The REGULAR MEETING of the New Ulm Economic Development Authority was called to

order at 8: 00 a.m. October 11, 2016 in the City Council Chambers at City Hall.

Roll was called and the following members were present: Commissioners Fix, Guggisberg, Shipp, Wohlers and President Schmitz.

Also present were Mayor Beussman, Executive Director Gramentz, Housing CoordinatorBregel and Treasurer Jorgensen.

Commissioner Guggisberg made a motion to approve the minutes of the September 13, 2016Regular Meeting. Commissioner Fix seconded the motion and all voted aye.

The Economic Development Coordinator reported on various economic development

activities in the community.

The Housing Coordinator reviewed for the Commissioners highlights of the administrativeactivities during the month of September 2016, as follows:

Housing Choice Voucher Program — She reported that the Housing Assistance Paymentsdisbursements exceeded payments to landlords by $470 for the month. HUD AdministrativeFee expenses exceeded disbursements by $ 1, 487 for the month. Total vouchers are at 103 as

of September 1, 2016. The current waiting list is at 75. Public Housing Program — Net assets in the program are $ 640,341. 16 as of September 30,

2016. Broadway Haus is fully leased with 52 on the waiting list. The Family Units have

one vacancy with 55 on the waiting list. EDA — Investment pool assets of $484, 112 as of September 30, 2016. The increase in

revenue is due to the proceeds from the sale of the spec house at 612 Pfaender Drive. Staff

distributed information to landlords about a Rental Rehabilitation Deferred Loan Program

that is available and a few landlords have shown interest in these funds. Construction on thespec house at 633 Pfaender Drive is completed and an open house is scheduled for next

week. The street improvements are nearly completed in the Milford Heights Subdivision. Property Rehabilitation Loan Program — Available funds of $290, 160 as of September 30,

2016. A new application was received and is pending approval. Rental Properties — Cash investment assets of $71, 106 as of September 30, 2016.

Garden Terrace Apartments — Garden Terrace has two vacancies. There were two turnovers

during the past month and there are two move -out notices pending for November. The

waiting list is at 60.

Commissioner Fix made a motion to accept the Administrative Activities Report.

Commissioner Wohlers seconded the motion and all voted aye.

The Authority received notice that the Department of Housing and Urban DevelopmentHUD) had issued new Fair Market Rents ( FMR' s) effective October 1, 2016. The Housing

Coordinator noted that on an annual basis, HUD issues new FMR' s to account for changes in rental

rates within Brown County. She noted that the new FMR' s were as follows: 1 Bedroom - $522; 2

Bedroom - $681; 3 Bedroom - $852; and 4 Bedroom - $939.

The Housing Coordinator explained that HUD allowed the Authority to select a PaymentStandard for the Section 8 Housing Choice Voucher Program between 90% and 110% of the

established Fair Market Rent for Brown County. Staff recommended the following PaymentStandard: 1 Bedroom - $ 522; 2 Bedroom - $681; 3 Bedroom - $852; and 4 Bedroom - $939.

Commissioner Fix offered the following resolution and moved its adoption:

RESOLUTION 16- 14

BE IT RESOLVED, that the Economic Development Authority of the City of New Ulm, Minnesota does hereby establish the following Payment Standards for the Section 8 Housing ChoiceVoucher Program in Brown County:

The motion to adopt said resolution was seconded by Commissioner Wohlers and upon roll call, thefollowing voted:

The Authority considered for approval a resolution approving Flat Rent changes for thePublic Housing program effective November 1, 2016. The flat rents represent the maximum

amount a family would pay when renting a Public Housing unit. The Flat Rent option allows a

family to continue occupying a unit even though their income increases significantly. The Flat Rentis being changed at this time to reflect the new Fair Market Rents ( FMRs) issued by the Departmentof Housing and Urban Development (HUD) and applied to all program units.

Staff is recommending that the new Flat Rents reflect the October 1, 2016 FMRs. She

recommended that the EDA approve the following rents: 1 Bedroom - $ 522; 2 Bedroom - $ 681; 3

Bedroom - $ 852; and 4 Bedroom - $939.

Staff is recommending that a house construction budget of $144,700 be approved. The

budget includes the $ 122,479 construction trades; $ 10,000 allowances; $ 8, 000 miscellaneous

expenses; and a 3% contingency.

