Dear Brothers and Sisters, Greetings to all Happy Christmas and Happy and prospers New Year 2016. By this time the bulletin reaches you the TIMACON 2015 must have been over and new president Dr.S.Damodaran and his team of office bearers would have take over. I take this opportunity to thank every one of you for giving me an opportunity to serve you as well as to our Association in the capacity of Honorary State Secretary 2014 – 15. No doubt it is a challenging and demanding job, which I have done my level best. During these 2 years we have improved in every aspect of our association including the financial aspect and more so improved the unity and morale of our association.

Dear Colleagues, Greetings. It is with great pleasure I share my views with you through this message. The Central Government promised to consider all our demands placed in Sathyagraha and this is a great victory for IMA. I congratulate all our National IMA leaders, State leaders and members. We cannot rest on our laurels but keep a constant watch to see that our demands are implemented. After many years Tamilnadu witnessed heavy rainfall with floods. Immediate flood relief has been done but, in the aftermath, communicable diseases will spread like wildfire and this has to be contained in the early phase. I request all the local branches of IMA to swing into action and conduct medical camps in the affected areas. On the 15th of November I attended the State Finals of the Fine Arts competitions as the Chief Guest. Despite the heavy rains all the branches from various zones participated with great enthusiasm. Vellore IMA hosted the event at Adakkamparai GVMCH auditorium. Vellore and Erode IMA gave a tough fight to each other. I thank Vellore IMA and Dr.Madan, the State Fine Arts Chairman for the excellent arrangements. I attended the Paramedical convocation, FSC meeting, FSS management committee meeting and combined meeting of PPLSS and FSS. The meeting was arranged nicely by Dharmapuri IMA and I thank Dr.Venkatesan and Dr.Ramesh for their hospitality.TIMACON 2015 State Conference is going to be held on the 12th and 13th of December at Vellore. I request all the members to register for the conference and make it a grand success. Long Live IMA!

Dr,C.N.Raja, Hony.State Secretary, IMA TNSB We have received very clear cut Judgment, Honourable Madurai Bench of State Consumer Disputers Commission order C.C.No.20/2014, which has given a big slap on quackery. IMA TNSB thanked the Honourable Madurai bench for upholding the importance and dignity of modern medicine and insisting on purity of systems. In the case Mr.S.Karupasamy Vs Mr.K.Duraipandy. Wife of complainant Mr.S.Karupasamy, K.Selvi was treated by Mr.K.Duraipandy of Theni District. Who is a Quack on 16.11.2013. Due to the faulty treatement she was admitted at Ragavendra Hospital Madurai on 17.11.2015 and subsequently died on 26.05.2014 after renal failure. The Honourable Madurai Bench is clearly given the followings “ A person who does not have knowledge of particular system of medicine but practices in that system is a quack and mere pretender to medical knowledge or put it differently a charlatan.” Apart from it the complaint has relied upon another judgment of the Honourable Supreme court in the case of Martin D'Souza Vs Mohammed Ishfaq reported on (2005) 6 SCC 1 where in the court has held that as follows: “A professional may be held liable for negligence on the ground that he was not possessed of the requisite skills which he professes to have thus a Doctor who has Qualification in ayurvedic, unani or homeopathic medicine will be liable if he prescribes allopathic treatment.” Apropos the punitive damages the complaint has contended that even after the loss of life and subsequent to initiation of the criminal proceedings against the 1st opposite party on the directions of the judicial magistrate it was contended by the complainant that the 1st opposite party is still is practising modern and allopathic medicine in the area without any let up and playing with the lives of illiterate and semi – illiterate rural folks. The contention of the complainant is supported by Ex. A – 8 which clearly establishes that the 1st opposite party is practising allopathic modern medicine and is playing with the precious lives of innumerable and unidentifiable consumers and therefore we are of the view that this is a fit case for imposing punitive damages on the 1st opposite party. Having regard to the facts and circumstances of the case we feel that a sum of Rs.300000/- must be remitted to the legal aid account of this commission. In the result, the complaint is partly allowed

