1.1 Introduction:

Bihar Road Development Corporation Ltd. (BSRDC), Govt. of Bihar, has taken initiative of improvement of Road Network in Bihar with the assistance of Asian Development Bank (ADB). BSRDC, Government of Bihar has been entrusted with the responsibility of rehabilitation and strengthening of selected state highways (SH) under the Loan Assistance of ADB, Loan No. 2663-IND with a Supervision Consultant to be engaged in accordance with Terms of Reference. Intercontinental Consultant and Technocrats Private Limited New Delhi In JV Rodic Consultants Pvt. Ltd. has been appointed after competitive bidding as Supervision Consultant (SC) for the implementation of the three civil work packages of SH corridors in Bihar.

The project intends to widen the existing carriageway to 2-lane carriageway with earthen shoulders on each side, strengthening / reconstruction of existing pavement, rehabilitation and widening of the existing bridges, construction of new culverts, bus stops, truck parking areas, and road junctions. The existing road is mostly single lane with unpaved shoulders in rural areas having carriageway width of about 3.75 m to 5.5 m with sub-standard geometrics at many places. Overall the roadis in badly damaged shape. After completion of this package, the project road will serve a long way to the people of rural areas improving the quality of life and will enhance the business potential. The civil work package is spread over the districts of BhojpurandRohtas.ThisEnvironmental Clearance Compliance Report is concerned with the Sakkadi- Nasriganj (SH-81) sub-project road for period April 2013 to September 2013.

1.2 Project Description

The section of SH-81 starts from Sakkadi Mor on NH-30 in Bhojpur District and terminates near Nasriganj in Rohtas District having design length of 83.250 km. The major settlements on the project road areSakkadi, Chandi, Akhgaon, Chilosa, Sandesh, Virpura, Nanaur, Sahar, Andhari, Bihita, Danwar, Kachawa and Nasariganj.RiverSone runs parallel to the project road and is a good source of construction sand for the nearby areas. The road has considerable traffic volume with high proportion of non-motorized traffic in the entire stretch.

The condition of the existing road was very poor as at many places the pavement was no more exists. There were villages in regular interval with many squatters and encroachers living or doing business along the road.

This project was considered by Expert Appraisal Committee in its meeting held on 5th -6th April 2011 and formal letter for Environmental clearance was issued on 1st June 2011. The Stage-I Forest clearance was issued by ministry on 01/08/2012 and Stage-II Forest clearance was granted on 2-7-13 (File N0-8-66/2011).The Tree cutting permission and permission to start work has been issued by concerned DFOs.The Construction Contract for Improvement/ Up-gradation of was awarded to M/s Patel Engineering Limited but the contract has been terminated w.e.f 25.08.2014.After retendering Construction Contract for Improvement/ Up-gradation of has been awarded to M/s BSCPL Infrastructure Ltd. to complete balance work of Sakaddi to Sahar(44 Km) of Sakaddi – Nasirgunj Road on 24.07.2015 and M/s M.G.Contractors Pvt. Ltd to complete balance work of Sahar-Nasirgunj(39.20 Km) of Sakaddi – Nasirgunj Road on 19.06.2015.

1.3 Project Objectives:

The objective of the proposed Project is to promote economic growth and reduce poverty as well as all-round development in educational & health facilities and trade activities in the State by:

(i) Increasing the efficiency of inter-state and intra-state transport services,

(ii) Developing a sustainable road network maintenance system,

(iii) Improving BSRDC‟s governance & transparency, and

(iv) Promoting synergies in the Rural Development Programme.

1.4 Environmental Category:

The subproject is categorized as Environmental Category “B”, according to ADB‟s Environment Policy (2002).

2. Compliance status for the conditions set forth in the Environmental Clearance issued by MOEF vide File No: - 10-24/2010 –IA-III dated 1stJune 2011

5. Specific Condition Compliance Status

(i) The project indicates cutting of 1634 trees for the widening of the road. Necessary prior permission shall be obtained for cutting of trees from the competent authority. Compensatory afforestation shall be carried out as per stipulated conditions of MoEF and State Forest Division.

Tree cutting permission granted by D.F.O. Sasaram vide letter no.2492 dated 20.07.2013 & D.F.O. Bhojpur, Ara vide letter no.1400 dated 23.09.2013 and afforestation shall be carried as per condition of Forest department.

(ii) R&R shall be as per the guidelines of State/Central Government.

Being complied, payment of compensation to PAP as per relevant guidelines of State/Central Government/ADB is in progress.

