The Uttarakhand Vidhan Sabha Secretariat Service
(Recruitment and Conditions of Service) Rules, 2011
Part- one
Preliminary
Short Title and
Commencement
1. (1) These rules may be called the Uttarakhand Vidhan
Sabha Secretariat Service (Recruitment and Conditions
of Service) Rules, 2011
(2) It shall come into force from the date of notification
in the Gazette.
Status of Service 2. The service of Uttarakhand Vidhan Sabha is the service of
Vidhan Sabha Secretariat which includes posts of Group
“A”,”B”,”C” and “D”.
Definitions 3. In these Rules, unless there is anything repugnant in the
subject or context-
(a) “Speaker” means the Speaker of Sabha;
(b) “Deputy Speaker” means the Deputy Speaker of Sabha;
(c) “Appointing Authority” means Officer authorized
under Rule 16;
(d) “Citizen of India” means a person who is a citizen of
India under Part- II of “The Constitution of India” or
deemed to be a Citizen of India;
(e) “Constitution” means the “Constitution of India”;
(f) “Sabha” means the “Uttarakhand Vidhan Sabha”;
(g) “Government” means the Government of Uttarakhand
State;
(h) “Member of Service” means a person who has been
substantially appointed under these Rules or Rules or
Orders applicable prior to these Rules on a post in some
cadre of service or is holding such post”;

Provided that for regularization of all employees
appointed other than by substantive appointment, the
Speaker may constitute a Selection Committee which
shall take action for the regularization of such
employees according to due process;
(i) “Service’ means Uttarakhand Vidhan Sabha Secretariat
Service;
(j) “Substantive Appointment” means an appointment not
being an ad hoc appointment, on a post in the cadre of
the service and made after selection in accordance with
the rules and if, there were no rules, in accordance with
the procedure prescribed for the time being by executive
instruction by the Government;
(k) “Principal Secretary/Secretary” means Principal
Secretary/Secretary of the Sabha;
(l) “Secretariat ” means Secretariat of the Sabha
(m) “Direct Recruitment” means
(i)promotion; or
(ii)recruitment other than Deputation or transfer from
other services of Government;
(n) “Competitive Examination” means the competitive
examination as laid down by the Recruitment and
Promotion Committee for a post in the service;
(o) “Year of recruitment” means a period of twelve months
begininng from the first day of July of a Calendar year.
Part-2
Cadre
Service Cadre 4 (1) (a) There shall be a separate Secretariat of the Assembly
under the superintendence and control of the Speaker.
(b) The number of posts of each cadre in the service shall be

as determined from time to time by the Speaker on the
recommendations of the Post Scale Assessment Committee
(2)The number of employees/officers and posts in each class
in service shall be as given in “Appendix A” unless changed
by orders issued under sub rule (1)
Provided that
(a) The appointing authority may leave a post vacant and the
Governor can stay a post in abeyance in such a way that no
person shall be entitled to reimbursement
(b)the Governor in consultation with the Speaker can create
such permanent and temporary posts as he considers suitable
Provided that the Speaker, without consultation with
the finance department may create permanent posts of
Officers/Employees for a period not more than six months
which he considers expedient and necessary for the work of
Sabha.
Post Scale Assessment
Committee
5. The assessment of norms for posts in various cadres of
the Secretariat shall be decided by the following Committee:
(1)Hon’ble Speaker, Vidhan Sabha - Chairman;
(2) Hon’ble Deputy Speaker, - Deputy Chairman;
Vidhan Sabha
Provided that if the post of Deputy Speaker is vacant,
in his place, a senior most Member of Vidhan Sabha;
(3) Hon’ble Parliamentary Affairs -Member;
Minister
(4)Hon’ble Finance Minister -Member;
or a representative nominated
by him
(5) Chairman, Public Accounts - Member;
Committee of Vidhan Sabha
(6) A Scheduled Caste or Schedule - Member;
Tribe member of Vidhan Sabha
nominated by Hon’ble Speaker

