1. Adoption of draft agenda
The Conference of Presidents
- noted the draft agenda (PE 332.418/CPG) ;
- noted a statement by the President that Mrs THEATO, chairman of the Committee
on Budgetary Control, had been invited to outline the state of play with regard to the
Eurostat affair under Item 4.2;
- decided, at the proposal of the President, to hold over to the next meeting the
following items:

3. Adoption of the final draft agenda for the first September 2003 part-session (Monday, 1 to
Thursday, 4 September 2003) – scheduling of debates for forthcoming part-sessions
The Conference of Presidents
- considered item by item the final draft agenda for the first September 2003 part-
session (Monday, 1 to Thursday, 4 September 2003) on the basis of a note drawn up
by the Directorate-General for the Presidency, following a meeting with the
Secretaries-General of the political groups on 28 August 2003;
- adopted the proposals formulated in that note, with the following changes:
WEDNESDAY
- decided, after an exchange of views, not to conclude the debate on Iraq with a
resolution and to refer the matter to the Committee on Foreign Affairs, Human
Rights, Common Security and Defence Policy for a recommendation on the subject
pursuant to Rule 104 of the Rules of Procedure for the second September part-
session.

4. President's announcements
4.1 Joint meeting of the European Parliament and the Parliamentary Assembly of the
Council of Europe
The Conference of Presidents
- noted a letter of 16 July 2003 from Mr SCHIEDER, President of the Parliamentary
Assembly of the Council of Europe, on the joint meeting of the European Parliament
and the Parliamentary Assembly of the Council of Europe scheduled for 25
September 2003 in Strasbourg (PE 332.463/CPG);
- noted a communication from the President on the joint meeting of the European
Parliament and the Parliamentary Assembly of the Council of Europe scheduled for
25 September 2003 at 3 p.m. on the subject of 'Building one Europe' at which the
following topics were to be debated: the impact of the future Constitutional Treaty,
cooperation with the Council of Europe in the context of an enlarged Europe,
freedom of movement, migration and border controls and promotion of the Charter
of European Political Parties for a Non-Racist Society. The chairmen of the political
groups are invited to attend;
- heard Mr BARÓN CRESPO, chairman of the PSE Group, who suggested that Mr
NAPOLITANO, chairman of the Committee on Constitutional Affairs, should attend
as a speaker, like the chairman of the Committee on Foreign Affairs, Human Rights,
Common Security and Defence Policy;
- called on the chairmen of the three committees most closely concerned to speak at
the joint meeting;

- noted a statement by the President that a Charter of European Political Parties for a
Non-Racist Society would be presented at the meeting.
4.2 State of play in the Eurostat affair
The Conference of Presidents
- heard the President, who said that the Committee on Budgetary Control had
requested that an invitation be addressed to Mr PRODI, President of the
Commission; who informed the group chairmen of the information at his disposal
concerning the progress made with regard to three reports, namely: the report by
OLAF on Eurostat, which was not yet available, the internal audit report (concerning
400 contracts which had been signed), which should be ready at the end of October,
and the report of the Task Force (chaired by Mr ZANGL) on Eurostat's financial
management and control systems, which should be available at the end of September;
- heard Mrs THEATO, chairman of the Committee on Budgetary Control, who
recalled that her committee had heard the statements made by Mr SOLBES, Mr
KINNOCK and Mrs SCHREYER, Members of the Commission, on 16 July 2003 at
an extraordinary meeting; who confirmed that at that meeting the Committee on
Budgetary Control had expressed its intention of inviting Mr PRODI. She considered
the Commission politically responsible because the Directors-General had for some
time been aware of the financial abuses and the serious violations of the Financial
Regulation but had not alerted the Commissioners or the President of the
Commission. This suggested that there were shortcomings in the Commission's
internal communication procedures, which were inadequate and ineffective. She
deplored the fact that, despite the repeated requests of the European Parliament to the
Commission, Parliament still did not have any specific information or reports. She
said that the Committee on Budgetary Control hoped to be able to meet Mr PRODI
in order to ascertain what methods should be applied and to clarify the situation with

