SUBJECT: Revisions to Southern California Edison’s Interruptible Load Program Tariffs and Filed Forms for Large Industrial, Commercial, and Agricultural Customers, and Automatic PowerShift Program Tariffs for Residential and Commercial Customers

Southern California Edison Company (SCE) hereby submits for filing the proposed changes to its interruptible and air conditioner cycling program (ACCP) tariff schedules and filed forms that are listed on Attachment A and are attached hereto.

PURPOSE

In this advice filing, SCE proposes to revise language that addresses notices of interruption in Schedules I-6, TOU-8-SOP-I, AP-I, TOU-PA-SOP-I, RTP-2-I, I-6-BIP and filed form 14-256, Contract for Interruptible Service, Agricultural and Pumping. SCE also proposes to revise language in the Cycling Period provision contained in Schedules D-APS, D-APS-E, GS-APS, and GS-APS-E. These tariff revisions are necessary for consistency among similar tariffs and to clarify the circumstances under which SCE will implement load reductions upon notice from the California Independent System Operator (ISO).

BACKGROUND

Beginning in1998, the ISO became responsible for determining when load reductions in SCE’s service territory were needed. This was the result of the implementation of the ISO’s day-to-day control of SCE’s transmission grid, as well as the ISO’s ability to measure loads and generating resource needs.

Although the ISO is expected to notify SCE of its intention to implement load reductions affecting SCE’s Interruptible and Automatic PowerShift (APS) programs, when operating reserves are expected to fall below five percent through the next forecasted hour, this is not the only circumstance in which the ISO can initiate or has initiated load reductions. For instance, there have

been emergencies in which the ISO has notified SCE to reduce load immediately due to transmission constraints or other factors. SCE’s Interruptible and APS tariffs differ in describing the circumstances in which these programs will be activated. However, all are intended to be used to help avoid firm load curtailments upon notification from the ISO of any system emergency.

The specific reasons for the ISO’s need to reduce load may vary and the ISO may not provide or be able to provide an immediate explanation of the specific reason why load must be reduced during an emergency. As such, SCE’s Interruptible and APS tariffs must allow SCE to activate these programs upon the ISO’s notification of the need to reduce load in SCE’s service territory, regardless of the underlying cause of the emergency.

Given the different language presently used among the various Interruptible and APS tariffs in respect to the Notice of Interruption provision and the Cycling Period provision, SCE proposes to revise and to clarify these provisions. Similar clarifying language is proposed for filed form 14-256, Contract for Interruptible Service, Agricultural and Pumping. As described below, after the various revisions are complete, each of the Interruptible and APS tariffs will have consistent language concerning the Notice of Interruption and Cycling Period, which will read: “Upon notification to SCE from the Independent System Operator (ISO) of the need to implement load reductions in SCE’s service territory, a [notice of interruption/cycling period] can be [given/activated] under this Schedule.”

TARRIF REVISIONS

• For Schedules I-6, TOU-8-SOP-I, AP-I, TOU-PA-SOP-I, and RTP-2-I, delete the following text: “The ISO is expected to direct SCE to curtail specific amounts of load (up to the full capability of the interruptible program) sufficient to maintain operating reserves above the five percent level through the next forecasted hour” in the Notice of Interruption provision, and replace with the language cited immediately above. The use of a single example in the notice provision may inadvertently imply that it is the only circumstance in which the ISO calls for load reductions.

• For Schedules I-6, TOU-8-SOP-I, AP-I, TOU-PA-SOP-I, and RTP-2-I, delete the word “Maximum” and lower case the word “Demand” in the last sentence in the Notice of Interruption provision.

• For Schedule I-6-BIP, add the text “of the need to implement load reductions in SCE’s service territory” such that the first sentence of the Notice of Interruption provision will read: “Upon notification to SCE from the Independent System Operator (ISO) of the need to implement load reductions in SCE’s service territory, a Notice of Interruption can be given under this Schedule.” This change is needed for consistency among the interruptible tariffs and because the current language does not specify that the notice must be to reduce load in SCE’s service territory.

