EXECUTIVESUMMARY

ProjectScope

ThisResettlementPolicyFramework(RPF)appliestotheSustainableEnergyDevelopmentProject(SEDP)-aWorldBank(WB)fundedprojectfortheRepublicoftheMarshallIslands(RMI).TheRPFaddresses resettlement impacts generated by activities funded under Components 1 and 2 andprovidesfortheresettlementplanningoffutureREandEEinvestmentsinEbeyeandOuterIslands.SEDP was formulated from a WB funded study of potential solutions that addresses theGovernment of the Republic of the Marshall Islands (GoRMI)’s energy sector objectives of (i)increasingtheuseofREtoatleast20percentby2020whilereducingby20percentitsgreenhousegas emissions; and ii) reducing subsidies to the sector by lowering the operating costs (i.e. byreducingtheshareofexpensiveimportedfuelsinitsgenerationmatrixandbyincreasingitsenergysectorutilities´efficiency.ThreesolutionscorrespondstothedevelopmentofREinMajuro,Ebeyeandtheouterislands.Theseare:

• Solution 1 –Majuro – Centralized storage and control system: This optionwould involvebuilding i) a centralizedopenprotocolBatteryEnergyStorageSystem (BESS)1tobe locatedatMECpower station and ii) the installation of 3.4MW to 6.8MW2of solar PV to increase the share ofrenewableenergysupplybetween10-20percentforMajuro.• Solution2 – Ebeye- Centralized storageand control system:Thisoptionwould involve i)acentralizedopen–BESStobelocatedatKAJURpowerstationandii)upto3.4MWofsolarPV,locatedat different sites due to the limited land availability on Ebeye, to increase the share of renewableenergysupplytoapproximately30percentfortheatoll.• Solution3–Outerislands-Mini-grids:Thissolutionwouldsupportconversionoftheexistingdieselmini-gridsonthreeatolls:Wotje,JaluitandRongrong,intosolarhybridmini-gridsystemsandtheestablishmentofonenewsolar-hybridmini-gridinSanto(Kwajaleinatoll).

For RMI to be able to reach its intended targets in 2020 and 2050, all three solutions should beimplementedinaphasedapproach.TheSEDPisbuiltaroundSolution1onMajuroandpreparingforSolutions2and3,andwillincludethefollowingthreecomponents:Component 1: Renewable Energy Investments (IDAUS$28.6million).This componentwill includethefollowingthreesub-components:

(i) Sub-Component 1.1: Renewable Energy Integrated Solution in Majuro (US$22.6 million).This sub-componentwill finance the supplyand installationof anestimated3MWof solarpower-generation capacity, a BESS, and grid-management equipment to increase the

contributionofREinRMI´sgenerationsystemandreducedieselgenerationinMajuro. Thesub-componentwillincludeassistanceinO&MandcapacitybuildingforMECforatleasttwoyears.Aninitialassessmentonpotentialsites(ownedor leasedbyGoRMI)availabletohostthearraysofPVpanelsincludeMWSC´swaterreservoirneartheairport,somepublicschoolsandpublicbuildings,theemptyspaceadjacenttotheMajurohospital,andsomebasketballfields in thecity.Thewater reservoir is theprimarycandidate for several reasons: itwouldservebothMWSCandMECgenerationpurposes inasituationof limited landavailability; itwould reduce evaporation currently experienced by MWSC; it concentrates half of thepotentialsites’totalcapacity;itavoidsanticipatedpotentialdistributionconstraints;and,dueto its size and relative proximitywithMEC’s existing thermal generation facilities, a powerdistributionfeedercaneasilybeerectedtoconveythegeneratedREfromthereservoirsitetothepowerplant.Ifthereservoirisused,thiswouldinvolveinstallationoffloatingorfixedsolarPVpanelsinthereservoir.3Thiscomponentwillalsoaddresstheliningofthereservoirasneededduringimplementation.MoreinformationisprovidedintheTechnicalAssessmentsectionbelowandinAnnex1.

(ii) Sub-component1.2:DesignandSupervisionConsultants(US$1million).Thissub-component

will finance thedetailed survey for solution1/sub-component1.1onMajuro,apreliminarydesign and cost, preparation of bidding documents, and supervision of the engineering,procurementandconstruction(EPC)contractor.

(iii) Sub-component1.3:SupplyandInstallationofGensetsforMajuroandEbeye(US$5million).

Thissub-componentwill financegensets (low/mediumorhigh-speeddependingonstudies)forMECandKAJUR´spowerplants inMajuroandEbeyetoimprovefuelconsumptionandsystem reliability, and to help accommodate the planned grid solar capacity. Retroactivefinancing is also being considered for the purchase of the gensets if needed;World BankProcurement Regulations for Investment Project Financing (IPF) Borrowers and Procedureswouldapply.

Component 2: Promotion of Energy Efficiency and Loss Reduction Program (US$2 million). Thiscomponentwillprovidetechnicalandoperationalassistanceandwill complementComponent1byreducingenergydemandthroughimprovingtheefficiencyforbothuseandsupplyofelectricityfromMECandKAJUR.Itwillincludethefollowingthreesub-components:

(i) Sub-Component 2.1: Supply Side Management Loss Reduction Program (US$0.7 million).This sub-component will address issues related to supply-side management (SSM). A lossreductionprogramforMECandKAJURwillbedesignedandimplemented.Currentlossesareapproximately26percentof51,147MWhinMajuroandbelievedtobeahigherpercentagein Ebeye. This is mostly caused by technical mismatches in facility configurations andoperations. A loss reduction study will be prepared by external consultants to providerecommendationstoachievelossreductioninthetwoutilities.

(ii) Sub-Component 2.2: Demand Side Management and Information, Education, andCommunication (US$1 million). This sub-component will support a program of activitiesdesigned to enhance efficient use of energy. The program could include supply andinstallation of selected energy efficiency investments, such as enhanced insulation inbuildings and replacement of inefficient lighting or appliances in said buildings. Externalconsultantswill provide recommendations toharnessbest available technologies. This sub-component will also support information awareness campaigns, workshops, training, andeducationondemand-sidemanagement(DSM)andenergyefficiency.

