The Ministry of Environment, Forests & Climate Change has considered the application. It is noted that the proposal is for grant of Environmental Clearance for Proposed redevelopment of L.I.G-II A, B & C situated on land bearing S.No.22, H.No.l to 11(pt) at village Chikanghar, Tal: Kalyan, Dist: Thane, Maharashtra by Mis Tycoons Avanti Projects LLP. The proposal was considered by the EAC in its meetings held on 26 th - 28 th November, 2014 and 6 th - 7th January, 2015. The proponent has informed that: 1. The proposal involves redevelopment of L.I.G-II A, B & C situated on land bearing S.No.22, H.No.1 to 11(pt) at village Chikanghar, Tal: Kalyan, Dist: Thane, Maharashtra. 11. The plot area of proposed site is 8,790.83 sqm. FSI area is 41.004.21 sqm and total construction area of 1,14,093.76 sqm. The project comprises one rehab building with two towers and 1 sale building with 3 towers. Total 705 tenements will be developed. Maximum height of the building will be 91.35 m. 111. Total water requirement is 490 KLDwhich will be met from the supply of KDMCand reuse of treated wastewater. Fresh water requirement will be 322 KLD. The wastewater generation is estimated to be 457 KLDwhich is proposed to be treated in two STP of total 480 KLD capacity. It is proposed to reuse about 168 KLD of treated wastewater for flushing, about 50 KLDfor landscape. IV. Total solid waste generation is estimated to be 1823 kg/ day. This has reference to your application Nil dated 24.09.2014 andsubsequent letters dated 24.11.2014, 25.12.2014 and 02.02.2015 seekingprior Environmental Clearance on the above-mentioned subject.

2. The Ministry of Environment, Forests & Climate Change has consideredthe application. It is noted that the proposal is for grant of EnvironmentalClearance for Proposed redevelopment of L.I.G-II A, B & C situated onland bearing S.No.22, H.No.l to 11(pt) at village Chikanghar, Tal: Kalyan,Dist: Thane, Maharashtra by Mis Tycoons Avanti Projects LLP. v. Parking facility for 380 ECS is proposed to be provided against therequirement of 359 ECS (according to local norms).

VI. Rooftop rainwater harvesting potential is estimated to be 85 KLD andwill be collected in 4 RWHtanks of total 170KLDcapacity for harvestingafter filtration.

VlI. The total power requirement is 436 MW which will be met throughMSEDCL.

vin. Two D.G sets of 320 kVAare proposed as standby.IX. Proposed energy saving measures would save about 23.06% of power.x. The cost of the project is Rs.260 Crore.

Xl. Wildlife issues: It is not located within 10 km of Eco-Sensitive areas .. -XlI. Forest land: No forest land involved in the project.xni. There is no court cases/violation pending with the project proponent.XlV. The Project Proponent vide letter no. Nil dated 02.02.2015 has given

undertaking that he is in possession of land and as per registereddevelopment agreement as well as valid NOC from MHADAfor FSI to beconstructed for the entire project.

3. The proposal was considered by the EAC in its meeting held on 26th -28th November, 2014 and sought additional information viz. the DG sets areproposed to be located at the boundary, the Committee suggested to relocateinside the plot and submit the revised layout, obtain Fire clearance, keeping inview of the commercialisation of the building, the parking proposed appearsinadequate and will clog the road. PP shall provide adequate parking andsubmit revised layout.

4. The proposal was again considered by the Expert Appraisal Committee(EAC)and recommended in its 143rd EAC meeting held on 6th - 7th January,2015 for granting Environmental Clearance. The Ministry of Environment,Forests & Climate Change hereby accords Environmental Clearance for theabove-mentioned Proposed redevelopment of L.I.G-II A, B & C situated onland bearing S.No.22, H.No.1 to 11(pt) at village Chikanghar, Tal: Kalyan,Dist: Thane, Maharashtra by M/s Tycoons Avanti Projects LLP under theprovisions of the Environment Impact Assessment Notification, 2006 andamendments thereto and Circulars issued thereon and subject to thecompliance of the following specific conditions, in addition to the generalconditions mentioned below:

PARTA - SPECIFICCONDITIONS

I. Construction Phase

(i) The Project Proponent shall obtain all necessary clearance/permission from all relevant agencies including town planningauthority before commencement of work.

