What a busy nine months it’s been, hard to believe that at this time last year we were waiting for the final approval of the merger between

MCAR and WWoCAR, with the official signing of the merger documents taking place on october 1st.

one of my priorities this year was to reach out to our membership, to not only meet this great group of REALtoRs®, but to listen to their concerns, both with the association as well as the real estate industry. After the past seven months of hosting Coffee with the President and Presidential Brews throughout our various districts, i’ve come up with the top three items that are of most importance to our members.

Education. Professionalism. the Multiple Listing service.

the gMAR Board of Directors are committed to these issues and are currently working to bring the best services and products to our membership. Watch for future editions to find out more details.

We are saddened to inform you of the death of Charles L. Whitfield who passed away June 28, 2012. Charles had been a member of the board since 2007 as an agent with Real Estate Management specialists, inc. in Detroit.

Luretta garren passed away July 18, 2012. she had been a member since 1991 and an agent with national Realty Centers, inc. in Livonia.

Also, a long time REALtoR®, Patricia Morgan recently passed away. Pat began her career in 1978 at B.F. Chamberlain in 1978 and later went on to manage the Lathrup Village and subsequently the Royal oak offices. the company was purchased in 1998 and the name was changed to Prudential Chamberlain-stiehl REALtoRs®. she continued to work until her retirement in 2003. Additionally, she served

on the grievance and Professional standards Committees as well as a Director of the Birmingham-Bloomfield Chapter of the Women’s Council of REALtoRs®.

this inaugural year of gMAR has been an exciting one. if you look at gMAR today, you’ll have some

difficulty in identifying its old parts - MCAR and WWoCAR. When the leaderships of MCAR and WWoCAR looked at merging the two strong associations, they focused on the culture and services we had in common. With the merger we found that all of the great things we had envisioned were actually achievable. But with that, we found that some of our members don’t like change. While that doesn’t come as a surprise, it is still disconcerting that we haven’t got our message out yet.

the message? gMAR is growing into a vibrant, member-oriented organization that is focusing on providing the services that will make our members the most productive sales force in our market area.

Facilities updateWith the merger, many of our members from both legacy

associations have been worried about where the offices for the association will be. President tony schippa established a blue ribbon task force to serve on the Building task Force. Co-chaired by former MCAR leader Al Block and former WWoCAR lead Anthony Jablonski, the task force has spent months putting together a transition plan. As they near the end of their task, their work has already produced a policy statement from the Board of Directors that encompasses our vision of who we are. the Directors are committed to providing the highest quality services that are placed near where our members conduct business.

As for the physical facilities, we have some hard facts we need to address. the association owns the building in Farmington. the Association is consulting with respected commercial real estate firms in order to ascertain what the highest and best use of that facility is. the discussion regarding the Farmington office is revolving around three choices; 1) retain the building as the headquarters; 2) attempt to sell the building; or 3) attempt to lease the building until the market improves. For now, the building will be retained until all the facts are in and a decision can be made based on those facts.

the troy office has gone through some major changes over the past year. the office is centrally located for a segment of

our members, but it is also costly, even with the reduction in the physical space, and a corresponding reduction in lease costs. the Directors have made the decision to retain a facility in the troy area until a comprehensive decision can be made regarding our overall facility strategy. to that end, we will be transitioning the current troy facility to another less costly office solution in the troy area. i would like to provide you a specific address in this article, but we are a few days away from finalizing our selection. Watch for our special announcement soon that will provide you with our new temporary location. the short term lease will give us enough time to complete our research for a more permanent solution.

For our members in the Down River area, we haven’t forgotten about you. Part of our research includes exploring facility solutions that will address your needs as well.

the two keys, from my perspective, are first to provide the quality services to our members’ front door, and second, to provide support that is convenient for all members. Currently, i am pleased to say that we are running a highly efficient organization that is focused on allocating our financial resources to more member return on investment and less on internal expenditures. Bear with us as we analyze and resolve the final stages of this project.

