This manual provides guidance for the design and fitout of commercial outdoor seating areas in The Rocks and Circular Quay. The manual augments the Foreshore Authority’s policy for Commercial Outdoor Seating in The Rocks and Circular Quay 2012.

The manual describes styles, materials, colours and setout requirements to achieve the outcomes described by the policy document. It should be noted that the styles of furniture and ancillary equipment shown in this manual are generic only and do not refer to specific brands or products. The images are for guidance only; to demonstrate the type of materials and finishes that the Foreshore Authority believes will be complementary and appropriate to the character of outdoor seating in The Rocks and Circular Quay. The manual addresses three specific situations:

> Licensed areas in The Rocks

> Leased areas in The Rocks

> Licensed areas in Circular Quay.

The selection of furniture and ancillary equipment and the way they are configured will be subject to location and whether the outdoor seating is dependant on their licensing or leasing arrangement.

Leased areas refer to outdoor places such as courtyards, food courts, decks and the like that are fully contained within an existing leased area and do not directly encroach on an adjacent public domain.

Licensed areas refer to the special use of the public domain such as promenades, footpaths, thoroughfares, squares and places which are not part of the tenant’s normal property lease. These areas are subject to individual special licence arrangements on a commercial basis

In general, licensed areas focus on a coordinated approach between tenancies trading out onto footpaths with the ability to remove from the public domain all furniture and ancillary equipment after business hours and during special events. Leased areas however, can have a more permanent setup and more variety in the selection of furniture and ancillary equipment to develop individual character appropriate to its setting, while delivering a quality experience.

2. General principles 3. Approval procedures

The principles underpinning the general arrangement and selection of materials and finishes for outdoor seating areas are strongly informed by the heritage significance of The Rocks precinct and by the contemporary qualities of the Circular Quay precinct. The Australia ICOMOS Burra Charter principles relating to the introduction of new materials into a historically significant precinct should be followed.

In summary, outdoor seating and ancillary equipment must achieve:

• invitingdiningandrefreshmentplacesthatpromote The Rocks village experience and the Circular Quay retail and entertainment experience by enlivening the promenades, streetscape and back areas of The Rocks and Circular Quay

• seatingareasthatcomplementandencouragedesignexcellence with a consistent high standard of presentation

• outdoorseatingareasthatwillbedeferentialtotheheritageof The Rocks, allowing streetscape, buildings and courtyard spaces to remain the dominant visual elements in the landscape

• safety,throughconsistentdesignstandardsandapplication.

• maintainregulatoryrequirementsforpedestrianmovementsincluding those for persons with a disability.

Prior to lodging a development application, Roads Authority and Landowner’s consent must be obtained from the Foreshores Authority. In the majority of cases the Foreshore Authority is the landowner in The Rocks. Tenants will, in the first instance, liaise with their property manager to determine the viability of their proposal and in what form their submission must be presented for consideration by the Foreshore Authority.

A development application for outdoor seating will normally comprise:

1. A signed Roads Authority and Landowner’s consent form.

2. A completed development application form.

3. An inventory and/or drawings including scaled plans at 1:100 or more detailed and photographs describing the outdoor seating proposal.

4. For proposed structures such as awnings and shade sails, the Authority will require design scaled drawings and engineered fixing details and possible photomontages.

5. Details of the materials, graphics and colours of the furniture and ancillary equipment.

6. A statement of environmental effects including a heritage impact statement where proposed works will directly impact on a building listed on the State Heritage Register. The statement will assess visual, physical and interpretive impacts of the proposal on the heritage precinct, streetscape and/or building and the physical impact on its heritage fabric.

7. If the proposed outdoor seating affects items listed on the State Heritage Register, an application under s60 of the NSW Heritage Act 1977 or, where applicable, an exemption under S57(2) of the NSW Heritage Act 1977, will need to be approved prior to lodging a development application. It should be noted that the majority of historic buildings in The Rocks are listed on the State Heritage Register. Prospective applicants should seek advice from their property manager.

The Foreshore Authority reserves the right to determine the appropriateness of the seating proposal before giving landowner’s consent.

4. Technical Matrix

A matrix has been developed to link a tenancy location with its fitout options. For each situation, identify the lease or licensing status and refer to the appropriate specification sheet. Each specification sheet presents the dimensions, diagrams and images where acceptable examples are available.

