PUNJAB WILDLIFE & PARKS DEPARTMENT INVITATION FOR BIDS

1. Punjab Wildlife & Parks Department invites sealed bids from Government registered and approved Security Agencies in possession of valid NOC from Interior Ministry / Home Department (Punjab) for providing services of Security Guards.

2. Bidding shall be conducted through Open Competitive Bidding Single Stage Two Envelopes procedures specified as per provisions of PPRA Rules 2014 and is open to all eligible bidders as defined in the bidding document.

3. Interested eligible bidders may obtain further information and bidding documents immediately from the office of Deputy Director Wildlife, Lahore Region, Lahore on submission of written application at the cost of Rs.1000/- (Non-Refundable), during office hours. Late Proposals will be rejected. Bids of only those bidders will be entertained who purchased the Tender document.

4. Sealed Bids must be delivered to the office of Deputy Director Wildlife, Lahore Region, Lahore on or before 30.09.2021 and must be accompanied by Earnest Money for Rs.100000/- in the shape of pay order / bank draft as per PPRA Rule No.27.

5. Bids will be opened on 09.10.2021 at 12.30 PM in the presence of bidders or their representatives who choose to attend in the office of Deputy Director Wildlife, Lahore Region (with original CNIC of bidders / representatives) observing SOPs of COVID 19.

6. The bidders are requested to give their best and final prices as no negotiations are permissible as per PPRA Rules and regulations.

7. Taxes will be deducted as per applicable government rules. NTN / Sales Tax / PSTN Registration Certificates must be provided.

PART-I Section II.

TERMS & CONDITIONS

1. General: 1.1 Any offer not received as per terms & conditions of the tender enquiry is liable to be ignored. No offer shall be considered if: received without earnest money. received after the time and date fixed for its receipt. not signed by authorized person on each page of tender document. the offer is ambiguous. the offer is received by Fax or E-mail. the offer is from a black listed firm. offer received with shorter validity than required. the offer is not conforming to requirements indicated in the tender documents. Any conditional offer. 1.2 Offered rates (in Pak Rupees) will remain valid for a period of 3 months. 1.3 The contract will be enforced for a period of one financial year ending on 30th June. 1.4 No escalation in rate will be given during contract period. 1.5 The cover envelop should indicate particulars of tender, and date of opening. The envelope must be properly sealed. 1.6 The earnest money / security shall be forfeited if:

a. The acceptance of purchase order is not received within 7-days of issuance of order

b. The offer is withdrawn, amended or revised. c. The Security Agency fails to execute the contract strictly in accordance with

terms and conditions. 1.7 The bidder should indicate their National Income Tax No. / Sales Tax No. / PST No. and circle of Income Tax Department and attach Copy of NTN and GST / PST certificate. 1.8 Whole or part of tender can be cancelled by the competent authority without assigning any reason. 2. Cancellation / Penalty of Delay: 2.1 If the acceptance of the order (s) issued during the validity period of the tender is not acceptable by the bidder, the earnest money will be forfeited. 2.2 In case the offer is withdrawn, amended or revised during the validity period of the tender, the earnest money shall be forfeited. 2.3 In case bidder fails to execute the contract / order (s) in accordance with the terms & conditions laid down in the contract, the bank guarantee will be forfeited and security services can be hired from another company at risk and cost of the bidder. 2.4 In case of poor performance, competent authority may cancel the contract or impose appropriate penalty. The penalty may be upto double the approved rate of per month of total service charges.

3. Payment to the Contractors:

3.1 Payment will be made on monthly basis through crossed cheque to the Security Agency against invoice after satisfactory performance against the services within 15-days after the receipt of the bill for the month of duty. Payment against partial arrangements of Security Guards will not be made. 4. Earnest Money & Performance Guarantee: 4.1 Earnest money @ 4% of the tender will have to be deposited along with tender. It should be in the form of Call Deposit (CDR) in favour of Deputy Director Wildlife, Lahore Region. Earnest money of unsuccessful bidders shall be refunded on the finalization of the contract / tender whereas the earnest money of successful bidder shall be refunded on the submission of performance guarantee @ 5% of the contract value in the form of Call Deposit (CDR) in favour of Deputy Director Wildlife, Lahore Region. 5. Deduction of Taxes: All taxes (if applicable) will be deducted while making payment as per

Government instructions / notifications. Prices indicated on the Price Schedule shall be inclusive of all taxes (GST/PST). Prices shall be quoted in Pak Rupees.

