SECTION 1 – Overview

A. Purpose of this Request for Proposal The purpose of this Request for Proposal (RFP) is for the Yuma County

Local Workforce Investment Board, hereafter referred to as WIB, operatedby the Yuma Private Industry Council, Inc., hereafter referred to as YPIC, toidentify qualified providers for adult and dislocated worker Career andTraining Services under the Workforce Innovation and Opportunity Act(Public Law No: 113-128 (WIOA)).

The Federal legislation directing the public employment and training systemis in the midst of change. The Workforce Investment Act (WIA) is thefederal law that governs public workforce systems which was signed intolaw on August 7, 1998 and concludes on June 30, 2015. The passing of theWorkforce Innovation and Opportunity Act on July 22, 2014 provides newauthorizing legislation for programs authorized under WIA. Implementationof WIOA will take place on July 1, 2015 with guidance, technical assistancetools and resources under development. Additional information on WIA canbe found on the Department of Labor website www.doleta.gov/WIOA.

Under WIOA, Career Services are provided through the One Stop CareerCenter and through service providers (contractors). Training Services areprovided through approved vendors listed on the Arizona State EligibleTraining Provider List (ETPL) (WIOA, Section 122).

Under WIOA, all adults and dislocated workers are eligible for CareerServices as defined in the WIOA, section 134 and (2) (A) (1). Those whounlikely or unable to obtain or retain employment through Career Servicesare eligible for Training Services (WIOA, section 134, (3) (I)(aa)); those whobe in need of training services to obtain or retain employment (WIOA,section 134, (3) (I)(bb)); and those who have the skills and qualifications tosuccessfully participate in the selected program of training service (WIOA,Section 134, (3) (1) (cc). The ultimate goal is full time employment.

B. Target Population and Geographic AreasThe target populations are: WIOA eligible Adults and Dislocated Workers ages18 and older.

Services may be provided to adults and/or dislocated workers in the diverse partsof Yuma County, such as; San Luis, Gadsden, Somerton, Roll, Wellton,Antelope, Tacna, Dateland, and localities of Yuma East and South County.

C. Eligible ApplicantsAny private for-profit business entity, private non profit corporation, or publicentity may apply for available funds. However, entities which have been debarredare restricted from applying in accordance with 29 CFR, part 98.

Mandated One Stop partners cannot request funding for activities for CareerService activities which they are expected to perform as partners in the One Stopsystem. Activities in this case include staff, as well as associated costs, that mayor may not have been included in the partner’s initial Memorandum ofUnderstanding.

D. Funds AvailableThe quantities listed below reflect the total funds available, YPIC may grantmultiple contracts to different proposers, therefore the funds will need to bedistributed amongst those that are granted contracts.

Adults: Adult Basic Education/General Equivalency Diploma Preparation andPre-vocational Services.

$30,000.00

Adults: Full Services: Career Service, Training Services, and Follow UpServices. $175,000.00

Dislocated Workers: Adult Basic Education/General Equivalency DiplomaPreparation and Pre-vocational Services. $15,000.00

Dislocated Workers: Full Services: Career Service, Training Services, andFollow Up Services. $179,000.00

Total funds: $399,000.00

E. Term of ContractContract period shall start on July 1, 2015 and end on June 30, 2016.Option-year contracts will be granted to the selected providers. Option yearcontracts have the advantage of maintaining annual accountability goals by tyingfuture years of the contract to performance in the base year. The Contract will bea cost reimbursement contract.

Selected providers may also be awarded contracts from additional funds whichmay become available to the Workforce Investment Board during the next fiveyears.

YPIC reserves the right to terminate any or all contracts granted after the firstyear of performance, as deemed necessary or opportune by the Council.

G. Purposes of the Workforce Innovation and Opportunity Act(WIOA)The purposes of the Workforce Innovation and Opportunity Act is “to increase, forindividuals in the United States, particularly those individuals with barriers toemployment, access to and opportunities for the employment, education,training, and support services they need to succeed in the labor market.

