1.1 Purpose of the Document

The Industries Department, Himachal Pradesh, desires an automated system to eliminate the prevailing manual system of processes followed in the department, where the chances of human error are substantial. The current document serves as a System Requirement Specifications (SRS) for computerization of Industries Department. The amount of paper work is very bulky to handle with the current number of available staff who consequently plays multiple roles. This document provides an overview of the project for the client and a detailed specification for the system developers and designers. This document discusses the project scope, goals, parameters, target users, user interface, requirements, design issues and users' view.

1.2 Scope of Project

1.2.1.1 Study existing system of working of various wings of the Industries Department at State Headquarters, District Headquarters and field offices to assess requirement of hardware, networking and software for computerization of the Department.

Under these rules, unless the context otherwise requires: -

1.4.1 “Bonafide Himachali’ means a resident of the State of Himachal Pradesh as defined

by the Government of Himachal Pradesh from time to time.

1.4.2 “Commencement of commercial production” means the date on which the industrial

unit actually commences commercial production as certified by the Director of

Industries/General Manager, District Industries Centre/ Member Secretary, Single

Window Clearance Agency or any other officer authorized by the Director of Industries

to do so.

1.4.3 “Electricity Duty” means the electricity duty levied by the Government from time to

time, on the consumption of power by New Industrial units set up in the State.

“Enterprise” means an industrial undertaking or a business concern or any other

establishment, by whatever name called, engaged in the manufacture or production of

goods, in any manner, pertaining to any industry specified in the First Schedule to the

Industries (Development and Regulation) Act, 1951 or engaged in providing or

rendering of any service or services.

1.4.4 “Existing Industrial Unit” means an industrial unit, registered with the Industries

Department, which has been set up in the State and has commenced commercial

production before the appointed day.

1.4.5 "Export Oriented Unit" means an industrial unit set up for the purpose of exporting its

produce as defined in the Import/ Export policy of the Government of India, from time

to time, and duly approved /registered as such by the competent

1.4.6 “100% Export Oriented Unit” means such unit(s) as defined by the Government of India

from time to time.

1.4.7 “Feasibility Report” means a report on the economic and technical feasibility of an

industrial project prepared by an approved consultant or an agency

approved/recognized by the Director of Industries.

1.4.8 “Financial institution” means all scheduled commercial banks, Himachal Pradesh

Financial Corporation (HPFC); Himachal Pradesh State Industrial Development

Corporation (HPSIDC), I.C.I.C.I, I.D.B.I, S.I.D.B.I, NABARD, Co-operative Bank(s) in

the State of H.P , State KVIB, KVIC or any other institution declared to be a “financial

institution” by the Government of India under the relevant statute. It will also include

corporation(s)/institution(s) set up by the State/Central Government specifically to

assist and extend loan assistance to specific categories of entrepreneurs such as

women, SCs/STs, ex-servicemen, physically handicapped, backward classes etc..

1.4.9 “Fixed Capital Investment,” (FCI) means actual investment made in land, building,

plant and machinery by an industrial unit.

1.4.10 “Generating set” means a power plant for captive use only, installed by an industrial

unit(s).

1.4.11 “Government” means the Government of Himachal Pradesh.

1.4.12 "Himachal Pradesh Industrial Renewal Scheme, 2004 "means a scheme for rehabilitation of Small-Scale and Medium & Large scale Industrial units set up in the State, notified by the Government, and as amended from time to time.

1.4.13 “Industrial Area” means an area developed/earmarked by the Government or any of its agencies like HPSIDC, HIMUDA, HPSEDC etc. itself or in participation with private entrepreneur(s) for the establishment of industrial units including any developed plot(s) of land.

1.4.14 “Industrial Estate” means an area comprising sheds constructed by the Government or any of its agencies like HPSIDC, HIMUDA, HPSEDC etc. itself or in participation with private entrepreneur(s) for the establishment of industrial units.

1.4.15 “Medium enterprise” means an enterprise classified as such under sub-clause (iii) of clause (a) or sub-clause (iii) of clause (b) of sub-section(1) of section 7 of Micro, Small & Medium Enterprises Act,2006.

1.4.16 “Micro enterprise” means an enterprise classified as such under sub-clause (i) of clause

(a) or sub-clause (i) of clause (b) of sub-section (1) of section 7 of Micro, Small &

Medium Enterprises Act,2006.

1.4.17 “New Industrial Enterprise” means industrial enterprise registered with the Industries Department, located within the State of Himachal Pradesh which commences commercial production on or after the appointed day.

1.4.18 “Non Resident Indian”(NRI) shall have the same meaning as defined by Government of India from time to time.

1.4.19 “Power Tariff” means, only the rate of electricity per unit charged for the consumption of power, as specified from time to time under the relevant schedule of tariff by HPSEB and shall not include electricity duty, surcharge, peak load exemption charge, winter charge, fuel adjustment charge, service charge or any other charge under any name in the Tariff Schedule as may be levied by the competent authority, under its Schedule of Tariffs.

1.4.20 “Rural Area” means an area, which comprises any village or include any such area as the State Government may define in the H.P. Panchayati Raj Act,1994.

1.4.21 “Small enterprise” means an enterprise classified as such under sub-clause (ii) of

clause (a) or sub-clause (ii) of clause (b) of sub-section (1) of section 7 of Micro, Small

& Medium Enterprises Act,2006.

1.4.22 "State" means State of Himachal Pradesh .

1.4.23 “SSSBE”, “Tiny”, “Small”, “Ancillary”, “Medium and Large” industrial units shall have the same meaning as defined by the Government of India from time to time.

1.4.24 "Specified Category of Activity" means those activities which the State Government may declare under these Rules, as activities also to be provided incentives as provided for under these Rules and commence their operation for the first time after the appointed day.

1.4.25 "Special Category of Entrepreneurs" means entrepreneurs belonging to the Scheduled Caste, Schedule Tribe, Women, Ex-serviceman, Physically Handicapped person (with a disability of more than 50%), BPL family category who set up new industrial unit(s) themselves.

