SPECIAL NOTES FOR PRE QUALIFICATION

1. The downloaded tender should be submitted to Superitending Engineer (TR), Circle Office,

Visnagar Road, Mehsana, it should be distinctly indicated as “Bid against Tender No MTC/112014/01.

Contractor will have to submit their offer in two bids (1) TECHNICAL BID (2) PRICE BID. They

have to put the price bid sealed cover into the technical bid sealed cover other wise offer will be rejected.

2. The tenders must be sent by Registered Post / Speed Post only as to reach this office on or

before last date for receipt of tender as stated in the Tender Notice up to 15:00 hours. Tenders which are received late after due date of receipt will not be considered.

3. The rates are to be submitted in price bid. The Schedule-B shall be filled up with the quoted %

above or below & shall be submitted in sealed envelope superscripted – PRICE BID for “ANNUAL JOB CONTRACT FOR TENDERING FIRE FIGHTING SERVICES FOR OPERATION & MAINTENANCE OF E-MULSIFRE SYSTEM & FIRE EQUIPMENTS AT 400KV VADAVI S/S”. The Quoted % above or below shall be written both in words, & figures. If any discrepancy occurs between words & figures, then words shall prevail. The tender documents shall be written legibly & free from erasure, overwriting or conversions of figures, crossing out, initializing, dating & rewriting, shall be avoided. In case of any deviation in figure and words the rates quoted in words will prevail.

4. Tenders must be submitted in the enclosed schedule of work & quantities. Those received in

any other form will not be accepted. They should be accompanied by a covering letter in which the bidder should give all information as called for in the specifications & any other point which he would like to be considered along with the tender.

5. Any tender not bearing signature of the bidder & seal of the company on all the documents

accompanying the tender is liable to rejection. Further it is specifically instructed that conditional tenders shall summarily be rejected.

6. The Tenderer who offers the lowest in percentage (%) i.e. lowest total amount will be awarded /

recommended for placement of order. Item wise lowest % / value will not be considered for placement of order.

7. Failure to furnish full and complete details or furnishing vague information will make the tender

liable for rejection. The Tenderer is at full liberty to give information about his capacity and establishment to execute the work / contract.

8. The offer should be valid for a minimum period of 180 days from the date of opening of Tender. 9. The Technical Bid shall be opened as stated in the Tender Notice at 16:00 hours in the office of

Superitending Engineer (TR), Gujarat Energy Transmission Corporation Limited, Circle office, Mehsana (if possible).

10. The Tenderer offering their “Technical Bid” against this specification should satisfy following

criteria. The proof of such criteria should be submitted in the “Technical Bid.” If all or any of one of these criteria is not satisfied then their technical bid may be liable for rejection.

a) Registration: Bidder quoting for the bid shall have registration in appropriate class with

GETCO / Central / State Government / Railway / Semi. Govt.

b) Experience: Contractor should produce evidence of having experience in executing similar nature & magnitude of jobs preferably photo copy of orders secured from GETCO / Central / State Government / Railway / Semi – Government and satisfactory completion certificate from respective department.


c) Bank Solvency: Latest bank solvency certificate from any Schedule / Nationalized bank for

minimum 20 % amount of the estimated cost of tender. d) P.F. Registration: The P.F. Registration No. (Works) towards your firm registered with

Regional P. F. Commissioner. e) Earnest Money Deposit (EMD): 1% of estimated cost should be paid only by Demand Draft

drawn in favor of “GUJARAT ENERGY TRANSMISSION CORPORATION LTD.,” on any Nationalized / Scheduled Banks situated at “MEHSANA”. The Tender without E.M.D. or with part payment of EMD will not be opened or considered.

f) The copy of Service Tax registration certificate.

1 GENERAL TERMS AND CONDITTION

1.1 INVITATION OF TENDER:

The Superitending Engineer (TR), Mehsana for and on behalf of "GUJARAT ENERGY TRANSMISSION CORPORATION LTD", having its Head Office at Vidyut Bhavan, Race Course, Vadodara - 390 007, hereafter called the "GETCO" intends to invite Tender for “Annual Job contract for rendering fire fighting services for Operation & Maintenance of

Emulsifier System & Fire equipments at 400 KV Vadavi s/s under Chhatral TR. Division” as detailed in this specification.

1.2 DEFINITION:

1. The "GETCO" shall mean the Gujarat Energy Transmission Corporation Ltd, Vadodara and shall include their authorized representatives. 2. The “Contractor’’ shall mean the bidder, whose tender has been accepted by the GETCO for award of the contract and shall include his authorized representatives. 3. The "Engineer-in-Charge" shall mean the authorized officer of the GETCO to act as Engineer-in-Charge to supervise the work for the purpose of the contract. 4. The "Specification" shall mean the tender forming a part of the contract along with Performa, Schedules and Drawings. The "Order” shall mean the official letter issued by the GETCO, informing the bidder that his tender has been accepted. 5. The “Contract” shall mean the agreement to be entered into by the GETCO with the contractor and shall include the commercial, technical and general conditions, schedules, drawings and any other conditions specifically agreed between the parties forming a part of the contract. 6. The “Contract Value” shall mean the total amount indicated in the contract agreement as per order placed by the GETCO and calculated from the provisional quantities indicated in the tender. 7. The "Completion Period" shall mean the period starting from the date of issue of commencement given by executing authority and required to complete the work. 1.3 AMENDMENT OF TENDER:

At any time prior to the submission of tenders, the GETCO may for any reason whether at his own initiative or response to a clarification requested by bidder, modify the Tender conditions by amendment. The amendment for the same will be declared the same web site.