To support the alignments of workforce investment, education, andeconomic development systems in support of a comprehensive, accessible, andhigh-quality workforce development system in the United States.

To improve the quality and labor market relevance of workforceinvestment, education, and economic development efforts to provide America’sworkers with the skills and credential necessary to secure and advance inemployment with family-sustaining wages and to provide America’s employerswith the skilled workers the employers need to succeed in a global economy.

To promote improvement in the structure of and delivery of servicesthrough the United States workforce development system to better address theemployment and skill needs of workers, jobseekers, and employers.

To increase the prosperity of workers and employers in the United States,the economic growth of communities, regions, and States, and the globalcompetitiveness of the United States.

To provide workforce investment activities, through statewide and localworkforce development systems, that increase the employment, retention, andearnings of participants, and increase attainment of recognized postsecondarycredentials by participants, and as a result, improve the quality of the workforce,reduce welfare dependency, increase economic self-sufficiency, meet the skillrequirements of employers, and enhance the productivity and competitiveness ofthe Nation”. (Workforce Innovation and Opportunity Act, Public Law 113-128,Sec. 2)

H. ConsiderationsYuma County’s Local Workforce Investment Area (LWIA) reserves the right tomake technical corrections or additions to this RFP. Such corrections oradditions shall be sent to each applicant that registers at the TechnicalAssistance Conference.

I. WIOA Adult and Dislocated Worker Definitions

Client Eligibility: Will be determined by YPICAn individual must be authorized to work in the United States and, if applicable,must be registered for the Selective Service.

Adult EligibilityAn eligible adult is defined by WIOA is an individual who is 18 or older (WIOASection 3 (2)).

If limited funds dictate that Career Services and Training Services be prioritized,

a low-income adult is an individual (or is a member of a family) that (WIOASection 3 (36)):

1) Receives, or in the past 6 months has received, or is a member ofhousehold that is receiving or has been determined within the prior six-month period eligible to receive supplemental nutrition assistance programunder the Food and Nutrition Act of 2008;

2) Receives supplemental security income under the Social Security Act;3) Receives State, or local income based public assistance;4) Received an income in the prior six months that does not exceed the

higher of either the poverty level or the 70%of the lower living standardincome level;

5) Qualifies as a homeless individual under the Violence against Women Actof 1994;

6) Receives or is eligible to receive a free or reduce price lunch under theRichard B. Russell National School Lunch Act;

7) Is an individual with a disability whose own income meets the criteria in #4above but who is a member of a family whose income does not meet thisrequirement.

Dislocated Worker EligibilityA dislocated worker (WIOA Section 3 (15)) is an individual who:

A.I) has been terminated or laid off, or who has received a notice of

termination or layoff, from employment;II) a) is eligible for or has exhausted entitlement to unemployment

compensation; orb) has been employed for a duration sufficient to demonstrate,

to the appropriate entity at a One-Stop Center attachment tothe workforce, but is not eligible for unemploymentcompensation due to insufficient earnings or havingperformed services for an employer that were not coveredunder a State unemployment compensation law; and

c) is unlikely to return to a previous industry or occupation.

B.I) has been terminated or laid off, or has received a notice of

termination or layoff, from employment as a result of anypermanent closure of, or any substantial layoff at, a plant, facility, orenterprise;

II) is employed at a facility at which the employer has made a generalannouncement that such facility will close within 180 days; or

III) for purposes of eligibility to receive services other than trainingservices described in section 134 (c) (3), Career Service describedin section 134 (c)(2)(A)(xii), or supportive services, is employed at afacility at which the employer has made a general announcement

that such facility will close;

C. Was self-employed (including employment as a farmer, a rancher, or afisherman) but is unemployed as a result of general economic conditionsin the community in which the individual resides or because of naturaldisasters;

D. Is a displaced homemaker; or

E.1) Is a the spouse of a member of the Armed Forces on active duty

and who has experienced a loss of employment as a direct result ofrelocation to accommodate a permanent change in duty station ofsuch member; or

2) Is the spouse of a member of the Armed Forces on active duty andwho meets the criteria described in paragraph (16) (B).

