Extension of Pump Installation Permit for Well No. 5129-04 & 05
This is in response to your email dated April 16, 2011 requesting an extension for the completion date of the Waiale Wells 1 & 2 (Well No. 5129-04 & 05). Your request is approved. Your new completion date is June 8, 2012. All other conditions of your permit remain the same.
The original permit was issued in 2006. This is the third extension for the pump installation permit. If more time is needed beyond 2012, you may need to reapply or address the Commission.

The original well and pump permits were approved in 2006, running into December 2008. The well construction was completed on time, with time to spare for the pump installation. Like many other projects, yours was apparently delayed by economic conditions. There was a one-year extension for the pump installation, to December 8, 2009, and a second to extend it further (to June 8, 2011) approved January of this year (201 O). You therefore have another six months on existing approvals. If this is not sufficient to complete work and finish paperwork, it would be good to request additional time, and that request should come from the licensed contractor with the permit, Beylik Drilling and Pump Services (AC-21896).
By policy, we have extended permits a total of four years before taking the matter to the Commission for their further consideration, meaning we could conceivably approve extension of this permit through December 8,2012. You are advised to include paperwork time requirements in any request for an extension (through your contractor). If there are other permits about to expire before both installation work and the reporting requirements are complete, please have the contractor request sufficient time extension for all requirements.

Attached is the last extension letter for this well. The client has delayed this till now and will commence early next year. Can we extend it again to beyond the start of construction which is scheduled for January 2011? Please let me know if you need a formal extension request letter for us or the well owner.
BTW: If the pump contractor commences his work before the expiration date is it valid or should that date be extended to when the pump installation is complete? We got several PI permits which are delayed due to current economic conditions ..

The original intent had been to develop the well for dedication to the County in exchange for some water source credits for use at A&B Properties" development projects. Unfortunately, we were unable to work this out with the Maui DWS so we needed to pursue the well as a source for a private water system and this required that a second well be drilled (Wai'ale Well #2,5129-05). That well was permitted and drilled in 2009 and the Engineering Reports ("ER") for the two wells along with the Capacity Study and plans were submitted to DOH for their review and approval. The ERs were accepted as complete and the Capacity Study and plans are under review. When we have satisfied the DOH requirements and are provided the approval to construct, we hope to bid the project and begin work. We hope to begin the construction in 2010, but don't expect that the work will all be completed by the end of the year.

By way of this email weare requesting a one year extension for the pump installation permit for Wai'ali well #1, State well No. 5129-04 that expired in December 2009.
The development of the private water system that is owned by A&B Properties is moving forward and this permit is required to prepare plans and bid documents for the project.

We are hoping to move forward with our private water system develop plans for our Maui Business Park Phase II project utilizing the two Wai'ale Wells previously drilled. We noticed that the Pump Installation Permit for Well No. 5129-04 expired in December and would like to get an extension so that the permits will be in place as we seek plan approvals and prepare bid documents, etc. You sought and received one extension last year. Could you please request another extension?