(7) Principal Secretary/ Secretary - Member Secretary;
Vidhan Sabha
The presence of four Members shall be mandatory for the
quorum of this Committee,
Provided that if the members mentioned at serial
No. 3 and 4 of this Committee are not present in the
meetings of the Committee continuously on three
occasions then in that case the decision of the Speaker on
the recommendations of the Committee shall be final. On
the recommendations of the Committee, the Speaker may
after consultation with the finance department, make
modifications in Appendix ‘A’ for increase or decrease in
number of specified posts or by addition of new cadre of
posts in it.
Part- 3
Recruitment
Source of recruitment 6. The recruitment of various classes of posts in the Service
shall be done from the following sources-
(a) By Direct recruitment; or
(b) By Promotion; or
(c) By service transfer, deputation and merger.
Reservation 7. The reservation for candidates of Scheduled Castes,
Scheduled Tribes, Other Backward Classes and other Classes
of Uttarakhand State shall be made in accordance with the
orders in force at the time of recruitment.
Part- 4
Eligibility
Nationality 8. For direct recruitment to a post in the service, the
candidate-
(a)- should be a citizen of India

(b)- should be a Tibetan refugee, who has come before 1
January, 1962 with an intention to settle in India; or
(c)- a person of Indian origin, who has migrated with an
intention to settle permanently in India from the countries of
Pakistan, Burma, Sri Lanka and Kenya, Uganda and United
republic of Tanzania (erstwhile Tanganyika and Zanzibar);
provided that the candidate related to above Class
(b) and (c) would be the person in whose favour the State
Government has issued an eligibility certificate;
provided further that it would also be necessary for
the candidate of class (b) to get a certificate issued by Deputy
Inspector General, Police, Intelligence Branch, Uttarakhand;
provided furthermore that if the candidate is related to the
above class (c), the eligibility certificate will not be issued for
more than one year and after one year duration, such
candidate would be kept in service on his getting the
citizenship of India.
Note- The candidate in whose case the eligibility certificate
is mandatory but has not been issued nor it has been rejected
can be given admission in examination or interview and can
be appointed provisionally but the condition is that he
receives or is issued the requisite certificate within one year.
Educational and other
qualifications
9- No person shall be appointed in service until he completes
the prescribed qualifications and experience mentioned in
column three and four Annexure ‘B’ respectively for posts of
direct recruitment and those of other than direct recruitment.
Preferencial
Qualifications
10.The candidate of Group ‘C’ and Group ‘D’ who-
a- have served in the provincial army for a period of
minimum two years; or
b- have received ‘B’ certificate of National Cadet Corps,
shall be given preference in the case of direct
recruitment, even with other things remaining same.

Age 11.The age of candidate, if the posts are advertised from 1
January to 30 June should be minimum of 21 years and
maximum of 35 years as on 1 January of that year and if the
posts are advertised from 1 July to 31 December should be
minimum of 21 years and a maximum of 35 years as on 1
July of that year;
Provided that in the case of candidates belonging to
the Scheduled Castes, Scheduled Tribes, Other Backward
Classes of and other classes of Uttarakhand which are notified
by the Government from time to time, the maximum age limit
shall be increased by such years as may be prescribed;
Provided further that the Speaker of the House can
relax the age limit for a post by up to 5 years.
Character 12-The character of a candidate for direct recruitment must be
such as to render him suitable in all respects for employment
in Government Service. The appointing authority shall satisfy
himself in this respect.
Note- Persons dismissed by the Union Government or by a
State Government or by a local authority or by a corporation
or body owned or controlled by the Union Government shall
be ineligible for appointment to any post in the service.
Persons convicted of an offence involving moral turpitude
shall also be ineligible.
Marital status 13- A male candidate who has more than one wife living or a
female candidate who has married a man already wife living
shall not be eligible for appointment to a post in the service.
Provided that the Governor may if satisfied that there exist
special grounds for doing so exempt any person from the
operation of this rule.
Physical qualification 14- (1)No person shall be appointed in the service unless he
be in good mentally and bodily health and is free from any
physical defect likely to interefere efficient performance of
his duties. Before approving a candidate for appointment-

