Whereas the Government of Goa is of the opinion that an industri<¥ dispute exists between the management of M/s. Nestle India Ltd., Usgao-Goa, and their workmen represented by Gomantak Mazdoor Sangh, in respect of the matter specified in the Schedule hereto (hereinafter referred to as the "said dispute");

And whereas th~ Government of Goa considers it expedient to refer the said dispute for adjudication.

Now, therefore, in exercise of the powers conferred by clause (d) of sub-section (1) of section 10 of the Industrial Disputes Act, 1947 (Central Act 14 of 1947) (hereinafter ref,lrred to as the "said Act")., the Government of Goa hereby refers the said dispute for adjudication to the Indust:ial Tribunal of Goa, at Panaji-Goa, constituted under section 7-A of the said Act.

SCHEDULE

"(1) Whether the 25 points of Charter of Demands served by the Gomantak Mazdoor Sangh on behalf of the workmen on the manage9Y'nt of M/s. Nestle India Ltd., Usgao, Goa, is geil1.Jne and justified?

(2) If the answer to (1) above is in the affirmative, then, whether the action of the management of M/s. Nestle India Ltd., Usgao, Goa in not settling the above demands of the Union is legal and justified?

Notification

In exercise of the powers conferred by section 88, read with section 91-A, of the Employees' State Insurance Act, 1948 (Central Act No. 34 of 1948) (hereinafter referred to as the 'said Act'), the Government of Goa hereby exempts the medical representatives of Mis. Merit Pharmaceuticals Ltd., Alto-Porvorim, Bardez-Goa, residing on tour in implemented center, from the operation of the said Act, with retrospective effect from 1-4-1980, subject to the following conditions namely:-

(i) That whatever amount has been paid by the Employees' State Insurance Corporation to the State Government has to be reimbursed by the said M/s. Merit Pharmaceuticals Ltd., Alto­Porvorim, Bardez-Goa.

(ii) That whatever amount deducted by the Employer from the wages of the workmen a$ contribution under the Employees' State Insurance Scheme shall be refunded to the concerned medical representatives.

Whereas it appears to the Government of Goa (hereinafter referred to as "the Government") that the land specified in the Schedule hereto (hereinafter referred to as the "said land") is likely to be needed for public purpose viz. Construction of approach road to the existing Police Quarters at Sanguem.

Now, therefore, the Government hereby notifies, under sub-section (1) of section 4 of the Land Acquisition Act, 1894 (Central Act 1 of 1894) (hereinafter referred to as the "said Act") that the said land is likely to be needed for the purpose specified above.

2. All persons interested in the said land are hereby warned not to obstruct or interfere with any surveyor or other persons employed upon the said -land for the purpose of the said acquisition. Any contract for the disposal of the said land by sale, lease, mortgage, assignment. exchange or otherwise, or any outlay commenced or improvements made thereon without the

If the acquisition is abandoned wholly or in part, the fact will also be notified in the same manner.

4. The Government further appoints, under clause (c) of section 3 of the said Act, the Dy. Collector (LA), Collectorate, South Goa District, Margao to perform the functions of a: Collector under the said Act in respect of the said land.

"The tenure of both the Committees will be for a period of three years from the date of the issue of the Order. The Non-Official members will be entitled to claim TA/DA for attending the meeting as Grade I Officers as and when they attend the meeting.

This supersedes the earlier Order No. 8/39/87-Sports(Part File)/3186 dt. 29-11-2000".

In pursuance to above Notification to introduce irrigation well scheme which aims to help construction of new wells in minor irrigation sector by individual or group of farmers by extending them grant in aid in the· form of subsidy, to boost the agriculture in the State, the Government is pleased to appoint the following officers as designated Executive Engineers and Assistant Engineers for the pllIpose of implementation of the above scheme as under:

Kossambe, Inspector Legal Metrology (Weights & Measures), Panaji, to the post of Assistant Controller, L~gal Metrology (Weights & Measures), Group 'B' Gazetted, on regular basis, in the pay scale of Rs. 5500-175-9000, with immediate effect.

The pay of Shri K. B. Kossambe, shall be fixed as per Rules.

Shri K. B. Kossambe shall be on probation for a period of two years.

The expenditure thereon is debitable in the Budget Head "3475-0ther General Economic Services, 00-, 106-Regulation of Weights and Measures, 02-Expansion of Metric System (Plan), 01-Salaries.