1. Declaring the practice adopted by the 1st opposite party as unfair trade practice and;2. Directing the 1st opposite party to immediately discontinue the practice and not to repeat

the same in future and; 3. Directing the 1st opposite party to pay a sum of Rs. 1200000/- ( Rupees twelve lakh only )

being the medical expenses incurred by the complainant for providing treatment to his wife and;

4. Directing the 1st opposite party to pay a sum of Rs. 500000/- ( Rupees five lakh only ) As compensation for mental agony and;5. Directing the 1st opposite party to pay a sum of Rs. 300000/- ( Rupees three lakh only) as

punitive damages to the consumer Legal Aid Account of the Madurai Bench of Tamilnadu State Consumer Dispute Redressal Commision and;

6. To pay costs of Rs.10000/- ( Rupees ten thousand only )

Greetings from NHB TNSB!

It gives me great pleasure in addressing you through TIMA news. Lot of things of are happing in Nursing Home Board. Subsequent to our successful meeting at Courtallam, we have conducted our first inaugural session of IMA HBI NHB – NABH Initiative at Thanjavur on 15/11/15. In spite of heavy rains more than 200 delegates from 150 hospitals took part in the Marathon session which started at

9.30am and extended up to 7pm. The delegates had the fortune of listening to CEO NABH Dr. K.K. Kalra in person tell them that it is easy to get entry level accreditation and that you don't need external agencies to train you on that. He appreciated the initiative of Tamilnadu IMA and NHB in helping in their members to train for NABH entry level accreditation. The lectures were conducted by NABH Assessor Mrs. Lallu Joseph of CMC Vellore in an exemplary manner. She kept the audience spell bound by her easy way of explaining things. We were honoured by the presence of our national president Dr. A. Marthanda pillai, HBI chairman Dr. R.V. Ashokan, our state president Dr. R.V.S. Surendran and state secretary Dr. C.N. Raja. NHB Advisor Dr. V. Varadharajan showed his vast experience by making wonderful arrangements carrying IMA Thanjavur along with him. We thank IMA Thanjavur office bearers, president Dr. AR. Sambath, secretary Dr. A. Rajendran, NHB coordinator Dr. N. Aravind and others for helping us conduct the program in a very successful manner amidst inclement weather.

Subsequent to this meeting, our president elect 2017 Dr.JA. Jayalal came up with brilliant idea of having a 'Training the Trainer' program for two days on 18 & 19 December 2015. coinciding with the visit of CEO NABH Dr. K.K. Kalra to grant full accreditation to his hospital. We are making arrangements for successful conduct of the same. Full details can be had by visiting our website www.imanhb.org.

The next NHB Meeting (west zone) to be held on 3-1-2016 at Tirupur.

We are planning to come out with an “Annual Book” that will contain useful information on Govt. Acts, Taxes, and handpicked articles from NHB journals over the past 25 years. This will be a book for keeps.

We request you to help us come out with this edition by contributing towards an advertisement in the name of your hospitals. Since we intend to circulate this book ultimately to maximum members, we assure, you also stand to benefit by introducing yourself to our medical fraternity.

Dear All, Greetings from IMA Paramedical Wing!

Since our team took over in January 2014, we did the maximum possible in the Paramedical Wing and many things are to be continued and also new things to be done.

To List out a few:

1. Exclusive emblem: An Exclusive IMA TNSB Paramedical Emblem was designed.

2. No of new Institutions: In last 2 years many New Institutions started Para medical courses and in total we have around 55 active institutions.

3. Students strength : No of Students strength has increased to nearly 1700 from around 900

4. workshop : We initiated workshop for the Paramedical person already working in various hospitals and also our Students and so for conducted more than 10 workshops on various Practical aspects like attending to Emergencies, CPR, Handling monitors, Injection and IV Line access , Dressing methods etc

5. Zonal meets : We have conducted 8 Zonal meets in all the 4 Zones where we had Lectures, Panel Discussions, Stage Plays etc. on various topics like Ethics, Legal aspects, Future of Paramedics and Family & Profession, Dress code, personal and patient safety etc.

