WATER ACT 2000

Compliance dates for Initial Councils

The Commission notifies that under section 360 ZD of the Water Act 2000, these compliance dates apply to all premises located in the local government areas of; Redlands City Council, Scenic Rim Regional Council and Sunshine Coast Regional Council, where Commission Water Restrictions commenced on 30 March 2009.

The table below provides dates for compliance with the various listed Commission Water Restrictions. Column 1 identifies the Restriction and Column 2 provides information about the relevant compliance requirements.

Under Medium Level Water Restrictions your Water Efficiency Management Plan (WEMP) was to be submitted to Council for approval by 30November 2009.

9.2 Motor vehicle dealerships- washing of vehicles

You will need to be in a position to comply with the relevant water efficiency guidelines by 31 March 2010.

9.3 Vehicle washing in a fixed permanent commercial location

You need to complete the installation of water efficient fittings by 31 October 2010.

10.2 Land development, subdivisional activities State and Local Government roads and associated roadwork activities

Under Medium Level Water Restrictions you have needed to obtain written approval from Council since 30 March 2009.

11.1 Kitchen, laundry and ablution facilities on premises where annual consumption is greater than 1 ML

You need to complete installation of water efficient fittings by 31 October 2010. Compliance is demonstrated by submitting a Plumber's Certificate or Statutory Declaration to Council.

11.2 Urinal systems Your Urinal systems must be water efficient by 31October 2010. Compliance is demonstrated by submitting a Plumber's Certificate or Statutory Declaration to Council.

13.5 Outdoor showers You will need to fit outdoor showers with efficient showerheads and an automatic cut-off device by 2April 2010.

NOTIFICATION OF THE PREPARATION OF DRAFT STATE PLANNING INSTRUMENTS

I, the Honourable Timothy Mulherin MP, Acting Minister for Climate Change and Sustainability do herebynotify pursuant to section 60 of the Sustainable Planning Act 2009 that the draft South East QueenslandKoala Conservation State planning regulatory provision and draft South East Queensland Koala ConservationState planning policy have been prepared.

Copies of, and information about, the draft State planning instruments are available at www.derm.qld.gov.au orby calling 1300 130 372.

They are also available for inspection and collection free of charge from the Department of Environment andResource Management (Brisbane Office, Level 3, 400 George Street, Brisbane) or at www.derm.qld.gov.au.

Consultation on the draft State planning instruments is open from 23 December 2009 to 28 February 2010.

DIRECTIVE No. 22/09

1 Title: Gifts and Benefits

2 Purpose: This directive outlines the ethical considerations and procedures involved in the giving and receiving of gifts and benefits by employees and agencies of the Queensland Public Service.

3 Application: This directive applies to:

all public service agencies;

public service employees, including chief executives, senior executives, senior officers, public service officers, and temporary employees and general employees engaged under the Public Service Act 2008; and

those public service offices and employees to whom this directive is applied under the Public Service Regulation 2008.

DIRECTIVE No. 22/094. Legislative Provision: Public Service Act 2008 – sections

9, 25, 26, 53, 98.

5. Effective date: 1 January 2010

6. Definitions: Accountable officer has the meaning given by the Financial Accountability Act 2009 or the appropriate officer who has responsibility for the financial administration of the agency, if the agency is not subject to the Financial Accountability Act 2009.Employee health and well-being program means a program designed to promote health by encouraging individuals to lessen their exposure to common health risks and to actively prevent the onset of disease. Retail value means the reasonable retail value of the gift or benefit. Gifts and benefits means :

(a) the transfer of property or other benefit i. without recompense; or ii. for a consideration substantially less than full consideration; or

(b) a loan of property made on a permanent, or an indefinite, basis; received or given by an official when they are acting in their official capacity. For the purposes of this directive, gifts and/or benefits include tangible items of lasting value and intangible items of no lasting value (including hospitality).

It does not include any gifts or benefits given or received under an appropriately approved employee health and well-being program or an appropriately approved rewards and recognition program. It does not include benefits negotiated when an agency sponsors a service, product or activity on its own or with another government agency, as may occur under the Queensland Government Sponsorship Policy. Public perception means the perception of a fair-minded person in possession of the facts.Rewards and recognition program means gifts or benefits received by public service employees awarded under an appropriately approved agency program that recognises contributions towards meeting agency outcomes and objectives.

7. Directive: 7.1 Principles

Being a public service employee involves a public trust. This means that duties must be carried out impartially and with integrity. Consequently, it is not appropriate for public service employees to be offered, to accept or to give gifts and benefits that affect, may be likely to affect or could reasonably be perceived to affect, the independent and impartial performance of their official duties.

