Approve a Resolution of the Governing Board of the SJJPA, Authorizing the Chair to Execute the 2015-16 San Joaquin Intercity Passenger Rail Service Operating Agreement with AMTRAK

SJJPA must negotiate and sign an Operating Agreement with Amtrak.
The negotiations for the 2015-16 Operating Agreement with Amtrak have been underway since July 2015. SJJPA and LOSSAN JPA have been coordinating efforts in
the negotiations with Amtrak.
The current agreement expires Sept. 30, 2015.

The latest Draft 2015-16 Operating Agreement is being thoroughly reviewed by SJJPA staff, SJJPA counsel, Caltrans, and Amtrak.
This agreement is based upon actual costs, rather than the historical fixed price structure, and it requires much more up-front costing detail. Particular attention is being paid to removing one Comet
Car trainset from the fleet (at least until the initiation of the 7th train requires it).

The current FY 14/15 Operating Agreement between Caltrans and Amtrak contains a continuation clause in the event the new Agreement is not approved by October 1st

Determining the new scope of audit and testing must be undertaken collaboratively with the other JPA’s and Caltrans
New York and North Carolina had some difficulties with being denied access to Amtrak information and the cost of the audit became far greater than anticipated
The JPA’s and Caltrans will coordinate with these states to inform the process in CA

Implications of No Extension: If Passenger Service or Hazardous Materials are carried the
Federal Railroad Administration has the authority to levy fines on the railroad.
The railroads may stop all Passenger Operations and movement of Hazardous Materials effective December 31st, 2015, or operate in violation of federal law.
San Joaquin Service Amtrak is working with Caltrans to get all the on-board
equipment purchased, installed, tested on the equipment prior to December 31, 2015.

Approximately 6 years ago, the State of California, in support of California Operation Lifesaver (CAOL), proclaimed September as Rail Safety Month.
On August 26, 2015, SJJPA partnered with Union Pacific, Burlington Northern, Amtrak, ACE and CAOL to launch Rail Safety Month.
Safety & Security Program
A state grant funded, special safety train operated several times in the morning and afternoon along a 2 mile segment of track in Stockton, CA To educate people in the community, raise awareness, and
to coordinate safety enforcement on and near the railroad tracks.
It was the first time in Northern California that all these organizations came together to promote this event titled “See Tracks? Think Train!” .

San Joaquin Corridor Specific Rail Safety Activities Planned for September
Radio spots from 4 local radio personalities endorsing the ST3 message sponsored by CAOL –the spots will reach: Fresno, Madera, Mariposa, Kings, Tulare, and portions of Kern Counties.
A minimum of twenty eight 30 second PSA’s to run per week per station during September – they will also all be running in Spanish on the Spanish Radio Station.
Safety & Security Program
High School “I Took the Pledge” campaign lead by iHeart Radio – students take the pledge to not trespass with a potential to win an iPad or a duffle bag with goodies inside – reaching a minimum of 2 High Schools a week in September.
Several counties will be reached including Fresno, Madera, Mariposa, Kings, Tulare, and portions of Kern County.

Web Trespass Advertisements for Rail Safety Month on all 5 radio stations – will reach: Fresno, Madera, Mariposa, Kings, Tulare, and portions of Kern Counties.
All Stations will also run the OL See Tracks? Think Train! Trespass PSA’s throughout the month of September, reaching: Fresno, Madera, Mariposa, Kings, Tulare, and portions of Kern Counties.

Interview with State Coordinator promoting September Rail Safety Month on the local “Community Matters Show” which broadcasts on all of the radio stations on Sunday mornings. The interview will run on Sunday, September 6th

Approve New San Joaquin Valley Rail Committee MembersDan Leavitt
The purpose of the SJVRC is to discuss and formulate plans, suggestions, and ideas for changes and improvements to passenger trains service in the San Joaquin Rail Corridor and then pass these on to SJJPA.
Per the May 15, 2015 SJJPA Board action, before the SJVRC can report to the SJJPA, the SJVRC will need to convene and take action to change their By Laws.

Staff has scheduled a meeting of the existing SJVRC on October 9, 2015 at 1:30 pm. To discuss the changes adopted by the SJJPA and request
that they take action to approve these changes to their By Laws.
This meeting will be a conference call meeting held in multiple locations.

Mr. Snyder lived in and represented Alameda County on the SJVRC for many years.
Mr. Snyder now resides in Butte County and has expressed his strong desire to continue to serve on the SJVRC.
Recommended New Members For SJVRC
Staff recommends approving the recommendations submitted and continuing to work with Alameda County, Contra Costa TA, StanCOG, Merced CAG, Madera CTC, Fresno COG, Tulare CAG, Mariposa County, and Los Angeles County to bring the remaining recommendations for approval at the next SJJPA Board Meeting.

The Assembly Select Committee on Rail public hearing was held on August 21, 2015 in Modesto
This hearing focused on the improvement and expansion of the San Joaquin and Altamont Corridor Express rail services.
Two members of the Senate Select Committee also participated in the Hearing.

Chair Gray concluded by pledging to work with the San Joaquin Valley caucus to secure the funding needed to improve and expand the San Joaquin and ACE services.
He said he would start by working with the caucus to increase the ongoing Cap & Trade funds for Transit and Intercity Rail to 20% of ongoing Cap & Trade funding (it is currently at 10%).

Chair Gray said that he would work with Senator Jackson to schedule another joint hearing with the Senate Select Committee on Passenger Rail with the purpose of working to get more funding for Intercity and Commuter Rail services throughout California.

The SJJPA Finance and Audit Subcommittee will be having a conference call in October. Vice Chair Tatzin – Chair of the Subcommittee, Member Ishida
and Member Johnson
Topics for the meeting will include: A briefing on the financial policies and procedures adopted
by SJRRC that now apply to SJJPA via the Managing Agency Agreement.
A discussion on the SJJPA preferred reporting format for monthly expense and revenue.
A report by the Finance Committee will be given at the next SJJPA Board meeting on October 23, 2015.
Finance and Audit Subcommittee
SJJPA staff met with TRAC President Ron Jones, Vice President David Schonbrunn and TRAC’s lead staff person, Michael Setty on September 10, 2015.
SJJPA Board Members have expressed interest in TRAC’s proposals for the San Joaquin service and the Altamont Corridor.
The SJJPA 2015 Business Plan states, “SJJPA also will begin to explore the possibility of having some San Joaquin service in the future utilize the Altamont Corridor to bring San Joaquin service to additional Bay Area markets”.
Correspondence
As an initial next step, staff will pursue getting ridership and revenue forecasts from statewide planning efforts underway for alternatives which have some future San Joaquin service utilizing the Altamont Corridor.
Staff will also begin discussions with the state to obtain planning funds for the SJJPA to investigate the potential of having some San Joaquin service in the future utilize the Altamont Corridor.
Staff will continue to coordinate with TRAC.
Correspondence
Lindsey Jauregui expressed interest in having San Joaquin service extended over the Tehachapi Mountains to Barstow.
Gary Rucker (from Merced) expressed interest in pursuing a quiet zone through Merced and any help the SJJPA can provide to reduce freight noise though Merced.
The City of Hercules invited the SJJPA Board Members to their September 19th event to celebrate of the opening of a new Bay Trail Segment. Details provided in Briefing Materials