1.4.26 'Substantial Expansion' means the industrial unit existing before but which have

undertaken substantial expansion by way of increase in installed capacity of the

existing unit by not less than 25% of the capacity, which should be the result of

installation of additional plant and machinery and which comes into commercial

production from such expanded capacity not later than 31.3.2007 with further

fulfillment of following condition:

That such expansion shall result in additional employment of atleast 25% (excluding

contractual/sub contractual basis) of the existing manpower employed on regular basis

and further that it will continue to employ at all levels, atleast 70% of its total manpower

whether on regular basis or daily basis or contractual/sub contractual basis or by any

other mode from amongst the bonafide of Himachal Pradesh.

1.4.27 “ Tax Free Zone" means all Tribal areas notified by the competent authority of the

State Government and includes include all Tribal Development Blocks and

Development Blocks mentioned under this category in these Rules and include all

Backward Panchayats located in Blocks under the 'A' and ‘B’ Category Area and are

categorized as C category areas.

1.4.28 “Thrust Industries” means the industry as specified in Annexure-II of these Rules.

1.4.29 "Tribal areas" means the Tribal area as notified by the Government from time to time.

1.4.30 “Village Industry” means any industry, located in “rural area” in tiny sector which

produces any goods or renders any services with or without the use of power and in

which the total fixed capital investment in land, building, plant and machinery per head

of an artisan or a worker does not exceed Rs. 50,000/-.

1.4.31 DIT - Department of Information Technology

which defines how files on the World Wide Web are transferred. HTTP is the

framework for how browsers will display and use file formats.

1.4.35 SRS - A Software Requirements Specification (SRS) is a complete description

of the behavior of the system to be developed. It includes a set of processes that

describe all of the interactions that the users will have with the software.

1.4.36 GUI - Graphical User Interface is a particular case of user interfaces far interacting

with computers which uses graphical images and widget ( or control) that a computer

user interacts with, such as windows or text box.

1.4.37 Universal Resource Locator (URL). “Uniform Resource Locator”, is a string of

characters used to represent and identify a page of information on the World Wide

Web that is used by an web browser such as Netscape or Internet Explorer to find

HTTP, FTP, telnet, gopher and other resources on the Internet.

1.4.38 Web-based application - Any software program that is executed using web browser (

Internet Explorer, Firefox , Netscape).

1.4.39 World Wide Web (WWW)- World Wide Web (or simply Web for short) has two major

meanings: First, loosely used: the whole constellation of resources that can be

accessed using Gopher, FTP, HTTP, telnet, USENET, WAIS and some other tools.

Second, the universe of hypertext servers (HTTP servers), more commonly called

"web servers", which are the servers that serve web pages to web browsers.

1.5 Issues Identified The Right to Information Act,2005 provides that the Public Authorities will as far as possible keep the data in soft copy and that .

The existing manual system has many limitations as mentioned below:-

1.5.1 Store purchase

1.5.1.1 The maintenance of record is manual, cumbersome and time consuming.

1.5.1.2 Tender process is very lengthy and requires more manpower.

1.5.1.3 The preparation of comparative statements is lengthy process and is error prone.

1.5.1.4 The decision making process is lengthy.

1.5.1.5 Generation of reports is time consuming and collection of data is tedious.

1.5.2 Administration and Accounts

1.5.2.1 Budget is calculated manually which is time consuming and error prone.

1.5.2.2 Establishment Branch maintains the record of all the employees which is very bulky and it is difficult to handle.

1.5.2.3 Preparation of reports is time consuming and collection of data is tedious.

1.5.3 Industrial Development

1.5.3.1 Filing of Entrepreneurship Memorandum Part-I (EM-I) being manual process takes time.

Moreover, there is wastage of time on the part of entrepreneurs.

1.5.3.2 There is no database for expeditious decision making.

1.5.3.3 Generation of reports is time consuming and collection of data is tedious.

1.5.3.4 Most of work is done manually and hence error prone.

1.5.3.5 At present the Industries Department is running short of staff. One person has to

perform multiple tasks.

1.5.3.6 Entrepreneurs have to visit to Department for filing of EM-I & EM-II and other related

matters. It is time consuming and lengthy process. There have been initiatives by

various State Govts for online filing of EM Part-I.

1.5.3.7 The Department is implementing various employment Schemes such as Prime

Minister’s Employment Generation Programme(PMEGP), Rajiv Gandhi Udyami Mitra

Yojana (RGUMY), Rural Industries Programme etc. for the effective monitoring of

which software development is necessary.

1.5.3.8 The Department has an inventory of Office & Residential buildings and funds are

provided every year for the construction of new buildings or repair/addition to the

existing buildings. The monitoring of the progress of these works is very essential.

1.5.3.9 The Nucleus Cell has been created in the Directorate of industries under the Centrally

Sponsored Scheme “Collection of Statistics of MS&MEs”. Under this Scheme various

reports are to be provided to Govt. of India on Monthly, Quarterly basis such as Frame

list data, monthly Index of Industrial Production (IIP) data, quarterly report of

Entrepreneur’s Memoranda filed etc. Besides, reports to be sent to the State Govt.

include 20 Point Programme Report, Employment Generation Report and the data for

these reports has to be collected from the field offices of the Department. Submission

of this data needs to be web based for timely submission of these reports.

1.5.3.9 Monitoring of the Court cases of the Department is very essential and requires timely

action on the part of branch concerned. The cases need to be monitored Court-wise as

well as on the basis of pendency in various Courts.

1.5.3.10 The Department has developed 38 industrial areas and 15 industrial estates and funds

are provided every year for new works/new industrial areas as well as repair works.

These works need to be monitored for timely completion.

1.5.4 Geological and Mining:

1.5.4.1 The data about the area covered under a particular mining lease is not available at the click of button. After computerization, it will become easier to find out whether the particular khasra number is already allotted or not.

