RE: Common Council Petition #34779, Alderman Salerno for “Please have the police department increase traffic patrol an in the area of Daly Avenue and Willow Street. Residents have expressed concerns of excessive speeding in the area especially between the hours of 7pm and 12am and also have noticed many drivers not obeying the posted stop signs.”

Date: March 17, 2020

The New Britain Police Department Traffic Safety Bureau was made aware of this petition in March 2020. A site survey was conducted of the intersection to ensure that the area was appropriately marked with traffic control signs. All four corners of the intersection were found to be properly marked with clear and clean stop signs.

A check of two years of motor vehicle stop data from the immediate area shows twenty (20) motor vehicle stops were conducted. Of these stops seven (7) were for failing to obey the posted stop signs. In total the following enforcement action was taken for various motor vehicle charges; three (3) infractions, eleven (11) misdemeanor summons’, one (1) full custody arrest and five (5) verbal warnings. All of these stops occurred during the course of regular patrol duties. Traffic Sergeant Michael Cummiskey recommended that this petition be granted, and officers will continue to conduct motor vehicle enforcement in this area.

The Board voted to approve petition # 34779 for officers to continue to conduct motor vehicle enforcement in this area.

This petition was previously discussed during the January 2020 Board of Police Commissioners Meeting. It was previously documented that no crashes at this intersection were the result of speed, speed enforcement is occurring in the area, and the average speeds of vehicles travelling in the area are reasonable. This petition had been tabled to allow further consultation with public works engineers regarding signage improvements to improve compliance with the stop signs at the requested intersection. Based on site surveys and information gathered regarding the intersection, Traffic Sergeant Michael Cummiskey recommended that the following improvements be made which will conform with current MUTDC standards;• Carroll Street at Farmington Avenue: Add “Cross Traffic Does Not Stop” placard to existing stop sign.• McKinley Drive at Farmington Avenue: Add “Cross Traffic Does Not Stop” placard to existing stop sign.• Vertical Red Reflective Striping to be added to the vertical supports of Both Stop Signs.• Farmington Ave Northbound: A “Cross Road” warning sign be installed approximately 325 feet prior to Carroll Street. • Farmington Ave Southbound: A “Cross Road” warning sign be installed approximately 325 feet prior to McKinley Drive.

The Board voted to approve petition # 34939 and accept the listed recommendations of Sgt. Cummiskey.

RE: Common Council Petition #34978, Alderman Santiago for the appropriate department(s)to conduct a speed evaluation in the area of Corbin Avenue and Sterling Street. Residents have complained about on-going speeding issues in this area, especially near the highway off-ramp.”

Date: March 17, 2020

During the February 18th Board of Police Commissioners meeting, this petition was tabled to allow a speed study to be conducted within the petitioned area. Since this meeting, the New Britain Police Department had officers monitor traffic on the street with no violations being observed while on site.

Speed data was collected for the street for two weeks beginning February 19th, 2020 through March 4th, 2020. Due to street design, speed data could only be collected for eastbound traffic. This is not a limiting factor in this petition as interviews with local residents revealed that most speed concerns involve eastbound travelling vehicles. The data shows that out of almost 12,000 vehicles the average speed is 24 miles-per-hour with an 85th percentile speed of 32 miles-per-hour and the majority of vehicles travel at a speed of 27 miles-per-hour or less.

Based on interviews of residents, scene observations and data collected, it is my recommendation that updated speed signs be installed/re-installed at appropriate locations on Sterling Street. Further enforcement of speeding will be conducted by the New Britain Police Department.

RE: Common Council Petition #35001, Alderman Iris Sanchez for “the appropriate department(s) to install a “No Parking Anytime” sign in front of 246 North Street.”

Date: March 17, 2020

A site survey of the location found that there is currently no signage regulating parking in front of the petitioned address. 246 North Street is a multistory, mixed use building located at the northwest corner of the intersection of North Street and Stanley Street, with Willow Street abutting it immediately on its west side. The location of the building in respect to the roadway makes it difficult to see vehicles parked in front of 246 North Street when turning from Stanley Street in a southbound direction. The roadway in front of the property is two lanes wide, with no marked shoulder and becomes very narrow when a vehicle is parking in front of 246 Stanley Street. This stretch of roadway is bisected by a crosswalk with handicap ramp. The crosswalk is located at approximately the midpoint of the block, further limiting space for vehicles to park and still allow safe pedestrian passage.