(iii) Rain water harvesting including oil and grease trap shall be provided. Water harvesting structures shall be located at every 500 mts along the road. Vertical drain type rainwater harvesting structures shall be set up to minimize surface runoff losses of rainwater.

Rain water harvesting structure with Oil/ grease traps arrangement shall be constructed in due course.

(iv) IRC guidelines shall be followed for widening & up- gradation of road.

IRC Guideline has been considered in design.

(v) The responses/commitments made during public hearing shall be complied with letter and spirit.

Being complied.

(vi) All the recommendation of the EMP shall be complied.

Being complied during construction.

(vii) Green belt development shall be undertaken as suggested in EMP

(x) No ground water shall be used for the project. The project proponent shall obtain necessary permission from the State Irrigation Department before drawing water from the river sources for the purpose of the proposed construction activity.

As per CGWA policy 2009, the Infrastructure Projects are exempted for withdrawal of ground water up to 2000 cubic meter per day in alluvial plain. The river water, if required, will be drawn after obtaining necessary permission from the State Irrigation Department.

(xi) Sidewalk shall be provided along the bridges.

Sidewalks shall be provided in all the Major Brides.

(xii) The drain shall be at least 1 m. away from the toe of the embankment of the road adopting IRC Guidelines

The drains shall be constructed as per IRC Guidelines.

(xiii) Longitudinal drains shall be provided all along the project road to ensure proper drainage of the area. In addition, adequate number of under passes and culverts to act as cross drainage structures shall also be provided.

Longitudinal drains, as given in design & BOQ, being/shall be provided to ensure proper drainage of the area. Adequate number of culverts (230Nos.)shall be constructed for proper cross drainage of the area.

(xiv) The solid waste generated shall be used for rehabilitating the borrow areas.

The solid waste generated will be used for rehabilitating the borrow area after getting permission from concerned land owner.

(xv) For providing safety to the crossing animals and avoid road accidents speed breakers/rumbled strips shall be constructed at the identified locations of the animal movements. Enough hoardings and signage shall also be put up for the public and vehicles convenience.

Temporary signages shall be/ are being provided during the construction period wherever required. Permanent hoardings and signages per IRC Guideline and safety requirement will be provided before allowing the traffic on upgraded project road.

(xvi) Minimum of three times the number of trees to be cut shall be planted. It shall be ensured that the trees planted as a part of the afforestation

shall be looked after by NHAI. Tree plantation shall be of the same species/ local species and survival shall be monitored. Transplantation of trees shall be carried out wherever possible. The Tree plantation shall be taken up on the extreme end of the road.

(xvii) Necessary permission for tree felling form the concerned department shall be obtained before commencement of the project work and copies of the same shall be submitted to this Ministry.

(xviii) Adequate number of underpasses shall be provided in the habitation areas. The details of such underpasses shall be provided to the Ministry within 6 months from the date of issue of this letter.

The requirement of underpass in habitation was assessed during design and after receiving Environmental Clearance letter from the Ministry, but site conditions and specifications of State Highways do not suggest requirement of Underpass on this project road.

(xix) Necessary clearance from the State Government shall be obtained for extraction of sand from the rivers.

Sands are being/shall be procured from licensed supplier of Mining Department.

(xx) Proper signage shall be installed at appropriate locations for the convenience of the traffic movement

Signage, temporary or permanent, are being installed as per requirement of site for the convenience of traffic.

(xxi) The embankment/slopes and the slopes left after cutting shall be provided with vegetative turfing to avoid soil erosion.

It shall be provided .

(xxii) The hot mix plant shall be located at least 500 mts. away from habitation and on the barren land to avoid its adverse impact on the human population.

HMP is located 500 away from habitation.

(xxiii) Rehabilitation and payment of compensation to the project affected people (PAPs) shall be made as per the policy of the State Government.

Project Affected People (PAPs) are being compensated as per as per the policy of the State Government.

An experienced NGO has been appointed to help in carrying out this task.

(xxiv)

Noise barriers shall be provided at appropriate locations particularly in the areas where the alignment passes through inhabited area so as to ensure that the noise levels do not exceed the prescribed standards.

Noise barriers shall be provided as per EMP or wherever noise monitoring/modeling suggests its requirement.

(xxv) For road safety, IRC guidelines in respect of road signages, service roads, bus bays, inter – sections, pedestrians crossings, etc. shall be strictly adhered to.

The road safety measures and road furniture shall be provided as per IRC guidelines.

GENERAL CONDITIONS:

6. General Conditions Compliance Status

(i) Adequate provision for infrastructure facilities including water supply, fuel and sanitation must be ensured for construction workers during the construction phase of the project to avoid any damage to the environment.

