on October 18th, 19th, & 20th, 1999. The cost of this

seminar is $185.00.

In the matter of authorizing Kestner Engineers, P.C., to submit on behalf of the Town an application

under the State Environmental Bond Act for funds to construct a Sewer System in the vicinity of Crooked

Lake.

Supervisor Kelley moved and Councilman Trupia seconded the following resolution:

WHEREAS, in 1998 the Town was awarded a grant through the State Environmental Bond Act to help

finance construction of a sanitary sewer system in a portion of proposed Sand Lake Sewer System

Number II, encompassing the area of the Town around Crooked Lake, and

WHEREAS, additional grant funding will be necessary in order to finance construction of a sewer system

in the entire area of such Sewer District, and

WHEREAS, in order to apply for such additional funding a new Environmental Bond Act application must

be submitted by the Town, and

exploring sanitary sewer installations in the Town and a substantial portion of such funds remain

available,

NOW THEREFORE IT IS HEREBY RESOLVED AS FOLLOWS:

1. The firm of Kestner Engineers, P.C. is hereby retained for the purpose of submitting an

application under the State Environmental Bond Act for a grant to help finance installation of a sanitary

sewer district in the entire area of Sand Lake Sewer District Number II. Fees and charges of such firm for

such work shall be paid at the same rates currently in effect and shall be paid by the Town utilizing the

grant money heretofore received for such purpose.

2. The Town Supervisor is hereby authorized to execute such documents, contracts and forms as

shall be necessary for submission of the Environmental Bond Act grant application.

Municipal Resolution

Resolution authorizing the items listed below pursuant to the Clean Water/Clean Air Bond Act of 1996.

WHEREAS, the Town of Sand Lake, herein called the “Municipality”, after thorough consideration of the

various aspects of the problem and study of available data, has hereby determined that certain work, as

described in its application and attachments, herein called the “Project”, is desirable, is in the public

interest, and is required in order to implement the Project; and

WHEREAS, Article 56 of the Environmental Conservation Law authorizes State assistance to

municipalities for water quality improvement projects by means of a contract and the Municipality

deems it to be in the public interest and benefit under this law to enter into a contract therewith;

NOW, THERFORE, BE IT RESOLVED BY the Sand Lake Town Board

1. That Douglas S. Kelley, Supervisor or such person’s successor in office, is the representative

authorized to act in behalf of the Municipality’s governing body in all matters related to State Assistance

under ECL Article 56, Title 3. The representative is also authorized to make application, execute the

State Assistance Contract, submit Project documentation, and otherwise act for the Municipality’s

governing body in all matters related to the Project and to State assistance;

2. That the Municipality agrees that it will fund its portion of the cost of the Project and that funds

will be available to initiate the Project’s field work within twelve (12) months of written approval of its

application by the Department of Environmental Conservation;

3. That one (1) certified copy of this Resolution be prepared and sent to the Albany office of the

New York State Department of Environmental Conservation together with the Application for State

Assistance Payments;

4. That this Resolution take effect immediately.

· Dave Winkler gave a short presentation regarding a Variance that the Town is requesting in

regards to plans for the Old Town Hall.

· The State Police Grant has been extended to the end of 2000.

CABLE - Nancy Dunn - The video on the Dedication and Tour of the new Municipal Building was shown

STREETLIGHTING - Nancy Dunn -There will be no increase in the cost of streetlights for the year 2000.

NYSEG is having some trees trimmed by an outside firm.

YOUTH & RECREATION - Flora Fasoldt - Butler Park has been very busy with numerous activities. It is

being used by many organizations. The congestion is going to be addressed at the Board of Director’s

YOUTH COURT - Flora Fasoldt -There will be a new training session for the Rensselaer County Youth

Court starting up this fall. For more information, contact your liaison at the Averill Park High School.

YOUTH PROGRAMS - Lynn Hamel - On Friday, October 15th, the Town of Sand Lake along with Hoffay

Farms will be sponsoring a Harvest Hay Ride for families in Sand Lake. The rain date for this occasion will

be October 22nd. I would like to commend Joan Fuess and Susan Frost and the Sand Lake children who

participated in this Drama Program. They did a fine job and all enjoyed their production.

