It's been commonly known that R & R has been on the block for some time, and the asking price for the paper has continually dropped from the mid -40 million mark, down into the low 20's. As we're fairly sure that Group W credit isn't interested in operating the paper, the next question is, where will the bidding start this time --and from whom? THE PEOPLE SPEAK. Thirteen West Central Ohio stations have petitioned the FCC to deny an application by Lima Broadcasting for a new CP on 103.3 MHz in St. Mary's OH. The group argues that the resulting duopoly of the new station and the two Lima Broadcasting already owns, WIMA /WIMT, will exceed the audience share cap of 25% The Spring '93 Arbitron puts the combo's share at 31.3 %. The only competing applicant to Lima Broadcasting for the new station, Clear River Communications, had their app. returned last year. The group asks that the Commission dismiss Lima's application, or designate the matter for hearing.

The Commission has stayed an allotment in Globe AZ for KRXS, because the Mexican government is taking its sweet time. Linda Potyka petitioned for an upgrade to class C3 from A, which was effective October 25. Since Globe AZ is 199 miles from the border, the Mexican government must approve the upgrade, too. In the order, the Commission stated "...this delay is not directed to the merits of this specific proposal, but rather is a generic approach to all unopposed concurrence requests currently pending before the Mexican government." Manana....

Duke Radio Broadcasting, owner of KFIN Jonesboro AR, convinced the Commission to bend the rules a little by allowing them to purchase Patteson Brother's KBTM /KJBR -FM Jonesboro. However, one of the FM's must be sold with one year. The transaction satisfies the common ownership rule regarding number of stations owned, but gives the stations a combined share of 34.2 -- way over the 25 percent cap. Duke unsuccessfully argued that the stations six -year average trend was just over a 23 percent share of the market, and that the last Arbitron county -by- county numbers used to determine share in Jonesboro were "an anomaly."

In the latest wave of NAL's to radio stations, the ticket tally hit $61,600 this week, all from stations in Texas. The most common violations were EBS equipment violations or tests not made, missing public file documents, bad remote control meters, unlicensed operators, and excessive field strength at monitoring points for AM directional stations. Here's the hit list:

When Dorothy Torgerson's Lady Bug Broadcasting was awarded a new CP for 104.1 MHz in Union MS, she may have thought her troubles were over. They're just beginning. She's now facing lack of candor /misrepresentation issues as well as fitness as a licensee issues after her resume' has surfaced showing that she had ownership and duties at a station in Meridian MS that she apparently denied having during the proceeding. Things like the fact that she had a 49% stake in the station, and she was on the board of directors. The Commission has called her attempt to explain the situation as "backpedaling," and raises even more concern about her fitness to be a licensee. Torgerson could face fines up to $250,000.

The Commission's crack -down on stations that are silent without permission went one step further this week when it was discovered that Fischer Land & Development Corp's KSDY Sidney MT, which has been silent for three years, did not apply for license renewal back in 1987. The station's operating authority was terminated; the call letters deleted. No NAL has been issued.

Jacor's KOA took it on the chin for $10,000 after the Commission has found it didn't identify the sponsor on several spots that aired for the Cripple Creek Chamber of Commerce- -even after the spots were played for the Commission. The Commission contends that the spots were tested for lottery provisions, not sponsorship ID.

Southern Broadcasting Companies, former licensee of WSTT Thomasville GA, was successful this week in getting a forfeiture reduced from $17,500 to $5,000 after a former employee testified that the station's complete public file was maintained in a separate location then the one the Commission reviewed. The station will still have to pay the $5,000 fine for being off the air without authorization.

Broadcast Programming has picked the last apple off the tree. BP announced this week they are purchasing Bonneville Broadcasting System. Terms were not disclosed. Bonneville is the last of the eight major taped -programming suppliers, including Peters Productions, Radio Arts /Musicworks, -and the tape divisions of TM Century and Drake -Chenault. BP was recently purchased by Broadcast Electronics.

Command Communications is selling off its Spanish Information Service and Spanish Entertainment Networks to Alfa Broadcasting, forming a Spanish news and music service that currently has 60 affiliates in the U.S., and will service another 70 stations in Mexico.

Strategic Radio Research has announced two new subscribers for the AccuRatings service. Dallas & Tulsa will begin measurement with the Fall book.

