PLEASE TAKE NOTICE that theTown Board of the Town of Riverheadadopted a local law amending Chapter108 entitled “Zoning”, of the River-head Town Code at its meeting heldon July 7, 2015. Be it enacted by theTown Board of the Town of Riverheadas follows:

Chapter 108. ZoningArticle LVI. Downtown Center 1:

Main Street (DC-1) Zoning Use Dis-trict

§108-298. Uses.B. Special permit uses:(8) Micro-brewery, Brew-pub, Mi-

cro-cidery and Micro-winery subject tothe following additional criteria:

(a) The use shall not be locatedwithin 200 feet of a school or house of

worship.(b) The use shall be limited to serv-

ing pre-packaged food products unlessapplicant obtains approval and certifi-cate of occupancy for use as a brewpubor restaurant use within that portion ofthe premises used for preparation andservice of food.

(c) The use shall permit tastings andsale for on-site consumption subject toall required permits and approvals re-quired by state and local laws, rules andregulations.

(d) The use shall permit sale for

off-site consumption (i.e. filling ofgrowlers) limited to 1000 barrels annu-

ally and offer to licensed retailers andwholesalers limited to 2500 barrels ofbeer, cider or wine annually.

(e) The processing and manufac-turing shall not exceed 10,000 barrels(310,000 gallons) annually.

(f) All manufacturing and process-ing activities, including storage ofgrains, shall take place within an en-closed building.

(g) A maximum of seventy percentof the total square footage shall beused for manufacture and processing.

(h) A minimum of thirty percentshall be used for sale and marketing ofthe manufactured product.

(i) All sales and marketing shall belocated in the portion of the buildinglocated along road frontage.

(j) A micro-brewery, brew pub, micro-cidery, micro-winery use shall be requiredto hook up to the sewer system and en-ter into a monitoring agreement with

the Sewer District to determine flow andcalculate use fee (note, a separate hookup and fee shall be assessed for a pub/res-taurant use related to brewpub).

(k) All loading areas shall be locatedin the rear portion of the building.

It is the expresspurpose of this section to require thatany store vacant and/or closed for a pe-riod of thirty (30) days within the DC-1zoning use district shall be requiredto apply for signs in conformity withthe sign ordinance (section 108-56) inorder to: perpetuate the tasteful char-acter and attractive appearance; pro-mote good community planning and apositive aesthetic environment; protectproperty values; recognize the eco-

nomic importance and attractivenessof properly sited and well-designed

signs; preserve the historic characterand architectural heritage of the Town;provide a more enjoyable and pleasingcommunity; and to promote and ac-complish the goals, policies and objec-tives of the 2003 Riverhead Compre-hensive Master Plan.

B. Application for a sign permit.Unless otherwise stated herein, allsigns permitted in this section shallhave a sign permit issued by the Townof Riverhead Building Department asprovided in section 108-56.1.

*All signs shall be in conformity withthe examples that follow. Vacant orclosed window and/or other signs thatdo not conform shall not b e permitted.

(2) Submission of the permit fee attime of application. All fees paid pur-suant to this section are nonrefundable.Such fee shall be set from time to timeby resolution of the Town Board.