Adequate facilities as per laid norms has been provided.

(ii) Appropriate measures must be taken while undertaking digging activities to avoid any likely degradation of water quality.

Proper precautions are being taken to avoid degradation of water quality during digging for road and bridge/CD construction work.

(iii) Borrow sites for each quarry sites for road construction material and dump sites must be identified keeping in view of the following:

(a) No excavation or dumping on private property is carried out without written consent of the owner.

(b) No excavation or dumping shall be allowed on wetlands, forest areas or other ecologically valuable or sensitive locations.

(c) Excavation work shall be done in close consultant with the soil Conservation and Watershed Development Agencies working in the area and

(d) Construction spoils including bituminous material and other hazardous materials

must not be allowed to contaminate water courses and the dump sites for such materials must be secured so that they shall not leach into the ground water.

(iv) The construction material shall be obtained only from approved quarries. In case new quarries are to be opened, specific approvals from the competent authority shall be obtained in this regard.

Aggregates are being/shall be procured from established licensed quarry sites owned by 3rd parties.

No new quarries have been opened for this project.

(v) Adequate precautions shall be taken during transportation of the construction material so that it does not affect the environment adversely.

The mitigation measures, as provided in EMP, to avoid adverse impact of transportation of construction material are being complied.

(vi) Borrow pits and other scars created during the road construction shall be properly leveled and treated.

Borrow pits will be rehabilitated as per the conditions agreed with landowner and other scars created during construction of road shall be made good by adopting appropriate engineering measures.

(vii) Adequate financial provision must be made in the project to implement the aforesaid safeguards.

Budgetary provisions are made in contract cost to take care of expenses on environmental management and mitigation measures including road safety/signages.

(viii) The project proponent will set up separate environmental management cell for effective implementation of the stipulated environmental safeguards under the supervision of a Senior Executive.

The Bihar State Road Development Corporation (BSRDCL) already has a separate cell for effective implementation of environmental/social safeguards related issues at CPIU/PIU level.

(ix) Full support shall be extended to the officers of this Ministry/ Regional Office at Bhubaneswar by the project proponent during inspection of the project for monitoring purposes by furnishing full details and action plan including action taken reports in respect of mitigation measures and other environmental protection activities.

All support/documents, as desired by officers of Ministry/ Regional Office at Bhubaneswar, shall be provided

the stipulated conditions.

(xi) Ministry of Environment & Forests or any other competent authority may stipulate any additional conditions or modify the existing ones, if necessary in the interest of environment and the same shall be complied with.

Any additional conditions or modification in the existing conditions as communicated by Ministry of Environment & Forests shall be complied with.

(xii) The ministry reserves rights to revoke this clearance in any of the conditions stipulated are not complied with satisfaction of the ministry.

(xiii) In the event of a change in project profile or change in the implementation agency, a fresh reference shall be made to the Ministry of Environment and Forests.

So far no change in project profile or in the implementation agency.

If there is such change same shall be communicated to the Ministry of Environment and Forests.

(xiv) The project proponent shall inform the Regional office as well as the Ministry, the date of financial closure and final approval of the project by the concerned authorities and the date of start of land development work.

The date of commencement of project work is 12th Oct, 2011 .

(xv) A copy of the clearance letter shall be marked to the concerned Panchayat /local NGO, if any from whom any suggestion/ representation has been made received while processing the proposal.

(xvi) Safety provision such as bus bays, service roads intersection improvement etc. will be carried out by the project proponent. The project proponent shall provide adequate facilitates as per IRC norms/ guidelines.

2006, including the amendments and rules made thereafter.

8 All other statutory clearance such as the approvals for storage of diesel from chief controller of Explosive, Fire Department, Civil aviation Department, Forest conservation Act,1980 and wildlife (Protection) Act,1972 etc. shall be obtained, as applicable by project proponents from the respective competent authorities.

All statutory clearances as applicable for the project shall be obtained from the concerned departments.

9 The Project proponent shall advertise in at least two local Newspapers widely circulated in the region one of which shall be in the vernacular language informing that the project has been accorded Environmental Clearance and copies of clearance letters are available with the Bihar State Pollution Control Board and may also be seen on the website of the Ministry of Environment and Forests at http:/www.envfor.nic.in.The advertisement should be made within 10 days from the date of receipt of the clearance letter and a copy of the same should be forwarded to the Regional office of this Ministry at Bhubaneswar.

10 Environmental clearance is subject to final order of the Hon‟ble Supreme Court of India in the matter of Goa Foundation Vs. Union of Indian in Wit Petition (Civil) No.460 of 2004 as may be applicable to this project.