(iii) Sub-component2.3:PolicyFrameworkandRegulatoryRegimeforEnergyEfficiency(US$0.3

million).Thissub-componentwillsupportdevelopmentofpoliciesandregulationsforenergyefficiency, as well as the development of standards and labeling for energy efficiency,including phasing out inefficient incandescent bulbs and more stringent standards forappliances.Activitiesaimedatraisingconsumerawarenessonenergyefficiencyandrelatedcapacity-buildingactivitiesandtrainingwillalsobesupportedunderthissub-component.

Component 3: Technical Assistance, Capacity Building, and Project Management (IDA US$2.4million).

(i) Sub-component 3.1: Technical Assistance and Capacity Building (US$0.45 million). Aprogram of activities designed to enhance the capacity of MEC, KAJUR, and EPD will becarried out. These activities could include technical operation, procurement, financialmanagement,environmentalandsocialmanagement,monitoring,evaluation,andreporting.This sub-componentwill also support a study to assert EPD’s role in the sector, defines itsneedsasoneofthekeyactorsandfurtherprovidemeansforEPDtoundertakeafewstudiesessentialtotheenergysectordevelopmentaswellaspotentialsupportforstaffing.

(ii) Sub-component3.2:DesignofREProjects inEbeyeandtheOuter Islands(US$0.5million).

Thissub-componentwillsupportthepreparationofstudiesforthesubsequentphasesoftheproject,includingthedesign(uptothepreparationofbiddingdocuments)forREprojectsforEbeyeandtheOuterIslands(Wotje,Jaluit,Rongrong,andSanto).

(iii) Sub-component3.3:EstablishmentofO&MMechanismandImplementationArrangements

(US$0.15million).SetupofO&Mfund(i.e.,SinkingFund)tomaintaingenerationequipmentiscriticaltoensureitssustainability,especiallyinthePacificregion.Thissub-componentwillprepare the escrow account/sinking fundsmechanism and support training ofMEC and/orKAJURontheO&Mstrategies.

(iv) Sub-component3.4:ProjectManagement(US$1.3million).Thissub-componentwillsupport

and strengthenMEC´s capacity forprojectmanagementand implementation, coordination,monitoring and evaluation, and reporting. It will support the establishment of a ProjectImplementation Unit (PIU) in MEC including the recruitment of a Project Manager, andprocurement, financial management, social and environmental safeguards capacity asneeded.ItcouldalsoincludeanenergyspecialisttosupportEPDonthetechnicalsupervisionof relevant studies. Provision of technical assistance to support mainstreaming of genderdimensions in the project will also be financed under this sub-component. The project’s

incremental operating costs will be financed through this sub-component as well as officeequipmentandprojectaudits.

ScopeoftheLandAccess,AcquisitionandResettlement

Component1 involves voluntary access to government andpublic building roof-tops, vacant andavailable government leased public spaces and land under the jurisdiction of other governmentagencies and authorities, for the installation of solar PV panels, and ancillary infrastructure andequipment. Any land acquisition will be voluntary, minimal and temporary to provide forcontractors access and use, and or for any ancillary structures (e.g. transmission poles, and ortrenching)requiredtoconnectoff-gridinstallationstothemaingridetc.ForComponent2,mostreplacementequipmenttoreplaceoldandlessefficientoneswilloccupyexisting footprints,withinpower stations. A possible exception iswhere streetlights targeted forreplacement are on transmission poles located outside the road reserve or easements. Existinginformalarrangementswithaffected landownersmayrequire reviewandwhereadverse impactsneedmitigation,thesewillbeaddressedthroughcontractors’ESMPs.Land requirements for future investments envisaged under Component 3 will be confirmedfollowingpropertechnicalassessmentandscreeningduringprojectimplementation.Thisincludesinvestments in stand-alone PV systems in outer islands which may involve voluntary landacquisition from private and traditional landowners, where government leased lands areinsufficientorforothertechnicalreasons,notunsuitable.LikewiseistheuseofreefflatsinEbeye(eastofthedumpsiteandGugeegucauseway)forPVinstallation.Onthewhole,theamountoflandacquisitionenvisagedislimitedandconsistentwiththeCategoryBassessmentgiventothisProject.TheemphasisongovernmentbuildingsandgovernmentleasedlandsinthepreliminarydesignisaconsciousefforttokeepIRimpactstoaminimum.For planning purposes, Abbreviated Resettlement Action Plans (A/RAP) will be required insomeof these cases. Thepurposeof thisRPF is to setout guidelines to follow inpreparingdetailed or specific resettlement plans to address identified resettlement impacts, inaccordancewithWBSafeguardspolicies,aswellasRMIsafeguardslawsandregulations.In termsofRPF implementation,MEC’sProject ImplementationUnit (PIU)willbe responsible forthe day-to-day safeguards requirements, while MOF/DIDA will have overall coordination andoversight. MOF/DIDA has a safeguards expert for the WB funded PREP Phase 2, who will alsoprovide technical safeguardssupport for theSEDP. ForanyMajuro landacquisition,MECwillberesponsible with the assistance of the Department of Internal Affairs and the Land RegistrationOffice.InEbeye,KAJURwillrequiretheassistanceofKADA,whointurnwillseektheconsentofthetraditionallandowners.InternalmonitoringandreportingwillinvolvebothMECandMOF/DIDAatdifferentlevels.Theuseof an External Monitoring Agency (EMA) is an option available to MEC to ensure independent

oversightofRPFimplementation,shoulditconsidersitnecessarydependingonthecomplexityandscaleofcompensationentitlementsinvolved.AbudgetofUS$150,000isestimatedtocoverRPFimplementation.

