Tender Appendix A - Scope of Services

1) INTRODUCTION

i) Tender for Manpower Supply for Cleaning, Housekeeping, Gardening, Landscape and Grass Cutting Works Year 2014/2015 at Murum Hydroelectric Plant.

ii) Murum Hydroelectric Plant (MHEP) is a fully owned subsidiary of Sarawak Energy Berhad, is a hydropower plant that generates electric power with total installed capacity of 944MW and located about 280km away from Bintulu city of Sarawak and can be easily accessed by proper tar sealed road.

iii) Location of the work: Belaga, 97008, Bintulu, Sarawak. iv) Closing date and time: 12.11.2014 at 3.00pm. v) Person of Contact: Mr. Mohd Narzam (013-818 7654). vi) The Tenderer is invited to visit the site to ascertain the nature and method of

service and maintenance, security arrangement and working conditions. No additional claims will be entertained for the lack of knowledge of the sites and conditions under which the work is to be executed. Such visit shall be made on application to Assistant Operation Manager, Mr. Mohd Narzam (013-818 7654).

2) DEFINITION OF TERMS In this specifications, the terms

i) MHEP - shall mean Murum Hydroelectric Plant. ii) SEB - shall mean Sarawak Energy Berhad. iii) The Tenderer shall mean the qualified service provider. iv) Tender submission shall mean the submission of all required tender documents

including the complete filling out and submission of all schedules in this tender document to reach SEB on or before the tender closing date.

v) The Contractor - shall mean the successful Tenderer who has been offered the contract to perform all the works in this contract.

vi) Completion shall mean the completion of the manpower supply as specified in this contract with acceptable condition.

vii) The contract period is one (1) year and maybe extended subject to satisfactory performance

3) TENDER AWARD The tender shall be awarded to local Malaysian Contractor who has submitted the best offer through its tender submission. The Tenderer shall acquired the following qualification and experience

i) Agreed to all the terms and conditions specified by SEB in this specifications. ii) Please be informed that the Company is practising "Preference to Bumiputra

Companies" in accordance with Sarawak Energy Procurement Procedures And Policies. To enjoy such preference, submission of Bumiputra Status Certification in your tender submission is required.

iii) SEB is not bound to accept the lowest or any other tender. iv) Contract period may be extended based on the contractor performance evaluation

conducted by Sarawak Energy Berhad. v) No amendment will be entertained after the submission of the tender. vi) Evaluation of the contractor based on Sarawak Energy Berhad Procurement Policies

and Procedure (PPP)

4) SCOPE OF WORK The scopes of work is to supply manpower to Murum Hydroelectric Plant for performing the following works

i) Cleaning and housekeeping The details of works, frequency and working area are specified in Appendix A.1

ii) Gardening, landscape and grass cutting The details of works, frequency and working area are specified in Appendix A.2

iii) Any other General Works which may require upon request or special occasion from time to time such as prepare beverages and light snacks for meeting, visitors, food serving during special function etc.

iv) The quantity of manpower tabulated in Appendix A.1 and Appendix A.2 are an estimated figure only. The quantity figure may differ from the tabulation depended upon request by SEB based on the site workload demand and the manpower hourly/monthly rate shall remain the same.

5) CRITERIA FOR THE MANPOWER

i) Age: 18 year and above ii) Free from any criminal record iii) Have the ability to communicate clearly among the worker iv) The ratio of male and female worker is justified according to types of work such as

outdoor works, toilet cleaning works etc.

v) The Tenderer is strongly encouraged to employ as many as possible the local people from Tegulang and Metalun resettlements and also surrounding villages as part of employment opportunity initiative for local people.

