For many decades, auctions have consistently proven to be an excellent means for generating the maximum price attainable for a property. Auction campaigns aim to achieve a high profile for the property by attracting strong and widespread buyer activity during the first 3 weeks, which is widely considered to be the peak selling period. They encourage emotional attachments between buyers and the property and are ideal for managing and generating competition among prospective bidders as well as ensuring a transparent buying experience. But, is an auction right for your property?

When is it suitable to auction?

Consider these 3 elements:

1. Your situation (Timeframe and needs driven)

Most people who have busy lifestyles and want to sell within a certain timeframe, like to limit the need to have people inspecting their house at different times of the week. If you have a genuine reason to achieve a sale with planned property inspections and want to avoid taking your home off the market during the initial marketing period, the auction process could be advantageous for you. It runs to a schedule and it gives you control of the situation. It also avoids you needing to make decisions about offers made in the early stages of the marketing campaign.

2. Time of the year (Best presentation period)

Warmer weather can influence more properties going to auction. However the shift is changing

slightly in that the season doesn’t necessarily dictate when you should sell. Even the Canberra winter shouldn’t steer you away from auctioning your property. With online advertising and agent know-how, potential buyers hear about properties on the market much earlier than they used to and you may have less competition for buyers’ attention.

3. Type of property (Most effective sale method)

Whether you have a unit in a complex or a heritage listed home, understanding the buyer demand for your property is a critical consideration when deciding whether to go to auction. Does buyer demand for properties like yours exceed supply? Are buyers willing to pay a premium price to own your home due to its location or position in a suburb that is known to be tightly held? Does your home offer a unique selling feature such as a position backing reserve or an attractive view? For example, if you have a unit in a development of 50 units and there are already 7 units currently for sale and yours is similar or identical, taking your property to auction may not necessarily attract much buyer interest or achieve the result you want on auction day. However taking your property to auction can also be an option if you wish to avoid a pricing war with competing properties. An auction may create a real point of difference. The other key consideration is that the auction process, rather than auction day alone, will determine your success. Your agent will need a comprehensive strategy for the marketing period, auction day and post auction sales opportunities.

Setting your reserve

An experienced agent will provide you with a comparative market analysis when your property is listed. Apart from being an important professional service, it is also a legal requirement that your agent clearly outlines their advice around pricing strategy and market expectations. This gives you an indication of your current competition, recent sales that may indicate what a likely buyer would pay for a property in your area, and possibly information on properties that have failed to sell and why.

The reserve price is normally set a couple of days before auction day. When setting your reserve you need to take a number of factors into consideration. Your agent will contact you every few days throughout the marketing period to update you on what buyers are saying about your property and what comparable properties are selling for. This information will help you make an informed decision about where to set your reserve price in order to achieve your desired outcome. The reserve price you set will have a big impact on your prospects of selling your home on auction day.

Does it cost more to auction?

In short, the answer is no. Whether you’re going to market the property by way of private treaty (set price, by negotiation, offers over, an advertised buyer enquiry range) or auction, the marketing campaigns are likely to cost the same. What’s dif ferent about an auction in comparison to all other methods of sale offered is setting a date to sell your home as opposed to inviting people to make offers. A well-presented home says “welcome”. A really well-presented home can say “own me”. While your home doesn’t have to look like a showroom, it is preferable that it appear to be a comfortable place to live. Your home is one of many on the market, so it needs to stand out. It’s important to remember that homes are sold in competition, not in isolation.

We know from experience that owners who make an extra effort will, in many cases, achieve a quicker sale and a better than expected price.

The selling process typically starts months before a property appears on the market. It’s necessary to look at a home through the eyes of a buyer and determine what needs to be cleaned, painted, repaired or removed. The objective is to reduce or eliminate buyer objections or doubts.

Tips to ensuring your home looks its best:

Pavement appeal Make sure the front of your property looks appealing and inviting with a weed-free garden and some attractive plants or pot plants. There’s no second chance at a first impression.

Cut the clutter You want prospective buyers to imagine their own belongings in the property, so de-clutter and keep things tidy. Less clutter will help make rooms appear larger and allow buyers to

focus on your property rather than your furniture.

Set the scene You may want to hire furniture to create the look you desire. This is a great way to

transform your home and give it added appeal.

