Crowe said that the misuse and distribution of illegal fireworks was rife in the Tallaght and its hinterland The Garda in attendence at the Forum said that many of the fireworks were lethal concotions and caused countless serious injuries including the loss of eyesight, fingers and severe burns every year. Deputy Seán Crowe said “I welcome the assurances from the Garda Authorities at the Dublin Bus/ LUAS Community Forum that they will be prioritising the recovery of illegal fireworks in the run up to the celebration of Halloween.” Bus and LUAS representatives outlined the difficulties of running a gauntlet of these fireworks and the obvious inherent risks involved. Too many people including children are seriously injured every year from these fireworks, with some maimed for life, including the loss of eyesight, their fingers and suffering third degree burns. “A lot of positive work has been carried out over the last number of years to deal with the issue of selling illegal fireworks. The Garda response to these lethal fireworks and have not even the most minimum safety measures taken into account in their design. This is not a killjoy approach to Halloween festivities, but the right thing to do. The fireworks and bangers terrify animals,damage property, disturb sleep ILLegaL fIReWORkS - ReMOVaL a PRIORITY and can distract drivers and cause countless accidents every year. Those making a profit from selling these items, have a total disregard for the community and should cease immediately. “Parents need to be extremely vigilant that their children are not handling or let near these fireworks, both for their own safety and the safety of others in the community “The community need to send a clear signal to those that sell illegal fireworks, it is not acceptable and that any information on selling them will be responded to by the Garda Authorities.”

"How could TallaghtHospital not beshortlisted? It offerstri-location (GeneralHospital with teaching,Children Hospital andMaternity when the

Figures released fromthe CSo show that thenumber of peoplesigning on in Clondalkinand Lucan has risen by10% since September2011. In September2012 there were 9,157people signing on. The figure forSeptember 2011 was9,197. However 1,062people weretransferred fromClondalkin to theTallaght live register inoctober 2011, so whenthese are taken intoaccount the number ofpeople living inClondalkin and Lucansigning on rises to10,219, indicating a 10%

increase betweenSeptember 2011 andSeptember 2012.Sinn Féin DublinMid-Westrepresentative eoin ÓBroin has accused theGovernment of‘ignoring the growingunemployment crisis inClondalkin and Lucan.’Ó Broin said: ‘Figuresreleased by the CSoshow that the numberof people signing on inClondalkin and Lucanhas increased by 10% inthe last twelve months.This is in stark contrastto the state widefigures which show nosignificant change inthe last year.

‘The unemploymentcrisis in DublinMid-West is gettingworse and thegovernment just don’tseem to care. They aremore concerned withimposing cuts to homehelps and children’sbenefit than they are intackling the jobs crisis.‘For the last twelvemonths Sinn Féin hasbeen calling for urgentaction and investmentfrom Government tocreate jobs.Unfortunately our callshave fallen on deafears. only when theGovernment starts toinvest in projects to getpeople off the dole and

back into work will weseen any improvementin the live registerfigures.‘Later this month SinnFéin will be launchingdetailed and costedproposals for jobcreation across thecountry. We will bepresenting these to therelevant Departmentsfor consideration.‘The Governmentclaims that it does nothave the resources toinvest in job creationprogrammes. This is nottrue. only this week theFine Gael and Labourallowed AIB to pay anunguaranteed andunsecured bondholder

€1billion of tax-payersmoney. This moneyoriginated in thenational PensionReserve Fund and wasgiven to AIB last July.The fact that thismoney was used to payoff private banking debtrather than invested injobs says a lot aboutthe priorities of theGovernment.

‘Until we see a changeof direction at theheart of the Fine GaelLabour coalition we willnot see anyimprovement in theunemploymentsituation in Lucan andClondalkin.’

Councillor Éamonn Walsh (Tallaght Central) (FF)has welcomed the support of the majority of SouthDublin Co Council colleagues (14 votes to 10) on aban on alcohol sport sponsorship.The Joint oireachtas Committee dealing with thisissue on alcohol abuse comprises representativesof all the major parties.Councillor Walsh says ‘Disappointingly, however,despite this strong senior governmentrepresentation, all of the Fine Gael members votedagainst the Motion and many Labour councillors didso also.’Walsh says advertisers are well aware of the powerof advertising and the subliminal message thatalcohol sponsorship of sport sends out.

Sponsorship by alcohol companies of various sportsto a point where a particular brand is associatedwith a particular trophy in a sport which isfollowed avidly by schoolchildren, may encourageearly experimentation with alcohol by thoseyoungsters. The office of Tobacco Controlestimated that there was an illegal market of€145m in alcohol consumption by minors.

In 2009 it was found that €2.5 billion is lost throughabsenteeism and health costs as a result of alcoholabuse. The exchequer receives only €1bn euro intax revenue to offset this financial cost, leavingaside the human cost.

As a Councillor I hear constant stories of brokentrees, seating, arson of public property and thedisturbance and terrorising of older people bydrunken youths. Most of these crimes arecommitted under the influence of alcohol’.

This proposed ban is only one of a suite ofmeasures needed to combat this problem.

Walsh praises the role of the GAA with their ASAPprogramme which is designed to assist players andsupporters in clubs throughout Ireland to controltheir drinking without being sanctimonious or‘preachy’.Walsh says ‘The link between sport and alcoholneeds to be phased out and the government shouldstick to its 2016 target date and not kneeling andbowing to the drinks industry.’

