MARCH 7, 1984 Richard Heller began extensive landfilling in the late 1950*s on the 16.5 acre site situated in Delaware County between Darby Creek and the Philadelphia County Line. At the time only a few people lived in the r.earby vicinity. By 1970, on average 125 vehicles were received daily, T.cst from the City of Philadelphia. During the -period of operation cne once flat land became a sizeable hill approximately 150 to 200 feet high, filled with mostly household trash, apparently some industrial waste, ana who knows what else. _, In October 1969, the Commonwealth of Pennsylvania filed a complaint against the owners,- the Clearview Land Development Company, Inc., claiming that they unlawfully operated a garbage and refuse n_spcsal site. With that complaint began a series of legal actions. In December 1970, the State filed an application for a Preliminary Injunction claiming Clearview operated a landfill without a permit as required by the Solid Waste Management Act of 1968. It was not until November 1971, that the Court approved an Interim Consent Order which was presented by both the Commonwealth and the Redevelopment Authority. The .„ "Order" stipulated operation procedures and hours, as well as, the ?velopment of a land use study and a closure plan. This order was •3R**/ ^virtually ignored by the owners. ' -'s'.V The Eastwick Project Area Committee (PAC) formed in March 1971, in "^order to represent then 16,000 residents of the Eastwick Urban Renewal Area. 'After the Court Order, the PAC proceeded to monitor the dump and corresponded with the state officials responsible for enforcing the Order. Meanwhile, City of Philadelphia garbage trucks, as well as other vehicles, rolled up 83rd Street, ascended the hill unimpeded, and dumped their trash and waste. The PAC appealed to Federal, State, and City officials requesting that the court order be enforced. Richard Heller began extensive landfilling in the late 1950*son the 16.5 acre site situated in Delaware County between Darby Creekand the Philadelphia County Line. At the time only a few people livedin the r.earby vicinity. By 1970, on average 125 vehicles were receiveddaily, T.cst from the City of Philadelphia. During the -period of operationcne once flat land became a sizeable hill approximately 150 to 200 feethigh, filled with mostly household trash, apparently some industrial waste,ana who knows what else.

substancially changed from waste Jand to useabie land...this operationtransformed into a new unacceptable anachoronism." The order set outa plan similar to the previous Interim Consent Order. A final closureplan was to be submitted by May 1973.

After the Clearvisrw 'Land Development Company, Inc. again failed tocomply, Judge Feed issued a Final Order which stipulated that by Septerser30, 1973, all solid waste disposition shall cease and Clearview mustfellow the prescribed closure plan. The Department of Environmental ResourtlorRJ was instructed periodically t,c inspect the site and report anyviclat-ions. As part of the closure plan, the owners were instructed tograde and cover the entire hill with two feet of compacted earth andthen to fertilize and plant suitable ground cover.

At the same time that the Court was ordering the closure of theLandfill, DER granted ROMA Associates, Inc. a permit to construct andoperate a batch asphalt plant. Despite community protests and an appealsubmitted by State Senator Thomas McCreesh along with the Eastwick PACand the eolwyn Council, DER went ahead and issued the permit. In theend the asphalt plant operated for just three years between 1973 and 1976before closing down.

After the closure of the landfill and then of the asphalt plant, the'community began to regard the site as somewhat innocous. The hill wasn»- -icovered with vegetation and the landfill appeared as simply a large hi!*'The Eastwick PAC remained suspicious of the owner, Richard Heller, howeV^r,nc harmful activity was apparent. Starting in 1973, as part of the Urban Renewal development, newhouses were beginning to be built by Korman Corporation in the area justeast of the dump. Through the 1970's the residential development expandedwest. The Forrest Creek Community with nearly six hundred homes wasbuilt between 1973 and 1977. New houses were constructed and sold alongthe eastern perimeter of Heller's Dump. In 1979 and 1980 the Hedgerow •Community with nearly 300 houses was built along the scuthern border ofthe dump. At the time no one apparently seriously questioned the possibil-ity of dangers connected with the landfill. There are some reported

i .-3blems with methane gas leaking to the surface, but there are noreports of toxic wastes or fumes.

