LES HAUTES PARTIES CONTRACTANTES,

Considerant que, pour developper la cooperation entreles nations et pour leur garantir la paix et la surete, ilimporte:

d'accepter certaines obligations de ne pas recourira la guerre,

d'entretenir au grand jour ses relations interna-tionales fondees sur la justice et l'honneur,

d'observer rigoureusement les prescriptions du Droitinternational, reconnues desormais comme reglede conduite effective des Gouvernements,

de faire regner la justice et de respecter scrupuleu-sement toutes les obligations des Traites dans lesrapports mutuels des peuples organises,

Adoptent le present Pacte qui institue la Societe desNations.

ARTICLE PREMIER.

Sont Membres originaires de la Soci6te des Nations.,ceux des Signataires dont les noms figurent dans l'annexeau present Pacte, ainsi que les Etats, egalement nommeesdans l'annexe, qui auront accede au present Pacte sansaucune reserve par une d6claration deposee au Secre-tariat dans les deux mois de l'entree en vigueur du Pacteet dont notification sera faite aux Membres de la Societe.

Tout Etat, Dominion ou Colonie qui se gouverne libre-ment et qui n'est pas designe dans l'annexe peut devenirMembre de la Societe, si son admission est prononceepar les deux tiers de l'Assemblee, pourvu qu'il donnedes garanties effectives de son intention sincere d'observe:ses engagements internationaux et qu'il accepte le regle-ment etabli par la Societe en ce qui concerne ses forceset ses armements militaires et navals.

Tout Membre de la Societe peut, apres un preavis dedeux ans, se retirer de la Societe, a lacondition d'avoirrempli a ce moment toutes ses obligations internationalesy compris celles du present Pacte.

The Covenant of the League of Nations

THE HIGH CONTRACTING PARTIES,

In order to promote international co-operation and toachieve international peace and security by the acceptanceof obligations not to resort to war, by the prescriptionof open, just and honourable relations between nations,by the firm establishment of the understandings of inter-national law as the actual rule of conduct among Govern-ments and by the maintenance of justice and a scrupulousrespect for all treaty obligations in the dealings of organisedpeoples with one another,

Agree to this Covenant of the League of Nations.

ARTICLE 1.

The original Members of the League shall be those ofthe Signatories which are named in the Annex to thisCovenant and also such of those other States named inthe Annex as shall accede without reservation to thisCovenant. Such accession shall be effected by a Declara-tion deposited with the Secretariat within two monthsof the coming into force of the Covenant. Notice therofshall be sent to all other Members of the League.

Any fully self-governing State, Dominion or Colony notnamed in the Annex may become a Member of the Leagueif its admission is agreed to by two-thirds of the Assembly,provided that it shall give effective guarantees of its sincereintention to observe its international obligations and shallaccept such regulations as may be prescribed by theLeague in regard to its military, naval and air forcesand armaments,

Any Member of the League may, after two yearsnotice of its intention so to do, withdraw from the Leagueprovided that all its international obligations and all itsobligations under this Covenant shall have been fulfilledat the time of its withdrawal.

ARTICLE 2.

L'action de la Societe, telle qu'elle est definie dans lepresent Pacte, s'exerce par une Assemblee et par un Conseilassistes d'un Secretariat permanent.

ARTICLE 3.

L'Assemblee se compose de Representants des Membresde la Societe.

Elle se reunit a des epoques fixees et a tout autre mo-ment, si les circonstances le demandent, au siege de laSociete ou en tel autre lieu qui pourra etre designe.

L'Assemble connait de toute question qui rentre dansla sphere d'activite de la Societe ou qui affecte la paixdu monde.

Chaque Membre de la Societe ne peut compter plusde trois Representants dans l'Assemblee et ne disposeque d'une voix.

ARTICLE 4.

Le Conseil se compose de Representants des PrincipalesPuissances alliees et associees , ainsi que de Representantsde quatre autres Membres de la Societe. Ces quatre Mem-bres de la Societe sont designes librement par l'Assembleeet aux epoques qu'il lui plait de choisir. Jusqu'a la premieredesignation par l'Assemblee, les Representants de laBelgique, du Bresil, de l'Espagne et de la Grece sontMembres du Conseil.

Avec l'approbation de la majorite de l'Assemblee, leConseil peut designer d'autres Membres de la Societedont la representation sera desormais permanente auConseil. II peut, avec la meme approbation, augmenterle nombre des Membres de la Societe qui seront choisispar l'Assemblee pour etre represent6s au Conseil.

ARTICLE 2.

The action of the League under this Covenant shall beeffected through the instrumentality of an Assembly andof a Council, with a permanent Secretariat.

ARTICLE 3.

The Assembly shall consist of Representatives of theMembers of the League.

The Assembly shall meet at stated intervals and fromtime to time, as occasion may require, at the Seat of theLeague or at such other place as may be decided upon.

The Assembly may deal at its meeting with any matterwithin the sphere of action of the League or affecting thepeace of the world.

At meetings of the Assembly, each Member of the Leagueshall have one vote and may have not more than threeRepresentatives.

ARTICLE 4.