The EDA will general contract this project through the City' s Building Official' s Office. Staff anticipates that the sale price for the house will be about $ 160,000. Commissioner Fix offered

a motion accepting quotes, approve a house construction budget of $ 144,700, and authorize

construction of a speculative house on Lot 2, Block 3, Milford Heights First Addition.

Commissioner Guggisberg seconded the motion and all voted aye.

budget includes the $ 123,982 construction trades; $ 10,000 allowances; $ 8, 000 miscellaneous

The EDA will general contract this project through the City' s Building Official' s Office. Staff anticipates that the sale price for the house will be about $ 162, 000. After further discussion,

Commissioner Wohlers offered a motion to table this item and bring it back for consideration after apurchase agreement is in place for the spec house at 633 Pfaender Drive. Commissioner

Guggisberg seconded the motion and all voted aye.

A discussion took place on the EDA properties located at 318, 320 and 326 North

Broadway. Staff was instructed to notify local realtors that the EDA might be willing to sell theseproperties. No further action was taken at this time.

The Authority received a copy of the New Ulm Economic Development Authority audit forthe one year period ending June 30, 2016. The Treasurer presented a summary of the audit to theEDA. Commissioner Wohlers made a motion to accept the 2016 audited annual financial report.

Commissioner Guggisberg seconded the motion and all voted aye.

The Treasurer presented for approval the proposed 2017 budget for the Economic

Development Authority. She reported that the budget for the EDA Fund covers HousingAdministration, Affordable Housing Subdivision and other EDA activities for the 2017 budget year. The proposed tax levy is the same as 2016. The levy is the maximum amount allowed, which isnecessary to pay for interest on the assessments related to the Milford Heights Subdivision.

Commissioner Guggisberg offered the following resolution and moved its adoption:

BE IT RESOLVED, by the Commissioners of the Economic Development Authority of theCity of New Ulm, Minnesota that the New Ulm Economic Development Authority budget for 2017is hereby adopted.

The Housing Coordinator reviewed the proposed Garden Terrace annual budget. The

budget includes a modest rent increase. The proposed rents are comparable with other market rate

rentals in town.

The Housing Coordinator reviewed other Garden Terrace revenues and expenditures relatedto the proposed 2017 annual budget. Commissioner Wohlers made a motion to approve the Garden

Terrace budget. Commissioner Guggisberg seconded and all voted aye.

RESOLUTION 16- 17

Commissioner Fix offered the following resolution and moved its adoption:

WHEREAS, Reginald Vorwerk has served as Treasurer of the Economic Development

Authority of the City of New Ulm from October 14, 2003 until August 9, 2016; and

WHEREAS, Mr. Vorwerk also served as Finance Director for the City ofNew Ulm; and

Now, THEREFORE, BE IT RESOLVED, that the Economic Development Authority of theCity of New Ulm, Minnesota does hereby commend Reginald Vorwerk for his outstanding serviceand commitment to the City ofNew Ulm and its citizens.

The motion for the adoption of the foregoing resolution was duly seconded byCommissioner Guggisberg and, upon roll call, the following voted:

Voting Yes: Commissioners Fix, Guggisberg, Shipp, Wohlers and President Schmitz.

Overview:

Sealed quotes were accepted on October 5, 2016 for the construction of a speculative house on Lot 4, Block 3, Milford

Heights First Addition. The City Building Official' s Office will act as general contractor. The quotes were solicited forthe following project trades: carpentry; building materials; excavation/masonry; plumbing; HVAC; and electrical.

Staff recommends the following quotes be accepted:

Staff is recommending that the above noted quotations be accepted and that a house construction budget of $146,300 beapproved. The budget includes the $ 123, 982 construction trades; $ 10, 000 allowances; $ 8, 000 miscellaneous expenses;

and a 3% contingency. The allowances and miscellaneous details are on the attached Construction Budget Worksheet for637 Pfaender Drive, Milford Heights First Addition.

Primary Issues/Alternatives to Consider: The Preliminary Sale Price for the spec house at this time is estimated at approximately $ 162,000. The constructiontrades quotes, overall, came in comparable to the last spec house built this summer. Staff is comfortable with the quotes

received, as well as with the allowances and miscellaneous expense estimates.