The man who has more lives than Morris the Cat (but not as good of a TV contract), Morton Downey, Jr. has migrated yet again, this time to Major Networks. The web plans to use Downey as a cornerstone program for a new 24 -hour talk network to be launched soon. Downey has attempted syndication with Washington -based Radio America, his own deal at KGBS Dallas TX, and the American Forum Network.

Community Pacific Broadcasting and Silverado Broadcasting are joining forces to form a Western group. Community Pacific owns KKSD, KASH -FM, and KBFX Anchorage, and is in a sales LMA with KENI. In the Spokane market, Silverado has KAQQ /KISC and KNFR Opportunity WA, with a sales LMA with KCDA Coeur d'Alene ID. They also own KWG Stockton CA /KEXX Tracy CA. Community Pacific is selling a 50% stake to Silverado. The resulting company will be called Silverado Pacific Broadcasting.

If he thought being candid about his playlist during a panel session at the NAB Fall Radio Show was the best thing to do, WCSX Detroit OM Ralph Cipolla will think better of it next time. Crosstown rival WRIF happened to pick up the tape of the panel session, in which Cipolla said about his playlist, "It's all an illusion and basically we play the same songs over and over again . . ." The tape was then edited and turned into a promo for all to hear on WRIF. WCSX management is not commenting on the promo.

Radio revenue continues to hold its own according to the Radio Advertising Bureau, with September revenue up 9 percent over last month, and 8% over last year. National billings were up 9 %, as well. Surprisingly, network also posted a gain --a 6.7% gain over last year for the third quarter.

Arbitron h ?s decided to reissue the Wichita Falls hook for Spring 1993 after KTLT's Jim Schroder, in a diary review, discovered that "106" entries were credited to KHKS Denton (Dallas), instead of his station. Inside Radio notes this is the second time the Wichita Falls book has been reissued after a visit by Schroder.

Long -time Shamrock stations WHK /WMMS Cleveland OH are in the process of being sold to Hirsch Holding's, who will put the two together with it's WMJI Cleveland. Price was not disclosed.

Who says campus stations are limited to colleges and universities? If WMKV Reading OH (Cincinnati) has their way, they'll be live from Maple Knoll Village --a retirement community. WMKV is looking to program to Cincinnati's older community with a 24 -hour big band /nostalgia format with plans to expand to some of the classic radio programs of the 40's. Problem is the station's "advisory committee" needs another $250,000 to get everything moved and get the non -commercial CP, at 89.3 MHz, on the air. It's interesting to note here that the applicant, Southwestern Ohio Senior Services, won the CP in a comparative hearing from Miami University last year. In the hearing, each applicant must certify they have solid financial backing for a period of time in order to be considered fit to be a license. Too much bingo?

The Country Radio Broadcasters is searching for nominees for its Humanitarian Awards for outstanding public service in small, medium, and large .,,,.rket categories. The CRB will also hold a silent auction to raise money for the Country Radio Seminar Scholarship Program, during the CRS in Nashville. For more info, call (615) 269 -7071.

The NAB Radio Executive Committee is also looking for radio's best to induct into the Radio Hall of Fame. Nominations are being accepted based on "on -air reputation, legislative action, entrepreneurship, technical advances, executive leadership, programming innovations, and other significant contributions." The Children's Syndicated Radio Network is alive and well in Eaton Rapids MI. The network is distributing the "Motivation Station" which offers music, story telling, book reviews, and more. For more info, contact Sandra Bailey- Bristol at (517) 663 -8442.

Brian Beazer has been named Program Director of the Kool Gold Network. Brian has previously worked in Boise and Ogden /Salt Lake City. Jones Satellite Network's VP /GM Roy Simpson has left to become VP of Major Network's Southeast sales region. The search for a replacement at Jones is on.

The Commission blasted WHYN AM & FM Springfield MA with a $12,500 fine AND a short -term license renewal for EEO violations. The Commission found the station EEO program failed to recruit minorities. FCC Chairman James Quello dissented, stating the violations did not warrant a short -term renewal.

In the name of reducing interference, the NAB has asked the FCC to "review and perhaps overhaul" the rules governing AM directional antennas. The NAB says computer models coupled with historical data can do a much more efficient job of handling interference and field strength readings.

Three different technologies were presented a the first meeting of the NAB's NRSC High -Speed FM Subcarrier Subcommittee meeting, held November 3 in Washington. The subcommittee was formed to standardize a high- speed, transparent subcarrier signal system that is compatible with RBDS, allows for multiple service users, and is effective in a mobile environment. Seiko's HSDS system allows for receivers to switch frequencies, in the event that the signal being received from one station becomes too weak. NHK Japan's DARC system is designed for mobile reception to vehicles. The Federal Highway Administration and MITRE has also proposed a system which is being tested in Washington for use in the Intelligent Vehicle Highway System.