In 1977, Richard Heller asked the City tc provide water andsewer service to his property. The Hastwick PAC appealed to MayorRizEo to prevent the City from supplying these services to Heller.He had plans to build a trailer park on the site. Darby Townshipwrote to the City and indicated that Heller had the necessary zoningpermit and that he needed water and Fewer service from Philadelphia.Heller never received water and sewer service frorr Philadelphia.

In November 1981, the new PAC Director, Chip Bassets, discoveredevidence of recent dumping and was concerned aoout the stockpiling

.,_..- of steel drums. The PAC wrote letters to both the U. S. EnvironmentalProtection Agency (EPA) and DER, first, stating that by Court Orderdumping of any solid waste is prohibited, and second, requesting thatthe site be inspected for violations and tested for leachating andhazardous chemicals.

Shortly, afterwards DER issued a Notice of Violation to ClearviewLand Development Company, and ordered that the piles of debris beicmoved, that all future dumping be stopped, and that a barrier beconstructed to limit access. Also, DeLorenzo was issued a Notice of

M*.V Violation for operating without a permit. The Regional Director forDER wrote to the PAC stating that the steel drums were found to be emptyand DER recently closed a hazardous waste storage and transfer facilitylocated on the bite.

At an on-site conference November 1981 with the DER inspector,Robert Zang, Chip Bassett learned that the Clearview Landfill was notconsidered by DER as a priority site. The DER inspector had been in-specting the site and writing-up violations, however, the administratorsof DER were unwilling to prosecute. In DER's file there is a long listof violations to both the Solid Waste Management Act and to the 1973Court Order involving illeg'al dumping, fires, and other activities. Atthe time of our on-site inspection, Graves Resource Management had justdiscontinued the operation of a toxic waste transfer station because theywere operating without a permit or any notification to DER. inspector discovered ' r, the site barrels leaking chemicals, no safetyequipment, and nc ooi-'-nerts tO'verify the contents, origins or destinat-ions of the hazardous chemicals. Also, DeLorenzo Twin County Disposal Iwas illegally operating a solid waste, transfer station without a permit.Plus, other violations involving dumped debris and fires were cited.However, th^re was no evidence of the dumping of toxic waste.

Heller did nothing to abate the violations. DER issued furthernotices and threatened to take him to court. However, Heller stillillegally dumped on-site, never cleared up the existing debris, a.idonly recently installed a gate at the entrance.

In early Spring 1982, in response to our original request: inNovember 1981, DER conducted tests for leachate and toxic wastes alongthe stream bed of Darby Creek. DER was unable to release the results,-—'instead they submitted the test results to the Environmental ProtectionAgency (EPA). However, in a telephone conversation in October 1983,the DER inspector, Robert Zang, told Chip Bassett that there was evidenceof leachate from the landfill and some traces of toxic chemicals, butnot significant, or dangerous levels.

Unbeknownst to the Eastwick PAC, DER approved a permit in October1982 for DeLorenzo to operate the solid waste transfer station. Withthe aid of the Redevelopment Authority Legal Department, we filed anappeal .on the issuance of the permit. Despite protest letters from theCity, Korman Corporation, Tinicum National Environmental Center, and *,Jthe redevelopment Authority, in th< end DER convinced the Redevelopncr .Authority lawye::s that there was little ground for an appeal. The oneitem that was not sufficiently addressed was the inadequate informationprovided in the permit applicaton under compliance history. The factthat he operated without a permit was not indicated nor was any ofDeLorenzo's activities in New Jersey noted.

Becuase the access road to Heller's Dump crosses the Departmentof Recreation property, the PAC in December 1981, informed the RecreationDepartment that DER had ordered Heller to barricade the entrance. Wealso made it known to DER that much of the illegal damping was takingplace on the City's property. In February 1982, DER responded byissuing a Notice of Violation to the Department of Recreation fordumping. Legally, the property owner is responsible for any illegaldumping on their lanfc.

