Whereas, the land specifications whereof is given in“Annexure- A” to this notification is required for public purpose viz. forconstruction of an approach road (RHS) from Bridge over River Tawiat Sangarh to Nagola KM 1st RD-o to 1000 and KM 2nd RD-460 inVillage Nagola, Tehsil Dansal, District Jammu by PW(R&B)Department ;

Whereas, on the basis of an indent placed by Executive Engineer,PW(R&B) Const. Division II, Jammu vide 6907-10 dated 06-03-2015,a notification under section 4(1) was issued by Collector, Land

Acquisition (PWD), Jammu vide No. LA/636-44 dated 16-09-2016 forland measuring 12 Kanals 09 Marlas and 4½ Sirsai, followed by anothernotification vide No. LA/721-29 dated 29-09-2016 for land measuring22 Kanals 14 Marlas and 4½ Sirsai thus making the total quantum ofland to 34 Kanals and 14 Marlas situated in Village “Nagola”, TehsilDansal, District Jammu ;

Whereas, the Collector Land Acquisition (PWD), Jammu videletter No. LA/764-67 dated 28-10-2016 has reported that the notificationissued under section 4(1) of the J&K State Land Acquisition Act byhim was served upon the interested persons for filing objections, if any,to the proposed acquisition, but no objection was received from the landowners/interested persons in the prescribed time period as requiredunder sections 5 & 5-A of Land Acquisition Act ; and

Whereas, the report furnished by Collector, Land Acquisition(PWD), Jammu vide letter referred to above duly endorsed by DeputyCommissioner, Jammu vide No. DCJ/LA/PWD/Nagola/6&7/2016-17/1185-86 dated 01-12-2016 has been examined and it has been foundthat the land owners did not file any objection to the proposedacquisition ;

Whereas, the Government is satisfied that the land particularswhereof mentioned in “Annexure- A” to this notification is required forpublic purpose viz. for construction of an approach road (RHS) fromBridge over River Tawi at Sangarh to Nagola KM 1st RD-o to 1000and KM 2nd RD-460 in Village Nagola, Tehsil Dansal, District Jammuby PW(R&B) Department.

Now, therefore, in pursuance of section 6 of the J&K State LandAcquisition Act, Samvat 1990, it is declared that land measuring34 Kanals and 14 Marlas situated in Village “Nagola”, Tehsil Dansal,District Jammu particulars whereof are given in “Annexure-A” to thisnotification is required for public purposes viz. construction of approachroad (RHS) from Bridge over River Tawi at Sangarh to Nagola KM1st RD-o to 1000 and KM 2nd RD-460 in Village Nagola, Tehsil Dansal,District Jammu by PW(R&B) Department. Whereas, the land, specifications whereof are given in“Annexure- A” to this notification is required for public purpose viz. forconstruction of Banihal-Mangit road in Village Khari Tehsil BanihalDistrict Ramban ;

Whereas, on the basis of indent prepared by Executive Engineer,PMGSY Div-Ramban vide No. PMGSY/D/R/1454-56 dated29-10-2007, a notification under section 4 (1) was issued by Collector,Land Acquisition (ACR), Ramban vide No. ACR/PMGSY/706-14 dated08-09-2012 for land measuring 181 Kanals and 12½ Marlas situated atVillage Khari, Tehsil Banihal, District Ramban ;

Whereas, declaration under sections 6 & 7 of the Land AcquisitionAct was issued vide notification No. 10 RD of 2013 dated 06-03-2013 ;

Whereas, the tentative award so issued was submitted to theDivisional Commissioner, Jammu for approval of rates in 2014. Theacquisition proceeding could not be completed within the statutoryperiod of two years for want of approval of rates and the proceesingsthus lapsed under section 11-B of the Act ;

Whereas, a fresh notification was issued by the Collector, LandAcquisition (ACR), Ramban under section 4(1) of the Land AcquisitionAct vide No. Acq/PMGSY/16/337-47 dated 16-09-2016 for the land inquestion on the advice of the Financial Commissioners Revenueconveyed vide No. FC-LS-LA/4285/2012 dated 12-08-2015 ;