Member Duesthe Board of Directors had some tough decisions to make

as we conducted our strategic plan. Just as you do in your business, the Directors analyzed our market, our partner-competitors, and the members Roi by belonging to gMAR. some associations in our area have slightly lower dues, while some have dues that more than double our current dues structure. the decision for gMAR was where we wanted to be on this spectrum of dues and benefits of membership.

the Directors decided that gMAR would be built on the Member Roi business model. the Directors believe that for our members to be the most productive that they can be, gMAR would be commissioned to provide a broad range of services and support that will give members the most value for their dues dollar. We are combining our industry-best programming with the best that the national and Michigan associations provide, providing our members unparalleled return on their investment.

gMAR offers a great advocacy program that concentrates on the issues most important to our members. We offer world-class educational opportunities provided by the top trainers, plus a highly trained staff that understands the real estate industry and that performs as a resource for our members. We provide various forums that address real estate issues and we have a great group of Affiliate members that add to our knowledge base. in many ways, we act very much like a smaller association, with many of our members participating in our social programming. We have established the Real orators, a nationally chartered toastmasters club that includes REALtoRs®, affiliates, local business friends and members of academia. our award-winning Women’s Council of REALtoRs® has expanded from three chapters to our fourth chapter being established this summer. By the way, don’t let the ‘Women’ name mislead you. the WCR Chapters provide quality services for all members - male or female. in fact, one of our Chapters is led by one of our male leaders. When you get a chance, take a look at what the WCR offers. it could be just the thing you need to take your business to the next level. i could go on, but i hope you can see that gMAR is a unique REALtoR® association. so, if you decide to compare services offered by the REALtoR® associations in our market area, be sure to take a look at what your investment buys at gMAR.

your Voice at gMARi was talking to one of our members that owns a large

firm and was surprised to learn that the office owner was concerned that his agents might not have representation on the new Board of Directors. i shouldn’t have been surprised. Again, like you and the way you market your services, gMAR has to tell its story. the Board of Directors recently completed forming the eight districts that will make up the core of our new Board of Directors in 2013. the Districts are comprised of roughly the same number of members, partitioned by the zip code of our members’ offices. the new configuration assures that all members, and all geographical areas, will be equally represented. Each REALtoR® member will be able to vote for their home town Director, plus an array of at-large Directors. Watch for our publication that will outline the Districts and tell you what District you are in.

the MLs issueProbably one of the most surprising perceptions that we’ve

encountered is that some members thought the merger was of the two prominent MLss in our area - not the associations. We went out of our way to let members know that their vote was to merge the associations, and that we would not have complete control of what happens between the two MLss. that being said, gMAR now has a greater influence regarding the MLs issue.

Whatever your preferences are for your MLs of choice, there really is one overriding concept:

gMAR members are entitled to have access to one single

database that contains all REALtoR® listings in our market territory, without having to pay multiple subscriber fees.

the Board of Directors has articulated this concept to both Realcomp and MiRealsource through a policy statement, and they intend to press the issue until the inequity is resolved.

tell your Business AssociatesRecently, we found that over seven hundred - 700! -

members have blocked our electronic mail. While that isn’t bad as compared to other organizations’ publications, it still means that we’re not reaching a significant number of our members. it also means that many of our members haven’t had the opportunity to evaluate the new, feature rich content we are offering. if you’ve read this far, please take the next step and tell your non-reading friends about this article. if they change their minds about our publications, we can help them to reestablish their connection with us.

new information regarding the 3.8% tax

there has been a bit of misinformation circulating recently regarding a rumored “3.8% sale tax” on all home sales under the federal health care reform bill. the tax is not a transfer tax on real estate sales and similar transactions. not long after the tax was enacted, erroneous and misleading documents went viral on the internet and created a great deal of misunderstanding and made the tax into something far more draconian than the actual provisions.

the new tax does not eliminate the benefits of the $250,000/$500,000 exclusion on the sale of a principal residence. thus, onLy that portion of a gain above those thresholds is included in Adjusted gross income (Agi) and could be subject to the tax.

the 3.8% tax is imposed onLy on those with more than $200,000 of Agi ($250,000 on a joint return). the tax applies to investment income, defined as interest, dividends, capital gains and net rents. these items are all included in an individual’s Agi. A formula will determine what portion, if any, of these types of investment income would be subject to the tax.

REALtoRs® should familiarize themselves with the tax, but should not advise their clients about the application of the tax. the amount of tax will vary from individual to individual because the elements that comprise Agi differ from taxpayer to taxpayer.