1.4 THE TENDER:

1. The tenders must be sent by Registered Post / Speed Post only so as to reach this office on or before specified date & time. Due care should be taken to see that the tenders sent are posted early enough to ensure their delivery by the prescribed date or even earlier.

2. The tenders received after time and date specified in the tender notice, will not be accepted. Once the offer submitted by the contractor before due date of submission, the contractor will not be allowed to submit revised / additional / modified / other even before due date. However, if the issue and receipt of tender is extended by the Corporation due to any reason, the contractor June submit the revised offer before due date of submission, if he wish to submit.

3. The EMD will be forfeited by the GETCO in case of successful bidder who after his tender has been accepted, refuses to pay the security deposit, sign & complete the contract document before the validity of the offer. EMD of the unsuccessful Tenderer will be refunded within 180 days of placing of the order with the successful Tenderer and when the Tenderer asked for refund to the Superitending Engineer (TR), GETCO, Mehsana the original receipt of the EMD together with the advanced stamped receipt should be furnished along with application for refund of EMD.

4. The bidder shall be deemed to have satisfied himself with all the conditions and circumstances affecting the prices and possibility of executing the work. The bidder shall fix his prices taking into account the site & its surroundings, approach roads etc. No idling / mobilizing / demobilizing / remobilizing OR any other type of claim shall be admitted and paid on any part of the work.

5. No deviations from the Terms & Conditions of the Contract & or Technical Specification stipulated in this Contract shall be permitted & the tenders received with deviations shall summarily be rejected.

6. The Tenderer should fill in all schedules and submit all the details called for in this specification in prescribed Performa only.

1.5 GETCO'S RIGHT:

1. The GETCO reserves the right of terminating this contract or part thereof at time during its

tendency without giving notice of Termination or the reasons thereof. 2. The GETCO will be entitled to deduct directly from the bills, to be paid to the contractor any sum or sums payable

by him and which sum / sums the GETCO is required to pay as a principal employer on account of contractor default in respect of all liabilities referred to.

3. The bidders shall specifically note that any overwriting or corrections or manuscript in the bid shall be ignored and will not be considered authentic unless the same are signed with Bidder's Stamp / Seal.

4. In case of any doubt or interpretation of the terms and condition, the decision of the Superintending Engineer (TR), Gujarat Energy Transmission Corporation Ltd, and Mehsana will be final and binding to the bidder and no dispute in this regard will be entertained.


5. The GETCO reserves the right to accept any bid irrespective of whether it is lowest or not or to reject any or all bids or cancel withdraw invitation to bid without assigning any reason there of. Such decision of the GETCO shall not be subject to question by any bidder or the GETCO shall bear no liability whatsoever for such decision.

1.6 CONTRACT: 1. The work covered by this Specification shall be carried out and governed by the GETCO's / GEB’s Booklet of

"General Terms and Condition of Contracts" herewith accepting where conditions specified in this Specification conflict with similar conditions in the Booklet. The Tenderer will be deemed to be fully aware of this Booklet and any ignorance of the same will not exempt the contractor from his liability to abide the same.

2. The successful contractor will have to sign an agreement as per the GETCO’s rules on stamped paper & the necessary stamp duty charges shall be borne by the contractor.

1.7 EFFECT AND JURISDICTION OF CONTRACT:

1. The contract shall be considered as having come into force from the date of issue of order, which is accepted by the Contractor. 2. The laws applicable by the contract shall be the laws in force in India. The court of Mehsana shall have exclusive jurisdiction in all the matters arising under this contract.

1.8 FORCE MAJEURE:

1. The following clauses which substantially affect the performance of the contract shall only be considered as force majors conditions. a) Natural phenomena, including but not limited to floods, droughts, earthquakes and epidemics.

b) Acts of any Government, domestic or foreign, including but not limited to war, declared or undeclared, priorities, guarantees, and embargoes. Provided the party affected by the 'Force Majeure' shall within fifteen (15) days from the occurrence of such a cause, notify the other party in writing of such cause with sufficient documentary proof.

2 Notwithstanding any provision mentioned above, the GETCO shall not be in any way be liable for non-performance either in whole or in part of any contract or for any delay in performance thereof in consequence of strikes, shortages, combination of Labor or workman or lockout, breakdown or accident to machinery or accidents of whatever nature.

3. The Contractor or the GETCO shall not be liable for delays in performing their respective obligations resulting from any force majeure causes as defined above. The date of completion will be extended by a reasonable time by mutual agreement.

4. In case of damage or destruction of any property or equipments belonging to the Contractor due to force majeure causes, the GETCO shall not be liable for the same.

1.9 FAILURE TO EXECUTE ORDER:

In case of failure on the part of Tenderer to cope up with the work within the stipulated period, the same will be got executed through other agency at the risk and cost of the Tenderer even at higher rates and the difference in amount, if any, will be recovered from the bidder. The company reserves the right to cancel the order without assigning any reason.

1.10 PENALTY CLAUSE FOR ACCIDENT : In case if any safety related fatal Electrical/Mechanical accident occurred to any employee of agency or outsider due to negligence or non-compliance of GETCO safety norms, then in addition to the compensation and liability as per statutory requirement, contractor / agency shall be penalized as under:

1.11 All Electrical / Safety rules should be observed by the contractor while work. If any occurrence take place during

the work, the contractor will be held fully responsible for the same. 1.12 Tenderer must quote rates only on firm price basis. 1.13 Income Tax as per prevailing rules will be deducted from the bills.


