*2197 PLANNING—STATE SIGNIFICANT DEVELOPMENT APPLICATION FOR THE SYDNEY FOOTBALL STADIUM—Ms Voltz asked the Minister for Resources, Minister for Energy and Utilities, Minister for Arts, Vice-President of the Executive Council representing the Minister for Planning, Minister for Housing, and Special Minister for State—

(1) Will the Independent Planning Commission be holding any public hearings in relation to the State Significant Development application for the Sydney Football Stadium prior to making its decision?(a) If not, why not?

Answer— I am advised that Infrastructure NSW is the applicant in respect of the Sydney Football Stadium State Significant Development applications. Under the Enviromental Planning and Asssessment Act 1979, the Minister for Planning is the consent authority for State Significant Development applications where the development is lodged by or on behalf of a public authority. I have not directed the Independent Planning Commission under Section 2.9 of the Enviromental Planning Act 1979 to hold a public hearing in relation to the applications.

*2198 SPORT—CENTRES OF EXCELLENCE FUNDING—Ms Voltz asked the Minister for Resources, Minister for Energy and Utilities, Minister for Arts, Vice-President of the Executive Council representing the Minister for Western Sydney, Minister for WestConnex, and Minister for Sport—

(1) Have the following funds been paid to the National Rugby League clubs listed below under the Centres of Excellence funding, and on what date were they received?(a) Bulldogs $2 million(b) Knights $10 million(c) Rabbitohs $8.696 million(d) Roosters $5.765 million(e) Sharks $8 million

(2) Have the Sea Eagles received any of the up to $10 million funding reservation for a Centre of Excellence at Brookvale oval?(a) If so, when?

(3) Have the West Tigers received any of the $5.5 million funding reservation for a Centre of Excellence?(a) If so, when, and for which site?

Answer— The Office of Sport continues to work with all clubs regarding their projects. Funds will not be paid until all conditions are met for funding .

*2199 TREASURER—CONTAINER TERMINAL ARRANGEMENTS—Ms Voltz asked the Minister for Resources, Minister for Energy and Utilities, Minister for Arts, Vice-President of the Executive Council representing the Treasurer, and Minister for Industrial Relations—

(1) Has the Treasurer or any of the Treasurer's agencies been contacted by the Australian Competition and Consumer Commission (ACCC) in regard to its inquiry into arrangements affecting container terminals at New South Wales ports?(a) If so, has information been provided to the ACCC?

Answer— (1) I am advised that Treasury approached the ACCC and offered to provide information to assist with

the inquiry.

(2) I am advised that Treasury has previously provided information to the ACCC about the ports long term lease transactions, and is working co-operatively with the ACCC on whether further information is required for the current inquiry.

*2200 ROADS, MARITIME AND FREIGHT—CONTAINER TERMINAL INQUIRY—Ms Voltz asked the Minister for Primary Industries, Minister for Regional Water, Minister for Trade and Industry representing the Minister for Roads, Maritime and Freight—

(1) Have any of the Minister's agencies been contacted by the Australian Competition Consumer Commission (ACCC) in regard to its inquiry into arrangements affecting container terminals at New South Wales ports?(a) lf so:

(i) which agencies have been contacted?(ii) has information been provided to the ACCC?

Answer— I am advised:No.

*2201 ROADS, MARITIME AND FREIGHT—RMS LEGAL COSTS—Ms Voltz asked the Minister for Primary Industries, Minister for Regional Water, Minister for Trade and Industry representing the Minister for Roads, Maritime and Freight—

(1) How much has Roads and Maritime Services (RMS) spent to date on legal costs associated with its court case with Desane Properties Pty Limited?

(2) Have costs been awarded in the court case with Desane Properties Pty Limited?(a) If so, were costs awarded against RMS?

(i) if so how much?

Answer— I am advised:The matter has been listed before the Court of Appeal. It is inappropriate for me to comment on a matter that is before the courts.

