Hello everyone, and to all I wish a happy holidays! In our industry, around this time, there's typically a lot of sleepless nights when fulfilling the increased demand for tires! Hopefully, as a member of our organization, there is just as much demand for news! In this months news letter I'd like to give you a brief introduction on the direction our organization will be headed, as well as a preview for what will be discussed by our Vice President, Shaun Fitzgerald in the Fitz Report.

As you may know, we currently hold an annual dinner meeting during January. The idea of this meeting is to educate our members on current matters effecting the industry, create a personalized social experience for our members, feed our members, raise money towards future events and our scholarship award(s), and lastly to have a good time! At a recent meeting with our board of directors, it was decided that January was perhaps not the best time to hold these meetings. Based on the seasonal nature of our industry, and common vacation timing, we accumulated interest in finding a more feasible time for our members to attend. The intentions of this change were strictly formed on the basis of increasing attendance during a busy quarter. The solution was to have a meeting in February when business falls typically back to normal levels, and vacationing is less frequent.

The next change regarding these meetings considers how much our members are realistically receiving from attendance. This organization is moving in a direction focused on what the organization can do for you, rather than what you can do for it. We wish to fulfill the initial purpose(s) of these meetings to their fullest. In the past, there's been great speakers brought in, great food consumed, money raised, and a joyful time shared; however, we're looking to make this a more exclusive meeting involving a more educational experience. We're currently set out to provide you with a first or near firsthand experience involving updated procedures when working on vehicles. We hope to provide vital information that can be utilized by our members to benefit there businesses productivity. With that said, we hope more of our members bring with them employees who would benefit from such knowledge. Our meeting location is set to be at Rosedale technical institute where members will be able to enjoy all they did previously, with the addition of having a greater purpose to attend. There will likely be more specific details in next months news letter, so stay tuned!

I do want to make sure that everyone also does have a chance to take a look at Vice President Shaun Fitzgerald's industry update in the Fitz Report.The information provided concerns everyone in our organization. With all tire sells, change could be occurring on a national level regarding the data on individual tires sold, so please be sure to read this section of the paper, and to see what we can do take make a difference.

Lastly, If anyone has any thoughts on any of the above information, or is looking for more updated details, please be sure to contact me. I'm looking forward to doing everything I can to benefit you as a member and our organization as a whole. I am also open to discussion on any ideas you may have regarding our future functions, and would love to hear what you would like to receive as a member attending such events. FTC Approves Final Consent Order Against BMW: The Federal Trade Commission has approved a final consent order against BMW of North America LLC, whose MINI division allegedly violated the Magnuson-Moss Warranty Act by telling consumers that BMW would void their war-ranty unless they used MINI parts and MINI dealers to perform maintenance and repair work. In March 2015, BMW agreed to settle with the FTC that it violated provisions of the Warranty Act. The consent order against BMW will remain in effect for 20 years.

Highway Bill Passes House: On November 5th, the U.S. House of Representatives passed a six-year highway bill. The House and Senate bills now go to conference committee to work out the differences. Included in the Drive Act is the new tire registration mandate.

History: In 1970 the NHTSA demanded detailed registration information and levied fines on independent dealers who had failed to comply. The businesses installing tires were required to fill out paper registration forms that included the tire’s DOT number, size & brand along with customer contact information. It was the responsibility of the business installing the tires to properly fill-out and mail-in these forms. In 1982, Congress changed the requirements to establish a voluntary registration process in which customers, rather than dealers, voluntarily registered their tires. This process is similar for other consumer products, such as child safety seats and toys, where the purchaser voluntarily registers their purchase to get re-call notices. In 2008 a revision was made so tire dealers could electronically transmit the tire information, DOT # and purchaser’s name and address. All tire outlets owned by tire manufacturers are required to use this system. Many independent tire dealers, including most large chains, have opted to use electronic tire registration. The tire installing business is required to properly enter the information. This system eliminates the need for the paper cards or having the purchaser fill-out and mail in the cards.

Drive Act: Some of the provisions in the Drive Act that are opposed by Tire Dealers include: * Shifting of the liability and cost for tire registration to the retailer. * Returning to a paper registration system that requires the tire installer to fill-out all information and send in. * Requiring retailers to turn their customer lists over to manufacturers. * Fining retailers up to $1,000 per tire and $700,000 per location for failure to properly register tires.

FITZ Opinion: The National Transportation Safety Board (NTSB) released their report and it contained some headline grabbing lines such as “Tire registration has failed and motorist’s lives are being put in jeopardy.” Since riding on tires is something most all of the public does the media outlets are quick to sensationalize the story and are sure to show vehicles rolled over, tires up, after an accident. Many of our members received calls from local media outlets and some conducted TV/Radio interviews. I believe that most tire dealers will agree that the current registration process can be improved and this is a complicated issue. I believe the federal government left on their own will not design a registration system that is truly effec-tive. Also having tire dealers and tire manufacturers trying to shift cost and responsibility to the other will not result in a good system. With all of the technology tools available in today’s marketplace there are better options than written cards. There are a number of issues still to be addressed. What about all the tires being sold by online tire retailers that never see the car? What about those online tires that are installed at tire retailers but not sold by them? What about the mounted tire & wheel assembles shipped directly to consumers to install? What about used tires? What about when a car is sold and the tires transfer ownership? Do tire dealers really want to give a list of customers that bought a particular tire brand to that tire manufac-turer just as the manufacturers are starting to market and sell directly to consumers? Why not place easy to read DOT numbers on both sides of the tire? Why not a Government website that consumers and tire shops can type in a DOT # to see if it is on recall? What types of tires should this apply to? Can one process work for tire dealers utilizing the latest technology and for tire dealers with no computer system that handwrite invoices? These are just some of the questions and concerns that need to be addressed. I believe the best chance of getting a workable tire registration process is if tire dealers, tire manufacturers, the NTSB and our elected officials work together. The end goal is public safety. This is a complicated undertaking and time is needed to make sure a good system is crafted that is not to burdensome on small business.

On November 11th Ron Brutt sent the following message to association members. Please read the note and go to the link. I believe the tire dealers need to make their concerns heard through the TIA. I am hopeful that these efforts can bring to light the complexity of this issue and the need for all parties impacted by any new regulations play a role in the crafting of any new regulations.

Dear Fellow Member

As you have probably heard the NHTSB is recommending that mandatory registration be reinstated at the point of sale by tire dealers with very heavy penalties for non-compliance. We have been here before and it will not work. Having said that there will be fallout and it could cost you a serious fine. TIA has a petition ready to go to congress opposing this legislation.

I have attached a link that you can read more on this matter and electronically sign the petition. I encourage you to do this right away. This is a seri-ous matter that will negatively impact you and the tire industry.