The House Banking Committee has added the provisions of the radio ad disclosure legislation, which would help to eliminate those lengthy disclaimers at the end of leasing and financing spots. The NAB applauded the move, stressing the need for broadcasters to urge their senators to co- sponsor the Senate version of the bill. The bill now moves to the full House for approval.

In duopoly news, Albany GA has seen its first, with the purchase of Guardian Corp's WMGR /WJAD Albany GA by Peterson Broadcasting's WWGS /WSGY Tifton GA for $1.28 million.

Entertainment Communications (Entercom), in its first station sale in two decades, has entered into an LMA -to- purchase in Oklahoma City with NewMarket Media Corp. NewMarket, who owns KXXY AM & FM, will pick up Entercom's KOQL, for an undisclosed price. The LMA is effective immediately.

Great American TV & Radio Company has agreed to sell WLZR AM & FM Milwaukee WI for $7 million to Saga Communications. Saga also owns WKLH there.

In another transaction of note, Crawford Broadcasting has added another great market to their growing group. Crawford has announced its intent to purchase KXOK St. Louis MO for an undisclosed price.

Westwood One has added some new talk show fare as a lead in to afternoon talker Pat Buchanan. Brooke Daniels and Roberta Gale from New Jersey 101.5 (WKXW Trenton NJ) will discuss a wide range of issues from 9 a.m. to noon eastern time, beginning February 7.

Kurt Hanson's AccuRatings will be making their data available to agencies via computer software later this year. The move will allow third party processors to utilize the data in their sales software, including calculating reach, frequency, and gross ratings points.

Cincinnati will jump up into the nation's top 25 radio metros as Arbitron releases its annual market redefinition plan. The Cincinnati metro will add six counties, while Atlanta and Ft. Wayne will add three counties. Other metros with definition changes include Albany NY, Albuquerque, Austin, Dayton, Ft. Wayne, Greensboro - Winston /Salem -High Point, Houston, Knoxville, Lafayette LA, Pittsburgh, Raleigh - Durham, Rochester, St. Louis, San Antonio, and Seattle.

The Sound of 2000, the Second International Symposium on Digital Audio Broadcasting, will take place March 14 -17, 1994 in Toronto. The confab plans sessions and presentations about DAB programming, transition scenarios, systems technology, standards, and more. For more info, call 613 -594 -8226.

"ISSUES ETC. ", a new talk radio program dealing with today's issues is hosted by Don Matzat and covers issues including family values, violence on TV and the right -to -life movement. A SMOOTH BREEZE BLOWS INTO SACRAMENTO. After Brown Broadcasting's switch of KQPT Sacramento from new age to progressive rock, the city's jazz listeners had to do without. Soon, there'll be two stations coming on at once to fill the gap. Listeners will be treated to "the breeze" on KQBR Davis or "smooth" jazz on KSSJ Shingle Springs. Even though neither station has a signal that completely covers the market, KSSJ does have a facilities upgrade to 44,000 watts at 581 feet pending.

NO RECESSION AT THE FCC ENFORCEMENT BRANCH. Over $137,000 in fines was generated this week as the FCC enforcement branches in Denver, Houston, Chicago, Grand Island, and New Orleans hit radio broadcasters in a sweep for EBS, public file, field strength readings, and power variance violations. The EBS is looking at a make -over. Created in 1951 and revised in 1976, the FCC is now considering replacing the outmoded EBS system. The proposed new system would employ new digital equipment, automated procedures and integrate cable television for the first time. Comments by the NAB addressed many issues and concerns that have to be ironed out before a final FCC decision. Cost, was one of the critical concerns. NAB said many broadcasters, particularly small market stations, would not be able to absorb any significant costs of the new systems. To address the challenges and concerns, NAB asked the FCC to first issue a "Tentative Decision." on any revised EBS rules, deferring rinal action until receipt of further comments.