1. INTRODUCTION1. TheSustainableEnergyDevelopmentProject(SEDP)isdesignedtoincreasethe share of renewable energy generation and improve energy efficiency in theRMI.2. This document was prepared by an independent consultant for theGovernmentofRMItoaddresstheduediligencerequirementsoftheWorldBank’sSafeguards Policy OP/BP 4.12. Involuntary Resettlement OP/BP 4.12 requires thepreparationofaResettlementPolicyFramework(RPF)toguidethepreparationofdetailedresettlementplans forsubprojectswhicharenotyet identified. Detailedresettlement planning for those subprojects will be prepared during projectimplementationusingthisFramework.3. Such resettlement planning needs are likely for future RE projects inEbeye and the Outer Islands (Wotje, Jaluit, Rongrong and Santo) planned forsubsequentphasesof theProjectunderComponent3.Among theseoptions arestand-alone PV installations which may require more land than available ingovernment leased areas, orwhere such land are unsuitable for one reason oranother.Anysuchensuing landacquisitionwillbevoluntarybasedonnegotiatedandmutuallyagreedtermswithlandowners.1.1 BackgroundInformation4. The Government of Republic of the Marshall Islands’ (GoRMI) formallyrequested the Bank’s support in advancing its energy sector objectives of (i)increasingtheuseofREtoatleast20percentby2020whilereducingby20percentitsgreenhousegasemissions;and(ii) reducingsubsidiestothesectorby loweringthe operating costs (i.e. by reducing the share of expensive imported fuels in itsgeneration matrix and by increasing its energy sector utilities efficiency). In thatcontext, the World Bank commissioned a pre-feasibility study to conduct thedependencyonimportedfuels.TherecommendationsoftheReportarebasedonatechnicalmissiontothecountry,areviewofavailablestudiesintheenergysectorand a review of a proposal from a US company – Solar City – submitted to theGoRMIforthedevelopmentofasolarprojectonEbeyeandthreeouterislands.ThestudymadebySolarCityformsthebasisofaUS$11millionfinancialrequest(non-concessionalfundingat1%interestrate)submittedbytheGoRMItotheADFD(AbuDhabi Fund for Development) via IRENA (Decision expected early in 2017). TheOptionsReportproposesthreeoptionsforthedevelopmentofREinMajuro,Ebeyeand the outer islands. To undertake all three options concurrently would beextremely expensive, therefore a phased approach will be implemented over aperiodof5–7yearstoachievetheREgoalasproposed.

5.TheSEDPwillbeimplementednationally,andwillincludeinvestmentsandactivitiesin Majuro and Ebeye in the Kwajaelein atolls. It will prepare the designs andsafeguardsinstrumentsforfutureinvestmentsonEbeyeandotherouteratolls.

1.2.HigherLevelObjectivestowhichtheProjectContributes6. SEDP will contribute to RMI’s National Energy Policy (NEP) adopted inSeptember2009andreviewedin2015.TheNEP’svisionis‘improvedqualityoflifeforthepeopleoftheMarshallIslandsthroughclean,reliable,affordable,accessible,environmentally appropriate and sustainable energy services’. It has the followingbroadgoals–

i. strengthen financial, policy and legislative frameworks for the energysector;

ii. supply100percentofurbanhouseholdswithelectricityby2015;iii. provide95percentofruralouteratollhouseholdswithoff-gridelectricityby

2015;iv. provideaccesstomodernformsofcookingto90percentofallhouseholds

by2020;v. make households and businesses 50 percent more energy efficient and

governmentbuildings75percentmoreenergyefficientby2020;vi. achievea20percentefficiencyimprovementintransportsectorfueluseby

2020;vii. reducesupplysideenergylossesfromMECby20percentby2017;andviii. provide 20 percent of power generation through indigenous renewable

resourcesby2020.

7. The NEP also identified four priority outcomes that are (i) improved enablingframeworks for reducing dependence on imported fossil fuel; (ii) all Marshallesehave equitable access to modern energy services; (iii) smarter uses of energy inhouseholds,businesses, government, transport sectorandpowerutilities; and (iv)reliable,sustainableandaffordableenergysupply.8.SEDPisthuswellalignedwiththestrategicdirectionandframeworksthatidentifyneedsandprioritiestorespondtotheeffectsofclimatechangeandnaturalhazardsidentified by GoRMI and theWorld Bank. SEDP also contributes to strengtheningRMI’s economic resilience to external shocks, given its dependence on importedfossilfuel.9.TheprojectisinlinewithWorldBank’splanningandpolicydocuments,including:the “Pacific Possible: Report on Climate and Disaster Resilience” (July 2016); theEngagementNotefor“DisasterandClimateResilientDevelopmentProgramminginthe Pacific Islands Region” (April 2014); and the Policy and Practice Note “ActingTodayforTomorrow”(2012). Theprojectwillbeapracticalmeanstofulfill theseplans and policies, developed in close collaboration with donors and regionalorganizations, which have been well received. The SEDP also contributes to theSmallIslandStatesResilienceInitiative(SISRI)launchedduringtheSIDSconferencein Samoa in September 2014 andwhich forms part of the Bank’s engagement inclimateanddisaster resilientdevelopment in small islandstates in theCaribbean,IndianOcean,WestAfrica,andthePacific.10. The SEDP directly contributes to fulfilling the World Bank’s twin goals ofreducing the share of population living in extreme poverty, and boosting sharedprosperity.11. Women’s well-being is expected to be impacted positively by SEDP withimprovedaccesstoaffordableelectricity.2. PROJECTDESCRIPTION2.1 DevelopmentObjectiveandIndicators–

2.3 Projectbeneficiaries

15. Direct project beneficiaries include electricity consumers (residential,commercial, industrialandgovernment)inRMIwhowillbenefitfromanimprovedand more efficient and reliable electricity supply, and eventually from moreaffordable and sustainable tariffs.By reducing the dependence of imported fuelwithvolatilepricesandsupplies,theProjectwillbenefitthecountryasawholebyreducing the amount of subsidies to the sector that can be used for other highpriority sectors suchashealth, educationandother key infrastructure.Policy anddecisionmakers,aswellasplannersandmanagersandtechnicalstaffoftheutilitieswill also benefit from strengthened technical capacity. Finally, a more cleanerenergy matrix will have global environmental benefits by contributing to thereductionofgreenhousegas(GHG)emissions.2.4 ProjectComponents

gas emissions; and ii) reducing subsidies to the sector by lowering the operatingcosts(i.e.byreducingtheshareofexpensiveimportedfuelsinitsgenerationmatrixandby increasing itsenergysectorutilities´efficiency). In thatcontext, theWorldBankcommissionedastudytoconductapreliminaryanalysisofpotentialsolutionsthat would increase the share of RE in the country, thereby reducing thedependencyonimportedfuels.