Q I was involved in an accident just overa year ago now. At the time I did notpursue any claim as I felt that I wasalright. Now however, I am aware that Ihave a fairly constant pain in my neckwhich is interfering with my day to daylife. It was a road traffic accident I wasinvolved in and I did take details. Is it toolate to make a claim?

A It is important to remember that in allcases of accidents causing personal injury,a claim must be initiated within TWoYeARS oF THe DATe on WHICH THeACCIDenT oCCURReD. It is also arequirement that a letter of claim beissued by a claimant to the person he orshe feels is responsible for the accidentwithin TWo MonTHS of the date uponwhich the accident occurred. Such a letterof claim will normally be drafted by asolicitor. However, there is flexibilityabout the letter of claim being issuedwithin the two months but there is noFLexIBILITY about the claim being initiatedwithin two years from the date of theevent.

In short, it is advisable that you contactyour solicitor as soon as possible after anaccident. Your solicitor does notnecessarily need to start a claim on yourbehalf if you do not feel that it isappropriate at that time. However, at

least the facts are recorded and detailstaken so that at a later date, the claimcan easily be processed. our advice in allthese situations, is to take legal adviceearly and give particulars. You are withinthe time limit to commence a claim but asit can take some time to obtain an initialmedical report, which is a requirement ofregistering a claim then, we would suggestthat you go to see your solicitor as soon aspossible.

Q I had an accident at work some timeago and was out sick for two months. Iam back at work now and although I amnot recovered, I am nervous abouttaking a claim as I am afraid that I mightlose my job. I have been in the job forover six years. Could I lose my job if Itake a claim?

A As you have been with your employersfor such a long period of time, then, anyattempt to dismiss you could be construedas an unfair dismissal which in itself wouldgive rise to a claim for compensation.This is quite separate and apart from anyclaim for personal injuries.

Your employer will undoubtedly haverecorded the accident and may alreadyhave notified the details of same to it’sinsurance company. As such, a claim maywell be anticipated. You do not go intoany detail regarding the circumstances ofyour accident and you would need todiscuss same in some detail with yoursolicitor. However, assuming that this wasan accident which should not havehappened within the workplace and hascaused you personal injuries then, you dohave the right to claim against youremployer. You must initiate the claimwithin two years from the date of theaccident and it is important to allow yoursolicitor plenty of time to take details andobtain an initial medical report. It wouldbe unusual if your employer decided todismiss you simply because you initiated aclaim. You are protected by the law andif your employer takes legal advice theywill be so informed. our advice thereforeis to go to your solicitor and giveparticulars and commence an action forpersonal injuries arising out of youraccident at work.

Q I was at a funfair with my childrenrecently when one of the rides stoppedvery suddenly without any warningcausing my neck to jerk violentlyforward. I have been to my doctor andhe tells me that I actually have awhiplash type injury. would I have anyclaim?

A From what you describe, it seems as ifyou would have a perfectly good cause ofaction against this funfair. on the basisthat the ride stopped without any warningbefore slowing down then, this was

St. Brigid’s national School is a 29 teacher school in Brookfield in Tallaght,South Dublin with 341 pupils. Following a thorough review of their wastesituation they began working towards applying for a Green Flag for theirschool.They analysed all the different types of waste being produced in the school,what was being recycled already and what could be recycled. They made hugechanges in the school following their review such as bin spot checks, teacherquotas for photocopying, double sided printing, food waste monitoring,composting and recycling.They have dramatically reduced their waste going to landfill from 45 blacksacks a week in 2007 to just 1 in 2011, along with a massive increase inrecycling levels and composting. other positive impacts for the school wereincreased involvement with parents and the wider community and moreawareness around healthy eating for the students. The school were a verydeserving recipient of their first Green Flag in May 2012. The Road Safety Authority (RSA) will be processingnew driving licence applications from next year,removing the function from local authorities, FineGael Councillor emer Higgins has stated.Higgins said “A new plastic card licence will alsobe issued to new applicants from this date. Thiswill hopefully reduce the incidents of fraud, andwill also be easier for drivers to carry their licencesin their wallets,” she added.The Road Safety Authority (Commercial VehicleRoadworthiness) Act 2012, enacted earlier thisyear, provides for the Road Safety Authority (RSA)to be the national authority for driver licensing. “Work is well advanced on preparing for thetransition to the new system,” continued Cllr.

transit

Member states mustproperly enforce animaltransport rules and penaliseoffenders, MePs said thisweek in a resolution votedthrough by the europeanParliament’s AgricultureCommittee.The report calls for a rangeof improvements for thetransport of animals,including promoting the useof local meat processors andabattoirs in order to avoidunnecessarily long-distancetransport times.

“Long-distance animaltransport causes sufferingto animals and increasescosts for consumers,” saidthe report, calling for a

reduction in both thenumber of animalstransported, and thejourney length.

Research carried out by theeuropean Commission showsthat the numbers of animalstransported within the eUhas grown substantially inrecent years. For example,the number of pigs beingmoved increased by 70 percent between 2005 and2009.MePs also called for moreon-the-spot inspections tobe carried out, and fornational sanctions againstrule-breakers to beharmonised and made moredissuasive. The committeesaid measures to restrictthe time taken to transportanimals to slaughter toeight hours should beconsidered, but thatgeographical andscience-based exceptionsfor certain species must beallowed. However, theycautioned that aneight-hour journey limit

would not by itself besufficient to improve animalwelfare, which oftendepends more on propervehicle equipment and onthe good handling ofanimals.