LIBRARY - Flora Fasoldt - The Toddler’s Program will be starting on September 21st with the Pre-School

starting up on September 23rd. Bed Time Stories will be the 1st and 3rd Wednesday of the month. They

will be an Internet Skills Training Workshop for interested Parents and Children on Monday, September

27, 1999. Preregistration is recommended. Library Director, Carolyn McLoughlin has resigned effective

Friday, September 1st, 1999. She will be taking a position with the Cohoes City School District. Jane

Minotti has been appointed as the interim director.

presented to the Town Board who then refers this matter to the Planning Board.

Planning Federation Annual Conference on October 17th through October 20th, 1999 in Ellenville, New

York and that the Town reimburse those attending pursuant to the attached memo from the Planning

Board up to an amount not exceeding $431.00 plus mileage.

addressed in the near future.

OCTOBER 13, 1999

The regular monthly meeting of the Town Board of the Town of Sand Lake was called to order by

Supervisor Kelley at 7:30 P.M. at the Old Town Hall in Sand Lake, New York. After the Pledge of

Allegiance, the following answered roll call:

· Read aloud legal notice regarding bids on Plow and dump body for F550 Ford Dump Truck.

· There were two bids received, one from Zwack, Inc. for $18,795.00 and one from T & T Sales,

Inc. for $18,168.00.

SUPERVISOR’S REPORT - Douglas S. Kelley

· The surveying for the Sand Lake Sewer District Number II has started. We have a tentative

schedule from the engineers with completion slated for 7/17/2000.

· The Tentative budget for the year 2000 has been presented to the Town Board. We will be

having our first workshop this Saturday at 9:30 a.m. at the new municipal offices. From there, we will set

up a schedule of workshops which will enable us to formulate a preliminary budget. We will notify the

public of the date, time and place of these workshops.

· There will be an informational meeting regarding the proposed Averill Park water District at the

Averill Park High School on Thursday, October 21, 1999 at 7:00 p.m.

· We have installed a new flag pole at the new Municipal Offices at 8428 Miller Hill Road. The

Town was presented with a flag from Woodmen of the World on Saturday October 9, 1999. The flag was

presented by Carol Seneta.

· We have an opening for a Court Officer. If anyone is interested please contact my office.

· There will be a Tire Disposal Day on Saturday, October 23, 1999 at the Convenience Facility.

Permits are available at the Town Clerk’s office.

BOARD MEMBER REPORTS:

CABLE - Nancy Dunn- Time Warner has been rebuilding their system in preparing for the Road Runner

Program. We were unable to broadcast the meeting because a wire had broken off the dial card and we

couldn’t switch over to broadcast.

STREETLIGHTING - Nancy Dunn - Nothing to report.

YOUTH - Flora Fasoldt - There will be a Hayride and Bonfire/ Marshmallow Roast Scary Stories and

Music at Hoffay’s farm on Friday October 15th from 5:30 P.M. to 8:00 P.M.

YOUTH COURT - Flora Fasoldt - A new training session will begin on 10/18/99 for 8 consecutive weeks.

Anyone interested should contact the school liaison or the Town Justice.

held 10/23/99. Jane Minotti has been appointed the Director of the Sand Lake Library.

COMMENTS FROM RESIDENTS:

· Ed Patanian thanked the Sand Lake Library for picking up their Fund Raising activities. He would

like to see some work done on their budget regarding salaries.

· Ed Patanian regarding Speed Limit Reductions - feels that enforcement should be an issue in

lieu of lowering the speed limit.

Request for Speed Reduction.

Supervisor Kelley moved and Councilman Welcome seconded the following resolution:

WHEREAS, requests have been made to reduce the speed limit on Glass Lake Road because of

sight distance, curves, pedestrian traffic, existing and proposed housing density, and

WHEREAS, the public health, safety and welfare would be served by a reduction in the speed

limit,

THEREFORE BE IT RESOLVED,

The Town of Sand Lake, pursuant to Vehicle and Traffic Law Section 1622, hereby requests the

State Department of Transportation and County Superintendent of Highways to reduce the speed limit

on Glass Lake Road from NY 43/66 to Eastern Union Turnpike from 40 mph to 30 mph.

The Town Board directs the Town Supervisor and the Commissioner of Public Works to take

whatever steps are necessary to carry out this resolution.

RESOLUTION # 70-99

Request for Speed Reduction.