17. The Bank’s preliminary analysis evaluated the following three solutionscorrespondingtothedevelopmentofREinMajuro,Ebeyeandtheouterislands(allestimatedmonetaryvaluesareundiscounted,2016US$prices):

• Solution 1 – Majuro – Centralized storage and control system: 18. Thisoptionwouldinvolvebuildingi)acentralizedopenprotocolBatteryEnergyStorageSystem (BESS)4to be located atMEC power station and ii) the installation of 3.4MW to 6.8 MW5of solar PV to increase the share of renewable energy supplybetween 10-20 percent for Majuro. The associated solar PV panels could beinstalledattheexistingMajuroWaterCompany´s(MWSC)waterreservoirneartheairport,inalandleasedbytheGovernmentnearthehospitalorinvariousrecentlybuilt school rooftops. This solution would cost approximately US$19 million andsave US$580,000 per year on fuel cost subsidies from avoided diesel oilconsumptionforpowergeneration(basedon3.4MWcapacity).• Solution2–Ebeye-Centralizedstorageandcontrolsystem:

19. This option would involve i) a centralized open –BESS to be located atKAJURpowerstationandii)upto3.4MWofsolarPV,locatedatdifferentsitesduetothelimitedlandavailabilityonEbeye,toincreasetheshareofrenewableenergysupply to approximately 30 percent for the atoll. This project would costapproximatelyU$$19millionandwould saveapproximatelyUS$720,000per yearonfuelcostsubsidies.

• Solution3–Outerislands-Mini-grids:

20. This solution would support conversion of the existing diesel mini-grids onthreeatolls:Wotje,JaluitandRongrong,intosolarhybridmini-gridsystemsandtheestablishment of one new solar-hybrid mini-grid in Santo (Kwajalein atoll). Theproject would cost approximately US$10 million and would provide fuel costsavingstoMECofapproximatelyUS$700,000peryear.ForRMItobeabletoreachitsintendedtargetsin2020and2050,allthreesolutionsshouldbeimplemented;aphaseapproachwillberollupforthatpurpose.

The proposed project is built around Solution 1 on Majuro and will include thefollowingthreecomponents:Component 1: Renewable Energy Investments (IDA US$28.6 million). Thiscomponentwillincludethefollowingthreesub-components:

(i) Sub-Component 1.1: Renewable Energy Integrated Solution in Majuro(US$22.6 million). This sub-component will finance the supply andinstallation of an estimated 3MW of solar power-generation capacity, aBESS,andgrid-managementequipmentto increasethecontributionofREin RMI´s generation systemand reducediesel generation inMajuro. Thesub-component will include assistance in O&M and capacity building forMECforatleasttwoyears.Aninitialassessmentonpotentialsites(ownedor leased by GoRMI) available to host the arrays of PV panels includeMWSC´swater reservoir near the airport, somepublic schools andpublicbuildings, the empty space adjacent to the Majuro hospital, and somebasketballfieldsinthecity.Thewaterreservoiristheprimarycandidateforseveralreasons: itwouldservebothMWSCandMECgenerationpurposesin a situation of limited land availability; it would reduce evaporationcurrentlyexperiencedbyMWSC;itconcentrateshalfofthepotentialsites’total capacity; itavoidsanticipatedpotentialdistributionconstraints;and,due to its size and relative proximity with MEC’s existing thermalgeneration facilities, a power distribution feeder can easily be erected toconveythegeneratedREfromthereservoirsitetothepowerplant. Ifthereservoirisused,thiswouldinvolveinstallationoffloatingorfixedsolarPVpanels inthereservoir.6Thiscomponentwillalsoaddressthe liningofthereservoirasneededduring implementation.More information isprovidedintheTechnicalAssessmentsectionbelowandinAnnex1.

(ii) Sub-component 1.2: Design and Supervision Consultants (US$1 million).

This sub-component will finance the detailed survey for solution 1/sub-component 1.1 onMajuro, a preliminary design and cost, preparation ofbiddingdocuments, and supervisionof theengineering, procurement andconstruction(EPC)contractor.

(iii) Sub-component 1.3: Supply and Installation of Gensets for Majuro and

Ebeye (US$5 million). This sub-component will finance gensets(low/mediumor high-speeddepending on studies) forMEC and KAJUR´spower plants in Majuro and Ebeye to improve fuel consumption andsystem reliability, and to help accommodate the planned grid solarcapacity.Retroactivefinancingisalsobeingconsideredforthepurchaseofthegensetsifneeded;WorldBankProcurementRegulationsforInvestmentProjectFinancing(IPF)BorrowersandProcedureswouldapply.

Component2:PromotionofEnergyEfficiencyandLossReductionProgram(US$2million).Thiscomponentwillprovidetechnicalandoperationalassistanceandwillcomplement Component 1 by reducing energy demand through improving theefficiencyforbothuseandsupplyofelectricityfromMECandKAJUR.Itwillincludethefollowingthreesub-components:

(i) Sub-Component 2.1: Supply Side Management Loss Reduction Program(US$0.7million).Thissub-componentwilladdressissuesrelatedtosupply-sidemanagement(SSM).AlossreductionprogramforMECandKAJURwillbedesignedandimplemented.Currentlossesareapproximately26percentof51,147MWhinMajuroandbelievedtobeahigherpercentageinEbeye.Thisismostlycausedbytechnicalmismatchesinfacilityconfigurationsandoperations.Alossreductionstudywillbepreparedbyexternalconsultantstoproviderecommendationstoachievelossreductioninthetwoutilities.

(ii) Sub-Component 2.2: Demand Side Management and Information,

Education, and Communication (US$1 million). This sub-component willsupportaprogramofactivitiesdesignedtoenhanceefficientuseofenergy.The program could include supply and installation of selected energyefficiency investments, such as enhanced insulation in buildings andreplacementof inefficient lightingorappliances in saidbuildings.Externalconsultants will provide recommendations to harness best availabletechnologies.Thissub-componentwillalsosupportinformationawarenesscampaigns, workshops, training, and education on demand-sidemanagement(DSM)andenergyefficiency.

(iii) Sub-component2.3:PolicyFrameworkandRegulatoryRegimeforEnergy

Efficiency (US$0.3million).Thissub-componentwill supportdevelopmentofpoliciesandregulationsforenergyefficiency,aswellasthedevelopmentof standards and labeling for energy efficiency, including phasing outinefficientincandescentbulbsandmorestringentstandardsforappliances.Activities aimed at raising consumer awareness on energy efficiency andrelatedcapacity-buildingactivitiesandtrainingwillalsobesupportedunderthissub-component.

Component3: TechnicalAssistance,CapacityBuilding, andProjectManagement(IDAUS$2.4million).