A1 – Tables in licensed areas in The Rocks and Circular Quay

1. Uniformity with adjoining outdoor seating areas within the public domain is essential for a consistent presentation.

2. Tables are not to be fixed to the ground or any structure, and should be stackable so they can be stored outside of business hours.

3. Tables are to be of a simple design for presentation and, where they are located on asphalt, units with broad feet should be selected to minimise indentation and instability.

4. Table frames are to be of steel, aluminium or other metallic type material. No plastic materials or timber will be permitted.

5. Tables tops are to be weather resistant with non-permeable surfaces that can be readily kept in a clean hygienic condition and made from steel, aluminium, other metallic type material or imitation stone. No plastic or timber materials will be permitted.

6. Finishes are to be natural metal, polished, linished or painted in a dark or metallic colour. No bright colours are permitted.

7. Only tables 700–750mm height are permitted

8. Tables accommodating 2–4 persons are preferable.

5. Table performance specification

A2 – Tables in leased areas in The Rocks

1. Tables should be selected to enhance the character of the tenancy, but should be of a simple design and, where located on asphalt or irregular surfaces, units with broad feet should be selected to minimise indentation and instability.

2. Tables can be fixed to the ground or other structure, depending on circumstances, and legs may be adjustable to accommodate uneven grades.

3. Table structure is to be of steel, aluminium, other metallic type material or quality finished timber. No plastic materials will be permitted.

4. Table tops are to be weather-resistant with non-permeable surfaces that can be readily kept in a clean hygienic condition and made from steel, aluminium, other metallic type material or imitation stone or quality finished timber. No plastic materials will be permitted.

5. Tables are to be finished in natural metal, polished, linished or painted in a dark or metallic colour. Muted colours are recommended, but alternatives may be permitted on merit.

6. Tables over 700–750mm height will be considered on merit.

7. Tables should accommodate 2–4 persons. Larger table styles and configurations will be individually assessed on their merits.

6. Seat performance specification

B1 – Seats in licensed areas in The Rocks and Circular Quay1. Uniformity with adjoining outdoor

seating areas is essential for an integrated streetscape.

2. Seats must be of simple design and coordinated with tables for a consistent appearance.

3. Seats must not be fixed to the ground or any structure, and should be stackable so they can be readily stored outside of business hours.

4. Seat structure is to be of steel, aluminium or other metallic type material. No plastic or timber. materials will be permitted.

5. The seat itself can be made to match the frame or of steel, aluminium, other metallic type or a wicker type material.

6. Only seats 400–450mm height permitted

7. Seats are to be finished in natural metal, polished, linished or painted in a dark or metallic colour. Muted colours are preferable.

B2 – Seats in leased areas in The Rocks1. Seats should be of a simple design

and selected to coordinate with tables for a consistent appearance.

2. Bench or stool type styles and configurations may be permitted, but will be individually assessed on merit.

3. Where settings are located on brick, stone or other irregular surface, appropriate seats should be selected to provide adequate stability.

4. Seat heights over 450–500mm will be considered on merit.

5. Seats are to be weather-resistant, non-reflective, non-permeable surfaces that can be readily kept in a clean hygienic condition and can be made from steel, aluminium, other metallic type material or quality finished timber. No plastic materials will be permitted. Cushions may be considered in weather protected areas.

6. Seats are to be finished in natural metal, polished, linished or painted in a dark or metallic colour

7. Muted colours are recommended, but alternatives may be permitted on merit.

C2 – Seats in leased areas in The Rocks1. Umbrellas may be either permanently

fixed, socket fixed, or with removable base weights depending on the situation.

2. Water filled base weights are not suitable.

3. Removable umbrella base supports that are not supporting umbrellas shall be taken to a storage space in the leased area at the end of each business day for safety and security.

4. Umbrella size can vary depending on the size of the space, and will be assessed on the merits of the situation.

5. Umbrella fabric must be made of weather resistant non-reflective material.

6. The material may be of a colour that is sympathetic with the colour of the adjacent building(s) and will be assessed on merit.

7. Weatherproofing “gaps” between umbrellas will be permitted on merit, but drop down screens or a linking section from the umbrella to a building to create an awning will not be permitted.