• Filed form 14-256, Contract for Interruptible Service, Agricultural and Pumping, delete from section 5(a) the text “SCE shall initiate Interruption under this schedule when the

Independent System Operator (ISO) directs SCE to curtail specific amounts of load (up to the full capacity of the Interruptible program) sufficient to maintain operating reserves above the five percent level through the next forecasted hour,” and replace with “Upon notification to SCE from the Independent System Operator (ISO) of the need to implement load reductions in SCE’s service territory, a notice of interruption can be given under this Schedule.”

• For Schedules D-APS, D-APS-E, GS-APS, and GS-APS-E, revise the provision Cycling Period, eliminating all specific references as to when the ISO can direct SCE to activate a Cycling Period and replace with language that states “Upon notification to SCE from the Independent System Operator (ISO) of the need to implement load reductions in SCE’s service territory, a cycling period can be activated under this Schedule.”

All of the above proposed revisions are intended to provide clarity and consistency across all of the Interruptible and APS tariffs in accordance with the ISO’s notification practices and the intent that these programs be used to help avoid firm load curtailment. These revisions do not change the conditions under which these programs will be activated by SCE, nor the limitations on the maximum number or timing of interruption events.1

Although SCE believes it is important that the relevant tariff language be revised to provide consistency among these tariffs, these proposed revisions do not change how SCE will implement these programs upon receipt of an ISO notification for load reduction. Thus, unless the Commission directs SCE otherwise while this advice letter is under consideration, SCE intends to continue to activate the Interruptible and APS programs when the ISO provides notice to reduce load, regardless of the underlying reason for the load reduction, in the effort to avoid firm service load curtailments.

No cost information is required for this advice filing.

EFFECTIVE DATE

It is requested that this Filing become effective on the 40th calendar day after the dated filed, which is September 8, 2004.

1 The Enhanced APS program can be called an unlimited number of times during the summer, and thus, there is a

chance that the program could be called more times than if the program were limited only to instances of reserve margin issues or storm alerts, as the current language implies. However, because the ISO may order SCE to reduce load immediately and because the APS program is capable of immediate load reduction during an emergency (unlike the interruptible programs which require a 30-minute notice period before load will be reduced), it is important that the notification to reduce load for this tariff and the prior APS tariffs is the same as for the interruptible tariffs. If the Commission believes that the revision for the D-APS-E and GS-APS-E schedules constitutes a substantive change, SCE will provide these customers with notice under SCE Tariff Rule 12 of the revision so that these potentially affected customers can re-consider their participation in these programs.

SPECIAL CONDITIONS 1. Air Conditioning Cycling: Cycling will be accomplished utilizing the control device during

cycling periods as defined in Special Condition 5 to disconnect the air conditioning compressor for up to 15 minutes out of every 30 minutes for 50% cycling, or 20 minutes out of every 30 minutes for 67% cycling.

The control device will function at such times selected by SCE to disconnect the entire air conditioning system for 100% cycling. 2. Summer Season: The Summer Season shall commence at 12:00 a.m. on the first Sunday

in June and continue until 12:00 a.m. of the first Sunday in October of each year. 3. Control Device: SCE, at its own expense, will furnish, own, operate, and maintain the

control device installed by SCE at each customer's premises. 4. Term of Service: Service under this Schedule shall be for a minimum of one year from the

date on which service under this Schedule begins. 5. Cycling Period: A cycling period is one in which air conditioner service may be interrupted:

a. Upon notification to SCE from the Independent System Operator (ISO) of the need to implement load reductions in SCE’s service territory, a cycling period can be activated under this Schedule;

b. When a declaration by SCE of a Category One, Two, or Three Storm Alert exists

which may jeopardize the integrity of SCE’s distribution facilities;

c. For testing of the control device. Testing of the Control Device will only occur if SCE does not receive the desired load reduction results after an Air Conditioning Cycling event. Testing of the Control Device will interrupt power to a customer’s air conditioner a maximum of 15 minutes. SCE will test during peak hours only once per summer season.

SPECIAL CONDITIONS 1. Maximum Demand: Maximum demands shall be established for the On-Peak, Mid-Peak, and

Off-Peak Time Periods. The maximum demand for each period shall be the measured maximum average kilowatt input indicated or recorded by instruments , during any 15-minute metered interval in the month. Where the demand is intermittent or subject to violent fluctuations, a 5-minute interval may be used.