Budgetary/Fiscal Issues: Construction was just completed on a spec house at 633 Pfaender Drive and there is currently no purchase agreement inplace for this property. The EDA has typically waited for proceeds from a house sale prior to authorizing construction fora new house. However, the EDA now has additional funds available from Garden Terrace that could be utilized to fund

construction. The EDA' s current fund balance is $483, 830 and the Garden Terrace' s current fund balance is $ 730,270. The EDA has adequate funds available to support the construction costs of two houses.

If the EDA authorizes construction, a final sale price would be approved when the project nears completion. The most

significant variable will be an early sale or a long holding period.

The other option would be to reject the bids and solicit new bids after a purchase agreement is in place for the spec houseat 633 Mender Drive. This option could result in a 3- 5% increase in the construction budget to build the same house next

year.

Overview:

The most recent study was completed during 2012 and prior to that a study was done in 2004. These studies typically aredone every five to seven years, and are used by several sectors in the community as sources for growth trends anddemographic characteristics, as well as demand for real estate product types. The numerous analyses provided by thestudy helps the community anticipate housing needs, directs the public sector' s housing policies and provides valuableinsights to the key issues and conditions present in the local housing market. Based on the length of time since the laststudy was completed, 2012, it is time to proceed with a new study.

Primary Issues/Alternatives to Consider: The scope of the study will include:

Analysis of the community' s demographic makeup including income and employment trends; Analysis of for -sale housing market; Analysis of the rental and senior housing market; Estimate of demands for all types ofhousing over the next five years; Identification of planned/proposed housing developments; andRecommendations of appropriate housing concepts to meet current and future needs.

The study will include primary and secondary research. Primary research pertains to interviews with City staff, community leaders, rental property owners/ managers, major employers and other entities involved in the New UlmHousing market. Secondary research includes sources such as U.S. Census data.

Budgetary/Fiscal Issues: The cost of the study is estimated at $20,000. The 2017 EDA budget has a $ 20,000 appropriation for Consultant Servicesfor this study to be done. Bids will be brought to the EDA for approval in January 2017.

NEW ULM ECONOMIC DEVELOPMENT AUTHORITY (EDA) REQUEST FOR PROPOSALS FOR COMPREHENSIVE COMMUNITY HOUSING STUDY

I. Study Scope and Work Program

Relevant Background Information -

The City of New Ulm is located 90 miles southwest of the Minneapolis -St. Paul metropolitanarea. The City was settled in 1854 at the confluence of the Minnesota and Cottonwood Rivers. New Ulm is the largest city, major service center, and is the county seat for Brown County. TheCity and County had 2010 Census populations of 13, 522 and 25, 893 respectively. The marketarea for housing in New Ulm includes three nearby communities and 12 townships that surroundor are in close proximity to the City. They include Courtland, Hanska and Lafayette and thefollowing townships: Bernadotte, Brighton, Butternut Valley, Cambria, Cottonwood, Lafayette, Lake Hanska, Linden, Milford, Sigel and West Newton.

Purpose of Study -

The intent of the study is to identify current unmet needs within the existing housing market andto prepare a forecasting plan and methodology which will allow the New Ulm EDA to have anaccurate understanding of housing needs as they occur in the New Ulm area in the future. Themost recent housing study performed for the EDA was a February 2012 " Housing MarketAnalysis and Demand Estimates for New Ulm, Minnesota". Prior to that a study was conductedin 2004, " Housing Market Analysis and Demand Estimates for New Ulm, Minnesota". The 2004

study, was conducted by Maxfield Research, Inc. and the 2012 study was conducted byCommunity Partners Research, Inc.

The study should identify data on current housing uses and trends in New Ulm, includingprojections of future demographic and housing growth. Findings will be presented to theNew Ulm EDA, the New Ulm City Council and the citizens of New Ulm. Results of the studywill help to determine a long-term strategy for meeting New Ulm' s housing needs, including theconditions, challenges and opportunities in the City' s housing market.

Submitted proposals must address all parts of the RFP as described below:

A. Identify market and demographic trends on a national, statewide and regional basis whichimpact housing within the New Ulm area.

