TERMS AND CONDITIONS Section 1 – The Cover Provided This Policy relies on information given on the Proposal Form completed by the Policyholder and/or Assured and from any examining medical practitioner. If any of the information provided to IOMA Life is not true or incomplete that might reasonably have affected Our decision to provide this Policy, We may: change the Terms and Conditions of this Policy; or amend the premiums payable under this Policy; or cancel this Policy and refund the premiums paid without interest. If IOMA Life cancel this Policy it will end and all benefits under it will cease. This Policy does not acquire a surrender value. The Bucket List Plan Cover is only payable on the occurrence of an Assured Event and then in accordance with the terms of this Policy and there is no benefit payable at expiry of this Policy. You may select a Policy Term when first completing the Proposal Form. When you apply for cover you are offered Policy Term options. The term that you select defines the period that your Policy will be in force: 5 years, 7 years, 10 years, 15 years and 20 years. Note that because the maximum age allowed under the Policy is 70, you are offered fewer term choices as you get older. You shall become entitled to the Bucket List Plan Cover benefits on production of proof satisfactory to Us, and in particular to IOMA Life’s chief medical officer, of: an Assured Event: and the title of the person or persons claiming payment; and the age of the Assured (where such age has not been admitted),

subject always to these Terms and Conditions and any amendments requested by the Policyholder and agreed in writing by IOMA Life. Once You become entitled to the Bucket List Plan Cover IOMA Life will hold any amount due under it on behalf of the Assured, the Assured’s nominated beneficiaries, if any, the Assured’s Personal Representatives or the Assured’s Representative to administer the Bucket List Plan Cover as appropriate, in accordance with the terms of this Policy and in particular as detailed further at section 8 below. No benefit under this Assurance shall be subject to interest charges. Section 2 – Definitions In this Policy the following expressions shall have the meanings given to them in this Section 2. Assured The Assured identified in the Policy Schedule who receives the benefit of this Policy in the event of an Assured Event occurring. Assured Event Any one of the following events occurring during the Period of this Assurance: a. the diagnosis by medical specialists of a

condition that forecasts the death of the Assured within the following 12 months;

b. the suffering of a serious illness or injury by the Assured defined as a Total Permanent Disability;

c. The death of the Assured. Bucket List Plan Cover The bucket list benefits that the Insurer funds in accordance with the terms of this Policy in case an Assured Event takes place. Concierge The company appointed by Resurety Ltd to facilitate Your Bucket List Plan Cover.

Policy This Policy of assurance providing the benefits as detailed in the Policy Schedule. Policyholder/You/Your The person named as the Assured in the Policy Schedule or any other person who becomes the legal owner of the Policy. Policy Schedule The outline of cover provided under the Policy and showing details of the Policyholder and Assured and the extent and relevant limitations of the cover to be read in conjunction with this policy document. Representative The broker or intermediary named on Your current Policy Schedule accompanying this document. Resurety Ltd The Bucket List Plan management and administration company. Total Permanent Disability Total permanent disability – of specified severity We apply two definitions. The definition that We will apply to you is dependent upon Your age and Your occupation: 1. The following definition applies if you are

in full time employment of more than 16 hours per week. Total permanent disability - unable before age 65 to do a suited occupation again. Loss of the physical or mental ability through an illness or injury before age 65 to the extent that the Assured is unable to do the material and substantial duties of a suited occupation ever again. The material and substantial duties are those that are normally required for, and/or form a significant and integral part of, the performance of a suited occupation that cannot reasonably be omitted or modified.

A suited occupation means any work the Assured could do for profit or pay taking into account their employment history, knowledge, transferable skills, training, education and experience, and is irrespective of location and availability. The relevant specialists must reasonably expect that the disability will last throughout life with no prospect of improvement, irrespective of when the cover ends or the Assured expects to retire. For the above definition, disabilities for which the relevant specialists cannot give a clear prognosis are not covered.

2. The following definition applies if you are in part time employment of less than 16 hours per week or you are homeworker or retired or are not employed. Total permanent disability – unable before age 70 to do specified work tasks ever again. Loss of the physical ability through an illness or injury before age 70 to do at least 3 of the 6 work tasks listed below ever again. The relevant specialists must reasonably expect that the disability will last throughout life with no prospect of improvement, irrespective of when the cover ends or the Assured expects to retire. The Assured must need the help or supervision of another person and be unable to perform the task on their own, even with the use of special equipment routinely available to help and having taken any appropriate prescribed medication. The work tasks are: • Walking – the ability to walk more

than 200 metres on a level surface. • Climbing – the ability to climb up a

flight of 12 stairs and down again, using the handrail if needed.