The Council shall consist of Representatives of thePrincipal Allied and Associated Powersl, together withRepresentatives of four other Members of the League.These four Members of the League shall be selected bythe Assembly from time to time in its discretion. Untilthe appointment of the Representatives of the fourMembers of the League first selected by the Assembly,Representatives of Belgium, Brazil, Greece and Spainshall be Members of the Council.

With the approval of the majority of the Assembly,the Council may name additional Members of the Leaguewhose Representatives shall always be Members of theCouncil; the Council with like approval may increasethe number of Members of the League to be selected bythe Assembly for representation on the Council.

The Principal Allied and Associated Powers are the following:The United States of America, ithe British Empire, France, Italyand Japan (see Preamble of the Treaty of Peace with Germany).

ARTICLE 5.

Sauf disposition expressement contraire du present Pacteou des clauses du present Traite, les decisions de l'Assembleeou du Conseil sont prises a l'unanimite des Membres dela Societe representes a la reunion.

Toutes questions de procedure qui se posent aux reu-nions de l'Assemblee ou du Conseil, y compris la d6si-gnation des Commissions chargees d'enqueter sur despoints particuliers, sont reglees par l'Assemblee ou parle Conseil et decidees a la majorite des Membres de laSociete representes h la reunion.

La premiere reunion de l'Assemblee et la premierereunion du Conseil auront lieu sur la convocation duPr6sident des Etats-Unis d'Amerique.

ARTICLE 6.

Le Secretariat permanent est etabli au siege de laSociete. Ii comprend un Secretaire general, ainsi que lessecretaires et le personnel necessaires.

Le premier Secretaire general est designe dans l'annexe.Par la suite, le Secretaire general sera nomme par leConseil avec l'approbation de la majorite de l'Assemblee.

The Council shall meet from time to time as occasionmay require, and at least once a year, at the Seat of theLeague or at such other place as may be decided upon.

The Council may deal at its meetings with any matterwithin the sphere of action of the League or affecting thepeace of the world.

Any Member of the League not represented on the Coun-cil. shall be invited to send a Representative to sit as amember at any meeting of the Council during the consi-deration of matters specially affecting the interests ofthat Member of the League.

At meetings of the Council, each Member of the Leaguerepresented on -the Council shall have one vote and mayhave not more than one Representative.

ARTICLE 5.

Except where otherwise expressly provided in thisCovenant, or by the terms of the present Treaty, decisionsat any meeting of the Assembly or of the Council shallrequire the agreement of all the Members of the Leaguerepresented at the meeting.

All matters of procedure at meetings of the Assemblyor of the Council, including the appointment of Committeesto investigate particular matters, shall be regulated bythe Assembly or by the Council and may be decided bya majority of the Members of the League represented atthe meeting.

The first meeting of the Assembly and the first meetingof the Council shall be summoned by the President ofthe United States of America.

ARTICLE 6.

The permanent Secretariat shall be established at theSeat of the League. The Secretariat shall comprise aSecretary-General and such secretaries and staff as maybe required.

The first Secretary-General shall be the person namedin the Annex; thereafter the Secretary-General shall beappointed by the Council with the approval of the majorityof the Assembly.

Les secretaires et le personnel du Secretariat sont nom-mes par le Secretaire general avec l'approbation du Conseil.

ARTICLE 7.

Le siege de la Societe est etabli a Geneve.Le Conseil peut a tout moment decider de l'etablir en

tout autre lieu.Toutes les fonctions de la Societe ou des services qui

s'y rattachent, y compris le Secretariat, sont egalementaccessibles aux hommes et aux femmes.

Les Representants des Membres de la Societe et sesagents jouissent dans l'exercice de leurs fonctions desprivileges et immunites diplomatiques.

Les batiments et terrains occupes par la Soci{te, parses services ou ses reunions, sont inviolables.

ARTICLE 8.

Les Membres de la Societe reconnaissent que le main-tien de la paix exige la reduction des armements nationauxau minimum compatible avec la securite nationale etavec l'execution des obligations internationales imposeepar une action commune.

Le Conseil, tenant compte de la situation geographiqueet des conditions speciales de chaque Etat, prepare lesplans de cette reduction, en vue de l'examen et de ladecision des divers Gouvernements.

Ces plans doivent faire l'objet d'un nouvel examen et,s'il y a lieu, d'une revision tous les dix ans au moins.

Apres leur adoption par les divers Gouvernements,la limite des armements ainsi fixee ne peut etre depasseesans le consentement du Conseil.

The secretaries and staff of the Secretariat shall beappointed by the Secretary-General with the approval ofthe Council.

The Secretary-General shall act in that capacity at allmeetings of the Assembly and of the Council.

The expenses of the Secretariat shall be borne by theMembers of the League in accordance with the apportion-ment of the expenses of the International Bureau of theUniversal Postal Union.

ARTICLE 7.

The Seat of the League is established at Geneva.The Council may at any time decide that the Seat ol

the League shall be established elsewhere.All positions under or in connection with the League,

including the Secretariat, shall be open equally to menand women.