*2202 TRANSPORT AND INFRASTRUCTURE—LOST-TIME INJURY FREQUENCY RATES—Ms Voltz asked the Minister for Resources, Minister for Energy and Utilities, Minister for Arts, Vice-President of the Executive Council representing the Minister for Transport and Infrastructure—

(1) What is the lost-time injury frequency rate for the:(a) CBD & South East Light Rail Project?(b) Sydney Metro Northwest project?

Answer— I am advised :Safety is the NSW Government's top priority and is monitored at all our infrastructure projects.The 12-month rolling Lost Time Injury Frequency Rate (LTIFR) for Sydney Light Rai Project is 0.79 and for the Sydney Metro Northwest Project is 0.4. The Principal Contractors for these projects are responsible for discharging duties under Work Health Safety legislation.

*2203 WESTCONNEX—WESTCONNEX—Ms Voltz asked the Minister for Resources, Minister for Energy and Utilities, Minister for Arts, Vice-President of the Executive Council representing the Minister for Western Sydney, Minister for WestConnex, and Minister for Sport—

*2204 PRIMARY INDUSTRIES—LAND CLEARING PROSECUTIONS—Dr Faruqi asked the Minister for Primary Industries, Minister for Regional Water, Minister for Trade and Industry—

(1) Has Local Land Services commenced any prosecutions for breaches of Part 5A of the Local Land Services Act 2013?(a) If yes, please provide the date of prosecution and the type of offence for each prosecution.

Answer— The Chief Executive of the Office of Environment and Heritage is responsible for prosecutions under the Local Land Services Act 2013.Questions relating to prosecutions for breaches of Part 5A should be directed to the Minister for the Environment.

*2205 REGIONAL WATER—MACLEAY RIVER—Dr Faruqi asked the Minister for Primary Industries, Minister for Regional Water, Minister for Trade and Industry—

(1) Is the Minister aware of any concerns regarding small dams on private properties along the Macleay River which divert water from creeks and rivers and hasten evaporation?

(2) What steps has the Minister taken to ensure that the Hillgrove Mine Tailing Dam is secure and does not pose a threat to the Macleay River, especially in the context of climate change?

Answer— (1) A small number of concerns were referred to Natural Resources Access Regulator's predecessors

between 2010 and 2014.(2) I have been informed by the NSW Dams Safety Committee that there are three dams' facilities at the

Hillgrove Mine site - two tailings dams with one currently being capped and another mine process water dam. The owners of these dams are up to date with their monitoring and reporting requirements and the Dams Safety Committee is satisfied with their integrity and that they do not pose an unacceptable risk to the community or environment with respect to dam failure.With respect to climate change, contemporary dams' safety standards are reviewed periodically to take into account latest developments in weather prediction including probable maximum rainfalls that could affect dam integrity. Adherences to these standards are considered by the Dams Safety Committee.

*2206 PRIMARY INDUSTRIES—NEW SOUTH WALES CHIEF ANIMAL WELFARE OFFICER—Dr Faruqi asked the Minister for Primary Industries, Minister for Regional Water, Minister for Trade and Industry—

(1) Has the New South Wales (NSW) Chief Animal Welfare Officer, or an interim NSW Chief Animal Welfare Officer, been appointed?(a) If yes, who has been appointed?(b) If no, when is the appointment expected to occur?

(2) What is the job description of the NSW Chief Animal Welfare Officer?

Answer— (1) Yes, an interim NSW Chief Animal Welfare Officer has been appointed.

(a) Kim Filmer.

(2) This role will have oversight of animal welfare programs within NSW DPI with a particular focus on the ongoing reform process to improve animal welfare standards. They will also have a central role in engaging with key stakeholders to ensure the appropriate balance in relation to welfare standards is met.

(1) Has the New South Wales Native Vegetation Panel been appointed?(a) If yes, who has been appointed to the panel?(b) If no, when are the appointments expected to occur?