2. Interruptible Load: The Interruptible Load is the estimated increment of the customer's

Maximum Demand that normally occurs above the Firm Service Level and, under normal operating conditions, would be the amount of load to be disconnected from SCE's lines within the specified time period following Notice of Interruption.

3. Firm Service Level: Firm Service Level is the Maximum Demand SCE is expected to supply

and/or deliver during any Period of Interruption. The Firm Service Level shall be specified by the customer. During a Period of Interruption, the customer is expected to interrupt load to its specified Firm Service Level. Increases or decreases in Firm Service Level may be made no more often than once per year, upon written request by the customer between November 1 and December 1 and execution of an Amendment To Contract For Interruptible Service (Form 14-332). Customers served under this Schedule shall establish a Firm Service Level of zero or greater.

4. Interruptible Demand and Energy: Interruptible Demand is all kW of Maximum Demand in

excess of the Firm Service Level. Interruptible Energy is the number of kWh in each Time Period which exceeds the product of the Firm Service Level kW multiplied by the total number of hours in the Time Period.

5. Notice of Interruption: Upon notification to SCE from the Independent System Operator (ISO)

of the need to implement load reductions in SCE’s service territory, a Notice of Interruption can be given under this Schedule. SCE shall notify the customer to reduce the demand imposed on the electric system to the Firm Service Level. Upon receipt by a customer of a Notice of Interruption from SCE, the customer shall reduce the demand imposed on the electric system to the Firm Service Level within 30 minutes.

6. Period of Interruption: A Period of Interruption is a time interval which commences thirty

minutes after Notice of Interruption and which ends upon notification by SCE of the end of Period of Interruption.

of the need to implement load reductions in SCE’s service territory, a Notice of Interruption can be given under this Schedule. SCE shall notify the customer to reduce the demand imposed on the electric system to the Firm Service Level. Upon receipt by a customer of a Notice of Interruption from SCE, the customer shall reduce the demand imposed on the electric system to the Firm Service Level within 30 minutes.

4. Period of Interruption: A Period of Interruption is a time interval which commences thirty

minutes after Notice of Interruption and which ends upon notification by SCE of the end of Period of Interruption.

5. Excess Energy: The number of kWh consumed in a Period of Interruption which exceeds the

product of the Firm Service Level kW multiplied by the total number of hours of Interruption, shall be considered Excess Energy.

6. Charges for Excess Energy: For each Period of Interruption during which the customer fails

to interrupt and hence incurs Excess Energy, a $6.00 per kWh penalty shall be added to the customer's billing as otherwise provided in this Schedule.

7. Required Metering and Communication Equipment: Metering and Communication

equipment, as specified by SCE, will be installed, owned, and maintained in accordance with SCE specifications, including such facilities not located on the customer's property. These facilities will be solely under operational control of SCE unless otherwise specified by SCE. If required, SCE will provide and install metering equipment at no charge to the customer. However, a customer receiving metering equipment at no charge who terminates service under this Schedule for any reason before one full year, shall pay back to SCE the costs associated with the installation and maintenance of the metering equipment.

8. Contracts: A contract is required for service under this Schedule. To be served under this

Schedule, eligible customers shall comply with all provisions of the contract within 30 days of contract execution. Customers shall have a one month window each year between November 1 and December 1, to provide written notice to SCE to terminate service or to increase or decrease their Firm Service Level under this Schedule. Additionally, during this one month window, a customer receiving service concurrently under both this Schedule and under Schedule I-6 may select which Schedule under which it shall receive service during the following year. If no selection is made, service will be terminated under this Schedule and the customer will continue to receive service under Schedule I-6 as of January 1 of the next calendar year. However, a customer receiving metering equipment at no charge as defined in Special Condition 7, must remain on this Schedule for one full year. Customers shall not be permitted to prematurely terminate service hereunder for reasons that changes in electrical demand requirements may otherwise preclude them from taking service under this Schedule.

SPECIAL CONDITIONS 1. Interruptible Load: The Interruptible Load is the estimated increment of the customer's

Maximum Demand that normally occurs above the Firm Service Level and, under normal operating conditions, would be the amount of load to be disconnected from SCE’s lines within the specified time period following Notice of Interruption.