1.5.4.2 Generation of reports is time consuming and collection of data is tedious.

1.5.4.3 Most of work is done manually and hence error prone.

1.5.4.4 At present Department is running short of staff. One person has to perform multiple tasks. After computerization, efficiency of the staff will be increased as the precious time can be saved

1.5.4.5 The procedure for grant of mining lease takes about 5-6 months.

1.5.5 Sericulture

1.5.5.1 Generation of reports is time consuming and collection of data is tedious.

1.5.5.2 Most of work is done manually and hence error prone.

2.1. Background information During the period 1948-52 Himachal Pradesh was Chief Commissioner’s Province with 4 Districts

i.e. Chamba, Mahasu, Mandi & Sirmaur. The main industrial activities being carried out by the

Department during this period included weaving, carpeting, leather and tailoring centers. District

Industries Centers came into being in 1978 as a 100% centrally Sponsored Scheme and the

District Industries Officers were replaced with General Managers, District Industries Centers. The

Incentives Rules were formulated in 1971 and revised in the year 1980 , 1984, 1991, 1996, 1999

and 2004.

2.2 Organization The Industries Department is headed by the Director of Industries. The Directorate is divided

into six functional categories.

2.3 Project Perspective Propose computerized system for Industrial Development Wing, Sericulture Wing,

Handloom Wing, Geological & Mining Wing, Store Purchase Organization of the Industries

Department and propose web based software after re-engineering of the processes and

codification as per functional requirements. The softwares for Administration and Accounts

Wing, will be adopted from the common software developed for various Departments such

as Personnel Management Information System (PMIS) and On-roll Payroll system, E-

Samadhan for online monitoring of public grievances and monitoring of references

REFNIC.

2.4 User Interface

User Interface would be Web Browser (Internet Explorer, Netscape and Firefox etc). For

GUI, standard template is maintained for the uniform look, feel and functioning of the

modules. To ensure the common standards, logo of the Government of Himachal Pradesh

and Industries will be displayed on every page.

2.5 Software

The proposed system would use the following third party software components.

Operating System Server: Windows 2000 advance server or Higher. Clients: Window Windows XP or Higher Database : SQL Server 2005 Web server : IIS Tools : Visual Studio 2005 Platform : .NET

2.6 Communications Interface

The application software would use TCP/IP as network communications protocol.

The Industries Department at the State level is headed by the Industries Minister, Himachal

Pradesh. At the Secretarial Level, Principal Secretary (Industries) heads the Department. At the

Directorate level Department is headed by the Director of Industries. The Department is further

3.1 Store Purchase Organization The Store Purchase Organization is headed by the Additional Controller of Stores.

He reports to the Controller of Stores (Director of Industries) in the matters concerning Store

Purchase Organization. He is further assisted by Joint Director of Industries, Dy. Director of

Industries (SP), Store Inspection Officer (Textiles), Superintendent(s) Gr.-I, SO(F&A), ministerial

and other staff. He is further assisted by the Tehsildar (Recovery), Naib Tehsildar in the matters

of recovery of loans and land acquisition.

The State is moving from a centralized procurement regime to decentralizing the

procurement function to the respective Departments. The State Government decentralised the

purchases of stores during year 2000 and in accordance thereto the various Government

Departments have been authorised to make purchases of their own or through their

Departmental Purchase Committees for such items which are exclusively used by them

individually. As per the above said decentralised policy, it has been enjoined upon the Store

Purchase Organisation to finalise rate contracts in respect of such items as are needed by more

than one Department. However, the “Procedure and Rules regarding purchase of Stores by all

Departments of the Govt. of H.P. “ are same for all the Departments. The Store Purchase

Organisation is finalizing rate contracts in respect of the products enumerated in Annex-1 of

these rules. The items listed in Annex V of the rules may be purchased by the various

Departments themselves and this , will be done by duly constituted Department Standing

Purchase Committee( constituted with the concurrence of the Finance Department) which will

apply the same rules and procedures as by the SPO. Any item not covered by either Annex-I or

V will also fall within the procurement authority of the SPO.

The State has been selected as one of the pilot States for implementation of e-

Government Procurement under National e-Governance Plan(NeGP). This initiative is being

developed through IT Department. The planned initiative will cover supplier registration, indent

and inventory management, e-Tendering, e-Contract Management, e-Payments, Auctions, Rate

In this wing, Industrial Advisor, Joint Director of Industries, Project Coordinator and Deputy

Directors, report to the Director of Industries for the development of industries in the State. A

Nucleus Cell headed by the Deputy Director (Statistics) has been set up under the Centrally

Sponsored Scheme "Collection of Statistics of MSMEs". The Govt. of India provides pay and

allowances of five Sr. Investigators under this scheme. The Officer of this wing is further assisted

by Manager, DIC, Industrial Promotion Officer, Superintendent (s) Gr.-II, ministerial and other

staff.

3.4 Sericulture Wing:- The Sericulture Wing is headed by the Dy. Director (Sericulture) at the Directorate level. He

reports to the Director of Industries for Sericulture development. He is further assisted by

Superintendent(s) Gr.-II, ministerial and other staff.

3.5 Handloom Wing:- The Handloom Wing is headed by Industrial Advisor who reports to the Director for Handloom

(Director of Industries) and is further assisted by SIO (Textiles), Superintendent Gr.-II, ministerial

and other staff.

3.6 Geological & Mining Wing: The Geological and Mining Wing is headed by the State Geologist. He reports to the Director of

Industries for mineral exploration/regulation works. He is further assisted by Geologists, Assistant

Geologists, Superintendent Gr.- I & II, ministerial and other staff.

3.7 The organizational set up in the field offices of the Industries Department is as under:- 3.7.1 District Industries Centers:- The District Industries Centre is headed by General Managers. They are further assisted by

Managers, Industrial Promotion Officers, Economic Investigators, Extension Officers (Industries),

ministerial and other staff. In order to provide facilities to entrepreneurs close to their places of

work, Single Window Clearance Agencies (SWCAs) have been made functional at Parwanoo,

Baddi and Nalagarh in Solan District, Paonta Sahib and Kala-Amb in Sirmaur District, Gwalthai in

Bilaspur District and Sansarpur Terrace and Damtal in Kangra District.

3.7.2 Mining Offices:-

The Mining Office is headed by a Mining Officer. He is assisted by Mining Inspectors, Asstt.

Mining Inspectors, Mining Guards and ministerial and other staff. Further more, the Drilling

operation is headed by Drillers who are assisted by Asstt. Driller and Laboratory Assistant.