• Lifting – the ability to pick up an object weighing 2kg at table height and hold for 60 seconds before replacing the object on the table.

• Bending – the ability to bend or kneel to touch the floor and straighten up again.

• Getting in and out of a car – the ability to get into a standard saloon car, and out again.

• Writing – the manual dexterity to write legibly using a pen or pencil, or type using a desktop personal computer keyboard.

For the above definition, disabilities for which the relevant specialists cannot give a clear prognosis are not covered.

Terrorism An act of Terrorism means an act, including the use of force or violence, of any person or group(s) of persons, whether acting alone or on behalf of or in connection with any organisation(s), committed for political, religious or ideological purposes including the intention to influence any government and/or to put the public in fear for such purposes. Us/Our/We/The Underwriter/Insurer IOMA Life which is a trading name of Isle of Man Assurance Limited (Registered Number 003792C). Section 3 – Premiums Premiums for Your Policy must be paid within 30 days of the commencement date of this Policy and within 30 days of each due date thereafter. If a claim arises during this period, the unpaid premium will be deducted from any Bucket List Plan Cover payable. Notwithstanding Section 1 above, the premiums payable are guaranteed not to change during the period of this Policy. If Your premium has not been paid by the end of these 30 days, this Policy will be cancelled and all benefits under it will cease. In the event of cancellation, premium will remain due to IOMA Life on a pro rata basis for the period that IOMA Life has placed the Policy on risk but the full Policy premium shall be payable to IOMA Life in the event of a loss or occurrence prior to the date of termination

which gives rise to a valid claim under this Policy. It is agreed that IOMA Life shall give not less than 30 days prior notice of cancellation (the Notice Period) to the Policyholder. If the premium due is paid in full to IOMA Life before the notice period expires, notice of cancellation shall automatically be revoked. If not, the Policy shall automatically terminate at the end of the Notice Period. Section 4 – Sanctions Exclusions We shall not provide any benefit under this contract of Assurance to the extent of providing cover, payment of any claim or the provision of any benefit where doing so would breach any sanction, prohibition or restriction imposed by law or regulation. Section 5 – Renewing this Policy This Policy will expire at the end of Your selected Policy Term as detailed on Your Policy Schedule.

At the end of the Policy Term, you may be offered the chance to renew the Policy. If you decide to accept the offer to renew the Policy you will be required to complete a new Proposal Form. If Your circumstances have changed then the Insurer may decide to change the premium rate and/or the Terms and Conditions as detailed in this policy document or to decline further cover.

Section 6 – Cancelling this Policy The Policyholder has a statutory right to cancel this Policy within 30 days from the commencement date of the Policy or the date the documents are received, whichever is the later, by completing and returning the Cancellation Form included with these documents. Providing the Cancellation Form is posted on or before the 30th day after the commencement date of this Policy, IOMA Life will repay any money you have paid to Us or Your Representative free of any charges and within 30 days of receipt of the Cancellation Form. The Policyholder may cancel this Policy at any time after the 30th day after the

commencement date of this Policy by writing to Your Representative, (the contact details are shown on the Policy Schedule) or IOMA Life (whose contact details are shown in Section 9 of this Policy Document). In the event that premium is paid monthly Your Policy will be cancelled immediately. In the event that an annual premium has been paid You will be entitled to a refund of premium paid, subject to a deduction for the time in which You have been covered. This will be calculated on a proportional basis and providing You have not made a claim. IOMA life may cancel this Policy by giving You thirty (30) days notice in writing, which will be sent by post to the last address We hold for You. IOMA Life will only do this for a valid reason such as non-payment of premium. IOMA Life may also cancel Your Policy if you commit a fraud (see further section entitled “When We may cancel Your Policy”). Section 7 – Exclusions Active War Risk If an Assured Event is as a consequence of the Assured’s active involvement in war, hostilities or war-like operation (whether war is declared or not), civil war, mutiny, civil commotions assuming the proportions or amounting to a popular uprising, military rising, insurrection, rebellion, riot, military or usurped power or any action of any person acting on behalf of or in connection with any organisation actively directed towards the overthrow of any government or ruling body by force, Terrorism or violence then no amount will be payable under this Policy in respect of the claim. Excluded Occupations We do not cover those engaged in any of the following or similar activities or occupations: • Working with explosives • Diving • Oil and gas industry work • Tunnelling, mining, quarrying • Fishing (working on a trawler) • Working outside at heights • Combat armed forces occupations –

Those posted abroad or on a tour of duty

or expected to do so (within 12 months) to an active theatre of operations or humanitarian aid operations. Also high risk occupations such as bomb disposal, air crew and special services such as SAS/SBS.

