ALGERIA CAP EXPORTER AND IMPORTER GUIDELINES

INTRODUCTION In March 2011, the Algerian Ministry of Commerce published a note to all importers reminding them the obligation of submitting a proof of conformity for all shipments entering Algerian territory, to ensure that they meet legal and regulatory requirements that affect them. This obligation is enforced by the law 09-03 dated 25/02/2009 and the decree 05-467 dated 12/12/2005, on conditions and procedures of conformity control of imported goods at customs The conformity assessment of the regulated products is based on the review of existing certificates and test reports, followed by inspection of goods and testing where necessary. On successful conformity assessment, the certification and inspection body issues the Certificate of Conformity (CoC). The required Certificate of Conformity can also be referred as “Certificat de contrôle de qualité”. The original copy of the Certificate of Conformity is needed for every shipment and should be issued in the country of export. It is a mandatory document for Algerian Customs clearance.

OBJECTIVES AND PRINCIPLES The primary objectives of the programme are: To ensure that products imported into Algeria meet the security, safety, health and environment requirements as

per the sanctioned standards and technical regulations approved by IANOR (Institut Algerien de Normalisation).

Provide assurance to the Algerian consumer that the products imported into Algeria are free from potential hazards and fit for use.

To avoid costly delays at the ports and rejection of shipments if the shipments are found to include dangerous and unsafe products.

To help genuine and complying exporters and importers to quickly clear Customs process without the risk of rejection of shipments.

To streamline Custom clearance procedures, promote healthy and fair competition and fight against unsafe and dangerous goods.

THE INTERTEK SOLUTION Intertek pioneered the development of the product conformity assessment programmes, which is now being

applied in many parts of the world to prevent dangerous and unsafe products entering into the market. Intertek has over the years built up vast experience, infrastructure and necessary knowledge in the management of the conformity assessment programmes. To date Intertek has issued more than a million certificates of conformity.

REGULATED PRODUCT CONSIGNMENT CERTIFICATION PROCESS Regulated product consignments have to be verified for compliance to relevant sanctioned standards, essential requirements or manufacturer’s specification. The compliance verification process may involve physical inspection of the consignment and if necessary sample selection for testing purposes. The certification process is as outlined below: 1. Exporter Submits Request for Certification (RFC) and Supporting Documents

The Exporter contacts the responsible Intertek Country Office and submits a request for certification. Exporter includes the following information along with the request for the certification:

a. Details of products which are included in the shipment b. Name and address of exporter and importer c. Location of consignment and provisional date of availability for inspection d. Payment details, port of discharge, port of loading, mode of transport.

Exporter includes the following documents: a. Test reports/ Reports of analysis/ Quality mark validity proof b. Product specification sheet/ MSDS c. Certificates related to the management of the quality/ safety system (ISO 22000, ISO/TS 16949, ISO

13485…) d. Invoice

Exporter forwards the request for certification and the supporting documents to the Intertek Country Office

2. Country Office (CO) Review of RFC & Submitted Documentation The Country Office reviews the information provided by the exporter and does a preliminary check to verify

whether the substantiating test documents submitted are enough to do a conformity assessment of the products to the sanctioned standards.

If not then the CO will request the exporter to provide more information/documents. At this stage the CO will submit a quotation to the exporter for the inspection and certification costs and if acceptable, the CO office will arrange for the inspection and if necessary removal of samples for laboratory testing/ analysis.

3. Consignment Inspection/ Testing by the Appointed Inspector The Country Offices coordinates with the exporter for the inspection of the consignment. Once the inspection has been arranged, the inspector inspects the consignment to verify whether the

products included in the shipment are same as those detailed in the documents submitted for certification, the markings on the product and product’s packaging to ensure it includes the required information, the quantity of the product is as per the invoice and physical condition of the products. If necessary, the inspector may remove samples for additional assessment

4. Issue Certificate of Conformity/ Quality Control

On successful review and conformity assessment of the test reports and inspection result, Intertek will issue

the Certificate of Conformity. If Exporter requires additional original copies of the CoC, these could be provided by the CO.

