TheInternationalLawStudentsAssociation,Seekingtoeducatestudentsandlawyersaroundtheworldabouttheprinciplesand

significanceofinternationallaw,Encouragingthedevelopmentofprofessionalskillsinwrittenandoraladvocacy,Promotingthesocialresponsibilityoflawstudentsandlawyers,Strivingtofosterinternationalunderstandingandcooperation,Being committed to achieving these goals in an environment of mutual respect

amongalloftheindividualsandteamsinvolved;Celebratingthediversityofthenationsandculturesbroughttogetherintheglobal

DEFINITIONS

ThefollowingtermsasusedintheseRuleshavethecorrespondingmeanings.

“Administrator” means, with respect to any Qualifying or International competition, the person

appointedtoadministerthatcompetition.

“AdvancedRounds”means,withrespecttoanyQualifyingorInternationalCompetition,allofthe

applicableChampionshipRounds, SemifinalRounds,QuarterfinalRounds,OctofinalRounds, andRun-Off

Roundsconductedatthatcompetition.

“Applicant”meansthesideoftheTeamarguingonbehalfoftheApplicantstateatanygivenpoint

intheCompetition.

“BenchMemorandum”meansthememorandumoflawandauthoritiesconcerningtheCompetition

ProblempreparedbytheILSAExecutiveOfficefortheexclusiveuseofCompetitionjudges,asdescribedin

Rules2.14and5.7.

“Competition”meansthe2019PhilipC.JessupInternationalLawMootCourtCompetition.

“Competition Problem” means the official Problem of the Competition (or Compromis) as

supplemented,clarified,orcorrectedbytheILSAExecutiveOffice.

“CompetitionYear”meanstheperiodstartingonthedateofthereleaseoftheCompetitionProblem

andendingattheconclusionoftheInternationalRounds.

“ExecutiveDirector”meanstheExecutiveDirectoroftheInternationalLawStudentsAssociation.

“ExhibitionTeam”meansaTeamthatisinvitedtoparticipateintheInternationalRounds,butthat

isnoteligibletowintheJessupCuportheotherawardsassociatedwiththeInternationalRounds.

“ExecutiveOffice”meanstheExecutiveOfficeoftheInternationalLawStudentsAssociation.

“FriendlyCompetition”meansacompetitionamongTeamsfrommultiplenationsorageographic

region(s), approved by the Executive Director in accordance withRule2.18, which does not, unless

otherwisespecified,determinetheTeam(s)thatwilladvancetotheInternationalRounds.

“International Rounds” means the White & Case International Rounds, the final stage of the

Competition,heldeachyearinWashingtonD.C.

“Memorial”means thewrittenpleadingsof eachTeam,writtenand submittedpursuant to these

Rules.

“NationalRound”meansany competitionadministeredwith the approval of theExecutiveOffice

throughwhichacountrydeterminestheTeam(s)thatwilladvancetotheInternationalRounds.

“NationalRulesSupplement”meansasetofrulespromulgatedbyanAdministratortosupplement

ormodifytheOfficialRulesforpurposesofaQualifyingcompetitioninaparticularcountry.

“OfficialTeamContact”meanstheindividualidentifiedbytheTeamduringtheregistrationprocess

forreceiptofofficialteamcorrespondence.

“OfficialSchedule”meanstheofficialtimetableoftheCompetition,settingforthallrelevantevents

anddeadlinesassociatedwiththeCompetition.

“Oral Round”means a singlematch of oral presentation between two Teams, one representing

ApplicantandonerepresentingRespondent,asdescribedinRule7.0.

“Penalty”meanstheconsequenceofaruleviolation,pursuanttoRule11.0.

“Problem Clarifications and Corrections” means the official clarifications and corrections to the

Problem,aspublishedpursuanttoRule2.16.

“QualifyingRound”meansanycompetitionadministeredwith theapprovalofthe ILSAExecutive

Office through which a nation or geographic region determines the Team(s) that will advance to the

InternationalRounds.

“RegionalRound”meansanycompetitionadministeredwith theapprovalof theExecutiveOffice

throughwhichageographicregiondeterminestheTeam(s)thatwilladvancetotheInternationalRounds.

“Respondent”meansthesideoftheTeamarguingonbehalfoftheRespondentstateatanygiven

pointintheCompetition.

“Representative”, “NationalRepresentative,”or “RegionalRepresentative”meansaTeamselected

torepresent itsnationorregionat the InternationalRounds,whetherbyQualifyingRoundsorbyother

means.

“Rules” means these Official Rules of the Competition and any applicable National Rules

Supplement.

“Team” means a team of eligible students recognized by the Executive Office that registers to

competeintheCompetition,pursuanttoRule2.0.

“Team Advisor” means an individual, such as a coach or advisor, who at any time during the

CompetitionYearhasresponsibilityfororganizing,advising,ortrainingaTeam,whetherornotamember

ofthefacultyoftheinstitutionrepresentedbytheTeam.

“Team Homepage” means the personalized homepage available to each Team at

http://www.ilsa.org.ToaccesstheTeamHomepage,TeamMembersmustgotowww.ilsa.org.

“TeamNumber”means the official 3-digit number assigned by the Executive Office to each fully

registeredandpaidTeaminaccordancewithRule3.5.

“TeamMember”meansanyeligiblestudentwhoisregisteredasacompetitoronbehalfofaTeam.

OFFICIALRULE1.0:ORGANIZATIONOFTHECOMPETITION

1.1 Administration

The Competition is presented annually by the International Law Students Association (ILSA), and is

administeredbytheExecutiveDirectorofILSA.TheILSAExecutiveOfficeislocatedat70113thStreetNW

(12th Floor), Washington, DC 20005, U.S.A., tel: +1 (202) 729-2470, fax: +1 (202) 639-9355, email:

[email protected]. All materials developed by ILSA for the Competition, including, without limitation, the

Official Rules and the Competition Problem, are the sole property of ILSA. Thesematerialsmay not be

reproducedforanypurposeotherthanparticipationinoradministrationoftheCompetitionwithoutthe

express andpriorwritten consentof theExecutiveDirector. In addition, allMemorials become the sole

propertyofILSA,andmaynotberepublishedwithoutitsexpressconsent.

1.2 StructureoftheCompetition

(a) TheCompetition consists of two levels: (1)QualifyingRounds, and(2) the InternationalRounds.

Qualifying Rounds are held in each nation or region where more than one Team participates in the

Competition.The InternationalRounds, designated as theWhite&Case InternationalRounds, represent

the final level of the Competition, and includes Preliminary Rounds, Advanced Rounds, and the World

ChampionshipJessupCupRound.EachleveloftheCompetitionconsistsofwrittenpleadings(Memorials)

andoralpleadings(OralRounds).

(b) TheExecutiveDirectorwilldeterminetheexactnumberofTeamsparticipatingintheInternational

Roundsandthemannerinwhichtheyarechosen,providedthateachparticipatingnationispermittedto

enteratleastoneTeamintheInternationalRoundsoftheCompetitionforeverytenTeamsparticipatingin

thatnation’sQualifyingRound(s).InnationswhereonlyoneTeamparticipates,thatTeamistheNational

RepresentativetotheInternationalRounds.

1.3 EstablishmentofQualifyingRounds

IfmorethanoneTeamregistersfromaparticularnationorjurisdiction,theExecutiveDirectorwillinform

allsuchTeamsthataQualifyingRoundwillbenecessarytodeterminewhichTeam(s)willadvancetothe

International Rounds. The National Representative(s) to the International Rounds will be designated

subjecttoRule1.2(b).

1.4 Administrators

(a) The ExecutiveDirectorwill appoint anAdministrator for eachQualifyingRoundandwill inform

Teams of the name and contact information of the Administrator of their Qualifying Round as soon as

practicable. The Administrator will designate the date and location for the Qualifying Round and will

conduct the Qualifying Round in a manner consistent with these Rules and in consultation with the

ExecutiveDirector.AdministratorswillconsulttheOfficialJessupScheduleandchooseadatethatallows

advancingteamsadequateopportunitytoorganizetraveltotheInternationalRounds.

(b) AnAdministratormaynotserveasaTeamAdvisororinanyotherwayassistaTeamregisteredin

hisorherQualifyingRound.AnAdministratormaynotactasajudgeinhisorherQualifyingRound,unless

necessarytosatisfyOfficialRule7.2,providedthatTeamstobejudgedbytheAdministratorprovidetheir

consent.

1.5 RulesSupplements

(a) The Executive Office encourages all Administrators to formulate a Rules Supplement for their

QualifyingRounds.

(b) RulesSupplementsmustbesubmittedtoandapprovedbytheExecutiveOfficebeforetheymaybe

adopted and enforced by an Administrator. An Administrator shall submit a Rules Supplement to the

Executive Office for approval as soon as practicable but no later than two weeks prior to the

commencementoftheQualifyingcompetition.IftheRulesSupplementmodifiesthememorialsubmission

procedure, itmustbesubmittedforapprovalno later than twoweekspriorto thememorialsubmission

deadlineindicatedintheOfficialSchedule.

(c) UponapprovalofaRulesSupplement,theExecutiveOfficeshallpostitontheJessupwebsite,and

theAdministratorshallimmediatelynotifyeveryaffectedteamthataRulesSupplementhasbeenapproved

andadopted.

1.6 PowertoPromulgateAdditionalMeasures

TheExecutiveDirectormaypromulgateanyothermeasuresfortheorderlyconductoftheCompetitionor

to correct deficiencies in the Competition. After the Executive Office has approved a Rules Supplement

pursuant to Official Rule 1.5, Administratorsmay, in consultation with and upon prior approval of the

ExecutiveDirector,promulgateadditionalrules,modifications,orothermeasuresfortheorderlyconduct

oftheQualifyingcompetition.Anysuchproposedadditionalrules,modifications,orothermeasuresshall

notviolatethespiritoftheseRulesorthebestinterestsoftheCompetition.Anyproposedadditionalrules,

modifications or other measures shall be submitted to the Executive Office as soon as practicable for

approval in accordance with Official Rule 1.5, and once approved, codified by the Administrator in the

RulesSupplementandpostedtotheJessupwebsite.

1.7 InterpretationofRules

TheExecutiveDirectorshallserveasfinalarbiterofimplementationandinterpretationoftheseRulesand

ofallRulesSupplements.

OFFICIALRULE2.0:PARTICIPATIONANDELIGIBILITY

2.1 Institutional/TeamEligibility

(a) All educational institutionsofferingadegree in lawor in a field related to international laware

eligible to participate in the Competition. All determinations of eligibility are in the discretion of the

Executive Director. In exceptional cases, the Executive Director, in consultation with the relevant

Administrator, may grant eligibility to institutions with degree programs in international relations,

providedthatadequateinstructionininternationallawwillbeavailabletoallmembersoftheTeam.