(a) in the case of Gazetted post or service, he has to pass
the examination of Medical Board;
(b) in the case of other posts of service, he is desired to
produce health certificate according to rules made
under Fundamental Rule 10 included in Chapter 3 of
Part III of Financial Hand Book Volume II;
Provided that for a candidate appointed through
promotion to produce a health certificate is not desired.
(2) (A) Vidhan Sabha Guard (Male)
Following physical qualifications are essential for the post-
(1) Measurement of Chest without expansion with expansion
(a) for General/ 78.8 cm 83.8 cm
backward classes
and SC candidates
(b) For ST and Hill origin 76.3 cm 81.3 cm
Candidates
Note: It is essential to expand the chest by minimum of 5cms.
(2) - Height
(a)for General/ backward classes 167.7 cm
and SC candidates minimum
(b)For Hill origin 162.6 cm
Candidates minimum
(c)for ST candidates minimum 160.0 cm
(B) Vidhan Sabha Guard (Female)
Following physical qualifications are essential for the post-
(1) Height -
(a)For General/ Backward Classes 152.0 cm
and SC Candidates minimum
(b) For Hill origin 147.0 cm
Candidates minimum
(c) For Hill origin ST 147.0 cm
Candidates minimum
(2) Weight minimum 45 Kgs

Recruitment
Determination of
Vacancies
15- The appointing authority shall determine the vacancies to
be filled during the year and also the vacancies to be reserved
for Scheduled Castes, Scheduled Tribes, Other Backward
Classes and other classes of Uttarakhand under Rule 7 and
inform the Selection Committee.
Appointing Authority 16- Under the provisions of Rule 4 and the orders of
Governor under that rule, in the Secretariat-
(a) the appointment on all the gazetted posts shall be done
according to rules by the Speaker; and
(b) the recruitment on all the remaining posts shall be done
according to rules by the Principal Secretary/Secretary
under the orders of Speaker;
provided that if prior to commencement of
these rules, any substantive appointment or for the
purpose of substantive appointment any appointment
on probation has been done by the Governor or the
Speaker, then for persons recruited in such manner, the
Governor or the Speaker as the case may be shall
remain appointing authority.
Documents to be produced at the time of appointment-
A candidate-
(i) shall produce the certificate prescribed in Rule 7; and
(ii) shall produce a declaration related to the following
matters-
(a) If he is related to any person appointed in the
Secretariat, about the relation with such person;
(b) About being free from loan;
(c) About all of his immovable property in prescribed
proforma given in Annexure 2;
(d) Certificate of a living husband/wife; and

(e) About having read Official Secrets Act 1923 (Act No.
19 of year 1923) and the punishments for revealing the
subjects of the files of the secretariat.
Note- The above declarations shall be kept with
candidate’s character roll after his appointment.
Procedure for direct
Recruitment
17(1) For direct recruitment to various posts of service a
Selection Committee shall be constituted as hereunder-
(a)Hon’ble Speaker, Vidhan Sabha - Chairman;
(b)Hon’ble Deputy Speaker, - Deputy Chairman;
Vidhan Sabha
Provided that if the post of Deputy Speaker is vacant,
in his place, a senior most Member of Vidhan Sabha;
(c)Leader of Opposition, Vidhan Sabha - Member;
(d) Hon’ble Parliamentary Affairs - Member;
Minister
(e) An officer of Finance Department - Member;
Not below the level of Secretary
(f)A Scheduled Caste or Schedule - Member;
Tribe member of Vidhan Sabha
nominated by Hon’ble Speaker
(g)Principal Secretary/ Secretary - Member Secretary;
Vidhan Sabha
The presence of four Members shall be mandatory
for the quorum of this Committee.
Provided that if the members mentioned at serial
No. (d) and (e) of this Committee are not present in the
meetings of the Committee continuosly on three occasions
then in such case the decision of the Speaker on the
recommendations of the Committee shall be final;