3.7.3 Sericulture Offices The Sericulture Wing has seven divisions. Dy. Director of Industries (Sericulture) holds the

charge of Sericulture Division Shimla. The Silk Seed Promotion Officers Class II Gazetted heads

the Sericulture Division Palampur, Nadaun and Ghumarwin, whereas Sericulture Officers Class II

Gazetted hold the charge of sericulture division Dehra and Mandi. The General Manager DIC

Nahan holds the additional charges of Sericulture Division Dhaulakuan (Dist. Sirmaur). These

Officers are further assisted by the Development Officers, Technical Officer (Tassar), Sr.

Sericulture Inspectors, Extension Officers (Tassar), Sericulture Inspectors, Technical Assistants

(Tassar), ministerial and other staff.

3.9 Functioning of Wings

3.9.1 Functioning of Store Purchase Organization (Tender Processing for Rate Contract):

The Store Purchase Organisation is finalizing rate contracts in respect of the products

enumerated in Annex-1 of Store Purchase Rules. The items listed in Annex V of the rules

may be purchased by the various Departments themselves and this will be done by duly

constituted Department Standing Purchase Committees( constituted with the concurrence

of the Finance Department) which will apply the same rules and procedures as by the

Store Purchase Organisation. Any item not covered by either Annex-I or V will also fall

within the procurement authority of the Store Purchase Organisation.

The Store Purchase Organisation does open tendering for the finalization of

rate contracts for the items in its purview. Tender is published for for the finalization of

rate contracts and for selling the condemned Machinery/vehicles/stores. Following is

the process of tendering:

3.9.1.1. Notice Inviting Tenders(NIT) is published in two leading News Papers for wide Publicity. The Schedule-A of concerned item codes are prepared. The NIT and Schedule-A are also uploaded in the website https://tenders.gov.in

3.9.1.2. Complete details including tender form and terms & conditions can be obtained from the Office of Controller of Stores, H.P., and Offices of the General Managers, District Industries Centres, in Himachal Pradesh and the Incharge, Himachal Pavilion, Pragati Maidan, New Delhi-110001 on any working day from 10 AM to 1.30 PM. The Tender Form and the schedule “A” for the item concerned can also be downloaded from website of the Industries Department under URL http://himachal.gov.in/industry or https://tenders.gov.in. Such tenderers who download the Tender form and Schedules from the website of Department will have to enclose a bank draft of Rs. 250.00 payable to the Addl. Controller of Stores at Shimla.

3.9.1.3. Earnest money of Rs. 5000/- in the shape of fixed deposit receipt duly pledged in favour of the Additional Controller of Stores, H.P. should be furnished with each tender. The tenders of the firms who have deposited permanent earnest money or are registered with this Organization as local manufacturers or Small Scale Industrial units registered with DGS&D or NSIC need not deposit this amount and in such cases the tenderer must send attested copy of the valid registration certificate for the items for which tenders have been invited.

3.9.1.4. Tender Opening Committee opens the Tenders and checks documents submitted with tender. The following documents are required to be submitted alongwith duly signed tender form:-

3.9.1.2.10. Latest Sales Tax Clearance Certificate.

3.9.1.5. Comparative Statement of rates is prepared.

3.9.1.6. Technical and Financial Scrutiny Meeting :- Technical Scrutiny of all the tenders

received is done by a committee consisting of representatives of Engineer-in-Chief,

HPPWD, I&PH Department, or the user Departments and the Controller of Stores. The

committee examines whether the tenders or samples are according to the

specifications of the NIT and Schedule-A etc. and rates are recommended on the basis

of comparison of rates in the previous year rate contract and the prevailing market

rates of items and the same are recommended for approval of ACS/COS/GOVT.

3.9.1.7 Approval of Rates:- The rates as recommended by the Technical Scrutiny Committee

are examined by the Section Officer (F&A) who compares the rates with rates finalized in

last rate contract and also examines that the proposal is as per Store Purchase Rules. If

necessary, negotiations are held with firms with lowest rates. Thereafter, the rates are

submitted for the approval of competent Authority. The Authorities for the approval of

rates are as under:-

After the approval of rates by the Competent Authorities, the Acceptance letters are

issued to the firms which are required to be returned after acceptance alongwith

agreement documents within 30 days.

3.9.1.7. Acceptance letter for execution of Agreement of rates:- The following documents are

3.9.1.8 Rate Contract:-

1. The documents submitted by the firms are checked and if the rates have been accepted

unconditionally, the rate contract is awarded to the firms which is generally valid for a

period of one year.

2. Parallel Rate Contract is being awarded to the units ho came into production after the

opening of tender in accordance with the Store Purchase Rules with the approval of State

Govt. Document. The documents required for the grant of parallel rate contract are as

under:-

concerned/MS, SWCA. 3. An attested copy of the Permanent Registration/EM Part-II.

3.9.1.9. Registration of Local manufacturing units/ Supplier Firms:

Notary Public/ Magistrate. 5. Authorization certificate from the Principal manufacturer. 6. Permanent Registration Certificate of the Principal manufacturer issued by the

concerned GMDIC. 7. Latest Sales Tax Clearance Certificate. 8. Partnership deed if the firm is registered under Partnership Act, 1932. 9. Resolution of Board of Directors in case of a Company.

3.9.1.10 Auction of condemned Machinery/ unserviceable stores: This is the process of sale

of condemned machinery/ unserviceable stores. Tenders for selling the condemned stores

follow the same process but comparative statement is prepared in the descending order

and tender is given to the firm which gives the highest price. An earnest money

(refundable) to cover 10% of total amount quoted is required with tenders, 25 % after

accepting the highest bid & remaining 65 % amount of bid amount is deposited after

acceptance of rates by the tender in the concerned department within 21 days of date of

acceptance of tender.