(b) EachinstitutionmayenteroneTeam,regardlessofthenumberofcolleges,departments,faculties,

or schoolswithin that institution, and theTeammay include students fromoneormoreof its colleges,

departments,faculties,orschools(forexample,byallowingastudentinaninternationalrelationsprogram

to compete on the Teamwith students from its law faculty). However, a duly authorized officer of an

institutionmaypetitiontheExecutiveDirector,inwritingandpriortothestartoftheCompetitionYear,to

allowtheparticipationofmorethanoneTeamfromthatinstitution.AdditionalTeamsmaybeallowedifit

isestablishedthateachsuchTeamfulfillstheparticipationandregistrationrequirementsoftheseRules,

andoneofthefollowingconditionsismet:(i)anintramuralcompetitionorotherTeamselectionprocess

would be difficult or impossible to hold due to the institution’s regulations, calendar, geographic

location(s),orothercircumstancesbeyondthecontroloftheinstitutionorparticipatingTeams;or(ii)the

Teamsrepresentdifferentcolleges,faculties,branches,departments,orcampusesofthesameinstitution

andwillbeparticipatingindependentlyofeachother.

(c) An institutionlocated inone jurisdiction(the“home jurisdiction”)thathasapermanentphysical

campusinanotherjurisdiction(the“foreignjurisdiction”),andthatwishestoregisteraTeamintheforeign

jurisdiction,mustpetitiontheExecutiveDirectorinwriting.TheExecutiveDirectormayconsultwiththe

Administrator in thehomeand foreign jurisdictions, requestadditional information fromthepetitioning

school, and conduct an independent investigation. The Executive Director may then grant or withhold

permissiontoentersuchTeaminthebestinterestsoftheCompetition.Permissionmaybesubjecttosuch

conditionsastheExecutiveDirectormaydetermine,including,inparticular,limitationsonthecomposition

of the Team (for example, a requirement that all Team members be enrolled full time at the foreign

campus).

(d) InstitutionsthathaveoutstandingdebtsforfeesorotherCompetitionobligationsarenoteligibleto

competeintheCompetitionuntilsuchfeeshavebeenpaidorobligationshavebeensatisfied.

(e) Any Team composed of more than five Team Members (Official Rule 2.2), or which utilizes

improper outside assistance (Official Rule 2.8), the BenchMemorandum (OfficialRule 2.14), or another

Team’sMemorialwithoutauthorizationundertheseRules(OfficialRule2.15),maybedisqualifiedfromthe

Competition.

2.2 TeamComposition

(a) A Team may be composed of two to five Team Members who shall be the only individuals

contributing to theworkproduct of theTeamover the courseof theCompetitionYear. Substitutionsof

TeamMembersmustbemadeinaccordancewithRule3.6.

(b) Participatinginstitutionsand individualsarenotpermittedtouse thecurrentCompetitionYear’s

competitionmaterials(includingtheCompetitionProblem)foranypurposeotherthanparticipatinginthe

JessupCompetition, including, butnot limited to, conducting an internalmoot court competition and/or

JessupTeamtry-outs.Teamsand/orindividualsassociatedwithinstitutionsthatviolatethisRulemaybe

disqualifiedfromtheCompetition,andinstitutionsviolatingitmaybedeemedineligibletoparticipatein

futureyears.

2.3 TeamMemberEligibility

ApersonmaybeaTeamMemberifheorshe:

(a) ispursuingalawdegree,aninternationallaw-relateddegree,oraninternationalrelations-related

degreewheretheExecutiveDirectorhasgivenpermissioninaccordancewithOfficialRule2.1(a);and

(b) intendstocompeteonbehalfofaneligibleinstitutionatwhichheorsheisenrolledasafull-timeor

part-timestudentasof(i)theTeamMemberregistrationdeadline,(ii)theinstitution’sQualifyingRounds,

or(iii)theInternationalRounds;and

(c) has not, after having graduated from any type of law degree program, either (i) engaged in the

practiceoflaw,or(ii)engagedinanypaidorunpaidactivity(outsideofdegreestudies)whichwouldgive

the student an undue advantage in any aspect of the Competition over students who have not yet

completedtheirfirstlawdegree,andtheopinionoftheExecutiveDirectoroneitherissueshallbefinal;and

(d) hasneverparticipatedasjudge,eitherofMemorialsorinanyOralRound,atanyleveloftheJessup

Competition.

2.4 ExecutiveDirector’swrittenpermissionrequiredincertaincases

InadditiontosatisfyingRule2.3,apersonmustrequestandobtainthewrittenpermissionoftheExecutive

DirectortobeaTeamMemberiftheperson:

(a) is enrolled as a visiting or exchange student rather than as a degree candidate, or is otherwise

enrolledatmorethanoneinstitution;

(b) isservingasanexternorapprenticeinlieuofattendingclass;or

(c) has already received a graduate degree or post-graduate degree in a legal field (e.g., LL.M., J.D.,

CanadianLL.B.,M.Phil.(InternationalLaw),JurisMaster,J.S.D.,Ph.D.);or

(d) isenrolledinaprogramofstudyleadingtoapost-graduatedegreeinalegalfield(e.g.,Ph.D.,D.Phil.

J.S.D.).

Note that most LL.B. degrees are considered undergraduate degrees. Students who are currently

pursuinganundergraduatedegreeinalegalfieldarenotrequiredtoobtainspecialpermissionunder

Rule2.4(c).Inaddition,studentswhoarecurrentlypursuing,buthavenotyetcompleted,theirfirst

graduatedegreeinalegalfieldarenotrequiredtoobtainspecialpermissionunderRule2.4(c).

2.5 ExecutiveDirector’sDiscretion

Notwithstanding theprovisionsofRules2.3 and2.4, the ExecutiveDirector shall have thediscretion to

grantordenyeligibilityincertainexceptionalcircumstances,butshalldosoonlyinaccordwiththespirit

oftheseRulesandinthebestinterestsoftheCompetition.

2.6 TeamSelectionProcess

TeamMembersmaybechosenbyanymethodapprovedbytheresponsibleauthoritywithintheinstitution.

If an institution wishes to hold an intramural competition to determine the composition of its Team,

however,thecurrentCompetitionProblemmaynotbeused.SeeRule2.2(b).ViolationofthisRuleshallbe

penalizedaccordingtoRule2.8.

2.7 NationalityRequirements

Administrators may not, without the written approval of the Executive Director, set nationality

requirementswithregardto thecompositionofTeams.Requests forsuchapprovalmuststateclearly in

writingthereasons forsucharequirementandmustbe incorporated in therelevantRulesSupplement,

approvedinaccordancewiththeseRules.

2.8 OutsideAssistancetoTeams

Each Team must research, write, edit, and develop its own legal and factual arguments without the

assistance of persons who are not TeamMembers. Any Team that receives outside assistance may be

penalizedandmaybedisqualifiedfromtheCompetition.

2.9 AssistancefromTeamAdvisors

As a general principle, a Team shall have a number of Team Advisors no larger than is necessary to

adequatelyprepare theTeamtoparticipate fairly in theCompetition.Notwithstanding theprovisionsof

Rule2.8,TeamAdvisorsmayprovideadvicetoaTeam,providedsuchadviceislimitedto:

(a) generalinstructiononthebasicprinciplesofinternationallaw;

(b) generaladviceonresearchsourcesandmethods;

(c) generaladviceonmemorialwritingtechniques;

(d) generaladviceonoraladvocacytechniques;

(e) generaladviceon theorganizationandstructureofarguments in theTeam’swrittenand

oralpleadings;

(f) generalcommentaryonthequalityoftheTeam’slegalandfactualarguments;

(g) adviceontheinterpretationandenforcementoftheseRules;and

(h) adviceastopleadingoptionsorsimilarstrategicdecisions.

2.10 AssistancefromOtherTeams

TeamMembersandTeamAdvisorsfromanyTeam,includingTeamsthathavebeeneliminatedfromthe

Competition,maynotprovideassistanceinanywaytoanyotherTeam.Prohibitedassistanceincludes,but

isnotlimitedto, the following:giving theTeam’snotesorMemorialstoanadvancingTeam;posting the

Team’s Memorials online so that a person who is not a registered Team Member or registered Team

Advisormayaccessthem;engaginginpracticemootsagainstaparticipatingTeam;andprovidingvideoor

audio tapesof previous rounds,whetherpracticeroundsorCompetition rounds, to an advancingTeam.

TheExecutiveDirectormayallowforotherwiseprohibitedassistanceifdeemedtobeinthebestinterests

oftheCompetition.

2.11 JessupCourses

UnlesspriorapprovalisgrantedinwritingbytheExecutiveDirector,TeamMembersmaynotparticipate

orbeenrolledinaclassorcoursewhichusesthecurrentyear’sCompetitionProblemasasubjectmatterof

instruction, as a teaching tool, or as a means for selecting TeamMembers. No approval is necessary if

student enrolment in the course is limited to Team Members. In any case, even when approval is

unnecessaryorhasbeengrantedby theExecutiveDirector,TeamMembersmustcomplywith theother

provisionsofOfficialRule2.8regardingoutsideassistance.StudentsenrolledinaJessupcoursewhoare

notselectedtobeTeamMembersmaynotshareordiscusstheirworkwithTeamMembers.

2.12 DraftMemorials

Before Memorials are submitted, Teams may not distribute their memorials to anyone who is not a

registeredTeamMemberoraregisteredTeamAdvisor.RegisteredTeamAdvisorsmayprovidefeedback

onmemorialsatanytimeprovidedtheyabidebytheprovisionsofRule2.9withrespecttothepermissible

advicethatcanbegiventotheTeam.

2.13 PracticeRounds

(a) Teams may organize “practice rounds” of oral pleadings involving the Competition Problem to

preparefortheCompetition.Inpracticerounds,thepersonspresentingargumentsfortheApplicantand

RespondentmustbefromthesameTeam.

(b) RegisteredTeamAdvisorsmayserveasjudgesinpracticeroundsheldatanytimeprovidedthey

abidebytheprovisionsofRule2.9.

(c) An individualwho isnota registeredTeamMemberor registeredTeamAdvisormay serve as a

judgeinaTeam’spracticeroundsifheorshe:

(i) doessoonlyafterthesubmissionofMemorials;

(ii) isnotformallyaffiliatedwithanyotherTeamintheCompetition;

(iii) hasnotobtainedaccesstotheBenchMemorandum;

(iv) confineshisorherfeedbacktogeneralcommentaryontheadvocacystyleandtechniqueofthe

speakers,andtocommentaryrespectingthegeneralrulesofinternationallaw;and

(v) refrainsfromofferingcommentaryorsuggestionsaboutspecificsubstantivearguments.

2.14 ConfidentialityoftheBenchMemorandum

(a) TheBenchMemorandum is strictly confidential. TheExecutiveDirectorwilldisqualifyanyTeam

thatmakesuseoftheBenchMemorandum.TeamswhoobtainacopyoftheBenchMemorandumshould

immediatelyreturnittotheExecutiveDirectorwithoutexaminingthecontents.

(b) The Bench Memorandum may be used only at an official Qualifying Competition or the

InternationalRounds.

(c) IndividualswhohaveobtainedaccesstotheBenchMemorandummaynotjudgepracticerounds.

2.15 UseofOpposingTeam’sMemorialsandArguments

ATeammaynotvieworotherwisebecomeprivytoanyMemorialotherthanitsownandtheApplicantor

RespondentMemorialsofeachofitsscheduledopponents.Ateammayincorporateargumentsandother

informationfromtheMemorialsandOralRoundsofotherTeamsthattheTeamisauthorizedtoviewor

hearunderthisRule.

2.16 ProblemCorrectionsandClarifications

Teams may request clarifications and corrections to the Competition Problem by submitting a written

requesttotheExecutiveOfficethroughtheonlinesystemprovidedforthatpurposeatwww.ilsa.orgbythe

date in theOfficialSchedule.Baseduponthe requests received fromallTeams, theExecutiveOfficewill

publishProblemCorrectionsandClarificationsbythedateintheOfficialSchedule.EachTeammustensure

that it receives and adequately notes the Problem Corrections and Clarifications in preparation for the

Competition.