It is further noted that there is on street parking immediately adjacent to 246 North Street on Willow Street. A legal parking space requires it be a minimum of fifteen (15) feet from the nearest intersection and minimum of 10 feet from the nearest crosswalk. The area in front of 246 North Street does not provide the needed space due to the location of the crosswalk, and proximity to two intersections, there is not enough space to provide a legal parking space. Sergeant Michael Cummiskey recommends that this petition be approved and appropriate “No Parking Any Time” signage is installed in front of 246 North Street.

RE: Common Council Petition #35015, Alderman Thompson for “the appropriate department(s) to evaluate the need for installation of a stop sign on Highview Avenue at Biruta Street. Residents have complained about motorists rolling through the intersection.”

Date: March 17, 2020

A site survey of the location confirmed that there is no traffic control signage at the petitioned intersection, making this intersection an assumed stop. With Biruta Street being a high volume connector between Farmington Avenue and Burritt Street, a stop sign with stop bar is appropriate for the petitioned location. Traffic Sergeant Michael Cummiskey recommended that this petition be approved.

With Biruta Street being a high volume connector between Farmington Avenue and Burritt Street, a stop sign with stop bar is appropriate for the petitioned location. Traffic Sergeant Michael Cummiskey recommended that this petition be approved.

WHEREAS, the Common Council in Item #34996-2 was considering an amendment to gender neutralize all applicable provisions in the Code of Ordinances; and

WHEREAS, the proposed Amendment would be one hundred thirty-one (131) pages which is cost prohibitive to implement; and

WHEREAS, Section 1-2 “Rules of construction and definitions of the Code of Ordinances” already defines the term “Gender” as “The use of any gender shall include the other genders”; and

WHEREAS, the Common Council in lieu of proceeding with Item #34996-2 recognizes that it is important to include all applicable forms of the term Gender in its construction and application of the Code of Ordinances; now therefore be it

RESOLVED, that the use of any gender reference in any provision of the Code of Ordinances shall refer to and include “he, she, him, her, man, woman, men, women, they and/or them” as may be applicable; and be it further

Chapter 5, Article II, Sec. 5-18. Same—issuance; conditions; duration; contents.

The common council shall, upon the recommendation of the committee on licenses, after receipt of an application and fee filed pursuant to the provisions of this article, grant to the applicant a license to display or produce a public amusement, concert, opera or other performance or shall notify the applicant of the denial of his application and the reason or reasons therefor. Such license shall be granted under such reasonable conditions or terms and for such period of time as is in the best interests of the public health, safety and good morals of the residents of the city. All such licenses granted under this article shall contain the date of issuance, the name of the licensee, the license fee paid and the name or style of the exhibition licensed.

Chapter 5, Article II, Sec. 5-59. Same—Circus and carnival.

(a) There shall be a special license available to any applicant who operates a circus, carnival, bazaar or similar transient operation. Such license shall be granted after application as provided for regular licenses herein, but shall be valid only for a designated period not to exceed fourteen (14) days, which period shall be specified by the applicant upon application. The license fee for such a license shall be two hundred dollars ($200.00).

(b) Such license fee may be waived by the common council for all circus, carnival or bazaar events conducted by, for or on behalf of charitable, religious or educational associations or societies. The license committee of the common council shall have jurisdiction to make any determination required to allow such a waiver, but the common council must as a body vote to waive the fees.

(c) Any applicant who operates a circus, carnival, bazaar or similar transient operation on property owned by the City of New Britain shall be required to have insurance which conforms to the city's standards, names the City of New Britain and Consolidated School District as an additional insured and includes a hold harmless and indemnification agreement in favor of the City of New Britain.

Chapter 14, Article V, Sec. 14-92. Term; fee; renewal; revocation.

(a) Term. The term of each junkyard license shall be for a period of one year beginning on February first and ending at midnight on January thirty-first of the following year.

(b) Initial fee and renewal. A fee of one hundred dollars ($100.00) shall be paid to thelicense committee Building/Housing Inspections and Permitting Division of the Health and Building Services Department for the original license and a fee of fifty dollars ($50.00) for each renewal thereof.

(c) Revocation. Any violation of this article shall be, in addition to any penalty provided for in this Code, sufficient cause for revocation of such license by the council upon recommendation of the license committee, after a public hearing by such committee upon charges of such violation.

Chapter 14, Article V, Sec 14-93. Standards required for issuance.