Whereas, the Collector Land Acquisition (ACR), Ramban vide hisNo. Acq/PMGSY/16/337-47 dated 16-09-2016 has issued freshnotification under section 4(1) of the Land Acquisition Act. Theacquisition proceeding initiated earlier could not be completed within thestatutory period of two years which lapsed in terms of section 11-B ofthe said Act ;

Whereas, the Collector, Land Acquisition (ACR), Ramban videNo. Acq/PMGSY/2016-17/601-04 dated 16-01-2017 has reported thatthe fresh notification issued under section 4(1) of the J&K State LandAcquisition Act by him was served upon the interested persons for filingobjections, if any, to the proposed acquisition, but no objection wasreceived from the land owners/interested persons in the prescribed timeperiod as required under sections 5 & 5-A of Land Acquisition Act ;

Whereas, the report furnished by Collector, Land Acquisition(ACR), Ramban vide above referred letter duly endorsed by DC,Ramban vide DC/LA/Rbn/291-20 dated 30-01-2016 has been examinedand it has been found that the land owners did not file any objectionto the proposed acquisition ; and

Whereas, the acquisition proceedings already initiated lapsed,having not been completed during the stipulated period of two years asrequired under section 11-B of the Land Acquisition Act, therebynecessitating conducting of denovo proceedings ;


Whereas, the Government is satisfied that the land particularswhereof are given in “Annexure- A” is required for public purpose viz.for construction of Banihal-Mangit Road in Village Khari, Tehsil,Banihal, District Ramban.

Now, therefore, in pursuance of section 6 of the J&K State LandAcquisition Act, Samvat 1990, it is declared that land measuring181 Kanals and 12½ Marlas situated at Village Khari, Tehsil Banihal,District Ramban, particulars whereof are given in “Annexure-A” isrequired for public purposes viz. for construction of Banihal-MangitRoad under PMGSY. Further, the Collector, Land Acquisition (ACR),Ramban is directed under section 7 of the said Act to take order foracquisition of the said land after giving prescribed notice to theinterested person(s) as required under the Land Acquisition Act/Rules.

Further, in pursuance of section 17 of the Land Acquisition Act,Samvat 1990, it is also ordered that on expiry of fifteen days from thepublication of the notification under section 9 (2) of the said Act, theCollector will take possession of the aforementioned land in VillageKhari, Tehsil Banihal, District Ramban required for public purposessubject to fulfillment of the conditions prescribed under section 9(2) andsection 17-A of the Land Acquisition Act and rule 63 of the LandAcquisition Rules.

However, the Collector concerned shall be personally responsiblefor identification and proper title verification of all types of land involvedin the case and apportionment of compensation amongst all the interstedpersons/rightful claimants in accordance with the relevant laws/rules inforce, while making the award.

On 22-06-2006, another report was received from said MuhammadAbdullah Deka stating therein that his brother Nazir Ahmad Deka hasbeen abducted by some unknown persons who were boarded in a whitecolour Gypsy, near Biscoe School, Srinagar with the intention to kill him; and

Whereas, in this connection, case FIR No. 62/2006, undersections 302, 364, 201, 120-B RPC was registered in Police Station, KothiBagh, Srinagar and investigation initiated ; and

Whereas, during the course of investigation, in a similar nature case,bearing No. 06/2007 of P/S Batamaloo, it came to surface that PolicePersonnel of SOG, Ganderbal boarded in a white colour Gypsy had liftedthe Nazir Ahmed Deka from Lal Chowk near Biscoe School and afterhatching criminal conspiracy, killed him in a planned fake encounter atYachnar Badergund, Ganderbal, which was dramatized on 16/17-02-2006,jointly by SOG, Ganderbal and 5 RR ; and

Whereas, on 17-02-2006, accused namely Mukhand Raj Guru, Capt./Adjutant 05 RR Army Unit lodged a complaint in Police Station, Ganderbal,stating therein that an unidentified militant has been killed during anencounter. Accordingly, a case FIR No. 17/2006, under section 307 RPCand section 7/25 Arms Act, 1959 was registered in Police Station, Ganderbalregarding the said incident reported by said accused. However, the saidFIR was investigated upon by SIT (Special Investigation Team) and theclaim of accused was found false and a fabricated one. The investigationwas closed as “Not Admitted” on merits ; and