2.17 AnonymityofTeams

Teamsmustnotrevealtheidentityoftheirinstitutionorcountryoforigintojudgesatanytimeduringa

competition.TheAdministratormaydisqualifyorimposeaPenaltyagainstanyTeamthatintentionallyor

inadvertentlydisclosesitsschoolorcountryoforigintoajudgeduringacompetition,whetherornotsuch

disclosureoccursduringanOralRound.Allinstancesofdisclosureduringacompetitionshallbereported

to the Executive Office. For the sake of clarification,merely posting pictures of a Jessup Team or Team

Member(s) on social media or a publicly available website, absent other facts, does not constitute a

violationofthisRule.

2.18 “Friendly”Competitions

Notwithstanding any other provision in theserules(in particular,Rules2.8 and 2.10), the Executive

Directormay,inhisorhersolediscretion,authorizetheholdingofoneormore“Friendly”Competitions.

SuchcompetitionsmayinvolvetheexchangeofMemorials,theviewingofoneormoreotherTeams’oral

arguments,andquestioningandevaluationfromjudges.Inauthorizingsuchacompetition,theExecutive

Director shall make or approve arulessupplement that shall include which Teams are eligible to

participateinthecompetitionandhowthecompetitionistobeadministeredandconducted.Noteammay

participateinmorethanoneFriendlyCompetitioninthesameyear.

OFFICIALRULE3.0:TEAMREGISTRATION

3.1 TeamRegistration

(a) Each Team must register with the Executive Office by completing a registration form online at

www.ilsa.org and paying the appropriate registration fee by the deadline in the Official Schedule. Each

Team must provide a valid email address at registration. Notice sent to the registered email address

constitutesnoticetoallTeamMembers.

(b) ILSA may promulgate additional rules and procedures as dictated by the best interests of the

competition.AllTeamMembersandTeamAdvisorsareexpectedtoregularlychecktheirTeamHomepage

forupdatesandannouncementsandareassumedtohavedoneso.ATeammaynotvalidlycomplainthatit

wasnotgivenpropernoticeofarulechangeorupdate,whenthatchangeorupdatewasmadeavailableon

theTeamHomepage.

(c) As a condition of participating in a Qualifying Competition, the Qualifying Competition

Administratormay,withtheconsentoftheExecutiveDirector,levyareasonablefeetodefraythecostsof

organizingthatCompetition.

3.2 WaiverofRegistrationFee

(a) Teams unable to pay in full the registration fee levied pursuant to Rule 3.1(a)may apply for a

waiver or discount from the Executive Office, which the Executive Office may grant in exceptional

circumstances. QualifyingRoundAdministrators do not have authority to grantwaivers or discounts of

registrationfeesleviedpursuanttoRule3.1(a).RequestsforwaiversmustbesubmittedtotheExecutive

[email protected].

(b) AnyrequestforawaiverordiscountofafeeleviedpursuanttoRule3.1(c)shouldbeaddressedto

the Qualifying Competition Administrator in the first instance. Any appeal fromadecision taken by the

QualifyingCompetitionAdministratorshouldbeaddressedtotheExecutiveDirector.

3.3 TeamMemberRegistration

(a) Everystudentwhocontributes totheworkproductof theTeam,atanypoint in theCompetition

Year,mustberegisteredasaTeamMemberandcountedtowardthemaximumoffiveTeamMembersthat

constitutethatTeam.ConductingresearchforaTeam’soraland/orwrittenarguments,writinganypartof

a Team’s Memorial, and presenting any of a Team’s oral arguments are examples of activities that

contributetoaTeam’sworkproduct.StudentsdesignatedbyaschoolorbyaTeamasalternateorback-up

team members may not be registered as TeamMembers and may not contribute to the Team’s work

product.

(b) EachregisteredTeamMembermayserveanyTeamMemberrole,suchasresearcher,writer,oralist

fortheApplicant,andoralistfortheRespondent,andmayservemultipleorallTeamMemberroles,atany

timeduringtheCompetitionYear.TeamMembersdonotneedtoregisterorotherwisedesignatewithILSA

theirparticularrole(s)ontheteam.

(c) ItistheresponsibilityoftheTeamtoensurethatstudentsareeligibleundertheprovisionsofRule

2.3,orhavesubmittedarequestforspecialpermissionasrequiredunderRule2.4,priortocontributingto

theTeam’sworkproduct.

(d) Registered TeamMembers with pending requests for special permission may contribute to the

Team’s work product while awaiting ILSA’s decision regarding such requests. If the Executive Director

deniesarequest,therequestingTeamMembermustimmediatelyceasecontributingtotheTeam’swork

productandtheTeammustdiscardallworkproducedbytheineligibleTeamMember.

(e) ThenameofeachTeamMemberand thedegreeprograminwhichheorshe isenrolledmustbe

registeredwiththeExecutiveOffice,viatheonlineregistrationformlocatedunderthe“Profile”linkonthe

Team’sHomepage,bytheregistrationdeadlineintheOfficialSchedule.

3.4 TeamAdvisorRegistration

The name of each TeamAdvisor for a Teammust be registeredwith the Executive Office by theTeam

registrationdeadlineintheOfficialSchedule.TeamAdvisorsmustberegisteredbycompletingtheonline

registration form locatedunder the “Profile” linkon eachTeam’sTeamHomepage.An individual sitting

only as a practice round judge pursuant to Rule 2.13, whether or not a member of the faculty of the

institutionrepresentedbytheTeam,neednotregisterasaTeamAdvisor.

3.5 TeamNumberasIdentification

Once a Team has completed registration, including paying in full the appropriate registration fee, the

ExecutiveOfficewillassigntheTeamanofficialTeamNumber.

3.6 ChangestoRegistrationInformation

Once Team Members and Team Advisors are registered, Teams may not make any changes, whether

additionsor substitutions, including to contact and mailing information,without permissionfrom the

Executive Director. Any request to make a change must be submitted [email protected] an

explanationofthereasonfortherequestedchange.SubstitutionofTeamMemberswillbegrantedonlyin

exceptional circumstances andis unlikely tobe grantedwhereworkproduct (written, oral, or research)

TheExecutiveDirector, or theAdministrator in consultationwith theExecutiveDirector,will determine

theeligibilityofpersonstoserveasjudgesinanypartoftheCompetition,subjecttotheprovisionsofthis

Rule.

5.2 Students

StudentsmayactasCompetitionjudgesonlyifthey(a)holdadegreeinlawinanyjurisdiction,oradegree

inaninternationallaw-relatedfield,and(b)arenotdirectlyaffiliatedwithanyTeamparticipatinginthe

competitionatwhichtheyarejudging.

5.3 TeamAdvisors

Unless expressly permitted by an approved Rules Supplement or otherwise approved by the Executive

Director, TeamAdvisors, or others directly affiliatedwith a Team,may not act as judges at the oral or

memorialstagesofanycompetitionuntiltheTeamtheyadvisehasbeeneliminatedfromtheCompetition.

TeamAdvisorsorothersdirectlyaffiliatedwithaTeamwhoarepermittedtoactasjudgespursuanttothis

Ruleshallnot,inanycase,beprovidedwithaccesstotheBenchMemorandumandshallnot,inanycase,

discloseanythingtotheTeamtheyadviseconcerningthewrittenororalsubmissionsoftheTeam(s)they

judge,inviolationofRule7.13(a).

5.4 AnonymityofTeams

JudgesshouldnotattempttoascertaintheschoolorcountryoforiginofanyTeamduringacompetition.

However,incircumstanceswherethejudgebelieveshisorherevaluationofaparticularMemorialwould

beaffectedbyknowledgeofwhetherornottheprimarylanguageusedbytheTeamMembersintheirlegal

studiesisEnglish,thejudgemayrequesttheExecutiveOfficetorevealthisinformation.

5.5 OralRoundConflictsofInterest

(a) Definitions.ForthepurposeofthisRule5.5,thefollowingdefinitionsshallapply:

(1) an“Affiliation”meansapersonalorprofessionalrelationshipbetweenajudgeandaschool,

coach,orTeammemberparticipatinginthecompetitioninwhichthejudgeistoserve.

(2) a“ConflictofInterest”meansanAffiliationthatwould,intheeyesofareasonableobserver,

createaninferencethatthejudgewouldbeunabletobeimpartialastotheconductorresultofthe

OralRound.ReferenceshouldbehadtoRule5.5(f),whichlistscertainAffiliationsthatdonotperse

constituteaConflictofInterest.

(b) ProhibitionandMitigationofConflictof Interest.TheAdministratorshouldavoidplacinga judge

intoanoralroundinwhichheorshehasaConflictofInterest.IntheeventthattheAdministratorisunable

toavoidaConflictofInterest,theAdministratorshouldtakereasonablestepstomitigatetheeffectsofthe

ConflictontheOralRound.Suchstepsmightinclude:obtainingawaiveroftheConflictfrombothTeams;

informing the othermembers of the panel of the judge’s Affiliation; adding to the panel a judgewith a

proportionalAffiliationwiththeopposingTeam;andassigninganeutralofficialtoobservetheOralRound

andthesubsequentdeliberationstodeterminewhethertheConflictofInterestaffectedtheoutcomeofthe

OralRound.

(c) Waiver by Consent of Both Teams. Any Conflict of Interestmay be cured by the express oral or

writtenwaiver,eitherbeforeoraftertheOralRound,ofbothTeams.Inthisevent,neitherTeammaylater

fileanappealorothercomplaintonthebasisoftheConflictofInterest.Inaddition:

(1) IfaTeamisawareofanAffiliationbeforethecommencementofanOralRoundandfailsto

reportit,asrequiredunderRule5.5(e),beforetheOralRoundbegins, itshallbedeemedtohave

waivedanyallegedConflictofInterest.

(2) IfaTeambecomesawareofanAffiliationafterthecompletionofanOralRoundandfailsto

reportasrequiredunderRule5.5(e),itshallbedeemedtohavewaivedanyConflictofInterest.

(d) ProphylacticAvoidanceofConflicts.ItisthedutyofajudgetoreportanyAffiliationsatthetimehe

orsheregisterstojudgeorsubsequently,directlytotheAdministratorinadvanceoftheCompetition.The

Administrator shall investigate any reportedAffiliation (whether self-reported by a judge or otherwise)

andshalldeterminewhethersuchAffiliationconstitutesaConflictofInterest.

(e) ReportingObligationofTeams.IfaTeambelievesthatanAffiliationexistswhichmayconstitutea

ConflictofInterest,itshallpromptlyinformtheAdministratororthebailiffoftheaffectedOralRound.The

bailiff will report any alleged Affiliations to the Administrator, who shall take appropriate steps to

investigateand,ifheorshedeterminesthataConflictofInterestexists,toeliminateormitigateit.ATeam’s

failuretotimelyinformtheAdministratorofanAffiliationofwhichitisawarewillconstitutewaiverunder

Rule5.5(c).