(ii) "Consent for Establishment" shall be obtained from State PollutionControl Board under Air (Prevention and Control of Pollution) Act,1981 and Water (Prevention arid Control of Pollution) Act, 1974.

(iii) The plot area of proposed site is 8,790.83 sqm. FSI area shall be41.004.21 sqm and total construction area shall be 1,14,093.76sqm. The project shall comprise one rehab building with two

towers and 1 sale building with 3 towers. Total 705 tenementsshall be developed. Maximum height of the building shall be 91.35m.

(iv) Total water requirement is 490 KLD which shall be met from thesupply of KDMC and reuse of treated wastewater. Fresh waterrequirement shall be 322 KLD. The wastewater generation is 457KLDwhich shall be treated in two STPs of total 480 KLDcapacity.

(v) Total solid waste generation shall be 1823 kg/day.

(vi) Parking facility for 380 ECS shall be provided against therequirement of 359 ECS (according to local norms).

(vii) Rooftop rainwater harvesting potential is 85 KLD and shall becollected in 4 RWH tanks of total 170KLD capacity for harvestingafter filtration.

(viii) The total power requirement is 436 MW which shall be metthrough MSEDCL.

(ix) Two D.G sets of 320 kVA shall be installed as standby.

(x) The project proponent shall comply with the conditions ofNOC/Clearance obtained from Fire Department.

(xi) All the construction shall be in accordance with the local buildingbyelaws. The Project Proponent shall obtain all necessaryclearances.

(xii) The project proponent shall put in place a credible enforcementmechanism for compliance of energy conservation measures withits allottees, as projected, in perpetuity. This would be monitoredby the designed Energy Conservation/ efficiency Authority in theState.

(xiii) D.G set shall be at least 6 m away from the boundary.

(xiv) Temporary toilets will be provided for all construction labour.

(xv) Suitable toilet fixtures for water conservation shall be provided.

(xvi) Proponent shall obtain permission for ground water withdrawalfrom State Ground Water Authority.

(xvii) The rainwater harvesting plan should be incorporated by theCGWA.

(xviii) Provision shall be made for the housing of construction labourwithin the site with all necessary infrastructure and facilities suchas fuel for cooking, mobile toilets, mobile STP, safe drinking water,medical health care, creche etc. The housing may be in the form oftemporary structures to be removed after the completion of theproject.

(xix) A First Aid Room will be provided in the project both duringconstruction and operation of the project.

(xx) All the topsoil excavated during construction activities should bestored for use in horticulture/landscape development within theproject site.

(xxi) Disposal of muck during construction phase should not create anyadverse effect on the neighbouring communities and be disposedtaking the necessary precautions for general safety and healthaspects of people, only in approved sites with the approval ofcompetent authority.

(xxii) Soil and ground water samples will be tested to ascertain that thereis no threat to ground water quality by leaching of heavy metalsand other toxic contaminants.

(xxiii)Construction spoils, including bituminous material and otherhazardous materials, must not be allowed to contaminatewatercourses and the dump sites for such material must besecured so that they should not leach into the ground water.

(xxiv)Any hazardous waste generated during construction phase, shouldbe disposed off as per applicable rules and norms with necessaryapprovals of the State Pollution Control Board.

(xxv) The diesel generator sets to be used during construction phaseshould be low sulphur diesel type and should conform toEnvironment (Protection) Rules prescribed for air and noiseemission standards.

(xxvi)The diesel required for operating DG sets shall be stored III

underground tanks and clearance from Chief Controller ofExplosives shall be taken, as applicable.

(xxvii)Vehicles hired for bringing construction material to the site shouldbe in good condition and should have a pollution check certificateand should conform to applicable air and noise emission standardsand should be operated only during non-peak hours.

(xxviii)Ambient noise levels should conform to residential standards bothduring day and night as per Noise Pollution (Control andRegulation) Rules, 2000. Incremental pollution loads on theambient air and noise quality should be closely monitored duringconstruction phase. Adequate measures should be made to reduceambient air and noise level during construction phase, so as toconform to the stipulated standards by CPCB/ SPCB.