No person shall be licensed to operate a junkyard unless such junkyard conforms to the following standards:

(1) Enclosure. All junkyards shall be completely enclosed, except for such areas as may be approved by the licensing committee Common Council for entrance, exit and loading and unloading purposes. The enclosure shall consist of fencing to a height of not less than eight (8) feet or more than ten (10) feet above grade level constructed according to the following specifications:

(a) Chain link fencing attached to steel poles of a minimum of two (2) inches in diameter, buried to a depth sufficient to enable the construction to withstand lateral wind pressure and frost heave. Screening of the chain link fencing shall be provided by the installation of vinyl slats weaved through the chain links. Vinyl slats shall be of earth tone colors to effectively provide screening and to be aesthetically pleasing; or

(b) One-inch by six-inch .40 pressure treated lumber attached to .40 treated two (2) inch by four (4) inch cross braces. Braces shall be spaced no more than two (2) feet on center and shall be firmly attached to four-inch by four-inch .60 pressure treated posts, cedar posts or two-inch diameter steel posts, buried to a depth sufficient to enable the construction to withstand lateral wind pressure and frost heave.

(2) Maintenance of fences. All such fences shall be kept in good repair. All fences erected prior to June 1, 1960, upon replacement, shall conform to the standards set forth in paragraph (a) of this section.

(3) Storage of junk. No junk shall be piled to a height exceeding the height of the fence surrounding it in any junkyard. No junk shall be stored within one thousand (1,000) feet of any street line, or within two hundred fifty (250) feet of any adjoining property line, or within twenty-five (25) feet of any dwelling house; provided, however, that these distance requirements shall not apply to junkyards existing prior to June 1, 1960.

WHEREAS, the month of April is annually designated Autism Awareness month and April 2 is World Autism Awareness Day; and

WHEREAS, according to the CDC, Autism now effects 1 in 54 individuals; and

WHEREAS, our New Britain families seek understanding, acceptance and inclusion for loved ones challenged by the social, communication, sensory processing and restrictive and/or repetitive behaviors characteristic of Autism; and

WHEREAS, Autism Speaks has designated the year 2020 for their kindness campaign initiative, asking the public to achieve one million acts of kindness big and small impacting the lives of individuals with Autism; and

WHEREAS, during this pandemic health crisis, the need to stay at home increases the challenges on our families with Autism; and

NOW, THEREFORE, BE IT RESOLVED that the Mayor, Common Council and entire City of New Britain embrace the kindness movement and will look for opportunities to be supportive and inclusive of our Autism families; and

To Her Honor, the Mayor, and the Common Council of the City of New Britain:the undersigned beg leave to recommend the adoption of the following:

WHEREAS, COVID-19, a respiratory disease that spreads easily from person to person and may result in serious illness or death, has infected thousands of Connecticut residents and resulted in more than 100 deaths; and

WHEREAS, in response to the public health threat of COVID-19, the Governor of the State of Connecticut, the President of the United States, and the Mayor of the City of New Britain have subsequently declared states of emergency to protect public health and slow the spread of the disease; and

WHEREAS, on March 12, 2020, Governor Ned Lamont requested that all state and private employees work from home, if possible; and

WHEREAS, on March 20, 2020, Governor Ned Lamont issued an executive order asking non-essential businesses and residents to “stay safe and stay home;” and

WHEREAS, on April 6, 2020, Governor Ned Lamont stated that “everybody who can work from home has to work from home and that includes city employees;” and

WHEREAS, many other municipalities and the Consolidated School District of New Britain have each negotiated memorandums of understanding with their unions to enable remote work, allowing thousands of local government and school district employees to work from home; and

WHEREAS, the City of New Britain recently used RemotePC, a remote access technology, to allow Council members to remote into their Council computers; and

WHEREAS, the health and safety of City employees is paramount, especially those employees who, according to the Centers for Disease Control and Prevention, are vulnerable to COVID-19 such as people over the age of 65, people whose immune systems are vulnerable, and people who are susceptible to respiratory infections such as pregnant women;

NOW, THEREFORE, BE IT RESOLVED, that this Common Council requests that Mayor Erin Stewart take any and all appropriate action to cause and require City employees, to the extent feasible, to perform and complete their work in whole or in part from home, and to the extent reasonably appropriate, to provide such employees with the necessary technological devices and infrastructure required to enable such City employees to work in whole or in part from home.

WHEREAS, the mayor of New Haven, like many other Connecticut mayors and first selectpersons, declared that starting in March 22 “City employees that are not critical to operations will be notified that they should not report to work.” and that the mayor’s team “will be evaluating our employee safety and operations protocol, in addition to increasing options for teleworking where possible.”; and

NOW, THEREFORE, BE IT RESOLVED that the Common Council of the City of New Britain encourages Mayor Erin Stewart to evaluate which city employees can do their work remotely from home; and

BE IT FURTHER RESOLVED that Mayor Erin Stewart would provide the appropriate devices and technology to allow where-ever possible for city employees to work from home.