6) CONTRACTOR’S RESPONSIBILITIES AND OBLIGATIONS

i) The Contractor upon receiving official confirmation of the award of the contract from SEB, shall within 2 weeks or any agreed period, to mobilize his work force and commence the work.

ii) The Contractor shall be fully responsible to ensure his/her workers comply and carrying out the whole works in line with the company rules and regulations, Environment, Occupational Safety and Health policies as well as any by-laws as amended from time to time, guidelines and requirements made by any public, statutory and government agencies relevant to the Environment, Occupational Safety and Health aspects of the site and other related issues thereto.

iii) The Contractor shall take all reasonable precautions to prevent personal injury or death

of any person whomsoever, arising out of, in the course of or as caused by the execution of the works and shall be solely liable for, and indemnify the SEB in respect of any loss, liability, claim or proceedings whatsoever arising under the ordinance or at common law in respect of such injury or death, unless due to any act or negligence done by the SEB or of any person to whom the SEB is responsible for.

iv) The Contactor shall be responsible to ensure his/her workers are sufficiently covered by

the workmen compensation scheme or its equivalent and the cover note together with receipt of premium paid or the registration numbers under the Employee’s Sosial Security (SOCSO) Scheme to be submitted as soon as practicable but before commencement of the works to the SEB.

v) The Contactor shall be responsible to ensure his/her workers are registered as a

member of the Employees Provident Fund (EPF) and making the compulsory contribution in accordance with Employees Provident Fund Act 1991.

vi) The Contractor shall ensure that the manpower supplied must perform up to the

expectation of SEB in-charge personnel in respect of safety awareness, workmanship, cooperativeness and productivity.

vii) The Contractor shall provide company uniform for all the worker and the worker shall

wear the uniform all the time when in SEB premises.

viii) The Contractor shall provide the PPE to their workers for the working area that require safety PPE such as Power House and Ecological Power Station.

ix) The Contractor shall fulfill the quantity of manpower requested by SEB. In the event of

the urgent cases or extra work is required, the Contractor shall be able to immediately supply additional man power within 24 hours.

The Contractor shall have a team of workers with minimum of one (1) supervisor and other general workers to perform the works under this contract. The supervisor shall be a site contact person concerning to activities and works under this contract, shall supervise and arrange the works, to ensure the workers carry out their duties accordingly in respect of safety awareness, workmanship, cooperativeness, and productivity and comply with SEB’s rules and regulations. The management personnel are required to do random check on site to inspect the work quality and cleanliness standard and their workers performance.

The organization chart, name list of the team and contact number shall be submitted to SEB for approval two weeks before the commencement of the work. The Contractor must inform SEB if there is any change in their work force by submitting a new name list. SEB reserves the right to remove or reject any Contractor’s workers from site if his/her was found not complying with the conditions as set out in this contract and the Contractor shall replace without any additional charges or claims to SEB.

x) The working hours shall be from 8:00 a.m. to 5:00 p.m. for Monday to Friday. The Contractor is responsible to arrange work for his workers properly so that each of the specified areas that require to be cleaned is actually cleaned based on the cleaning interval. Working beyond the prescribed working hours is not allowed unless instructed by the SEB.

xi) The Contractor shall provide punch card or thumb print for the manpower attendant list report purposes. Contractor manpower’s are prohibited to use all the punch card or thumb print belongs to SEB.

xii) The Contractor shall provide its own transport to ferry its own workers to work site. The

Contractor shall also make its arrangements and bear the costs of providing accommodation to its workers. Similarly, the provision and costs of meals shall also be the responsibility of the Contractor.

7) DURATION OF CONTRACT The Contractor shall undergo an initial trial period of three (3) months and during the three (3) months period the performance and capability of the Contractor will be assessed by the SEB. If the performance and capability of the Contractor are satisfactory after the three (3) months period, the Contractor shall serve the SEB for full duration of contract period. However, if Contractor fails to meet the SEB’s requirement, the Contractor shall be served with termination letter. The Contract shall be valid for a period of one (1) year with effect from the offer date. At the end of the one (1) year period, the contract may be renewed annually, subject to maximum of 3 years and the services are deemed satisfactory by the SEB with a written request by the Contractor for renewal.

However, the SEB reserves the right to terminate the Contract if the work and services provided by the Contractor still remain as unsatisfactory upon the issuing of three (3) written notifications from the SEB to the Contractor indicating in details all aspects of unsatisfactory work and upon failure on the part of the Contractor to make any improvement during a reasonable period of not less than three (3) months. Under such circumstances, the SEB is not liable to pay or to compensate the Contractor any form of losses suffered as a result of such termination.