4. Identify strategies regarding existing and future housing needs for the EDA toimplement in the next five and ten year time periods.

II. Information to be Included in Proposal

The Consultant will conduct the proposed study in a professional manner and will accept fullresponsibility for all work products. All materials produced by the Consultant during the courseof the study become the property of the New Ulm EDA in perpetuity and may not be used forany other set of studies without approval of the New Ulm EDA. The EDA encourages data useand documentation from a wide number of sources including local, regional, state and nationalsources. The EDA also encourages usage and linkage of data, as much as possible, to the

physical environment of the City through the use of Geographic Information Systems ( GIS) data. The Consultant' s proposal should identify expectations regarding staff time, data or othermaterial requirements Consultant anticipates from the EDA.

Project Cost -

Provide a detailed project budget including estimated out-of-pocket expenses ( transportation, lodging, meals, etc.) and specify a not -to -exceed fee for the study. Identify the firm' s staffmembers who will conduct or be involved in the study including individual job title andresponsibilities, projected number of hours and hourly rate for services.

Statement of Qualifications -

O Provide a brief description of the firm' s capabilities, history and background informationon the company.

O Name, telephone, FAX number and e- mail address of person designated as the contact

person for the proposal.

O Resumes of individuals who would carry out the proposed study, and their respectiveroles in the study.

O Describe the methodology or approach to be used in addressing the study scope.

O Develop a work program and schedule for the scope of work which also identifies theteam members ( and firms) assigned to each part of the work program, and an estimate ofthe amount of consultant time allocated to each task.

O Provide information on similar studies completed in the past by your firm, includingcontacts for references.

Time Schedule -

Indicate a proposed time schedule for completing the study. This schedule should includeapproximate dates for performing field work, office review, report preparation and delivery dateof the final report. The intent of the EDA is to set the duration of the contract for a not -to -exceedsix (6) months time period for delivery of the final study document.

III. Specific Requirements

1. The New Ulm EDA reserves the right to reject any and all proposals received, and towaive all technicalities.

2. Only proposals received at the location described and in the time frame given will beconsidered.

3. The fees quoted in your proposal will be the maximum paid per hour and in total, unlessan amendment to the contract is approved by both parties.

4. All proposals received in response to this invitation shall become the property of theNew Ulm EDA and shall be retained on file, and by reference will become part of anysubsequent formal agreement.

5. Receipt of a proposal does not in and of itself constitute a contract with the New Ulm

EDA. No responsibility nor liability for any cost incurred in the preparation and/ orsubmission of such proposal will be accepted by the New Ulm EDA.

6. Proposals are to be submitted to the Executive Director, New Ulm Economic

Development Authority, 100 North Broadway, New Ulm, MN 56073 no later than5: 00 P.M., December 23, 2016. Once submitted, all proposals will be made available forpublic inspection.

7. Failure to respond to any portion of this proposal, unless otherwise noted or provided for, may result in rejection of the complete proposal from further consideration.

8. Any attempt to unfairly misrepresent the pricing structures of the cost proposal mayresult in rejection of the complete proposal from further consideration.

9. In the event of the consultant' s non-compliance with the Request For Proposals or

consulting services contract, the EDA shall impose such contract sanctions as it maydeem appropriate, including but not limited to withholding of payments under thecontract until the consultant complies, and/ or cancellation, termination or suspension of

the contract in whole or part.

10. The Consultant will provide 15 copies of the final study document, as well as inelectronic formats in order to create an ongoing source for research and analysis onhousing trends for low -to -moderate income residents.

IV. Evaluation Criteria

Proposals will be evaluated by the EDA based on the following areas:

Factors -

a. Recent consulting experiences in similar types of studies.

b. Qualifications of consultant' s staff members proposed for the study, and theirexperience in governmental consulting work, particularly with municipalities andcounties.

C. Demonstrated understanding of the scope of work, methodology and work plan tocomplete the study and reasonable time frame for conducting the study.

2. Cost

Overall cost, including out-of-pocket reimbursable expenses, for conducting the study.

3. Oral Presentation

Following a review of the written responses to this RFP, the New Ulm EDA may invitefirms to formally present their proposals at a mutually agreed upon time in New Ulm. The quality and thoroughness of the consultants' oral presentation will be considered inthe selection process.