8. Weatherproofing “gaps” will be the same colour as the umbrella material.

9. Third party advertising on umbrellas is not permitted.

C1 – Movable umbrellas in licensed areas in The Rocks1. Umbrella size and colours must

be consistent and coordinated between tenancies, as they will be a particularly strong visual element within the streetscape.

2. Umbrellas are to be removable and stacked off the public domain at the end of business hours.

3. Umbrella dimensions shall be as shown to ensure the weight is not excessive.

4. Umbrellas are to be secured by inserting the pole into a footpath socket provided by the Authority. The umbrella supplier will certify their product is suitable for the socket fixing method.

5. Umbrellas must be capable of withstanding nominal 40km/hr wind speeds, certified by the supplier.

6. Umbrella fabric is to be made of weather resistant non-reflective material in a cream colour.

7. Umbrella poles shall be white, black or a natural metal colour. No bright colours are permitted.

8. Weatherproofing “gaps” between umbrellas and drop down screens are not permitted.

9. Third party advertising on umbrellas is not permitted.

C3 – Fixed umbrellas in licensed areas in Circular Quay

1. Umbrellas are to be permanently fixed and certified by the supplier and an engineer that the umbrella fixing is suitable for the setting and will withstand normally expected wind loadings in the particular location.

2. Umbrella size shall be nominally as shown.

3. Umbrella fabric is to be made of weather resistant non-reflective material in a cream colour.

4. Umbrella poles shall be white, black or stainless metal steel colour. No bright colours permitted.

5. Weatherproofing “gaps” between umbrellas will be permitted on merit, but drop down screens or a linking section from the umbrella to a building to create an awning will not be permitted.

6. Weatherproofing “gaps” will be the same colour as the umbrella material.

7. Third party advertising on umbrellas is not permitted.

8. Awning performance specification

D1 – Retractable awnings in leased areas in The Rocks

1. There are limited situations where retractable awnings are a more appropriate means of providing shade to patrons.

2. Awnings material must be made of weather resistant non-reflective material.

3. Awnings shall not be attached to heritage walls unless the connection has been approved by the Authority and certified by a qualified engineer.

4. Awnings are to be supported by no other supporting structure or item other than the building wall to which it is attached.

5. The colour for awning material must be sympathetic to the style of building or surrounding buildings and other commercial outdoor furniture, such as shade sail or adjacent umbrellas, and will be assessed on merit.

6. Awnings shall not extend beyond the extent of the lease area.

7. The outer edge of the awning must have a minimum clearance from the ground of 2.3m.

8. No drop down weather screens are permitted.

9. Awnings that use a automatic or manual rope/wire system to extend the awning must ensure the rope or wire is safely secured after use.

10. Awnings should be retracted in high wind situations.

11. Third party advertising on awnings is not permitted.

9. Shade sail performance specification

E1 – Shade sails in leased areas in The Rocks1. There are limited situations where

shade sails are a more appropriate means of providing shade to patrons.

2. Shade sails will be supported by tension cables for visual lightness, but depending on the particular situation, a rigid structure may be considered on merit.

3. Tension cables shall not be attached to any wall or other structures unless the connection has been approved by the Authority and certified by an engineer.

4. No load carrying items other than the shade sail itself shall be supported by the tension cables.

5. Shade sails must be of a light non-reflective weather resistant material.

6. The proposed colour will be assessed on merit but must be sympathetic to the style of building or surrounding buildings and other commercial outdoor seating furniture, such as awnings or adjacent umbrellas.

7. The shade sail must have a nominal 1m clearance from any wall.

8. Third party advertising on sail is not permitted.

and have a stainless steel finish.

2. Heaters are to be removed at the end of the business day.

3. Third party advertising on heaters is not permitted.

F2 – Heaters in licensed areas in Circular Quay and leased areas in The Rocks1. Heaters may be fixed to the underside

of umbrellas as shown in the image opposite.

2. Heaters may be permanently fixed to walls subject to the approval of the Authority.

3. Alternatively, heaters can be free standing as for F1.

4. Heaters are to be weather-resistant and have stainless steel finish.

11. Waiter station performance specification

G1 – Waiter stations in leased areas in The Rocks1. Waiter stations can be permanently

fixed to the ground or movable. Proposals to fix to the building structure will require approval from the Authority and certified by an engineer.

