The GeneralAssemblyof the Commonwealthof Pennsylvaniaherebyenactsasfollows:
PART IGENERAL PROVISIONS
Section 101. Shorttitle.—This actshall beknown andmaybe cited astheGeneralAppropriationAct of2003.
Section102. Deflnitions.—Thefollowing wordsandphraseswhenusedin this actshall havethe meaningsgivento them in this sectionunlessthecontextclearlyindicatesotherwise:
“Employees.” Includesall directors,superintendents,bureauor divisionchiefs, assistant directors, assistant superintendents,assistant chiefs,experts,scientists,engineers,surveyors,draftsmen,accountants,secretaries,auditors, inspectors,examiners,analysts, statisticians,marshals,clerks,stenographers,bookkeepers,messengersand other assistantsin anydepartment,boardor commission.
“Estimatedendingunreservedfund balance.” For purposesof section212only, fundscategorizedas undesignatedandunreservedas defmedbythe Departmentof Educationas of theeffective dateof this section,heldinthegeneralfund accountsof a schooldistrict andprojectedfor thecloseoftheschoolyearfor whichaschooldistrict’s budgetwasadopted.
“Expenses”and “maintenance.” Includes all printing, binding andstationery, food and forage, materials and supplies, traveling expenses,training,motor vehiclesuppliesand repairs,freight, expressandcartage,postage, telephonesand telegraph rentals and toll charges,newspaperadvertisingandnotices,publicadvertisingby or throughanymedium,fuel,light, heat,powerandwater,minor constructionandrenovation,repairsorreconstructionof equipment,buildingsand facilities, rentof real estateandequipment,premiumson workers’ compensation,insurancepremiumsonpolicies of liability insurance,insurancepremiums on medicalpaymentinsuranceand suretybonds for volunteerworkers,premiumson employeegrouplife insuranceandemployeeandretiredemployeegrouphospitalandmedical insurance,paymentof Commonwealthshare of Social Securitytaxes and unemployment compensationcosts for State employees,thepurchaseof replacementor additional equipmentand machineryand allotherincidental costsandexpenses,including paymentto the Departmentof GeneralServicesof mileageandotherchargesfor theuseof automobilesandrental paymentsfor permanentlyassignedautomobilesandof expensesor costs of services incurred through the PurchasingFund. The term

“expenses”alsoshallinclude themedicalcostsfor thetreatmentof inmatesof State institutionswhen the inmatemust be transferredto an outsidehospital,providedthat in no caseshall the State institution pay more forpatientcarethanthatprovidedunderthe Statemedicalassistanceprogram.
Section 103. Abbreviations.—Thefollowing abbreviationswhenusedinthis act shall havethe meaningsgiven to them in this section unlessthecontextclearlyindicatesotherwise:

Stateappropriations.—(a)GeneralFund.—Thefollowing
sumsset forth in this act, or as much thereofas may be necessary,arehereby specifically appropriatedfrom the GeneralFund to the severalhereinafter named agenciesof the Executive, Legislative and JudicialDepartmentsof the Commonwealthfor the paymentof salaries,wagesorothercompensationandtravel expensesof the duly electedor appointedofficers and employeesof the Commonwealth,for the paymentof feesforcontractualservicesrendered, for the purchaseor rental of goods andservices,printing, public advertisingby or throughanymedium,equipment,landandbuildingsandfor paymentof any otherexpenses,asprovided by