6. Convocation: Two Convocations, One at Coimbatore and One at Dharmapuri where conducted and to encourage and make them feel proud for taking one of the Noble Professions. They was ceremonial parade with Robes, candles etc. Thanks to Dr. Venkatesan – President, Dr. Ramesh Babu – Secretary and their Team from IMA Dharmapuri for making elaborate arrangements in spite of heavy rain and uncertainty for the Convocation.

7. International Nurses Day celebration: Every year we encouraged our Member Institutes to celebrate IND Concentrating on the Theme for the year.

8. Paramedic al Magazines: We continue to bring out Quarterly Para medical magazine with contributions of articles from Doctors, paramedical teachers, Staffs, Hospital owners etc.

9. Wages Evaluation Committee: We got the Representative for IMA in the Wages Evaluation Committee formulated by the Government for Paramedical persons in Private Institutions and we actively took part in the survey throughout the state.

10. Tie Up with Cheshire Home: IMA TNSB PARAMEDICAL WING ,Along With IMA Coimbatore And Cheshire Homes Is Planning To Start New Training Course In Hospital Needs For Differentially Abled Persons So That These Persons Can Be Absorbed In Our Hospitals For Data Entry, Doctor Assistant ,Front Office And In Other Management.

11. Books for our Courses : Already we have initiated compiling the write ups for chapters for the various books for the different courses conducted by IMA Paramedical wing

12. Tie up with University: We have initiated the process of tie up of our courses with Karpagam University and is in the process.

13. Many more to be done in Paramedical Wing for the benefit of Paramedics, for the Effective Health Care Delivery by the Hospitals to the Public etc. We thank all the State Office Bearers, IMA Branches, Various Faculties, The Paramedical Institutions and Others who helped in various ways to carry out our duties in the last 2 years. November has been a month of varied academic activities. World diabetes day was observed in various institutions improving awareness & knowledge on preventing & containing the increase in diabetic population wherein I participated on 14th & 15th of November in association with american institute for radiologic pathology. A symposium on chest & neuroimaging with overseas faculty was held in radisson blue hotel, chennai - 8 which was well attended by doctors from chennai and outstation too. on 1962 November we had a webinar on asthma, at residency towers, chennai - 17 challenges in treating asthma.

Likewise, by the grace of the great physician I had organised many symposia seminars & CMEs during the last 2 years as chairman AMS TNSB on 19th October 2014 I organised the multi speciality conference of IMA AMS TNSB “TIMA AMSCON 2014" on the theme “Current Updates” at apollo speciality hospital, Vanagaram, graced by the presence & blessings of State & national ima leaders. I had enrolled more than 80 new ima ams life members in this tenure. I received the chairman’s appreciation award at amscon 2014 at kolkata putting ima ams taminadu chapter shine on the national map.

I thank & praise almighty & loving god, for being with me & enabling me to carry out my duties as state chairman ima ams well. I thank you all for the encouragement & support. I shall continue to strive for ima & ima ams growth.

AMSCON 2015 is to be held on December 19th 20th 2015 at koyala nagar community centre, bccl koyala nagar, Dhanbad, Jharkhand state we invite you all for your gracious presence.

IMACGP Course Diabetology module for Chennai Centre was conducted on

Sunday the 22nd November 2015 and the 4th module for Madurai centre will be

conducted on 6th December 2015 at Madurai IMA Hall.

'In house' Training in Diabetology and Endocrinology Courses are scheduled to

take place in Madurai in the months of January – February 2016. 6th and 7th

modules of Endocrinology Course also will be taken up in the months of January –

February.

The modules for all other CGP courses are regularly progressing as per the Time

– Table in various centres.

We sincerely thank our State President Dr.R.V.S.Surendran and State Hony.

Dear Members,

Greetings from Erode.