6. Payment of Income Tax & other taxes: Contract will be executed with the firms registered with income tax & PPRA.

Income tax and all other such taxes will be liability of the Security Agency. 7. Termination of Contract:

Competent authority may terminate contract with or without assigning any reason and will inform the supplier about his decision in writing. 8. Dispute Resolution:

In case of any dispute before or after the execution of contract, matter will be resolved as per provisions of PPRA Rules 2014. 9. Information about firm:

The Security Agency will provide information along with tender (Technical Bid) about the following: a. Company profile and professional experience

b. Copies of tax registration certificates c. Authorization/ License from Ministry of Interior / Home Department, Punjab. d. 24/7 helpline number on which any complaint/ issue can be registered. Alternate contact number is also mandatory.

10. Format & Signing of Bid 10.1 The Bidder shall prepare the Technical and Financial bids on its letter head. The bids shall be typed or written in indelible ink and shall be signed by the Bidder or a person or persons duly authorized to bind the Bidder to the contract. All pages of the bid shall be initialed by the person or persons signing the bid. 10.2 Any interlineations, erasures, or overwriting shall be valid only if they are initialed by the person or persons signing the bid.

11. Submission of Bid

11.1 The bidding procedure shall be Single Stage Two Envelopes as per provisions of PPRA Rules, 2014. The bidder shall seal the original Technical and Financial bid (separately sealed) into a single envelope. The Bidder shall seal the bid in envelopes, duly marking the envelopes as “Technical” & “Financial”.

11.2 The envelopes shall: be addressed to the Deputy Director Wildlife, Lahore Region at the address given in INVITATION TO THE BIDS bear the title of procurement Activity indicated in the Bid Data Sheet, the Invitation for Bids title and number indicated in the INVITATION TO THE BIDS, and a statement: “DO NOT OPEN BEFORE,” to be completed with the time and the date specified in the INVITATION TO THE BIDS, and The inner envelopes shall also indicate the name and address of the Bidder to enable the bid to be returned unopened in case it is declared “late”.

11.3 No bid may be modified after the deadline for submission of bids. 11.4 No bid may be withdrawn in the interval between the deadline for

submission of bids and the expiration of the period of bid validity specified by the Bidder on the Bid Form. Withdrawal of a bid during this interval will result in the Bidder’s forfeiture of its bid security. 12. Opening & Evaluation of Bids 12.1 The bids will be opened in the presence of bidders’ representatives who choose to attend, at the time, on the date, and at the place specified in INVITATION TO THE BIDS. The bidders’ representatives who are present shall sign an attendance sheet evidencing their presence. 12.2 During evaluation of the bids, the Procuring Agency may, at its discretion, ask the Bidder for a clarification of its bid. The request for clarification and the response shall be in writing, and no change in the prices or substance of the bid shall be sought, offered, or permitted. 12.3 The Procuring Agency may waive any minor informality, non-conformity, or irregularity in a bid which does not constitute a material deviation, provided such waiver does not prejudice or affect the relative ranking of any Bidder. 12.4 If a bid is not substantially responsive, it will be rejected by the Procuring Agency and may not subsequently be made responsive by the Bidder by correction of the nonconformity.

12.5 The evaluation of Financial Bid will be on Lowest Evaluated Bid inclusive of all prevailing taxes and duties. 12.6 Any effort by a Bidder to influence the Procuring Agency during bid evaluation, or bid comparison may result in the rejection of the Bidder’s bid.

PREPARATION AND SUBMISSION OF BIDS

1. ELIGIBILITY CRITERIA

a) Only Government registered and approved Security Agencies having possession of valid NOC from Interior Ministry / Home Department (Punjab) are eligible to apply for the Tender. b) The Security Agency must be registered with Federal / Provincial Govt. Home Department. c) The Applicant must give details about Legal Status of the Firm / Company- Certificate of incorporation / registration under Laws must be provided. d) Affidavit / Undertaking for Correctness of Information, Declaration of non-involvement in litigation / black listing and compliance to the specifications, conditions and provision of required Security Guards services in the office of Assistant Director Wildlife, Breeding Farm Jallo, Lahore on the defined time lines as mentioned in Terms of Reference of this bidding Document / Work Order issued (to be provided on non-judicial stamp paper of Rs.100/-) e) Copy of Valid NTN Certificate f) Copy of valid GST Registration / PST Registration. g) Copy of Firm/ Company registration with Social Security / PESSI & EOBI.