(i) Sub-component3.1:TechnicalAssistanceandCapacityBuilding (US$0.45million).AprogramofactivitiesdesignedtoenhancethecapacityofMEC,KAJUR,andEPDwillbecarriedout.Theseactivitiescouldincludetechnicaloperation, procurement, financialmanagement, environmental and socialmanagement,monitoring, evaluation, and reporting. This sub-componentwillalsosupportastudytoassertEPD’sroleinthesector,definesitsneedsasoneofthekeyactorsandfurtherprovidemeansforEPDtoundertakea

fewstudiesessentialtotheenergysectordevelopmentaswellaspotentialsupportforstaffing.

(ii) Sub-component3.2:DesignofREProjectsinEbeyeandtheOuterIslands

(US$0.5 million). This sub-component will support the preparation ofstudies for thesubsequentphasesof theproject, includingthedesign (uptothepreparationofbiddingdocuments)forREprojectsforEbeyeandtheOuterIslands(Wotje,Jaluit,Rongrong,andSanto).

(iii) Sub-component 3.3: Establishment of O&M Mechanism and

ImplementationArrangements(US$0.15million).SetupofO&Mfund(i.e.,Sinking Fund) to maintain generation equipment is critical to ensure itssustainability, especially in the Pacific region. This sub-component willpreparetheescrowaccount/sinkingfundsmechanismandsupporttrainingofMECand/orKAJURontheO&Mstrategies.

(iv) Sub-component 3.4: Project Management (US$1.3 million). This sub-

component will support and strengthen MEC´s capacity for projectmanagement and implementation, coordination, monitoring andevaluation, and reporting. It will support the establishment of a ProjectImplementation Unit (PIU) inMEC including the recruitment of a ProjectManager, and procurement, financial management, social andenvironmental safeguards capacity as needed. It could also include anenergy specialist to support EPD on the technical supervision of relevantstudies. Provision of technical assistance to support mainstreaming ofgender dimensions in the project will also be financed under this sub-component. The project’s incremental operating costs will be financedthroughthissub-componentaswellasofficeequipmentandprojectaudits.

3. SCOPEOFRPF3.1 TypologyofPotentialSubprojectsandassessedIRRisks

35. The SEDP comprises of RE and EE investment projects to be implemented inMajuroandstudiesofoptionsforEbeyeandtheOuterIslands(uptothepreparationofbiddingdocuments), for implementation in the future (not fundedby thisproject). ThisRPF covers the potential involuntary resettlement impacts of all potential investmentsunderComponent1andoptionsforEbeyeandOuterIslands.1. Thevarious typesofenergy investmentoptionsexamined fall into the followingcategories-

a. SolarPVinstallations

i. SolarPVinstallationsarephotovoltaicgeneratingunitscomprisingofphotovoltaicarrays, string inverters, AC lightning-proof combiner boxes and box-typetransformers, etc. Technical studies carried out as part of project preparation

identify several solar PV options with a potential installed capacity of 4.13MWacrossmanylocationsinMajuro.Theseare(i)waterreservoir(ii)airportparking(iii) school building (Delap Elementary School) roof (iv) NitiJela roof (v)EducationalCulturalCentre (ECC) roof (vi) InternationalConventionCentre (ICC)roof (vii) hospital playground (viii) College ofMarshall Islands basketball/sportscentreand(ix)hospitalparking/greenspacearea.

The solar PV installations will not require any involuntary land acquisition. Allproposed locationsareeitherofgovernmentorpublicbuildingsongovernmentleased land. Should additional land be required, as may be required forcontractors’use,Government-leased landwillbeprioritised,otherwise itwillbevoluntaryandtemporary,withlandsreturnedtooriginalownersfullyrestoredtotheiroriginalconditionsorbetter,beforecontractorsleave.ResettlementimpactsofsolarPVinstallationsforEbeyeandtheOuterIslandswillbe the focusof studies andassessments tobe carriedoutunderComponent3.This will include (i) solar PV installations in Ebeye on the lagoon-side reef flatadjacenttothedumpsiteandtheGuugeeguecausewayand(ii)stand-alonePV-diesel hybrid systems for outer islands of Wotje, Jaluit, and Rongrong.Resettlement impacts assessments for Ebeyewill consider, among other issues,thetargetedreef flatasasourceof livelihoodsand incomefor localhouseholdsand resettlement implications associated with any environmental impacts thatmaybegenerated.Ofthestand-alonePV-dieselhybridsystemsenvisagedfortheOuterIslands,ifgovernmentleasedlandisinsufficientorunsuitableforPVarraysandancillaryinfrastructure,thenprivatelyownedlandwillbeneeded.Suchlandusewillbeonavoluntarybasisandaleasenegotiatedwithlandowners.Where resettlement impacts are minor, they will be addressed as part of theESMPandwillnotrequireaseparatesafeguardsinstrument.b. EnergyStorageSystems

Photovoltaic power generation has the features of intermittency, volatility andrandomness.Thus it is critical that the20%of total installedcapacitygeneratedthrough solar PVs is well smoothed out to prevent extreme fluctuations andensuresupplyreliability.Thisisthefunctionoftheenergystoragesystems.SEDPwill invest inaBatteryEnergyStorageSystem(BESS)havingatotalcapacityof2MWandlocatedattheMECpowerstation.AncillaryequipmentforafunctioningBESS includes investments in energy storage converter PCS and distributionequipment.The need for a similar energy storage and control system for Ebeye tocomplementanysolarPV installationswillbeconsideredaspartof theplannedassessments.

ReplacementofinefficientstreetlightingwithmoreefficientLEDlights,enhancedinsulationofselectedbuildingsandpubliceducationandawarenessactivitiesareother EE activities proposed. No land acquisition or resettlement impacts areenvisaged.

3.2 Scopeoflandaccessandacquisitionrequired21.No involuntary landacquisitionwillberequired forsolarpowerPV installationstargeting rooftops, above water reservoir, and government leased open spaces.ReplacementgeneratorswillbeonexistingfootprintswhileBESSinstallationswillbeaccommodatedwithinexistingMECandKAJURpowerstationscompounds.SimilarlyLEDstreetlightswillreplaceinefficientonesonexistinglocations.22. Stand-alonesolarPVinstallationconsideredforouterislandswillbeexaminedclosely during detailed planning to avoid or otherwise minimize involuntaryresettlement impacts. Thepriority is touseexistinggovernment leased lands.Onlywhen existing government leased lands are insufficient or unsuitable for technicaland or environmental reasons will be option of land acquisition from privatelandownersbeconsidered. In suchcases,all landacquisitionwillbeonavoluntarybasisandwillbesecuredthroughnegotiationswithprivatelandowners.23. Small parcels of land will be required temporarily for contractors’requirements during construction for storage and stockpiling, assembling ofprefabricated PV panels before installation and contractors’ site offices. Wheregovernment leased landscannotaccommodatecontractors landneeds, contractorswillnegotiateandmakearrangementsdirectlywithinterestedlandowners.24. Consequently,theoverallscopeoflandacquisitionandresettlementrequiredis

2. Voluntaryaccessto,andtemporaryuseof,private landforContractor’suseduringprojectimplementation:

1) Voluntaryacquisitionofprivatelandsonouterislandsforstand-alone

PV-dieselhybridinstallationsandancillaryinfrastructure.