Representatives of the Members of the League andofficials of the League when engaged on the business ofthe League shall enjoy diplomatic 'privileges and immu-nities.

The buildings and other property occupied by theLeague or its officials or by Representatives attendingits meetings shall be inviolable.

ARTICLE 8.

The Members of the League recognise that themaintenance of peace requires the reduction of nationalarmaments to the lowest point consistent with nationalsafety and the enforcement by common action of inter-national obligations.

The Council, taking account of the geographical situationand circumstances of each State, shall formulate plansfor such reduction for the consideration and action ofthe several Governments.

Such plans shall be subject to reconsideration and revi-sion at least every ten years.

After these plans shall have been adopted by the severalGovernments, the limits of armaments therein fixed shallnot be exceeded without the concurrence of the Council.

Considerant que la fabrication privee des munitionset du materiel de guerre souleve de graves objections, lesMembres de la Societe chargent le Conseil d'aviser auxmesures propres a en eviter les facheux effets, en tenantcompte des besoins des Membres de la Societe qui nepeuvent pas fabriquer les munitions et le materiel deguerre necessaires a leur surete.

Les Membres de la Societe s'engagent a echanger, dela maniere la plus franche et la plus complete, tous ren-seignements relatifs a l'echelle de leurs armements, aleurs programmes militaires et navals et a la conditionde celles de leurs industries susceptibles d'etre utiliseespour la guerre.

ARTICLE 9.

Une Commission permanente sera formee pour donnerau Conseil son avis sur l'execution des dispositions desarticles 1 et 8 et, d'une facon generale, sur les questionsmilitaires et navales.

ARTICLE 10.

Les Membres de la Soci6te s'engagent a respecter et amaintenir contre toute agression exterieure l'integriteterritoriale et l'independance politique presente de tousles Membres de la Societe. En cas d'agression, de menaceou de danger d'agression, le Conseil avise aux moyensd'assurer l'execution de cette obligation.

ARTICLE 11.

Ii est expressement declare que toute guerre ou menacede guerre, qu'elle affecte directement ou non l'un desMembres de la Societe, interesse la Societe tout entiereet que celle-ci doit prendre les mesures propres a sauve-garder efficacement la paix des nations. En pareil cas, leSecretaire general convoque immediatement le Conseil,a la demande de tout Membre de la Societe.

The Members of the League agree that the manufactureby private enterprise of munitions and implements ofwar is open to grave objections. The Council shalladvise how the evil effects attendant upon such manufac-ture can be prevented, due regard being had to the necessi-ties of those Members of the League which are notable to manufacture the munitions and implements ofwar necessary for their safety.

The Members of the League undertake to interchangefull and frank information as to the scale of their armaments,their military, naval and air programmes, and the conditionof such of their industries as are adaptable to warlikepurposes.

ARTICLE 9.

A permanent Commission shall be constituted to advisethe Council on the execution of the provisions of Articles 1and 8 and on military, naval and air questions generally.

ARTICLE 10.

The Members of the League undertake to respect andpreserve as against external aggression the territorialintegrity and existing political independence of allMembers of the League. In case of any aggression orin case of any threat or danger of such aggression, theCouncil shall advise upon the means by which this obliga-tion shall be fulfilled.

ARTICLE I 1.

Any war or threat of war, whether immediately affectingany of the Members of the League or not, is hereby declareda matter of concern to the whole League, and the Leagueshall take any action that may be deemed wise andeffectual to safeguard the peace of nations. In case anysuch emergency should arise, the Secretary-General shallon- the request of any Member of the League forthwithsummon a meeting of the Council.

It is also declared to be the friendly right of each Memberof the League to bring to the attention of the Assembly

blee ou du Conseil sur toute circonstance de nature aaffecter les relations internationales et qui menace parsuite de troubler la paix ou la bonne entente entre nations,dont la paix depend.

ARTICLE 12.

Tous les Membres de la Societe conviennent que, s'ils'eleve entre eux un differend susceptible d'entrainerune rupture, ils le soumettront soit a la procedure del'arbitrage, soit a l'examen du Conseil. Ils conviennentencore qu'en aucun cas ils ne doivent recourir a la guerreavant l'expiration d'un delai de trois mois apres la sen-tence des arbitres ou le rapport du Conseil.

Dans tous les cas prevus par cet article, la sentencedes arbitres doit etre rendue dans un delai raisonnableet le rapport du Conseil doit etre etabli dans les six moisa dater du jour oil il aura ete saisi du differend.

ARTICLE 13.

Les Membres de la Societe conviennent que s'il s'eleveentre eux un differend susceptible, a leur avis, d'une solu-tion arbitrale et si ce differend ne peut se regler de fagonsatisfaisante par la voie diplomatique, la question serasoumise integralement a l'arbitrage.

Parmi ceux qui sont generalement susceptibles de solu-tion arbitrale, on declare tels les differends relatifs al'interpretation d'un Traite, a tout point de droit inter-national, a la realite de tout fait qui, s'il etait etabli,constituerait la rupture d'un engagement international,ou a l'etendue ou a la nature de la reparation due pourune telle rupture.