law or by this act,necessaryfor theproperconductof the duties,functionsand activitiesand for thepurposeshereinaftersetforth for the fiscal yearbeginningJuly 1, 2003,andfor thepaymentof bills incurredandremainingunpaidat thecloseof thefiscalyearendingJune30,2003.
(b) StateLotteryFund.—Thefollowing sumsset forth in this act,or asmuchthereofasmaybenecessary,areherebyspecificallyappropriatedfromthe StateLottery Fund to the severalhereinafternamedagenciesof theExecutiveDepartmentof the Commonwealthfor the paymentof salaries,wagesor other compensationand travel expensesof the duly appointedofficers andemployeesof the Commonwealth,for the paymentof feesforcontractualservicesrendered,for the purchaseor rental of goods andservicesandfor paymentof any otherexpenses,as providedby law or bythis act, necessaryfor the proper conductof the duties, functionsandactivities and for the purposeshereinafterset forth for the fiscal yearbeginningJuly 1, 2003,andfor thepaymentof bills incurredandremainingunpaidatthecloseof thefiscal yearendingJune30,2003.
(C) EnergyConservationandAssistanceFund.—Thefollowing sumssetforth in this act, or as much thereof as may be necessary,are herebyspecifically appropriatedfrom the Energy Conservationand AssistanceFundto theseveralhereinafternamedagenciesof theExecutiveDepartmentof the Commonwealthfor the paymentof fees for contractualservicesrendered,for the purchaseor rental of goods and servicesand for thepaymentof anyotherexpenses,asprovidedby law or by this act,necessaryfor the properconductof the duties, functionsandactivities and for thepurposeshereinafterset forth for thefiscal yearbeginningJuly 1, 2003,andfor the paymentof bills incurredand remainingunpaidat the closeof thefiscalyearendingJune30,2003.
(d) Judicial ComputerSystemAugmentationAccount.—Thefollowingsums set forth in this act, or as much thereofas may be necessary,arehereby specifically appropriated from the restricted receipt accountestablishedwithin the GeneralFund, known as the Judicial ComputerSystem Augmentation Account, to the Judicial Department of theCommonwealthfor the paymentof salaries,wagesor other compensationand travel expenses,for the paymentof fees for contractual servicesrendered,for the purchaseor rental of goods and servicesand for thepaymentof anyotherexpenses,asprovidedby law or by thisact,necessaryfor the proper conductof the duties,functionsand activities and for thepurposeshereinaftersetforth for thefiscalyearbeginningJuly 1, 2003,andfor the paymentof bills incurredandremainingunpaidat the closeof thefiscal yearendingJune30,2003.
(e) EmergencyMedical ServicesOperatingFund.—Thefollowing sumsset forth in this act, or as much thereofas may be necessary,areherebyspecificallyappropriatedfrom the EmergencyMedical ServicesOperatingFundtothe severalhereinafternamedagenciesof theExecutiveDepartmentof the Commonwealthfor the paymentof fees for contractualservices

rendered,for the purchaseor rental of goods and servicesand for thepaymentof any otherexpenses,asprovidedby law or by thisact,necessaryfor the proper conductof the duties, functionsand activitiesand for thepurposeshereinafterset forth for the fiscalyearbeginningJuly 1, 2003,andfor the paymentof bills incurredandremainingunpaidat the closeof thefiscalyearendingJune30,2003.
(I) The StateStoresFund.—Thefollowing sumsset forth in this act, orasmuch thereofas may be necessary,areherebyspecifically appropriatedfrom The State Stores Fund to the hereinafternamed agency of theExecutiveDepartmentof the Commonwealthfor the paymentof salaries,wagesor other compensationand travel expensesof the duly appointedofficers and employeesof the Commonwealth,for the paymentof feesforcontractualservicesrendered,for the purchaseor rental of goods andservicesandfor thepaymentof anyotherexpenses,asprovidedby law or bythis act, necessaryfor the proper conductof the duties, functions andactivities and for the purposeshereinafter set forth for the fiscal yearbeginningJuly 1, 2003,andfor thepaymentof bills incurredandremainingunpaidatthecloseof the fiscalyearendingJune30,2003.
(g) Motor LicenseFund.—Thefollowing sums,or as muchthereofasmaybe necessary,areherebyappropriatedfrom the Motor LicenseFundtothe hereinafter named agenciesof the Executive Department for thepaymentof salaries,wagesandother compensationandtravel expensesofthe dulyelectedor appointedofficers andemployeesof theCommonwealth,for contractualservicesandotherexpensesnecessaryfor theproperconductof the duties, functionsandactivities for the purposeshereinafterset forthfor the fiscal year beginning July 1, 2003, and for the paymentof billsincurredand remainingunpaidat the close of the fiscal yearendingJune30,2003.
(h) Aviation RestrictedRevenueAccount.—Thefollowing sums,or asmuch thereof as may be necessary,are herebyappropriatedfrom theAviation RestrictedRevenueAccount in the Motor License Fund to thehereinafternamedagenciesof the ExecutiveDepartmentfor the purposesset forth herein for the fiscal year beginning July 1, 2003, and for thepaymentof bills incurredandremainingunpaidat the close of the fiscalyearendingJune30, 2003.
(i) HazardousMaterial ResponseFund.—Thefollowing sumssetforthin this act,or as muchthereofas maybe necessary,areherebyspecificallyappropriatedfrom the HazardousMaterial ResponseFund to the severalhereinafter named agencies of the Executive Department of theCommonwealthfor the paymentof feesfor contractualservicesrendered,for the purchaseor rental of goodsandservicesandfor the paymentof anyotherexpenses,asprovided by law or by this act, necessaryfor the properconduct of the duties, functions and activities and for the purposeshereinafterset forth for the fiscal yearbeginningJuly 1, 2003, andfor the

