Kolberg-Pioneer, Inc (“KPI”), Johnson Crushers International, Inc (“JCI”), or Astec Mobile Screens, Inc , as applicable, warrants the PRODUCTS (defined to include new machinery, parts and/or accessories) it manufactures (as a “Manufacturer”) to the extent set forth herein (the “Warranty”) to first end-users who purchase the PRODUCTS directly from Seller (“Seller” is defined as the company, among KPI, JCI or Astec Mobile Screens that issues the Order Acknowledgement for PRODUCTS that are subject to the Warranty; a Seller may be a Manufacturer) Manufacturer extends this same Warranty to authorized Dealers who purchase the PRODUCTS from Seller for resale, and such Dealers are authorized to extend this same Warranty (and no other) to each purchaser of the PRODUCTS at the time of sale and to notify each purchaser of the terms and conditions of this Warranty Dealer is not authorized by KPI, JCI or Astec Mobile Screens to make any other, different, or additional warranty on behalf of KPI, JCI or Astec Mobile Screens, and any such warranty given by Dealer is not binding on KPI, JCI or Astec Mobile Screens Dealer shall hold KPI, JCI and Astec Mobile Screens harmless from any claim, loss and/or costs (including attorneys’ fees) arising from failure to observe these conditions

Manufacturer warrants, commencing with the date of receipt of the goods by first end-user and for a period of one (1) year or two thousand (2,000) hours of use, whichever comes first, all new PRODUCTS manufactured by Manufacturer to be free from defects in workmanship and material* Immediately upon discovery of any alleged defect, notice must be provided in writing by Buyer to Seller and Manufacturer and in no event will any claim be accepted that is made more than thirty-six (36) months after the date of shipment of the new PRODUCTS to the Dealer or to the first end user, in the case of a direct sale If, within such warranty period, any PRODUCT shall be proved to the satisfaction of Manufacturer to be defective, it shall be replaced or, at the option of Manufacturer, repaired at its factory, providing the defective PRODUCTS are returned to Manufacturer’s manufacturing plant, freight prepaid At its option, Manufacturer may repair, or arrange to have repaired, any defective PRODUCTS at the location of the Dealer, at the yard location or operating site of the first end-user, or at any other suitable location, at no charge to first end-user and at no charge to Dealer other than those specified in its Dealer’s Agreement The right to have defective PRODUCTS repaired or replaced shall constitute Dealer’s and first end-user’s sole and exclusive remedy Repair or replacement of PRODUCTS pursuant to this warranty shall not extend or renew the original warranty period for any PRODUCTS repaired or replaced Any PRODUCTS repaired or replaced under this warranty (including any replacement machinery or part) will be warranted for the remaining warranty period only

Manufacturer, through Seller, may, at its sole discretion, refund the purchase price of the defective PRODUCTS in lieu of repairing or replacing them, providing the defective PRODUCTS are returned to Manufacturer’s manufacturing plant, freight prepaid, and providing such return is authorized in advance by Manufacturer Manufacturer may, at its sole discretion, waive the requirement that defective PRODUCTS be returned to its factory in connection with a warranty claim

An end user-purchaser or Dealer who ships PRODUCTS to the factory for inspection and possible quotation for repair must agree to the terms of the repair and quotation within thirty days If not, the PRODUCTS must be moved and shipped from the factory at the expense of the end user-purchaser or Dealer, otherwise a storage fee will be charged equal to $2 50 U S per square foot per month or part thereof

It is Manufacturer’s policy that all returns are shipped prepaid, DDP- Yankton, South Dakota USA, Eugene, Oregon USA, or Sterling, Illinois USA as applicable All transportation and clearance fees at the origin and destination are the responsibility of the returning party Neither Seller nor Manufacturer is responsible for any penalties due to the inappropriate Customs filings, including ISF KPI, JCI and Astec Mobile Screens Return Authorization must be completed prior to return, and a pre-advice of the return routing must be furnished to Manufacturer prior to making the return goods shipping arrangements

