Tan City Vice Mayor & Presiding Officer City Councilor City Councilor City Councilor City Councilor City Councilor City Councilor City Councilor City Councilor City Councilor City Councilor City Councilor CityCouncilOr(IndigenousPeoples Representative) City CouncilOr(President, Liga ng mga Barangay) City Councilor (OL) WHEREAS, the Philippine Constitution, in the Declaration of Principles and Policies, mandates that the state shall promote social justice in all phases of national development; WHEREAS, Article 13 of the same Constitution includes disabled persons as one of the priority sectors to be given access to essential goods and services at affordable cost and further provides that the state shall establish a special agency for disabled persons for their rehabilitation, self-development and self-reliance and their integration into the mainstream of society; WHEREAS, national and local government agencies are directed to implement programs and services to ensure the full participation of Persons With Disability(PWD) in all aspects of community life thru Republic Act 7277, otherwise known as the Magna Carta for Disabled Persons, and later amended thru Republic Act 9442 which provides other privileges and incentives to PWDs; WHEREAS, Section 16 of Republic Act 7160, otherwise known as the Local Government Code of 1991 states that "government units, shall ensure and support among other things, the preservation and enrichment of culture, promote health and safety, enhance economic prosperity and social justice, promote full employment among their residents, maintain peace and order, and preserve the comfort and convenience of the inhabitants", ORDINANCE NO.13, SERIES OF 2015 Page 1

WHEREAS, in order to sustain and continuously carry out the tasks of monitoring, evaluation, data gathering, needs assessment, planning, establishment of production center, creation of job opportunities and advocacy in General Santos City, establishing the Persons With Disability Affairs Office (PDAO) to serve as its structural organization for the implementation of the abovementioned purpose is necessary;

NOW, THEREFORE, on motion of City Councilor Shandee Theresa 0. Llido-Pestano, duly seconded by City Councilors Elizabeth B. Bagonoc and Rosalita T. Nunez, be it-

Resolved, as it is hereby resolved to enact this Ordinance:

ORDINANCE NO. 13 Series of 2015

AN ORDINANCE ESTABLISHING THE PERSONS WITH DISABILITY AFFAIRS OFFICE (PDAO) IN GENERAL SANTOS CITY AND APPROPRIATING FUNDS THEREFOR

Be it ordained by the Sangguniang Panlungsod of the City of General Santos that:

SECTION 1. TITLE.- This ordinance shall be known as the PERSONS WITH DISABILITY AFFAIRS OFFICE (PDAO) ORDINANCE OF GENERAL SANTOS CITY.

SECTION 2.- SET-UP

A. There shall be established a Persons with Disability Affairs Office (PDAO) which shall be attached to the City Social Welfare and Development Office. The office shall be manned by sufficient number of employees to ensure delivery of services to the sector. Preference must be given to qualified persons with disabilities.

B. The City Mayor shall assign a Public Services Officer who shall serve as the focal person to handle the affairs of the sector.

SECTION 3.- COMPOSITION.- The Person with Disability Affairs Office (PDAO)shall be composed of the following:

1. One (1) Public Services/Focal Person 2. Two (2) Community Relations Officers 3. One (1) Clerk

SECTION 4. FUNCTIONS.- The Functions of the Office/focal Person, shall be the

following:

1. Formulate and implement policies, plans and programs for the promotion of the welfare of the PWDs in coordination with concerned national and local government agencies, Peoples Organizations (Pos), and Non-Government Organizations (NGOs);

2. Coordinate the implementation of the provisions of RA 10070, Batas Pambansa Blg. 344, otherwise known as the Accessibility Law, and other relevant laws at the local level;

3. Represent PWDs in the meetings of the local development councils and other special bodies;

4. Recommend and enjoin the participation of Non-Government Organizations (NGOs)and Peoples Organizations (Pos) in the implementation of all disability related laws and policies;

5. Gather and compile relevant data on PWDs in their localities;

6. Disseminate information including, but not limited to, programs and activities for PWDs, statistics on PWDs, including children with disability, and training and employment opportunities for PWDs;

7. Submit reports to the office of the local chief executive on the implementation of programs and services for the promotion of the welfare of PWDs in their respective areas of jurisdiction;

8. Ensure that the policies, plans and programs for the promotion of the welfare of PWDs are funded by both the national and local government;

9. Monitor fundraising activities being conducted for the benefits of PWDs; and

10.Seek donations in cash or in kind from local or foreign donors to implement approved work plans for PWDs, in accordance with existing laws and regulations; and perform such other functions as may be necessary for the promotion and protection of the welfare of PWD's.

SECTION 5.- As mandated in Section 4 of RA 10070, the Local Government of General Santos City shall ensure that the necessary fund from any available local revenue is allocated for the implementation of the PDAO activities for the benefit of PWDs in the city. For the succeeding years of implementation, PDAO funding shall be included in the City's Annual Plans and Budget. The fund shall be used exclusively for the Persons with Disability Affairs Office (PDAO), including but not limited to its operational costs, implementation of programs that will promote and alleviate the welfare of the PWDs, and provision of basic services.

• • SECTION 6.- SEPARABILITY CLAUSE.- If for whatever reason, any provision of the

Ordinance is declared to be unconstitutional or invalid, the other provisions hereof not so affected shall continue to be in full force and effect.

SECTION 7.- EFFECTIVITY CLAUSE.- This ordinance shall take effect fifteen (15) days after its publication in a newspaper of general circulation within the City of General Santos.