Public service employees must at all times be mindful of their obligation to maintain and enhance public confidence in the integrity of public administration.

Public service employees must not ask for or encourage the giving of any form of gift or benefit in connection with the performance of official duties. This includes entering any discretionary competitions which involve a prize.

Any gift or benefit accepted, regardless of monetary value, implies, or may imply, a relationship which may interfere with objectivity and independence.

In most situations public service employees can decline offers of gifts or benefits courteously by explaining that acceptance would be against agency policy and consequently that they have no discretion in the area.

Gifts or benefits accepted by a public service employee remain the property of the agency unless the accountable officer for the agency determines it is appropriate for the recipient to retain the gift or benefit.

7.2 Acceptance of gifts and benefits If offered a gift or benefit, a public service employee or agency must always consider whether a gift or benefit is appropriate to accept. Issues to consider include why the offer was made and the public perception of acceptance. Public service employees should discuss these issues with a supervisor or manager to ensure appropriate approval is obtained prior to a decision about whether to accept a gift or benefit. Any offer of cash, or any items which are readily converted into cash, must be refused in all circumstances. Accepting money in any form will breach a number of public service policies and legislative requirements and may be seen as an attempt at bribery.

7.2.1 Benefit to the State of Queensland Any gift, other than a token or memento, must not be accepted unless it can be shown to be of benefit to the agency, the State of Queensland and/or the public generally.

7.3 Giving of gifts or benefits The provisions of this directive also apply to the giving of gifts or benefits by public service employees and agencies. Consideration must be given to why the gift is being offered and the public perception of the giving of the gift or benefit. Any gift or benefit must be for official purposes and accountable officers must be able to identify the benefit for the agency, the State of Queensland and the public generally.

7.3.1 Official Hospitality Expenditure for official hospitality must be considered only where it is considered essential to facilitate the conduct of public business through persons who are able to do so, either by advice or because of their vocation or business needs. Such hospitality should not be a substitute for business meetings which would ordinarily be conducted in the workplace.

7.3.2 Corporate Gifts The practice of giving gifts should not be common or frequent in occurrence. The appropriateness of gift giving must be considered and appropriate approval must be obtained from the accountable officer. Where a gift is to be made on behalf of the State, consideration should be given to selecting an appropriate gift from the Official Gift Range maintained by Protocol Queensland.

7.3.3 Gifts or benefits offered to public service employees Any gift or benefit that is offered to a public service employee on behalf of their employing agency or the State, except those offered as part of an appropriately approved employee health and well-being program, appropriately approved rewards and recognition program or relevant directive1 , must comply with the requirements of this Directive.

7.4 Reporting of gifts and benefits Any gift or benefit received or given that has a retail value of more than $150 must be recorded in a gifts and benefits register. If multiple gifts are from the same donor or from donors in a similar relationship with the public service employee, in any financial year and the cumulative value is more than $150, then each gift or benefit must be reported. Gifts or benefits received must be reported within one month of receipt. Any gifts of cultural or historical significance must be reported, regardless of their value.

7.4.1 Determining valuesPublic service agencies and employees should have an appropriate person verify the estimated retail value of a gift, if the value is not easily established. Deliberately undervaluing a gift or benefit to avoid reporting it or to fraudulently keep it may be official misconduct.

7.4.2 Gifts and Benefits Register Gifts or benefits received or given with a retail value of more than $150 must be recorded in the agency’s gifts and benefits register. Agency registers must be in a form approved by the Commission Chief Executive. The register must be published under the Right to Information Act 2009 as part of an agency’s publication scheme. The register must be published online each quarter, within 10 calendar days of the end of the quarter.

7.4.3 Review of Gifts and Benefits Register The gifts and benefits register is to be subject to regular review. The reviewer must be independent and should communicate any results of the review to the accountable officer.The purpose of such a review should include analysis for trends or patterns which may cause concern and need corrective and preventative action.

DIRECTIVE No. 22/097.5 Retention of gifts and benefits Gifts or benefits accepted by a public service employee or agency remain the property of the agency unless the accountable officer determines it is appropriate for the recipient to retain the gift or benefit.

7.5.1 Accepted gifts of $150 value or less Any gift or benefit which has a retail value of $150 or less and is accepted by a public service employee or agency, may remain the property of the employee if acceptance is not likely to affect, or could reasonably be perceived to affect, the independent and impartial performance of the employee’s official duties. Any gifts of cultural or historical significance must remain the property of the agency, regardless of their value.