IMPORTANT NOTICE: New U S Customs ISF Enforcement: As of January 26th, 2010, U S Customs is imposing a penalty up to $5,000 for failure to file a proper ISF transmission on ocean shipments coming into the U S There are also penalties for failure to file timely and accurately If you need assistance in this matter, or with clearing the shipments through U S Customs, contact Seller

The obligation of Manufacturer under the terms of this Warranty is limited to the described repair or replacement of defective PRODUCTS by Manufacturer With regard to machinery, parts or accessories which are furnished but not manufactured by Seller or Manufacturer, the warranty obligation of the original equipment Manufacturer shall be passed through to the customer or Dealer but not otherwise warranted by Seller or Manufacturer No warranty shall apply to any used machinery or parts No warranty shall apply to the PRODUCTS of Manufacturer which, in its opinion, have been adversely affected by the use, on or with its products, of parts, attachments, equipment or lubricants not manufactured or authorized by Manufacturer

Manufacturer reserves the right to make any design changes, or added improvements to its PRODUCTS at any time without incurring any obligation to make or install the same on units previously delivered

No warranty shall apply to PRODUCTS which have been furnished, repaired or altered by others so as (in the opinion of Manufacturer) to have affected the same adversely No warranty shall apply to PRODUCTS which (in the opinion of Manufacturer) have been subject to accident, negligence, or improper operation, installation, maintenance, storage, care or other-than-normal use including without limitation operating same outside the normal range of design limits, during and after shipment Any parts or labor furnished by Manufacturer, or other expenses incurred, in anticipation of a warranty claim which is later determined not to be covered by the terms of this Warranty shall be payable to Manufacturer upon receipt of an invoice for such charges

No warranty shall apply to any PRODUCTS adversely affected, in Manufacturer’s sole judgment, by such PRODUCTS being used with any machinery, part or accessory not manufactured or authorized by Manufacturer and field modifications, retrofits, or attachments installed on Manufacturer’s machinery, parts or accessories by others Only Manufacturer approved modifications and retrofits may be installed on PRODUCTS produced by Manufacturer Written authorization must be obtained from Manufacturer’s Engineering or Service Managers prior to any non-Manufacturer modifications or replacement parts being installed on Manufacturer’s PRODUCTS

No warranty is extended to normal maintenance items such as replacement of grease, hydraulic oils, lubricants, and other fluids, filters, fuses, o-rings, shop supplies, basic alignments and adjustments, hammer and wear liner maintenance, screen cloth installation and tensioning, chute work, and tightening of bolts, nuts and fittings, etc , or any wear parts subject to normal wear

No warranty shall apply to damage resulting from improper long-term storage or failure to rotate, lubricate, or operate equipment and electric drive components during periods of inactivity of more than one (1) month Likewise, no warranty shall apply to electrical damage as the result of improper storage, physical damage, improper grounding, over-voltage, power surges, single phasing, lightning strikes, or excessive cycling of power to starters, variable frequency drives (VFD), or electrical components over a short period of time as limited by the supplier of the component

Manufacturer warrants that field services conducted by it in connection with installation or repair of PRODUCTS will be performed in a good workmanlike manner The obligation and liability of Manufacturer in connection with field services shall

be limited to a refund of the amount it charged for such services, if any Inasmuch as the work to be performed by the buyer or end-user with the Manufacturer’s PRODUCTS will vary according to the materials used, local conditions, and the results required and that such variation will continue throughout the use of such PRODUCTS, it is not possible to (and Manufacturer does not) warrant or represent that PRODUCTS manufactured by it will handle specific materials or will produce specific results from such materials Any application analysis and resultant equipment performance expectations are provided as estimates only and are not to be construed in any manner as a production guarantee

Manufacturer is wholly discharged of all liability under the foregoing warranties in the event that purchaser of the PRODUCTS fails to pay for the PRODUCTS promptly and in accordance with the terms of the purchase agreement