"- '-The PAC had little hope of closing Heller down, so the Boarddecided to press the City to develop the unimproved portion of theF<?cional Park, and to landscape the site so as to obscure and blockoff Heller's Dump. In June 1982, the Managing Director, Wilson Goode,assured PAC representatives that this site would be developed. Afterseme delay the F.AC followed-up in January 1983 with a letter to theRecreation c omiTiissioner urging him to select the architect for this site .

For years sufficient funds had been allocated for the Regional Parkwithin the" Capitaj. Budget as part cf ~^ a City's commitment to successful""'complete the^astwick Urban Renewal P.i.c.n. However, in FY' 84 under MayorGreen's austerity budget, funds were substantially cut, though thereare still sufficient funds to hire an architect.

Finally, by June 1983, an architect, Howard r'ransnoff, was hired.PAC representatives inspected the site with hiit- and with officials fromtne Re-creation Department, after which the PAC set down the followingpriorities:

1. relocate the access road closer to Darby Creek;2. fence off the recreation site from Heller's Dump and

the access road;3. conduct test borings to insure that1.there are no

toxic wastes on the site;4. clean and fill the site where dumping has occurred;5. construct a walkway linking the existing Regional

Park Walkway with 34th Street; and6. plant trees and grass, possibly leaving some area with

-he natural habitut.y^l / In August 1983, Kevin Nesko of Darby Township obtained from EPAa copy of the results from the test conducted by DER in the spring of 1982Contrary to what the DER inspector tcld Chip Bassett, the documentsappear to show evidence of serious pollution. Two substances identifedin the test include: acetone, possible solvents, possible pesticides,low levels cynide, low levels phenols, possible PCB, and various heavymetals. The fact that the concentration found of these substances werelow does not preclude the fact that tnese toxics are on the site and thawthere may likely be dangerous concentrations of these hazardous substanceselswehere on the site. Also, it must be noted that these tests wereconducted after a heavy rain. This may have diluted normal concentrations

Armed with the results of DER's ^?st, Kevin Nesko presented thisinformation to a reporter for the :>e -a-.are County Daily Times whichmade this a front page expose1 on £ep-;-;~ber 1, 1983.

Largely because of the public release of these results, EPA inOctober 1983 conducted more extensive tests in the same general area.Heller initially prohibited the EPA investigators from entering thedump site. After negotiations between lawyers, EPA apprently agreedto test only along the same stream bee already tested by DER. EPAhas indicated that the results of this last rest will be releas edby mid-April 1984. Unfortunately, regardless of the results, the tesisstill will nor measure possible toxic pollution on the opposite sideof the landfill in Eastwick.

Because there may be a potential health hazard connected with HellDump, the Eastwick PAC has written to the City Department of Recrea'icr.and Department of Public Health requesting that comprehensive soil,ground water and air monitoring tests be conducted around the perimeterof the site, and that signs be posted around the dump. The HedgerowResidents' Association has written similiar letters. Also, Hedgerow aswell as Forrest Creek Community Association have distributed flyerswarning their residents of the possible danger and have circulatedpetitions that request EPA, DER, and the City toconduct the necessary

~.>^>""Enviornir.ental Action Now (CLEAN). The principle purpose behind CLEANis tc safeguard public health and protect the environment from thehazard of -oxic waste. As one of its first tasks, CLEAN has beeninvestigating the past and present activities connected with Heller'sDump.

Finally, it must be noted that contamination by toxics can onlyoccur either by direct contact with the subtance or through the air.If all the sources of contamination are covered, then it is unlikely thatthe air is polluted. However, smoke from fires on the dump or fumesfrorr open barrells and pits will likely create a hazardous condition.The ground water may be polluted with hazardous chemicals. The onlylikely sources one will come into direct contact with contaminated groundwater are a leachate pond where ground water collects, a leachate stream