Fix it From leaking taps to broken bulbs, make sure minor repairs are taken care of. A coat of paint will freshen scuffs and scrapes on walls and woodwork. Basic maintenance will help ensure

Auctions offer great transparency. One of the things that can give people reservations about buying at auction is thinking they won’t get a straight answer from agents about the property. As a buyer you want guidance and a good salesperson masters the art advising all their clients. It’s a balancing act and is typically the most contentious part of auctions, as the agent has to be non-judgmental about the assessment of the property value. The truth is, there is no exact answer about what a property is worth, and the price the owner will accept is constantly changing. A great agent will share market data, recent sales information and insights on other buyers’ comments. They aim to be as open as possible, so they don’t waste your time. However, there are no precise answers regarding what will happen on auction day.

As a buyer, it is always important to make your own judgments about a property based on your experience in the market, information provided by the agent and your own needs. The reserve price is rarely, if ever, disclosed. Advice and opinion on an expected reserve price will only create uncertainty if you are not confident about your own position. Always remember, when you are a registered bidder you always have the choice about what you are prepared to pay and offer for a property. Most of us have a price we would love to buy for, a price we think is fair, and the maximum price we would consider paying to obtain our dream home. You need to ask yourself “What is the maximum price I would

offer for the home and will I be happy to walk away if it goes higher?” or “Will I regret it if I let this property go to someone else at this price?” Your answers should determine your actions.

Practice builds confidence

If you have never been to an auction, we advise that you attend a number of auctions, so you can get a feel for how they work. Gaining greater understanding will give greater confidence. Watch the auctioneer and how he calls for bids and interacts with the bidders. What do the agents do during the auction? How do bidders behave? How do people react under pressure? Does the auctioneer encourage bidding or rely on the bidders to call the bids? Look for what happens when the bidding breaks down, what agents do with their buyers, how they treat the sellers, and how the process unfolds. This will give you a better idea of what to expect on auction day.

Bidding at auction can be an intimidating process. If you’d rather be left alone while bidding, so you don’t feel unnecessarily pressured, make sure you let the agent know. However, it is important you know they are there to assist you and can provide vital information that may assist you during the auction.

When you register to bid, you can feel exposed by doing so. It can make you feel vulnerable. When you bid at public auction, you are publicly demonstrating that you like something and are interested. This is why it is so important to be fully prepared. If you are well prepared for an auction, you will likely also find that you will actually enjoy the atmosphere and the experience! Also, it’s important to remember that the other bidders are far more concerned with how they feel than what you are doing.

If you are unsuccessful on auction day, it may just be that it wasn’t meant to be. If you gave it your best shot, you shouldn’t walk away feeling like you have failed. Ideally, the marketing agent will demonstrate how much they care by offering condolences and also offering you other solutions going forward. They may suggest similar properties available for sale. They should continue to build and maintain a relationship with you by helping you find another property that you love just as much.

In today’s business world it is said “You don’t sell to everybody, you sell to somebody” (Anita Roddick). We encourage interested buyers to meet with the agent in the lead up to the auction. It is great getting one on one with people, particularly if you have questions you want to ask before auction day. Your agent can arrange a private appointment to assist with further inspections of the property, answer questions on finance, the buying process or the overall auction experience. If you are still unsure about the process on the day, your agent can sit down with you, have a discussion and walk you through dif ferent scenarios and how you might manage them.

It might even be an idea to register early, which means there is one less thing to do on the day. It also allows you to be discreet, ask any final questions of your agent, and increase your chances of going unnoticed as a registered bidder.

Transparency and honesty are paramount to auctions. Which is why we provide you with as much information as possible for both legal and ethical reasons. It is unfair to you as a buyer if an agent is not honest with you, as it will not give you the great experience you deserve.

Being prepared with your finance

There are often situations with auctions where the buyer attends and participates in the bidding thinking the property will sell for a lower amount than recent sales suggest. Commonly, the property ends up selling for a significantly higher amount. Seller motivation can often mean that the reserve price will be lower than market values suggest. Don’t overlook the opportunity for a bargain, but also consider what the value of the property is to you. If you like the home, arrange finance for a price you are willing to pay, so if the price goes higher than initially expected, you can still remain a genuine contender to buy the property.

Actual value and perceived value can be quite different, depending on variables in the market, and can often drive up the bid price at auction. Come prepared to pay a deposit based on the maximum price you are prepared to pay.

It is important that you are as informed as you can be before the auction. You don’t have a crystal ball and can’t predict what the property will sell for, but you can do your research and with your agent’s help you can be as prepared as possible going in.