Item # RE: Public Bid No. 3951, Columbus Boulevard & Chestnut Street Phase VII Downtown Complete Streets project, Public Works Department

To Her Honor, the Mayor, and the Common Council of the City of New Britain:the undersigned beg leave to recommend the adoption of the following:

WHEREAS, public bid No. 3951 was solicited and received in accordance with theOrdinances of the City of New Britain for the Columbus Boulevard & Chestnut Street Phase VII Downtown Complete Streets project for the Public Works Department; and

WHEREAS, this project was design in-house by the Public Works Department Engineering Division and is 100% funded by a State of Connecticut Department of Economic and Community Development (DECD) grant; and

WHEREAS, invitations to bid were solicited in accordance with DECD requirements. The bid was duly advertised on the City and the State of Connecticut Department of Administrative Services websites. Responses were received as per attached; and

WHEREAS, the bids were reviewed for conformance to specifications by the Public Works Department Engineering Division and the Public Works Department is therefore recommending that the bid be awarded to Martin Laviero Contractor, Inc. of Bristol, CT.who submitted the lowest responsible bid and met all of the bid specifications for theColumbus Boulevard & Chestnut Street Phase VII Downtown Complete Streets project;and

WHEREAS, funding is available in the State Grants Responsible Growth and TOD account numbers 253106008-5855 Contractor Expenditures and 253106008-5871 Contingency; and

NOW, THEREFORE, BE IT RESOLVED, that the Purchasing Agent is herebyauthorized to issue a purchase order for $1,749,898.75 and enter into a contract with Martin Laviero Contractor, Inc. of Bristol, CT. for Public Bid No. 3951, Columbus Boulevard & Chestnut Street Phase VII Downtown Complete Streets for the Base Bid and Bid Alternate No. 1 for the Public Works Department per the terms and specifications of Public Bid No. 3951.

Item # RE: Public Bid No. 4014, for the Recreation and Community Services Department

To Her Honor, the Mayor, and the Common Council of the City of New Britain:the undersigned beg leave to recommend the adoption of the following:

WHEREAS, Public Bid No. 4014 was solicited and received in accordance with the Purchasing Ordinances of the City of New Britain for the sale of Park Concession Rights at various City Parks; and.

WHEREAS, Under the terms of this public bid, bidders were to offer payment to the City for the right to provide concession services at various City Parks; and

WHEREAS, Invitations to bid were solicited and the bid was duly advertised in the New Britain Herald, the City and State of Connecticut’s Department of Administration Services websites and e-mailed to one hundred and seven (107) and mailed to one (1) Concession Companies. The Purchasing Agent did not receive any letters from the Concession Companies on the mailing list who indicated they could not provide a response to the bid request; and

WHEREAS, The money received for the Park Concession Rights at various City Parks will be was deposited into 001420001-4411, Recreation Programs, Concession Rentals; and

WHEREAS, Only one Bid response was received as per attached; and

WHEREAS, The bid were reviewed for conformance to specifications by the Recreation and Community Services Department’s Administration and the Purchasing Agent; and

WHEREAS, Therefore the Director of the Recreation and Community Services Department is recommending that Plagia Company, Inc of Waterbury, CT be awarded the Concession Rights for Chesley Park, A.W. Stanley Park, Stanley Quarter Park, Washington Park, Willow Street Park, Walnut Hill Park and Willow Brook Park who offered a payment of $3,347.00 to the City for the Concession Rights to these Parks; and

NOW, THEREFORE, BE IT RESOLVED, That the Purchasing Agent is hereby authorized to grant Plagia Company, Inc of Waterbury, CT the concession rights for Chesley Park, A.W. Stanley Park, Stanley Quarter Park, Washington Park, Willow Street Park, Walnut Hill Park and Willow Brook Park in accordance with the payment, terms and specifications of Public Bid No. 4014.