2. Waiter stations are preferably to be made of stainless steel material or other non porous material that is hygienic and readily cleanable, but alternative materials that complement the setting will be considered on merit.

3. Waiter stations will have approximate dimensions of up to 900mm bench height (1200mm max height) x 600mm depth x 1500mm width. Stations larger than these dimensions will be assessed on merit.

G2 – Waiter stations in licensed areas in Circular Quay1. Waiter stations must be on lockable

casters and not permanently fixed to the ground or building structure.

2. Waiters stations are to be removed from the licensed area and locked away after the hours of business.

3. Waiter stations are to be preferably made of stainless steel or other non-porous material that is hygienic and readily cleanable.

4. Waiter stations will have approximate dimensions of up to 900mm bench height (1200mm max height) x 600mm depth x 1500mm width. Stations larger than these dimensions will be assessed on merit.

5. One waiter station per licensed area will be permitted.

H1 – Menu sign and specials board in licensed areas in The Rocks1. Menu sign and specials board are

not to be fixed but must be removed from the licensed area at the close of business.

2. Menu sign and specials board must be positioned within the licensed area only and are not to compromise the health and safety of patrons or impede their movement within the licensed area or adjacent public walkways. Furthermore, it should be demonstrated that they are stable, including in windy conditions.

3. Use of freestanding menu is permitted where a wall mounted menu is not available or the installation of one is considered inappropriate by the Authority.

4. Menu sign and specials board should be selected to be complementary to adjoining tenancy boards and made of a high quality material.

5. Menu sign and specials board are to be maximum dimensions of 1000mm high x 600mm wide.

6. Third party advertising is not permitted.

H2 – Menu and specials boards in leased areas in The Rocks1. Menu and specials boards are not

to be fixed but must be removed from the licensed area at the close of business.

2. Menu and specials boards must be positioned within the licensed area only and are not to compromise the health and safety of patrons or impede on adjoining public walkways.

3. One menu board only is permitted per entry point to the licensed area.

4. Menu and specials boards should be selected to be complementary to adjoining tenancy boards and made of a high quality stainless steel, aluminium or other metal with colour of natural metal or painted to match.

5. Menu and specials boards are to be maximum dimensions of 1000mm high x 600mm wide.

6. Third party advertising is not permitted.

H3 – Menu and specials boards in leased areas in Circular Quay1. Menu and specials boards must be

positioned within the leased area only and are not to compromise the health and safety of patrons or impede their movement within the leased area or adjoining public walkways.

2. Menu and specials boards are to be maximum dimensions of 1000mm high x 600mm wide.

3. Menu and specials boards should be complementary to adjoining tenancy menu boards. but can be more customised to the character of the tenancy and its culinary style and will be assessed on merit.

4. Third party advertising is not permitted.

5. For wall mounted fixed menu boards refer to The Rocks Commercial Signage Technical Manual 2009.

13. Partitions performance specification

I1 – Partitions in licensed areas in The Rocks1. Licensed areas will be defined by

partitions supplied by the Authority but maintained by the tenant.

2. The graphics will be consistent on all partitions with the tenancy business name included to customise each location. The size and position of the logo is predetermined by the Authority.

3. Partitions will be constructed of metal framing and have metal or tensioned vinyl screen and be nominally 2000mm wide x 900mm high.

4. Partitions are intended to mark two sides and corners of the licensed area only and are not to be used to fully enclose the licensed area.

5. The placement of partitions is not to impede the movement of surrounding pedestrian traffic.

6. Partitions are to be a minimum 800mm from the face of a road kerb where adjoining a road.

7. Partitions are to be removed at the end of normal business hours.

8. Third party provided screens with associated advertising will not be permitted.

I2 – Bollards and rope in licensed areas in Circular Quay1. Licensed areas will be defined

by bollards and rope only.

2. The bollards will be free standing and fully removable at the end of normal business hours.

3. The placement of bollards will not impede the movement of surrounding pedestrian traffic.

4. The bollards will be constructed of circular sectioned stainless steel, chrome plated steel or aluminium.

5. Bollards will be nominally 750mm to 900mm in height.

6. Rope can have the business name and logo attached for tenancy definition.