Responses to the CWRM's Comments on the Engineering Report for Waiale Well 1 (State No. 5129-04) in Kahului, Maui
This letter responds to your comments dated July 29, 2009 regarding the Engineering Report
(ER) to certify Waiale Well 1 (State No. 5129-04) for drinking water use. Two comments were made and
each is addressed below.
Comment 1: We recommend coordination with the county to incorporate this project into the county's Water Use and Development Plan. Please contact the respective Planning Department and/or Department of Water Supply for further information.
The developer, A&B Properties, Inc., will coordinate with DWS and the Planning Department to add this
well and its recently completed Waiale Well 2 to the County's Water Use and Development Plan.
Comment 2: The estimated sustainable yield of the underlying Kahului Aquifer is 1 mgd; current pumpage was on the order of 25 mgd until January of this year, when it dropped to near zero. This level of pumpage (primarily for irrigation) toward the eastern aquifer boundary is presumably supported by sugar cane irrigation recharge. In addition, this project location is presumably supported by acknowledged "substantial leakage" from the Waiale Reservoir. Given potential loss of recharge at some point, natural sustainable yield cannot support pumping these wells at this level without incurring increased salinity.
There are seven identifiable sources of the Kahului Aquifer'S recharge: (1) underflow from Haleakala; (2)
underflow from the West Maui Mountain; (3) leakage from Waiale Reservoir; (4) agricultural irrigation
return flow on HC&S sugarcane fields; (5) local landscape irrigation return flow; (6) individual wastewater
disposal systems; and (7) local rainfall recharge. The CWRM's 1.0 MGD sustainable yield is based
exclusively on rainfall-recharge on the aquifer's 9.5-square mile area, among the least significant of its
sources of recharge. The aquifer also has the benefit of caprock protection from saltwater intrusion along
its north (Kahului Harbor) and south (Maalaea) shorelines. As a result, salinity levels are exceptionally
low for a thin basal lens.

Nevertheless, the long-term salinity of water pumped by Waiale Well 1 is a concern. If HC&S ceases
activities, its irrigation return component of recharge would be lost, but this would be offset by the
elimination of its pumpage from the aquifer. If increasing salinity does occur, remediation by
desalinization or the addition of other wells to better distribute pumpage may be required. A&S
Properties, Inc., developer of the well and water system, is aware of these possible consequences.

Thank you for the opportunity to review the subject document. The Commission on Water Resource Management (CWRM) is the agency responsible for administering the State Water Code (Code). Under the Code, all waters of the State are held in trust for the benefit of the citizens of the State, therefore, all water use is subject to legally protected water rights. CWRM strongly promotes the efficient use of Hawaii's water resources through conservation measures and appropriate resource management. For more information, please refer to the State Water Code, Chapter 174C, Hawaii Revised Statutes, and Hawaii Administrative Rules, Chapters 13-167 to 13-171. These documents are available via the Internet at http://www.hawaii.gov/dlnrlcwnn.
Our comments related to water resources are checked off below.
181 1. We recommend coordination with the county to incorporate this project into the county's Water Use and Development Plan. Please contact the respective Planning Department and/or Department of Water Supply for further information.
D 2. We recommend coordination with the Engineering Division of the State Department of Land and Natural Resources to incorporate this project into the State Water Projects Plan.
o 3. We recommend coordination with the Hawaii Department of Agriculture (HDOA) to incorporate the reclassification of agricuHural zoned land and the redistribution of agricultural resources into the State's Agricultural Water Use and Development Plan (AWUDP). Please contact the HDOA for more information.
o 4. We recommend that water efficient fixtures be installed and water efficient practices implemented throughout the development to reduce the increased demand on the area's freshwater resources. Reducing the water usage of a home or building may earn credit towards Leadership in Energy and Environmental Design (LEE D) certification. More information on LEED certification is available at http://www.usgbc.orglleed.Alisting of fixtures certified by the EPA as having high water efficiency can be found at http://www.epa.govlwatersense/pplindex.htm.
o 5. We recommend the use of best management practices (BMP) for stormwater management to minimize the impact of the project to the existing area's hydrology while maintaining on-site infiltration and preventing polluted runoff from storm events. This level of pumpage (primarily for irrigation) toward the eastern aquifer boundary is presumably supported by sugar cane irrigation recharge. In addition, this project location is presumably supported by acknowledged "substantial leakage" from the Waiale Reservoir. Given potential loss of recharge at some point, natural sustainable yield cannot support pumping these wells at this level without incurring increased salinity.