WHEREAS, Public Bid No. 4015 was solicited and received in accordance with the Purchasing Ordinances of the City of New Britain for the July 4, 2020 Fireworks for the Recreation and Community Services Department; and

WHEREAS, Funding will be available for the July 4, 2020 Fireworks within the July 4th Fireworks Fund, 256417010-5807; and

WHEREAS, Invitations to bid were solicited and the bid was duly advertised in the New Britain Herald, the City and State of Connecticut’s Department of Administration Services websites and e-mailed to five (5) Fireworks Display Companies. The Purchasing Agent did not receive anye-mails from the Fireworks Display Companies on the e-mail list who indicated that they could not respond to the bid request; and

WHEREAS, Only one (1) bid response was received again this year. The Bid response that was received is per the attached; and

WHEREAS, The bid was reviewed for conformance to specifications by the Recreation and Community Services Department’s Administration and the Purchasing Agent. The bid was reviewed to determine the shell size, shell type, number of shells, a complete description of thefinale and the time length of the show included in the bid submitted; and

WHEREAS, Atlas Pyrovision. Entertainment Group, Inc. was the only Fireworks Display Company to submit a bid this year. They have provided July 4th Fireworks Displays in the past to other municipalities in Connecticut and New England and was highly recommended after conducting several reference checks; and

WHEREAS, The Director of the Recreation and Community Services Department is recommending that the bid be awarded for the July 4, 2020 Fireworks Display to Atlas Pyrovision Entertainment Group, Inc. of Jaffrey, NH; and

WHEREAS, The New Britain Police, Fire, & Communications Department requested a purchase order for the purchase of the InTime scheduling and timekeeping system for the New Britain Police, Fire, and Communications Divisions. The InTime systems are exclusively designed for 24 hour emergency services type entities and are needed on a daily basis by the New Britain Police, Fire, & Communication Departments; and

WHEREAS, InTime is the manufacturer of this scheduling and timekeeping system and the associated hardware and software. They do not have a dealer in the State of Connecticut where their products can be purchased. All purchases for software, maintenance, and warranties must be made directly from InTime. The Purchasing Agent verified this and has been in contact with InTime. Therefore bid solicitation for the purchase of the InTime scheduling and timekeeping system along with software maintenance would not be beneficial to the City, and

RESOLUTIONItem # RE: Participation in the Deferment Program and Low

Interest Rate Program

To Her Honor, the Mayor, and the Common Council of the City of New Britain:the undersigned beg leave to recommend the adoption of the following:

WHEREAS, COVID-19, a respiratory disease that spreads easily from person to person and may result in serious illness or death, has infected thousands of Connecticut residents and resulted in dozens of deaths; and

WHEREAS, in response to the public health threat of COVID-19, the Governor of the State of Connecticut, the President of the United States, and the Mayor of the City of New Britain have subsequently declared states of emergency to protect public health and slow the spread of the disease; and

WHEREAS, a large number of New Britain residents have lost their jobs as a result of business closures, creating economic hardship that will make payment of taxes to the City of New Britain difficult for homeowners and landlords whose tenants are no longer able to pay rent in full; and

WHEREAS, on April 1, 2020, Governor Ned Lamont issued an executive order allowing municipalities to participate in one or two programs “to offer support to eligible taxpayers, businesses, nonprofits, and residents who have been economically affected by the COVID-19 pandemic,” the “Deferment Program” and/or the “Low Interest Rate Program;” and

WHEREAS, the Deferment Program allows municipalities to offer “a deferment by ninety (90) days of any taxes on real property, personal property or motor vehicles, or municipal water, sewer and electric rates, charges or assessment for such tax, rate, charge, or assessment from the time that it became due and payable,” if it became due during the period of March 10, 2020 through and including July 1, 2020, for any taxpayer that attests to significant economic impact by COVID-19; and

WHEREAS, the Low Interest Rate Program allows municipalities to reduce the interest charged on “the delinquent portion of the principal of any taxes on real property, personal property or motor vehicles, or municipal water, sewer and electric charges or assessments or part thereof” to three (3) per cent per annum (from the current maximum rate of eighteen (18) per cent per annum), if the tax or charge was due and payable during the period or March 10, 2020 through and including July 1, 2020, or had been delinquent on or prior to March 10, 2020, after which time the remaining delinquent portion will be subject to the previously established rates; and

WHEREAS, in order to provide tax relief to New Britain taxpayers and residents, the Common Council of the City of New Britain must vote on and notify the Secretary of the Office of Policy and Management no later than April 25, 2020 of its determination to participate in the Deferment Program and/or the Low Interest Rate Program;

NOW, THEREFORE, BE IT RESOLVED, that the Common Council of the City of New Britain determines to participate in the Deferment Program for taxpayers that attest to significant economic

impact by COVID-19 and authorizes Mayor Erin Stewart to notify the Secretary of the Office of Policy and Management and to implement the Deferment Program; and