2. Firm Service Level: Firm Service Level is the Maximum Demand SCE is expected to supply

and/or deliver during any Period of Interruption. The Firm Service Level shall be specified by the customer. During a Period of Interruption, the customer is expected to interrupt load to its specified Firm Service Level. Increases or decreases in Firm Service Level may be made no more often than once per year, upon written request by the customer between November 1 and December 1 and execution of an Amendment To Contract For Interruptible Service (Form 14-332). Customers served under this Schedule shall establish a Firm Service Level of zero or greater.

3. Interruptible Energy: Interruptible Energy is the number of kWh in each hour which exceeds

the product of the Firm Service Level kW multiplied by one hour. 4. Voltage Discount: The sum of the hourly Distribution and URG Generation charges will be

reduced by 4.3% for service delivered and metered at voltages of 2 kV through 50 kV, and reduced by 17.4% for service delivered and metered at voltages above 50 kV.

5. The daily maximum temperature at its Los Angeles Downtown site, as recorded by the

National Weather Service, will be used to determine the hourly rates for the following day according to the RTP-2-I rate schedule. It is the customer's responsibility to acquire the daily maximum temperature at its Los Angeles Downtown site. SCE will not provide this information.

6. Notice of Interruption: Upon notification to SCE from the Independent System Operator (ISO)

of the need to implement load reductions in SCE’s service territory, a Notice of Interruption can be given under this Schedule. SCE shall notify the customer to reduce the demand imposed on the electric system to the Firm Service Level. Upon receipt by a customer of a Notice of Interruption from SCE, the customer shall reduce the demand imposed on the electric system to the Firm Service Level within 30 minutes.

7. Period of Interruption: A Period of Interruption is a time interval which commences thirty minutes

after Notice of Interruption and which ends upon notification by the Company of the end of Period of Interruption.

APPLICABILITY Applicable to customers with a measured demand of 50 kW or greater, or with a connected load of 50 horsepower or greater who are served under an Agricultural and Pumping rate schedule, and who elect to provide Interruptible Load automatically. However, this Schedule is not applicable to customers receiving the Off-Peak Credit provided under Schedule PA-1 or to customers served under experimental rate schedules. As of June 7, 1992, this Schedule is closed to customers taking service under Schedule TOU-PA-SOP. In addition, as of January 1, 1993, this Schedule is not applicable to Schedule TOU-PA-SOP customers. Service under this Schedule is subject to the availability of a control device and may not be available in certain areas of SCE's service territory where communication signaling equipment has not been installed or signal strength is inadequate to activate or deactivate interruption. This Schedule is in effect until modified or terminated in the rate design phase of SCE’s next general rate case or similar proceeding. TERRITORY

RATES

All charges and provisions of the customer’s otherwise applicable tariff (OAT) shall apply and the billing determined under the customer’s OAT will be credited $0.00827 per kWh per month. SPECIAL CONDITIONS 1. Maximum Demand: Maximum demands shall be established for the On-Peak, Mid-Peak, and

Super Off-Peak Time Periods. The maximum demand for each period shall be the measured maximum average kilowatt input indicated or recorded by instruments, during any 15-minute metered interval in the month. Where the demand is intermittent or subject to violent fluctuations, a 5-minute interval may be used.

2. Interruptible Load: The Interruptible Load is the estimated increment of the customer's

one (1) per day, four (4) in any calendar week, and 25 times per calendar year. The duration of the Periods of Interruption will not exceed 6 hours each, 40 hours per calendar month, and total of 150 hours per calendar year.*

5. Ownership and Control of Facilities: Communication, metering, and interrupting facilities, as

specified by SCE, will be installed, owned, and maintained in accordance with SCE specifications at customer's expense, including such facilities not located on the customer's property. These facilities will be solely under operational control of SCE unless otherwise specified by SCE.

Such communications and interrupting facilities may include, but will not be limited to, the following:

CONTRACT FOR INTERRUPTIBLE SERVICE Agricultural and Pumping

SOUTHERN CALIFORNIA EDISON COMPANY ("SCE") hereby agrees to provide interruptible electric service to ______________________________________________________________________________________________ ("Customer"), located at __________________________________________________________________________________________ for Account Number __________________________________________ under Schedule _________________ as this schedule now exists or may hereafter be amended or superseded, a copy of which is attached hereto and by this reference incorporated herein. SCE and Customer agree as follows: 1. EQUIPMENT: SCE shall provide automatic disconnection and notification equipment at Customer's expense. Customer agrees

to provide, at Customer's service address, an appropriate location and electric power source for SCE's equipment. SCE shall have sole access to this equipment. SCE shall own, operate, and maintain the equipment at Customer's expense.