3.9.2 Functioning of Administration Wing.

3.9.2.1 Establishment Branch

It deals with all the service matters of the official/officer working in the Department and as such

maintains the record of all the employees in service book. Service book contains the information

i.e. date of appointment, leave account, salary, increment , promotion, penalty, date of transfer,

pay fixation etc. about an employee from the date he has joined the department to the date he is

retired. Service book is duly verified by the respective controlling authorities for preparing

pension statement. To get the maximum benefits of pension an employee should have served for

33 years qualifying service. Sanctioned strength of the different posts of the Department is pre-

defined. Vacancies for every category in the Department are filled up in accordance with the

provisions made in the R & P Rules of the respective categories, either by direct recruitment or

by promotion or both. A software called Personnel Management Information System (PMIS) has

been developed for the computerization of Service Books of the Staff and is being implemented

in the Department.

3.9.2.2 Accounts/Budget Branch:-

3.9.2.2.1. Budget estimate and budget allocation

Accounts Wings at DIC level forwards Form E (nominal role), Form ‘A’,

category wise detail of posts and detail of contingency expenditure to Head Office.

Accounts Wing at head office consolidates information of all the DICs in the Form ‘E’.

Information is extracted from Form E and three more forms are created i.e. Form ‘A’,

Form ‘C’ and Form ‘D’. All these forms along with an application form are forwarded to

State Government. Funds are released by State Government on the basis of

budget estimates. The Accounts wing is implementing On-roll Payroll System and the

other activities of the Accounts wing will also be covered with the development of

common software for such activities under computerization of Treasuries.

3.9.3 Functioning of Industrial Development Wing:-

3.9.3.1 Classification of industrial Enterprises:-

The Micro Small & Medium Enterprises Development Act,2006 classifies Industrial

enterprises into three categories i.e. micro, small and medium enterprises depending upon the

investment in plant & machinery. The enterprises having investment exceeding the limit for

medium enterprises will fall under the category of large enterprises. Further it can be divided into

manufacturing and service enterprises.

The Micro Small & Medium Enterprises Development Act,2006 came into operation from 2nd

Oct,2006, uses the word enterprises which covers both manufacturing and service activities.

However, the limit of investment is different in these categories as mentioned above. The act

also replaces provisional and permanent registrations with acknowledgement of Entrepreneur’s

Memoranda Part-I & Part-II respectively. In order to ensure expeditious clearances from the

respective Departments for the setting up of new enterprises, a State Level Single Window

Clearance and Monitoring Authority (SLSWC&MA) has been constituted under the Chairmanship

of Hon’ble Chief Minister to clear projects and ensure speedy approval from various Departments

or Agencies. In-principle approval of large and medium scale enterprises, negative listed

enterprises, forest based enterprises, extensive power consumption enterprises (power

consumption more than 1000KW) is done by SLSWC &MA.

3.9.3.3 Authorities competent to accept Entrepreneur’s Memoranda Part-I:-

An entrepreneur desirous of setting up a micro enterprise may file an entrepreneur’s

memorandum with Extension officer (Industries) at the block level. In case of Micro & Small

enterprises and Medium Enterprises, the same at SWCA level and District level. An

entrepreneur desirous of setting up a medium enterprise shall file an entrepreneur’s

memorandum at the SWCA level or District level depending upon the location where such

enterprise is to be set up.

functioning enterprise is eligible to apply for file Part-II of the Memorandum EM-II without first

3.9.3.5. Prime Minister’s Employment Generation Scheme 3.9.3.5.1 Eligibility Conditions of Beneficiaries:

(i) Any individual, above 18 years of age (ii) There will be no income ceiling for assistance for setting up projects under

PMEGP. (iii) For setting up of project costing above Rs.10 lakh in the manufacturing sector

and above Rs. 5 lakh in the business /service sector, the beneficiaries should possess at least VIII standard pass educational qualification.

(iv) Assistance under the Scheme is available only for new projects sanctioned specifically under the PMEGP.

(vi) Institutions registered under Societies Registration Act,1860; (vii) Production Co-operative Societies, and (viii) Charitable Trusts. (ix) Existing Units (under PMRY, REGP or any other scheme of Government

of India or State Government) and the units that have already availed Government Subsidy under any other scheme of Government of India or State Government are not eligible.

3.9.3.5.3 Implementing Agencies.

The scheme is being implemented by KVIC, Mumbai which will be single nodal agency

at the national level. At the State level the scheme will be implemented through State

Directorates of KVIC, State KVIBs and DICs in rural areas in urban areas the scheme is

being implemented by State DICs only.

3.9.3.5.4 Identification of beneficiaries.

The identification of beneficiaries is being done at district level by a Task Force consisting

of representatives from KVIC/ State KVIB and State DICs and Banks. The Task Force is

headed by Deputy Commissioner or his representative.

3.9.3.5.5 Entrepreneurship Development Programme. ( EDP)

Two to three weeks EDP is conducted for providing training to PMEGP beneficiaries which

includes interaction with successful entrepreneurs, banks as well as orientation through

field visits.

3.9.4. Physical verification of PMEGP units.

100 % physical verification of the actual establishment and working status of each of the

units, set up under PMEGP will be done by KVIC, through the agencies of State

Government and / or , if necessary, by out sourcing the work to professional institutes

having expertise in this area, following the prescribed procedures of Govt. of India.

3.9.4.1 A candidate fills in and submits the form for loan in the office of Extension

Officer(Industries) at Block level, in the Office Member Secretary, SWCA or in the

Office of concerned General Managers at District level or in the local Bank Branch of

Schedule Commercial bank for onward submission to the General Manager,DIC at

District level. The following documents are enclosed with the application form:

• Income Certificate issued by the Competent Authority or an affidavit on the prescribed format attested by the Notary Public/Oath commissioner.

• Proof of residing in the area for the last three years or a copy of the Ration card in support of the same.

• Copy of the Registration Certificate issued by Employment Exchange.

• Certificate of educational qualifications.

• Age proof or Educational Certificate indicating date of birth.

• Caste Certificate/ Disableness Certificate/Ex-serviceman for availing age concession.

3.9.4.2 All the candidates are interviewed by a Task Force Committee constituted at the District

Level under the Chairmanship of Deputy Commissioner. If the candidate is recommended,

a copy of the application form alongwith enclosures as mentioned above is sent to the

Scheduled Commercial Bank in whose service area the activity is to be carried out for the

sanction of loan and the other copy is kept in the DIC itself. The Bank processes the case

as per the RBI guidelines and if the activity is found viable, other codal formalities are

completed and the candidate is deputed to DIC for training. Each candidate is provided

training certificate after the successful completion of training. The loan is disbursed by the

Bank only after the candidate has undergone training.