regard to the Eurostat affair;
- heard Mr POETTERING, chairman of the PPE-DE Group, who thanked the
Committee on Budgetary Control and its chairman for taking the initiative to monitor
the Eurostat affair. He expressed his surprise at the timetable for drafting two distinct
reports - the internal audit report and the report of the Task Force - and said that he
wished to have further information and greater transparency in the explanations on
the affair. He considered that the Commissioners must accept individual
responsibility for their own Directorates-General because, even after the internal
reform, there was still evidence that the Commission's internal communication
system was functioning poorly. He stressed that at least one of the reports on
Eurostat must be available in time for the meeting with Mr PRODI in the Conference
of Presidents and with representatives of the Committee on Budgetary Control, and
that the meeting must be held as soon as possible;
- heard Mr BARÓN CRESPO, chairman of the PSE Group, who said that his group
supported the efforts of the Committee on Budgetary Control with regard to Eurostat
and that it should continue its work. He stressed that the Commissioners must
shoulder their political responsibility for the services where serious problems had
arisen. It was particularly important that the Conference of Presidents should be able
to study as soon as possible the reports - one of which, that by OLAF, had been
promised by 30 June - concerning the results of the inquiries into Eurostat's financial
management and control, and that the Conference of Presidents should be informed
of the measures which the Commission proposed to take with regard to its
functioning. It would accordingly be desirable for the President of the Commission to
explain the Commission's conduct to the Conference of Presidents;
- heard Mr WATSON, chairman of the ELDR Group, who, on behalf of his group,
thanked Mrs THEATO for her work. He stressed that the problem of the serious
fraud cases at Eurostat was one for which political responsibility must be borne and

that Parliament's role was to ensure that the affair was dealt with as quickly as
possible. He expressed his concern about the seriousness of the situation and said
that the discharge in respect of 2001 would not have been given in April 2003 if
Parliament had then been aware of the details concerning Eurostat. All necessary
steps must be taken to ensure that at least one of the reports in question was available
soon and that Mr PRODI could then be heard by the Conference of Presidents or the
Committee on Budgetary Control or else the Conference of Presidents enlarged to
include members of the Committee on Budgetary Control;
- heard Mr WURTZ, chairman of the GUE/NGL Group, who drew attention to the
need for transparency and to comply with the deadlines for the availability of the
reports on the assessment of the situation at Eurostat; who said that the Committee
on Budgetary Control must continue its work with the mandate it had been given;
who took the view that, in the context of a dialogue between the European
Parliament and the Commission and in a political context, it would be desirable, once
Parliament had studied the reports by OLAF and the Task Force, to invite the
President of the Commission to address Parliament in plenary;
- heard Mrs FRASSONI, chairman of the Verts/ALE Group, who endorsed the
opinion of Mr POETTERING while stressing that it was necessary to be able to hear
Mr PRODI, President of the Commission, before the Conference of Presidents and
the members of the Committee on Budgetary Control before considering the
substance of the reports in question;
- heard Mr DELL'ALBA, non-attached Member, who expressed his concern about the
fact that the reports (particularly that by OLAF) were not yet ready; who took the
view that, in the context of the work already performed by the Committee on
Budgetary Control with regard to the Eurostat affair and in view of budgetary
implementation aspects, Mr PRODI ought at this stage to be heard by the Committee
on Budgetary Control rather than the Conference of Presidents;

- heard Mrs GARAUD, non-attached Member, who likewise expressed her concern
about the unavailability of the reports on fraud, six months after investigations into
the Eurostat affair had been launched, and thus deplored the fact that it was not
possible to assess the situation and the implementation of penalties; who considered
that the difficulty of the situation showed the Commission to bear political and
administrative responsibility, both for the irregularities which had not resulted in
administrative penalties within the Commission and for the failure to take the
measures which it could have taken in response to events; who considered that it was
vital to insist that the documents assessing the situation at Eurostat should be
forwarded as quickly as possible and that Mr PRODI should appear before the
European Parliament to provide explanations;
- heard Mr PASQUA, chairman of the UEN Group, who expressed his concern about
this affair and said that, according to the information available, the situation was
serious and detrimental not only to the Commission but to all the European
institutions; who considered that the Commission should be capable of shouldering
its responsibility; the European Parliament should not be an accessory to the silence
and opacity which had been observed in this affair but should continue its efforts to
secure explanations about EUROSTAT without delay;
- heard Mrs THEATO, chairman of the Committee on Budgetary Control, who said
that her committee would follow up the report on the discharge in respect of 2001
and would monitor closely the next reading of the budget (September 2003) and that,
if shortcomings in the implementation of the budget came to light, the Committee on
Budgetary Control would table amendments and would place appropriations in the
reserve; who stressed that members of the Committee on Budgetary Control must be
able to attend the meeting with Mr PRODI;
- heard the President, who thanked all concerned for the exchange of views;