SCOPE OF WORK OF TENDER / CONTRACT 1. To respond immediately and attend the fire, rescue, an emergency and special call with fire

happens. 2. To carry out operation and maintenance of fire protection system, fire detection systems, fire

extinguishers, other fire and rescue equipments details as given in Annexure - I. 3. To maintain documents, records registers for daily routine work checking, inspection and test of

all fire and safety equipments including fire pumps systems and equipments at the frequency and as per Performa as may be prescribed by the GETCO from time to time and to ensure its cleanliness, upkeep, maintenance and operations.

4. To record and maintain the daily occurrence register of major and minor events occurring during

the period of 24 hours and report the same to the authorized officer of the GETCO i.e. Executive Engineer of 400 KV S/S Vadavi of such happening immediately and later on in the form of occurrence report.

5. To render any services any time as directed by the Executive Engineer of 400 KV S/S Vadavi. 6. To arrange for checking of all fire fighting devices installed in the sub-station while on round on

checking any thing found defective or not working shall be reported immediately to EE [TR] for rectification.

7. To carry out surprise checking personally by the Contractor or Contractor’s senior fire officers

particularly in night time for the alertness of the fire staff deployed by the Contractor in the premises and to keep them vigilant.

8. To improve the overall quality & performance of fire staff by imparting necessary training at

regular intervals in operation and maintenance of fire protection systems and equipments systems.

9. To conduct fire drill of fire staff on regular basis at least twice in a month. To arrange mock drills

quarterly associating sub-station staff. 10. To keep informed to the GETCO’s authorized officers about the all incidences and any abnormal

activities or accidents. 11. Any other jobs / services not included above, but the nature of which pertains to fire services.


REQUIREMENT OF FIRE STAFF SET UP At 400KV Vadavi s/s, the set up required is as below. The details of man power required for carrying out the

functions mentioned below and also duties as laid down in Annexure - II will be as under.

The norms for selection / recruitment of fire staff to employ in 400 KV Vadavi sub-station of GETCO are as given in Annexure-II.

1.0 Brief Functions of Fire Staff: - 1.1 A fire Supervisor will be overall in-charge of fire station of 400 KV S/S Vadavi. He will responsible for

discipline, control and training etc. of his staff.

1.2 His functions will include both line functions i.e. fire extinguishing & control of other emergences and staff function i.e. inspection, checking testing etc. of fire protection and fire detection systems & equipments and also fire preventive and precautionary measures etc in 400 KV S/S Vadavi.

1.3 He will also immediately respond to a fire call / emergency call of nearby GETCO sub-station with the approval to EE [TR] 400 KV S/S Vadavi.

1.4 Each shift consists of 8 hours duration:

FIREMAN:

1.5 Fire staff will be posted at 400KV sub-station of GETCO to operate and maintain fire protection and fire detection systems and equipments installed and held in the same. The details of fire protections and other fire detection systems and fire equipments are provided and given in Annexure - I.

1.6 There will be one [1] firemen in each shift and will assist fire officer / supervisor in various fire service job during shift. The detailed duties of fire supervisor and firemen are prescribed and as laid down in Annexure – II.

2.0 Additional Services: 2.1 In addition to the scope of work mentioned as above, the contractor shall provide additional fire

service on the emergency situation at the same rates, for which whenever possible, sufficient advance intimation shall be given.

3.0 Special Conditions: 3.1 The Contractor shall arrange at his own cost, the attractive uniform articles etc. available for his staff

for discharging of their duties as per job requirement.

3.2 The Contractor shall follow the procedure and system described by the GETCO from time to time and communicated to the Company in writing with regard to his scope of work.

3.3 The GETCO shall provide to the Contractor necessary facilities as may be mutually agreed upon

between the Company and Contractor. The places to be provided will be utilized by the Contractor only and exclusively for discharging and carrying out the official functions relating to Company. However, in case of any disagreement, the same will be referred to the Chief Engineer [TR] of the GETCO whose decision shall be final and binding on the Contractor.

3.4 In no case the fire personnel of the Contractor will go on strike or go for agitation or remain absent or

behave in a manner not conducive to GETCO’s interest, the Contractor shall promptly replace such

persons.

3.5 The fire personnel to be recruited / deployed either individually or collectively by the Contractor and shall meet with our standard norms / standard requirement.


3.6 The fire operational force should have, thorough knowledge of handling fire fighting equipments etc. whenever deployed on need base. For the purpose, they must possess valid certificate issued by the Govt. Recognized Institution.

3.7 Whenever any of the Contractor’s fire personnel deployed at any of the GETCO’s premises notices or hears anything against the interest of the GETCO, he shall report the same promptly to the authorized officer EE [TR] of the GETCO through Contractor’s representative, stationed at Company’s site.

3.8 All fire personnel of Contractor shall be respectful and shall possess required tact and patience. 3.9 The Contractor shall be required to keep round the clock a qualified fire officer for immediate contact

who is permanently stationed at Vadavi who will obtain services required for fire fighting by the GETCO as and when required.

3.10 The Contractor shall ensure that the fire fighting personnel observe code of conduct, discipline, common sense and duties required to be observed by them to the Electrical Installation to avoid accidents.

3.11 The Contractor shall place qualified responsible and experienced person at Company’s site to control and guide them.

3.12 The contractor shall keep instruction book on site for taking site instruction from time to time. This book shall be made available on site whenever asked for.

3.13 The Contractor should provide identification card (ID Card) to their employees.

4.0 Deployment: -

4.1 To discharge the responsibilities and liabilities to the satisfaction of the GETCO, the Contractor shall call for personnel of the different categories to be positioned at different places / points in consultation with the EE [TR] of the sub-station who in turn will take advice and guidance from Director [Fire] of the GETCO from time to time on need base.