40 Marks Marks will be awarded on pro-rata basis. 8 Marks will be awarded for each Complied Experience but the maximum marks shall not exceed 40Marks

The bidder must obtain minimum 50% marks in each of the above criteria with aggregate marks 60% (60 marks out of 100 marks). AWARD OF CONTRACT: All bids will be evaluated on basis of above given evaluation criteria and the bidders who do not fulfill above mentioned evaluation criteria will be considered as technically non-responsive bidders and will not be taken into consideration for Financial Evaluation. However technically qualified bidders (Responsive to Evaluation Criteria) will be considered as responsive bidder, and among technically responsive and qualified bidders, the bidder with lowest rates will be awarded the contract (subject to fulfillment of all required conditions of bidding document & PPRA Rules, 2014).

TERMS OF REFERENCE (TORs)

1. The Security Agency will ensure that its personnel perform their security duties

efficiently, vigilantly, honestly, faithfully and in the most substantial manner required in their profession. The persons employed by the Security Agency shall be treated as the Security Agency’s employees.

2. The Security Agency will provide medically fit & duly verified Security Guard to Assistant Director Wildlife, Breeding Farm Jallo, Lahore.

3. The Security Guards will obey all the instructions of the Employer with regards to the discipline (as set by the Administration) involving security matters.

4. Fixation of timings / place of duty / working hours for duty of Security Guard provided by the Security Agency shall be made by the office of Assistant Director Wildlife, Breeding Farm Jallo, Lahore. Each Security Guard will have to perform his duty for 12 hours. In case of Security Guard is on leave, Security Company will arrange for his substitute with prior intimation to Assistant Director Wildlife, Breeding Farm Jallo, Lahore.

5. The contract will be enforced for a period upto 30.06.2022. 6. The Security Agency will provide one weapon (Repeater 12 bore / Pistol 30 bore)

and one torch light to each Security Guard along with appropriate uniform and ammunition without any extra charges. Ammunition used by the Security Guards while performing duties will not be charged from Punjab Wildlife & Parks Department.

7. In case, any of the Security Guard provided by the Security Agency is found guilty of misconduct, he will be returned to the Security Agency forthwith for taking necessary action. However, the Security Agency in the meantime shall immediately arrange replacement within 03 hours.

8. Security clearance of the provided security guards from special branch within one month of start of contract shall be the responsibility of the Security Company. However company shall certify his guards regarding their security clearance on its own risk from the day one.

9. The Security Agency will be responsible for any loss due to negligence of Security Guard provided by him for security related matters. The value of damaged / stolen items will be determined by joint inquiry as per recommendations by both the parties. The inquiry committee will comprise one representative each from Punjab Wildlife & Parks Department and Security Agency. Inquiry report / facts / findings will be submitted to the office of Deputy Director Wildlife, Lahore Region for final decision.

10. Security Agency shall make sure presence of guard at Wildlife Park Jallo, Lahore in time and for all the duty hours according to plan. In case of security guard found sleeping / missing, appropriate penalty @ Rs.500/- in monetary terms shall be charged as decided by the disciplinary committee of Punjab Wildlife & Parks Department.

11. The Security Agency will rotate the Security guards as routine on monthly basis. 12. That Security Agency will provide clearance by Special Branch of Punjab Police for

each security guard deployed. 13. The deployed security guards shall possess the following; a. CNIC

b. Company ID Card c. Authority Letter for Carrying weapon d. Weapon license (if required) e. Weapon / hand held detector f. Whistle & Torch

14. In case of use / misuse of the weapons and any carelessness showed by the security guards, the contractor shall be held responsible. 15. The contractor shall provide 02 passport size photographs and copy of CNIC, duly attested by the in-charge of the concerned security firm, of all deputed security guards for Client record. 16. The record and attendance shall be maintained by the In-charge of Wildlife Park Jallo, Lahore i.e. Assistant Director Wildlife, Breeding Farm Jallo, Lahore. 17. Contractor will be responsible to have full insurance cover for his deployed staff for loss of life or any kind of injury, during deployment. Proof of Insurance cover must be provided before signing of Contract. 18. The deployment shall be for 12 hours working shift in a day and 7 days in a week. The client reserves the right to waive off / relax or impose condition which deem necessary at any stage of contract in the best interest of client, without explaining any reason.