- asked the President of the European Parliament:
to invite Mr PRODI, President of the Commission, to present at the meeting of the
Conference of Presidents on 25 September 2003 in Strasbourg, and with the
participation of the members of the Committee on Budgetary Control, the
conclusions of the report of the Task Force and the measures which the Commission
proposed to adopt in order to prevent irregularities and embezzlement in future, and
to insist that the report be available in time for that meeting.

the request for authorisation to appoint two rapporteurs to draw up the report on the draft
Treaty and Parliament's opinion to be submitted at the forthcoming Intergovernmental
Conference
The Conference of Presidents, taking a decision without debate,
- noted the above letter of 24 June 2003 from Mr NAPOLITANO (PE 332.370/CPG);
- decided, exceptionally and in accordance with the practice in connection with the
previous Intergovernmental Conferences, to authorise the Committee on
Constitutional Affairs to appoint two rapporteurs to draw up the draft report entitled
'draft Treaty establishing the European Constitution and Parliament's opinion to be
submitted at the forthcoming Intergovernmental Conference' (procedure
CNS(2003)0902).

9. Letter of 2 July 2003 from Mr DAUL on the requests for application of Rule 162a -
enhanced cooperation between committees
The Conference of Presidents, taking a decision without debate,
- noted the above letter from Mr DAUL, chairman of the Conference of Committee
Chairmen, to which was annexed the list of requests for application of Rule 162a (PE
332.409/CPG + annex);
- decided to authorise the application of Rule 162a for the drafting of the reports
which appear in the list annexed to the letter from Mr DAUL, with the exception of
the request by the Committee on Petitions concerning the non-legislative report on
the trade in wild animal meat (NIN/2003/2078), a decision on which was held over
to the next meeting.

10. Approval of non-legislative reports proposed by the Conference of Committee Chairmen
on 2 July 2003 and submitted to the Conference of Presidents for authorisation on 3 July
2003 - justifications for the requests
The Conference of Presidents, taking a decision without debate,
- noted the letter of 2 July 2003 from Mr DAUL, chairman of the Conference of
Committee Chairmen, forwarding the requests for authorisation to draw up own-
initiative reports and the justifications for the requests (PE 332.408/CPG + annexes);
- decided, in the light of the justifications adduced, to authorise the drafting of the
own-initiative reports proposed by the following committees: AFET, LIBE, JURI,
ITRE, ENVI, CULT, DEVE and FEMM;
- decided to authorise the requests by the EMPL and ECON committees on condition
that the quota of 6 reports to be drafted simultaneously was not exceeded.

11.1 Letter of 21 May 2003 from Mr TUMUR-OCHIR, Speaker of the Great Hural of
Mongolia, inviting the European Parliament to send a delegate to attend the Fifth
International Conference of New or Restored Democracies in Mongolia
The Conference of Presidents, taking a decision without debate,
- noted the following documents:
the above letter from Mr TUMUR-OCHIR, Speaker of the Great Hural of
Mongolia, stating that the Conference would take place from 10 to 12 September
instead of 18-20 June 2003 – financial statement (PE 332.487/CPG and annex),
the letter of 21 February 2003 from Mr TUMUR-OCHIR to Mr COX, inviting
the European Parliament to the Fifth International Conference of New or
Restored Democracies scheduled for 18-20 June 2003 in Mongolia and reply of
29 April 2003 from President COX (PE 328.369/CPG + COMPL.);
- noted the letter of 29 April 2003 comprising the reply from Mr COX to this
invitation;
- decided, subject to their availability, to send one of the Vice-Presidents responsible
for interparliamentary relations to represent the European Parliament at the Fifth
International Conference to be held on 11 and 12 September 2003 in Ulan Bator,
Mongolia.
