NOTICE OF TRUST-EE’S SALE
Reference is hereby made to that certain trust indenture/deed of trust (“Deed of Trust”) dated 11/10/03, recorded as Instrument No. 550495 Book 165 Page 0209, mortgage records of HILL County, Mon-tana in which John C Adams and Rheanon J Adams was Grantor, Heritage Bank was Beneficiary and Hill County Title Company was Trustee. On September 30, 2016, Miller Oil Company d/b/a The City Line (“Miller Oil”) filed its Application for Final Approval of Rate Increase and Charges for Gas Service (“Application”) for its Culbertson, Montana service area. Miller Oil states that its revenue requirement for the test period of January 1, 2015 to December 31, 2015 is $324,280, and when com-pared with revenues at present rates of $290,689, requires an increase of $33,590.
Miller Oil states “[t]he reason for the proposed change in rates is to allow the Company to recover its operation and maintenance costs, deprecia-tion and amortization expens-es, taxes other than income, income taxes and to earn a return of 8.14% on rate base.” Letter of Transmittal, 2 (Sept. 30, 2016). Miller Oil requests a return on equity of 9.8%. For residential and small commer-cial customers, the requests would increase revenues by 11% and a customer in this class using an average 2,786 cubic feet a month would see a bill increase from $65.41 to $74.95. For the schools, the request would increase rates by 27% and a school using an average 11,937 cubic feet a month would see a bill increase from $211.38 to $272.39.
