Background On November 2, 2000 Resolution G-3301 approved, on an interim basis, SoCalGas’ request in Advice No. 2950 for a new tariff, Schedule No. G-CBS, Utility Distribution Company (UDC) Consolidated Billing Services. Resolution G-3301 stated that the Schedule No. G-CBS tariff is effective until either (1) SoCalGas files a permanent tariff with its next BCAP application to allow a comprehensive review of the service and its cost system conversion and labor implication, or (2) such time as such service is adopted in the Natural Gas Strategy Proceeding (I.99-07-003). In its 2003 BCAP application (A.01-09-024) SoCalGas did file tariff Schedule No. G-CBS as a permanent tariff because that service has not been adopted in I.99-07-003. However, a decision in the 2003 BCAP is not expected to take effect until January 1, 2003. There are several minor changes in tariff Schedule No. G-CBS which should be implemented prior to that time in order to better serve customers and provide some additional flexibility to ESPs. Those changes are the subject of this Advice Letter. Under Schedule No. G-CBS, SoCalGas provides a consolidated service to bill customers of participating ESPs for both SoCalGas transportation and related charges and the ESP’s gas procurement charges. The tariff provides for one monthly flat rate per therm that is applied to all of the ESP’s customer-accounts.

Advice No. 3069 - 2 - September 28, 2001

This Advice Letter proposes four relatively simple changes to the current tariff:

1. Add flexibility in the deadline for informing SoCalGas of monthly rate changes. 2. Allow extra lines in the bill presentment for UDC Consolidated Billing Service. 3. Clarify the delinquent charge notification. 4. Revise the labor price to “at cost” to ensure that all SoCalGas’ labor costs are

captured and billed to the ESP. Description of Tariff Changes, Schedule No. G-CBS Bill Calculation The Bill Calculation section on the first sheet of the existing tariff reads, in relevant part, as follows:

SoCalGas will calculate and send a consolidated bill containing both SoCalGas’ transportation and related charges and the ESP’s gas procurement charges to the Customer. SoCalGas will calculate the ESP’s charges based upon ESP-supplied rates. The ESP will send rate changes to SoCalGas via e-mail on a monthly basis, at least five business days before the first of the month. The ESP is solely responsible for ensuring SoCalGas’ receipt of applicable gas procurement rates and for the correctness of all rates provided to SoCalGas.

SoCalGas proposes a change to the bill calculation provisions of the tariff.

Revise the first sentence of the second paragraph to read; “The ESP will send rate changes to SoCalGas via e-mail on a monthly basis, at least five business days, before the first of the month. Rate changes may be made less than five days before the first of the month, if agreed to by SoCalGas in its sole discretion. The ESP is solely responsible for ensuring SoCalGas’ receipt of applicable gas procurement rates and for the correctness of all rates provided to SoCalGas ”. This change is at the request of and in response to the currently participating ESP’s concern with volatile gas commodity costs. The ESP has indicated that it sometimes does not know what its gas procurement rates will be for the coming month until after the tariff-established deadline.

Bill Presentment Advice No. 2950 provided that the ESP’s procurement charge would be presented as two separate line items on the bill. The first line identifies the ESP and its telephone number. The second line shows the total ESP charges and is identified as “ESP Procurement Charges.” SoCalGas has since determined that three lines and occasionally a fourth are necessary to display the rates used to calculate ESP procurement charges when the customer’s billing cycle overlaps two and possibly three different established monthly rate periods.