ELSEWHERE

After all the commotion about the proposed 70% Arbitron sample hike over three years, only one -third of the markets will see the benefits of it. Of the 96 markets that were scheduled to see the first phase of the sample increase in time for the Winter '94 book, only 32 made it. Those who had 80% of the subscribing stations return their contract addendum will see a 30% sample increase next year. Another 64 markets have until December 31 of this year to get those addenda back in, or Arbitron plans to "withdraw the offer," according to Inside Radio. Some of the larger markets that won't see the sample hike are Boston, Houston, Seattle, San Diego, Pittsburgh, Tampa, Cleveland, and Sacramento.

The biggest transaction news of the week is the $160 million "partnership" between Broadcast Alchemy and Booth American. According to Inside Radio, the two companies will remain separate entities, but will roll their stations in a yet -to- be -named station group. Booth will combine its stations in Detroit, Denver, Cleveland, Cincinnati, and Sacramento with Broadcast Alchemy's stations in Indianapolis and Pittsburgh. Booth's stations in Toledo, Saginaw, and South Bend will not be included in the new group. The new group will have one duopoly --in Indianapolis --but Booth will have to spin off WZPL Indianapolis.

Greater Media is picking up Great American's WRIF Detroit MI for $11.5 million `o create its second duopoly in a top 10 market. Greater Media already owns album rocker WCSX Birmingham MI.

Group W is set to purchase KKHI AM /FM for $14.2 million. Possible format includes all -news (with the help of the company's TV station), but nothing's definite yet. No comment from Group W.

Max Radio is doubling up in the Greensboro -Winston /Salem -High Point market by purchasing Beasley's WJMH Reidsville. Price was not disclosed. Max owns WMQX there.

Autotalk, Inc., producers of the first all- traffic broadcast, have reached an agreement to utili.oe -4äe ,Setae SÀeppiAg econ1 ry- aigrii,q program to broadcast it's traffic reports. Autotalk is a device that connects to car radios and delivers free, continuous, regional traffic reports. Presently broadcasting in San Francisco and Los Angeles, Autotalk is looking to expand to 30 areas in five years. Ten potential markets include New York, Chicago, Philadelphia, Boston, Baltimore, Dallas, Houston, Tampa, Cleveland and Miami. Fines ranged from $300 in New York to $20,000 in Covington LA, topping last week's total of $137,250 in fines. The Senate confirmed Reed Hundt as FCC chairman late Friday (11/19) night. The chair has been vacant for almost a year since Al Sikes' departure.

NAB has turned down support of a October 8, 1993 Sony request for AMAX certification for a new personal receiver that it is developing, stating that it doesn't fully comply with the NRSC recommendations. Sony has said that the present specification is typical of a high -quality home or automobile receiver but not of a personal portable. To encourage continuation of development and marketing of AMAX receivers the NAB is proposing that the NRSC consider a revision of their receiver specifications.

Minnesota Public Radio (MPR) held a 35 -hour on -air fundraiser October 29 -30. Getting permission from the FCC to lift its non -commercial restriction for a 35 -hour period, MPR helped raise a total of $741,269 to save the Saint Paul Chamber Orchestra. The FCC granted the waiver saying that "the waiver would serve the public interest."

ELSEWHERE

The Radio Music Licence Committee (RMLC) and Broadcast Music Inc. (BMI) have announced that agreements have been reached on new blanket and per program licenses. Most provisions in the licenses are retroactive to January 1, 1992, and the agreements run though December 31, 1996. Some stations may end up paying more for 1992. The per program licence rate will remain the same but the use of the "highest one -minute rate" as the determining part of the per -program fee will be phased out. Other changes include:

-No longer an automatic 8% monthly fee adjustment from year to year. CPI will be used instead.

-Small stations (Revenue < $150,000) will continue to pay reduced rates. -BMI's right to audit station reports will be increased from two to four years on a "phase -in" basis.

SESAC is expanding its services to jingle composers and advertising music songwriters. INTERSTAR, a new full -time sports -talk radio network announced that it will commence 24 hour per day operations as of March 1, 1994. Talent has been signed on and others are in negotiations. WDCU is about to be jazzed up. After about eleven years the station is finally hiring a program director. Formerly of WBGO -FM, Wylie Rollins will start programing at the end of 1993. The station will also be adding NPR hourly newscasts.

Damion, formerly air talent /Program Director at AOR KLOS Los Angeles, will be joining Unistar's Adult Rock and Roll for overnights.

ABC Radio Networks has announced they've hired Santa Claus. Santa will begin his minute -long reports on November 29th and end them on December 24th, due to a previous engagement. His daily reports will cover everything from snacks he's left to what Joey Buttafuoco will get in his stocking this year, and other topics.