2) Anyunintendedresettlement impactsonaffectedlandoccupiersandusersasaresultof theacquisitionof land, includingpossible lossofassets or access to assets, livelihood sources, including access tocommunalsharedresourcesanddesignatedprotectedareas,suchasfishing-dependenthouseholdsinEbeye.

4. PRINCIPLES AND OBJECTIVES GOVERNING LAND ACCESS

PREPARATIONANDRESETTLEMENT26. The overriding principles governing the preparation and implementation oftheRPFandanyresettlementactionplansdeemedrequiredandbasedonitare–

a. All land acquisition (temporary or permanent) will be voluntary andwill bedocumentedvialeasesorsimilar.

b. Toavoidorminimize involuntaryresettlementofoccupiersorusersthatarenot landowners,asa resultof land leasearrangements. And,where this isnot feasible, to assist displaced persons ( in improving or at least restoringtheir livelihoods and standards of living in real terms relative to pre-displacement levels or levels prevailing prior to the beginning of projectimplementation,whicheverishigher.

c. To consult and informproject affectedpersons, host communities and localgovernmental organizations as appropriate, and provide them withopportunitiestoparticipateintheplanning, implementation,andmonitoringof the resettlement program including the process of developing andimplementing the procedures for determining eligibility for compensationbenefits and development assistance, and for establishing appropriate andaccessiblegrievancemechanisms.

d. To inform displaced persons of their rights, consult them on options, andprovide them with technically and economically feasible resettlementalternativesandneededassistance.

e. Togivepreferencetolandbasedresettlementstrategiesfordisplacedpersonswhoselivelihoodsarelandbased.

f. For those without legal rights to lands or claims to such land that could berecognized under the laws of RMI, provide resettlement assistance in lieu ofcompensationforlandtohelpimproveoratleastrestoretheirlivelihoods.

g. To disclose draft resettlement plans, including documentation of theconsultationprocess,inatimelymanner,beforeappraisalformallybegins,inanaccessible place and in a form and language that are understandable to keystakeholders.

h. To implement all relevant resettlement plans before project completion andprovideresettlemententitlementsbeforedisplacementorrestrictionofaccess.

i. To assess whether the objectives of the resettlement instrument have beenachieved, upon completion of the project, taking account of the baselineconditionsandtheresultsofresettlementmonitoring.

5. LAND ACQUISITION AND RESETTLEMENT FOR PROJECTACTIVITIES

27. All land acquisition for known project activities is voluntary and should notgenerateanyinvoluntaryresettlementimpactsforoccupiersorusers..28. Landneeds for stand-alonePV-diesel systemsproposed forouter islandswillbeassessed during the detailed planning stage. All three outer islands (Wotje, Jaluit andRongrong)haveexistingsystemsanditismostlikelythattheinvestmentswilloccupytheexistingoradjacentland.Smallamountsof‘newland’forinfrastructuremayberequiredinadditiontotheexistinglanduse.Landrequired for solar investmentsonEbeyewillprioritiseGovernment leased land. Ifprivatelandisrequired,thenaleasewillbenegotiated.Consistentwiththeapproachtakenforknownprojectinvestmentsinthisfirstphase,theaimistoavoidadverseresettlementimpacts,orifunavoidable,tobekepttoaminimum.OP/BP4.12requiresthatwheretheimpactsontheentiredisplacedpopulationareminor,orfewerthan200peoplearedisplaced,anabbreviatedresettlementplanA/RAP)maybeprepared.InthisRPF,thisisthelevelofresettlementimpactsanticipated.TheproceduresandrequirementsforpreparingA/RAPsaresetoutinthisRPF.5.1 AbbreviatedResettlementPlans(A/RAP)29. ThescreeningandassessmentofsocialimpactsduringthepreparationofprojectswillidentifyifanA/RAPisrequiredforeachinvestmentoptionexamined.30. MECwill be responsible for the preparation of any A/RAP required, and for itsimplementation including thepaymentof financialandotherentitlements toconfirmedbeneficiaries.

31. Annex 4 provides an A/RAP outline to guide preparation. Once an A/RAP isprepared, itwill be reviewed and approved by the Bank. Implementation of theA/RAPincludingthepaymentofallentitlementsneedstobecompletedbeforeaBankNOLtogoaheadwithconstructionworks isrequested.Financialarrangements includingprovisionsforanycompensationandorremedialactionsrequiredaredescribedinSection11.

7. LEGALFRAMEWORK41. The legal framework for land acquisition and resettlement is based on the laws andregulations of the Republic of the Marshall Islands Government and the World Bank’sSafeguardsPolicies.42. The principal Marshall Islands laws governing land acquisition, resettlement andcompensationpresently include(i)RMIConstitution(ii)LandAcquisitionAct1986(iii)CoastConservation Act 1988 and (iv) the Public Lands and Resources Act 2008.MWSC’s lease ofprivate land for the water reservoir is being renewed. The Master Plan between theTraditional Landowners of Kwajalein and KADA 2016 is also relevant. These legislation andlegalinstrumentsarediscussedindetailinthefollowingsection..7.1.ConstitutionoftheRMI43. TheConstitutionoftheRepublicoftheMarshallIslandscameintoeffectin1979andamendmentsweremadein1995.TheConstitutionsetsforththelegitimatelegalframeworkforthegovernanceoftheRepublic.44. The Marshall Islands has a bicameral legislature consisting of the lower house orNitijela (legislative power) and the upper house or Council of Iroij (customary power). Thelegalsystemcompriseslegislature,municipal,commonandcustomarylaws.