7.5.2 Accepted gifts of more than $150 value Any gift or benefit accepted by a public service employee or agency and is not a gift of cultural or historical significance:

which has a retail value of between $150 and $350 may remain the property of the employee if the accountable officer gives approval for the public service employee to retain the gift or benefit in appropriate circumstances; or

which has a retail value of over $350 may remain the property of the employee if the accountable officer gives approval for the public service employee to retain a gift or benefit, in exceptional circumstances.

All gifts of cultural or historical significance must remain the property of the agency, regardless of their value. If a gift or benefit is retained by the agency, it must be used for public benefit and in an appropriate manner. If an agency does not have an appropriate use for the gift or benefit, it may be disposed of in accordance with the Guidelines for Gifts and Benefits.

7.5.3 Gifts or benefits must not involve time away from official duties Public service employees must not be away from their official duties at public expense. Gifts or benefits can only be used outside the public service employee’s normal working hours or on approved leave, unless the gift or benefit forms part of the public service employees’ official duties and appropriate approval is obtained.

FOR THE SHIRE OF WHITSUNDAY

Notice is given under the Integrated Planning Act 1997,schedule 1 that on 17 December, 2009 Whitsunday RegionalCouncil adopted an amendment to the planning scheme for theWhitsunday Shire (Whitsunday Shire Planning Scheme 2009).

The planning scheme amendment will have effect on and fromFriday 8 January 2010. The reference for the amendment is 1 of2009.

Multi-agency pools

Some Queensland Government agencies are on the lookout for people to fill similar jobs or occupations at the same time. With multi-agency pools, you only have to apply once to access job opportunities across participating agencies. Your application will then be able to be viewed and assessed by all the agencies in that pool - or, if you prefer, you can specify that you want to be considered only for particular agencies. When you have found the job you would like to apply for.

1. You can phone for a copy of the information kit or you can download the documents from the Smart Jobs and Careers website at www.jobs.qld.gov.au. The information kit will include:

• a job information package, outlining the procedure for preparing and sending in your application, and

Appointees to the Senior Executive Service are offered an attractive remuneration package with salary sacrifice in return for optional benefits including.

Interstate Standard Gauge Corridor – Australian Rail Track Corporation Ltd

1. We hereby direct the board of QR Limited ACN 124 649 967 (QR):

(a) to cause QR to effect (or, as applicable, cause QR's subsidiaries to effect) an unconditional surrender of the Corridor Sublease as so far as it relates to the Lots described in Schedule 1 to this Direction for nil consideration; and

(b) to cause QR to effect (or, as applicable, cause QR's subsidiaries to effect) a transfer of the Structures to Australian Rail Track Corporation Ltd ABN 75 081 455 754 (ARTC) for nil consideration.

each to be effected on 15 January 2010.

2. We further direct the board of QR to do all things necessary to give effect to this Direction.

3. In this Direction:

(a) unless defined in this Direction, terms used bear the same meaning as in the Government Owned Corporations Act 1993.

(b) Corridor Sublease means sublease registered number 701720343.

(c) Structures means such rail transport infrastructure and other rail infrastructure (as those terms are defined in the TIA) and buildings (as defined by section 245(3) of the TIA) identified in Schedule 2 to this Direction.

(d) TIA means the Transport Infrastructure Act 1994 (Qld).

TRAINING AND EMPLOYMENT GUIDELINES

A function of the Training and Employment Recognition Council under section 168(1)(n) of the Vocational Education, Training and Employment Act 2000 (the Act) is to make recommendations to the Minister about guidelines for the council about matters arising from the performance of the council’s functions.

Section 189 of the Act provides that a guideline recommended by the council becomes effective when it is approved in writing by the Minister. That section also provides that if a guideline is approved by the Minister, the council must ensure the guideline is published in the gazette. Under section 189, the council must comply with all approved guidelines in performing its functions.

Guideline 3 version 6 - Recognising vocational placement schemes has recently been approved by the Minister for Education and Training, effective 15 December 2009.

Guideline 4 version 6 - Registering and regulating vocational placement agreements (short and long) has recently been approved by the Minister for Education and Training, effective 15 December 2009.

GUIDELINE Title: Recognising vocational placement schemes

A function of the Training and Employment Recognition Council (the council) under section 168(1)(e) of the Act is to recognise vocational placement schemes.

GUIDELINE

Description of Guideline

1. The council may recognise, or refuse to recognise, vocational placement schemes.

2. Vocational placement schemes will only be recognised under an institutionally based course1 leading to a qualification or statement of attainment.

3. The object of the placement is to give the student practical training and experience that is required to enable the student to gain the competency outcomes of the course/qualification, and, is assessed as part of, the student’s course.