J. Performance MeasuresWIA Section 116 establishes performance accountability measures that applyacross the core programs to assess the effectiveness of States and local areas inachieving positive outcomes for individuals served by those programs.

The following formulas have been developed by the U.S. Department of Labor,where “registration” means entry into the program, and “exit” means leaving theprogram. At the present time, the State of Arizona has proposed the followingperformance measures with Yuma County.

Adults(i) The percentages of program participants who are in unsubsidized

employment during the second quarter after exit from the program;

(ii) The percentage of program participants who are in unsubsidizedemployment during the fourth quarter after exit from the program;

(iii) The median earning of program participants who are in unsubsidizedemployment during the second quarter after exit from the program;

(iv) The percentages of program participants who obtain a recognizedpostsecondary credential, or a secondary school diploma or itsrecognized equivalent (subject to clause (iii)), during participation in orwithin 1 year after exit from the program;

(v) The percentage of program participants who, during a program year arein an education or training program that leads to a recognizedpostsecondary credential or employment and who are achievingmeasurable skills gains toward such a credential or employment.

SECTION TWO – Proposal Categories

Proposer may propose to serve Adults, Dislocated Workers, or both. Proposermay propose to serve participants in any or all of the following categories.Individual Proposals will be required for each of the categories.

Adults:Adult Basic Education/General Equivalency Diploma Preparation andPrevocational Services.YPIC will case manage the files. $30,000.00

Adults:Full Services: Career Services, Training Services and Follow Up Services.(tied to performance) $175,000.00

Dislocated Workers:Adult Basic Education/General Equivalency Diploma Preparation andPrevocational Services.YPIC will case manage the files. $15,000.00

Full Services: Career Services and Follow-Up Services. $179,000.00(tied to performance)

Total funds: $399,000.00

A. Career Services: Public Law 113-128 Section 134 (2)

Career Services shall be provided to Adults and Dislocated Workers through theOne-Stop delivery system and shall, at a minimum, include:

1. Determinations of whether the individuals are eligible to receiveassistance under this subtitle;

2. Outreach, intake (which may include worker profiling), and orientationto the information and other services available through the One-Stopdeliver system;

3. Initiate assessment of skills levels (including literacy, numeracy, andEnglish language proficiency), aptitudes, abilities (including skillsgaps), and supportive service needs;

4. Labor exchange services.

Delivery of Services: The career services described in subparagraph (A) shall beprovided through the One-Stop delivery system –

directly through the one-stop operators identified pursuant to Public Law No: 113-128 section 121 (d); or

Through contracts with service providers, which may include contracts withpublic, private for profit, and private nonprofit service providers, approved by thelocal board.

B. Training Services: Public Law 113-128 Section 134 (3)

(A) Training Services shall be provided to Adults and Dislocated Workersrespectively:

1. Who, after an interview, evaluation or assessment, and careerplanning, have been determined by a One-Stop operator or One-Stoppartner as appropriate, to –

(aa) be unlikely or unable to obtain or retain employment, that leads toeconomic self-sufficiency or wages comparable to or higher thanwages from previous employment, through the career servicesdescribed in paragraph (2)(A)(xii);

(bb) be in need of training services to obtain or retain employment thatleads to economic self-sufficiency or wages comparable to orhigher than wages from previous employment; and

(cc) have the skills and qualifications to successfully participate in theselected program of training services;

2. Who select programs of training services that are directly linked to theemployment opportunities in the local area or the planning region, or in

another area to which the adults or dislocated workers are willing tocommute or relocate;

3. Who meet the requirements of subparagraph (B); and4. Who are determined to be eligible in accordance with the priority

system in effect under subparagraph (E).