RESOLUTIONItem # RE: ESSENTIAL CITY OF NEW BRITAIN OPERATIONS

To Her Honor, the Mayor, and the Common Council of the City of New Britain: the undersigned beg leave to recommend the adoption of the following:

WHEREAS, COVID-19, a respiratory disease that spreads easily from person to person and may result in serious illness or death, has infected thousands of Connecticut residents and resulted in dozens of deaths; and

WHEREAS, in response to the public health threat of COVID-19, the Governor of the State of Connecticut, the President of the United States, and the Mayor of the City of New Britain have subsequently declared states of emergency to protect public health and slow the spread of the disease; and

WHEREAS, in response to the public health threat of COVID-19, the Governor of the State of Connecticut issued on March 20, 2020, an executive order asking non-essential businesses and residents to “stay safe and stay home”; and

WHEREAS, the City of New Britain is committed to continuing to provide essential services to our residents and has gone above and beyond in enacting numerous proactive measures in ensuring City employees remain safe in providing such services; and

NOW, THEREFORE, BE IT RESOLVED that the Common Council of the City of New Britainoffers their sincere gratitude and appreciation to all essential City of New Britain employees and first responders for their steadfast service and accessibility to the public at this challenging time; and

BE IT FURTHER RESOLVED that the Common Council encourages the leadership of city unions to work with Mayor Erin Stewart to ensure that essential City of New Britain operations continue throughout this unprecedented time.

RESOLUTIONItem # ______________ RE: State Mandated Tax Deferral/Low Interest Rate Program

To Her Honor, the Mayor, and the Common Council of the City of New Britain:the undersigned beg leave to recommend the adoption of the following:

WHEREAS, COVID-19, a respiratory disease that spreads easily from person-to-person and may result in serious illness or death, has infected thousands of Connecticut residents; and

WHEREAS, in response to the public health threat of COVID-19, the President of the United States, the Governor of Connecticut, and the Mayor of the City of New Britain have subsequently declared states of emergency to protect public health and slow down the spread of the disease; and

WHEREAS, a large number of New Britain residents have lost their jobs as a result of business closures, creating an economic hardship that will make payment of taxes to the City of New Britain difficult for homeowners and landlords whose tenants are no longer able to pay rent in full; and

WHEREAS, on April 1, 2020, Governor Ned Lamont issued Executive Order 7S, mandating municipalities to participate in one or two programs “to offer support to eligible taxpayers, businesses, nonprofits, and residents whom have been economically affected by the COVID-19 pandemic;” a “Deferment Program” and/or a “Low Interest Rate Program;” and

WHEREAS, the Deferment Program allows municipalities to offer “a deferment by ninety (90) days of any taxes on real property, personal property of motor vehicles, or municipal water, sewer, and electric rates, charges, or assessment for such tax rate, charge, or assessment from the time that it became due and payable,” if it became due during the period of March 10, 2020 through and including July 1, 2020, for any taxpayer that attests to significant economic impact by COVID-19 ; and

WHEREAS, the Low Interest Rate Program allows municipalities to reduce the interest charged on “the delinquent portion of the principal of any taxes on real property, person property or motor vehicles, or municipal water, sewer, and electric charges or assessments or part thereof,” to three (3) percent per annum (from the current maximum rate of eighteen (18) percent per annum, if the tax or charge was due and payable during the period of March 10, 2020, through and including July 1, 2020, or had been delinquent on or prior to March 10,2020 after which time the remaining delinquent portion will be subject to the previously established rates; and

WHEREAS, the Governor’s Executive Order stated that municipalities shall pass a resolution allowing one or both of these programs, and submit it to the State Office of Policy and Management by no later than April 25, 2020; and

WHEREAS, due to the amount of questions received by town leaders throughout the state, the State Office of Policy and Management is working to distribute additional guidance to municipalities further explaining the terms of these programs; and

WHEREAS, the Common Council of the City of New Britain recognizes that there will be an economic impact to the taxpayers of the city and city operations; and

WHEREAS, upon receipt of the guidance from OPM, the Common Council encourages the Finance Department, the Assessor’s Office and the Tax Collector to quickly study such impact before making recommendations to the Mayor on the program offerings.

NOW, THEREFORE, BE IT RESOLVED, that the Common Council of the City of New Britain authorizes Mayor Erin Stewart, in consultation with the aforementioned departments, to notify Secretary of the Office of Policy and Management and the Common Council of the participation in one or both of the Deferment Program and the Low Interest Rate Program by no later than April 25, 2020.