La Cour d'arbitrage a laquelle la cause est soumise,est la Cour designee par les Parties ou prevue dans leursConventions anterieures.

Les Membres de la Societe s'engagent a executer debonne foi les sentences rendues et a ne pas recourir ala guerre contre tout Membre de la Societe qui s'y confor-mera. Faute d'execution de la sentence, le Conseil proposeles mesures qui doivent en assurer l'efet.

or of the Council any circumstance whatever affecting inter-national relations which threatens to disturb internationalpeace or the good understanding between nations uponwhich peace depends.

ARTICLE 12.The Members of the League agree that if there should

arise between them any dispute likely to lead to a rupturethey will submit the matter either to arbitration or toenquiry by the Council, and they agree in no case to resortto war until three months after the award by the arbitra-tors or the report by the Council.

In any case under this Article the award of the arbitratorsshall be made within a reasonable time, and the reportof the Council shall be made within six months after thesubmission of the dispute.

ARTICLE 13.The Members of the League agree that whenever any

dispute shall arise between them which they recogniseto be suitable for submission to arbitration and whichcannot be satisfactorily settled by diplomacy, they willsubmit the whole subject-matter to arbitration.

Disputes as to the interpretation of a treaty, as to anyquestion of international law, as to the existence of anyfact which if established would constitute a breach of anyinternational obligation, or as to the extent and natureof the reparation to be made for any such breach, aredeclared to be among those which are generally suitablefor submission to arbitration.

For the consideration of any such dispute, the courtof arbitration to which the case is referred shall be thecourt agreed on by the parties to the dispute or stipulatedin any convention existing between them.

The Members of the League agree that they will carryout in full good faith any award that may be renderedand that they will not resort to war against a Memberof the League which complies therewith. In the eventof any failure to carry out such an award, the Councilshall propose what steps should be taken to give effectthereto.

ARTICLE 14.

Le Conseil est charge de preparer un projet de Courpermanente de Justice internationale et de le soumettreaux Membres de la Societe. Cette Cour connaitra de tousdifferends d'un caractere international que les Parties luisoumettront. Elle donnera aussi des avis consultatifs surtout differend ou tout point dont la saisira le Conseilou l'Assemblee.

ARTICLE 15.

S'il s'eleve entre les Membres de la Societe un differendsusceptible d'entrainer une rupture et si ce differendn'est pas soumis l'arbitrage prevu a l'article 13, lesMembres de la Societe conviennent de le porter devant leConseil. A cet effet, il suffit que l'un d'eux avise de ce diffe-rend le Secretaire general, qui .prend toutes dispositionsen vue d'une enquete et d'un examen complets.

Dans le plus bref delai, les Parties doivent lui communi-quer l'expose de leur cause avec tous faits pertinents etpieces justificatives. Le Conseil peut en ordonner la publi-cation immediate.

Le Conseil s'efforce d'assurer le reglement du differend.S'il y reussit, il publie, dans la mesure qu'il juge utile,un expose relatant les faits, les explications qu'ils compor-tent et les termes de ce reglement.

Si le differend n'a pu se regler, le Conseil redige et publieun rapport, vote soit a l'unanimite, soit a la majoritedes voix, pour faire connaitre les circonstances du diffe-rend "et les solutions qu'il recommande comme les plusequitables et les mieux appropriees a l'espece.

Tout Membre de la Societe represente au Conseil peutegalement publier un expose des faits du differend et sespropres conclusions.

Si le rapport du Conseil est accepte h l'unanimite, levote des Representants des Parties ne comptant pasdans le calcul de cette unanimite, les Membres de la

ARTICLE 14.

The Council shall formulate and submit to the Members'of the League for adoption plans for the establishmentof a Permanent Court of International Justice. TheCourt shall be competent to hear and determine anydispute of an international character which the parties'thereto submit to it. The Court may also give an advisoryopinion upon any dispute or question referred to it bythe Council or by the Assembly.

ARTICLE 15.

If there should arise between Members of the Leagueany dispute likely to lead to a rupture which is not sub-mitted to arbitration as above, the Members of the Leagueagree that they will submit the matter to the Council.Any party to the dispute may effect such submissionby giving notice of the existence of the dispute to theSecretary-General, who will make all necessary arrange-ments for a full investigation and consideration thereof.

For this purpose the parties to the dispute will commu-nicate to the Secretary-General, as promptly as possible,statements of their case with all the relevant facts andpapers, and the Council may forthwith direct the publi-cation thereof.

The Council shall endeavour to effect a settlement ofthe dispute, and, if such efforts are successful, a statementshall be made public giving such facts and explanationsregarding the dispute and the terms of settlement thereofas the Council may deem appropriate.

If the dispute is not thus settled, the Council, eitherunanimously or by a majority vote, shall make andpublish a report containing a statement of the facts ofthe dispute and the recommendations which are deemedjust and proper in regard thereto.

Any Member of the League represented on the Councilmay make public a statement of the facts of the disputeand of its conclusions regarding the same..

If a report by the Council is unanimously agreed to bythe Members thereof other than the Representativesof one or more of the parties to the dispute, the Members

Societe s'engagent a ne recourir a la guerre contre aucunePartie qui se conforme aux conclusions du rapport.