(B) Qualification:(i) Requirement: Except as provided in clause (ii), provision of such

training services shall be limited to individuals who-(I) are unable to obtain other grant assistance for such services,

including Federal Pell Grants established under subpart 1 ofpart A of title IV of the Higher Education Act of 1965 (20 U.S.C.1070 et seq.); or

(II) require assistance beyond the assistance made available underother grant assistance programs, including Federal Pell Grants.

(ii) Reimbursements: Training services may be provided under thisparagraph to an individual who otherwise meets the requirements ofthis paragraph while an application for a Federal Pell Grant is pending,except that if such individual is subsequently awarded a Federal PellGrant, appropriate reimbursement shall be made to the local area fromsuch Federal Pell Grant.

(ii) Consideration: In determining whether an individual requiresassistance under clause (i)(II), a One-Stop operator (or One-Stoppartner, where appropriate) may take into consideration the full cost ofparticipating in training services, including the costs of dependent careand transportation, and other appropriate costs.

(C) Training Services:WIOA mandates that all Training which include services such as occupationaltraining, customized training, incumbent worker training, or be providedthrough the use of Individual Training Accounts (ITA) and that eligibleindividuals will receive ITAs through the One- Stop delivery system. The One-Stop system is the basic delivery system for adults and dislocated workersand the mechanism though which they will be provided an Individual TrainingAccount for payment of training from Eligible Training Providers. Allindividuals seeking training assistance will have received Career Services,and have been determined in need of training services.

For information relating to payment of ITA, refer to the YPIC’s SupportService Policy located at www.ypic.com

(D) Training Services may include:(i) Occupational Skills Training, including training for non-traditional

employment;(ii) On-the-job-training;

(iii) Incumbent worker training in accordance with subsection (d)(4);(iv) Program that combine workplace training with related instruction,

which may include cooperative education programs;(v) Training programs operated by the private sector;(vi) Skill upgrading and retraining;(vii) Entrepreneurial training;(viii) Transitional jobs in accordance with subsection (d)(5);(ix) *Job readiness training provided in combination with services

described in any of clauses (i) through (viii);(x) Adult education and literacy activities, including activities of English

language acquisition and integrated education and training programs,provided concurrently or in combination with services described in anyof clauses (i) through (vii); and

(xi) Customized training conducted with a commitment by an employer orgroup of employers to employ an individual upon successfulcompletion of the training.

*Note (ix): WIOA section 134 (3)(D) does recognize “job readiness training” as atraining service. Job readiness training provides, through career preparationlecture and role play, the development of the same set of skills andunderstanding to be acquired through work experience. It is generally offered aspre-vocational world-of-work skills that may include showing up on time, workplace attitudes and behaviors, and the like. Job readiness training usually doesnot include an associated work component, but it may.

(E) Priority Services:The following individuals are those other than low-income Adults and publicassistance recipients, who must be given priority by law:

1) Veterans2) Individuals with Disabilities3) Individuals with substantial language or cultural barriers;4) Offenders;5) Homeless individuals;6) Other hard-to-serve populations as defined by the Governor:

a) Older Workersb) Displaced Homemakersc) Individuals with multiple barriers to employmentd) Dropoutse) High school dropouts who do not function at the high

school level.

It is critical that the proposer identify and describe how the targeted population isdetermined in need of training, that the training is not provided by mandatedpartners, that the proposed training can and will benefit the participant, and thatthe training will assist YPIC in meeting its performance measures. Training shallbe directly linked to occupations in high demand in the local area.

On November 10, 2009 U.S. Department of Labor issued Training andEmployment Guidance Letter No. 10-09. The purpose of this Training andEmployment Guidance Letter (TEGL) is to provide information to assist andsupport those agencies and other grantees that receive funds from theDepartment to operate qualified job training programs in the implementation ofthe Priority of Service for Veterans’ Employment and Training Service(VETS).