3. Compliance Status with National /State /Local Statutory Environmental

Requirements:

BSRDC Ltd has obtained permission for tree cutting from forest department and other

permissions from the Department of Mining, Directorate of explosive, consent for

construction & operation of construction equipment such Hot Mix Plants, Stone Crushers,

Batching Plants, WMM Plants, DG sets etc shall be obtained by Civil works contractors

once a new contractor will be appointed.

implementation of environmental management and monitoring plan (EMMP) through

regular review meetings held with the environmental expert of supervision consultants and

environmental coordination. The mitigation measures identified during environmental

assessment have been incorporated in design and are being implemented during

construction. PAPs which include Squatter and Encroaches have been/are being

compensated as per ADB guidelines and Bihar State policy. Written agreements are

between land owner and contractor for all temporary lands acquired for the construction

camps, borrow areas and other project related ancillary activity. Only ground cover/shrubs

that impinge directly on the permanent works or necessary temporary works is being/have

been removed. Trees identified under the project will be/have been cut after getting

approval from Concerned Forest Department.

Debris generated due to the dismantling of the existing road been utilized for the paving of

cross roads, access roads and paving works in construction sites and campus, temporary

traffic diversions, haulage routes etc.

The Contractor has been instructed to ensure that any spoils or material unsuitable for

embankment fill will not be disposed of near any water course, agricultural land, and natural

habitat like grass lands or pastures.

Contractor is sprinkling water on unpaved surfaces to control dust particularly in sections passing through the settlement areas or habitations. They have been advised to regulate frequency of water sprinkling depending on weather conditions and the local requirements.

The construction camps are located away from the habitation. There are sufficient facilities

in Camp to ensure that the workforce are provided with an acceptable standard of living

and comfort during their stay in camp. Sufficient quantity of potable water supply is there in

every workplace/ labour camp site at suitable and easily accessible places and such

facilities are regularly maintained. The contractor provided garbage bins in the camps and

these are regularly emptied. Labor/supervisor camps also provided with adequate and

appropriate facilities for water supply, sanitation, disposal of sewage and solid waste. At

camp, first aid kits are readily available.

Although SC has assessed that the implementation of EMMP during the reporting period has been satisfactory, some areas such as safety arrangements, traffic management and usage of personal protective equipment (PPE) by the construction workers require to be improved.

5. Approach and methodology engaged for environmental monitoring of the project:

Construction work in subprojects is in progress. Government of Bihar has commissioned

the services of Intercontinental Consultants and Technocrats Pvt. Ltd. (ICT), In JV Rodic

Consultants Pvt. Ltd.to supervise the construction activity including implementation of

Environmental Management Plan by Contractor.

Concerned staff of SC regularly visit the constructions sites and report to their Team

Leader about issues/problems related to environment and non-compliance of measures as

given in EMP. Necessary directions, in case of non-compliance, are being given to the

contractors on the site and through the writings about the procedures to resolve

problems/issues or requirements.

6.Monitoring of environmental receptors/ attributes (e.g. ambient air, surface water, ground water, noise etc.):

6.1Monitoring Basis:

Besides regular on site monitoring for the implementation of Environmental Management

Plan, air quality, water quality and noise levels are required to be monitored to check if any

adverse impact is being caused by the construction activities. The monitoring of

environmental components is being carried out as per the agreed Environmental

Monitoring Plan.

6.2 Type of environmental receptor/attribute to be monitored:

The environmental attributes to be monitored include the air, noise and water quality parameters at the proposed construction sites in the sub-project corridors. In air quality the parameters monitored include SPM, RPM, SO2 and NOx. The water quality parameters for outlet water of camp include temperature, pH, BOD, COD, TSS, TDS , oil and grease and Pb. Drinking water samples are to be collected and tested to ensure that parameters are well within permissible limit as mentioned in IS:10500.

6.3 Monitoring Results and Correlation with Statutory Requirements at

National/State/Local Levels:

During reporting period Environmental monitoring for Air, Water and Noise parameters, for

this package has been carried out in the month of Feb 2016 to ensure that plants and

machineries working on project do not pollute the surrounding environment. The values of

all the air quality parameters, water and Noise levels, observed at all the sites, are within

the permissible/regulatory limits.

7.Any other environmental aspects, impacts observed during implementation which was not covered earlier:

No such aspect/impact observed during the period.

8.Details of complaints received from public and actions taken thereof to resolve:

BSRDC has established a grievance redressal cell. However no complaint was received

from public or any other during this period.