Legislation on improvements to Critical Dunes Act Passes house: Bill now heads to the governor’s Desk for signature

Both the house and senate met recently to work on a few issues before heading back to the campaign trail. on July 18, legislation aimed at applying a less subjective approach to critical dune regulation passed the house on a 63-40 vote. the bill is now on its way to the governor’s desk for signature. As you may recall last month, senate Bill 1130, sponsored by senator Arlan Meekhof (R-olive twp.) passed the senate on a 26-12 vote. once signed by the governor, the bill will have immediate Effect.

REALtoRs®, builders, and property owners living and working within the critical dunes can attest to the fact

that the application of the Critical Dunes Act has been inconsistent and frustrating for many years. Private property within the critical dunes area has been subject to significant red tape, inconsistent treatment, and often outright prohibition in terms of development and the exercise of private property rights. Efforts as simple as permitting driveway access to an owner’s property have been stifled due to a lack of clarity on how the law should be applied.

Protecting the dunes is in the best interest of property owners as it is one of Michigan’s most unique natural resources, adding both aesthetic and marketing value. however, a property owner and the Department of Environment Quality should have a common understanding on the balance between preservation and property rights. this legislation aims to restore that balance and add clarity to the permitting process.

the MAR will continue to keep you updated on when this bill becomes signed into law.

WAshington (July 19, 2012) - A proposed bill may soon help speed up the approval process for homeowners selling their home through short sale by requiring subordinate lien holders to review and respond to short sale requests within 45 days.

the legislation, “the Fast help for homeowners Act,” was offered in Congress today by u.s. Rep. Jerry Mcnerney (D-Calif.) and is strongly supported by the national Association of Realtors®.

“As the leading advocate for homeownership, Realtors® know that issues and delays with secondary lien holder remain an obstacle to streamlining the short sale process,” said nAR President Moe Veissi, broker-owner of Veissi & Associates inc., in Miami. “short sale negotiations are much more difficult for borrowers who have multiple servicers involved and ongoing delays continue to severely limit the number of homeowners who are approved for short sales, forcing many homeowners into foreclosure.”

the proposed legislation would establish guidelines requiring the primary lien holder to inform secondary and any subsequent lien holders of a request for short sale. the bill would also impose a deadline for subsequent lien holders to respond to both the primary lender and the consumer following a short sale request.

nAR has been actively pushing the mortgage servicing industry for years to improve the short sale review and approval process, especially in cases where second liens are

involved. Veissi praised Rep. Mcnerney for his efforts on the bill and urged Congress to pass it quickly.

“second mortgage lien holders frequently hold up and cancel the short sale transaction while trying to collect the largest possible payout in exchange for releasing the homeowner’s lien, even though the secondary lien holder often gets nothing if the home ends up going into foreclosure,” said Veissi. “While efforts have been made to improve primary lien holders’ response times, issues still abound with second and subsequent lien holders, and this legislation is a step in the right direction.”

Realtors® continue to report that short sale transactions are being held up due to a lack of response regarding acceptance of short sale requests. nAR wants mortgage servicers to approve reasonable short sale offers so that homeowners can avoid foreclosure, and minimize the negative impact on families, home values and neighborhoods.

nAR believes that streamlining the short sale approval process for both primary and secondary lien holders will help close more short sale transactions. “We applaud any effort to help improve the short sale process and give distressed homeowners alternatives to foreclosure,” said Veissi.

QUESTION: I recently showed a house to a client, and he expressed an interest in making an offer. Later, I showed the same property to another client, and she wants to make an offer. Have I violated the Code of Ethics?

AnsWER: First, clarify your relationship with each buyer. standard of Practice 1-2 defines a “client” as “the person(s) or entity(ies) with whom a REALtoR® or a REALtoR®’s firm has an agency or legally recognized non-agency relationship.”

if both buyers are indeed your clients, Article 1 of the Code requires that you “protect and promote the interests” of each person. if you have a written agency agreement with each of these buyers, it should specify what you are permitted to do if both want to make an offer on the same property.

Many buyer agency agreements specifically allow the agent to show or present the same property to multiple clients. if you don’t have written agreements, or if your written agreements don’t specify what your duties are in this situation, you have a possible conflict of interest.

the first client to see the property could claim that you failed to protect his interests by showing the property to the second client before he had an opportunity to make an offer. But, if you didn’t make the property available to the second client, she could claim that you didn’t give her information about a property that likely fit her needs.

in any event, you should discuss this possibility with clients when you begin working with them. it’s possible that your state agency statutes address this situation. But the best way to avoid this problem is to have a buyer agency agreement that specifies what your duties are.