3.9.5 Industrial Policy

3.9.5.1 Categorization of the State

The State has been classified into three categories of Areas as "A", "B", "C", depending upon its location; distance from the border of adjoining States; extent of industrial development; extent of overall backwardness of the block; resource availability and potential for employment generation for local people. The categorization into three Categories.

3.9.5.2 Category "A" Areas are areas under the Kanungo Circles falling within the

respective development blocks but excludes any Backward Panchayats which may fall

under the specifically mentioned Kanungo Circles listed as Category “A” Areas.

3.9.5.3. Category "B" Areas includes the entire area falling under the Development Blocks

indicated in the list and includes any left out areas of the Development Blocks indicated under

Category ‘A’ Areas but excludes any Backward Panchayat.

3.9.5.4 Category "C" Area (Tax Free Zones) includes all Tribal Development Blocks and

Development Blocks mentioned under this category and includes all Backward Panchayats

located in Blocks under the ‘A’ and ‘B’ Category Area.

3.9.6 Construction of Office/residential buildings of the Department:-

The Directorate of Industries is housed in the Udyog Bhavan, Shimla-1. The District

Industries Centre, Shimla is housed in Majitha House,Chota Shimla. All the District Industries

Centres are housed in Departmental Buildings. The Offices of Mining Officers are also housed in

DIC Buildings. The Extension Officers (Industries) work in the Offices of concerned Block

Development Officers. However, residential quarters have been constructed in large number of

Blocks. Except, District Shimla, residential quarters have been constructed in all the eleven

Districts and SWCAs, Baddi and Parwanoo. The Sericulture Wing has seven Divisions. The

Deputy Director (Sericulture) heads the Shimla Division besides holding the charge of the wing

at the Directorate level. Silk Seed Promotion Officers head Sericulture Divisions Nadaun,

Palampur,Ghumarwin, whereas Sericulture Officers head Sericulture Division Dehra and Mandi.

GM DIC, Sirmaur is holding additional charge of sericulture division Dhaulakauna (Dist Sirmaur).

These offices further have control over Govt. Sericulture Centres set up in various parts of the

state in districts.

The State Govt provided funds every year for the construction of new

Office/residential buildings, additions to existing Office/residential buildings as well as for the

repairs and maintenance of these buildings. The works are executed by the H.P. State Industrial

Development Corporation Ltd./ HPPWD or the BDO of the concerned Block Development

Officer. The Monitoring of these works is essential for effective utilization of these funds. The

funds are released for these works from the following Head of Accounts:-

3.9.7 RURAL INDUSTRIAL PROGRAMME / RURAL ARTISANS PROGRAMME.

The main objective of Rural Industries Programme/Rural Artisans Programme is

up-gradation of skills of rural artisans by providing them required training in improved techniques

and tools and rehabilitating them in their trades, so that they are able to increase their earnings.

The following categories of persons are eligible for assistance under this programme:-

1. All Rural Artisans and their family members.

2. All farmers who have less than 5 acres of land and their family

members.

3. All the landlesss labourers who are willing to become artisans.

4. All scheduled castes and scheduled tribes people.

The District-wise codes to be used are at Annexure-1 and the form for reporting

under the Scheme is at Annexure-2.

3.9.8 Industrial Area Development and Plot allotment:-

3.9.8.1 Industrial Area Development

The State Govt. has created basic infrastructure required for the development of industrial

activities in the State. In order to provide infrastructural facilities to the entrepreneurs, 38

industrial areas and 15 industrial estates have been developed in the State. An amount of Rs

125 crores has spent on industrial Infrastructure in the State during the last over four years.

The State Govt provided funds every year for the development of new Industrial areas

additions to existing Industrial areas as well as for the repairs and maintenance of these

Industrial areas. The works are executed by the H.P. State Industrial Development

Corporation Ltd./ HPSEB/HPPWD etc. The Monitoring of these works is essential for effective

utilization of these funds. The funds are spent for these works out of the following Head of

3.9.8.2 Plot allotment

Allotment of plots/sheds in Industrial Areas/Estates is done as per the provisions of

Industrial Policy & Incentive Rules. An application for allotment of developed/ undeveloped

plot(s)/ land for industrial purposes/ social infrastructure/ public utilities shall be made to the

concerned General Manager, District Industries Centre/Member Secretary, Single Window

Agency on a prescribed form along with earnest money in the shape of a bank draft.

Following is the process of plot allotment:-

• The Entrepreneur submits application for plot allotment alongwith a copy of EM1, project report and earnest money.

• The Project report is reviewed by Committee Members i.e. the General Manager, DIC, Executive Engineer/AE, HPSIDC, and a Manager, DIC at District level.

• The allotment of plots in Solan District is done by a Committee at the State level which is headed by the Director of Industries.

• The Committee allots plots/sheds on leasehold basis and the allotment is on first come first serve basis. Out of turn allotment can be made in favour of priority /thrust enterprises.

• The allottee signs agreement to lease, deposits 30% of the total lease amount at the time of allotment, takes possession of the plot and rest of the payment is done in installments. The lease is generally for a period of 95 years.

3.9.8.3 Land Bank

The Department of Industries, Himachal Pradesh has identified land in various District of the State and has constituted a Land Bank comprising of private and Govt. land which are available for setting up of Industries. The private land comprises of such lands whose owners have consented to sell their land to private entrepreneurs through mutual negotiation. The department of Industries, Govt. of Himachal Pradesh, will provide escort and facilitation service in case the entrepreneurs are willing to purchase such private land. 3.9.8.4 Nucleus Cell :-

The Nucleus Cell has been created in the Directorate of industries under the Centrally

Sponsored Scheme “Collection of Statistics of MS&MEs”. Under this Scheme various

reports are to be provided to Govt. of India on Monthly and Quarterly basis such as

Frame list data for the MS&MEs, monthly Index of Industrial Production(IIP) data,

Quarterly report of Entrepreneur’s Memoranda filed etc. Besides, reports to be sent to

the State Govt. include 20 Point Programme Report, Employment Generation Report

and the data for these reports has to be collected from the field offices of the

Department. Submission of this data needs to be web based for timely submission of

these reports. The product codes to be used are given in Annexure-3.