Provided further that where the direct recruitment
is being done to the post of Principal Secretary/ Secretary,
then Principal Secretary/ Secretary of Personnel Department
or, Law or Legislative Department of Government nominated
by the Speaker shall be member Secretary.
(2) The selection committee shall from time to time organize
a competitive examination for fulfilling the vacancies to the
post of Group ‘C’. The following procedure shall be
followed for the competitive examination-
(a) The appointing authority shall invite the applications
in the prescribed format for giving permission to appear
in the competitive examination. The application forms
can be obtained from the office of the appointing
authority on payment;
(b) No candidate shall be given admission to the
examination without the admit card issued by the
appointing authority;
(c) After receiving of the result and tabulation of the
written examination and based on the result of the
written examination, such candidates will be called for
the interview by the committee who have received
marks according to the standard set by the committee in
this regard keeping in view to ensure the representation
of the candidates of Scheduled castes, scheduled tribes,
other backward classes and other classes of Uttarakhand
under Rule 7. The marks obtained by each candidate in
interview shall be added to the marks obtained by him in
written examination.
Note:
1- The syllabus and rules for the competitive examination
shall be prescribed by the committee from time to time.
2- The selection committee can nominate any organisation
for organizing competitive examination.

(3) The Speaker can constitute a selection committee for the
direct recruitment to Group ‘C’ posts according to the
instructions issued from time to time by the state government
and the committee, according to the prescribed procedure, can
forward names to the appointing authority for recruitment
process.
Procedure for
Recruitment through
promotion
18(1) For promotion to posts from Under Secretary to
Secretary/Principal Secretary, a Committee shall be
constituted in the following manner:-
(a)Hon’ble Speaker, Vidhan Sabha - Chairman;
(b)Hon’ble Deputy Speaker, - Deputy Chairman;
Vidhan Sabha
Provided that if the post of Deputy Speaker is vacant,
in his place, a senior most Member of Vidhan Sabha;
(c)Leader of Opposition, Vidhan Sabha - Member;
(d)Hon’ble Parliamentary Affairs - Member;
Minister
(e) An officer of Finance Department -Member;
not below the rank of Secretary
(f)A Scheduled Caste or Schedule - Member
Tribe member of Vidhan Sabha
nominated by Hon’ble Speaker
(g)Principal Secretary/ Secretary - Member Secretary
Vidhan Sabha
The presence of four Members shall be mandatory for the
quorum of this Committee;
Provided that if the members mentioned at serial
No. (d) and (e) of this Committee are not present in the
meetings of the Committee continuously on three occasions
then in such case the decision of the Speaker on the
recommendations of the Committee shall be final;

Provided further that where the promotion is
being made to the post of Principal Secretary/ Secretary, then
Principal Secretary/ Secretary of Personnel Department or,
Law or Legislative Department of Government nominated by
the speaker shall be member secretary.
(2) The recruitment through promotion shall be done by a
Selection Committee constituted under Rule 17 on the basis
of order of merit /Seniority (Leave where not applicable)
rejecting the unsuitable.
(3) A list of eligible candidates shall be prepared by the
appointing authority in order of merit and their character roll
and other such record related to them shall be kept before
Selection Committee as considered appropriate.
(4) The cases of candidates shall be considered by the
Selection Committee on the basis of records specified in Sub
Rule (2) and if it considers necessary candidates can be
interviewed.
(5) The Selection Committee shall prepare the list of selected
candidates on the basis of seniority and forward it to
appointing authority.
(6) For promotion to posts from Group ‘D’ to Group ‘C’ and
Typist to Section Officer, a Selection Committee shall be
constituted in the following manner-
(a) Principal Secretary/Secretary - Chairman;
(b) An officer nominated by the Speaker - Member;
who shall be not below the rank of
Additional Secretary
(c)An officer of Scheduled caste - Member;
/Scheduled Tribe nominated by
the appointing authority
(d) Additional Secretary - Member Secretary;