(xxix) Fly ash should be used as building material in the construction asper the provisions of Fly Ash Notification of September, 1999 andamended as on 27th August, 2003.

(xxx) Ready mixed concrete must be used in building construction.

(xxxi) Storm water control and its re-use as per CGWB and BISstandards for various applications.

(xxxii) Water demand during construction should be reduced by use ofpre-mixed concrete, curmg agents and other best practicesreferred.

(xxxiii) Permission to draw ground water shall be obtained from thecompetent Authority prior to construction/ operation of the project.

(xxxiv) Separation of grey and black water should be done by the use ofdual plumbing line for separation of grey and black water.

(xxxv) Fixtures for showers, toilet flushing and drinking should be of lowflow either by use of aerators or pressure reducing devices orsensor based control.

(xxxvi) Use of glass may be reduced by up-to 40% to reduce the electricityconsumption and load on air-conditioning. If necessary, use highquality double glass with special reflective coating in windows.

(xxxvii)Regular supervision of the above and other measures formonitoring should be in place all through the construction phase,so as to avoid disturbance to the surroundings.

(xxxviii)Under the provisions of Environment (Protection) Act, 1986, legalaction shall be initiated against the project proponent if it wasfound that construction of the project has been started withoutobtaining environmental clearance.

II. Operation Phase

(i) The quantity of fresh water usage, water recycling and rainwaterharvesting shall be measured and recorded to monitor the waterbalance as projected by the project proponent. The record shall besubmitted to the Regional Office, MoEF&CC along with sixmonthly Monitoring reports.

(ii) The treated wastewater of 168 KLD shall be recycled and reusedfor flushing and landscaping (50 KLD) to reduce the demand offresh water as committed.

(iii) Solid waste management shall be collected, treated disposed inaccordance with the Municipal Solid Waste (Management &Handling) Rules, 2000. No municipal waste should be disposed offoutside the premises.

(iv) The Operation and Maintenance of STP shall be made in the MoUwith STP supplier. Project Proponent shall ensure regularoperation and maintenance of the STP.

(v) Parking facility with 6 m clear driveway shall be provided ascommitted.

(vi) The Project Proponent shall explore the possibilities of reusing thetreated wastewater from nearby projects.

(vii) The installation of the Sewage Treatment Plant (STP) should becertified by an independent expert and a report in this regard

should be submitted to the Ministry before the project iscommissioned for operation. Treated affluent emanating from STPshall be recycled/ reused to the maximum extent possible.Treatment of 100% grey water by decentralized treatment shouldbe done. Discharge of unused treated affluent shall conform to thenorms and standards of the State Pollution Control Board.Necessary measures should be made to mitigate the odourproblem from STP.

(viii) The solid waste generated should be properly collected andsegregated. Wet garbage should be composted and dry/inert solidwaste should be disposed off to the approved sites for land fillingafter recovering recyclable material.

(ix) Diesel power generating sets proposed as source of back-up powerfor elevators and common area illumination during operationphase should be of enclosed type and conform to rules madeunder the Environment (Protection) Act, 1986. The height of stackof DG sets should be equal to the height needed for the combinedcapacity of all proposed DG sets. Use low sulphur diesel. Thelocation of the DG sets may be decided with in consultation withState Pollution Control Board.

(x) Noise should be controlled to ensure that it does not exceed theprescribed standards. During night time the noise levels measuredat the boundary of the building shall be restricted to thepermissible levels to comply with the prevalent regulations.

(xi) The green belt of the adequate width and density preferably withlocal species along the periphery of the plot shall be raised so as toprovide protection against particulates and noise.

(xii) Rain water harvesting for roof run-off and surface run-off, asplan submitted should be implemented. Before recharging thesurface run off, pre-treatment must be done to remove suspendedmatter, oil and grease. The borewell for rainwater rechargingshould be kept at least 5 mts. above the highest ground watertable.