Dans le cas ot le Conseil ne reussit pas a faire accepterson rapport par tous ses Membres autres que les Repre-sentants de toute Partie au differend, les Membres de laSociete se reservent le droit d'agir comme ils le jugerontnecessaire pour le maintien du droit et de la justice.

Si l'une des Parties pretend et si le Conseil reconnaitque le differend porte sur une question que le droit inter-national laisse a la competence exclusive de cette Partie,le Conseil le constatera dans un rapport, mais sans recom-mander aucune solution.

Le Conseil peut, dans tous les cas prevus aupresent article, porter le differend devant l'Assemblee.L'Assemblee devra de meme etre saisie du differenda la requete de l'une des Parties; cette requete devra etrepresentee dans les quatorze jours a dater du moment oule differend est porte devant le Conseil.

Dans toute affaire soumise a l'Assemblee, les dispositionsdu present article et de l'article 12 relatives a l'actionet aux pouvoirs du Conseil, s'appliquent egalement al'action et aux pouvoirs de l'Assemblee. II est entenduqu'un rapport fait par l'Assemblee avec l'approbation desRepresentants des Membres de la Societe representes auConseil et d'une majorite des autres Membres de la Societe,a l'exclusion, dans chaque cas, des Representants desParties, a le meme effet qu'un rapport du Conseil adoptea l'unanimite de ses Membres autres que les Representantsdes Parties.

ARTICLE 16.

Si un Membre de la Societe recourt a la guerre, contrai-rement aux engagements pris aux articles 12, 13 ou 15,il est ipso facto considere comme ayant commis un actede guerre contre tous les autres Membres de la Societe.Ceux-ci s'engagent a rompre immediatement avec luitoutes relations commerciales ou financieres, a interdire

of the League agree that they will not go to war with anyparty to the dispute which complies with the recommenda-tions of the report.

If the Council fails to reach a report which is unani-mously agreed to by the Members thereof other than theRepresentatives of one or more of the parties to thedispute, the Members of the League reserve to themselvesthe right to take such action as they shall consider necessaryfor the maintenance of right and justice.

If the dispute between the parties is claimed by oneof them, and is found by the Council to arise out of amatter which by international law is solely within thedomestic jurisdiction of that party, the Council shallso report and shall make no recommendation as to itssettlement.

The Council may in any case under this Article referthe dispute to the Assembly. The dispute shall be soreferred at the request of either party to the dispute,provided that such request be made within fourteen daysafter the submission of the dispute to the Council.

In any case referred to the Assembly, all the provisionsof this Article and of Article 12 relating to the actionand powers of the Council shall apply to the action andpowers of the Assembly, provided that a report made bythe Assembly, if concurred in by the Representativesof those Members of the League represented on the Counciland of a majority of the other Members of the Leagueexclusive in each case of the Representatives of the partiesto the dispute, shall have the same force as a report bythe Council concurred in by all the Members thereofother than the Representatives of one or more of theparties to the dispute.

ARTICLE 16.

Should any Member of the League resort to war indisregard of its covenants under Articles 12, 13 or 15, itshall ipso facto be deemed to have committed an act ofwar against all other Members of the League, whichhereby undertake immediately to submit it to the seve-rance of all trade or financial relations, the prohibitions

tous rapports entre leurs nationaux et ceux de l'Etaten rupture de pacte et a faire cesser toutes communicationsfinancieres, commerciales ou personnelles entre les natio-naux de cet Etat et ceux de tout autre Etat, Membreou non de la Socite6.

En ce cas, le Conseil a le devoir de recommander auxdivers Gouvernements interesses les effectifs militaires ounavals, par lesquels les Membres de la Societe contribue-ront respectivement aux forces armees destinies a fairerespecter les engagements de la Societe.

Les Membres de la Societe conviennent, en outre, dese preter l'un a l'autre un mutuel appui dans l'applicationdes mesures economiques et financieres a prendre en vertudu present article pour reduire au minimum les pertes etles inconvenients qui peuvent en resulter. Ils se pretentegalement un mutuel appui pour resister a toute mesurespeciale dirigee contre l'un d'eux par l'Etat en rupture depacte. Ils prennent les dispositions necessaires pour faci-liter le passage a travers leur territoire des forces de toutMembre de la Societe qui participe a une action communepour faire respecter les engagements de la Societe.

Peut etre exclu de la Societe tout Membre qui s'est renducoupable de la violation d'un des engagements resultantdu Pacte. L'exclusion est prononcee par le. vote de tousles autres Membres de la Societe representes au Conseil.

ARTICLE 17.

En cas de differend entre deux Etats, dont un seulementest Membre de la Societe ou dont aucun n'en fait partie,l'Etat ou les Etats etrangers a la Societe sont invites ase soumettre aux obligations qui s'imposent a ses Membresaux fins de reglement du differend, aux conditions esti-mees justes par le Conseil. Si cette invitation est acceptee,les dispositions des articles 12 a 16 s'appliquent sousreserve des modifications jugees necessaires par leConseil.