Alternatively you can make an agreement for a part deposit prior to auction and if during the bidding process the price goes over your deposit amount, you can ask the agent during the auction if the seller would agree to a part deposit. It may also be possible to negotiate variations in the settlement conditions in the contract and this should always be confirmed with the agent prior to auction day.

Typical Buyer Concerns

Here are the 4 main auction concerns or comments from buyers

Waste of time There may be more than one unsatisfied buyer at an auction. Knowing that you might not

be successful can help you come to terms with this. There can only be one buyer, this is no different to any other property purchasing process, auctions are simply more transparent.

Having no idea of price Unfortunately our role as agent generally does not allow us to disclose a reserve price. As much as agents can guide you about price based on recent sales in the area, the seller’s

expectations of what their house should be sold for may be different to market expectations. One of the valuable things about the auction process is it can clearly demonstrate market value. It is important to remember that it is the buyer who determines the final sale price.

Buyers covering costs associated with auctions with no guarantee of success In the ACT, selling a home requires demonstrating building inspection and pest reports as

part of the contract of sale. Like with most big decisions, it is always important that you seek advice. Yes, there will be costs involved with consulting solicitors and other experts, but buying

a property is a huge investment and you want to make absolutely sure you have covered all the bases. We will always recommend services if required.

Pressure of attending auctions When you want something that other people love, it is going to be competitive and quite

stressful. We have agents and auctioneers who are very mindful and aware about the situation and will attempt to keep the auction day experience friendly and energetic, calming nerves

and putting people at ease.

Offer before auction day

In some cases sellers may consider offers prior to auction. After inspecting the property, it is advisable to tell the agent of your interest. This ensures you will be advised of any pre-auction day offers made by other prospective buyers.

You need to be aware that any offer of this nature is made under auction conditions and requires full conditional finance approval. If such an offer is accepted, it will require an immediate unconditional exchange of contracts prior to the property being taken off the market.

Preparation for buying at auction

It is important to be prepared. Auctions can provide you with a terrific opportunity to purchase your dream home in a transparent negotiating process. Understanding the requirements of each stage and what options you have will increase your ability to bid confidently.

Prior to bidding or making an offer ensure you have done the following:

Arranged finance

Obtained a draft copy of the contract

Discussed what settlement terms are available

Read all the property reports

Commissioned any additional inspections or a valuation

Sought advice on the contract terms and conditions

These steps will help to make sure you have the information and details you require to make your decision.

Benefits of buying at auction

There are many benefits of buying at auction many of which will appeal and apply to you. When you understand them, the attraction of the auction process will become clear.

Avoiding anxious uncertainty If your hand is up when the hammer comes down, contracts are exchanged and the

property will be yours. No one can step in and take it away from you, the seller can’t change their mind, and no one can gazump you. No breaks will occur anywhere along the chain of

transactions. You will also bypass the anxious, uncertain, often lengthy period which private treaty buyers experience between agreeing to a purchase and exchanging contracts.

Everyone wins if the property sells The open and transparent nature of auctions and the bidding format allows all interested

buyers to participate, and everyone knows if or when the property sells.

Fixed timeframe The process is generally quick and easy. There is a fixed, known timeframe from the very

beginning - the auction date is set and the period from then to completion, is stated in the conditions of sale. You know how long you have to evaluate the property, obtain advice and

expert opinions, and determine your maximum bid price.

It’s not first come, first served Everyone has a fair chance at auction. It isn’t a first come, first served arrangement. Most properties entered into auction are sold under the hammer. This doesn’t mean you can’t put in a pre-auction bid if you are very keen. To be accepted, it would need to be a very

strong bid to convince the owners to forgo the opportunity to expose their property to all the other buyers on auction day.

Strategies to use on auction day

Being successful is about planning and preparation and having a conversation with your partner, family or a third party about how

much you are prepared to pay. Ensure you decide on this before the day. However, you might want to consider being a little flexible. Would you really let the property slip away if the price is only $1000 over your limit?

Arrive early and get comfortable. Try to identify other bidders – or get a friend or relative to do this.

You need to register as a bidder in accordance with the Civil Law (Sale of Residential Property) Act 2003. To do this you will need proof of identity in an approved form displaying

your name & address. Photo ID is required (e.g. Current driver’s licence or passport).

If someone is bidding on your behalf, they will need a copy of your photo ID and a signed written authority from you to do so, in addition to their own photo ID. If you are the successful bidder the auctioneer may want to confirm your winning bid before selling you the property.