(f) AffiliationsWhichDoNotConstituteConflictsofInterest.ThedifferencebetweenamereAffiliation

andaConflict of Interest is the reasonable inferenceof partiality.Absent additional facts supporting an

inferenceofpartiality,thefollowingfrequentlyoccurringAffiliationsdonotconstituteConflictsofInterest:

(1) thejudgeknowsorrecognizesaTeammemberbyreasonoftheMember’sparticipationin

previousmootcourtcompetitions;

(2) thejudgeknowsoneorbothcoaches,eitherbecauseofprofessionalorpersonalaffiliation,

priorparticipationinmootcourtcompetitions,orotherreasons;

(3) thejudgeisanalumnusofoneoftheschoolsparticipatingintheOralRound;and

(4) thejudgeisanemployeeofoneoftheschoolsparticipatingintheOralRoundwheresuch

5.6 PriorViewingofTeams

(a) SubjecttoSection5.5(b),judgesshouldnotviewaTeamthattheyhaveviewedinapreviousOral

Round.IfajudgemustviewaTeamtwice,theAdministratorshouldstrivetoensurethatheorsheviews

theTeam’soppositeside.

(b) IntheAdvancedRoundsoftheInternationalRounds,theExecutiveDirectormaypermitjudgesto

viewoneormoreTeamsthattheyhavepreviouslyjudged,ifsuchviewingservesthebestinterestsofthe

Competition.

5.7 BenchMemorandum

JudgesmustkeepthecontentsoftheBenchMemorandumstrictlyconfidential,andmaynotdiscloseitto

TeamsorTeamAdvisors.

5.8 CommentarybyJudges

JudgesareencouragedtoprovidedirectfeedbacktoTeamsregardingtheirperformanceatthecompletion

of an Oral Round. In providing such feedback, judges are admonished to give due regard to the time

limitationsandscheduleoftheCompetition,andmustabidebythefollowing:

(a) In thePreliminaryRoundsof any competition, Judgesmaynotprovide any feedback thatwould

revealthecontentsoftheBenchMemorandum,thescoresgiventoindividualOralists,ortheresultsofthe

Round.

(b) In the Advanced Rounds of any competition, Judges may not provide any feedback that would

reveal the contentsof theBenchMemorandumor scores given to individualOralists.The results of the

RoundmayberevealedtotheTeamsonlyifthejudgesareauthorizedtodosobytheAdministrator.

OFFICIALRULE6.0:MEMORIALS

6.1 SubmissionofMemorials

(a) Each Team participating in the Competition must prepare one Applicant and one Respondent

Memorial.

(b) Each Teammust submit its Applicant and RespondentMemorials to the Executive Office via its

TeamHomepage(available throughwww.ilsa.org),andsend itsApplicantandRespondentMemorials to

therelevantAdministrator,ifany,attheemailaddressprovidedbytheAdministrator,nolaterthan17:00

(5:00 p.m.) Central Standard Time (CST) (UTC/GST – 6), on the date specified in the Official Schedule.

Submission to theAdministratormust occur in a single emailmessage, addressed to theAdministrator,

with both Applicant and Respondent Memorials attached as separate files titled “###A” and “###R”,

respectively(where“###”istheTeam’sofficialTeamNumberassignedinaccordancewithRule3.5).Ifone

oftheMemorialswillbesubmittedlate,aTeammayseparatelysubmitthetimelymemorialonlinethrough

its Team Homepage and send the timely Memorial to the Administrator before the deadline without

penalty. The official time of submission for the purpose of calculating late penalties is the time each

individualMemorialisuploadedtoaTeam’sHomepage.Administratorsmayassessadiscretionarypenalty

ofnomorethan5points(unlessaRulesSupplementprovidesotherwise)ifaTeamfailstotimelyemailits

memorialstotheAdministrator.

(c) InexceptionalsituationsanduponapprovaloftheExecutiveDirectorpursuanttoOfficialRule1.5,

anAdministratormaymodifytheMemorialsubmissionguidelinesviaaRulesSupplementinthefollowing

ways:

(i) byestablishingadeadlinewhichisearlier,butnotlater,thanthetimeanddatespecifiedin

theOfficial Schedule. If an earlierdeadline isset, theMemorialsmustbeuploadedvia theTeam

Homepage andemailed to theAdministratorby this earlierdeadline.Memorials receivedby the

ExecutiveOfficeaftertheearlierdeadlinewillbesubjecttolatepenalties;

(ii) by requiring electronic copies to bemailed to opponent Teams by the deadline and in a

mannerandformspecifiedbytheAdministrator;or

(iii) byrequiringpapercopiestobemailedtotheAdministratorand/oropponentTeamsbythe

deadlineand inamannerand formspecifiedby theAdministrator. If theAdministratorrequests

papercopies,heorshemayspecifyalaterpostmarkorcourierdeadlineforthepapercopiesthan

for the electronic submission, provided that an electronic copy is sent to ILSA and the

Administratorbythedesignateddeadlineforelectroniccopies.

(d) Allelectronicandpapercopyversions(ifany)ofMemorialssubmittedtotheExecutiveOffice,the

Administrator,oranyotherpersonmustbeidentical.

(e) TeamsmayresubmittheirMemorialswithoutpenaltyuntiltheMemorialdeadlinehaspassed.After

theMemorialsubmissiondeadline,resubmittedMemorialswillbesubjecttoatwo-pointpenalty,aswellas

anyapplicablelatepenalties.

(f) Equipmentfailureorproblemswillnotbeconsideredjustificationforimproperformattingorlate

submissionofMemorials.

6.2 DisqualificationDeadline

UnlessotherwiseagreedinadvanceandinwritingbytheExecutiveOffice,aTeamwillbedisqualifiedfrom

theCompetition if itdoesnotsubmitboth itsApplicantandRespondentMemorialsby17:00(5:00p.m.)

Central Standard Time (CST) (UTC/GST – 6) on the Disqualification Deadline for Memorial submission

specifiedintheOfficialSchedule.AnyMemorialsubmittedafterthedeadlineforSubmissionofMemorials

asdefinedbyOfficialRule6.1(b),butprior to theDisqualificationDeadline,willbesubject toapplicable

latepenalties.

6.3 MemorialsSubmittedinLanguagesOtherThanEnglish

If permittedbyanapplicableRules Supplement,TeamsmaysubmitMemorials forQualifyingRounds in

languagesotherthanEnglish.TeamsmustuploadsuchMemorialsintheoriginallanguageviatheirTeam

homepageonorbeforethedeadlineindicatedintheOfficialSchedule.MemorialsofsuchTeamsadvancing

to the International Rounds must be translated into English and submitted to the Executive Office at

jessup@ilsa.orgnolaterthanthreeweekspriortothestartoftheInternationalRounds.Unlessotherwise

approved inadvanceand inwritingby theExecutiveOffice, failure tosendtranslationsby thisdatewill

result in disqualification of the Team. SuchMemorials must otherwise conform to the required format

outlinedintheseRulesandmustbe,tothegreatestextentpossible,verbatimtranslationsoftheoriginally

submittedMemorials. TranslatedMemorials must be accompanied by a certificate from the translators

stating that the contents of the Memorials were not revised, updated, or otherwise altered in the

translationprocess.TheExecutiveDirectormaydisqualifyanyTeamthataltersthesubstantivecontentof

itsMemorial(s)duringtranslation.

6.4 MemorialFormatting

(a) File Type: All parts of eachMemorial must be contained in a single file. Memorials must be in

MicrosoftWordformatandhavea.docor.docxfileextension.MemorialsthatdonotconformtothisRule,

suchasmemorialsinPDFformatormemorialsusinga .datfileextension,willnotbeaccepted.IfaTeam

submits its memorials in an unacceptable format it may resubmit conforming Memorials, but will be

subjecttoresubmissionpenaltiesunderRule6.1(e).

6.15 AnonymityinMemorials

Names of participants, and the nations or school name of Teams, may not appear on or within the

6.16 TeamswithTechnologicalLimitations

IfaTeamisunabletocomplywithanyportionofOfficialRule6.0duetotechnologicallimitations,itmay

possibleand,ataminimum,twoweeksbeforetheMemorialdeadline.

6.17 Four-JudgePanelsattheInternationalRounds

At the International Rounds, the Administrator shall employ four judges to grade each Memorial. The

Administratorshallidentifythescorethatisfurthestfromthemeanofallfourscores,andthatscoreand

thescoresheetonwhichitappearsshallbedisregarded.Thethreeremainingscoresshallbeutilizedforthe

purposeofdeterminingRoundoutcomesandTeamMemorialrankings.

6.18 Three-JudgePanelsatQualifyingCompetitions

AtQualifyingcompetitions,theAdministratorshallemploythreejudgeswheneverpossibletogradeeach

Memorial. In extenuating circumstances, theAdministratormayauthorizepanels of two judges, but this

shouldbedoneonlyasalastresort.AdministratorsshouldminimizethenumberoftimesthataTeamis

evaluated by a two-judge panel. In no case may an Administrator authorize a panel of a single judge.

7.0 GeneralProcedures

EachOralRoundofeachcompetitionconsistsof90minutesoforalpleadings.ApplicantandRespondent

are each allotted45minutes.Oral presentationsduring theRoundmustbemadeby two, andonly two

Members,fromeachTeam.PriortothebeginningoftheOralRound,eachTeammustindicatetothebailiff

howitwishestoallocateits45minutesamong(a)itsfirstOralist,(b)itssecondOralist,and(c)rebuttal

(for Applicant) or sur-rebuttal (for Respondent). The Team may not allocate more than 25 minutes,

includingrebuttalorsur-rebuttal, toeitherOralist,although inextenuatingcircumstances, theExecutive

DirectorhasdiscretiontopermitasingleOralisttoarguebeyondthe25-minutelimit.Timeallocatedfor

butnotusedbyoneOralistmaynotbeusedbytheotherOralistorsavedforrebuttalorsur-rebuttal.Any

TeamMembermayactasanOralistduringanyroundoftheCompetition,andneednotalwaysarguethe

sameside.TeamsusinginterpretersmaybeallottedadditionaltimepursuanttoRule7.14.

7.1 ExtensionofTimeatJudges’Discretion

Judgesmay,attheirdiscretion,extendtotalTeamoralargumenttimebeyondthe45-minuteallocation,and

Oralists asked by the judges to expand upon arguments may, in this instance, exceed the 25-minute

individuallimit.

7.2 ThreeJudgePanels

IneachOralRound,theAdministratorshallemploythreejudgeswheneverpossible,andmayemploymore

than three judges in Advanced Rounds. In extenuating circumstances, the Administratormay authorize

panelsoftwojudges,butthisshouldbedoneonlyasalastresort.TheAdministratorshouldminimizethe

numberoftimesthataTeamisevaluatedbyatwo-judgepanel.InnocasemayanAdministratorauthorize

thatanOralRoundbepresidedoverbyasinglejudge.

7.3 OralRounds

TheorderofthepleadingsineachOralRoundatalllevelsoftheCompetitionis:

Applicant 1 -->Applicant2 --> Respondent1 -->Respondent2 -->Rebuttal (Applicant1 or 2) --> Sur-

rebuttal(Respondent1or2).OnceanOralisthascompletedhisorhermainpleading,thatOralistmaynot

makeanyadditionalargumentexceptforrebuttalorsurrebuttal.Thisappliesirrespectiveofwhetherthe

pleading Team uses all of the time it has allocated for its main pleadings. Time not used in the main

pleadingmaynotextendthetimeallocatedtorebuttalorsur-rebuttal.