Des l'envoi de cette invitation, le Conseil ouvre uneenquete sur les circonstances du differend et propose

of all intercourse between their nationals and the nationalsof the covenant-breaking State, and the prevention ofall financial, commercial or personal intercourse betweenthe nationals of the covenant-breaking State and thenationals of any other State, whether a Member of theLeague or.not.

It shall be the duty of the Council in such case to recom-mend to the several Governments concerned what military,naval or air force the Members of the League shall severallycontribute to the armed forces to be used to protect theCovenants of the League.

The Members of the League agree, further, that theywill mutually support one another in the financial andeconomic measures which are taken under this Article,in order to minimise the loss and inconvenience resultingfrom the above measures, and that they will mutuallysupport one another in resisting any special measuresaimed at one of their number by the covenant-breakingState and that they will take the necessary steps to affordpassage through their territory to the forces of any ofthe Members of the League which are co-operating toprotect the Covenants of the League.

Any Member of the League which has violated anyCovenant of the League may be declared to be no longera Member of th e League by a vote of the Council concurredin by the Representatives of all the other Members of theLeague represented thereon.

ARTICLE 17.

In the event of a dispute between a Member of the Leagueand a State which is not a Member of the League, or betweenStates not Members of the League, the State or Statesnot Members of the League shall be invited to acceptthe obligations of membership in' the League for thepurposes of such dispute, upon such conditions as theCouncil may deem just. If such invitation is accepted,the provisions of Articles 12 to 16 inclusive shall be appliedwith such modifications as may be deemed necessaryby the Council.

Upon such invitation being given, the Council shallimmediately institute an enquiryinto the circumstances

telle mesure qui lui parait la meilleure et la plus efficacedans le cas particulier.

Si l'Etat invite, refusant d'accepter les obligations deMembre dela Societe, aux fins de reglement du difTerend,recourt a la guerre contre un Membre de la Societe, lesdispositions de l'article 16 lui sont applicables.

Si les deux Parties invitees refusent d'accepter les obli-gations de Membre de la Societe aux fins de reglement dudifferend, le Conseil peut prendre toutes mesures et fairetoutes propositions de nature a prevenir les hostilites eta amener la solution du conflit.

ARTICLE 18.

Tout traite ou engagement international conclu a l'ave-nir par un Membre de la Societe devra etre immediatementenregistre par le Secretariat et publie par lui aussitot quepossible. Aucun de ces traites ou engagements internatio-naux ne sera obligatoire avant d'avoir ete enregistre.

ARTIC.LE 19.

L'Assemblee pent, de temps a autre, inviter les Membresde la Societe a proceder a un nouvel examen des traitesdevenus inapplicables ainsi que des situations interna-tionales, dont le maintien pourrait mettre en peril la paixdu monde.

ARTICLE 20.

Les Membres de la Societe reconnaissent, chacun en cequi le concerne, que le present Pacte abroge toutes obli-gations ou ententes inter se incompatibles avec ses termeset s'engagent solennellement a n'en pas contracter a l'avenirde semblables.

Si, avant son entree dans la Societe, un Membre a assumedes obligations incompatibles avec les termes du Pacte,il doit prendre des mesures immediates pour se degagerde ces obligations.

of the dispute and recommend such action as may seembest and most effectual in the circumstances.

If a State so invited shall refuse to accept the obligationsof membership in the League for the purposes of suchdispute, and shall resort to war against a Member of theLeague, the provisions of Article 16 shall be applicableas against the State taking such action.

If both parties to the dispute, when so invited, refuseto accept the obligations of membership in the Leaguefor the purposes of such dispute, the Council may takesuch measures and make such recommendations as willprevent hostilities and will result in the settlement of thedispute.

ARTICLE 18.

Every treaty or international engagement entered intohereafter by any Member of the League shall be forthwithregistered with the Secretariat and shall as soon as possiblebe published by it. No such treaty or internationalengagement shall be binding until so registered.

ARTICLE 19.

The Assembly may from time to time advise the recon-sideration by Members of the League of treaties whichhave become inapplicable and the consideration of inter-national conditions whose continuance might endangerthe peace of the world.

ARTICLE 20.

The Members of the League severally agree that thisCovenant is accepted as abrogating all obligations orunderstandings inter se which are inconsistent with theterms thereof, and solemnly undertake that they willnot hereafter enter into any engagements inconsistentwith the terms thereof.

In case any Member of the League shall, before becominga Member of the League, have undertaken any obligationsinconsistent with the terms of. this Covenant, it shallbe the duty of such Member to take immediate steps toprocure its release from such obligations.

ARTICLE 21.

Les engagements internationaux, tels que les traitesd'arbitrage, et les ententes regionales, comme la doctrinede Monroe, qui assurent le maintien de la paix, ne sontconsideres comme incompatibles avec aucune des dispo-sitions du present Pacte.

ARTICLE 22.

Les principes suivants s'appliquent aux colonies etterritoires qui, a la suite de la guerre, ont cesse d'etre sousla souverainete des Etats qui les gouvernaient prece-demment et qui sont habites par des peuples non encorecapables de se diriger eux-memes dans les conditionsparticulierement difficiles du monde moderne. Le bien-etre et le developpement de ces peuples forment unemission sacree de civilisation, et il convient d'incorporerdans le present Pacte des garanties pour l'accomplissementde cette mission.