Answer— The Government is currently in the process of establishing the Native Vegetation Panel.Despite advertising in December 2017 and a separate candidate identification process, the Government was not satisfied with the level of response received. The positions will be re-advertised in the coming weeks, accompanied by a more intensive candidate selection process.Until the candidate identification process has been completed and to fulfil the statutory duty of the panel, an interim expert panel will be established.

*2208 RACING—GREYHOUNDS AS PETS—Dr Faruqi asked the Minister for Primary Industries, Minister for Regional Water, Minister for Trade and Industry representing the Minister for Lands and Forestry, and Minister for Racing—

(1) How many staff members does the Greyhounds as Pets Program have?(a) How many of these staff members work at the Wyee Greyhounds as Pets facility?

Answer— I am advised by Greyhound Racing NSW:(1) 14.9 full time equivalent (FTE) employees

(a) 11.3 FTEs.

*2209 ROADS, MARITIME AND FREIGHT—NORTHERN BEACHES HOSPITAL ROAD UPGRADE PROJECT—Dr Faruqi asked the Minister for Primary Industries, Minister for Regional Water, Minister for Trade and Industry representing the Minister for Roads, Maritime and Freight—

(1) Has there been any increase in traffic incidents on Warringah Road, Frenchs Forest Road or Oxford Road West since the beginning of the Northern Beaches Hospital road upgrade project?

(2) Is the mesh used on the Northern Beaches Hospital road upgrade project, including approach ramps, compliant with Australian standards?(a) If yes, which standards?

Answer— I am advised:(1) There is no evidence of an increase in crashes on Warringah Road or Frenchs Forest Road. Oxford

Road West does not exist in this area.(2) Yes, Australian Standard AS 2432.

*2210 ENVIRONMENT—AIR POLLUTION AT MERRYLANDS—Dr Faruqi asked the Minister for Resources, Minister for Energy and Utilities, Minister for Arts, Vice-President of the Executive Council representing the Minister for the Environment, Minister for Local Government, and Minister for Heritage—

(1) Is the Environment Protection Authority (EPA) aware of a smoky and pungent odour affecting residences in in the suburb of Merrylands since September 2017?(a) If yes, what is the cause of the odour?(b) If yes, what is the EPA doing to identify the cause and prevent the odour?(c) Are there any plans to improve air quality monitoring in the Cumberland ⁄ Holroyd area?

Answer— I am advised that:(1) No.

additional monitoring stations in Western Sydney.

*2211 ENERGY AND UTILITIES—MACLEAY RIVER—Dr Faruqi asked the Minister for Resources, Minister for Energy and Utilities, Minister for Arts, Vice-President of the Executive Council—

(1) What steps has the Minister taken to ensure that the Hillgrove Mine Tailing Dam is secure and does not pose a threat to the Macleay River, especially in the context of climate change?

Answer— I am advised:The Hillgrove Mine tailing dams are subject to ongoing regulation and oversight by a number of agencies, including the Dam Safety Committee, the Environment Protection Authority, the Department of Planning and Environment and the NSW Resources Regulator.In October 2016 a joint-agency audit program involving the Resources Regulator, the Environment Protection Authority and the Department of Planning and Environment was carried out in relation to the tailing dams. The audit found that Hillgrove had implemented and maintained safety management systems for the operation and maintenance of dams on site.In addition, compliance monitoring by the Environmental Sustainability Unit, now within the Resources Regulator, has not identified any issues in relation to the tailings dams. These activities include:

• Two site inspections targeting progressive rehabilitation performance (7 Dec 2016, 9 August 2017);

• Review of the Annual Environmental Management Reports for the 2015 and 2016 Reporting periods; and

• Assessment of Mining Operations Plan (MOP) amendment submitted by the leaseholder in September 2016 to address operations during Care and Maintenance.

The Resources Regulator continues to actively monitor the operation and rehabilitation of the tailings dams.