(xiii) Energy conservation measures like installation of CFLs/TFLs forthe lighting the areas outside the building should be integral partof the project design and should be in place before projectcommissioning. Use CFLs and TFLs should be properly collectedand disposed off/sent for recycling as per the prevailingguidelines/rules of the regulatory authority to avoid mercurycontamination. Use of solar panels may be done to the extentpossible.

PART - B. GENERAL CONDITIONS

(i) A copy of the environmental clearance letter shall also be displayedon the website of the concerned State Pollution Control Board. TheEC letter shall also be displayed at the Regional Office, District

Industries centre and Collector's Office/ Tehsildar's office for 30days.

(ii) The funds earmarked for environmental protection measures shallbe kept in separate account and shall not be diverted for otherpurpose. Year-wise expenditure shall be reported to this Ministryand its concerned Regional Office.

5. Officials from the Regional Office of MoEF&CC, Nagpur who would bemonitoring the implementation of environmental safeguards should be givenfull cooperation, facilities and documents/data by the project proponentsduring their inspection. A complete set of all the documents submitted toMoEF&CC should be forwarded to the CCF, Regional office of MoEF&CC,Nagpur.

6. In the case of any change(s) in the scope of the project, the project wouldrequire a fresh appraisal by this Ministry.

7. The Ministry reserves the right to add additional safeguard measuressubsequently, if found necessary, and to take action including revoking of theenvironment clearance under the provisions of the Environmental (Protection)Act, 1986, to ensure effective implementation of the suggested safeguardmeasures in a time bound and satisfactory manner.

8. All other statutory clearances such as the approvals for storage of dieselfrom Chief Controller of Explosives, Fire Department, Civil AviationDepartment, Forest Conservation Act, 1980 and Wildlife (Protection) Act, 1972etc. shall be obtained, as applicable by project proponents from the respectivecompetent authorities.

9. These stipulations would be enforced among others under the provisionsof Water (Prevention and Control of Pollution) Act, 1974, the Air (Prevention andcontrol of Pollution) act 1981, the Environment (Protection) Act, 1986, thePublic Liability (Insurance) Act, 1991 and EIA Notification, 2006.

10. The project proponent should advertise in at least two local Newspaperswidely circulated in the region, one of which shall be in the vernacular languageinforming that the project has been accorded Environmental Clearance andcopies of clearance letters are available with the State Pollution Control Boardand may also be seen on the website of the Ministry of Environment, Forests &Climate Change at http://www.envfor.nic.in. The advertisement should bemade within Seven days from the date of receipt of the Clearance letter and acopy of the same should be forwarded to the Regional Office of this Ministry atNagpur.

11. This Clearance is subject to final order of the Hon'ble Supreme Court ofIndia in the matter of Goa Foundation v/ s. Union of India in Writ Petition (Civil)No.460 of 2004 as may be applicable to this project.

12. Any appeal against this clearance shall lie with the National GreenTribunal, if preferred, within a period of 30 days as prescribed under Section16 of the National Green Tribunal Act, 2010.

13. A copy of the clearance letter shall be sent by the proponent to concernedPanchayat, Zilla Parisad z Municipal Corporation, Urban Local Body and theLocal NGO, if any, from whom suggestions/ representations, if any, werereceived while processing the proposal. The clearance letter shall also be put onthe website of the company by the proponent.

14. The proponent shall upload the status of compliance of the stipulated ECconditions, including results of monitored data on their website and shallupdate the same periodically. It shall simultaneously be sent to the RegionalOffice of MoEF&CC, the respective Zonal Office of CPCB and the SPCB. Thecriteria pollutant levels namely; SPM, RSPM, S02, NOx (ambient levels as wellas stack emissions) or critical sectoral parameters, indicated for the projectshall be monitored and displayed at a convenient location near the main gate ofthe company in the public domain.

15. The environmental statement for each financial year ending 31st March inForm-Vas is mandated to be submitted by the project proponent to theconcerned State Pollution Control Board as prescribed under the Environment(Protection) Rules, 1986, as amended subsequently, shall also be put on thewebsite of the company along with the status of compliance of EC conditionsand shall also be sent to the respective Regional Offices of MoEF&CCbye-mail.