La meilleure methode de realiser pratiquement ce prin-cipe est de confier la tutelle de ces peuples aux nationsdeveloppees qui, en raison de leurs ressources, de leurexperience ou de leur position geographique, sont le mieuxa meme d'assumer cette responsabilite et qui consentent al'accepter: elles exerceraient cette tutelle en qualite deMandataires et au nom de la Societe.

Le caractere du mandat doit differer suivant le degr6de developpement du peuple, la situation geographique duterritoire, ses conditions economiques et toutes autrescirconstances analogues.

Certaines communautes, qui appartenaient autrefois al'Empire ottoman, ont atteint un degre de developpementtel que leur existence comme Nations independantes peutetre reconnue provisoirement, a la condition que les conseilset l'aide d'un Mandataire guident leur administrationjusqu'au moment ou elles seront capables de se conduireseules. Les vceux de ces communautes doivent etre prisd'abord en consideration pour le choix du Mandataire.

Le degre de developpement ou se trouvent d'autrespeuples, specialement ceux de l'Afrique centrale, exigeque le Mandataire y assume l'administration du territoire

ARTICLE 21.

Nothing in this Covenant shall be deemed to affectthe validity. of international engagements such as treatiesof arbitration or regional understandings like the MonroeDoctrine for securing the maintenance of peace.

ARTICLE 22.

To those colonies and territories which as a consequenceof the late war have ceased to be under the sovereigntyof the States which formerly governed them and whichare inhabited by peoples not yet able to stand by themselvesunder the strenuous conditions of the modern world,there should be applied the principle that the well-beingand development of such peoples form a sacred trust ofcivilisation and that securities for the performance ofthis trust should be embodied in this Covenant.

The best method of giving practical effect to this prin-ciple is that the tutelage of such peoples should be entrustedto advanced nations which, by reason of their resources,their experience or their geographical position, can bestundertake this responsibility and which are willing toaccept it, and that this tutelage should by exercised bythem as Mandatories on behalf of the League.

The character of the mandate must differ accordingto the stage of the development of the people, the geo-graphical situation of the territory, its economic conditionsand other similar circumstances.

Certain communities formerly belonging to the TurkishEmpire have reached a stage of development where theirexistence as independent nations can be provisionallyrecognised subject to the rendering of administrativeadvice and assistance by a Mandatory until such time asthey are able to stand alone. The wishes of these com-munities must be a principal consideration in the selectionof the Mandatory.

Other peoples, especially those of Central Africa, areat such a stage that the Mandatory must be responsiblefor the administration of the territory under conditions

a des conditions qui, avec la prohibition d'abus, tels quela traite des esclaves, le trafic des armes et celui de l'alcool,garantiront la liberte de conscience et de religion, sansautres limitations que celles que peut imposer le maintiende l'ordre public et des bonnes mceurs,. et l'interdictiond'etablir des fortifications ou des bases militaires ou navaleset de donner aux indigenes une instruction militaire, sice n'est pour la police ou la defense du territoire, et quiassureront egalement aux autres Membres de la Societedes conditions d'egalite pour les echanges et le commerce.

Enfin, il y a des territoires, tels que le Sud-Ouest africainet certaines iles du Pacifique austral, qui, par suite de lafaible densite de leur population, de leur superficie res-treinte, de leur eloignement des centres de civilisation, de.leur contiguite geographique au territoire du Mandataire,ou d'autres circonstances, ne sauraient etre mieux admi-nistres que sous les lois du Mandataire, comme une partieintegrante de son territoire, sous reserve des garantiesprevues plus haut dans l'interet de la population indigene.

Dans tons les cas le Mandataire doit envoyer au Conseilun rapport annuel concernant les territoires dont il ala charge.

Si le degre d'autorite, de controle ou d'administrationa exercer par le Mandataire n'a pas fait l'objet d'uneConvention anterieure entre les Membres de la Societe,il sera express6ment statue sur ces points par le Conseil.

Une commission permanente sera chargee de recevoiret d'examiner les rapports annuels des Mandataires et dedonner au Conseil son avis sur toutes questions relativesa l'execution des mandats.

ARTICLE 23.

Sous la reserve, et en conformite des dispositions desConventions internationales actuellement existantes ouqui seront ulterieurement conclues, les Membres de laSociete:

a) s'efforceront d'assurer et de maintenir des conditionsde travail equitables et humaines pour l'homme,la femme et l'enfant sur leurs propres territoires,ainsi que dans tous les pays auxquels s'.etendent

which will guarantee freedom of conscience or religion,subject only to the maintenance of public order and morals,the prohibition of abuses such as the slave trade, the armstraffic and the liquor traffic, and the prevention of theestablishment of fortifications or military and naval basesand of military training of the natives for other thanpolice purposes and the defence of territory, and willalso secure equal opportunities for the trade and commerceof other Members of the League.