Combined Selection
List
19- If in any year of recruitment, appointments are made both
by direct recruitment and promotion, a combined selection list
shall be prepared by taking names of candidates from both the
relevant lists in such manner that the prescribed percentage is
maintained, the first name in the list being of the person
appointed by promotion.
Part - 6
Appointment, probation and Confirmation
Appointment 20-(1) Subject to sub rule 2, the appointing authority shall
appoint candidates in such order the names of the candidates
as they appear in the lists prepared under Rule 17 or 18 as the
case may be.
(2) If in any year, the appointment is to be done both by direct
recruitment and promotion; the regular appointment will not
be done until the selection is done by both the sources and
combined lists made according to Rule 19.
(3) If in relation to an appointment, orders of more than one
appointment are issued, then a combined order will also be
issued in which the names of the selected candidates will be
mentioned on the basis of seniority determined in the
selection or in that order, as the case may be in which their
names appear in the seniority list from which they have been
promoted. If the appointments are made both by direct
recruitment and promotion the names will be ordered in
cyclic order as prescribed in Rule 19.
Conditions of service
on deputation and
action related to
discipline.
21 (1) Under such restrictions and up to such limit which the
appointing authority sets with the consent of the responsible
authority and finance department, a person on deputation in
secretariat during the tenure of his service in the secretariat

shall be allowed to remain under the same terms and
conditions of service for which he had rights before his
deputation in the secretariat.
(2) If in the view of the appointing authority, it is necessary to
take disciplinary action against a person on deputation in
Secretariat, his services will be kept again under the service
providing authority and documents related to preliminary
inquiry, if held, shall be sent to service providing authority.
Probation 22-(1) A person appointed to service or a permanent post or
on a vacancy against that post shall be on probation for a
period of two years.
(2) The appointing authority, in different cases, can increase
the period of probation specifying the date of probation till
which the period is increased. The reasons for this have to be
recorded;
Provided that except in exceptional circumstances,
the period of probation will not be increased for more than
one year and under any circumstances not more than two
years.
(3) If the appointing authority is of the view that during the
period of probation or after the end of probation period or in
the increased period of probation, the person under probation
has not properly used his opportunities or has been
unsuccessful in satisfying otherwise, he shall be reverted back
to his basic post if any, and if he does not hold any lien on a
post his services shall be terminated.
(4) Such person under probation who or has been reverted
under sub rule (3) or whose services have been terminated
shall not be eligible for any compensation.
(5) The appointing authority for the purpose of calculating the
period of probation can give permission to count the
continuous service done on a post of that specific cadre or an
equivalent or higher post in officiating or temporary capacity.

(6) the candidate shall be kept on a probation of two years for
substantive appointment on a post;
Provided that according to related seniority rules, on the post
of undersecretary and in other cadres on posts higher than the
pay scale of undersecretary, shall be confirmed on the basis of
satisfactory service after the completion of period of
probation.
(7) The period of probation shall be calculated from the date
of joining on the post.
Confirmation 23- A person under probation can be confirmed at the end of
his probation period or extended probation period in his
appointment, if he-
(a) has passed the prescribed departmental examination, if
any;
(b) has successfully completed prescribed training, if any;
(c) his work and conduct is satisfactory;
(d) his integrity is certified; and
(e) the appointing authority is satisfied that he is otherwise
eligible for being confirmed.
Seniority 24- (1) Except as hereinafter provided, the seniority of
persons shall be determined according to Uttarakhand
Government Servant (Determination of Seniority) Rules,
2002. If two or more than two persons are appointed at the
same time, their seniority will be determined in the order in
which their names appear in the appointment order;
Provided that if an earlier date is mentioned in the
appointment order by which a person is substantively
appointed then that date will be considered as the date of his
substantive appointment and in other matters this date shall be
considered as the date of issuing of the order;
Provided further that if in relation to someone, more than one
order is issued than the seniority shall be such as mentioned
in the combined list issued under Sub Rule (3) of Rule (20).