7.4 RebuttalandSurrebuttal

EachTeammayreserveuptotenminutesforrebuttalorsur-rebuttal.Asacourtesytothejudges,Teams

shouldannounceatthebeginningoftheiroralargumentwhethertheyintendtoreservetimeforrebuttal

orsurrebuttalandhowmuchtimetheyintendtoreserve,althoughafailuretodosowillnotentailwaiver

of the right to rebuttal or surrebuttal.Onlyoneof the twooralistsparticipating in theOralRoundmay

delivertherebuttalorsurrebuttal,buttheTeamneednotindicateinadvancewhichofthepleadingTeam

Members will do so. The rebuttal shall immediately follow Respondent 2, and the surrebuttal shall

immediatelyfollowtherebuttal.Teamsmaywaivetheirrebuttalorsurrebuttal.

7.5 ScopeofPleadings

ATeam’soralpleadingsarenotinanywaylimitedtothescopeoftheTeam’sMemorial.Thescopeofthe

Applicant’srebuttalislimitedtorespondingtotheRespondent’sprimaryoralpleadings,andthescopeof

theRespondent’ssur-rebuttalis limitedtorespondingtotheApplicant’srebuttal.IftheApplicantwaives

rebuttal,Respondent’s sur-rebuttal is automaticallywaivedaswell. Although judges are admonished to

enforce the limits on the scope of rebuttal and sur-rebuttal, andmay take a violation of this Rule into

accountinevaluatinganOralist’sperformance,thereisnodiscretionaryornon-discretionaryPenaltyfor

exceedingthescopeofrebuttalorsur-rebuttal.

7.6 ExParteProcedure

(a) In extreme circumstances, such aswhenaTeam fails to appear for a scheduledOralRound, the

Administrator, afterwaiting 30minutes,may allow theOralRound to proceed ex parte. In an ex parte

proceeding, theattendingTeampresents itsoralpleadings,whicharescoredby the judgesto theextent

possibleasiftheabsentTeamhadbeenpresentandarguing.Insuchacase,theTeamthatfailstoappear

foritsscheduledRoundforfeitsallsixoftheRound’sOralRoundPoints.

(b) TheAdministratormayscheduleanadditionalexparteproceedingfortheabsentTeamlaterinthe

competition, if time and administrative concerns permit. The scores from the absent Team’s ex parte

proceeding do not affect the scoring of the original Oral Round and are used only for purposes of

calculatingindividualoralpleadingscores.

(c) TeamwillbedeemedtohavefailedtoappearifonlyoneMemberfromagivenTeamappearsfor

theOralRound.Insuchanevent,theabsentTeam’ssingleOralistshallbeallowedtopleadandreceivean

individual score for purposes of calculating individual oral pleading scores, even though his/her team

forfeitsallsixOralRoundpoints.

7.7 OfCounsel

During each Oral Round, one additional TeamMember registered pursuant to Rule 3.3 may sit at the

counseltablewiththetwoOralists,ascounsel.Thepersonactingascounselneednotbethesameperson

ineachOralRound.

7.8 CompetitionCommunications

Only the oral communications with the judges described in Rule 7.9, 7.10, and 7.11 are permitted. In

particular,nowrittencommunicationorexhibitsmaybepresentedordeliveredbyanyTeamMemberto

anyjudge.

7.9 OralCourtroomCommunicationbetweenCounselandJudges

EachOralistmaycommunicatewith the judges,and the judgesmaycommunicatewith thatOralist,only

duringhisorherallottedtime.Inextraordinarycircumstances,thejudgesmaycommunicatedirectlywith

eitherTeam’scounsel table(forexample, toclarify thespellingofanOralist’snameor torequest thata

Teamremainquietduringitsopponent’soralpresentation).

7.10 OralCourtroomCommunicationandActivityatCounselTable

Topreventdisruption,communicationatthecounseltablebetweenTeamMembersmaybeinwritingonly.

Teamsandteam-affiliatedspectatorsshallavoidallunnecessarynoise,outbursts,orother inappropriate

behaviorthatdistractsfromtheargumentinprogress.

7.11 WrittenCourtroomCommunication

Written communication during the OralRound shall be limited towritten communication among Team

Members seated at the counsel table. No other written communication may take place between any

combination of the following parties: judges, the oralist, TeamMembers seated at the counsel table, or

spectators(includingTeamMembersseatedintheaudience).

7.12 Spectators

AllPreliminaryRoundsshouldbeopentothepublic.Teamsmayagreeinadvance,andafterconsultation

with theAdministrator, to limitthenumberofspectatorsinaroomduringthePreliminaryRounds.The

presence of Team Advisors or other spectators affiliated with the Team is permitted in the courtroom

during an Oral Round in which the Team is competing. Teams are responsible for ensuring that their

spectatorsdonot engage inanydisruptivebehavior, andshall ensure thatspectatorsdonotdisclose to

7.13 Scouting

(a) TeamMembersorpersonsdirectlyaffiliatedwithanyTeammayattendonlyPreliminaryRoundsin

whichthatTeamiscompeting.TheExecutiveDirectormay,intheinterestsoftheCompetition,(1)waive

thisRule,or(2)allowTeamAdvisorstojudge,providedsuchTeamAdvisorsoffernoadvicetotheTeam

theyadviseabouttheTeam(s)theyjudge.ViolationofthisRuleshouldbebroughttotheattentionofthe

bailiffand/orAdministratorimmediately,withoutdisturbingtheOralRound,orimmediatelyaftertheOral

Roundhasfinished.

(b) There are two types of scouting, both ofwhich are prohibited. “Direct Scouting” occurswhen a

TeamattendsanOralRoundinvolvingoneormoreTeamsagainstwhichitwillcompeteinafutureOral

Round.“IndirectScouting”occurswhenaTeamattendsanOralRoundinvolvingtwoTeamsagainstwhich

itisnotscheduledtocompeteinthePreliminaryRounds.

(c) ATeamthatcommitsDirectScoutingforfeitsallsixOralRoundPointsineachfuturePreliminary

RoundinwhichitcompetesagainstaTeamitscouted.

(d) A Team that commits Indirect Scouting shall forfeit one Preliminary Round. For example, if the

Teamwon four Preliminary Rounds, its total number of wins shall be reduced to three, without other

adjustmenttoitsTotalRawPointsorTotalRoundPoints.(IfaTeamthatcommitsIndirectScoutingwins

no Preliminary Rounds, there shall be no such adjustment.) This adjustment shall occur prior to the

determinationoffinalPreliminaryRoundrankingsdescribedinRule10.8.

(e) During theAdvancedRoundsof anyCompetition,anyTeamstill in contention is forbidden from

attending any Advanced Round matches not involving that Team. Any Team which commits scouting

duringtheAdvancedRoundswillforfeittheRoundinwhichthescoutingoccurredand,asaconsequence,

any subsequent Round in that competition in which the Team competes. In the event that scouting is

discoveredonlyafterthesubsequentRoundshavebeenheld,theresultingforfeit(s)shallnotretroactively

affecttheseedingofsubsequentRounds.

7.14 InterpretersandtheUseofInterpreters

Teamsmayuseinterpreters,subjecttothefollowingprovisions:

a) InQualifyingRounds:EachAdministratormayallowTeamsand/orjudgestouselanguagesother

than English duringOralRounds in a Qualifying competition, and/ormay provide procedureswhereby

interpretersmaybeused,byincludingRulestothiseffectintheirRulesSupplements.

(b) InInternationalRounds:ATeamwishingtopresentitsoralpleadingsattheInternationalRounds

in a language other than English must arrange to have its oral pleadings interpreted during the

InternationalRounds.Arrangementsforandcostsincurredinhiringinterpretersandprovidingrequired

equipment are the responsibility of the Team. A Team wishing to use interpreters must inform the

ExecutiveOfficeassoonasitknowsithasadvancedtotheInternationalRoundsand,inanyevent,nolater

than four weeks prior to the start of the International Rounds. Teams using interpreters may request

permissionfromtheExecutiveDirectortoextendtotalTeamoralargumenttimebeyondthe45minutes

allottedunderRule7.1.Themaximumextensionpermittedwillbe20minutesperOralRound.Theuseof

aninterpreterinoneOralRounddoesnotcommittheTeamtousinganinterpreterinlaterOralRounds.

Given that interpreters will be translating all arguments in a given Oral Round, any extension of time

grantedtoaTeamshallalsobegrantedtoitsopponent.AlljudgesandOralistsinanOralRoundinvolving

an interpreter should take the professional needs of the interpreter (for example, the need for clear

enunciation)intoaccountduringtheOralRound.

c) UseofTeamMembersasInterpreters:AmemberofaTeammayserveasaninterpreterforother

membersoftheTeamif:(a)heorshedoesnotactasanOralistinthesameOralRoundinwhichheorshe

isaninterpreter;and(b)heorshedoesnotsitatcounseltableduringtheOralRoundinwhichheorsheis

aninterpreter;and(c)heorshedoesnotcommunicatewiththeTeaminanywayduringtheOralRound,

excepttointerprettheoralpleadings.

d) Non-EmbellishmentbyInterpreters: WhenaTeamemploysaninterpreter,heorshemayrender

only a literal interpretation of the Oralists’ pleadings and the judges’ comments. No embellishment,

enhancement, or clarificationon thepart of the interpreter isallowed.ATeam that violates thisRule is

subjecttoforfeitureofallsixOralRoundPointsforthatOralRound.

7.15 AudioandVideotaping

Noaudiotapingorvideotapingoforalpleadingsispermittedwithouttheadvancepermissionoftheentire

panelofjudges,thetwoparticipatingTeams,andeithertheAdministratorortheExecutiveDirector.Inno

circumstancesmayparticipatingTeamsviewor listen to any videoor audiotapeof anOralRounduntil

afterthecompletionoftheCompetitioninwhichthetapedOralRoundtookplace.ILSAreservesallrights

totheaudiotapingandvideotaping,oranyotherformofaudioorvisualreproduction,ofanyOralRoundor

partthereof.AllTeamsparticipatingintheWorldChampionshipJessupCupRoundwillbedeemedtohave

consentedtothetapingandbroadcastingofthatOralRound.

7.16 AnonymityofTeamsinCourtrooms

DuringanOralRound,participantsmaynotdirectlyorindirectlyindicatetheircountryorschooloforigin

tothejudgesorbailiff, includingthroughthewearingofnametags,pins, logos,orothersignifiers,orthe

placementoffolders,files,librarybooks,orothermaterialsidentifyingtheirschooloncounseltable.For

thepurposesofthisRule,theterm“participants”includesTeamMembers,TeamAdvisors,andspectators

affiliatedwiththeTeam.

7.17 Computers,MobilePhones,andotherElectronicDevicesinCourtrooms

DuringanOralRound,Oralistsatthepodiumandparticipantsseatedatcounseltablemaynotoperate,for

any purpose, mobile phones, laptop computers, PDAs, or any other computing or electronic devices,

includingbutnotlimitedto thosewhichareinternet-enabledordata-capable,orhave instantmessaging

capabilities.Allsuchdevicesmustbeturnedoffandremovedfromsightassoonasthebailifffirstenters

thecourtroom,andmustremainoffandoutofsightuntiltheconclusionoftheOralRound.ATeamthat

violatesthisRulemayforfeituptosixOralRoundPoints;theAdministratorshalldetermineaPenaltythat

correspondstotheseverityoftheviolation.