Thank you for the opportunity to review the subject document. The Commission on Water Resource Management (CWRM) is the agency responsible for administering the State Water Code (Code). Under the Code, all waters of the State are held in trust for the benefit of the citizens of the State, therefore, all water use is subject to legally protected water rights. CWRM strongly promotes the efficient use of Hawaii's water resources through conservation measures and appropriate resource management. This memo and its attachments present the results of final pump testing of Waiale Well No.1 in
Kahului. Pump testing was conducted on July 16 to 18, 2007. It consisted of an initial step-drawdown
test followed by a 48-hour constant rate test. The step test was done to define the well's hydraulic
capacity. The longer-term constant rate test was run to provide an indication of expectable salinity under
a continuous pumping stress. Both tests are also requirements of the Water Commission's Well
Construction permit.
Step-Drawdown Test Results
The step-drawdown test was run at four rates of pumping, starting at 340 GPM during the first
step and ending at 642 GPM during the last step. Eac~ rate was run for 30 minutes, during which time
the pumping rate was periodically measured and the water level response was recorded at i-minute
intervals. T~ese data are illustrated on Figure 1. Drawdown at the four rates of pumping and a curve
fitted to these data are tabulated below.

The performance points and fitted curve are depicted on Figure 2. For reference, similar results
for the open borehole pump test done on April 11, 2007 are also shown on the graph. The well's
hydraulic capacity is substantial. At 500 GPM, for example, the drawdown is just 0.4 feet.
Constant Rate Test Results
The 48-hour constant rate test was run at an average of 515 GPM. Measured pumping rates and
water level response throughout this test are illustrated on Figure 3. Of primary concern was the
water salinity. This was tracked in three ways: (1) measuring the specific conductance at 30-minute
intervals throughout the test using a HACH Sension 5 meter [Figure 4]; (2) recording the specific
conductance at 1-minute intervals with a Solinst LTC meter [Figure 5]; and (3) measuring the specific
conductance and testing the chloride concentration of samples collected at 3-hour intervals (Table 1).
The pumped water salinity remained well within the recommended limits for drinking water.
However, there was a small but measurable salinity increase throughout the test. Specific conductance
started at 632 jJS/cm and ended at 642 IJS/cm. Chlorides were 37 MG/L at the start and 41 MG/L at the
end. A stable salinity had not been achieved at the end of the test.
Summary Conclusions and Recommendations
1. The well's hydraulic capacity is excellent. In and of itself, this capacity poses no limit on the wei
production. Keeping the salinity at an acceptable level will be the limiting factor.
2. Including the more extensive water quality testing done during the April 11th open borehole pu
test, the results demonstrate that the well can produce potable quality water.
3. If the well is used for drinking water supply, the capacity of the installed pump should not exceed, .
450 GPM to ensure satlsfactory long-term salinity.
4. If the well is used for irrigation or other non-potable uses, ~ pump capacity up to 600 GPM could .
be utilized.

In accordance with Department of Land and Natural Resources, Commission on Water Resource Management's Administrative Rules, Section 13-168, entitled "Water Use, Wells, and Stream Diversion Works", this document permits the construction and testing of Waiale Well 2 (Well No. 5129-05) at TMK (2) 3-8-007:101, Maui, subject to the Hawaii Well Construction & Pump Installation Standards (HWCPIS - February 2004) which include but are not limited to the following conditions:

The Chail"Eerson of the Commission on Water Resource Management (Commission), P.O. Box 621, Honolulu, HI 96809, shall be notified, in writing, at least two (2) weeks before any work authorized by this permit commences and staff shall be allowed to inspect installation activities in accordance with § 13-168-15, Hawaii Administrative Rules (HAR).
This permit shall be prominently displayed, or made available, at the site of construction work until work is completed.
The well construction permit shall be for construction and testing of the well only. The permittee shall coordinate with the Chairperson and conduct a pumping test in accordance with the HWCPIS (the latest pump test worksheet can be obtained by contacting Commission staff or at www.hawaii.gov/dlnr/cwrmJresourcesJlermits.htm). The permittee shall submit to the Chairperson the test results as a basis for supporting an application to install a permanent pump. No permanent pump may be installed until a pump installation permit is approved and issued by the Chairperson. No wIthdrawal of water shall be made for purposes other ilian testing without a Certificate of Pump Installation Completion. The permitted pump capacity described on the pump installation permit may be reduced in the event that the pump test does not support the capacity.
In basal ground water, the depth of the well may not exceed one-fourth (1/4) of the theoretical thickness (41 times initial head) of the basal ground water unless otherwise authorized by the Chairperson. If it can be shown that the well does not tap basal ground water then this condition may be waived after consultation with and acceptance by Commission staff. However, in no instance can the well be drilled deeper than one-half (1/2) of the theoretical thickness without Commission approval.
The permittee shall incorporate mitigation measures to prevent construction debris from entering the aquatic environment, to schedule work to avoid periods of high rainfall, and to revegetate any cleared areas as soon as possible.
In the event that historically significant remains such as artifacts, burials or concentrations of shells or charcoal are encountered during construction, the permittee shall stop work and immediately contact the Department of Land and Natural Resources' State Historic Preservation DiVIsion. Work may recommence only after written concurrence by the State Histonc Preservation Division.
The proposed well construction shall not adversely affect existing or future legal uses of water in the area, including any surface water or established instream flow standards. This permit or the authorization to construct the well shall not constitute a determination of correlative water rights.
The Well Completion Report Part I shall be submitted to the Chairperson within sixty (60) days after completion of work (please contact staff or visit www.hawaii.gov/dlnr/cwrmJresources_permits.htm for current form).
The permittee shall comply with all applicable laws, rules, and ordinances; non-compliance may be grounds for revocation of this permit.
The well construction permit application and, if relevant, any related staff submittal approved by the Commission are incorporated into this permit by reference.
If the HWCPIS are not followed and as a consequence water is wasted or contaminated, a lien on the property may result.
Any variances from the HWCPIS shall be approved by the Chairperson prior to invoking the variance.
The work proposed in the well construction permit application shall be completed within two (2) years from the date of permit approval, unless otherwise specified. The permit may be extended by the Chairperson upon a showing of good cause and good-faith performance. A request to extend the permit shall be submitted to the Chairperson no later than the date the permit expires.
If the well is not to be used it must be proyerly capped. If the well is to be abandoned during the course of the project then the permittee must apply for a well abandonment permit in accordance with § 3-168-12(1), HAR, prior to any well sealing or plugging work.
The permittee, its successors, and assigns shall indemnifY, defend, and hold the State of Hawaii harmless from and against any loss, liability, claim, or demand for property damage, personal injury, or death arising out of any act or omission of the applicant, assigns, officers, employees, contractors, and agents under this permit or relating to or connected with the granting of this permit.
This permit shall apply to the location shown on the application only. If the well is to be relocated, the permittee shall apply for a new well construction/pump installation permit m accordance with §13-168-12(f), HAR.

Thank you for the opportunity to review and comment on the well and pump application for the proposed installation of the Waiale No.1 Well and associated pump, which was received by our staff on November 13, 2006. OUf review is based on reports, maps, and aerial photographs maintained at the State Historic Preservation Division (SHPD); no field inspection was conducted on the subject property
Based on the submitted documents. the subject action for the proposed undertaking consists of the construction of a well and the installation of an associated pump.
A search of our records indicates that an archaeological survey has not been conducted of the subject parcel. There has been on-going archaeological mitigation in the area. The subject parcel is located within Pu 'u One (sand dune complex) dunes that are known to contain isolated and clustered preContact traditional Ha\\oaiian human burials. There are documented historic archaeological sites on the immediately adjacent parcels that consist of human burials, associated grave goods, artifacts, pre· and post-Contact cuitural remains, and manuports (basalt stones etc.).
Based on the compiled infonnation, we believe it is possible historic archaeological sites and/or previously disturbed archaeological sites may be present in the subsurface deposits of the subject property. Ground altering work associated with the proposed installation may have an affect on any histOrIC properties which are present in the subsurface deposit. We believe any effect may be mitigated through a program of precautiolla.-y archaeological monitoring. Therefore, we recommend the following conditlOll be attached to the subject permit, should it be approved:

We received your Well Completion Report Part I for the Waiale Well 1 (Well No. 5129-04) on November 5, 2007 and accept it as complete.
This completes your obligation under the well construction permit. A certificate of well construction completion will be issued to the well operator/landowner and you will receive a copy. This certificate transfers responsibility of specific aspects of well usage and maintenance from you to the well operator/landowner.
However, the pump test did not collect chloride samples as required. This can be remedied at pump installation. A proper chloride sample must be drawn at the end of 48-hours pumping at the intended use rate of 500 gpm, with results submitted with the well completion report, part 2. That well completion report cannot be accepted and a certificate of completion for pump installation work cannot be issued, nor may water be used from the well for the intended purposes until this requirement is met.

We are pleased to inform you that the Well Construction work permitted for the Waiale Well 1 (Well No. 5129-04) is complete and acceptable.
To protect Hawaii's natural ground water resources for the benefit of all, the following requirements apply to the use of your well:
1. Before this well can be pumped on a regular basis, a certificate of pump installation completion must be obtained.
2. If the well is not in use it must be properly capped.
3. If the well is to be abandoned then the landowner must cause a licensed contractor to apply for a well abandonment permit in accordance with § 13-168-12(f) prior to any well sealing or plugging work.
4. In the event that the well operator and/or landowner changes, the Commission shall be notified of the change prior to the change, and all forms shall be transferred to the new owner.
5. In the event the benchmark in the concrete base of the well is altered in any way, an updated elevation survey (page 5 of the Well Completion Report Part I) shall be submitted to the CommIssion. The Well Completion Report Part I can be obtained by contacting staff or at www.hawaii.gov/dlnr/cwrm/forms.htm
Because groundwater in Hawaii is a public trust, and adverse effects at one well may affect other water resources, any violation of the above conditions, or any other provision of the Hawaii Administrative Rules, may be subject to fines of up to $5,000/da),. We received your Well Completion Report Part I for the Waiale Well 1 (Well No. 5129-04) on November 5, 2007 and accept it as complete.
This completes your obligation under the well construction permit. A certificate of well construction completion will be issued to the well operator/landowner and you will receive a copy. This certificate transfers responsibility of specific aspects of well usage and maintenance from you to the well operator/landowner.
However, the pump test did not collect chloride samples as required. This can be remedied at pump installation. A proper chloride sample must be drawn at the end of 48-hours pumping at the intended use rate of 500 gpm, with results submitted with the well completion report, part 2. That well completion report cannot be accepted and a certificate of completion for pump installation work cannot be issued, nor may water be used from the well for the intended purposes until this requirement is met.

1. Regarding ~-thickness exceedence
Allowing for a potential1-ft tidal fluctuation, the resulting increase it total aquifer thickness would place the well depth of 21 0.97 ft within the If4-thickness of the basal lens. Therefore, no variance is required.
2. Missing chloride data
A chloride sample is still required to determine if long-term pumping of the well at 500gpm will result in up-coning of sea water. The following are recommended as an alternative to conducting a second pump test:
a) If the well will be pumped constantly as part of normal operations: Collect a chloride sample after 48-hr of constant pumping at 500gpm ;
OR
b) If the well will not be pumped constantly: Collect a chloride sample after a CWRM-specified number of hours/days have elapsed, during which time the well is operated under normal pumping rates and durations. The duration of operation prior to collecting a sample will be determined by CWRM based on normal operation pumping rates and durations provided by the well owner/operator.