paymentof bills incurredandremainingunpaidat the closeof the fiscalyearendingJune30,2003.
(j) Milk MarketingFund.—Thefollowing stunsset forth in this act, oras much thereofas may be necessary,areherebyspecificallyappropriatedfrom the Milk MarketingFundto the severalhereinafternamedagenciesofthe Executive Departmentof the Commonwealth for the paymentofsalaries,wages or other compensationand travel expensesof the dulyappointedofficersandemployeesof theCommonwealth,for thepaymentoffees for contractualservicesrendered,for the purchaseor rental of goodsandservicesandfor thepaymentof anyotherexpenses,asprovidedby lawor by thisact, necessaryfor the properconductof theduties, functionsandactivities and for the purposeshereinafterset forth for the fiscal yearbeginningJuly 1, 2003,andfor thepaymentof bills incurredandremainingunpaidatthecloseof thefiscal yearendingJune30,2003.
(k) HomeInvestmentTrustFund.—.Thefollowing sumsset forth in thisact, or as much thereof as may be necessary,are hereby specificallyappropriatedfrom the Home InvestmentTrust Fund to the hereinafternamedagenciesof theExecutiveDepartmentof theCommonwealthfor thepaymentof salaries,wagesor othercompensationandtravel expensesof theduly appointedofficers and employees of the Commonwealth,for thepaymentof feesfor contractualservicesrendered,for thepurchaseor rentalof goods and servicesand for the paymentof any other expenses,asprovided by law or by this act, necessaryfor the proper conductof theduties,functionsandactivitiesandfor thepurposeshereinafterset forth forthefiscal yearbeginningJuly 1, 2003,andfor thepaymentof bills incurredandremainingunpaidatthecloseof thefiscal yearendingJune30, 2003.
(1) Tuition PaymentFund.—Thefollowing sumsset forth in this act, oras much thereofas may be necessary,are herebyspecificallyappropriatedfrom the Tuition PaymentFundto the hereinafternamedagenciesof theExecutiveDepartmentof the Commonwealthfor the paymentof salaries,wagesor other compensationand travel expensesof the duly appointedofficers andemployeesof the Commonwealth,for the paymentof fees forcontractualservices rendered,for the purchaseor rental of goods andservicesandfor thepaymentof anyotherexpenses,asprovided-by-law-orbythis act, necessaryfor the proper conductof the duties, functionsandactivities and for the purposeshereinafterset forth for the fiscal yearbeginningJuly 1, 2003,andfor thepaymentof bills incurredandremainingunpaidatthecloseof thefiscal yearendingJune30,2003.
(m) Banking DepartmentFund.—Thefollowing sumsset forth in thisact, or as much thereof as may be necessary,are hereby specificallyappropriatedfrom the Banking DepartmentFundto the hereinafternamedagenciesof the Executive Departmentof the Commonwealth for thepaymentof salaries,wagesor othercompensationandtravelexpensesof theduly appointed officers and employeesof the Commonwealth, for thepaymentof feesfor contractualservicesrendered,for thepurchaseor rental

of goods and servicesand for the paymentof any other expenses,asprovided by law or by this act, necessaryfor the proper conduct of theduties,functionsandactivitiesandfor thepurposeshereinafterset forth forthe fiscal yearbeginningJuly 1, 2003,andfor thepaymentof bills incurredandremainingunpaidatthecloseof thefiscalyearendingJune10,2003.

(d) Preventive Health and Health Services Block Grant.—ThePreventiveHealth andHealth ServicesBlock Grant (PHHSBG)is for theprovision of preventive health and other health services related toemergencymedicalsystems,healthinitiative grants,comprehensivepublichealth,hypertension,fluoridation, healtheducation,risk reduction,homehealth,rapecrisisanddomesticviolenceservices.
(e) Maternaland Child Health ServicesBlock Grant.—TheMaternaland Child Health ServicesBlock Grant (MCHSBG) is to enablestatestomaintain and strengthen their leadership in planning, promoting,coordinatingand evaluatinghealth care for pregnantwomen, mothers,infants and children,and children with specialhealthcare needsand inprovidinghealthservicesfor mothersandchildren whodo not haveaccesstoadequatehealthcare.
(I) Low-Income Home Energy AssistanceBlock Grant.—TheLow-IncomeHomeEnergyAssistanceBlock Grant (LIHEABG) is tohelplessenthe impact of the high cost of energy on low-income families andindividuals, including energyefficiencygrantsfor low-income dwellings.No less than 15% of the LIHEABG funds receivedshall be used forweatherization.LIFIEABG fundsreceivedpursuantto aPresidentialrelease