7.18 TimekeepingDevicesintheCourtroom

Theofficial timeof thematch shall be indicatedby thebailiff.Nooneother than thebailiffmaydisplay

timecardsorotherwisesignaltotheOralisthowmuchtimeisleft.Teamsmayusesilentdigitaloranalog

watches at the podium or at counsel table. However, the use of any such device which, in addition to

keeping time, is capableof either (a) sendingor receivingdata to anotherpersonor to the Internet, or

(b)storingtextdata,shallbeprohibitedatcounseltableandatthepodiumasaviolationofRule7.17,even

ifsuchfunctionalityisturnedoff.

OFFICIALRULE8.0:QUALIFYINGCOMPETITIONPROCEDURES

8.1 PreliminaryRounds

EachTeamparticipatinginaQualifyingcompetitionshallparticipateinPreliminaryRoundsconsistingof

fourOralRounds,twiceasApplicantandtwiceasRespondent.IffourorfewerTeamsareparticipatingina

Qualifyingcompetition,theExecutiveDirectormaypermitfewerrounds,andtheAdministratorshallwork

with the Executive Director to decide an appropriate match schedule, pairing procedure, and scoring

system. Each Team shall, to the degree possible, face any opposing Team only once in the Preliminary

Rounds of a Qualifying competition. In the event that Teams must face each other in two Preliminary

Rounds,eachTeamshallpleadasApplicantinoneRoundandRespondentintheotherRound.

8.2 Pairings

The pairing of Teams for Preliminary Rounds shall be done, in the first instance, by a random draw.

PairingsandMemorialsofopposingTeamswillbedistributedtoTeamsonorpriortothefirstdayofthe

Qualifyingcompetition.TheAdministratormaymodifythepairingstoaccountforabsentTeamsorother

contingencies.IfTeamsmustbenewlypaired,theymustbeprovidedtheirnewopponents’Memorialsas

soonasreasonablypossible,butattheveryleast15minutespriortothestartofthenewly-pairedround.

8.3 QuarterfinalRounds

If16ormoreTeamsareparticipatinginaQualifyingcompetition,theAdministratormayholdQuarterfinal

Roundsconsistingoffourmatchesamongtheeighthighest-rankingTeamsfromthePreliminaryRounds.In

such Quarterfinal Rounds, the pairings shall be determined by “power-seeding” as follows: the eighth-

rankedTeamversusthefirst-rankedTeam,theseventh-rankedTeamversusthesecond-rankedTeam,the

sixth-ranked Team versus the third-ranked Team, and the fifth-ranked Team versus the fourth-ranked

Team.

8.4 SemifinalRounds

(a) IfQuarterfinalRoundshavebeenheld,thewinningTeamineachofthefourQuarterfinalRounds

shall advance to the Semifinal Rounds. In SemifinalRounds, the pairings shall be determined by use of

“power-seeding,” i.e., thehighest-rankedremainingTeamshallcompeteagainst the lowest-rankedTeam.

TherankingstobeusedwillbethefinalrankingsfromthePreliminaryRounds.

(b) InotherQualifyingRoundsofeightormoreTeams,theAdministratormayholdSemifinalRounds

among the four highest-ranking Teams from the Preliminary Rounds. In such Semifinal Rounds, the

pairings shall be determined by “power-seeding” as follows: the fourth-ranked Team versus the first-

rankedTeam;andthesecond-rankedTeamversusthethird-rankedTeam.

8.5 ChampionshipRounds

IfSemifinalRoundshavebeenheld,thewinningTeamineachofthetwoSemifinalRoundsshalladvanceto

the Championship Round. If Semifinal Rounds have not been held, then the top two Teams from the

PreliminaryRoundsshallcompeteagainstoneanotherinasingleChampionshipRound.Ineithercase,the

winneroftheChampionshipRoundistheNationalChampion.

8.6 PleadingOption

(a) Prior to the commencement of the Advanced Rounds, each competing Team will be given its

completedmasterTeamscoresheetfromthePreliminaryRounds,butnotindividualjudges’scoresheetsor

notes.

(b) In theQuarterfinalandSemifinalRounds, thehigher-rankingTeamfromthePreliminaryRounds

shallhavetherighttochoosewhichsideitwillargue.Thisrightiscalledthe“pleadingoption.”

(c) TheAdministratorshallchooseameansofrandomdecisionindeterminingthepleadingoptionfor

aChampionshipRound.Possiblemethodsinclude,butarenotlimitedto,thefollowing:

(i) Coin toss: A designated Team Member of the higher-ranking Team from the

PreliminaryRoundswillcallthetoss,andtheAdministratorwilltossthecoin.Ifthe

TeamMembercorrectlycallsthetoss,thenhisorherTeamwillhavethepleading

option. If that Team Member does not correctly call the toss, then the opposing

Teamwillhavethepleadingoption.

(ii) Rolling a Die: A designated TeamMember of the higher ranking Team from the

Preliminary Rounds will roll a 6-sided die. If the Team Member rolls an even

number,thenhisorherTeamwillhavethepleadingoption.Ifthenumberrolledis

odd,thentheopposingTeamwillhavethepleadingoption.

(iii) Drawing Lots: A designated TeamMember of the higher ranking Team from the

PreliminaryRoundswillselectapieceofpaperfromacontainer(e.g.,ahat,bag,or

box).Thepiecesofpaperwillsayeither“Yes”or“No”,andthereshallbeanequal

numberof piecesmarked “Yes” and “No.” If the TeamMember selects apieceof

paper saying “Yes,” his or her Teamwill have the pleading option. If the piece of

papersays“No,”thentheopposingTeamwillhavethepleadingoption.

Administrators may also use any reasonable alternate random method to determine pleading

optioninaChampionshipRound.

(d) TheTeamwiththepleadingoptionhastenminutestodecidewhichsideitwishestoplead.Ifthat

Team fails to select, then the opposing Team has five minutes to do so. If the opposing Team fails to

exerciseitspleadingoptionwithinafive-minuteperiod,italsoshallforfeititspleadingoption.Shouldboth

Teams fail to select, then thehigher-rankedTeamwill argueApplicantand the lower-rankedTeamwill

argueRespondent.

(e) Oncethesideshavebeendetermined,theAdministratorwill immediatelynotifybothTeams.The

Administrator will give each Team the appropriate Memorial of its opponent. The Teams will then be

grantedareasonabletimetopreparefortheOralRound.

8.7ComplaintsRegardingConductofaQualifyingRound

(a) GeneralProcedure.ATeammaysubmitacomplaint to theExecutiveDirectorconcerningoneor

moreviolationsoftheOfficialRulesthatitallegesmateriallydepriveditofanopportunitytoadvancetothe

InternationalRounds.SuchcomplaintmustbesubmittedtotheExecutiveDirectorandtheAdministrator

viaelectronicmailnolaterthan48hoursaftertheconclusionoftheQualifyingRound.ATeam’sallegation,

howeverwellsupported,thatthejudgesinagivenOralRoundreachedthewrongconclusioncannotbethe

basisforacomplaint.

(b) RequiredContentsofaComplaint.Acomplaintmustincludethefollowinginformation:

(i) theTeamnumber,school,andcontactinformationofthecomplainingTeam;

(ii) thespecificfactsconstitutingtheallegedviolation(s);

(iii) a description of how the violation(s)materially deprived the team of an opportunity to

advancetotheInternationalRounds;and

(iv) theidentitiesandcontactinformationofanywitnessestotheviolation(s).

(c) ProhibitiononDiscussionofComplaint.UnlessdirectedtodosobytheExecutiveDirector,aTeam

shallnotdiscussitscomplaintwithanyjudgesorotherwitnessestotheallegedviolation(s)untilafterthe

finaldecisiononthecomplaintisdeliveredbytheExecutiveDirector.

(d) ExhaustionofLocalRemedies.If,atthetimeaviolationoccurs,aTeamthatisawareoftheviolation

fails tobring it to theattentionof theAdministrator,and if suchviolationcouldhavebeenremediedby

promptactionoftheAdministrator,theTeamshallhavewaivedanycomplaintbaseduponthatviolation.

(e) Standing. Only a Team claiming that, as a result of a violation, it wasmaterially deprived of an

opportunitytoadvancetotheInternationalRoundsshallhavestandingtofileacomplaintbaseduponthat

violation.AnyotherallegationsofviolationsshallbetreatedascommentsorsuggestionsunderRule8.7(h).

(f) Investigation of Complaints. The Executive Director will promptly investigate a complaint. Such

investigationwillfocusonwhethertheallegedviolationactuallyoccurredand,ifso,whethertheviolation

materiallydeprivedtheTeamofanopportunitytoadvancetotheInternationalRounds.Suchinvestigation

may entail discussions with the Administrator, judges, other Teams, and interested and disinterested

observers.Evenwhenitisdeterminedthataviolationoccurred,theExecutiveDirectormayconcludethat

theviolationdidnotmateriallydeprivetheTeamofanopportunitytoadvancetotheInternationalRounds.

(g) Remedy.IftheExecutiveDirectorconcludesthataviolationoccurredandmateriallydeprivedthe

complainingTeamof anopportunity to advance to the InternationalRounds, heor she shall impose an

appropriateremedy,includingbutnotlimitedto:overrulingtheresultsofoneormoreAdvancedRounds;

changingtheTeamdeclaredasthewinneroftheRound;invitingoneormoreadditionalTeamstoattend

the InternationalRoundsasadditionalrepresentativesof thecountryorregion inquestion;or issuinga

formalapologytothecomplainingTeam(s).

(h) No Prohibition on Constructive Suggestions. Teams are encouraged to offer suggestions to the

AdministratorortheExecutiveDirectorfortheimprovementoftheCompetition.Suchsuggestionsshallbe

promptly acknowledged, although for reasons of expediency, theymay not be addressed until after the

conclusionoftheInternationalRounds.

OFFICIALRULE9.0:INTERNATIONALPAIRINGPROCEDURES

9.1 Representation

All Representatives approved for that purpose by the Executive Director are eligible to compete in the

InternationalRounds.

9.2 PreliminaryRounds

ThePreliminaryRoundsoftheInternationalRoundsconsistoffourOralRounds.EachTeampleadstwice

asApplicantandtwiceasRespondent.

9.3 PairingsforthePreliminaryRounds

(a) The Executive Director shall establish the pairings for the Preliminary Rounds, in the first instance, by a

random draw. The Executive Director may modify the draw to ensure geographical and competitive diversity and

balance (including with reference to the total International Rounds Memorial scores of the competing Teams), or

otherwise in the best interests of the Competition.

(b) PairingsfortheInternationalRoundsandtheMemorialsofopposingTeamswillbedistributedto

TeamsonorpriortothefirstdayoftheInternationalRounds.

(c) TheExecutiveDirectormaysubsequentlymodifythepairingstoaccountforabsentTeamsorother

unforeseeable contingencies. In such case, the ExecutiveDirectorwill notify affected Teamsanddeliver

theiropponents’Memorialsassoonaspossible.

9.4 ReligiousSchedulingConflicts

No later than fourweeksprior to thePreliminaryRounds,Teamsmustnotify theExecutiveDirector in

writing of any potential schedule conflicts owing to religious observances or similar concerns. The

ExecutiveDirectorwillmakeeveryefforttomakeappropriateaccommodations.