Excluded Pursuits for Total Permanent Disability Benefit We will not pay benefits if the Total Permanent Disability was caused by any of the following or similar hazardous pursuits or activities (one off events can be ignored such as holiday or charity): • Motor sport - car, motorcycle and

powerboat racing • Aviation - private flying • Transocean sailing or offshore racing • Hang gliding, parachuting, skydiving or

BASE jumping • Mountaineering & rock climbing • Caving and pot-holing • Scuba diving • Any extreme sport i.e. bungee jumping

(other than one off bungee jumping), white water rafting, cliff or free diving, etc

• Equestrian Sport (other than private hacking)

• Winter sports other than holiday skiing or snowboarding for pleasure

• Full contact martial arts, combat sport or boxing.

Criminal Acts If an Assured Event arises from the direct or indirect consequence of any act of the Assured which is deliberate and in material violation of the law of any jurisdiction, then no amount will be payable under this Policy in respect of the claim. Section 8 – Making a Claim If You need to make a claim, Your Representative should be contacted (the contact details are shown in the Policy Schedule) or alternatively IOMA Life should be contacted and You will be sent a Claim Form for completion.

In order for the claim to be assessed, You must submit the completed Claims Form together with proof of the Assured Event. This proof will be reviewed by IOMA Life’s chief medical officer who will decide, in their sole discretion, if this constitutes sufficient proof of an Assured Event. In addition, IOMA Life may need some, or, all of the following evidence depending on the nature and circumstances of the claim: • Proof of the Assured’s age • Proof of ownership of the Policy • Medical reports and records • Coroners and/or police reports • Such other information as IOMA Life may

reasonably require to assess the claim • Certified ID and address verification If it should be found that the age of the Assured was understated when this Policy commenced, then the Bucket List Plan Cover shall be reduced to such a sum as would have been assured had the age been correctly stated. If You, or anyone acting on Your behalf, make a claim knowing it to be false or fraudulent in amount or in any other respect, this Assurance will be invalid. This means We will not pay the fraudulent or false claim, or any subsequent claim and may keep any premium paid. IOMA Life will not pay a claim if by doing so they will be in breach of any sanction, prohibition or restriction imposed by law or regulation. After We have paid a claim Your Policy is cancelled and IOMA Life will not make any further payment. Time Limits for Claims All claims should be submitted within 6 months of the claimable event. Failure to notify Us within this time may result in Us declining to pay the claim. Payment of Claims The level of cover provided will be as set out in Your Policy Schedule.

Upon the occurrence of an Assured Event You may elect to either:

a) Receive the bucket list benefits and lump sum listed in Your Policy Schedule ; or

b) If for any reason You cannot or do not wish to avail Yourself of Your bucket list benefits, then You may elect to receive a higher lump sum cash payment instead.

In the event of the Assured’s death prior to any claim on the Policy the Bucket List Plan Cover will be paid as a lump sum to the appropriate recipient as detailed in this Policy.

Any lump sum payment will be payable to You (or Your beneficiary if appropriate) directly. Payment will be made upon receipt of the required proofs of claim at IOMA Life’s Registered Office in accordance with the Policy. If You elect to receive the bucket list benefits Resurety Ltd or its agent will contact the appointed Concierge to facilitate Your benefits and will request the funds from IOMA Life as and when requested by You in accordance with the terms of this Policy. IOMA Life will pay for the bucket list benefits as and when requested by You in accordance with the terms of this Policy. Where the Concierge books the benefits on Your behalf, IOMA Life and Your Representative shall not be liable to You for anything beyond the accurate booking of the bucket list benefits in line with Your requests and in particular has no liability for anything that occurs or fails to occur on the bucket list benefits themselves through the act or omission of a third party or otherwise. The Concierge will consult with You to organise Your bucket list benefits. They will book and pay for flights and other travel arrangements, hotel accommodation, activities, excursions and any other items according to Your wishes (subject to the plan limits). They are also available to You for any

issues or emergencies that may occur during Your bucket list trips or activities. Section 9 - How to contact us or your representative If You have any questions or concerns about this Policy or wish to make a claim, You, or Your personal representative should contact either Your Representative (whose details are shown on the Policy Schedule) or IOMA Life. Effective Date and Policy Term This Policy takes effect on the Effective Date stated in the Policy Schedule, at 12.01 A.M., local standard time at the Policyholder’s address, and shall continue in effect as long as the premium is paid as herein agreed, unless and until either the Policyholder or IOMA Life terminates the Policy in accordance with the section entitled “Policy Termination by the Policyholder or the Insurer”. The Policy can be renewed up to the maximum age of 70. Nomination of Beneficiaries You may nominate in writing up to 4 beneficiaries under the Policy and the proportions in which they will receive any payments made by Us. A beneficiary nominated by You will lose their entitlement to any payment from Us if:

a) We receive written notice of assignment of the Policy; or

b) You send written notice to Us that a beneficiary’s nomination is revoked; or

c) the beneficiary dies before You do; or d) the Policy is cancelled or terminated; or e) We are unable to find a beneficiary after

making reasonable efforts to locate them.