Section 1902. Limitation on encumbering or spending Federalfunds.—Federalfundsshall be encumberedor spentonly to the extentthatsuchfunds are estimatedas being availableduring the fiscal year of theCommonwealth.
Section 1903. Appropriation of prior unspentFederalfunds.—AnyFederalmoneywhich hasbeen previously appropriatedby the GeneralAssembly and authorizedor allocated by the FederalGovernmentbutremainsunspentfrom prior fiscal yearsand will not be renewedfor fiscalyear2003-2004is herebyappropriated.
Section 1904. Subgrants between Federal fundappropriations.—Subgrantsmay be madebetweenappropriationswithoutfurtherapprovalof theGeneralAssembly.The Secretaryof theBudgetshallsubmita list of subgrantsto the chairmanand minoritychairmanof theAppropriationsCommitteeof the Senateand the chairmanand minoritychairmanof the AppropriationsCommitteeof the Houseof Representativesquarterly.No subgrantto a Stateagency,however,may be madefrom arestrictedreceiptaccountwithout a specific appropriationby the GeneralAssembly.
Section 1905. Utilization of emergencyFederalfunds.—(a) Federalfundsavailablefor costs and damagesresulting from natural disastersorcivil disobediencemaybeaddedto an appropriationcontainedin thisactorto funds appropriatedor may be used for the purposesprescribedby theFederalGovernment.
(b) In addition to the moneysappropriatedby this act, all moneysreceivedfrom theFederalGovernmentfor thepurposeof disasterassistanceor relief, or othermoneysreceivedas a direct resultof terroristactsandmoneysfor homelandsecurityand defense,shall be paid into the GeneralFund and are hereby appropriated out of the General Fund to thedepartments,boards,commissionsor agenciesdesignatedby theGovernor.
(c) In the event of any emergencysituation in which the GeneralAssemblycannotact in sufficient time, the Governoris authorizedthroughexecutiveauthorizationto provide up to $10,000,000in Federalfunds toalleviate the emergencysituation. For the purposes of this section,“emergency” is defmedas any situation in which thereis a chanceof orwhichmayresult in substantialhumansuffering.
Section 1906. Transfer of funds from TANFBG to CCDFBG andSSBG.—Inaccordancewith Federallaw whichpermitsthetransferof fundsfrom theTANFBG to the CCDFBGand SSBG,the Departmentof PublicWelfare, upon approvalof the Secretaryof the Budget, may makesuchtransfersof funds,providedthatanysuchtransferwill not result in a deficitin anyappropriationfrom whichfundsare transferred.The Secretaryof the

Section 2007. Appellatecourtsappropriationcontingency.—Thefundsappropriatedin PartII to the Supreme,SuperiorandCommonwealthCourtsfor justice andjudge expensesare contingentupon a voucheredexpenseaccountplanbeingcontinuedby theSupremeCourt.

Section2008. Transferof excessfunds.—TheGovernor may transferany excessmoneyin thosefundsreceivingproceedsof CommonwealthofPennsylvaniageneralobligationbondsin excessof theamountnecessaryforthe purposesfor which the bonds were issuedto the appropriatesinkingfund for paymentof debtservicedueon outstandingbonds.If suchexcessfunds, together with any available balance,exceedthe amount of debtserviceremainingto be paid, thefundsshall be transferredto the GeneralFundor to theappropriatespecialfundresponsiblefor suchdebtservice.
Section 2009. Transfer of funds by the SupremeCourt.—(a) TheSupremeCourt maytransferanyexcessfundsappropriatedin sections281,285, 286, 287and 291 to theJudicial Departmentin Part II to theJudicialComputer AugmentationAccount during the month of June 2004. Notransfermaycreateor increaseadeficiencyin theappropriationfrom whichthe transferis made.WhenevertheSupremeCourtmakesa transferunderthis subsection,the SupremeCourt shall give written notification to theSecretaryof theBudgetandchairmanandminoritychairman-oftheSenateCommitteeon Appropriationsandthechairmanandtheminority chairmanof theHouseof RepresentativesCommitteeon Appropriationstendayspriorto any transferwhich shall alsoincludecertification thatsuchtransferwillnot resultin adeficit in anyappropriation.

TheDepartment of Education may withholdwhateverfunds appropriatedherein it feelsnecessaryto ensurethat such audit reportsaresubmittedin theprescribedfashion.