4.2 The Contractor shall not change the strength of any category of fire personnel without prior approval.


Recruitment Norms of Fire Staff

1.0 Fire Man: - The candidates possessing the following minimum qualifications shall be eligible for fireman at place:

1.1 Educational & professional qualifications:

- Should have passed SSC or equivalent.

- Should have passed 6 months Fireman Training / Course from recognized Institute.

1.2 Physical Standard:

- No deformity.

- Height 165 cm.

- Weight 50 kg.

- Chest 81 & Chest 86 [On expansion]

- Vision – 6/6 without wearing glasses or any other aid. Night or Colorblindness shall be

disqualification.

1.3 Endurance Test: -

- Should be able to run a distance of 100 meters [one hundred meter] with 64 kg weight in one minute.

- Should be capable of climbing a rope or vertical pipe to a height of 3 [Three] meter from the ground. - Should be capable of clearing ditch of 2.7 meters i.e. long jump.

- Should be capable of climbing an extension ladder.

1.4 Age & Date of Birth.

- Must have completed 18 years but not more than 28 years of age.

1.7 Desirable qualifications:

Preference may be given to candidates those have:

i. Good knowledge of swimming

ii. Light vehicle driving license.

Annexure - I Scope of work and details of Fire Protection and Fire Detection systems and equipments held and installed in a 400 KV Vadavi Sub-Station. 1. Fire Pump House: a. Water reservoir & Fire bore well pump house

d. Discharge water header in complete Sub-Station are a with control valves.

e. Various devices & instruments in pump house to operate and control fire protection systems. 2. Water Sprays [Emulsifier] System: The Emulsifier system is provided on transformers and other oil filled equipments and it

consists of the following: a. System piping.

b. Quartzite Bulb Detectors (QBD).

c. Water Spray Projectors.

d. Deluge Valves.

e. System Control Valve.

f. Alarm Gong bell system.

3. Fire detection & alarm system:

The fire detection and alarm system shall be installed in a 400 KV sub-station and shall consists of the following.

a. Control panel. b. Heat detectors. c. Ionization detectors. d. Optical smoke detectors. e. Manual calls point. f. Wiring. g. Operation & control devices. 4. Fire Points:

The fire points shall contain fire extinguishers of different types and capacities and other rescue items.

a. Dry chemical powder fire extinguishers. b. Foam fire extinguishers portable and higher capacity. c. Co2 fire extinguishers portable and higher capacity. d. Sand buckets and sand storage drums. e. Hooters / Bells. f. First Aid box. g. Emergency light / generator.


5. Documents & records: The following fire service documents and records may be generally provided in a sub-station

and will have to be maintained by contract fire staff and submitted to EE [TR] as per schedule.

a. Fire log-book. b. Electric pump log-book. c. Diesel driven pumps log-book. d. Fire detection and alarm system log-book. e. Fire extinguishers log-book. f. Emulsifier system log-book. g. Fire hydrant system log-book. h. Fire / special calls register log-book. i. Mock drills register. j. Daily inspection / visit reports register. k. Fire system and equipment defect and rectification register. l. Fire systems & equipments check, inspection and performance test register. m. Daily occurrence book. n. Any other documents & register added later on and required for administration and

furtherance of the work.


Annexure - II

Duties of Fire Staff a. To be available and to hold himself in readiness for any duties at any time he may be called

upon by EE [TR], 400 KV Vadavi S/S to perform and to keep himself acquainted with all matters coming to his knowledge, affecting either his own stations or general business of the fire service department.

b. To obey implicitly all orders of EE [TR], 400 KV Vadavi S/S and exact the strictest

obedience and civility from those serving under him, to devote the whole of his time and attention to the Fire Service work to set an example to his men by sobriety, cleanliness, promptitude, civility and general attention to his duties.

c. To take charge of and be responsible for all appliances, fire protection system, stores

equipments etc. issued to his station and submit a report to EE [TR], 400 KV Vadavi S/S] as to the correctness or otherwise of such articles taken charge of. He should submit a requisition to EE [TR], 400 KV Vadavi S/S] of the fire equipment requirements of his station as necessary.

d. To see that all appliances, fire protection and fire detection systems and equipments are

kept clean and also in thorough working order, stowing them properly for immediate use at fires and other emergencies without loss of time.

e. To instruct and drill all men under his charge in the use and maintenance of fire appliances

systems and equipments. f. To hold a muster parade for the inspection of uniforms, clothing, boots, and equipments at

least a month to see that the men keep themselves and their clothing in a clean and good condition and to report shortages, if any, to his superiors. The inspection of uniforms and equipments should be carried out periodically.

g. To ensure that the roll is called at such times as he considers most suitable. h. To ensure prompt attendance of fire appliances and men, he should carry out surprise

turnouts at odd hours at least once a month. i. To ensure that his station time clock is checked with time clock or time signal at least twice a

day at proper intervals. j. To see that man placed on station duty is properly dressed and is acquainted with his duties. k. To see that communication system is in properly working order and to send an immediate

report to appropriate authority when it is not so. l. To keep him and men at all times in readiness, to receive any superior officer / Engineer and

to give if required an accurate account of all matters connected with the fire station under his charge.

m. To see that the fire pumps under his charge have water passed through their pumps at least

once every week. This only refers to cases where a fire pump has not otherwise during the above period.

n. To report at once to EE [TR], 400 KV Vadavi S/S or his superior for the damage or casualty

that may have occurred as a result of accident.


o. To keep himself and his staff acquainted with the water supply within the area under his charge. In cases where fire hydrants and Emulsifier systems are provided, it shall be his duty to see that he and his staff examine all the fire hydrant & Emulsifier falling within his jurisdiction periodically as may be fixed from time to time.