3.9.8.5 Monitoring of the Court cases:-

Monitoring of the Court cases of the Department very essential and requires timely action

on the part of branch concerned. The cases need to be monitored Court-wise as well as

on the basis of pendency in various Courts.

3.9.9 Geological & Mining Wing: For the contractor to ensure regular supply of minor minerals to public legally, grant of mining

lease is necessary. In case applicant wants to set up a stone crusher then apart from mining

lease, approval for stone crusher site is also required.

However, in rest of the cases only mining lease is required. Following is the process:

3.9.9.1 Provisional Registration of stone crushers. Firstly, applicant obtains a Provisional Registration from the Geological Wing, Department of

Industries. For this purpose, an application in Form”A” is submitted in the Geological Wing,

Department of Industries and it is accompanied by:-

(a) A fee of Rs. 2500/- (Two thousand and five hundred) only. (b) Revenue record and site plan of the land on which the stone crusher is proposed to be

installed. (A stone crusher should have a minimum working area ranging from 2-5 Bighas, depending upon

the size of the stone crusher for raising machinery/ plant and stacking of raw materials/finished

product in private land or in Govt. land after completing codal formalities and obtaining land lease

from the competent authority.)

(c) In case of private land, consent of land owner where the stone crusher is to be installed.

(d) An application for mining lease from where the minor mineral shall be used as raw

material for feeding/running the stone crusher. This area should be within 5 kms. radius of the stone crusher.

Based on these documents ‘Provisional Registration’ is issued by the Geological Wing,

Industries Department which forms the bases for obtaining pre-production clearances from other

Government Departments. State Geologist informs SDM and Mining officer to conduct joint

inspection and forwards all the relevant documents i.e. revenue record and site plan of the land

to the Mining Officer.

3.9.9.2 Joint Inspection of the areas applied for mining lease and for setting up of stone crusher.

3.9.9.2 .1 Joint Inspection of crusher site. The site for setting up the stone crusher is appraised and approved by a Joint Inspection Committee, consisting of the following Members: 1. Sub-Divisional Officer (Civil) concerned Chairman. 2. Divisional Forest Officer or his representative Member 3. Representative of the State Environment Protection & Pollution Control Board Member 4. Executive Engineer, PWD or his representative Member 5. Executive Engineer, I&PH or his representative Member 6. Representative of the Deptt. of Tourism Member 7. Representative of HPSEB –Local SDO (E) Member 8. Geologist or Mining Officer Member Secretary The Joint inspection is conducted at least by four Members viz. Chairman,

representative of H.P. State Environment Protection & Pollution Control Board, D.F.O. or his

representative and Geologist/ Mining Officer on a prescribed checklist. Other members may

issue separate NOC’s as per the check list.

3.9.9.3 Joint Inspection of the area applied for mining lease. The area applied for lease is inspected by a Committee consisting of the following members: 1. Sub-Divisional Officer (Civil) concerned Chairman. 2. Assistant Conservator of Forest/Range Officer Member 3. Representative of the State Environment Protection and Pollution Control Board Member. 4. 3.9.9.5 Recovery of royalty through M Forms:

• After the grant of mining lease mining officer issues M-Forms to lessee.

• The lessee gives royalty on the number of M-forms issued which is submitted in the

Treasury office through Treasury Challan TR-1 form.

• Information about the lessee like Date, No. of M-Forms issued, M-Form No., Book No. and

Total Amt. (Royalty) is stored in the two registers.

• First register contains information party wise and in the second register whole information

is mixed.

• During Transportation of minerals from source to destination check posts are encountered

where officials check the M-Forms and record all the dispatch information like Date, Party

Name, M-Form No., Book No. and Total Amount in the register.

• After a month this register is sent to the Mining office where this register is compared

against existing register.

• If the amount of mineral supplied exceeds the number of M-Forms issued then lessee will

have to submit required amount of royalty.

3.9.10 Functioning of Handloom Wing

3.9.10.1 Workshed Scheme for Handloom Weavers: Under this scheme, financial assistance is provided to those weavers who lack the proper workplace for weaving. Following is the process:

• The Extension Officer identifies all the weavers who do not have proper work place and makes a list which is then forwarded to GM, DIC.

• The General Manager in turn forwards the list to HO. After consolidating all the lists the next step is to obtain approval from the state government.

• When State Government gives the approval then consolidated approval, certificates and UC (utilization certificate about how money is utilized last year) is forwarded to GOI for release of funds.

• Required funds are then deposited in the account of State Government and two copies of sanction letter (funds on paper) are issued one is sent to Director of industries and other to Secretary, Finance Department.

• The Director of industries forwards moves the proposal to Administrative Department for the grant of Administrative Approval and Financial Sanction.

• The Administrative Department gets the approval of Finance Department and then Administrative Approval and Financial Sanction is conveyed to the Director of Industries for the drawal of funds from the treasury.

• On the basis of this Administrative Approval and Financial Sanction, a bill is prepared which is then sent to treasury office.

• After the bill is passed by the Treasury Office, the amount is drawn from the Bank and is sent to the concerned General Managers.

• The General Manager disburses the funds to all the Extension Officers from where all the weavers can get the funds.

5.1 Vertical connectivity

HIMSWAN (Himachal State Wide Area Network) proposes to establish a minimum of 2 Mbps

connectivity up to the block level through the PPP model as per the Implementation Option I

specified in the DIT Guidelines. This bandwidth may increase in phases to 16 mbps from one

district to another and from district headquarters to the State capital.

By setting up Himachal State Wide Area Network (HIMSWAN), the State Government

intends to modernize the communication infrastructure in the State to create a State of the art

and reliable network for G2C, G2E, G2B and G2G interfaces. The Project is aimed at providing

HIMSWAN link to Government Offices and Integrated Community Service Centres at State,

District, Sub-Divisional, Tehsil and Block headquarters in Himachal Pradesh. The HIMSWAN will

be expandable in future vertically (i.e. down to the Panchayat/ Village level) and horizontally (i.e.

all offices/ locations within the same location). There will also be adequate bandwidth provision to

meet the increasing demands of data, voice and video transmission.