(2) The inter se seniority of appointments as a result of a
selection will be the same which, as the case may be, is
determined by the commission or the selection committee;
Provided that if a candidate from direct recruitment after
being given offer for the post, is unable to join on his post
without valid reasons, he may lose his seniority.
(3) The seniority of persons appointed through promotion will
be the same as was in their cadre in which they are promoted.
(4) Where the appointments are made both by promotion and
direct recruitment, or through any one source and separate
quota is prescribed for the sources, the inter se seniority will
be determined by putting names in order as they appear in the
combined list in cyclic order in such a way that the prescribed
percentage is maintained as described under Rule 20.;
Provided that-
(a) where the appointments from any source are made in
excess of the prescribed quota, the persons appointed in
excess of quota shall be pushed down from seniority to
subsequent year or years in which there are vacancies
in accordance with the quota;
(b) Where appointments from any source fall short of the
prescribed quota and appointments against such
unfilled vacancies are made in subsequent year or years
the persons so appointed shall not get seniority of any
earlier year but shall get the seniority of the year in
which their appointments are made. However, in
combined list of that year, (to be prepared under this
Rule), their names shall be placed at the top followed
by the names in the cyclic order of the other
appointees.
(c) Where, in accordance with the rules or prescribed
procedure, the unfilled vacancies from any source
could in the circumstances mentioned in the relevant

rule or procedure be filled from the other source and
appointment in excess of quota are so made, the
persons so appointed shall get the seniority of that very
year as if they are appointed against the vacancies of
his quota.
Part - 7
Pay etc.
Pay scale 25 (1)Scales of Pay and allowances -
(a) The scales of pay of every cadre in which extra pay and
special pay and, subsistence allowance and other
allowances are included shall be such as are prescribed
from time to time by the Government for the
corresponding every cadre post in the civil secretariat.
If there is no such post in the civil secretariat as is there
in the secretariat, the scales of pay in which the extra
pay is included shall be determined by the Vidhan
Sabha Post Scale Assessment Committee;
(b) The posts of Reporter, Editor, Management officer,
Deputy Marshal, Deputy Librarian, Information Officer
and Assistant Public Information officer shall be
eligible for pay scale equivalent to Section Officer/
Private Secretary;
(c) Regulation of Leave, Allowances, Pensions etc.-
subject to the provisions of rules under these service
rules, the service terms and conditions of the services
of members shall be generally regulated by the rules
and orders applicable for Government servants under
the rule making control of the Governor;
Provided that till there is no due change with the
consent of finance department, the scales of pay of
posts in various cadres of the secretariat shall be such
as given in annexure ‘A’.

(2) Pay-
The starting pay of a person appointed in any post of the
secretariat shall be regulated under the fundamental rules
as amended from time to time.
(3) Increment-
(a) Notwithstanding any provision in the Fundamental
Rules to the contrary, a person on probation shall be given
increment on the condition that his work and conduct has
been reported satisfactory. If the period of probation is
extended due to failure in providing satisfaction, such
increased period of probation shall not be counted for the
purpose of providing increment un till the appointing
authority does not otherwise directs;
Provided that if the period of probation is increased due to
failure of the probationer in some departmental examination,
the increased period shall not be counted for the purpose of
increment but the effect of such bar on increment shall not be
of suspending the increments.
(b) If a person is in the Government or Secretariat Service
before his appointment, his pay during the period of probation
will be determined according to rules referred to in general
Rule 29 (b).
(c) For regulating the sanction of increment, stopping it and
related matters, the rules, with the required amendments, shall
be the same as prescribed for equivalent posts in the
Government Secretariat by the Uttarakhand Government
through rules and general orders.
(4) For every person appointed to the post of treasurer, it
would be mandatory to provide security of Rs. 5000 only
(Rupees five thousand only) according to the provisions of
Part-I of Financial Hand book Volume -V.