p. To make himself and his staff acquainted with the network of communication system which

may be existing in the sub-station. q. To make himself and his staff acquainted as far as possible with the topography of his and

adjoining areas, as well as fire risks in such areas. r. To make himself and his staff acquainted with the operation & maintenance of fire protection

and fire detection systems and various fire equipments provided and installed in the sub-station area.

s. To maintain all registers, log-book, occurrence books, attendance rolls, etc up-to-date and to

his superiors every month. All fire and special services reports shall be submitted by him within 48 hours of the occurrence.

t. Inspect, check, test, maintain, refill fire extinguisher and sand buckets. Duties of fireman: a. To be available at the station to which he is posted, while on duty. b. To obey implicitly all orders of his superiors and hold himself in readiness to carry out all

duties as may be assigned to him by his superiors obediently, smartly and efficiently. c. To keep himself and his quarters, if provided, neat and clean. d. To devote whole of his time and attention to the fire service department work while on duty. e. To set example to others by sobriety, cleanliness, promptitude, civility and general attention

to his duty. f. To be responsible for keeping the station premises such as appliance, room, offices, drill

yard, watch room, workshop, dormitory, drill tower, hose drying tower, etc neat and clean by washing when necessary and appliances, equipments, gears, etc. clean and tidy.

g. To keep himself alert to attend to fires, special services, fire drills, etc in the shortest possible

time on the alarm being sounded. h. To keep himself acquainted as far as possible with the topography of his own and adjoining

areas, as well as fire risks in such areas.

i. To carry out duties that may be assigned to him from time to time, and be responsible of the fire unit and all equipments therewith, correct upkeep, stowage and maintenance thereof.

j. To thoroughly inspect the fire appliance or fire protection systems and equipments to which

he is posted and to report to his officer of having verified the same. The firemen are responsible of the unit for the appearance, scrupulous cleanliness of the unit and various equipment therewith, correct upkeep maintenance and stowage of equipments allotted. This shall include cleaning in the stores, scrubbing and washing of the hoses, floors, walls, doors and windows of the premises, garages and drill lowers, smoke chamber, maintenance of garden, etc.

Firemen and other ranks accommodated in barracks or dormitory shall be solely responsible

for the proper cleanliness, orderly arrangement of their personal belongings, etc. They will also be held responsible for the safety of the various fixtures, sanitary and electrical fittings in such premises.


k. 1.Fireman, when posted as guard or sentry by turns, or by other method as deemed fit by the Officer In-charge of the Station, shall not leave his post until he is properly relieved. He shall be in full uniform prescribed for him for the season. While on guard duty, the fireman shall be responsible:

2. To guard all properties, fixtures, fittings and other things, both in the fire station premises and station surroundings.

3. To see that all persons entering upon the fire station premises are directed to the Officer in-charge and to see that they leave the premises immediately their business is finished.

4. To be aware and remain alert at all times. 5. To control the movements of incoming and outgoing vehicle to avoid accidents. 6. To watch the garden and plants in station ground. l. In addition to the above, a fireman shall perform any legal duty, in the interest of the Fire

Services, when ordered by appropriate authority. m. While taking over charge, which should be at least 10 minutes before the schedule for

change over, he shall be responsible to acquaint himself with all matters current and pending of operational and administrative importance. He shall also be responsible to check the station clock, telephone connection and fire alarm system.

n. It shall be his duty to maintain the station occurrence book-up-to-date at all times in the

prescribed form as may be laid down. o. He shall be his prompt in receipt and transmission of calls of fires and other emergencies

etc. and immediate reporting to his officer and sound the alarm system. He shall keep and maintain record of all movements during fire & emergency situations in the occurrence book.

p. He shall be responsible for the maintenance of record of movements of staff, appliances equipments, fire protection & detection systems, details, data on mobilizing GETCO etc.

q. He shall execute such other duties as may be entrusted him from time to time by his superiors.


Annexure - III 1.0 Qualifying Conditions. 1.1 A certificate to the effect that, the Tenderer firm have a qualified fire officer & have enough experience

on the roll of the company to guide and advice the fire service personnel posted in GETCO sub-stations must be produced.

1.2 The firm will employ qualified fire Supervisors & fireman trained from Government recognized

institution / school / college. The proof of having required numbers of qualified firemen and fire supervisors available must be attached.

1.3 The institution / organizations / firms have to submit a copy of registration certificate registered with

government for carrying out similar type of work or similar type of experience certificate. 1.4 The institutions / organizations / firm have to submit a copy of a safety policy of the Company along

with the Tenders. 1.5 The institutions / organizations / firms should enclose with tender copies of creditability / performance

certificates from Govt. / semi Govt. / autonomous bodies for carrying out similar type of works. 1.6 The institutions / organizations / firm should enclosed company brochure / leaf / company profile white

submitting the tender. 1.7 The institutions / organizations / firms awarded contract will have to insure all fire staff deployed for

fire service work in GETCO with any recognized insurance company. 1.8 The institutions / organizations / firms awarded contract will have to take Mediclaim for all the fire staff

deployed for fire service work in GETCO with a recognized insurance company. 2.0 Provision for Penalty: 2.1 If any of fire staff is not found available for the job assigned, or found guilty or negligent in

performance of his duties the penalty of Rs. 500/- for each such default will be recovered from the contractor.

3.0 Quotation of Rates 3.1 Your offer rates shall be inclusive of all legal & statutory liabilities and other terms and conditions

mentioned in this tender document. 3.2 The rates to be quoted for the category of Fireman and Fire Supervisor should be in accordance with

and subject to minimum wages Act and it shall be the sole responsibility of the contractor to strictly adhere to and comply with all the mandatory labor law provisions applicable to the employment / department of fire personnel by him. The rates shall remain fixed and firm and shall not be subject to any escalation whatsoever during the period of one year.