1. Regarding Y4-thickness exceedence
Allowing for a potential1-ft tidal fluctuation, the resulting increase it total aquifer thickness would place the well depth of210.97 ft within the l/4-thickness of the basal lens. Therefore, no variance is required.
2. Missing chloride data
A chloride sample is still required to determine if long-term pumping of the well at 500gpm will result in up-coning of sea water. The following are recommended as an alternative to conducting a second pump test:
a) Ifthe well will be pumped constantly as part of normal operations: Collect a chloride sample after 48-hr of constant pumping at 500gpm ;
OR
b) If the well will not be pumped constantly: Collect a chloride sample after a CWRM-specified number of hours/days have elapsed, during which time the well is operated under normal pumping rates and durations. The duration of operation prior to collecting a sample will be determined by CWRM based on normal operation pumping rates and durations provided by the well owner/operator.

Thank you for the opportunity to review and comment on the well and pump application for the proposed installation of the Waiale No.1 Well and associated pump, which was received by our staff on November 13, 2006. Our review is based on reports, maps, and aerial photographs maintained at the State Historic Preservation Division (SHPD); no field inspection was conducted on the subject property.
Based on the submitted documents, the subject action for the proposed undertaking consists of the construction of a well and the installation of an associated pump.
A search of our records indicates that an archaeological survey has not been conducted of the subject parcel. There has been on-going archaeological mitigation in the area. The subject parcel is located within Pu 'u One (sand dune complex) dunes that are known to contain isolated and clustered preContact traditional Hawaiian human burials. There are documented historic archaeological sites on the immediately adjacent parcels that consist of human burials, associated grave goods, artifacts, preand post-Contact cultural remains, and manuports (basalt stones etc.).
Based on the compiled information, we believe it is possible historic archaeological sites and/or previously disturbed archaeological sites may be present in the subsurface deposits of the subject property. Ground altering work associated with the proposed installation may have an affect on any historic properties which are present in the subsurface deposit. We believe any effect may be mitigated through a program of precautionary archaeological monitoring. Therefore, we recommend the following condition be attached to the subject permit, should it be approved:

1) A qualified archaeological monitor (or monitors) shall be present during all ground-altering activities conducted in the project area in order to document any historic properties which may be encountered during the proposed undertaking and to provide mitigation measures as necessary. An archaeological monitoring plan will need to be submitted to the SHPD for review and acceptance, prior to the commencement of any ground-altering activities. An archaeological monitoring plan must contain the following nine specifications: (1) The kinds of remains that are anticipated and where in the construction area the remains are likely to be found; (2) How the remains and deposits will be documented; (3) How the expected types of remains will be treated; (4) The archaeologist(s) conducting the monitoring has (have) the authority to halt the construction in the immediate area of the find in order to carry out the plan; (5) A coordination meeting between the archaeologist and construction crew is scheduled, so that the construction team is aware of the plan; (6) What laboratory work will be done on remains that are collected; (7) A schedule of report preparation; (8) Details concerning the archiving of any collections that are made; and (9) An acceptable report documenting the findings of the monitoring activities shall be submitted to the SHPD for review upon 180 days following the completion of the proposed undertaking.

No withdrawal of water shall be made other than for testing until a Certificate of Pump Installation Completion has been issued by the Commission.
This permit shall be prominently displayed, or made available, at the site of construction work until work is completed.
The pump installation permit shall be for installation of a 550 gpm rated capacity, or less, pump in the well. This permanent capacity may be reduced in the event that the pump test data does not support the capacity.
A water-level measurement access shall be permanently installed, in a manner acceptable to the Chairperson, to accurately record water levels.
The permittee shall install an approved meter or other appropriate means for measuring and reporting withdrawals and appropriate devices or means for measuring chlorides and temperature at the well head.
Well Completion Report Part II shall be submitted to the Chairperson within 60 days after completion of work. This form can be obtained by contacting staff or on the internet at www.hawaii.gov/dlnr/cwrm.
The permittee, well operator, and/or well owner shall comply with all applicable laws, rules, and ordinances, and non-compliance may be grounds for revocation of this permit.
The pump installation permit application and any related staff submittal approved by the Commission are incorporated into this permit by reference. This permit is also subject to the HWCPIS. If the HWCPIS are not followed and as a consequence water is wasted or contaminated, a lien on the property may result. In basal ground water, the depth ofthe well may not exceed one-fourth (1/4) of the theoretical thickness (41 times initial head) of the basal ground water unless otherwise authorized by the Chairperson.
The permittee shall incorporate mitigation measures to prevent construction debris from entering the aquatic environment to schedule work to avoid periods of high rainfall, and to revegetate any cleared areas as soon as possible.
In the event that historically significant remains such as artifacts, burials or concentrations of shells or charcoal are encountered during construction, the permittee shall stop work and immediately contact the Department of Land and Natural Resources' Division of Historic Preservation.
The proposed well construction shall not adversely affect existing or future legal uses of water in the area, including any surface water or established instream flow standards. This permit or the authorization to construct the well shall not constitute a determination of correlative water rights.