Part-II Section I.

Contract Forms (DRAFT) THIS CONTRACT (“Contract”) is entered on _ , by and between, on one hand; -, (“the Client”) and on the other hand; _ (“the Contractor”), for a total Value of /- WHEREAS, the Client wishes to have the Contractor to perform “_ --” (“the services”) WHEREAS, the Contractor is willing to perform “ --” The Contract has following Annexures; 1. Annexure-C: Letter of Acceptance NOW THEREFORE THE PARTIES hereby agree as follows: In consideration of the payments to be made by the Client to the Contractor as hereinafter mentioned, the Contractor hereby covenants with the Client to supply therein in conformity in all respects with the provisions of the Contract 4. The Client hereby covenants to pay the Contractor in consideration of the provision of the services and the remedying of defects therein, the Contract Price or such other sum as may become payable under the provisions of the contract at the times and in the manner prescribed by the contract. 1. Services 2. Term 3. Payment

(i) The Contractor shall perform the services specified in Annex A, “TORs,” which is made an integral part of this Contract (“the Services”). (ii) The Service Firm shall arrange to deploy the security guards within 07 days and depute its manpower in accordance with the requirements of the Wildlife Park Jallo, Lahore. The Contractor shall perform the Services commencing from Service Based

i For Services rendered pursuant to Part-1-Section III of Bidding Documents, the Client shall pay the Contractor an amount not to exceed inclusive of all applicable taxes for the whole contract period.

ii In addition, Deputy Director Wildlife, Lahore Region will not compensate / reimburse the Contractor for other expenses, in connection with the activities to be carried out under the Contract.

iii Payment shall be made via crossed cheque in favour of the Contractor upon submission of invoice and verification / acceptance of services. All payments shall be subject to taxes and duties, including any amendments thereto, as applicable in Pakistan for the duration of the Contract. 4. Performance Standards

i The Contractor undertakes to perform the Services with the highest standards of professional and ethical competence and integrity. The Contractor shall promptly replace any employees assigned under this Contract that the Client considers unsatisfactory.

ii By entering into this Contract, the Contractor declares and confirms the non-existence of any conflict of interest or other legal hindrance which could potentially result in the inability of the Contractor to enter said Contract as of the date mentioned herein.

iii The Contractor further declares and agrees to intimate any subsequent condition or legal matter which could potentially restrain him from properly performing his duties and obligations as laid down herein for any reason whatsoever till the complete execution of the Contract. 5. Confidentiality The Contractor shall not, during the term of this Contract and within two years after its expiration, disclose any proprietary or confidential information relating to the Services, this Contract or the Client's business or operations without the prior written consent of the Client. 6. INSURANCE The Contractor shall take out and maintain at its own cost. Life / Health EOBI & PESSI Insurances of all its employees against the risks and the contractor shall provide evidence to the Deputy Director Wildlife, Lahore Region showing that such insurances have been taken out and maintained, and that the current premium thereof has been paid. The Contractor shall ensure that such insurances are in place prior to commencement of the services / before signing of Contract. Contractor will be responsible to have full insurance cover for his deployed staff for loss of life or any kind of injury, during deployment.

7. Assignment

The Contractor shall not assign this Contract or sub-contract any portion of it without the Client's prior written consent. 8. Law Governing Contract & Language The Contract shall be governed by the laws of Government of Pakistan, Governing and the language of the Contract shall be English. 9. Force Majeure The term "Force Majeure" as employed herein shall mean acts of God, strikes, lock-out or other industrial disturbances, acts of public enemy, wars, blockades, insurrection, riots, epidemics, landslides, earthquakes, storms, lightning, floods, washouts, civil disturbances, explosions and any other similar events including regulatory or legislative actions materially affecting the ability to meet the obligations under this Agreement, not within the control of either Party and which by the exercise of due diligence neither Party is able to overcome. If either Party is temporarily unable by reason of Force Majeure or the contractor or regulations of Pakistan to meet any of its obligations under the Agreement, and if such Party gives to the other Party written notice, of the event within fifteen (15) days after its occurrence, such obligations of the Party, as it is unable to perform by reason of the event, shall be suspended for as long as the inability continues. Neither Party shall be liable to the other Party for loss or damage sustained by such other Party arising from any event referred to as Force Majeure or delays arising from such event. Force Majeure shall not include inability to perform due to lack of skills, expertise required under the Agreement.