4.0 General 4.1 Contractor who awarded the contract has to hand over entire fire plants and its equipment in working

condition after completion of contract and their final bill will be passed after fulfill this condition.


TERMS & CONDITIONS REGARDING INDUSTRIAL LAWS AND OTHER RELATED MATTERS (1) Wages to be paid at time of payment etc. by the contractor.

(A) The contractor shall pay minimum prevailing rates per day or as may be specified hereafter or rates fixed under the minimum wages Act. Whichever is higher. The wages or very contract labor employed by him under this contact shall be paid by him before the expiry of 7th day of the month in respective of which the wages are payable (i.e. wages of a month have to be paid by him in the first week of the next month). The payment shall be disbursed in the presence of management representative during the working hours in factory premises and the contractor shall get the entries certified in the register of wages by the representative of the GETCO. Any default will result in cancellation of contract forthwith or also the contractor shall be paid punishable to the extent of Rs.100/- fine per each day.

(B) The contractor shall give his telephone number and address to the GETCO so that in case of labor troubles etc. the contractor can be contacted. The contractor shall arrange to have his office outside the factory premises and the contractor shall keep himself present through out the working hours.

(2) Labor Laws:- (A) Person below the age of 18 years shall not be employed for the work. (B) No. female worker shall be employed in the night shift between 7 p.m. to 6 a.m. (C) Contractor shall maintain a valid labor license under the contract labor (Regulation and

Abolition) Act for employing necessary manpower to be required by him. In the absence of such license the contract shall be liable to be terminated without assigning any reason thereof.

(D) The contractor shall at his own expenses comply with all labor laws and keep the GETCO indemnified in respective thereof. Some of the major liabilities under various labor and industrial laws which the contractor shall comply with are as under :-

(i) Payment of contribution by way of employer’s contribution towards provident fund, family pension scheme, Deposit linked insurance scheme, Administrative charge etc. at the rates make applicable from time to time by Government of Gujarat/Government of India or other statutory authority.

(ii) Payment of deposit in respect of each contract labor at the rate as per admissible with the office of commissioner of Labor as per the contract Labor (Regulation and abolition Act.).

(iii) License fee as prescribed under the contract labor (Regulation and abolition Act) and rules framed there under depending upon the number of workmen employed by the contractor.

(iv) Paid leave facility and wages as per the provision of the factories Act at the rate of one day for every 20 days of working.

(v) Identify cards as prescribed under the factories Act with photo at fixe there to the same identification. Liabilities as per industrial Disputes Act any payment to the contractor’s employees arising out of any claim or disputes under the industrial Disputes Act, 1947 or any other labor laws.

(vi) Payment of compensation in case accidental injury. (vii) Maternity leave as per the provisions of the maternity Benefit Act. The above are some

of the major liabilities of the contractor in addition to other liabilities. Prescribed under the various labor laws in force from time to time from statutory authorities like State Government/ Government of India which the contractor shall have to comply with.

(3) Provident fund & Family pension Scheme:-

The contractor shall submit along with his bill (month wise) a statement regarding deduction against employees provident fund and family pension scheme in respective of each concerned employee, provident fund and family pension scheme at the rate at admissible ( or at the rate made applicable by the Government from time to time ) of the wages. The contractor’s contribution and his workers contribution towards provident fund and family pension scheme shall be deposited by the contractor with regional Provident Fund Commissioner, Ahmedabad.


(4) Deposit Linked Insurance Scheme:-

The contractor shall have to deposit ½ % of the wage in respect of employees who is a member of the Provident Fund as the contribution to the deposit linked insurance Scheme with Regional Provident Fund Commissioner.

(5) Administrative Charges:-

Administrative charges for maintaining provident fund A/C shall be deposited by the contractor with Regional Provident Fund Commissioner, Ahmedabad at the rates applicable.

(6) Paid Leave Facility:-

Paid leave facility at the rate of one day for every twenty days worked by the contract labor shall be provided by the contractor to his workers. He shall maintain leave Records/leave cards for individual laborer which shall be duly verified and approved/certified by the authorized officer of the GETCO.

(7) Workmen’s compensation fund & Employer’s Liability Insurance:-

The contractor shall cover all his employees under workmen’s compensation fund and under the liability insurance.

(8) The contractor shall employ adequate number of experienced staff at site for dial supervision and for maintenance of various register and records required under the law and contract No. payment for supervision shall be admissible.

(9) Contractor to indemnify the GETCO:-

The contractor shall indemnify the GETCO and every member officer and employees of the GETCO also, engineering in charge and his staff against all actions, proceeding, claims demands, costs and expenses which may be made against the GETCO or Government for or in respective of performance of his obligation under the contract documents. The GETCO shall not liable for or in respective of or in consequence of any accident or injury to any workman or other person in the employment of the contractor or his sub-contractor and the contractor shall indemnify and keep indemnified the GETCO against all such damage and compensation and against all claims, demands, proceedings costs, charges and expenses whatever in respective thereof in relation thereto.

(10) Workmen’s compensation and employer’s liability insurance:-

Insurance shall be affected for the entire contractor’s employee engaged in the performance of this contract. If any of the work is subject the contractor shall require the sub-contractor to provide workmen’s compensation and employer’s liability insurance for the latter’s employees unless such employees are covered under the contractor’s insurance.

(11) The GETCO reserves the right to terminate this rate contract at any time during its tendency without giving notice of termination or any reasons thereof.