Supervisor Kelley moved and Councilwoman Fasoldt seconded the following resolution:

WHEREAS, requests have been made to reduce the speed limit on Snake Hill Road because of

sight distance, curves, pedestrian traffic, existing and proposed housing density; and,

Authorization to advertise for Cleaning Services for the Year 2000.

Supervisor Kelley moved and Councilwoman Fasoldt seconded the following resolution:

BE IT RESOLVED, that the Town Clerk is authorized to advertise for bids for the purpose of

cleaning the Sand Lake Municipal Offices and Sand Lake Library for the year 2000. Specifications have

been prepared by the Commissioner of Public Works and are available at the Town Clerk’s office during

regular business hours.

Authorization to advertise for bids for Refuse Removal for the Year 2000.

Supervisor Kelley moved and Councilman Trupia seconded the following resolution:

BE IT RESOLVED, that the Town Clerk is authorized to advertise for bids for the purpose of

Refuse Removal for the year 2000. Specifications have been prepared by the Commissioner of Public

Works and are available at the Town Clerk’s office during regular business hours.

Travel request; Justice Department.

Supervisor Kelley moved and Councilman Trupia seconded the following resolution:

BE IT RESOLVED that Town Justice Shulman and Court Clerk Peggy Burkart are authorized to

attend the NYS Association Magistrates Annual Conference to be held at the Nevelle Hotel from October

11th through October 13th, 1999 and each shall be compensated up to $500.00 for their documented

actual and necessary expenses.

Travel request; Zoning Board of Approval.

Supervisor Kelley moved and Councilwoman Fasoldt seconded the following resolution:

BE IT RESOLVED that ZBA Member Geraldine Burger is authorized to attend the NY Planning

Federation Annual Conference Sessions on October 17th - October 20th, 1999 in Ellenville, New York

and that the Town reimburse Ms. Burger up to an amount not exceeding $496.00.

RESOLUTION # 76-99

Request for additional allocation for Seniors.

Supervisor Kelley moved and Councilwoman Fasoldt seconded the following resolution:

WHEREAS, the Sand Lake Seniors do not have sufficient funds to schedule their December trip

to be scheduled,

Supervisor Kelley moved and Councilwoman Dunn seconded the following resolution:

BE IT RESOLVED, that a Public Hearing be held upon the Preliminary Budget on Thursday,

November 4, 1999 at 7:30 P.M.

RESOLUTION # 78-99

Approve October 1999 Fund Warrant.

Supervisor Kelley moved and Councilman Welcome seconded the following resolution:

BE IT RESOLVED, that the October 1999 Fund Warrant from Claim # 974 to #1069 be approved

as audited: General Fund $29,114.31; Highway Fund $ 264,419.48; Municipal Account $ 2,274.17; Sewer

Study $ 6,798.63; Streetlighting $ 5,659.21 Sewer Fund $ 9,328.94 for a total of $ 317,594.74.

EXECUTIVE SESSION:

Supervisor Kelley made the motion to adjourn the Regular Town Board meeting and move into

Executive Session at 8:37 P.M.

MOTION CARRIED: UNANIMOUS

At 8:37 P.M. the Executive Session was called to order. At this time Attorney Baum passed out

literature from two other municipalities regarding their Noise Ordinance. This was for input only. He also

addressed a personnel problem and said that he will keep the Board informed of this matter.

Supervisor Kelley made the motion to adjourn the Executive Session and reconvene the Regular

Town Board meeting at 8:42 P.M.

SUPERVISOR’S REPORT - Douglas S. Kelley

· Salem United Methodist Church of Shaver Road, West Sand Lake is interested in the extension

of the Sand Lake Sewer District No. I. I had a meeting with two members of the Board of Trustee’s and

the Sewer Attorney. They will be following up on this with a letter to Town Board Members and also to

Kestner Engineers.

· The Town of Sand Lake will have a hearing with the State of New York regarding a Variance for

the Old Town Hall in order to accommodate the State Police along with the Court System and the

renovations of this building. The estimated cost of renovating this building is approximately $400,000.

There is a $93,000 Grant for the State Police facilities and also a sum of $72,000 for outside

improvements.

· We are working on the Budget Preparation and will have it finalized by November 20, 1999.