Thank you for the opportunity to comment on this well construction/pump installation permit application.
Aquifer Status and Proposed Amount of Withdrawal The proposed well would withdraw 0.350 MGD for municipal use from the Kahului aquifer. Only 33 of 147 wells in Kahului aquifer have reported withdrawals in the Commission on Water Resources Management (CWRM) database. The proposed well would not have an immediate effect on existing DWS wells, but it could have an impact on the overall aquifer, especially if sugar cane irrigation should cease over the Kahului aquifer.
Ground Water Protection We have concerns about the potable water quality of wells within Kahului aquifer. The drilling site is not optimal for a potable source due to current and historic potential contaminant sources. The Department and the applicant have discussed dedication to the County of this well. We have proposed to the applicant to consider and discuss alternative sites which may experience lower risk of contamination. We request that CWRM not issue the subject permits until the Department and the applicant had the opportunity to discuss alternative well sites.
In order to protect ground water resources, we encourage the applicant to adopt Best Management Practices (BMPs) designed to prevent contamination through and to the proposed well. Sample BMPs

Inspect exposed parts of the well periodically for problems such as: cracked or corroded well casing, broken or missing well cap, damage to protective casing, settling and cracking of surface seals 2. Slope the area around the well so that surface runoff drains away from the well 3. Provide a well cap or sanitary seal to prevent unauthorized use of or entry into the well 4. Provide for sediment removal or well cleaning as necessary 5. Have the well tested once a year for fecal coliform or other constituents that may of concern 6. Keep accurate records of any well maintenance, such as disinfection or sediment removal, that might require use of chemicals in the well. 7 . Avoid mixing or using pesticides, fertilizers, herbicides, degreasers, fuels, or other pollutants near the well 8. Do not locate any type of potentially polluting activity up slope from the well

3. This permit shall be prominently displayed, or made available, at the site of construction work until work is completed.
4. The pump installation permit shall be for installation of a 550 gpm rated capacity, or less, pump in the well. This permanent capacity may be reduced in the event that the pump test data does not support the capacity.
5. A water-level measurement access shall be permanently installed, in a manner acceptable to the Chairperson, to accurately record water levels.
6. The permittee shall install an approved meter or other appropriate means for measuring and reporting withdrawals and appropriate devices or means for measuring chlorides and temperature at the well head.
7. Well Completion Report Part II shall be submitted to the Chairperson within 60 days after completion of work. This form can be obtained by contacting staff or on the internet at www.hawaii.gov/dlnr/cwrm.
8. The permittee, well operator, and/or well owner shall comply with all applicable laws, rules, and ordinances, and non-compliance may be grounds for revocation ofthis permit.
9. The pump installation permit application and any related staff submittal approved by the Commission are incorporated into this permit by reference. This permit is also subject to the HWCPIS. If the HWCPIS are not followed and as a consequence water is wasted or contaminated, a lien on the property may result. Any variances from the HWCPIS shall be approved by the Chairperson prior to invoking the variance.
10. The work proposed in the pump installation permit application shall be completed within two (2) years from the date of permit approval, unless otherwise specified. The permit may be extended by the Chairperson upon a showing of good cause and goodfaith performance. A request to extend the permit shall be submitted to the Chairperson no later than the date the permit expires.
II. The permittee, its successors, and assigns shall indemnify, defend, and hold the State of Hawaii harmless from and against any loss, liability, claim, or demand for property damage, personal injury, or death arising out of any act or omission of the applicant, assigns, officers, employees, contractors, and agents under this permit or relating to or connected with the granting ofthis permit.