*2212 ENVIRONMENT—WATER CONTAMINATION AT RAAF BASE WILLIAMTOWN—Dr Faruqi asked the Minister for Resources, Minister for Energy and Utilities, Minister for Arts, Vice-President of the Executive Council representing the Minister for the Environment, Minister for Local Government, and Minister for Heritage—

(1) Is the Environment Protection Authority (EPA) aware of any plans to clear drains inside the 'Williamtown Management Area' (also known as the 'Investigation Area' or the 'red zone') relating to the water contamination at RAAF Base at Williamtown?(a) lf yes:

(i) What are these plans?(ii) What advice has the EPA given regarding the prevention of further contamination as a

result of clearing the drains?(iii) What controls will be in place to prevent further contamination?(iv) How has the EPA ensured that the current plan will not lead to further contamination?(v) Has the EPA advised agencies that they intend to clear the drains to dump the

contaminated sediment on private land, then organise to have the sediment removed at a later date?

(vi) Is it a requirement of any resident within the 'red zone' who wishes to remove contaminated soil from their property that they must dispose of it in a licensed waste treatment facility?

(vii) Is it a requirement of any contractor removing sediment that they must dispose of it in a licensed waste treatment facility?

(viii) How will the EPA prevent contaminated water from moving downstream during the sediment clearing?

(b) Has the EPA tested the sediment contained in drains?

*2213 TRANSPORT AND INFRASTRUCTURE—AUSGRID REQUIREMENTS FOR CBD LIGHT RAIL—Ms Voltz asked the Minister for Resources, Minister for Energy and Utilities, Minister for Arts, Vice-President of the Executive Council representing the Minister for Transport and Infrastructure—

When was the Minister first advised of the cost and delay implications that Ausgrid's requirements would have on the CBD light rail?

Answer— I am advised :Issues associated with utilities and services were anticipated prior to commencement of construction of the CBD and South Easter Light Rail and were the subject of extensive negotiations.Therefore, the contract with ALTRAC included mechanisms for dealing with risks associated with utilities.As matters related to AUSgrid's requirements for utilities are the subject of ongoing court proceedings, it would be inappropriate to comment further.

Answer— In December 2017, the NSW Government released the Water Reform Action Plan, with the objective of delivering on the state's responsibility to ensure there is an equitable and transparent approach to the management of water for current and future generations.The goals of the plan are to:

• introduce best practice for water management• ensure transparency in how we share, allocate and manage water• build a compliance and enforcement regime that ensures strong and certain regulation• build capability to support implementation of water reforms.

In March 2018, the NSW Government published a consultation paper on water take measurement and metering which presented a range of policy options, including private ownership of metering. The consultation paper sought feedback on how the NSW Government could deliver on its commitment to implement a robust metering framework.Between July 2017 and April 2018, no Government owned meters were installed in the Barwon-Darling system. WaterNSW are aware that some licence holders have recently commenced installing additional meters or re-commissioning existing water meters with data loggers. However, if a licence holder installs a meter, they are not obligated to notify WaterNSW of that installation. One application for an amended Water Supply Work approval was granted in April 2018.The NSW Government is currently consulting on a robust metering policy. This change was made to reflect customer travel patterns and support more reliable bus services across the corridor.Customers are able to travel between Bronte Beach and Railway Square by using route 379 services between Bronte Beach and Bondi Junction, then transferring to route 440 services towards Railway Square. Answer— (1) to (5) I am aware that sugarcane burning is still practiced in northern NSW, although I understand the

industry has been moving to phase it out.Best management practice, including harvesting and pre-harvesting techniques, is largely a matter for the industry itself, which has its own extensive Research and Development network.I also understand that Sugar Research Australia has previously funded research into cane cleaning options with a view to reducing the need for cane fires in NSW.The NSW Department of Primary Industries does not maintain statistics on the actual percentage of farmers who burn sugarcane. In terms of the health related aspects of this question, these may be best directed to the Minister for Health.