TheJudiciaryoftheRMI

45. RegardingtheJudiciary,accordingtotheConstitution,thejudicialpoweroftheRMI“…shallbeindependentofthelegislativeandexecutivepowersandshallbevestedinaSupremeCourt,aHighCourt,aTraditionalRightsCourt,andsuchDistrictCourts,CommunityCourtsandothersubordinatecourtsasarecreatedbylaw,eachofthesecourtspossessing such jurisdictionandpowers andproceedingunder such rules asmaybeprescribedbylawconsistentwiththeprovisionsofthisArticle.”

Inrelationstoresettlement,theConstitutionstatesasfollows:“ThejurisdictionoftheTraditionalRightsCourtshallbelimitedtothedeterminationofquestions relating to titlesor to landrightsor toother legal interestsdependingwholly or partly on customary law and traditional practice in the Republic of theMarshallIslands.”

46. TheConstitutionpreservesthetraditionalrightsoflandtenure,stipulatingin‘ArticleXTraditionalRights’that:

1. Nothing in Article II shall be construed to invalidate the customary law or anytraditionalpracticeconcerning land tenureorany relatedmatter inanypartoftheRepublicof theMarshall Islands, including,whereapplicable, therightsandobligationsoftheIroijlaplap,Iroijedrik,AlapandDriJerbal.

2. WithoutprejudicetothecontinuedapplicationofthecustomarylawpursuanttoSection 1 ofArticle XIII, and subject to the customary lawor to any traditionalpractice inanypartof theRepublic, it shallnotbe lawfulorcompetent foranypersonhavinganyrightinanylandintheRepublic,underthecustomarylaworany traditional practice to make any alienation or disposition of that land,whether by way of sale, mortgage, lease, license or otherwise, without theapproval of the Iroijlaplap, Iroijedrik where necessary, Alap and the Senior DriJerbal of such land, who shall be deemed to represent all persons having aninterestinthatland.

3. TitletolandoranylandrightinRMImaybeheldonlybyacitizenoftheRepublic,a

corporationwhollyownedbycitizensoftheRepublic,theGovernment,orlocalgovernment,orapubliccorporationorotherstatutoryauthorityconstitutedunderthelawoftheRepublic.

7.2 LandAcquisitionAct198647. TheRMILandAcquisitionAct1986makesprovisionfortheacquisitionof landsandservitudesforpublicuseforpaymentofjustcompensationintermsofArticleII,Section5oftheConstitutionoftheMarshallIslandsandtoprovideformattersconnectedtherewithandincidentalthereto.48. The Act defines “land” to include “things attached to the earth”. It also defines“personsinterested”,withreferencetoland,tonotincludeamonthlytenant.Theactcoversthe general provisions, preliminary investigation and declaration of intended acquisition,proceedings in court, paymentof compensation, possession anddisposal, divestingof landandgeneralitemspertainingtosuchlandacquisition.ThefollowingsummaryisgivenofthePartsoftheAct:

• The Preliminary Investigation and Declaration of Intended Acquisition details theprocess for investigations for selecting land, compensation for any damage doneduringinvestigationsandissuingnoticesofintendedacquisition.

• WheretheMinisterdecidesthatparticularlandoraservitudeinanyareashouldbeacquired under this Chapter [Proceedings in Court], he shall direct the Attorney-GeneraltofileanapplicationintheHighCourtprayingforadeclarationbytheHighCourt, that such taking of land for public use is lawful. The Proceedings in Courtdetails the process for determination by theHigh Court, the procedure before theHighCourt,theassessmentofcompensation.

• The Payment of Compensation details tender and payment, compensation whichcannot be paid, renunciation of right to compensation, interest on compensation,exchange, finality as to payment of compensation and exchange with otherlandowners.

abandonment of acquisition proceedings, serving of notices, application ofconstitutionalprovisionsandpayment.OfparticularnoteinthisPartisthat:

o Where any other written law authorizes the acquisition of land under this

ChapterandtheMinisterdecidesthatanylandisreasonablyrequiredunder

such other written law by any authority, person or body of persons, the

purposeforwhichthatlandisrequiredshallbedeemedtobeapublicuseand

theprovisionsofthisChaptershallapplyaccordinglytotheacquisitionofthat

landforthatauthority,personorbodyofpersons.7.3.CoastConservationAct198849. ThisActmakesprovision for a surveyof the coastal zoneand thepreparationof acoastal zonemanagement plan; to regulate and control development activities within thecoastal zone; to make provisions for the formulation and execution of schemes for coastconservation;andtoprovideformattersconnectedtherewithorincidentalthereto;50. Part IV sets out a Permit procedure for obtaining permission to engage in anydevelopmentactivitywithinthecoastalzone.Itrequirestheproposedactivityto

(a) beconsistentwiththeCoastalZoneManagementPlanandanyregulationsmadetogiveeffecttosuchPlan,

(b) not otherwise have any adverse effect on the stability, productivity and

environmentalqualityoftheCoastalZone.

(c) Furnishanenvironmentalimpactassessmentreport;51. PartV319empowerstheDirectororanyofficerauthorizedbyhiminwriting,toissuepermitssubjecttosuchconditionsashemayimposehavingregardtothePlan,fortheoccupation,foranyperiodnotexceedingthree(3)years,ofanypartoftheforeshoreorbedofthesealyingwithintheCoastalZone.7.4 PublicLandsandResourcesAct200852. This Act defines ‘public land’ (s.102), rights in areas below the high water mark(s.103),grantofpubliclandsinexchangeforuseofprivatelyownedlands(s.104)andtitletoland-filledandlandreclaimedfrommarineareas(s.105).53. Section103alsostipulatesthattheowneroflandabuttingtheoceanorlagoonshall have the right to fill in, erect, construct and maintain piers, buildings, or otherconstructiononoroverthewaterorreefabuttinghislandandshallhavetheownershipand