(f) Customized Training and On-The-Job Training Definitions

Customized Training:The term “customized training” means training –

(A) that is designed to meet the specific requirements of an employer(including a group of employers);

(B) that is conducted with a commitment by the employer to employ anindividual upon successful completion of the training; and

(C) for which the employer pays-(i) a significant portion of the cost of training, as determined by the

local board involved, taking into account the size of the employerand such other factors as the local board determines to beappropriate, which may include the number of employeesparticipating in training, wage and benefits levels of thoseemployees (at present and anticipated upon completion of thetraining), relation of the training to the competitiveness of aparticipant, and other employer-provided training and advancementopportunities; and

(ii) in the case of customized training (as defined in subparagraphs (A)and (B) involving an employer located in multiple local areas in theSate, a significant portion of the cost of the training, as determinedby the Governor of the State, taking into account the size of theemployer and such other factors as the Governor determines to beappropriate. (Public Law 113-128 Section 3 (14))

On-The-Job-Training (OJT):The term “on-the-job training” means training by an employer that is provided to apaid participant while engaged in productive work in a job that –

a. provides knowledge or skills essential to the full and adequateperformance of the job;

b. is made available through a program that provides reimbursement to theemployer of up to 50 percent of the wage rate of the participant, except asprovided in section 134(c)(3)(H), for the extraordinary costs of providingthe training and additional supervision related to the training; and

c. is limited in duration as appropriate to the occupation for which theparticipant is being trained, taking into account the content of the training,the prior work experience of the participant, and the service strategy of theparticipant, as appropriate. (Public Law 113-128 Section 3 (44))

OJT Contracts may be written only for permanent positions and must be for fulltime. Maximum training time will not exceed 1040 hours and will notexceed six months, unless the contract is modified due to the actual traininghours not being completed within a six month period. The new employer has thefull hiring decision and is encouraged to keep the new employee working on apermanent basis after completion of the OJT to ensure compliance with the OJTagreement.

(g) Certificate:A certificate is awarded in recognition of an individual’s attainment of measurabletechnical or occupational skills necessary to gain employment or advance withinan occupation. These technical or occupational skills are based on standardsdeveloped or endorsed by employers. Certificates awarded by workforceinvestment boards or awarded recognition of the attainment of only genericpre-employment or work readiness skills are not included in this definition.A certificate is awarded in recognition of an individual’s attainment of technical oroccupational skills by:

A state educational agency or a state agency responsible foradministering vocational and technical education within a state.

An institution of higher education described in Section 102 of the HigherEducation Act (20 USC 1002) that is qualified to participate in the studentfinancial assistance programs authorized by Title IV of that Act. Thisincludes community colleges, proprietary schools, and all other institutionsof higher education that are eligible to participate in federal studentfinancial aid programs.

A professional, industry, or employer organization (e.g. National Institutefor Automotive Service Excellence certification, National Institute forMetalworking Skills, Inc., Machining Level I credential) or a productmanufacturer or developer (e.g. Microsoft Certified DatabaseAdministrator, Certified Novell Engineer, Sun Certified Java Programmer)using a valid and reliable assessment of an individual’s knowledge, skills,and abilities.

A registered apprenticeship program. A public regulatory agency, upon an individual’s fulfillment of educational,

work experience, or skill requirements that are legally necessary for anindividual to use an occupational or professional title or to practice anoccupation or profession (e.g. FAA aviation mechanic certification, statecertified asbestos inspector).

A program that has been approved by the Department of Veterans Affairsto offer education benefits to veterans and other eligible persons.

Job Corps centers that issue certificates. An institution of higher education which is formally controlled, or has been

formally sanctioned, or chartered, by the governing body of an Indian tribeor tribes.