Whereas, during the course of investigation, on the basis of statementsof witnesses, the seizure memos and other evidence, the InvestigatingOfficer established a prima facie case against the accused personsunder sections 302, 364, 201, 120-B of Ranbir Penal Code against theaccused persons ; and

Whereas, the appointing authority of Bahadur Ram Keth (Dy. SP)and Hansraj Parihar (SSP) is the Government in the Home Departmentand the offence has been committed by the accused persons in connivancewith other accused, while acting or purporting to act in discharge of their

During search, one foreign militantidentified as Zubair Ahmad Mughal @ Ameer Maviya S/o Abdul RashidR/o Gulshan Iqbal, Karachi, Pakistan, was apprehended in the said housealong with arms and ammunition and Farooq Ahmad Bhat was alsonabbed for being abettor of the foreigner militant ; and

Whereas, with regard to the aforementioned incident, a caseFIR No. 14/2015 under section 7/25 Arms Act, 14 Foreigners Act andsections 13, 19, 20 of Unlawful Activities (Prevention) Act, 1967 wasregistered in Police Station, Tarzoo and the investigation was initiated ;and

Whereas, during the course of investigation, on the basis of statementsrecorded under section 161 and 164-A of Cr. P. C. and based on thecircumstantial and documentary evidence, the Investigating Officer hasestablished a prima facie case for offences under section 7/25 Arms Act,section 14 Foreigners Act and sections 13 and 20 of Unlawful Activities(Prevention) Act, 1967 against Zubair Ahmad Mughal @ Ameer MaviyaS/o Abdul Rashid Mughal R/o Gulshan Iqbal, Karachi, Pakistan, being aforeigner militant and member of LeT outfit for offences undersections 13 and 19 of Unlawful Activities (Prevention) Act, 1967 againstFarooq Ahmad Bhat S/o Abdul Jabbar Bhat R/o Choora ; and for offencesunder section 13 of Unlawful Activities (Prevention) Act, 1967 againstMohammad Ashraf Mir S/o Ghulam Ahmad Mir R/o Chanpora,Athoora and Mohammad Yousuf Najar S/o Mohammad Munawar NajarR/o Chanpora, Athoora ; and

During search operation, militants opened fire upon security forcesand in the ensuing cross firing, Subidar Kanganwari Verand JCO No.460478P of 19 Maratha Regiment Camp, Chokibal, Police Head Constable,Mohamad Shafi No. 100/H, Police Constable Reyaz Ahmad No. 307/Hof SOG, Handwara were killed, besides two foreign terrorists also gotkilled on the spot. Besides, ASI Reyaz Ahmad No. 286/S, SPO ReyazAhmad No. 523/SPO, Ct. Shehal No. 365/KP, SPO Fayaz AhmadNo. 398/SPO of SOG, Handwara and a civilian Mst. Shamali W/oAb. Gaffar Mir R/o Zonireshi sustained injuries ; and

Whereas, in this connection, case FIR No. 22/2014 undersection 307 Ranbir Penal Code, 7/25 Arms Act, was registered in PoliceStation, Kralpora, and investigation initiated and during investigation offencesunder section 302 RPC and 19 Unlawful Activities (Prevention)Act, 1967 were added ; and

Whereas, during the course of investigation, on the basis ofstatements of witnesses, the seizure memos and other evidence, theInvestigating Officer established a prima facie case against theaccused persons under section 19 of Unlawful Activities (Prevention)Act, 1967 ; and

Whereas, the authority appointed by the State Government undersub-section (2) of section 45 of the Unlawful Activities (Prevention) Act,1967 has independently scrutinized the Case Diary file and all otherrelevant documents relating to the case and has come to a definiteconclusion that this is a fit case for sanctioning prosecution against theaccused person ; and

Whereas, after perusing the Case Diary, the relevant documentsand also taking into consideration the observations/views of the Authorityappointed under sub-section (2) of section 45 of the Unlawful Activities(Prevention) Act, 1967, the State Government is of the view that thereis sufficient material and evidence available against the accused personfor his prosecution under the aforesaid provisions of law.