2. COMMUNICATION CHARGE: Customer shall pay any charges associated with SCE's providing communication service for the

purpose of notifying Customer and monitoring Customer's electric service. 3. COMMUNICATION AND EQUIPMENT CHARGE: Section 3.1 is applicable if customer is newly requesting interruptible service

for the above location. Section 3.2 is applicable only if customer is receiving interruptible service at another location but is moving customer's entire operation to the above location and will continue interruptible service.

3.1 Customer is newly requesting interruptible service and shall pay an estimated, nonrefundable charge calculated in

accordance with SCE's Rule 2, Section H (Added Facilities) as follows: For SCE's central facilities and equipment installed at Customer's location which includes an Income Tax Component of Contributions $ For ongoing costs of ownership $ TOTAL $ The above estimates are subject to adjustment based on the recorded total installed cost. 3.2 Customer is an existing interruptible service customer who is moving operations from another SCE service location and

is signing this Contract for Interruptible Service ("Contract") in order to continue interruptible service at the above location, and shall:

a) Pay a non-refundable charge of $ for the relocation of SCE's central facilities and equipment from

Customer's previous SCE service location to the service location specified in this Contract; and b) Continue interruptible service under conditions which are (in SCE's sole opinion) substantially the same as

those served under Customer's Contract for Interruptible Service for the previous service location. 4. Service under Schedule and the applicable interruptible credits shall not commence until the next regular meter reading

following the installation of SCE's equipment at the Customer's location and the Customer's compliance with Section 3.1 or 3.2 if applicable.

5. PERIODS OF INTERRUPTION: (a) INITIATION: Upon notification to SCE from the Independent System Operator (ISO) of the need to implement load

reductions in SCE’s service territory, an interruption may be initiated. Advance notice of interruption will not be given by SCE.

(b) TERMINATION OF INTERRUPTION PERIOD: SCE shall terminate a Period of Interruption when the ISO determines

that the system conditions necessitating the Period of Interruption have ended. Customer must manually restart the interrupted equipment.

6. RULE 14: Notwithstanding the above provisions, SCE cannot guarantee that interruptions may not occur during any period as a

result of situations or circumstances beyond the control of SCE as contemplated in Rule 14 of SCE's Tariff Schedules. 7. INDEMNITY: Customer shall defend at its own cost and indemnify and hold harmless SCE, its officers, agents, employees,

assigns, and successors in interest from and against any and all liability (including liability based upon negligence and liability without fault), damages, costs, losses, claims, demands, actions, causes of action, attorneys' fees and expenses, or any of them, resulting from the death or injury to any person or damage to any property, including the property and/or personnel of SCE, to the extent caused by SCE initiating a Period of Interruption and/or by Customer's electric service being disconnected or reconnected by SCE and/or Customer pursuant thereto.

8. ENTIRE CONTRACT: This Contract constitutes the sole, only, and entire agreement and understanding between the Parties as

to the subject matter of this Contract. Prior agreements, commitments or representations, whether expressed or implied, and discussions between the Parties shall not be construed to be a part of this Contract unless contained herein.

9. NONWAIVER: The failure of either Party to enforce any of the terms and conditions or to exercise any right or privilege in this

Contract shall not be construed as a waiver of any such terms and conditions or rights or privileges and the same shall continue and remain in force and effect as if no such failure to enforce or exercise had occurred.

10. CALIFORNIA PUBLIC UTILITIES COMMISSION: (a) This Contract shall at all times be subject to such changes or modifications by the Public Utilities Commission of the

State of California as said Commission may, from time to time, direct in the exercise of its jurisdiction. (b) Notwithstanding any other provisions of this Contract, SCE shall have the right to unilaterally file with the Public Utilities

Commission of the State of California, pursuant to the Commission's rule and regulations, an application for a change in rates, charges, classification, or service, or any rule, regulation, or contract relating thereto.