9.5 InternationalRun-Off,Octofinal,andQuarterfinalRounds

The Advanced Rounds of the International Rounds consist of the International Run-Off Rounds, the

InternationalOctofinalRounds,theInternationalQuarterfinalRounds,theInternationalSemifinalRounds,

and the World Championship Round. Subject to Rule 9.8, the 32 highest-ranked Teams from the

PreliminaryRoundsshallparticipateintheAdvancedRounds.

9.6 InternationalRun-OffRounds

The International Run-Off Rounds consist of 16 pairings of the 32 highest-ranked Teams from the

PreliminaryRounds,subjecttoRule9.8.

9.7 InternationalOctofinalRounds,QuarterfinalRounds,SemifinalRounds,andWorld

ChampionshipJessupCupRound

TheInternationalOctofinalRoundsconsistofeightpairingsofeachofthe16Teamsthatwinsamatchin

theInternationalRun-OffRounds.TheInternationalQuarterfinalRoundsconsistoffourpairingsofeachof

the eight Teams that wins a match in the International Octofinal Rounds. The International Semifinal

Rounds consist of two pairings of each of the four Teams that wins a match in the International

Quarterfinal Rounds. The two winning Teams from the International Semifinal Rounds advance to the

WorldChampionshipJessupCupRound.

9.8 NationalRepresentationLimitation

Nomore than eight Teams from one nationmayadvance to the Advanced Rounds of the International

Rounds. Ifmore thaneightTeams fromonenationplace among the32highest-rankedTeams from the

Preliminary Rounds, only the eight highest-ranked Teams from that nation may advance. If after the

applicationofthisRule,therearefewerthan32TeamseligiblefortheAdvancedRounds,thenexthighest-

rankedTeam(s)thatdidnototherwisequalifyfortheAdvancedRoundsshallbeaddeduntilthenumberof

Teamsequals32.ThissubsequentadditionshallalsobesubjecttothisRule9.8.

Example:IfnineTeamsfromthenationofErewhonqualifyfortheInternationalRun-OffRounds,theninth-

ranked Erewhon Team shall not advance to the Advanced Rounds. The 33rd ranked Team from the

PreliminaryRoundsshallbeaddedtotheAdvancedRounds,unlessthatTeamisalsofromErewhon.Insucha

case,thenext-highest-rankedTeamnotdisqualifiedbythisRulewouldadvance.

9.9 PairingsfortheInternationalAdvancedRounds

ThepairingsintheInternationalRun-Off,Octofinal,Quarterfinal,andSemifinalRoundsshallbedetermined

byuseof“power-seeding,”i.e.thehighest-rankedTeamshallcompeteagainstthelowest-rankedTeam;the

second-highest-rankedTeamshallcompeteagainst thesecond-lowest-rankedTeam,etc.Forpurposesof

thisRule,allrankingsshallbedeterminedbythefinalstandingsofthePreliminaryRounds. 9.10 PreviousMeetingQualification

If application of the pairing protocols would result in a Team facing an opponent that it faced in the

InternationalPreliminaryRounds,theExecutiveDirectorwilladjustthepairingsinanequitablemannerin

orderthatsuchpairingisavoided.IftheExecutiveDirectordeterminesthat,withrespecttoagivenpairing,

no adjustment is possible, the Executive Director may disregard this qualificationwith respect to such

pairing.

9.11 NationalPair-OffQualification

(a) IfeightTeamsfromagivennationadvancetotheOctofinalRounds,thefirst-rankedTeamshallbe

paired against the eighth-ranked Team, the second-ranked Team against the seventh-ranked Team, the

third-ranked Teamagainst the sixth-ranked Team, and the fourth-ranked Teamagainst the fifth-ranked

Team. All Teams not affected by this qualification shall then be paired according to the general pairing

Rules.

(b) IfsevenTeamsfromagivennationadvancetotheOctofinalRounds,thesecond-rankedTeamshall

bepairedagainsttheseventh-rankedTeam,thethird-rankedTeamagainstthesixth-rankedTeam,andthe

fourth-rankedTeamagainstthefifth-rankedTeam.AllTeamsnotaffectedbythisqualificationshallthenbe

pairedaccordingtothegeneralpairingRules.

(c) IfsixTeamsfromagivennationadvancetotheOctofinalRounds,thethird-rankedTeamshallbe

paired against the sixth-ranked Team, and the fourth-ranked Team against the fifth-ranked Team. All

TeamsnotaffectedbythisqualificationshallthenbepairedaccordingtothegeneralpairingRules.

(d) If fiveTeams fromagivennationadvance to theOctofinalRounds, then the fourth-rankedTeam

shall be paired against the fifth-ranked Team. AllTeams not affected by this qualification shall then be

pairedaccordingtothegeneralpairingRules.

(e) IffourTeamsfromagivennationadvancetotheQuarterfinalRounds,thefirst-rankedTeamfrom

suchnationshallbepairedagainstthefourth-rankedTeamfromsuchnation,andthesecond-rankedTeam

shall bepaired against the third-rankedTeam.AllTeamsnot affectedby this qualification shall thenbe

pairedaccordingtothegeneralpairingRules.

9.12 PleadingOptionintheInternationalRounds

(a) PriortothecommencementoftheInternationalAdvancedRounds,theExecutiveDirectorwillgive

eachcompetingTeamacopyofitscompletedTeammasterscoresheet.

(b) TheExecutiveDirectorshallchooseameansofrandomdecisionindeterminingthepleadingoption

fortheAdvancedRounds.Possiblemethodsinclude,butarenotlimitedto,thoselistedinRule8.6(c).

(c) TheTeamwiththepleadingoptionmustselectwhichsideitwillarguewithintenminutes.Ifthat

Teamfailstomakeaselection,theotherTeammustselectwhichsideitwillarguewithinfiveminutes.If

that Team fails tomake a selection, then the higher-ranked Team shall argue Applicant and the lower-

willbearguingandwilldelivertoeachTeamonecopyofitsopponent’sMemorial.BothTeamsshallthen

haveareasonableamountoftimetopreparefortheOralRound.

10.5 RoundPoints

(a) MemorialRoundPoints:Ineachmatch,atotalofthreeRoundPointswillbeawardedbasedona

comparison of the highest, middle, and lowest scores on Memorials. If four-judge panels are used to

evaluateMemorials,thescorefurthestfromthemeanwillbediscardedandthethreeremainingscoreswill

beusedastheMemorial’shighest,middle,andlowestscores.TheMemorialstobecomparedcorrespondto

thesidethattheTeamarguedinthatmatch(inotherwords,thescoresoftheApplicantTeam’sApplicant

Memorials are compared with the scores of the Respondent Team’s Respondent Memorials). For each

comparison,theTeamwiththehigherscoreisawardedoneRoundPoint.Hence,thehighestscoregivenby

amemorialjudgeforoneTeamiscomparedtothehighestscoregiventheotherTeam,andoneroundpoint

isawardedtotheTeamwiththehigherofthesescores.Similarly,thetwomiddlescores,andthenthetwo

lowestscores,arecomparedtodeterminewhichTeamreceivesthesecondandthirdroundpoints.Ifinany

suchcomparisonthetwoTeams’scoresareequal,eachTeamisawardedone-halfofaRoundPoint.

(b) OralRoundPoints:Ineachmatch,atotalofsixRoundPointsareawardedbasedonacomparison

ofcombinedoralargumentscores.Foreachjudge,thesumofthejudge’sscoreforApplicant’stwoOralists

iscomparedtothesumofthejudge’sscoresforRespondent’stwoOralists.Foreachjudge,theTeamwith

thehighestcombinedoralistscoreisawardedtwoRoundPoints.Ifinanysuchcomparison,thetwoTeams’

scoresareequal,eachTeamisawardedoneRoundPoint.

(c) Total Round Points: In each Round, a Team’s Total Round Points is the sum of the Team’s

MemorialRoundPointsandOralRoundPoints.

10.6 Two-JudgePanels

If only two judges score a givenMemorial ora givenOralRound, theAdministrator shall create a third

scoreandscoresheetbyaveragingthescoresofthetwojudges.

10.7 DeterminingtheWinnerofaPreliminaryRoundMatch

Inanygivenmatch,theTeamreceivingmoreofthenineavailableRoundPointswinsthematch.Ifthetwo

Teamseachreceive4.5RoundPoints,theTeamwiththehigherTotalRawScorewinsthematch.Ifthetwo

TeamshaveanequalnumberofRoundPointsandanequalTotalRawScore,thematchisadraw.

10.8 PreliminaryRoundRankings

(a) TeamsshallberankedbynumberofwinsinthePreliminaryRounds,fromhighesttolowest.

(b) IftwoormoreTeamshavethesamenumberofwins,theTeamhavingthehighernumberofdraws

shallberankedhigher.

(d) If twoormoreTeamshave the samenumberofwins, the samenumberof drawsand the same

Total Competition Raw Score, the Team with the higher Total Competition Round Points from the

PreliminaryRoundsshallberankedhigher.

10.9 Tie-BreakingProcedure

IftwoormoreTeamsaretiedafterapplicationofRule10.8,andtheoutcomeofthedeterminationdoesnot

affect (a) anyTeam’s entry into theAdvancedRounds, or (b) thepairingof anyTeams in theAdvanced

Rounds of the competition, the Teams shall be ranked equally. If, however, further determination is

necessarytodetermineadvancementorpairings,therankingsshallbeaccomplishedasfollows:

(a) IfonlytwoTeamsaretiedandifthetiedTeamshavefacedeachotherinthePreliminaryRounds,

thewinnerofthatmatchshallberankedhigher.

(b) IfonlytwoTeamsaretiedandtheTeamshavenotfacedeachotherinthePreliminaryRounds,the

Administratorshallbreak the tieaccordingto thefollowingmethods,startingwiththe firstandworking

downonlyifthepriormethoddoesnotbreakthetie:

(i) the Team with the higher total Oralist and Memorial score average wins, calculated by

adding theTeam’sTotalCompetitionOralRawScoredividedby24and theTeam’sTotal

CompetitionMemorialRawScoredividedbysix;

(ii) theTeamwhoseopponentswonmorematcheswins,calculatedbyadding thenumberof

winsof theTeams’opponentsand forthispurposeonly,countingadrawasone-halfofa

win;

(iii) theTeamwinswhoseopponentsscoredhigher,calculatedbyaddingtheTotalRawScores

oftheTeams’opponents;

(iv) theTeamwiththehighertotaloralistscoreaveragewins,calculatedbydividingtheTotal

CompetitionOralRawScoreby24;or

(v) theAdministratordeterminesamethodtobreakthetie,takingintoaccounttheinterestsof

theTeamsandtheCompetitionasawhole.

10.10 ScoringProceduresforAdvancedRounds

The following scoring procedures and guidelines shall apply to Advanced Rounds of Qualifying or

Internationalcompetitions.

(a) QualifyingRounds.

JudgesofAdvancedRoundsofeachQualifyingcompetitionshallmakeanindependentreviewoftheTeam

Memorialsandoralarguments,takingbothintoaccount,althoughtheyneednotgiveanyparticularfixed

weighttoeitherMemorialsororalarguments.TheAdministratorshallprovideaPreliminaryRoundOral

Scoresheettothejudgestouseattheirdiscretion.ThedecisionregardingthewinneroftheRoundshallbe

bymajorityvoteofthejudges.Notiesareallowed.