(12) The GETCO will be entitled to deduct directly from the bills, to be paid to the contractor any sum or payable by you and which sum/sums the GETCO is required to pay as principal employer on account of your default in respect of all liabilities referred to in above clauses.


COMMERCIAL TERMS & CONDITIONS : 1. The work should be carried out according to the specification and as per instructions and programmed

laid out by the Executive Engineer-in-charge of the work. 2. The quantities mentioned in the accompanying schedule are only approximate. Actual quantities will be

decided after detailed survey and the same may decrease or increase according to the local conditions, the department reserved the rights for revision or committing any of the quantities. The quantities actually executed by the contractor will be calculated at the rate given in the contract schedule.

3. The tenders shall remain open for acceptance at least for a period of 180 days from the date of opening of tenders.

4. The contractor should employee a Supervisor with sufficient qualification and experience who could supervise the execution of work through out. He should always be present on the site.

5. Tenderer must provide mobile phone at fire room so as to contact fire supervisor / fireman by authority at any time.

6. The bidder shall indicate %age above/below of total bid price indicated in appropriate price schedule. 7. Tenderer must quote rates only on firm price basis. 8. The work should be commenced immediately from the date of receipt of instructions from office and

should be completed within stipulated time period thereafter. 9. As regard damage the materials, equipment etc. Agency will be responsible. If there is any

compensation to be paid in respect of “WORKMAN” compensation act of any other statutory provisions, the same will have to be paid by the contractor direct. If he thinks fit he may take necessary insurance cover, at his cost.

10. Security deposit: The successful Tenderer will have to pay the Security Deposit of 5% of work order value. Initially 2.5% of Security Deposit will have to be paid by demand Draft drawn in favor of “GUJARAT ENERGY TRANSMISSION CORPORATION LTD.” on any Nationalized / Scheduled banks situated at “MEHSANA” within 10 days from the date of issue of letter of indent. Balance 2.5% of Security Deposit shall be recovered from first two R.A. bills in equal installments. The security deposit will be refunded only after completion of guarantee period.

11. The tender includes all minor accessories and items of work which may not have been specifically mentioned in the specification schedule etc. but are essential for completion of work. The contractor will not be eligible for any extra payment in respect of such minor accessories and items required for the works.

12. The time allowed for completion the contract is twelve months from the date of the commencement of the work, failing which the penalty ½% per week or part thereof on delayed portion of work value subject to ceiling of 10% of the total contract value will be imposed.

13. The contract shall be awarded initially for a period of one year. The GETCO reserves its right to extend the said contract for a further period of one year, if work performance is found satisfactory at 400KV Vadavi s/s subject to mutually agreed terms and conditions.

14. Contractor will have to take insurance of all persons engaged for this work till completion of work. GETCO will not be liable for any compensation due to accident either electrical or mechanical to contractor and persons engaged by contractor for this work. Contractor has to produce the proof of such insurance to the EE [TR] Vadavi.

15. Guarantee: It is the responsibility of the contractor to carry out the complete work without any defects and to the satisfaction of EIC. If it is noticed that any defects occurs due to bad workmanship, contractor will have to rectify the same at his own cost.

16. Income Tax as per prevailing rules will be deducted from the bills. 17. Service tax shall be reimbursed on production of proof of such payment made by the contractor to

appropriate authority.


TENDER AND CONTRACT FOR WORKS

I/We hereby tender for the GETCO of the work specified in the under written memorandum within the time specified Schedule B (Memorandum showing items of work to be carried out) and in accordance, in all respect, with the specifications and instructions in writing and as per annexed conditions of contract and agree that when the materials for works are provided by the GETCO such materials and rates to be paid for them shall be as provided in Schedules.

MEMORANDUM

(a) General Description of Work : “Annual Job contract for rendering Fire Fighting Services for Operation

& Maintenance of E-Mulsifier system & fire equipments at 400 KV Vadavi s/s under Chhatral TR. Division’’.

(b) Estimated Cost : Rs. 407732.00/- (c) Earnest Money : Rs.4080.00/-

(d) Security deposit: The successful Tenderer will have to pay the Security Deposit of 5% of work order value. Initially 2.5% Security Deposit will have to be paid by demand Draft drawn in favor of “GUJARAT ENERGY TRANSMISSION CORPORATION LTD.” on any Nationalized / Scheduled banks situated at “MEHSANA” within 10 days from the date of issue of letter of indent. Balance 2.5% of Security Deposit shall be recovered from first two R.A. bills in equal installments. The security deposit will be refunded only after completion of guarantee period.

(e) Time allowed for the completion of work from date of written order to commence.

Should this tender be accepted, I/We hereby agree to abide by and fulfill all the terms and provisions of the conditions of contract annexed hereto, as applicable, and in default thereof, forfeit and pay to the GETCO the sums of money mentioned in the tender.

And whereas according to the condition of the Contract the CONTRACTOR is under obligation to execute

this Safety cum Indemnity Bond before the commencement of actual execution of work

Now the indenture witnesses that I/We the CONTRACTOR do hereby undertake to follow the guidelines

as per Annexure A prepared by the GETCO.

Further we the CONTRACTOR agree that the GETCO shall be sole judge of and as to whether there has

been any breach of the guidelines as per Annexure A of this bond and as to the extent of the loss, damages,

costs, charges and expenses caused to or suffered by the GETCO.

We the CONTRACTOR further agree that our liability under this bond shall not be discharged because of

the change in the constitution of the GETCO or for the extension of the time limit or for any other reason.