There are territories, such as South-West Africa andcertain of the South Pacific Islands, which, owing to thesparseness of their population, or their small size, or theirremoteness from the centres of civilisation, or theirgeographical contiguity to the territory of the Mandatory,or other circumstances, can be best administered underthe laws of the Mandatory as integral portions of itsterritory, subject to the safeguards above mentioned inthe interests of the indigenous population.

In every case of mandate, the Mandatory shall renderto the Council an annual report in reference to the territorycommitted to its charge.

The degree of authority, control or administration tobe exercised by the Mandatory shall, if not previouslyagreed upon by the League, be explicity defined in eachcase by the Council.

A permanent Commission shall be constituted to receiveand examine the annual reports of the Mandatories andto advise the Council on all matters relating to the obser-vance of the mandates.

ARTICLE 23.

Subject to and in accordance with the provisions ofinternational conventions existing or hereafter to beagreed upon, the Members of the League:

(a) will endeavour to secure and maintain fair andhumane conditions of labour for men, womenand children, both in their own countries andin all countries to which their commercial and

leurs relations de commerce et d'industrie, et, dansce but, d'etablir et d'entretenir les organisationsinternationales necessaires;

b) s'engagent a assurer le traitement equitable despopulations indigenes dans les territoires soumisa leur administration;

c)'chargent la Societe du controle general des accordsrelatifs a la traite des femmes et des enfants, dutrafic de l'opium et autres drogues nuisibles;

d) chargent la Societe du controle general du commercedes armes et des munitions avec les pays oi le con-tr6le de ce commerce est indispensable . l'interetcommun;

e) prendront les dispositions necessaires pour assurerla garantie et le maintien de la liberte des commu-nications et du transit, ainsi qu'un equitable traite-ment du commerce de tous les Membres de la Societe,etant entendu que les necessites speciales des regionsdevastees pendant la guerre 1914-1918 devront etreprises en consideration;

f) s'efforceront de prendre des mesures d'ordre inter-national pour prevenir et combattre les maladies.

ARTICIE 24.

Tous les bureaux internationaux anterieurement etablispar traites collectifs seront, sous reserve de l'assentimentdes parties, places sous l'autorite de la Societe. Tons autresbureaux internationaux et toutes commissions pour lereglement des affaires d'interet international qui serontcrees ulterieurement seront places sous l'autorite de laSociete.

Pour toutes questions d'interet international reglees pardes conventions generales, mais non soumises au contr6lede Commissions ou de bureaux internationaux, le Secre-tariat de la Societe devra, si les parties le demandent et sile Conseil y consent, reunir et distribuer toutes informationsutiles et preter toute l'assistance necessaire ou de sirable

industrial relations extend, and for that purpose willestablish and maintain the necessary internationalorganisations;

(b) undertake to secure just treatment of the nativeinhabitants of territories under their control;

(c) will entrust the League with the general supervisionover the execution of agreements with regard tothe traffic in women and children and the trafficin opium and other dangerous drugs;

(d). will entrust the League with the general supervisionof the trade in arms and ammunition with thecountries in which the control of this traffic isnecessary in the common interest;

(e) will make provision to secure and maintain freedomof communications and of transit and equitabletreatment for the commerce of all Members of theLeague. In this connection, the special necessitiesof the regions devastated during the war of 1914-1918 shall be borne in mind;

(f) will endeavour to take steps in matters of inter-national concern for the prevention and controlof disease.

ARTICLE 24.

There shall be placed under the direction of thle Leagueall international bureaux already established by generaltreaties if the parties to such treaties consent. All suchinternational bureaux and all commissions for the regulationof matters of international interest hereafter constitutedshall be placed under the direction of the League.

In all matters of international interest which areregulated by general conventions but which are notplaced under the control of international bureaux orcommissions, the Secretariat of the League shall, subjectto the consent of the Council and if desired by the parties,collect and distribute all relevant information and shallrender any other assistance which may be necessary ordesirable.

Le Conseil peut decider de faire rentrer dans les depensesdu Secretariat celles de tout bureau ou Commission placessous l'autorite de la Societe.

ARTICLE 25.

ARTICLE 26.

Les amendements au present Pacte entreront en,vigueurdes leur ratification par les Membres de la Societe, dont lesRepresentants composent le Conseil, et par la majoritede ceux dont les Representants forment l'Assemblee.

Tout Membre de la Societe est libre de ne pas accepterles amendements apportes au Pacte, auquel cas il cessede faire partie de la Societe.

The Council may include as part of the expenses of theSecretariat the expenses of any bureau or commissionwhich is placed under the direction of the League.

ARTICLE 25.

The Members of the League agree to encourage andpromote the establishment and co-operation of dulyauthorised voluntary national Red Cross organisationshaving as purposes the improvement of health, the pre-vention of disease and the mitigation of suffering through-out the world.

ARTICLE 26.

Amendments to this Covenant will take effect whenratified by the Members of the League whose Represen-tatives compose the Council and by a majority of theMembers of the League whose Representatives composethe Assembly.

No such amendment shall bind any Member of theLeague which signifies its dissent therefrom, but in thatcase it shall cease to be a Member of the League.