Manufacturer’s liability hereunder is conditioned upon Dealer or first end-user giving notice in writing to Seller and Manufacturer of any alleged defect, and such notice must be given immediately upon the discovery of such alleged defect

Manufacturer does not warrant or represent that any PRODUCTS manufactured by it meet any Federal, state or local statutes, codes, ordinances, rules, standard or other regulations covering safety, pollution, noise, electrical wiring, etc

This limited warranty extends only to the original first end user and is not transferable No subsequent owner or user shall have any rights or claims under this limited warranty policy This limited warranty policy may not be modified except pursuant to a written agreement signed by Manufacturer

SELLER EXTENDS NO WARRANTIES OF ANY KIND EXCEPT TO THE EXTENT SELLER IS ALSO A MANUFACTURER AND, IF A MANUFACTURER, ONLY TO THE EXTENT A MANUFACTURER EXTENDS THE WARRANTY CONTAINED HEREIN

THE FOREGOING WARRANTY IS IN LIEU OF ALL OTHER WARRANTIES EXPRESS OR IMPLIED (EXCEPT THE WARRANTY OF TITLE) INCLUDING BUT NOT LIMITED TO ANY IMPLIED WARRANTY OF MERCHANTABILITY, OF FITNESS FOR A PARTICULAR PURPOSE, OF NON-INFRINGEMENT, AND ANY IMPLIED WARRANTY FROM COURSE OF DEALING OR USAGE OF TRADE, EACH OF WHICH IS EXPRESSLY DISCLAIMED NEITHER SELLER NOR MANUFACTURER SHALL BE SUBJECT TO ANY OTHER OBLIGATIONS OR LIABILITIES WHATSOEVER WITH RESPECT TO MACHINERY, PARTS, ACCESSORIES, OR SERVICES MANUFACTURED OR FURNISHED BY IT OR ANY UNDERTAKINGS, ACTS OR OMISSIONS RELATING THERETO UNDER NO CIRCUMSTANCES SHALL KPI, JCI OR ASTEC MOBILE SCREENS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR OTHER DAMAGES, EXPENSES, LOSSES OR DELAYS HOWSOEVER CAUSED, INCLUDING BUT NOT LIMITED TO LOST PROFITS, ATTORNEYS’ FEES OR COSTS OF LITIGATION THERE ARE NO WARRANTIES WHICH EXTEND BEYOND THE DESCRIPTION ON THE FACE HEREOF

NEITHER SELLER NOR MANUFACTURER SHALL BE SUBJECT TO LIABILITY FOR ANY LOSSES, EXPENSES OR DAMAGES ARISING FROM ANY NEGLIGENCE BY IT OR ANY OF ITS EMPLOYEES, AGENTS OR REPRESENTATIVES IN CONNECTION WITH THE MANUFACTURE, SUPPLY, OR INSTALLATION OF PRODUCTS, OR THE PROVISION OF SERVICES

*Provided, however, for Vanguard Plus Series Jaw Crusher unit only, consisting of pitman assembly and crusher base, excluding entire chassis and mount structure, warranty shall be two (2) years or four thousand (4000) hours of use, whichever comes first

IntroductionThe policies and procedures in this publication have been developed to assist you in accessing the support services available from KPI-JCI and Astec Mobile Screens Our services include experienced engineering, service and warranty departments to provide after-market support It is our goal to provide our distributors/customers with quality products and the best service and support possible Adherence to the policies and procedures in this publication will help insure we achieve that goal together The cooperation we extend each other will ultimately result in more satisfied customers and a more profitable experience for all

Distributors are expected to cooperate by assisting factory personnel in carrying out their duties in accordance with the rules listed in this policy

RecommendationsThe service department is a very important part of any organization If well organized and efficiently managed, it can be a valuable source of repeat sales of new equipment, parts and service Your service personnel are very important, front-line company representatives, dealing directly with the customer in what is usually a high-stress situation Their actions, attitude and appearance will be the example the customer will remember