Pay during probation 26 (1) Notwithstanding any provision in the Fundamental
Rules to the contrary, a person on probation, if he is not
already in permanent Government Service shall be allowed
his first increment in the time scale when he has completed
one year of satisfactory service, has passed departmental
examination and on completing training where prescribed and
second increment after two years of service, when he has
completed the probation period and is also confirmed;
Provided that if the period of probation is
extended on account of failure to give satisfaction, such
extension shall not count for increment, unless the appointing
authority directs otherwise.
(2) The pay during probation of a person who was already
holding a post under the Government, shall be regulated by
the relevant Fundamental Rules;
Provided that if the period of probation is extended on
account of failure to give satisfaction, such extension shall not
count for increment, unless the appointing authority directs
otherwise.
(3) The pay during probation of a person who is already in
permanent Government service shall be regulated by the
relevant Rules applicable to the Government servants
generally serving in connection with the affairs of the state.
(4) Punishment and Appeal
(a) Punishments-
The punishments for persons appointed in the secretariat and
the procedure for using them will be the same as applicable to
the posts of equivalent class in Civil Secretariat.
(b)Punishing authority- Under Article 311 of the
Constitution of India, the power of giving punishment to a
member of the service lies with the appointing authority;

(c) Appeal – A person appointed in the Secretariat on which a
punishment has been served, shall have the right of only one
appeal and such appeal if the punishing authority is –
(1) Principal Secretary/Secretary, will be made to the
Speaker; or
(2) Speaker, will be made to the Governor.
Part - 8
Other Provisions
Canvassing 27- No recommendations, either written or oral, other than
those required under the rules applicable to the post or service
shall be taken into consideration. Any attempt on the part of
the candidate to enlist support directly or indirectly for his
candidature shall disqualify him for appointment.
Regulation of other
matters
28-In regard to the matters not specifically covered by these
rules or special orders, persons appointed to the service shall
be governed by the rules, regulations and orders applicable
generally to government servants serving in connection with
the affairs of the state.
Relaxation in
conditions of service
29- Where the state government is satisfied that the operation
of any rule, regulating the conditions of service of persons
appointed to the service causes undue hardship in any
particular case it may, in consultation with the Speaker,
notwithstanding anything contained in the rules applicable in
this case by order dispense with or relax the requirements of
that rule to such extent and subject to such conditions as it
may consider necessary for dealing with the case in just and
equitable manner.

(1) Other conditions of service-
(a) In such cases, which especially do not come under
these rules or under orders or special orders provided or
issued under these rules, the persons appointed in the
secretariat shall be governed by those rules, regulations
and orders (with required modifications) which are
generally applicable on the government servants
serving on equivalent posts in relation to the affairs of
the Uttarakhand state;
(b) In case of doubt, according to rule 29 (b), the Speaker
shall decide about -
(1) those servants under the government who are
equivalent to the posts of the secretariat; and
(2) Those rules, regulations and orders applicable to the
posts under the government and the modifications in
them which are applicable on the equivalent posts in
the secretariat.
(c) After retirement facilities to concerned post will be
admissible to holder of Principal Secretary Post.
(2)Process of issuing order by the Speaker-
Unless otherwise stipulated, the Speaker would, before
issuing any order under these rules, receive consultation or
consent, as the case may be, which are expected from
those departments and authorities of the government,
under Rules of Business and secretariat instructions, as
amended from time to time and issued by the Uttarakhand
Government, or as the case may be, the government orders
and applicable rules during the operation of a proclamation
under Article 356 of the Constitution of India before
issuing such orders.

(3)Certification of orders issued by the Speaker-
Under the provisions of these rules, the orders of the
Speaker shall be certified in such manner and by such
officer who is directed from time to time by the Speaker
though general or special order.
Savings
30(1). Nothing in these rules shall affect reservations and
other concessions required to be provided for the candidates
belonging to the Scheduled Castes, Scheduled Tribes, Other
Backward Classes of citizens and Other special categories or
persons in accordance with the orders of the Government
issued from time to time in this regard.
(2) The Speaker, in extraordinary circumstances and in
consultation with the recruitment and promotion committee,
can relax qualifications prescribed in these rules except
maximum age limit and educational qualifications.
(3) The orders under the provisions of these rules shall be
certified in such manner and by such officer as the Speaker
directs from time to time through general and special orders.