(b) InternationalRun-Off,Octofinal,QuarterfinalandSemifinalRounds

IneachmatchintheInternationalRun-Off,Octofinal,QuarterfinalandSemifinalRounds,scoringforeach

pairingshallbeconductedaccordingtothisRule.JudgesmustkeepsecretfromallTeamstheexactscorein

eachpairing,andeachjudge’sdetermination;onlytheidentityofthewinningTeamshallberevealed.

(i) Three judges shall read the Applicant Memorial of the Team arguing Applicant and the

RespondentMemorial of the Team arguing Respondent. The TeamwhoseMemorial each judge

determinesissuperiorwillreceiveonepoint.IfajudgedeterminesthatthetwoMemorialsareof

equal quality, each Team will receive one-half point. Thus, three points are allocated by the

Memorialsjudges.PenaltiesfromthePreliminaryRoundsshallnotapplyintheAdvancedRounds.

(ii) Three judges shall sit for the Oral Round. The Team whose presentation each judge

determinesissuperiorwillreceivetwopointsfromthatjudge.Ifa judgedeterminesthatthetwo

oralpresentationswereofequalquality,eachTeamjudgewillreceiveonepoint.Thus,sixpointsin

aggregateareallocatedbytheoral-roundjudges.

(iii) The winner of the match is the Team with the greater of the nine points allocated by

MemorialsandOralRoundjudges.

10.11 MethodofScoring–WorldChampionshipJessupCupRound

JudgesoftheWorldChampionshipJessupCupRoundshallfollowtheguidelinessetoutinRule10.10(a)for

determiningthewinneroftheJessupCup.

10.12 RankingofOralists

Individual Oralists shall be ranked from highest to lowest average oral score by the Administrator. An

Oralist’saverageoralscoreistheaverageofthescoresawardedtothatindividualbyeachjudgeduringthe

PreliminaryRounds,excludingthesinglelowestscoreawardedtotheOralist.Ifanoralistarguedinonly

onePreliminaryRound,heorsheisnoteligibleforranking.IftwoormoreOralistsaretiedforpurposesof

Awards,theExecutiveDirectorshallbreakthetiebycomparingaverageoralscoreswithoutexcludingthe

singlelowestscoreawardedtoeachOralist.

Example:LucyarguedintwoPreliminaryRounds.Inherfirstappearance,thethreejudgesawardedhera90,

an 85, and an 81.In her second appearance, the three judges awarded her an 89, an 85, and an 80. In

determining her average oral score, the Administrator would disregard the 80 she received in the second

Round(herlowestmark).Soherscorewouldbethesumofherotherfivescores(430),dividedbythenumber

ofjudgeswhosescoreswerecounted(5),foranaverageoralscoreof86.0.

10.13 RankingofMemorials

Total Memorial scores for each Team shall be determined by adding the Total Raw Score of a Team’s

ApplicantMemorialandtheTotalRawScoreoftheRespondentMemorial,foratotalofsixjudges’scores.

TeamMemorialsshallberankedbytheAdministratorfromthehighestTotalMemorialscoretothelowest.

Tiesarepermitted.ScoresshallbeadjustedforPenaltiesperRule11.0.

10.14 ReportingofResults

Aftertheconclusionofeachcompetition,eachparticipatingTeamshallreceivethefollowing:

(a) acopyofindividualMemorialjudges’scoresheetswithcomments,ifany;

(b) a copy of individual Oral Round judges’ scoresheets and Penalties, if any, with

attendantcomments,ifany,fromPreliminaryRoundsofthecompetition;

(c) acopyoftheOverallRankingsofthePreliminaryRounds,withtheTotalWin-Loss

records,OverallRawScores,andOverallRoundPoints;

(d) acopyoftheOralistRankingsfromthePreliminaryRounds;

(e) acopyoftheMemorialRankingsfromthePreliminaryRounds;and

(f) asummaryoftheAdvancedRoundsofthecompetition.

OFFICIALRULE11.0:PENALTIES

11.1 MemorialPenalties

(a) MemorialPenaltiesmaybeimposedbytheAdministratorandshallbedeductedfromeachofthe

individualjudges’scoresonaTeam’sMemorial.IntheeventthataMemorialisscoredbyonlytwojudges

underRule10.6,penaltiesshallbededucted fromeachof the two judges’scoresprior tocalculating the

thirdscore.

(b) TheminimumadjustedrawscorethatanyTeammayreceivefromanyindividualMemorialjudgeis

50points.Nofurtherreductionmaybemadetoscoresaftertheminimumscoreisreached,regardlessof

unallocatedPenaltypointsremaining.

(d) TheAdministratorshallnotifyallaffectedTeamsofimposedPenaltiespriortothefirstPreliminary

Round,andshallincludewithsuchnotificationareasonabledeadlineforanyappealsfromthedecisionto

impose Penalties. A Team may appeal any Penalty imposed against its Memorials by completing the

appealsformlocatedontheTeamHomepage.TheExecutiveDirectorshalldecideuponthevalidityofany

appeal from the imposition of a Penalty by the Administrator. No further appeal is available from this

decisionoftheExecutiveDirector.

(e) Penalties shall be assessed for violations of the Rules concerningMemorials by reference to the

followingtable:

11.2 Plagiarism

Teamsshallnotcommitplagiarism.“Plagiarism”meanstheactofappropriatingtheliterarycompositionof

another,orpartsorpassagesofanother’swritings,ortheideasorlanguageofanother,andpassingthem

offas theproductofone’sownmind.After investigationandreview, inaverifiedcaseofplagiarism,an

Administrator shall assess a Penalty between one and 50 points to each offendingMemorial, with the

Directormaydooneorbothofthefollowing:(1)disqualifytheTeam;(2)notifytheTeam’sdeanand/or

otheruniversityofficial(s)oftheresultsoftheExecutiveOffice’sinvestigation.

11.3 OralRoundPenalties

The Administrator shall impose an Oral Round Penalty only when he or she is satisfied that an event

subjecttosuchPenaltyhasoccurred,ifnecessaryafterconsultationwiththejudges,bailiff,Teams,and/or

spectators.

11.4 ComplaintProcedure

(a) IfaTeambelievesthataninfractionoftheRuleshasoccurredduringanOralRound,theTeammay

notifythebailiff inwritingwithin fiveminutesof theconclusionof thatOralRound. Ifthere isnobailiff,

Teamsmust approach theAdministratorwith complaints.Writtennotification shall clearlydescribe the

alleged violation and the parties involved. Teams shall not directly approach the judges regarding a

violationoftheseRules.Whenpossible,themattershouldberaisedwiththebailiffoutsidethepresenceof

the judges. Failure by any Team to follow the procedures described in this paragraph shall result in a

waiveroftheTeam’scomplaint.

(b) IfajudgebelievesthataninfractionhasoccurredduringanOralRound,heorsheshallnotifythe

bailifforallyorinwritingwithinfiveminutesafterthecompletionoftheOralRound.Whenpossible,the

mattershouldberaisedwiththebailiffoutsidethepresenceoftheotherjudges.

11.5 DeductionofPenaltiesbyJudgesProhibited

PenaltypointsmaybedeductedonlybytheAdministrator.Innoinstanceshalljudgesthemselvesdeduct

any Penalty points from the scores of the oralists. Judges shall score the Oral Round as if no violation

occurred,andmaytakeaninfractionintoaccountonlyifsoinstructedbytheAdministrator.

11.6 ActivitySubjecttoOral-RoundPenalties

Penaltiesmay be assessed for violationsduring anOral Round by reference to the following table. The

AdministratorshalldeductthePenaltyamountfromeachjudge’scombinedscore(thesumofthejudge’s

scoreforOralist1andOralist2)beforedeterminingtheOralRoundPoints.

eitherTeammayappealtotheExecutiveDirector.Ifanappealissubmitted,theAdministratorshallconsult

withtheExecutiveDirectorinresolvingit.TheExecutiveDirector’sdecisiononallappealsisfinal.

11.8 DiscretionaryPenalties

(a) In addition to the Penalties listed in Rule 11.6, the Administrator may assess up to 15-point

DiscretionaryPenaltiesforotherviolationsoftheletterorspiritoftheseRules.ThesizeofthePenaltyshall

correspondtothedegreeoftheviolationinthejudgmentoftheAdministrator.DiscretionaryPenaltiesmay

be imposeduponaTeam for conduct of itsTeamMembersorof personsaffiliatedwith theTeam. Such

violationsmayinclude:

(i) poorsportsmanship;

(ii) submittingmultiplefrivolouscomplaintsagainstotherTeams;

(iii) inappropriatebehavioratthecounseltableduringtheOralRounds;

(iv) blatantdisregardfortheproceduresorrequirementsoutlinedintheRules.

(b) Serious breaches of sportsmanship, for example, inappropriate ex parte communications with

competition judges either before or after amatchmay, at the sole discretion of the Executive Director,

resultinaTeambeingdisqualifiedfromtheCompetition.

11.9 DeMinimisRule

TheAdministratormaywaiveorreducethepenaltyforademinimisRuleviolation.

Cup ingood condition to theExecutiveDirectorbefore thenext year’s InternationalRounds.TheWorld

ChampionshipTeamisresponsibleforengravingitsschoolnameontheJessupCup.

12.2TheHardyC.DillardAward

TheHardyC.DillardAwardispresentedtoTeamsforexcellenceinMemorialwriting.TheMemorialsofthe

Team with the highest Total Memorial Scores in any Qualifying Competition shall be entered, without

furtheractionbytheTeam, tocompete fortheHardyC.DillardAward.Eachentry fortheDillardAward

shallbescoredbyapanelofthreeor four judges. If three-judgepanelsareused,allthreescoreswillbe

usedtodeterminerawMemorialscores.Iffour-judgepanelsareused,thescorethatisfurthestfromthe

meanwill be discarded and the three remaining scores will be used to calculate rawMemorial scores.

AwardswillbepresentedtothetopfiveTeams,basedonrawMemorialscores,unadjustedforpenalties.

TheExecutiveOfficeshallassignnewTeamNumbers tobeusedon thecoversofMemorials inorder to

preserveanonymity.

12.3 TheAlonaE.EvansAward

TheAlonaE.EvansAward ispresented toTeams forexcellence inMemorialwritingatthe International

Rounds. Awards will be presented to the top twenty Teams based on Total Memorial Scores in the

InternationalRounds.

12.4TheRichardBaxterAwards

The Richard Baxter Awards are presented to Teams for excellence in Memorial writing by comparing

individualApplicantandRespondentMemorials.TheApplicantandRespondentMemorialsofTeamsthat

receiveanAlonaE.EvansAwardoraHardyC.DillardAwardareenteredintocompetitionfortheBaxter

Awards.TherearetwoBaxterAwards:onefortheBestOverallApplicantMemorialandonefortheBest

OverallRespondentMemorial. TheBestApplicantandBestRespondentMemorials shall bepublished in

thecorrespondingyear’sissueoftheILSAJournalofInternational&ComparativeLaw.

12.6 OtherAwards

In each Competition, the Administrator shall make arrangement for appropriate recognition of the

following: Teams that receive the top Total Memorial Scores, highest ranked oralists, and Teams that

advancetotheAdvancedRounds.TheBoardofDirectorsmaybyresolutionprovideforotherawards,such

asBestOralistat theFinalRounds,BestNationalAdministrator, andother categories as theBoardmay

fromtimetotimeseefit.