Certificates and degrees must be documented in the Arizona Job Connection(AJC) system. Documentation in participant files should include either a copy ofthe certificate or degree, school transcripts, letter from the school or ArizonaDepartment of Education. In addition to a copy of one of the above, case notesin either AJC or the participant file must document the attainment of the degreeor certificate. (WIA Guidance Letter #14-06)

SECTION THREE – PROPOSAL INSTRUCTIONS

A. Instructions to Proposers:(i) Complete the Cover Page form provided in this Section. The cover

page does not count against the narrative page limit.(ii) Write a proposal narrative that –

1. Responds to the questions in Section Three – Narrative:Scope of Work.

2. Responds to the questions in Section Four – Narrative:Agency Capacity.

The proposal narrative may not exceed 20 pages. Responsesshould be typed in 12-point font, with one-inch margins, and doublespaced.

(iii) Complete required budget form for each of the proposals, each witha budget detail. The budget form and budget detail do not countagainst the 20-page limit.

(iv) Provide the required and any other supplementary items describedin Section Six in a separate appendix. The appendix does notcount against the 20-page limit. However, items included in theappendix may or may not receive consideration in evaluating yourproposal.

(v) If the proposer will be providing training (Other than OJT orCustomized), the proposer will need to provide documentation thatit is listed on the State of Arizona’s Eligible Training Provider List; orcomplete an application for certification as an Eligible TrainingProvider for the State of Arizona. Applications are available on theArizona Department of Education’s web site atwww.azjobconnection.gov under the title of Provider Applications.

(vi) Provide a table of contents for the entire proposal. The table ofcontents does not count against the 20-page limit.

(vii) Submit one original and five (5) copies of the entire proposal andappendix. (The audit can be included only in the original)

(viii) Each copy should be clipped together. Please do notstaple your proposal copies. Please submit an electronic copy ofthe proposal in a thumb drive.

Cite recent, specific projects or programs, the year(s) they were funded and thefunding source. Provide relevant statistics for each project on numbers served,services provided, and the outcomes achieved. In particular, cite past experiencemeeting quantitative performance benchmarks similar to those established byWIOA. State results from any recent customer satisfaction evaluations from bothparticipants and employers for similar services.

B. Agency ExpertiseExplain how the proposed program will be managed. Describe staffing and staffroles, including staff for One Stop participation. SECTION EIGHT: FILE COMPLIANCE

The Yuma Private Industry Council will: Provide the selected provider(s) with technical assistance on YPIC and AJC

The selected proposer (Service Provider) of Full Services (Career Services, TrainingServices, and Follow-Up Services) will:

Maintain all aspects of file compliance such as: data entry and maintenance ofdata in the YPIC and Arizona Job Connection (AJC) system.

Develop an Individual Employment Plan (IEP) for each participant. Conduct case management from enrollment time of participants until the exit of

participants from the program, as applicable. Proposers will provide follow up for 12 months after the participant exited the

program, as applicable.

B. Contract Award ProcessFunding recommendations shall be made by the Proposal Review Committee.

The Proposal Review Committee may require the proposers selected to participatein negotiations, and to make revisions on the proposal as needed.

The Workforce Investment Board (WIB) will review the recommendations made bythe Proposal review Committee, the WIB will make the final selection, and awardcontracts.

YPIC shall hold all proposals submitted in confidence pending completion of awardsand negotiations. Following award, contracts and proposals shall be available to thepublic.

Funding of any and all proposals is subject to fund availability and level of fundingby the US Department of Labor. This RFP does not commit Yuma Private IndustryCouncil, Inc. to award a contract, to pay any costs for preparation of proposals, orto procure or contract for services.

The Yuma County Workforce Investment Area reserves the right to:

(i) Renew contract(s) up to five years, for the period July 1, 2015 to June30, 2020 without re-issuing an RFP.

(ii) Award local monies from Yuma County and the State of Arizona tosubcontractors receiving funding under this RFP.

(iii) Accept or reject any or all of the proposals received and to cancel in partor in its entirety this request if it is in the best interest of the WIB to do so.

(iv) Make no fund award in any advertised proposal category.

(v) Negotiate necessary adjustments in proposed funding levels andprogram activities.

(vi) Fund agencies outside the order of rating recommendations.