Dealers should:• Staff your service department with trained and experienced personnel • Always have adequate tools to perform the work required • Complete a detailed report of all work performed during the course of a repair, and store information in a readily-

available manner for future reference • Service personnel should notify your sales department of prospective sales of new equipment or parts • They may make recommendations to the customer regarding on-site spare parts inventory • Service personnel should coach customers in implementing maintenance programs, whenever necessary

ResponsibilitiesThe factory’s service department is available to assist the distributor’s service personnel should a problem occur with factory equipment

Manufacturer will:• Provide over-the-phone service 24/7

• Provide training conferences at factory to aid in understanding equipment operation, maintenance, application and equipment troubleshooting Full-line product training will be provided to new distributors and additional training will be scheduled based upon individual requirements

• Have factory service technicians available to assist and guide the installation, startup, repair or operation of factory equipment

• Provide support on equipment operation, maintenance and equipment troubleshooting • Keep the distributor informed of modifications and recommendations that will affect the equipment in its territory

through Engineering and Service Bulletins and field campaigns - Service Bulletin (SB) - for external and internal distribution These will cover required procedures and will typically

be warrantable items - Parts and Service Memo (PSM) - for external and internal distribution These will cover procedures that are

optional or general information which may or may not require completion These will typically be non-warrantable items It can include operational tips, part or accessory options, maintenance tips, and application suggestions

- Engineering Bulletin - for internal distribution These will cover internal processes, procedures and specifications These may be distributed externally on a case by case basis

• Maintain service records and communicate to management the effectiveness of the distributor’s service department

ResponsibilitiesThe factory’s service department is available to assist the distributor’s service personnel should a problem occur with factory equipment

Distributor will:• Provide for equipment startup, either by their own trained personnel, or by factory personnel at distributors expense

to instruct the customer/end user in safe and proper operation procedures, adjustments, lubrication, maintenance, capabilities and limitations of the equipment, and the importance of all decals and warning labels of factory products sold by them

• Service all factory products at their own expense, whether or not sold by them that are being used in their territory • Maintain a current and accurate record of the equipment during the warranty period

This shall include:- Customer’s name and address- Equipment model and serial number- Hour meter reading- Service and repair history- Application of equipment

• Use the designated forms of communications with factory’s service and warranty departments • Retain and protect any items that may be considered a warranty failure for proper evaluation When a warranty claim

form is submitted, the item should be in the same condition as when it was removed from the equipment • Promptly complete all mandatory retrofits as directed by the factory per engineering or service bulletin • Provide factory service personnel, transportation, and tools at no charge to factory whenever a factory technician is

in the distributor’s territory on a service-related trip when, at the discretion of the factory, the distributor will not be charged for the factory technician’s time

• Ensure service personnel receive regular factory training to become familiar with the latest technology • Notify the factory of equipment or application problems • Complete and sign Warranty Registration and Pre-Operational Check forms On rental machines, this report must be

completed, signed and returned to the factory each time the machine is rented • Warranty Registration and Pre-Operational Check forms are to be filed within 10 days of start-up of new equipment If a

Warranty Registration and• Pre-Operational Check form is not filed within 10 days, the effective warranty date will default to the date the equipment

New Equipment Start-UpProper start-up and training is essential for obtaining optimum performance of distributor/end user’s equipment Factory-trained technicians are available to perform startups at the regular published rates Startups are provided at no charge only in the following instances:

• Equipment start-up is agreed to by factory, noted on the equipment sales order, and arranged prior to shipment of equipment

• New models that will require distributor training as deemed prudent and reasonable

New Equipment Startup Includes:• A training overview of equipment operations and maintenance, and review of all technical manuals as supplied • A complete inspection of equipment • Operational testing up to three days to include any necessary break-in and full load testing where possible • Adjustments required to optimize the equipment operation

Troubleshooting and Repair SupervisionFactory service department provides technicians to identify and troubleshoot distributor/end user equipment on-site Technicians are available at the regular published rates We request that you contact the factory service department to dispatch a technician as far in advance as possible