5.2 Horizontal connectivity

HIMSWAN will connect Sub Division/ Tehsil/ Block headquarters to respective

District headquarter and District headquarters to State headquarter i.e. STPI Building, SDA

Complex, Shimla-9. The offices of Industries Department will be connected to the nearest POP

( Tehsil / Sub-tehsil / Block headquarters with Wireless Technology or XSDL.

GENERAL INSTRUCTIONS FOR FILING THE PART-1 OF MEMORANDUM

1. Any person who intends to establish a micro or small enterprise, at his discretion; or a

medium enterprise engaged in providing or rendering of services may, at his discretion

whereas a medium enterprise engaged in the manufacture or production of goods shall file

the Memorandum of Micro Small or Medium Enterprise, under sub-section (1) of section

8 of the Micro, Small and Medium Enterprises Development (MSMED) Act, 2006 at

District Industries Centre for all categories of enterprises or in the office of Member

Secretary, Single window Clearance Agency for Micro and Small Enterprises or with

Economic Investigator or Extension Officer (Industries) at Block Level for Micro

Enterprises under whose jurisdiction the enterprise is proposed to be located.

2. Four Copies of the memorandum should be filed. Form will be numbered by the District

Industries Centre.

3. Entrepreneurs desirous of setting up small and medium enterprise must submit two copies

of project profile/pre investment report/ project report. Micro enterprises, intending to

avail financial assistance/term loan from the financial institution/ banks should also

submit two copies of project profile/pre investment report/ project report.

4. There is no fee for processing the memorandum.

5. Existing units need not to file Part 1 of the memorandum and they should fill up only part

II of the Memorandum.

6. In case of any change in the information, at any point of time, please inform the details

within three months to District Industries Centre under whose jurisdiction the enterprise is

proposed to be located.

7. Write/Type in Block (Capital) Letters

8. Leave one Blank Box after each word.

9. Fill up whichever is applicable.

10. All codes other than Pin Code Shall be filled by the office of Industries Department.

1. This acknowledgment of Entrepreneurs Memorandum is valid for 2 years. You are required to commence production and file its EM (Part-II) within 2 years from the date of acknowledgment of EM (Part-I) failing which Ex (Part-I) shall become invalid.

2. This acknowledgment is given to enable the enterprise to obtain all facilities/ clearances etc. required for setting up an enterprise.

3. This acknowledgment does not constitute an authorization under Industrial Development & Regulation Act, 1950 or any other relevant acts or Rules of the Govt. of India and the State Govt. Wherever applicable such statutory permission or clearances as may be required under the provisions of such Acts or Rules should be obtained by the enterprise before taking any effective steps for the implementation of the enterprise

This acknowledgment does not imply any commitments whatsoever on the part of the Industries Department, Govt. of Himachal Pradesh to provide finance, raw materials, land etc. or any other assistance as may be applicable under the relevant rules and procedures which will be considered separately on merit on the request of enterprise to be made to the concerned Authorities separately.

5. The enterprise will have to employ at all level at least 70% of the total manpower or as may be prescribed form time to time to be employed in the enterprise whether on regular/ contractual/ sub- contractual/ daily basis / or any other mode from among the bonafide residents of Himachal Pradesh.

6. The enterprise shall establish the registered office of the Company in Himachal Pradesh proposed to be incorporated for undertaking the proposed manufacturing/ servicing activities in the State.

7. In case of Medium Enterprise and Enterprise listed as negative activity by Govt. of India/ State Govt, Forest produce based activity and Power intensive activity requiring more than 1000 KW power also required to obtain in Principal clearance from the State Level Single Window Clearance & Monitoring Authority (SLSWC & MA) by applying on prescribed application form.

8. If the enterprise is proposed to be located within the boundary of any Municipal Area in the building having plinth area of more than 100 sq. mtrs or outside the limit of any Municipal Area in buildings having plinth area of more than 1000 Sq. mtrs. then enterprise shall construct a roof top rain water harvesting structure of the appropriate design and dimension in the building. In case the water is to be drawn from captive tube well the installation of recharging structure in the premises of enterprise to supplement ground water resources is mandatory.

9. Any other condition(s) which may be applicable to new/ proposed enterprise at the time of filing of Entrepreneurs Memorandum in accordance with the rules and procedure applicable and as may be amended from time to time.

ENTREPRENEURS MEMORANDUM PART-II

FOR

SETTING UP MICRO, SMALL OR MEDIUM ENTERPRISE

GENERAL INSTRUCTIONS FOR FILING THE PART-II OF MEMORANDUM:

11. Any person who has established a micro or small enterprise, at his discretion; or a

medium enterprise engaged in providing or rendering of services may, at his discretion or

a medium enterprise engaged in the manufacture or production of goods shall file the

Memorandum of Micro Small or Medium Enterprise, under sub-section (1) of section 8 of

the Micro, Small and Medium Enterprises Development (MSMED) Act, 2006 at District

Industries Centre for all categories of enterprises or in the office of Member Secretary,

Single window Clearance Agency for Micro and Small Enterprises under whose

jurisdiction the enterprise is located.

12. Form will be numbered by the District Industries Centre.

13. Four Copies of the memorandum should be filed.

14. There is no fee for processing the memorandum.

15. Existing units should fill up only part II of the Memorandum.

16. Write/Type in Block (Capital) Letters

17. Leave one Blank Box after each word.

18. Fill up whichever is applicable.

19. All codes other than Pin Code Shall be filled by the District Industries Centre.

20. The following documents for grant of EM Part II should also accompany the

Memorandum:-

a. Papers in support of arrangement/ ownership of land/ building in which the

enterprise has been established.

b. List of plant and machinery giving detail regarding cost, date of purchase

and month of installation alongwith photocopies of purchase bills.

c. Power release certificate of HPSEB.

d. First raw material purchase bill.

e. First sale invoice of each product.

f. Consent to operate issued by H.P. State Environment Protection and

Pollution Control Board.