(vii) Direct subcontractors to implement changes in accordance with Statedirectives made to comply with the Workforce Innovation andOpportunity Act and applicable regulations.

Funding AllocationYuma County’s WIB, operated by the Yuma Private Industry Council, Inc. (YPIC) isadvertising for services with $205,000 as a planning figure for adult funding and$194,000 as a planning figure for dislocated worker funding. Initial funding awardsmay be increased or decreased if funding or priorities change. Additional awardsthrough this process may be made if other workforce funding becomes available.

C. AppealsAny person wishing to appeal any decision made must follow the appeal process asestablished by Yuma County Local Workforce Investment Board.

Appeals may be made only for an alleged violation of the proposal review processwhich resulted in discrimination or does not meet the procurement requirements ofWIOA.

Appeals must be submitted in writing. When an appeal is made, the AppealsCommittee can make the following recommendations:

(i) There was compliance with applicable procedural requirements.

(ii) Any deviation from applicable requirements was not substantive and didnot significantly affect the results. A recommendation of changes to beadopted for future RFP review process is in order.

(iii) There was a deviation from applicable procedural requirements whichmay have materially affected the outcome. Committee may recommendre-review or other appropriate remedy. The recommendation may bemade to the Proposal Review Committee.

D. Procurement ProcessThe Yuma County LWIA/AE procurement process complies with:

(i) Subject to the provisions of Sections 122 and 184 of the WorkforceInnovation and Opportunity Act, recipients and sub-recipients shalladminister procurement systems that reflect applicable State and locallaws, rules and regulations as determined by the Governor.

(ii) Purchases of contractual services by the Yuma Private Industry Council,Inc., Workforce Investment Board shall be based on competitive bidswhere appropriate. The content and issuance of invitations andspecifications, and basis of awards and rejection of bids shall complywith ARS Section 11-254.01.

(iii) The WIB reserves the right to reject the bid/proposal response of anypersons or corporations who have previously defaulted on any contractwith Yuma County or who have engaged in conduct that constitutes acause for debarment or suspension.

(iv) Per 41 CFR Part 29-70.216-7, "Recipient Code of Conduct". Contractorsand subcontractors shall avoid conflicts of interest, real or apparent byobserving the following requirements:No officer, employee, or agent shall –

1. Solicit or accept gratuities, favors, or anything of monetaryvalue from suppliers or potential suppliers, includingsubcontractors under recipient contracts; or

2. Participate in the selection, award, or administration ofprocurement supported by Department of Labor (DOL) fundswhere, to the individual's knowledge, any of the following hasa financial or other substantive interest in any organizationwhich may be considered for award:

the officer, employee, or agent; any member of his or her immediate family; his or her partner; or a person or organization which employs, or is

about to employ any of the above.

3. Violate any State or Federal conflict of interest law orregulation.

E. Standards For Financial Management and Participant DataSystems and Other Requirements

(i) General. The financial management system and the participant datasystem of each contractor and subcontractor shall provide federallyrequired records and reports that are uniform in definition, accessible toauthorized Federal and State staff, and verifiable for monitoring,reporting, audit, program management, and evaluation purposes(Workforce Innovation and Opportunity Act Subtitle E).

An awarding agency may review the adequacy of the financialmanagement system and participant data system of anycontractor/subcontractor as part of a pre-award review or at any timesubsequent to award.

(ii) Financial Systems. Contractors and subcontractors shall insure that theirown financial systems as well as those of their subcontractors providefiscal control and accounting procedures that meet the followingminimum standards, as well as comply with Workforce Innovation andOpportunity Act Section. 185:

1. In accordance with generally accepted accounting principles,financial systems shall include: Information pertaining to subcontract and contract awards,

obligations, un-obligated balances, assets, expenditures, andincome;

Effective internal controls to safeguard assets and assure theirproper use;

A comparison of actual expenditures with budgeted amountsfor each subcontract and contract;

Source documentation to support accounting records; and Proper charging of costs and cost allocation; and