controlof such construction;provided, that saidowner first obtainswrittenpermissionoftheChiefSecretarybeforebeginningsuchconstruction.54. Section105,whichstipulatesthattitletonewlandcreatedthroughlandfillorotherland reclamation processes, from marine areas below the ordinary high mark by thegovernment, or by any other person, corporation or other legal entity, for any purposewhatsoever, shall vest in the owners of the adjoining land or lands. 9.OrganizationalproceduresforRPFandARAPimplementation59. MECwillberesponsiblefortheimplementationoftheday-to-daysafeguardsrequirementsforallcomponentsofSEDPassetoutintheRPF.ThisincludesprojectsinMajuroaswellasOuterIslands,butnotEbeyewhichwillbeunderKAJUR’sresponsibility.Whereresettlementimpactsareminor, mitigation measures will be incorporated into project EMPs, and MEC will ensurecontractorsareliablefortheirimplementation,aspartoftheircontracts.60. Providing overall coordination and oversight for project safeguards is MOF/DIDA.MOF/DIDAwillensuretheavailabilityofanadequatebudgetforRPFimplementationincludingthepaymentofcompensation.BothMOF/DIDAandMECwillbesupportedintheserolesbyaProject-fundedSafeguardsSpecialistbasedinMOF/DIDA.61. Where A/RAPs need to be prepared, for instance as possible for outer island projects,MOF/DIDAwillpreparetermsofreferenceandwillengagearesettlementplanningconsultantforthispurpose,guidedbytheRPF.TheresettlementplanningconsultantwillbeassistedbyMEC(orKAJURifinEbeye),theLandRegistrationAuthorityandtherelevantLocalGovernmentauthorityinA/RAPpreparationactivitiessuchas inconductingdetailedmeasurementsurveysofanyaffectedassets, in identifying and or ascertaining the rightful landowners and beneficiaries, and landboundaries.AdraftTORfortheresettlementplanningconsultantisannexed.62. ForA/RAPmonitoring,MEC(andKAJURforEbeye)willberesponsiblebutmayrequiretheassistanceoftherelevantLocalGovernmentauthoritytoensureeffectiveandimpartialmonitoring,particularlywherepaymentoffinancialcompensationandphysicalrelocationareunavoidable.Thealternative option is to engage the services of an independent NGO acting as an ExternalMonitoringAgency(EMA)butthisisnotconsiderednecessarygiventhesmallscaleofentitlementsandnumberofbeneficiariesenvisaged. TheMEC (andKAJUR forEbeye)willmonitor, assessandreport on the effectiveness of procedures and processes for A/RAP implementation, and theimpactsofresettlementonProjectAP’s.

12. RESETTLEMENTBUDGETANDFINANCIALARRANGEMENTS69. Budget provisions for resettlement impacts include rent or lease payments8 for allvoluntarylandacquisitionsandfinancialentitlementsforDPforlossofland,otherassetsincludingcropsandothersourcesoflivelihoods.Thesearetabulatedandsummarizedinseparatesheetsassupporting schedule in the RAP or A/RAP document. MOF/DIDA will also ensure cost of A-RAPpreparation is incorporated into project budget for future phases for Outer Islands and Ebeyeprojectimplementation.

70. ThecostsofimplementinganRAPorA/RAPwillbetheGovernmentofRMI’sresponsibilityasitsequitycontributiontothesubprojectinvestments.TheMOF/DIDAshallensurethatthetotalcostofcompensationandentitlementarebudgeted forandshall cover the following: (a)projectdisclosure,(b)publicconsultationsandfocusgroupdiscussions,(c)detailedmeasurementsurveys(DMS)and(f) internalmonitoringand implementationoftheRAP. Inaddition, theRMIwillcovercontingenciesforthetotalofcompensationandadministrativecost.

71. The budgets for compensation will be approved by theMoF/DIDA (in consultation withMEC) on behalf of RMI Government. MOF/DIDA will also ensure timely availability of adequatebudgetary support and the releaseof funds for any subprojectA/RAPs. Prior to implementation,the MOF/DIDA will set up the accounting chart of accounts for capturing the expenses forcompensationandadministrativecosts.

13. MECHANISMSFORCONSULTATIONSWITHANDPARTICIPATIONOF

Inresponsetotheinterestexpressedaboutprivatebuildings,theMECrepresentativeintervenedtoexplainthatproperstructuralassessmentsofallbuildingsarenecessarytoensuretheyarestructurallysoundandcapableofcarryingPVpanels.Thereisalsotheissueofliabilityinvolvedintheon-goingrepairsandmaintenanceofbuildingshostingPVinstallationsthatcomplicatesprojectfinancing.Partofthepreferencegiventogovernmentbuildingsinthecurrentdesignistosimplifyprojectdesignandtoavoidsuchcomplicationswhichareoftenlikelytodelayandordisruptionstoprojectpreparationandimplementation.

5. ParticipantswerealsoadvisedthatallcompensationpaymentsassociatedwiththeProjectwillbeRMI’sresponsibilityandwillnotbefundedoutoftheProjectgrant.ItisthereforeinthebestinterestofRMIthatcompensationisminimized.

6. InresponsetodiscussionsovertheissueofthecumulativeimpactoftheprojectontheissueofaccumulatedwasteoilinbothMECandKAJUR’scompound,theJICArepresentativeinformedtheconsultationthatJICAisfundingafeasibilitystudyforwaysofreusingwastelubricantoils.ThefeasibilityteamiscurrentlyinRMIandhavevisitedMECandKAJUR’sfacilitiestoassesstheirfacilitiesandcapacities,andtocollectusedoilsamplesfortesting.

AparticipantfromKAJURaskedifthereareresettlementimpacts,andifso,howarethesehandled?WilltheProjectensuredthatcompensationowedaresettledandpaidoutandnotignored?Inresponse,itwasexplainedthataresettlementactionplan(RAP)willbepreparedifthereareresettlementimpactsandallcompensationandentitlementsidentifiedintheRAPwillbepaidout.Moreover,theProjectwillnotstartuntilWBissatisfied,basedontheRAPImplementationreporttobepreparedandsubmittedbyGovernmentofRMI,thatallentitlementshavebeenfullypaidtotherightfulpeople.

Therewasclarificationofthetermresettlementwhichoneparticipantmisunderstoodtomeantherewillberelocationofaffectedpeople.Itwasexplainedthatthetermismuchbroaderandalsorefertolossesandordamagetoassets,andthatifpeopleneededtoberelocatedtemporarilyfromtheirhomes,theProjectwillberesponsiblefortheirrelocationincludingallcostsassociatedwithit.

18. MinistryofPublicWorkscommentedthattheproposedflexiblesupportstructureforthesolarPVsonwaterreservoirshouldbedesignedtowithstandhighwindspeed.TyphoonisnotverycommonintheRMIbutthedesigningfirm/consultantshouldalsoconsidertheimpactsoftyphoon.

19. MWSCrequestedthatthetechnicalfeasibilitystudyoncefinalizedshouldbesharedwithstakeholders.