FEES The party acquiring the certification services is accountable for charges to the conformity assessment related services performed by the conformity assessment Company. These fees cover the cost of inspection, evaluation, testing, and all other technical and administrative activities involved in the shipment certification. An individual quote will be provided to the party requesting for the certification services and agreed upon before commencing with the conformity assessment process.

1. Unless otherwise explicitly agreed between the parties in writing, any Certificate or report issued in response to this application is issued strictly subject to Intertek's General Terms

and Conditions, a copy of which is available from our nearest Country Office or at our website: http://www.intertek.com/terms/.

2. Intertek represents and warrants that any Certificate or report issued in response to this RFC is issued in good faith and in the reasonable belief that it has authority to do so from the respective authorities or within the provisions of relevant decrees issued by them.

3. The Request for Certification (RFC) sets out the entire agreement and understanding between the parties in relation to its subject matter. The Exporter acknowledges that, in submitting the RFC, it has not relied on any oral or written representation, warranty, or other assurance (except as provided for or referred to in this RFC) and waives all rights and remedies which might otherwise be available to it in respect thereof, provided always, that nothing in this clause limits or excludes any liability for fraud.

4. Inspection Auditors and/or Observers from the Country Office are to be allowed access to the Exporter’s inspection site without prior notice for the purpose of ensuring that a recently performed inspection has been correctly conducted. The Auditors and/or Observers are authorized by the Country Office to amend or overturn the inspection outcome if the result of the audit supports this action. In their course of action, Inspection Auditors and/or Observers will not hamper or hinder the export process.

5. In the event of conflict between the Exporter and an Approved Laboratory relating to the testing of the products, the dispute shall be resolved by the two parties, without

involvement or responsibility on the part of the Country Office (CO), Registration and Licensing Centre (RLC), Centre of Technical Expertise (CTE) or Programme Management (PM). PM shall be informed of such dispute to allow a reassessment of the laboratory’s approval status to be made if warranted.

6. In the event of conflict between the Exporter and any of the COs, RLCs or CTEs relating to the inspection, evaluation, licensing, registration or certification of the regulated products, the Exporter shall be entitled to submit a complaint to the CO, RLC or CTE. If no agreement can be reached, the exporter is entitled to submit an appeal to the Programme Management within two (2) weeks from the date of submittal of the complaint to the CO, RLC or CTE. Documents supporting the Exporter’s point of view shall be attached to the appeal. Programme Management undertakes to investigate the complaint in accordance with Intertek’s internal complaints procedure, and issue a decision thereon within one (1) month from the date of receipt.

7. The Exporter is responsible for informing Intertek in advance of any applicable import/export restrictions that may apply, including instances where products, information or technology may be exported to a country that is restricted or banned from such export.

8. The Exporter commits to fulfill the certification requirements, including implementation of appropriate changes as and when advised by Intertek.

9. The Exporter makes all the necessary arrangements for the investigation of complaints, should the need arise.

10. The Exporter commits to use the Conformity Certificate solely for the purpose for which it has been issued for and must refrain from any form of misuse or make any statement that may cause disrepute to Intertek. The Conformity Certificate issued is only for the shipment verified by Intertek and must not be used in communication media and marketing documents to indicate otherwise. The Exporter must not use the Intertek logo in any documents, brochures, etc. without prior consent from Intertek.

11. If the Exporter provides copies of the Conformity Certificate to other party, the document shall be reproduced in its entirety.

12. The service undertaken by Intertek does not absolve the Buyer and Seller from their contractual obligations to each other, or from compliance with any other import or export regulations.

13. Unless otherwise explicitly agreed between the parties in writing, the above conditions shall be governed by English law and any dispute arising out of this RFC to which these conditions apply shall be subject to the jurisdiction of the English Courts. This Clause supersedes Clauses 22 and 24 in Intertek’s General Terms and Conditions with respect to jurisdiction.
