DBE PARTICIPATION GOAL

Participation goals must be met with DBE certified participants as set forth in 49 CFR §26.55 or through the demonstration of a good faith effort under 49 CFR §26.53.

Proposers must complete and submit at the time of the submittal due date: Commitment to DBE Participation Form; identifying the percentage of DBE

utilization the Bidder is committed to, Letter(s) of Intent; completed in full, signed by both the Bidder and DBE sub(s) Form 1A – List of Proposed Subcontractors, Subconsultants, and/or Suppliers

COUNTING PARTICIPATION FOR SUPPLIERS

If the materials or supplies are obtained from an DBE:

Manufacturer, count 100% of the cost of the materials or supplies toward DBE goals.

Regular dealer, count 60% of the cost of the materials or supplies toward DBE goals.

Packager, broker, manufacturers' representative, or other persons who arrange or expedite transactions, count the entire amount of fees or commissions charged.

Additional information about counting DBE participation can be found in the IFB and Section 26.55 of the Code of Federal Regulations (CFR)

Ordinances

• Denver Prevailing Wage Ordinance (D.R.M.C. Sections 20-76 and 20-77) applicable to employees performing construction, alteration, improvements, repairs, maintenance or demolition of any city-owned or leased building or city-owned land

• Denver City-Wide Minimum Wage (D.R.M.C. Section 58-16) – performing work within the geographical boundaries of the City and County of Denver

• Denver Contractor Minimum Wage (D.R.M.C. Section §20-82) applies to all work performed on City of Denver property or using city dollars.

• City Auditor’s Office has sole authority to enforce wage ordinances

• Weekly Certified Payrolls must be submitted through LCPtracker• Weekly payment to employees is required• Proper rates/classification of work performed

• wages determination(s) bound in contract• wages rates are minimums• higher hourly rates established off site must continue to be paid

• Company provided fringes benefits must be reviewed and approved• Overtime is enforced after 40 hours• Apprentices

• apprentices must be registered with the U.S. Department of Labor Apprenticeship & Training Program

• ratio must be 1:1 (one apprentice to one journeyman)