We the CONTRACTOR further agrees to the given terms and conditions: a. That the CONTRACTOR undertakes /undertake to indemnify and keep harmless the GETCO from all claims, actions, proceedings and risk, damage danger to any person whether belonging or not belonging to the. CONTRACTOR. b. That the CONTRACTOR shall keep harmless the GETCO from all claims, compensation, damages any proceedings in respect of any of its employee / workmen under the Workmen Compensation Act or any other laws for the time being in force.

c. That, if during the course of execution of work as stated in the contract order mentioned hereinabove


issued by the OBLIGEE, it is found that the CONTRACTOR has not complied with guidelines as per Annexure A or terms and conditions / formalities within the meaning of Employees’ State Insurance Act,1948 (ESI) or Workmen Compensation Act 1923 or any other laws relating to the Labor Welfare for the time being in force, and also has not observed the safety norms in accordance with the law prevailing at the place of work/job to the satisfaction of the GETCO, the GETCO shall have the right to stop the execution of work/job and the period of such stoppage shall not be taken into account for the calculation of the total period of completion of work for which the CONTRACTOR is responsible to complete the work/job and it will be deemed that discontinuance was due to default of the CONTRACTOR . d. That, if any time, due to exigency, GETCO as the Principle Employer, becomes liable to pay any such compensation mentioned hereinabove, whether on failure of the CONTRACTOR or for any other reason, the GETCO shall have the right to recover the said amount from any amount receivable by GETCO or any bank guarantee deposited or anything payable whether in connection with this contract or other contract by the CONTRACTOR to the OBLIGEE. e. That the CONTRACTOR is/are aware and accept that for the persistent or repeated violation of any guidelines as per Annexure A and terms and conditions mentioned in this Safety cum Indemnity Bond, GETCO shall have right to terminate the contract of work issued to the CONTRACTOR . f. In case if any safety related fatal Electrical / Mechanical accident occurred to any employee of agency or outsider due to negligence or noncompliance of GETCO safety norms then in addition to the compensation and liability as per statutory requirement, contractor / agency is hereby agreed to pay the penalty amount as given below:

I/We the CONTRACTOR hereby confirm that in case of any dispute/difference for settlement of claims under this Safety Cum Indemnity bond the courts in Gujarat State wherever job/work is performed or as per GETCO norms shall have the jurisdiction to decide the rights & liabilities of the parties while adjudicating the matter of claims under this Safety Cum Indemnity Bond.

h. This Safety cum Indemnity Bond shall continue and hold good until it is released by the GETCO in Writing on the Contractor’s application after the Contractor has discharged all his obligations under the order mentioned hereinabove and submitted a “NO DEMAND CERTIFICATE

From the GETCO under the said order. The Safety cum Indemnity Bond shall be valid for a CONTRACT

PERIOD and renewable thereof (Claim Period). i. This Safety cum Indemnity Bond and the guidelines as per Annexure A herein contained are in

benefit of society a the nation, safety guidelines are agreed upon by the agency as under.

Safety is our prime concern and zero accident is our goal. In order to prevent the accident, while execution of

works in indoor and outdoor systems of GETCO, the following guideline and preventive measures are identified.

Prior to execution of work a joint survey must be conducted by GETCO supervisor and contractor’s supervisor for risk assessment •Clearly identify the work location, to distinguish between the equipment that is dead and other Equipment / part that may be live. •Disconnect equipment from supply. •Protect against other live parts. •Take special precautions when close to bare Conductors / Bus bar.

Prior to execution of work a joint survey must be conducted by GETCO supervisor, contractor’s supervisor and DISCOM line man in order to identify the following : a. HT/LT line or tap line crossing under each span of Line of the work. b. Isolation point of each line crossing. c. Each line crossing & isolation point under each span must be discussed and noted in maintenanceRegister with sketch.

Following safety guidelines are mandatory for all contractors operating in GETCO premises for Electrical, non electrical & civil works. 1. The contractors must provide advance planning of work to concerned in charge of substation in Writing. 2. Before starting any work whether switch yard, “permit to allow to work” must be taken from control room in charge. 3. Utilizing Electrical / no electrical equipments, Safety rules must be implemented. 4. If the work is to be carried out on Sunday or Public holiday, the necessary permission must be Taken in advance, requesting in writing. 5. Unwanted person including children of labors will not be allowed at working site/ in the switchyard And in the prohibited area. 6. Any electrical work or electrical connections to equipment for any other work must be carried out by certified electrician/wiremen with adequate size of wire Through MCB as per I.E. Rule. -Live penal area / bus bar must be isolated and sealed / bifurcated with red colour tape for visible Warning. Display Board must hang on LCP panel. -Transformer must be switched off whenever and wherever contractor and line workers are not satisfied with isolation, earthing or any equipment performance of GETCO, it will be pointed out and Work shall begin only after resolution. Contractor shall not take up job in absence of GETCO Authorized person. All wire temporary connection & material whenever erection activity has any connection and disconnection work of bus bar, String bus.

Contractor’s supervisor and GETCO Supervisor must ensure all isolations physically with adequateearthing technically prior to give clearance to gang leader for taking up job. While execution of stringing work, the identified line crossing must be isolated / reenergized and written clearance should be obtained from concerned DISCOM supervisor. The isolation of Tap line must be physically seen and verified by Contractor and GETCO supervisor.At D.O. fuse junction contractors person should be posted to ensure that no person restore D.O. supply while work is under execution Contractor’s supervisor must ensure that concern officer take LCP for EHV line and power line crossing.


All workers / labor of contractor & supervisors must use personal protective equipment (PPE) during the work like gloves, safety belt, Safety shoes, Helmet, earthing rods, etc, duly approved by GETCO.

Local earthing of electrical equipments like Filter M/c, welding machine, testing kits etc. Is must. Crane shall only be used for material Handling and erection. Working platform Shall only be used for work in switchyard.
