Re: 2010 ABA Findings of Fact [1-18-2015]
Dear Colleagues,
I'm attaching excerpts from (a) the 2010 Findings of Fact
adopted by the ABA Section on L
Education, and (b) the December 20, 2013 deposition of SUNY
employment counsel, Jame
Esq. The Law School's current accreditation is based on the
first document, which, in turn,
the Self Study Report presented to the Site Visit Committee by
former-Provost Satish K. Tr
Dean Makau W. Mutua, and former-Vice Dean James A. Gardner.
The Findings of Fact in paragraphs 45-54 address academic
freedom and security of emplo
Law School.
Paragraph 48 finds that the Law School provides presumptively
renewable term contracts
Professors, in compliance with ABA Standard 405(c).
Mr. Jarvis testified in federal court that the SUNY Trustees'
Policies do not allow presumptrenewable term contracts based on a
good cause standard for non-renewal. He gave that fa
to defend former-Dean Mutua's attempt to repress academic
freedom by terrorizing and inti
faculty. Over a year has passed and Mr. Jarvis has not corrected
or withdrawn it, which jus
inference that it was intentional and calculated to obstruct
justice.
Paragraph 51 finds that the Law School has never terminated the
employment of any Clini
for any reason, either under the prior Clinical Faculty
Appointments Policy (1994) or the n
improved one (2009).
The very last person who is in a position to defend this lie is
the man who drafted the ABA
Report, James A. Gardner. He was lying about the unlawful
actions which he instigated to
my legal writing "fiefdom," as he strangely called it. (I never
knew that I had a fiefdom, or
In addition, he used his position in the Dean's Office to
prevent me from continuing my voc

perjury to law enforcement, ev
and everyone else who was on the faculty at that time knows that
he and former-Vice Provo
Finley failedin their unprecedented and cowardly campaign to
block my reappointment and