This well qualifies as a source which will serve as a source of potable water to a public water system (defined as serving 25 or more people at least 60 days per year or has 15 or more service connections) and must receive Director of Health approval prior to its use to comply with Hawaii Administrative Rules (HAR), Title II, Chapter 20, Rules Relating to Potable Water Systems, §11-20-29.
This well does not qualifY as a source serving a public water system (serves less than 25 people or more people at least 60 days per year or 15 service connections) and if the well water is used for drinking, the private owner should test for bacteriological and chemical presence before initiating such use and routinely monitor the water quality thereafter. However, if future planned use from this source increases to meet the public water system definition then Director of Health approval is required prior to implementation.
If the well is used to supply both potable and non-potable purposes in a single system, the user shall eliminate cross-connections and backflow connections by physically separating potable and non-potable systems by an air gap or an approved backflow preventer, and by clearly labeling all nonpotable spigots with warning signs to prevent inadvertent consumption of non-potable water. Backflow prevention devices should be routinely inspected and tested.
It does not appear that this well will be used for consumptive purposes and is not subject to Safe Drinking Water Regulations.
For the applicant's information, a source of possible wastewater contamination I lis [ I is not located near the proposed well site (information attached).

We acknowledge receipt, on November 1,2006, of your completed Well ConstructionlPump Installation permit application and filing fee for the Waiale No.1 Well (Well No. 5129-04). You can expect your application to be processed within ninety (90) days from this date.
For your information, the attached table describes the process, responsible parties, and deadline requirements for driIling or modifying a well and installing, modifying, or replacing a pump.
By this acceptance letter, we are also notifying the well operator/landowner that water may not be pumped for purposes other than testing until the certificate of well construction/pump installation completion letter is issued to the well operator and landowner. Additionally, the permitted pump capacity described on the pump installation permit may be reduced in the event that the pump test does not support the capacity. No certificate of pump installation wiIl be issued until the Commission has determined that the pump capacity will not have adverse effects on the aquifer, other nearby wells, or streams. In other words, you may need to remove the pump and install a smaller pump at the Commission's discretion before you can withdraw water for purposes other than testing.

This well qualifies as a source which will serve as a source of potable water to a public water system (defined as serving 25 or more people at least 60 days per year or has 15 or more service connections) and must receive Director of Health approval prior to its use to comply with Hawaii Administrative Rules (HAR), Title II, Chapter 20, Rules Relating to Potable Water Systems, §11-20-29.
This well does not qualify as a source serving a public water system (serves less than 25 people or more people at least 60 days per year or 15 service connections) and if the well water is used for drinking, the private owner should test for bacteriological and chemical presence before initiating such use and routinely monitor the water quality thereafter. However, if future planned use from this source increases to meet the public water system definition then Director of Health approval is required prior to implementation.
If the well is used to supply both potable and non-potable purposes in a single system, the user shall eliminate cross-connections and backflow connections by physically separating potable and non-potable systems by an air gap or an approved backflow preventer, and by clearly labeling all nonpotable spigots with warning signs to prevent inadvertent consumption of non-potable water. Backflow prevention devices should be routinely inspected and tested.
It does not appear that this well will be used for consumptive purposes and is not subject to Safe Drinking Water Regolations.
For the applicant's information, a source of possible wastewater contamination I lis II is not located near the proposed well site (information attached).
An NPDES permit is required.
Other relevant DOH rules/regulations, information, or recommendations are attached.
In the event that the location of the well changes but is still within the parcel described on this application, our division considers the comments to still be applicable, and we do not need to review the new location.