If You do not name any beneficiaries, benefits will be payable to Your personal representatives on death. Contracts (Rights of Third Parties) Act 2001 Notwithstanding any other provision in this Agreement, nothing in this Agreement is intended to confer on any person other than the Policyholder and IOMA Life any right to enforce any of the provisions of this Agreement which such person would not have had, but for the Contracts (Rights of Third Parties) Act 2001. Mis-statement of Information If when You took out the Policy We were told incorrect information about the Assured or important information was not given to IOMA Life, We may; • ask You to alter the amount of the

premiums that You pay to Us; and/or • We may reduce the amount which We

pay for a claim below the level set out in the Policy Schedule;, and/or

• We may cancel Your Policy. Force Majeure No liability on the part of IOMA Life shall arise if IOMA Life is prevented from fulfilling its obligations under the Policy by reason of any supervening event beyond its reasonable control (including, without limit, any act of god, war, national emergency, terrorism, fire, flood, strike or industrial action). Entire Contract; Changes These Policy Terms and Conditions, the application of the Policyholder and the Policy

Schedule constitute the entire contract between the parties. No change in this Policy shall be valid unless approved by an executive officer of IOMA Life in accordance with these Terms and Conditions and unless such approval be endorsed hereon or attached hereto. No agent has authority to change this Policy or to waive any of its provisions. Assignment Subject to any statutory restrictions, an Assured may designate a beneficiary to receive death benefits payable under this Policy or change any beneficiary already appointed by filing a written notice of assignment at the Registered Office of IOMA Life or to any authorised agent of IOMA Life in a form to be agreed by IOMA Life (Notice). The Notice shall contain full details of the beneficiary(ies) sufficient for IOMA Life to properly identify the beneficiary(ies). No designation or change of beneficiary under the Policy shall be binding upon IOMA Life until IOMA Life has been provided with such Notice, accompanied by an original or a duplicate of the assignment. The Policy may not be charged or used as security for a loan by the Assured without the prior written consent of IOMA Life, which it may in its absolute discretion withhold. The Policy may only be charged or assigned or novated in whole and not in part. IOMA Life assumes no responsibility for the validity or legality of such assignment or novation. We will not change who is entitled to benefits under Your Policy until We receive this notice. Currency All payments We make to You and all payments made to Us must be in the Policy currency as stated in the Policy Schedule. Invalidity If any provision of these Terms and Conditions is found by any court or administrative body of competent jurisdiction to be invalid or

unenforceable, such invalidity or unenforceability will not affect the other provisions of these Terms and Conditions which will remain in full force and effect. Legal Discharge Payment of benefits by IOMA Life to any person entitled to receive benefits under this Policy shall be treated as being made in legal discharge of all obligations owed by IOMA Life to the Policyholder in respect of such Assured or beneficiary under this Policy. Legal Actions No action at law or in equity shall be brought to recover on this Policy prior to the expiration of sixty (60) days after written proof of loss has been furnished in accordance with the requirements of this Policy. No such action shall be brought after the expiration of three (3) years (or the minimum time, if more than three (3) years), permitted by law in the jurisdiction where the Assured resides after the time written proof of loss is required to be furnished. Adverse Consequences You should note that IOMA Life reserves the right to satisfy itself as to the residency status of the Assured at the time of death and when making a claim the claimant will be asked to confirm the residency status of the Assured at the time of death event leading to the claim. IOMA Life reserves the right to refuse to settle a claim where to do so, would in its reasonable opinion, result or be likely to result in either IOMA Life or the recipient of benefits under this Policy suffering material adverse financial, regulatory or tax consequences. Governing Law The Policy shall be governed by and construed in accordance with Isle of Man law and the Isle of Man courts will have exclusive jurisdiction in relation to all disputes concerning the Policy.

