ofcounterfeitgoods
Preamble
We,thesignatoriestothisDeclaration,acknowledgethedestructiveimpactoftheinternationaltradeincounterfeiting1oneconomicgrowth,employment,securityandthehealthandsafetyofconsumers.
Wecondemnthefactthatcounterfeitersemploysubterfugetoaccessandexploitthegloballogisticssupplychainwhichdamagesourbusinessesandcompromisesourreputations.
Werecognizethatcounterfeitingisasignificantpartofthewiderscourgeofglobalillicitandillegaltrade2andwecallonothersinthemaritimetransportindustrytoaddressthisissuethroughcontinuousproactivemeasures,andcorporatesocialresponsibilityprinciples.
Wewillnotknowinglyfacilitateortoleratethecarriageofcounterfeitproducts;andweacknowledgethatallourcompaniescanbenefitfromadoptingthemeasuressetoutbelow.
Wearewillingtocollaborate,withinthelimitofavailableresources,throughjointworkinggroupstodevelopadetailedseriesofnon-bindingmeasuresorbestpracticestobeimplementedinrelationtothetermsbelow,topromotethisDeclarationacrossthemaritimetransport/shippingsectorandtoencourageallothersinthesectortosignit.
1OrganisationforEconomicCo-operationandDevelopment(OECD)study,TradeinCounterfeitandPiratedGoods:MappingtheEconomicImpact”(April2015)highlightsthattradeincounterfeitandpiratedgoodshasgrownfromUS$250billionannuallyin2008tomorethanUS$461billionin2013.Accordingtothesefindings,counterfeitproductsnowrepresentmorethan2.5%ofallworldtrade,including5%ofallimportsintotheEuropeanUnion.
2Illicittradeencompassesawidevarietyofillegaltradingactivitiesbeyondcounterfeiting,includingillicit“white”tobaccoproducts,humantrafficking,environmentalcrime,illegaltradeinnaturalresources,armsandweaponsandnarcotics,smugglingofexcisablegoods,illegalpharmaceuticalsandcropprotectionproducts,tradeinsubstancesthatcausehealthorsafetyrisks,andavarietyofillicitfinancialflows.Theillicittraffickingofcounterfeitgoodsisoftenlinkedtootherseriouscrimes.Europolhaswarnedthatcounterfeitingisanincreasinglyattractiveavenuefororganizedcrimetodiversifytheirproductrangeandevidencesuggeststhatcriminalnetworksusesimilarroutesandmodusoperanditomovecounterfeitgoodsastheydotosmuggledrugs,firearmsandpeople.(UNOfficeofDrugsandCrime,TheIllicitTraffickingofCounterfeitGoodsandTransnationalOrganizedCrime(2014);Europol,SeriousandOrganisedCrimeThreatAssessment(2013);UnitedNationsInterregionalCrimeandJusticeResearchInstitute,ConfiscationoftheProceedsofCrime(2012);OECDIllicitTradeReview(2016);USDepartmentofState,TheGlobalIllicitTradeinTobacco,AThreattoNationalSecurity(2015).

Principles
A. Zero tolerance policy regarding counterfeiting 1. Implementapplicableinternational,regionalandnationalrulesandmutuallyagreed
standardsaimedatpreventingthecarriageofcounterfeitproducts.
2. Informallcustomersandsub-contractorsofthesecommitmentsandourzero-tolerancepolicytowardscounterfeits.
3. Ensurecompliancewithallapplicablelaws,regulationsandrulesincluding,butnotlimitedto,thoserelatingtocustomsregulation.
B. Supply chain controls 1. Applyappropriateduediligencemeasures,suchasKnowYourCustomerprocesses.
2. Includeappropriateconditionsprohibitingthecarriageofcounterfeitproducts.
3. Takeappropriatestepsinordertoensurethereisnocooperationwithcompanies,entitiesorindividualswithseriousorproveninvolvementincounterfeiting.
4. Encourage,whereverdeemedappropriatebythesignatory,theimplementationofsimilarmeasuresbyotherplayersintheextendedsupplychains.
C. Risk profiling 1. Applyspecificvigilancemeasuresandcommonearlywarningindicatorsinordertoidentify
high-riskshipmentsofcounterfeits.
2. Cooperateinordertoreviewandrefine,whenappropriate,pre-agreedcriteriabyallsignatoriesforscreeningandearlywarningindicatorsofcounterfeits.
D. Raising awareness and conducting training 1. Increaseawarenessaboutthenature,scale,andconsequencesofcounterfeitingand
refrainfromdealingwithcriminalactorswhoexploitmaritimetransportinfrastructurestocarryoutawiderangeofillicitandillegaltrade.
2. Improvethetrainingofstaffwithinthetransportsectortoenablethemtoreportsuspectedcounterfeitactivity.

E. Sharing information and cooperating 1. Identifyapointofcontactforeachsignatorytocoordinatewithnationalandsupra-
nationalauthorities.
2. SupportprocessesdevelopedbycompetentauthoritiessuchastheWorldCustomsOrganizationandnationalcustomsagenciestoaidthedetectionandseizureofcounterfeitproducts.
3. Contributetoinformationexchangesbetweenthepartiesondetectionandseizureofcounterfeitproducts,subjecttocompliancewith(i)signatory’srelevantcontractualobligations,suchasthosepertainingtoconfidentialityofcustomerinformation,and(ii)applicablelawsandregulations,includingbutnotlimitedto,competitionanddataprotectionlaws.
4. Cooperateandcollaboratewithcompetentlawenforcementauthoritiesonanyinvestigationsrelatingtothecarriageofcounterfeits.
F. Non-binding terms ThisDeclarationofIntentisavoluntaryandnon-bindingstatementofthesignatories’mutualintenttoprevent,tothebestoftheirabilities,totheextentpossibleandincompliancewithallapplicablelawsincludingcompetitionlaws,themaritimetransportationofcounterfeitgoods.TheDeclarationofIntentisnotintendedtocreateanylegallyenforceablerightsorobligationsinrespectofanysignatory,includinganyobligationontheirparttoenterintoanyadditionalbindingagreements.