4. Applications for approval to offer a vocational placement scheme: a. will only be accepted from registered training organisations b. may be lodged subsequent to, an application to deliver the qualification

for which the vocational placement scheme relates. Schemes will not be approved until the RTO has the course/qualification on their scope of registration.

c. must be forwarded to the council via its nominated instrument in a timely fashion with the appropriate fee

d. are to be submitted in the format approved by the council with sufficient information as defined by the council to make an informed decision

e. are required to demonstrate the link between the intended vocational placement scheme(s) and the competencies within the qualification

f. will state the required hours per calendar year a learner will spend in the vocational placement for that qualification

g. must not be in contravention of this or any other legislation, regulation, guideline, specified restrictions and/or departmental policy regarding the placement of persons into a ‘work environment’.

h. Are required to identify a clear separation between the three parties involved in the placement: 1. the organisation 2. the student 3. the person to provide the placement.

5. The hours approved on the information notice are the maximum hours (duration) for the placement (once the student is assessed as competent as per the units on the training plan, the vocational placement would cease).

6. Vocational placement hours are in addition to the nominal hours of delivery.

Supporting Documents

1 A course is generally defined as “a structured approach to the development and attainment of skills and knowledge”. For the purposes of vocational placement, a course means the learning processassigned to a particular qualification, competency or accredited course.

GUIDELINE

Description of Guideline

1. Short Placements

Under section 117 of the Act, registered training organisations are required to maintain a register of vocational placements (electronic or paper). A vocational placement agreement may be registered where:


a) the registered training organisation has recognition for the vocational placement scheme (see Guideline 3) for which the vocational placement agreement is intended

b) all parties have agreed to and signed the vocational placement agreement c) a training plan (see Chapter 4, Part 3 of the Act) signed by all parties is

attached to the vocational placement agreement d) the placement of the student is not in contravention of this or any other

legislation, regulation, guideline, specified restrictions and/or departmental policy regarding the placement of persons into ‘work environment’

e) the placement person can provide the required facilities, range of work, supervision and training required under the training plan

f) the total placement for the student on that year for that course is no more than 240 hours

g) the placement person is not a prohibited employer as defined in the Act h) the placement of the student with the placement person does not exceed any

I. permitted ratio that applies to apprentices/trainees or learners to tradesperson and/or

II. suitably qualified persons

2. Long Placements

Section 118 of the Act requires registered training organisations to submit to the Council a signed copy of all Vocational Placement Agreements (long placement), for registration prior to the commencement of that placement. It is not a requirement of section 118 that a registered training organisation maintains a register of long vocational placement agreements as the council maintains the register.

The council will accept such agreements as long placements providing all criteria as set out above are met and in addition:

a) the total period of placement for the student in that year for that course is more than 240 hours; and

b) the Industrial Commission has made an order under the Industrial Relations Act 1999, section 140A, fixing remuneration and conditions for the placement.

Short title

1. This notice may be cited as the Declaration of Entry LevelLuxury Taxis (No. ) 2009.

“Entry level luxury taxi” means a vehicle declared by theChief Executive under Section 145 of the TransportOperations (Passenger Transport) Act 1994 (Qld) to be anentry level luxury taxi. Your notice of objection must state the grounds of the objectionand the facts and circumstances you are relying on to supportthose grounds. Please note that any matter pertaining to theamount or payment of compensation is a not a ground ofobjection under the Act.

If you wish to be heard in support of your objection, you mustalso state this in your written objection. If you do so, then youmay appear personally or be represented by counsel, solicitoror agent and be heard by GAWB or its delegate. The hearing willbe held on 23 February 2010 at the office of GAWB located atFirst Floor, 147 Goondoon Street, Gladstone, Queensland at10am.

GAWB is willing to negotiate to acquire the land by agreementor, failing agreement, to negotiate to reach agreement aboutcompensation to be paid and consequential matters.

If you wish to make a claim for compensation then you mustserve a written claim for compensation on GAWB within 3 yearsafter the day the land was taken. If you serve a claim forcompensation on GAWB more than 3 years after the day theland was taken, GAWB may accept and deal with the claim forcompensation, if it is satisfied it is reasonable in all thecircumstances to do so.

If GAWB does not accept a claim served on it more than 3 yearsafter the day the land was taken, you may apply to the LandCourt to decide whether it is reasonable in all thecircumstances for GAWB to accept the claim. If the Land Courtdecides it is reasonable in all the circumstances for GAWB toaccept the claim, GAWB must accept and deal with the claimunder the Act.

Please also note that GAWB will not take into consideration, inassessing the compensation, a contract, licence, agreement orother arrangement (a relevant instrument) that was entered intoin relation to the land after this notice of intention to resumewas served on you, if the relevant instrument was entered intofor the sole or dominant purpose of enabling you or anotherperson to obtain compensation for an interest in the landcreated under the instrument.