Once you have registered you will be allocated a card with a bidder’s number. You will need to clearly display this bidding number every time you bid. You may choose to

announce the amount you are bidding or nod to the auctioneer when agreeing to the nominated bidding amount.

Make your bids clearly and confidently. Set yourself an upper limit, but also factor in any personal value the property may hold for you. What value do you place on owning the property? Are there benefits such as views or location that hold personal value to you?

Most auctioneers will often make a final-sounding declaration like “first call, second call, third and final call, all silent” – and then stop, disappear into the house to seek final

instructions from the seller and re-emerge moments later to restart the auction.

What to expect on Auction day

There is an old saying, “Do you protect them along the way, or shock them on the day?” Auctions are not intended to be sugar coated. The agent needs to be genuine and not mislead you in any way. They need to educate you throughout the process so you feel comfortable on the day.

Expect the unexpected. Recently there was a dispute across the road and the seller was concerned if the auction was held on site the neighbour might yell something out that would deter buyers. In this case it was important to reassure them that there would be a whole team there on the day. We were able to manage the situation which not only eased their concerns but assured a successful auction.

Everyone has their own pre-conceived thoughts or fears of what may happen on auction day. If you have only ever watched auction shows which are edited all you see is what the media wants you to see - the tears of joy or despair, you don’t see the truth the real life of what goes on. It’s important to be prepared, be confident and have your strategies well thought out beforehand.

Auctioneers role

Auctioneers and the agents are the facilitators. The agent is there to offer assistance and support; they are not there to bombard you. They should always make themselves available to you, but not be in your pocket. As an auctioneer their role is to make the buying and selling experience enjoyable and ensure people are given every opportunity to get a great result.

Owner to arrive and enter the home like all other buyers - remain as anonymous as possible. The agent will seek the seller out and move to a discrete location to discuss the ‘game plan’ for the auction.

A team will clear the property if outdoors and/ or move all buyers to where the auction will take place.

The auctioneer and listing agent will then ask for final instructions before suggesting where seller should be whilst the auction is taking place.

The auctioneer will go through an introduction, discuss the legal requirements which is the contract and conditions of sale by auction (as legislated) and will then discuss the best elements of the property and location before welcoming bidding.

First call…second call……third and final call….SOLD!

Let’s talk about the two possible outcomes, either the property sells, or it doesn’t.

If it doesn’t sell, don’t be disheartened. Under different circumstances the property could be worth more or be more desirable to another buyer. We understand that what happens after the auction can sometimes be the most important stage of the entire process. This needs to be treated as a positive. It is very common that if the property doesn’t sell on auction day it will sell in the week or two after.

As an auctioneer it’s very easy for an auction to look good when there are 10 bidders and 72 bids, but a really good auctioneer who has no bids with no interest can still make the crowd feel engaged and keep it energetic. If the property gets passed in and fails to reach reserve, the auctioneer and agent will thank everyone for coming along, escort people out and speak with people who have shown interest. If you were the highest bidder, you will have the first right to negotiate under auction conditions.

If the property is passed in and immediate negotiations do not reach agreement, the agent can then begin negotiations with other bidders. Should these be unsuccessful, the property will generally be placed on the market for private treaty negotiations at a price agreed to by the seller.

If it sells, the auctioneer will immediately congratulate the highest bidder and commiserate unsuccessful bidders. The highest bidder will then be taken to where the original contracts are being held to complete these documents. It is best that the seller is not present while this is taking place.

Once the buyer has signed the contract and paid a deposit, an agent will come to get the seller to sign the other side of the contract in order to execute the exchange of contracts.

In some cases the buyer would like to meet the seller, but it is up to the seller to decide if they want to meet the buyer.

The buyer will then depart the property. The team of agents will have left at the conclusion of the auction and removed all of the items that were brought for the auction. The listing agent and their team will then collect the original contracts and depart with the job completed.

The agent will ensure that all legal documents are handed over to each solicitor and that the deposit is banked in the agency’s trust account. You will receive a letter of confirmation of this occurring from the agency. It is now important for you to make arrangements for removalists, change your contact details and notify your agent and solicitor of these changes.

The seller will vacate the property and leave it in the same condition as inspected during open homes for settlement. The agent will then bring the buyer through the property on the day or just prior to settlement to ensure that the property is in the same condition. Once this occurs the property will be ready for settlement. Once settlement occurs the new owner will collect the keys from the agent or solicitor and be ready to move in. The agent requires a document called “order on the agent” from the seller’s solicitor before they can release the keys and release the deposit into the seller’s bank account, minus costs.