SoCalGas proposes to display the ESP name, telephone number and total ESP procurement charges on the first line and then use additional lines, as needed, to display the ESP’s established monthly gas procurement rates. A sample of the SoCalGas UDC Consolidated Bill is included herein as Attachment C. Delinquent Charge Notification The first statement of the Delinquent Charge Notification section reads as follows: “SoCalGas will send notices informing Customers of unpaid balances that have become delinquent.” SoCalGas proposes to change this sentence to clarify that SoCalGas is not sending a separate notice for ESP delinquent charges. SoCalGas proposes to revise the first sentence to read: “SoCalGas will include ESP delinquent charges on SoCalGas’ existing overdue notices.” Labor Rate The labor rate for providing other billing services is currently shown at $70 per hour at the top of Sheet 3. However, future labor costs may be higher or lower than the fee shown depending on the skill sets required to do the work. Therefore, SoCalGas is revising this labor rate to read “at cost” so full costs will be billed for any work done in providing this service. Protests Anyone may protest this advice letter to the California Public Utilities Commission. The protest must state the grounds upon which it is based, including such items as financial and service impact, and should be submitted expeditiously. The protest must be made in writing and received within 20 days of the date this advice letter was filed with the Commission. There is no restriction on who may file a protest. Applicable to Energy Service Providers (ESPs or also known as core aggregators) who provide direct access to core Customers, as defined in Rule No. 1.

DESCRIPTION OF TARIFFED SERVICE

Bill Calculation

SoCalGas will calculate and send a consolidated bill containing both SoCalGas' transportation and related charges and the ESP's gas procurement charges to the Customer. SoCalGas will calculate the ESP's procurement charges based upon ESP-supplied rates.

The ESP will send rate changes to SoCalGas via e-mail on a monthly basis, at least five business days, before the first of the month. Rate changes may be made less than five business days before the first of the month, if agreed to by SoCalGas in its sole discretion. The ESP is solely responsible for ensuring SoCalGas' receipt of applicable gas procurement rates and for the correctness of all rates provided to SoCalGas .

The gas procurement rate assignment will be limited to the following:

Rate per Therm: One flat rate per therm applied to all of the ESP's accounts for each calendar month. This rate per therm can be changed only on a monthly basis. Meters are read on a cycle basis, which may include a portion of two months' gas usage. Therefore, Customer's usage will be prorated based on the number of days for each month and the procurement rate established for each calendar month will be applied to the Customer's usage in each respective calendar month to calculate the gas procurement charges.

Fixed Service Charge: One fixed service charge per account applied to all the ESP's accounts with the option of applying it as a daily charge or a monthly charge. This fixed service charge can be changed only on a monthly basis.

Bill Presentment

The gas procurement charges will be presented as separate line items on the bill.

The first line will identify the ESP, its telephone number, and the total ESP procurement charges. The ESP's procurement rates, both the fixed service charge and volumetric rate used to calculate total ESP charges, will be shown as additional line items on the bill.

SoCalGas will calculate all taxes, surcharges and fees applicable to the procurement charge and remit them to the respective taxing authorities on the ESP's behalf. The ESP will at all times remain liable for such taxes, including any penalties and interest imposed on audit.

Payment Processing

SoCalGas will process the Customer's payments for both SoCalGas' transportation and related charges and the ESP's procurement charges. SoCalGas will remit payments to the ESP for only those amounts collected for procurement charges on a weekly basis. In the event of partial payments, the remittance received will first be applied to SoCalGas' transportation and related charges.

ESP Customers will have the same payment options as SoCalGas' Customers.

Delinquent Charge Notification

SoCalGas will include ESP delinquent charges on SoCalGas' existing overdue notices. Such notices may show the balances owed to SoCalGas and the ESP as a combined total. Customers' service will not be disconnected for non-payment of ESP procurement charges billed by SoCalGas.

RATES

If an ESP requests that SoCalGas calculate the charge and bill the ESP's Customer for the energy supply portion of the Customer's bill, the price shall be:

The ESP will provide rates to SoCalGas by the 5th day before the first day of the calendar month in which they go into effect. Rates may be provided less than five business days before the first of the month if agreed to by SoCalGas in its sole discretion. The ESP fixed charge, if any, and the ESP gas commodity rate will be in effect for the entire calendar month.

Billing usage will be prorated by the number of days of each calendar month in the billing cycle. ESP charges will equal the sum of the prorated customer usage in each calendar month multiplied by the applicable ESP rate in the calendar month in the billing cycle plus the prorated fixed charges.