· The Tire Day on October 23, 1999 was quite successful. We collected over 700 tires.

and the Circle Theatre Players.

YOUTH - Lynn Hamel - The Hayride of October 15 was a huge success. Lynn thanked all involved. There

will be a Holiday Craft on December 9th, 1999 at 6:30 P.M. in the new Municipal Offices located at 8428

COMMENTS:

· Frank Allen - concerned regarding the safety of the new town offices. Requested that the Speed

Limit sign be moved further east to adequately notify the public of the proper speed limits.

BUSINESS:

RESOLUTION # 80-99

In the matter of making a temporary appointment to the position of Clerk to the Assessor.

Supervisor Kelley moved and Councilman Welcome seconded the following resolution:

WHEREAS, the position of Clerk to the Assessor is currently vacant due to illness and

WHEREAS, it is in the interest of the Town that such position be filled so that the business of the

Town may proceed in an orderly and expeditious fashion,

NOW THEREFORE IT IS HEREBY RESOLVED AS FOLLOWS:

Rhoda Hale is hereby appointed to the position of Clerk to the Assessor for a 30 day temporary

position only, at the rate of $8.91 per hour.

approved as audited: General Fund $ 53,519.50; Highway Fund $ 135,594.41; Municipal Account $

1,598.00; Streetlighting $ 5,659.21 and Sewer $ 4,278.35 for a total of $ 200,649.47.

Application for Grant - Justice Court Assistance Program Grant.

Supervisor Kelley moved and Councilwoman Fasoldt seconded the following resolution:

BE IT RESOLVED, that the Town Justice Department is authorized to make application under the

1999 Justice Court Assistance Program Grant for a grant to aid and assist in the operation of the Justice

Court. Grant money is available to update automation, purchase equipment, furniture, legal reference

materials, benches and can also be used for training/education of the Justices and staff.

Adoption of the Year 2000 Annual Budget.

Supervisor Kelley moved and Councilman Trupia seconded the following resolution:

WHEREAS, the Town Supervisor presented his Year 2000 Tentative Budget to the Town Board

on October 2, 1999

WHEREAS, the Town Board conducted a Public Hearing on it’s Budget on November 4, 1999;

NOW THEREFORE BE IT RESOLVED, that the Year 2000 Preliminary Budget, as revised to reflect

the following amendments, is adopted as the Year 2000 Annual Budget.

The regular monthly meeting of the Town Board of the Town of Sand Lake was called to order by

Supervisor Kelley at 7:30 P. M. at the Old Town Hall, in Sand Lake, New York. After the Pledge of

RESOLUTION # 85-99

Appointment of New Court Clerk.

Supervisor Kelley moved and Councilman Trupia seconded the following resolution:

BE IT RESOLVED, that the Town Judges, Morton D. Shulman and David W. Fryer are authorized

to appoint a new Court Clerk due to the current Clerk, Peggy Burkart, submitting her notice of

resignation. The new clerk will start immediately and Ms. Burkart will stay on until such time that the

new clerk is familiar with the workings of the Court.

Award Contract to Mohawk Hudson Humane Society.

Councilman Trupia moved and Councilwoman Fasoldt seconded the following resolution:

WHEREAS, the Animal Shelter Agreement with Mohawk and Hudson River Humane Society is

THEREFORE, BE IT RESOLVED, that the Supervisor, after review by the Town Attorney is hereby

directed to execute the appropriate agreement for the services and use of the facility of the Mohawk

and Hudson River Humane Society.

Awarding Cleaning Services.

Supervisor Kelley moved and Councilwoman Fasoldt seconded the following resolution:

WHEREAS, the Town of Sand Lake advertised for proposals for cleaning services in the Troy

Record on October 25th and November 1st, 1999 and in the Sand Lake Advertiser on October 30th and

November 6th, 1999,

WHEREAS, several proposals have been received and reviewed by the Commissioner of Public

Works;

THEREFORE, BE IT RESOLVED, that upon the recommendation of the Commissioner of Public

Works the proposal of JC Landscaping & General Contracting is hereby accepted to provide cleaning

services for the Sand Lake Municipal Offices and Sand Lake Library for the Year 2000 beginning January

1, 2000.

A motion was moved by Supervisor Kelley and seconded by Councilman Welcome to send a

request to NYSDOT regarding the Speed Limit of NY66.