In order that we may serve you better, please be prepared to provide the following information to the service department when you call:

• Your company name, address and telephone numbers• The type of equipment, including model and serial number• The serial number and location of equipment to be started• Name and contact information of whom will be available on site to meet with the technician• A detailed description and the nature of the problem or repair• A purchase order Quotations are available to estimate anticipated costs

Factory Repair ServicesJohnson Crushers International, Inc (JCI) provides repair/rebuilding of equipment at its factory location These services are most appropriate when machine work may be required or a total factory rebuild, with warranty, is requested For these services, JCI will provide a quotation for tear-down and inspection This will be followed by an inspection report and quotation for recommended repairs When a customer purchases a total factory rebuild, including all recommended and quoted repairs, the standard or modified rebuild warranty may apply Instances where only a portion of the recommended repairs is authorized, the warranty will only apply to the specific repairs that were authorized and performed

Normal hours of work are considered to be between the hours of 8 a m and 5 p m local at the specific factory, Monday through Friday Overtime should be kept to a minimum

Please bear in mind that in most cases the distributor or customer will be paying for the service Since factory service personnel must be paid double time for work or travel on Sundays and holidays, special approval must be secured from the factory service department for each case

If the time period installing or servicing factory equipment extends over holidays, factory field personnel are entitled to spend these holidays with their families In these instances, the distributor or customer will be charged for the traveling expenses involved

Customer must be persuaded to be reasonable in their demands Very often it is not necessary for factory service personnel to watch over the equipment for every hour of operation after it has been started They can always be called for in case of emergencies Time spent in traveling to and from the motel is considered to be time worked Distributors are cautioned against calling for factory service personnel prematurely, for time they spend in waiting prior to the beginning of actual setup/start-up of the equipment will be counted as service days

It is highly recommended that the equipment is ready for start-up before the factory technician arrives to the job site If the factory technician has to wait for the machine to be prepared, the factory will expect reimbursement for the waiting period

Astec Industries, Inc policy requires that the extension of credit for all sales (parts, equipment and service) be approved by the credit department prior to making a commitment to the customer In addition, special requirements pertain to the extension of credit for all International sales (parts, equipment and service) The credit department is basically prohibited from extending credit to an International customer unless the customer has been approved for foreign credit insurance by the Astec Industries, Inc foreign credit insurance broker, international risk consultants All international customers that fail to gain approval for foreign credit insurance are required to prepay for the trans- action via wire transfer or approved letter of credit

In the case of disputes concerning the decisions of the credit department, decisions can be appealed to the division president or Astec Controller

Charges for Factory Service and Engineering PersonnelCharges commence upon departure of the factory engineering or service technician from the home factory location, including Saturdays, Sundays and holidays

Daily rates (subject to change) do not include transportation, lodging, meals, parking, taxi and other itemized miscellaneous expenses These expenses are itemized and invoiced at their actual costs

Effective January 1, 2017, rates for factory service and engineering personnel will be as follows:

Factory Service Personnel• $1,000 00 per day for up to an eight (8)-hour day, except Sunday and holidays • $150 00 per hour for each additional hour above eight (8) on all days except Sundays and holidays • $175 00 per hour on Sundays and holidays

Factory Engineering Personnel• $1,200 00 per day for up to an eight (8)-hour day, except Sunday and holidays • $175 00 per hour for each additional hour above eight (8) on all days except Sundays and holidays • $200 00 per hour on Sunday and holidays

Note: Idle time beyond the control of KPI-JCI and Astec Mobile Screens will be billed at the applicable rate for both service and engineering personnel

Transit TimeTransit time to the job, while on the job, and returning to the factory will be charged at the applicable rate

TransportationThe factory will determine the mode of travel (air, company or rental car or any combination) The factory will only invoice transportation charges at actual costs

Lodging, Meals and Other ExpensesThe factory will determine the lodging and meals to be purchased by the technician The factory will only invoice lodging, meals and other trip expenses at actual costs
