WHEREAS, the #,- Constitution of the Republic of thePhilippinesdeclares that the State shall protect and promote the i/ht tohealthof the people and instill health consciousness among them;WHEREAS, the Republic of the Philippines, under the +a0e1o2Con3ention on 'obacco Contol(FCC! to "hich she is a part#,determined to gi$e priorit# to the right to protect public health and topromote measures of tobacco control based on current and rele$antscienti%c, technical and economic considerations, and agreed to implementthe measures pro$ided in the treat#;

WHEREAS, the Local Go3en0ent Co4e of #,,# 5Republic Act No.#6"7 accords e$er# local go$ernment unit po"er and authorit# to promotethe general "elfare "ithin its territorial &urisdiction, including the promotionof health and safet# of its constituents;WHEREAS, the Philippine Clean Ai Act of #,,, 5Republic Act No.-8,7 declares the right of e$er# citi'en to breathe clean air, prohibitssmoing inside enclosed public places including public $ehicles and othermeans of transport, and directs local go$ernment units to implement thispro$ision;

WHEREAS, the 'obacco Re/ulation Act of !""9 5Republic Act No.,!##7prohibits smoing in certain public places "hether enclosed oroutdoors in certain places; prohibits the purchase and sale of cigarettes andother tobacco products to and b# minors and in certain places fre)uented b#minors; imposes bans and restrictions on ad$ertising, promotion andsponsorship acti$ities of tobacco companies; and directs local go$ernmentunits to implement these pro$isions;WHEREAS, the Ci3il Se3ice Co00ission *e0oan4u0 5CSC7 CiculaNo. # seies of !"", prohibits smoing in premises, buildings, and

grounds of go$ernment agencies pro$iding health, education or social"elfare and de$elopment ser$ices such as hospitals, health centers, schoolsand uni$ersities and colleges; pro$ides for speci%c re)uirements fordesignated smoing areas;WHEREAS, the Lan4 'anspotation +anchisin/ an4 Re/ulatoy &oa45L'+R&7 *e0oan4u0 Cicula !"",:"96 pro$ides that dri$ers and

regulate and subse)uentl# ban all tobacco ad$ertisements and sponsorships,the pro$isions onl# pro$ided a transition b# "a# of partial bans andrestrictions, and still continue to e0pose minors to tobacco ad$ertising andmareting7 An eecti$e ban on tobacco ad$ertising, promotion andsponsorship should, as recogni'ed b# Parties to the FCC inArticles

13.1and 13.2, be comprehensi$e and applicable to all tobacco ad$ertising,promotion and sponsorship7WHEREAS, in order to minimi'e ease of access and aordabilit# of tobaccoproducts, particularl# to minors, and in order to pro$ide a more supporti$een$ironment for those "ho are attempting to )uit tobacco use, there is aneed to strengthen e0isting measures on access restriction, including theregulation of sales, distribution and a$ailabilit#, and those prescribedunderArticle 16of the FCC7

"ee but not more than one (4!month, or re$oed7 Should the license>permit found to be in$iolation of this ordinance, fall outside of the &urisdiction of+apitan Cit#, the recommendation for re$ocation or suspensionof license>permit shall be for"arded to the appropriate agenc# orgo$erning bod#7 he suspension or re$ocation of thelicense>permit of the erring establishment or public con$e#anceshall onl# be lifted once all the re)uirements set forth upon re2inspection and e$aluation of the Health 3-ce,Luilding>Engineering 3-ce, Lusiness Permits and Nicensing

inspections of establishments and buildings to determine their compliance"ith the pro$isions of this 3rdinance7Regular inspection shall thereafter be conducted at least once e$er# monthor simultaneousl# "ith other regular inspections done b# the appropriate Cit#

o-ce or department, "hiche$er is more fre)uent, during normal hours ofoperation of the establishment7he inspection team shall issue a Citation icet against the establishmentupon %nding of non2compliance "ith or of an# $iolation of this 3rdinance7 ACitation icet ma# be issued for each da# that the establishment is found tobe non2compliant7Re2inspection of the establishment shall be done on an# da# after theissuance of the Citation icet, but in no case more than ten (45! calendarda#s after such issuance7 8f the establishment fails to compl# "ith the

obligations stated in the Citation icet upon re2inspection, the inspectionteam shall recommend the suspension of its license>permit, consistent"ith ection 8 "e#hereof78n the course of inspection, the inspection team ma# apprehend indi$idual$iolators and re)uest the assistance of the P