Section 11 - Administration of Your Policy(ies) IOMA Life may employ agents to perform any administrative, management or other ancillary services required to enable IOMA Life to perform its obligations under the Policy. Requests and instructions will only be valid if made or given in writing to IOMA Life at its Registered Office. Any notice given, or other communication, by IOMA Life in connection with the Policy Terms and Conditions will be given, or made, in writing and sent by post to the nominated correspondence address of the Assured as last notified in writing to IOMA Life. Section 12 - When We can make changes to Your Policy IOMA Life, acting on professional actuarial advice, may make such alterations by way of an Endorsement to the Policy Terms and Conditions as it considers appropriate if:- A. It ceases to be reasonably practicable for

IOMA Life to comply with the Policy Terms and Conditions as a result of:-

i. any change (introduced, enacted or proposed) in any legal, regulatory or other official requirements applicable to IOMA Life, the Policy or the Assured; or

ii. a change in the interpretation or application of any such legal, regulatory or other official requirements; or

iii. compliance with any request from any government, statutory or regulatory agency or authority; or

B. there is any change to the basis of

taxation which applies to IOMA Life or to the Policy. IOMA Life can make reasonable and appropriate changes to the Policy Terms and Conditions (or issue a replacement set of Policy Terms and Conditions) at any time while the Policy is in force. IOMA Life will give the Assured no less than thirty (30) days' notice by

post of a change to these Policy Terms and Conditions and the notice of change may be included in any documentation IOMA Life issues to the Assured.

Changes to the Policy Terms and Conditions that are outside of Our control or not to the Assured’s detriment will take place immediately. All other changes will take effect thirty (30) days from the date of the notification of a change or such later date as may be specified. Section 13 - Policy Termination by the Policyholder or Insurer When you may cancel Your Policy Details of when You may cancel Your Policy are contained at Section 6 of these Terms and Conditions. When We may cancel Your Policy

Fraud

IOMA Life may cancel Your Policy if You commit a fraud which includes doing any of the following: • Make any untrue statements to Us. • Fail to disclose any material facts relevant

to Your Policy or a claim. • Act fraudulently in any other way. If We cancel Your plan because of fraud, Your Policy will become void. If this happens, We will return all the Policy premiums You have paid.

Termination of Policy

Your Policy will terminate on the premium due date following: • the Assured’s attainment of age seventy

(70); or • the end of the period for which

contribution (i.e. premium) has been made.

• We have the right not to offer renewal for this product.

You can contact either your representative (whose details are in the Policy Schedule) or Us by letter, phone or email using the contact details set out above. How we will deal with your complaint

The time it takes to resolve Your complaint will depend on how complex it is and how much investigation We have to do. We will always try to resolve Your complaint as quickly as possible, keeping You informed of Our progress. For further information, or if You wish to complain about any aspect of service You have received, please contact IOMA Life. If Your complaint is not dealt with to Your satisfaction You can also complain to the Financial Services Ombudsman Service for the Isle of Man. Copies of Our internal complaints procedure is available on request. Holders of policies issued by IOMA Life will not have the right to complain to the UK Financial Ombudsman Service. Section 16 - Compensation The Isle of Man Life Assurance (Compensation of Policyholders) Regulations 1991 protects investors by providing a statutory guarantee up to 90% of the amount of any liability of the insurance company under any life Policy for eligible claimants and would be payable in the unlikely event that IOMA Life became unable to meet its liabilities.

APPENDIX Benefit Table The Bucket List Cover has the following benefits:

NOTE: Lump Sum and Bucket List Items benefits and associated benefits may vary depending upon use of the Take a Companion benefit, Special Needs Allowance, Travel Insurance Fund and Reserve Fund .

At Claim

Upon the occurrence of an Assured Event You may elect to either:

a) Receive the bucket list experiences listed and the lump sum listed in the table above, or;

b) If for any reason You cannot or do not wish to avail Yourself of Your bucket list and associated benefits, then You may instead opt to take the entire total Policy limit as a lump sum cash benefit.

In the event of the Assured’s death prior to any claim on the Policy the Life Insurance Cover will be paid by the Insurer.

If You elect to receive the bucket benefits Resurety Ltd or its agent will contact the appointed Concierge to facilitate Your benefits and will request the funds from IOMA Life as and when requested by You in accordance with the terms of this Policy. The Concierge will consult with You to organise Your bucket list experiences. They will book and pay for flights and other travel arrangements, hotel accommodation, activities, excursions and any other items according to Your wishes (subject to the plan limits). They are also available to You for any issues or emergencies that may occur during Your bucket list trips or activities.

The Bucket List Plan is underwritten by IOMA Life which is the trading name of Isle of Man Assurance Limited which is regulated and authorised by the Isle of Man Financial Services Authority.