2. Financial systems shall be sufficient to: Permit preparation of required reports; Permit the tracing of funds to a level of expenditure adequate

to establish that funds have not been used in violation of theapplicable restrictions on the use of such funds;

As required by Workforce Innovation and Opportunity ActSection 185, permit the tracing of program income, potentialstand-in costs and other funds that are allowable except forfunding limitations as defined in 20 CFR 667 of this Part,Audits; and

(iii) Applicant and Participant Data Systems. Each contractor andsubcontractor shall ensure that records are maintained in the StateArizona Job Connection MIS System:

1. Of each participant's enrollment in a Workforce Innovation andOpportunity Act funded program in sufficient detail to demonstratecompliance with the relevant eligibility criteria attending a particularactivity and with the restrictions on the provision and duration ofservices and specific activities imposed by the Act; and

2. Of such participant information to develop and measure theachievement of performance standards established by theSecretary.

(iv) Insurance: Each contractor and subcontractor shall obtain and maintainat its own expense, during the entire term of this Contract the followingtype(s) and amounts of insurance: (Yuma County and YPIC, Inc shallbe listed as an also insured on all policies)

General Aggregate- $2,000,000 Products – Completed Operations Aggregate - $1,000,000 Personal and Advertising Injury - $1,000,000 Blanket Contractual Liability – Written and oral $1,000,000 Fire Legal Liability $ 50,000 Each Occurrence $1,000,000

Insurance must be from carriers acceptable to Yuma County.Contractors and subcontractors shall provide the WIB with certificatesof insurance. Commercial General Liability shall name Yuma Countyas an "Additional Insured". All certificates must provide for a 30-dayadvance notice of any modification, material change, non-renewal orcancellation. In addition evidence of statutory workers' compensationmust be provided.

The policy shall be endorsed to include the following additional insuredlanguage: “The State of Arizona and the Department of EconomicSecurity shall be named as additional insured with respect to liability

arising out of the activities performed by or on behalf of theContractor”.

Automobile LiabilityBodily injury and Property Damage for any owned, hired, and/or non-ownedvehicles used in the performance of this Contract.Combined Single Limit (CSL) - $1,000,000a) The policy shall be endorsed to include the following additional insuredlanguage; “The State of Arizona and the Department pf Economic Security(YUMA County and YPIC, Inc.) shall be named as additionally insured withrespect to liability arising out of the activities performed by or on behalf of theContractor, involving automobiles owned, leased, hired or borrowed by theContractor”.

b) This requirement shall not apply to: Separately, each contractor orsubcontractor exempt under A.R.S. 23-901, and when suchcontractor or subcontractor executes the appropriate waiver (Soleproprietor – subcontractor executes the appropriate waiver (SoleProprietor- Independent Contractor) form.

(v) Regulations and Cost Principles: In addition, each contractor andsubcontractor must comply, if and to the extent applicable, with thefollowing regulations and cost principles, including any subsequentamendments:

F. Compliance With LawsContractors and subcontractors shall comply with all federal, state, and locallaws, rules, regulations, standards and Executive Orders, including but not limitedto:

Any such applicable legal authority, including but not limited to the provisions of theWorkforce Innovation and Opportunity Act of 2014 (WIOA) and regulations adoptedunder the act, shall be incorporated into the agreement by reference and, to the extentinconsistent with any provision of this RFP or the contract, shall supersede and besubstituted for the inconsistent contractual provision.

SECTION TEN: PROPOSAL EVALUATION CRITERIA

Each Proposal will be scored independently by each rater on the point scale indicatedbelow. Raters will use documents listed in Section One, G., to help them apply thecriteria stated below to each proposal. Committee members are encouraged to makecomments when rating each proposal. Individual rating forms will be available uponrequest of proposers after the contracting process has been completed. These areintended to assist proposers in determining their areas of strength and weakness inresponding to the RFP. Individual ranking forms identifying Proposal Review Committeemembers by number, not by name, will be distributed upon request.