This time we analysed the PPLSSS growth rate. Out of 561 New Members who joined IMA from April 2015 till November 2015, only 240 members have joined PPLSSS scheme. It is better that all new IMA members join PPLSSS also.The top 10 Branches with maximum New Members are

Out of the 240 members, East Zone has enrolled more members followed by North, South and West Zones. Only 36 Hospitals have enrolled in the HPS. We are repeatedly cautioning our members to become HPS members as Consumer / Lawyer notices are sent against the hospitals also.

FBS growth is very minimal. A Committee has been formed to revise the amount to be allotted for each treatment. Members are requested to take care to renew their PPLSSS / HPSmembership without break. If there is any case during the break period, it will not be covered by PPLSSS or HPS. In FBS also, continuous membership has to be maintained.

Our PPLSSS guest houses in Mount road and Chetput Spur Tank Road didn't get affected during the floods in Chennai. We can contribute Clothes and Bedsheets through our IMA Branches to flood affected areas.

Like Eye Donation, Skin Donation is harvested from Donor within 6 hours after death and requires no legal formalities. Uppermost layer of the skin is harvested which is too thin and so there is no bleeding. This procedure takes 30-45 mints. The harvested skin is treated and can be preserved for upto 5 years. In south India, Coimbatore Ganga Hospital is the 2nd institution to have the skin bank. For the past 11 months they are harvesting skin and using. Congrats to Dr.S.Rajasabapathy. Individual membership in PPLSSS, please note, will not cover the Hospital under

any circumstances.

Family Benefit Scheme membership should also be a continuous one without

any break, which is important and necessary to get hospitalization benefits.

Total reimbursement benefits for the Hospitalization expenses incurred in an

year by a member for self, his/her spouse & children aged below 20 years shall not

exceed Rs.1,20,000.

The maximum of Rs.60000/- as reimbursement benefits shall be allowed per

Hospitalization for the member or his/her spouse or children. The window period

between two claims shall be six months.

1.) Starting of TPA - IMA TNSB should start a TPA (Third Party Administrator) or Health Insurance company. Register it with IRDA. Fix standards and rates for the various procedures and schemes by the government and private insurance companies. This can function as like our other schemes of IMA TNSB like FSS, PPLSSS, HPS and FBS.

2.) Administration reforms and Elections for TNSB.

1. TPA We are in a vice like grip of insurance companies. They dictate unreasonable terms and conditions and give us unviable rates for our work.They profit more using us whereas we are not recognized and grossly underpaid. The TPA whose sole intention is only profit are threatening and demeaning and service is last on their motive. They are using our disunity to profit for themselves. Though many of us are recognized for cashless facilities, we are underpaid and forced to do things demeaning our noble profession, both by the Government and the Private companies.

We want change and respect. To quote the example of Andhra, the rates were fixed by a medical Doctor the charges being Rs.30,000/- for hysterectomy whereas in TN the Lap Assisted procedure is given 9000 to 16000 depending on your grades?!

United we stand and obviously if IMA TNSB takes up this proposal of starting a TPA of health insurance company it would revolutionize the way we treat and for the patient's benefit. Time framed committee may be formed to study the feasibility, form the rules and modalities of implementation. We request that this is taken up as a priority matter for discussion at the ensuing State Council at Vellore, as we have enough senior leaders to do this important work, deciding the rates with eyes on economic viability and social responsibility.

If and when IMA TNSB forms a TPA on its own, all the recognized health insurance companies can be requested to recognize IMA TNSB TPA as the ONLY TPA for settlement of all their claims. All members, IMA TNSB and patients will be benefited by this enterprise.

Let us join our hands to stop this manipulation and revolutionize the system of health insurance in our country.

You would have seen in the TIMA newsletter last edition about the list of state office bearers for 2016-2017. Dr. J. Nandini MD.,DM., eminent cardiologist from vellore, young and energetic personality, activelv involving in all IMA activities has been elected as Women Doctors Wing State Chairman.

I request all the members to give their full support to the new office bearers and make our state as Number one in National level.

Once again, I sincerely thank all the contestants, winners, State President, Secretary, office bearers and leaders, who helped us a lot in conducting the elections smoothly without any problem.
