  • What is TITLE IX ? “Title IX prohibits sex discrimination in educational institutions that

    receive federal funding. Under Title IX, schools are legally required to respond and remedy hostile educational

    environments and failure to do so is a violation that means school could risk losing its federal funding.” – Know Your IX

Why is Title IX important?

    ❑ Sexual harassment and sexual violence interfere with students’ rights to receive an education free from discrimination.

  • DEFINE: Affirmative Consent

    ▪ informed, ▪ affirmative, YES MEANS YES▪ conscious, ▪ voluntary, ▪ continuous▪ and mutual agreement to engage in sexual activity. ▪ Standard of consent for universities, not for the

    criminal justice system

  • What is a Responsible Employee ?

    ▪ An employee who has been given the duty of reporting incidents of sexual harassment/misconduct or any other misconduct by students to the Title IX coordinator or other appropriate designee; or

    ▪ An employee who a CSU community member reasonably believes has this authority or duty.

  • The responsible employee needs to advise the student…

    ▪ warn the student of the your obligation to report any information the student reveals to the Title IX coordinator,

    ▪ Let them know that the University works hard to maintain their confidentiality, but cannot guarantee it.

    ▪ Let them know you can help connect them with counseling, advocacy, health, mental health or other sexual assault-related resources who are not obligated to report it to the Title IX coordinator.

    A Note on Discrimination, Harassment, and Retaliation (DHR) Title IX and CSU policy prohibit discrimination, harassment and retaliation, including Sex Discrimination, Sexual Harassment or Sexual Violence. CSUEB encourages anyone experiencing such behavior to report their concerns immediately. CSUEB has both confidential and non-confidential resources and reporting options available to you. Non-confidential resources include faculty and staff, who are required to report all incidents and thus cannot promise confidentiality. Faculty and staff must provide the campus Title IX coordinator and or the DHR Administrator with relevant details such as the names of those involved in an incident. For confidential services, contact the Confidential Advocate at 510-885-3700 or go to the Student Health and Counseling Center. For 24-hour crisis services call the BAWAR hotline at 510-845-7273.
